Quotationer must have valid GST registration certificate, PAN issued by the concerned authority

and should have completed successfully atleast one similar nature of work of value not less than 35%

of estimated cost of work during the preceding four (04) Financial Years including the current year,

Upto the date of submission of quotation. Self attested photocopies of all the documents should

invariably be enclosed with the quotation documents.

The quotationer’s must quote their rates in figures and words in the attached “Schedule of

Quantity” itself. In case the rates quoted in figures and words differ, the rates written in words shall be

considered.

Quotations not accompanied with required documents & EMD in the requisite form shall

summarily be rejected.

EXECUTIVE ENGINEER

TERMS & CONDITIONS

1. The works shall be carried out as per the applicable CPWD specifications for Civil Works/BIS specifications with

latest amendments & as per the instructions of the Engineer-in-Charge at site of work. 2. The security deposit shall be deducted @ 10% of the gross amount of bill, which will be released after

satisfactorily completion of defect liability period of 06 months (12 months in case of road work) 3. Income tax/labour cess or any other tax as levied upon shall be deducted as per prevailing rules of the

Central/State Govt. 4. No T&P shall be supplied by the Corporation. Contractor shall have to make his own arrangements for all tools &

plant. 5. The rates quoted by the party should be inclusive of all taxes & cess such as labour cess, GST etc. as

promulgated by the Central/State Govts. From time to time & nothing shall be paid extra on this account. 6. The Contractor/Party may actually visit the site of work & study the site conditions of work before quoting their

rates. 7. The Electricity for testing purposes will be given by the CWC free of cost and for other purposes CWC may allow

electric power, if available, on actual electric energy consumption by putting separate electric energy meter with

due permission of Site Engineer. 8. The contractor will have to make his own arrangements for obtaining water to be used for execution of the works

or CWC may supply water if available, for execution of work against which water charges @ 1% shall be

recovered on gross amount of the work done. However, CWC may allow labourers to use the drinking water

facility of the Warehouse, if available/necessary. 9. No material will be issued to the Contractor/Party by the department. 10. Time allowed for completion of work shall be strictly adhered to by the parties. 11. The Contractor/Party shall be responsible for safety of workmen during execution of work. No claim in case of

accident, mis-happening shall be entertained by CWC. 12. The materials/equipments/accessories required for Civil works shall be arranged by the Party/Contractor as per

approved makes as appended in Annexure-I enclosed. The contractor however, shall seek approval of specific

make from the Engineer-in-charge before commencing the work. The decision of Engineer-in-Charge shall be

final and binding on the contractor in this respect. 13. The dismantled materials to be obtained, which are property of CWC, shall have to be kept safe and properly

stacked by the contractor for proper accounting for disposal/credit. 14. Contractor/Party shall abide by the provisions of labour (Regulation & Abolition) Act, ESI and EPF etc. as the

case may be. 15. The payments for Running bills/Final bill or release of security deposit shall be made by EE, CWC, RO, Lucknow. 16. The bills/Vouchers towards purchase of Cement/steel/sleeper/bitumen etc. shall have to be produced by the

contractor alongwith Manufacture Test Certificates. 17. The contractor shall not be entitled for any compensation for any losses suffered by hindrances, cause of delay in

commencing or executing the work whatsoever the cause of such delay may be including delay in procuring of

Govt. controlled or other materials 18. The contractor shall have to hand over the premises in neat and clean condition and will remove all debris/rebish

other material at his own cost. 19. The Engineer-in-Charge at his discretion can remove any person of the Contractor from the site if found

incompetent or indulges in misconduct. 20. The Contractor shall make his own arrangement for Security/Watch & Ward of work and material at his cost &

responsibility. 21. The contractor shall give an undertaking regarding blacklisting/debarring of them as per Annexure-II

enclosed. 22. Conditional quotations in any form shall not be accepted. 23. Corporation reserves the right to accept or reject any or all the quotations without assigning any reason thereof.

SPECIAL CONDITONS

1. During the execution of works at site, some restrictions may be imposed by Engineer-in-Charge/

Warehouse Manager on account of safety and security etc. The contractor shall be bound to follow all

such restrictions/ instructions & nothing extra shall be payable on this account.

2. No compensation shall be payable to the contractor for any damage caused by rains, lightening,

windstorm, floods, earthquakes or other natural calamities during the execution of work. He shall make

good all such damages at his own cost and no claim on this account will be entertained.

3. If the Contractor/Supplier fails to start the work within the stipulated time period as specified in the NIQ

documents, the CWC shall have the right to cancel the work order, forfeit the earnest money deposited

by the Contractor/ Supplier and to debar the Contractor/supplier for a period of three (03) years for

participation in CWC’s quotation /tender inquiries

4. The works have to be carried out in neat and tidy manner to the satisfaction of the Engineer-in-Charge

and all care has to be taken to ensure that no part of the building gets damaged during execution of

works. Materials used for carrying out the work shall be of standard quality.

5. The payments shall be released after execution of the works to the satisfaction of the Engineer-in-Charge

& against the bills submitted by the Party/Contractor.

commencing the work. The decision of Engineer in-charge shall be final and binding on the

Items that are not covered in the above list and are required for execution shall be procured with the

approval of Engineer In-charge. The decision of Engineer In-charge shall be final and binding on the

contractor in this respect.
