Earl Grey Pass TrailTe Kaslo and District Com-
munity Forest Society sponsoreda grant application to Canada150 (to celebrate Canada’s 150thbirthday in 2017) to get fundingo help refurbish the Earl Grey
Pass Trail. Te grant applica-ion was successful in garnering
$40,000 from Canada 150. Tis
will be matched by partners suchas Area D RDCK ($10,000), BCParks ($10,000) and Colum-bia Basin Trust ($20,000) tootal $80,000. Tis money will
go towards making the currentcable cars easy to use, for workon the campsites on the trail,and for trail work where and as necessary.
“Te Earl Grey Pass is historically signicant, dat-ng back to the early 1800s when Kinbasket, a Shuswap
First Nations Chief, led his band over this pass to Inver-mere. Te trail was an important supply and access routebetween the East and West Kootenays through the 1800snto the early 1900s. In 1908, the Fourth Earl Grey, then
Governor-General of Canada, travelled the trail from easto west and the trail was subsequently named in his hon-
our.” (Source, Hiking the West Kootenay, John Carter 1993)
Te trail is approximately 61 kilometres long and is
usua y ac -pac e over t ecourse of several days. A cabinwas constructed near the start othe east side of the trail for EarlGrey’s trip back in 1908. Tecabin needs extensive repairsand may be considered as a sep-arate project. As one nears thetrail end on the west side, there isanother cabin – the McLaughlinCabin – that dates back to 1906.
It was built to service old mineworkings in that area. Te trailhas changed dramatically sinceits early days as natural phe-nomena inuence the route.Tetrail had signicant work under-taken on it in the mid 1960s andit was offi cially re-opened in
1967 for Canada’s Centennial. Since then there has beenadditional work done, but recent blowdown events andthe ushing of Hamill Creek have caused issues with the
trail. It is hoped that this funding will help bring back thetrail to a reasonable level for hiking. Te Earl Grey TrailRestoration Committee members are Carolyn Schramm,John Cathro, Chris Webster, Kaslo and District Commu-nity Forest, Rob MacDonald, Hugh Ackroyd and TomRoos, BC Parks, Bill Bryce, Friends of West Kootenay Parks and Joe Johnston.

It’s bad enough if you’re charged withand convicted of a crime, like assault – youmay be looking at some serious jail time.But that’s not all of it. Your victim can alsosue you in civil court, where you’ll facean uphill battle. And if they’re seriouslyinjured, that crime can cost you plenty ofmoney, too.
A recent case off ers a good example of
this.
Mark (all names changed) rented ahouse on Chuck’s blueberry farm and hadlived there with his common-law wife andyoung family for four years. Bad blood haddeveloped between him and his landlordChuck in the last couple of years, though.
Chuck and his family lived in anotherhouse on the farm. One evening, whiledrunk, Chuck called Mark and threatened
to hurt or kill him. He then drove to Mark’srental house, taking a one-metre longmetal bar along. When he arrived at Mark’shouse, he struck and broke one of thewindows with that bar, ripping the curtain.He then parked his truck a bit further awayand came back to the rented house, metalbar in hand.
Mark, watching TV with his family atthe time, came out of the house to protecthis family. He was unarmed. Chuck struck
him on the head with the metal bar – ithad about six inches of fresh blood on itaferwards.
Mark fell to the ground, but was able toget up and pin Chuck down. Te policewere called and took Chuck away. Chuckwas criminally charged with making death
threats, assault with a weapon and assaultcausing bodily harm. He was prosecutedand convicted, and faced a long jailsentence.
Mark led a civil lawsuit and sued Chuckfor monetary compensation. Te court inthe criminal trial (which requires a higherstandard of proof than what is requiredin a civil lawsuit) had accepted Mark’s
version of events. Te civil court adoptedthose conclusions in Mark’s lawsuit. Afera conviction in a criminal trial, you canonly re-argue the same issues again in acivil lawsuit in very limited circumstances.And the civil court decided that thoselimited circumstances didn’t apply here. Inany event, it also believed Mark’s versionof what had happened. It decided the civillawsuit in Mark’s favour and said Chuckwas far and away the most to blame for
Mark’s injuries.Due to the blow to his head, Mark
suff ered hearing problems, balanceproblems, fatigue and other serioushealth problems. His ability to hold apermanent job was gone, probably forever.Admittedly, Mark had a pretty checkeredpast, some criminal convictions, a veryspotty work history and little education(he never nished Grades 10 or 11, havingdropped out of both).
But factoring everything in, the civilcourt ordered Chuck to pay Mark moneycompensation for Mark’s non-pecuniarydamages (“pain and suff ering”), loss ofearning capacity going forward, futurecare costs and more, totalling roughly$300,000.

RedFish FestivalTe Kokanee return – and so does the RedFish Festival!
Tere’s more to celebrating the kokanee’s return than agood party at the Kokanee Creek Visitors Centre on Sun-day, August 30.
“Tere are an amazing number of people who take thespawning channel tours during the Redsh Festival,” saysthe centre’s naturalist, Joanne Siderius. Siderius and herteam will give channel walks three times an hour fromnoon until 6 pm during the festival.
“Come out and learn how and why the sh return andtheir importance to the Kokanee Creek ecosystem”, saysSiderius. “We are always impressed with the number offamilies who want to learn more about conservation andthe redsh,” she says. “Understanding the kokanee lifecycle is key to understanding Kokanee Creek and main-taining it as a healthy ecosystem.”
Te tours are only one part of the free festival, now in itsfourth year, presented by the West Kootenay EcoSociety.Music from the Bessie Wapp Quartet and All Canadian BackBacon and interactive dance from Slava Doval highlight the
celebration. But there is more – food and snacks from local vendors, art displays and lots of activities for the kids!
“Te Discovery Room is packed the whole time withkids, sparkly red sh, and tons of fun,” Siderius says.“Tere’s a real buzz on.Te sh may have more importantthings on their minds, but we have a great time and thekids learn a lot about a natural cycle that is the spark oflife in the park. announce the passing of Scott
Blunderfield “ Blundy” on
July 14, 2015 in Vancouver.
Scott was born in Edmon-
ton June 9, 1951, to Don and
Marion Blunderfield. He was
the eldest of three boys.
He grew up in Calgary,
married his first wife Else and they had a son Jesse together.
In his mid twenties he moved to the farming community of
Rimbey, Alberta. There he was joined by Faye, his second
wife and her two young children. This is where he was
bitten by “the back to the land movement”. After surviving
harsh winters it was decided to move to a better climate.
In the ’70s the young family settled on a small acreage in
Appledale, known affectionately as “Blundy’s Farm”.
Scott was hired on at the pulp mill in Castlegar in 1980 and
worked there until his retirement. In the latter part of his
life he moved to Slocan City. He truly enjoyed living in this
small community, with his beloved little dogs. He got so
much enjoyment having the Slocan Lake just outside his
door, taking family and friends out on his fishing boat.
Scott was predeceased by his father Don. He is survived
by his mother Marion, his brother Dr. Mark Blunderfield,
sister-in-law Jean, brother Dean Jarvey, sister-in-law Marya
and their families. His children Jesse (JT) Blunderfield,
Lonny Blunderfield (Katie), Nicole Gale (Shawn), and Jesse
Stitt. Grandchildren Avery Olsen, Lily Gale, Seth Stitt, Oak-
lyn, Emmett, and Beckham Blunderfield. He is also survived
by 16 nieces and nephews.
A memorial service will be held in Slocan City at
2pm, Saturday August 29th at the Legion Hall.
