CAP. I ASPECTE GENERALE Chapter I – General Aspects

Art.1. Carta stabile te cadrul de organizare, principiile de func"ionare i conducere, precum i direc"iile de dezvoltare ale Universitatii “LUMINA” din Bucure ti. Asumându- i responsabilit!"ile i r!spunderile ce decurg din aplicarea prevederilor Legii înv!"!mântului nr. 84/1995, cu modific!rile i complet!rile ulterioare i ale Legii nr. 128/1997 privind Statutul personalului didactic, cu privire la libertatea i autonomia academic!. Carta este conceput! ca un document-cadru de sus"inere i promovare a propriilor norme, valori i standarde academice. Rolul ei este de a clarifica principiile fundamentale ce orienteaz! activitatea Universit!"ii “LUMINA” din Bucure ti, precum i modalit!"ile practice de urm!rire a obiectivelor propuse prin misiune.

Art.1 The charter establishes the organizational frame, the functioning and leading principles as well as the development directions of the “LUMINA” University. Assuming the responsibilities which result from bringing the Law of Education and that of the Teaching Staff Status into operation, regarding the liberty and the academic autonomy, the Charter is designed as a guiding document for sustaining/supporting and promoting our own rules and values and academic standards. Its role is to clarify the fundamental principles that guide the activity of the “LUMINA” University as well as the actual means of fulfilling the objectives settled by this mission.

Art. 2. Universitatea “LUMINA” din Bucure ti este o institu"ie de înv!"!mânt superior i cercetare, de drept privat, cu personalitate juridic!. Acest statut al institu"iei implic! asumarea unor obliga"ii i responsabilit!"i concordante cu valorile i criteriile de eficien"! specifice func"ion!rii sale.

a. Oferirea unor oportunit!"i egale de înv!"are tuturor studen"ilor, prin raportare doar la motiva"iile i abilit!"ile lor i nu la considerente ce "in de bun!starea material!, ras!, religie sau specific cultural;

alin. b) sensibilitate crescut! fa"! de condi"iile sociale i economice române ti i europene i fa"! de interesele studen"ilor/absolven"ilor de a dobândi acele competen"e care s!-i fac! ap"i s! urmeze cariere competitive i s!- i îmbun!t!"easc! statusul social i economic;

alin. c) promovarea i dezvoltarea valorilor ce se refer! la calitate, încredere, responsabilitate i r!spundere fa"! de cet!"eni i fa"! de beneficiarii imedia"i: studen"ii.

Art.2 The “LUMINA” University is an educational institution of higher education and research of private law and with legal person. This status of the institution implies assuming certain obligations and responsibilities according to the values and to the efficiency criteria specific to its functioning.

a. to offer all students equal opportunities of studying according only to their motivation and abilities and not to reasons regarding their material welfare.

b. highly increased sensibility towards the social and economic conditions in Romania and in Europe and towards the students/graduated people’s interest in attaining those abilities which can help them embrace competitive careers, improve their social and economic status.

c. to promote and develop the values regarding quality, confidence, responsibility towards the citizens and the very close beneficiaries: the students.

Art. 3. Universitatea “LUMINA” din Bucure ti func"ioneaz! pe baza autonomiei universitare, în"eleas! ca modalitate specific! de autoconducere i de exercitare a libert!"ilor academice în cadrul stabilit de Constitu"ia României, Legea înv!"!mântului nr. 84/1995, cu modific!rile i complet!rile ulterioare, alte reglement!ri cu caracter legal, precum i de propriile regulamente.

Art.3 LU functions on the basis of the university autonomy seen as a specific way of leading/managing and exerting an academic freedom within the limits established by the Romanian Constitution, the Education Law or other rules and regulations and the university's own rules and regulations.

Art. 4. Autonomia universitar! se realizeaz! prin: Art. 4 The university autonomy is achieved by :

elaborarea de reglement!ri proprii cu privire la organizarea i desf! urarea activit!"ilor didactice, de cercetare tiin"ific! i administrativ!;

Developing their own regulations regarding the organization and conduct of teaching, scientific research and management;

elaborarea planurilor de înv!"!mânt i a programelor analitice în acord cu strategiile, standardele i indicatorii de performan"! competitivi pe plan na"ional i interna"ional, organizarea admiterii candida"ilor la studii, stabilirea criteriilor i a metodologiilor de evaluare a cuno tin"elor dobândite i de desf! urare a examenelor de licen"! i diserta"ie;

Drawing up plans for educational and analytical programs in line with strategies, standards and performance indicators competitive national and international, for organizing entrance exams for the candidates ,for establishing criteria and methodologies for evaluating the knowledge acquired and conduct in the examinations and licensing dissertation

Selecting and promoting teaching staff, administrative staff, research, technical and administrative and other categories of staff

Ensure human and financial resources in relation to the need of carrying out the tasks arising from the curricula, plans for education and scientific research

gestionarea eficient! a resurselor financiare i materiale, identificarea i atragerea de surse suplimentare de venituri;

Effective management of financial resources and materials, identifying and attracting additional sources of revenue

organizarea serviciilor administrativ-gospod!re ti i auditarea activit!"ii acestora potrivit legii;

Administrative service organization and auditing their activities according to law

acordarea unor burse de studii; Granting of scholarships

organizarea de activit!"i i manifest!ri tiin"ifice, culturale i sportive;

Organizing activities and scientific, cultural and sports events

stabilirea i folosirea însemnelor proprii; Establishing and using their own marks

asigurarea ordinii i disciplinei în spa"iul universitar; Ensuring order and discipline in the university

Art. 5. Identitatea Universitatii “LUMINA” din Bucure ti este circumscris! prin urm!toarele caracteristici: i) Denumire: Universitatea “LUMINA” din Bucure ti. ii) Sigla, insigna i medalia aniversar!, stabilite de Senat. iii) Sediul Rectoratului: str. Gara C!"elu, nr. 1R, sector 3.

Art.5 The identity of the LU is given by the following characteristics: I)Name “The LUMINA UNIVERSITY”- BUCHAREST (LU) ii)The Sigle, the badge and the anniversary medal established by the Senate iii)The Rectorship headquarters: str. Gara Catelu nr.1R, sect.3

Universitatea “LUMINA” din Bucure ti se înfiin"eaz! ca institu"ie de înv!"!mânt superior privat, cu personalitate juridic!, în temeiul …………………, fiind unul din domeniile de activitate ale Funda"ei “LUMINA INSTITU#II DE ÎNV$#$MÂNT”...., sentin"! civil! nr……/din………….., înregistrat! în registrul funda"iilor.

Art.6 The LU was founded as an institution of private higher education with juridical person, on the grounds of ............. as one of the domains of activity of the Foundation “LUMINA” Educational Institutions ............... by civil decision no............../from..............,registered in the foundation register.

Art. 7. Universitatea “LUMINA” din Bucure ti este o comunitate academic! ce î i desf! oar! activitatea într-un spa"iu propriu, pe baza unui buget format din resursele financiare private alocate de catre Funda"ia “LUMINA INSTITU#II DE ÎNV$#$MÂNT” i din resurse proprii, care func"ioneaz! în conformitate cu prevederile art. 32, alin. 6 din Constitu"ia României, potrivit c!rora „Autonomia universitar! este garantat!”, cu dispozi"iile Legii nr. 84/1995 – Legea înv!"!mântului nr. 84/1995, cu modific!rile i complet!rile ulterioare i ale Legii nr. 128/1997 privind Statutul personalului didactic, cu normele juridice prev!zute de Ordonan"a de Urgen"! a Guvernului nr. 75/2005 privind asigurarea calit!"ii educa"iei, aprobat! prin Legea nr. 87/2006 , în temeiul Legii nr. 88/1993 privind acreditarea institu"iilor de înv!"!mânt superior i recunoa terea diplomelor, revizuit! i completat! prin Legea 144/1999, precum i cu principiile specifice Declara"iei de la Bologna privind constituirea “spa"iului european al înv!"!mântului superior”.

Art.7 The LU is an academic community that carries out its activity in its own location, based on a budget made up of private financial resources allotted by the “Lumina Educational Institutions” Foundation and of its own resources and which functions according to the Romanian laws and educational legislation, and that functions according to the stipulations of art. 32, para. 6 of the Romanian Constitution, under which “The university autonomy is guaranteed, by the law no. 84/1995 – the Law of Education no. 84/1995, with subsequent amendments and the Law. 128/1997 on the Status of teaching staff with legal regulations stipulated by The government emergency ordinance no. 75/2005 on the quality of education approved by Law no. 87/2006, under Law no. 88/1993 regarding the accreditation of institutions of higher education and the recognition of diplomas, revised and supplemented by Law 144/1999, as well as specific principles of the Bologna Declaration on the establishing the “European space of higher education”

Art. 8. Comunitatea academic! este alc!tuit! din personalul didactic, de cercetare/proiectare, consultan"! sau expertiz!, precum i din studen"ii integra"i în activitatea didactic! i de cercetare organizat! pe diferite forme de preg!tire i niveluri de înv!"!mânt. Pot face parte, de asemenea, din comunitatea academic! absolven"ii (alumnii), profesorii i cercet!torii care i i vor aduce contribu"ia la bunul mers al institu"iei, f!r! a avea îns! prerogative i competen"e

Art.8 The academic community is made up of the faculty members and staff, the research/designing, consultancy or expertise staff as well as the students who are involved in didactic and research activities organized in different forms and levels of studying. Future graduates, professors and researchers can belong to the academic community if they will contribute to the progress of their institution but without having decisional prerogatives and competences. Romanian and foreign cultural

decizionale. Sunt considerate ca apar"inând comunit!"ii academice i personalit!"ile culturale, tiin"ifice etc. din România sau din afara grani"elor ei, care de"in titluri tiin"ifice sau onorifice acordate de Universitatea “LUMINA” din Bucure ti.

personalities and scientists who possess scientific or honorific titles, awarded by the LU, are considered as belonging to the academic community.

Art. 9. Comunitatea academic! folose te în activitatea sa personal auxiliar i tehnic- administrativ.

Art.9 The academic community uses in its activity auxiliary and technical – administrative staff.

Art. 10. Regulamentele Universit!"ii sunt supuse aprob!rii Senatului si Consiliului de Administra"ie. Pe baza prevederilor prezentei Carte se elaboreaz! regulamente privind:

Art.10 The internal order regulations (ROI) are to be ratified/approved by the Senate and the Administration Board (to be verified!). On the ground of this Charter regulation we stipulate the following rules and regulations

: to organize and function the educational and research institutions (faculties, departments, sections, teaching boards, institutes, laboratories) as well as the auxiliary intuitions of support, technical, administrative and social (libraries, hostels, cafeterias, publishing house, printing house).

organizarea concursurilor de admitere a studen"ilor i stabilirea criteriilor de acordare a burselor de studiu i cercetare, precum i a altor stimulente financiare sau de alt! natur!;

to organize the entrance examination/tests for students, to establish the criteria of granting scholarships for studying, research or other financial stimuli, or of any other type.

selec"ia i promovarea personalului didactic, de cercetare i a celorlalte categorii de personal tehnic sau administrativ;

to select and promote the faculty members, research staff and the other categories of technical and administrative staff.

organizarea programelor de studii i elaborarea planurilor de înv!"!mânt i a programelor analitice, conform Programului Bologna;

to organize the curricula and to elaborate the studying plans and the analytical curricula.

organizarea i controlul activit!"ii financiar-administrative i a serviciilor economico-gospod!re ti.

to organize and control the financial – administrative activity and the economic and well – managing services.

Art. 11. Universitatea “LUMINA” din Bucure ti împ!rt! e te principiile stipulate în Magna Charta of European University (Bologna, 1988) i în Declara"ia de la Bologna (1999).

Art.11 The LU shares the principles stipulated by the Magna Charta of the European University (Bologna 1988) and by the Bologna Declaration (1999).

Art. 12. Principala misiune asumat! de Universitatea “LUMINA” din Bucure ti este de a forma i dezvolta competen"e profesionale în domeniul tiin"elor politice, administrative, sociale, culturale, economice i IT, contribuind astfel la transform!rile i dezvolt!rile na"ionale i interna"ionale din domeniile de referin"!, în spiritul valorilor i principiilor democratice, al deschiderii spre cooperarea european! i interna"ional!. Urmând aceast! misiune, institu"ia are drept obiective principale:

Art.12 The main mission assumed by the LU is to form and develop professional competences in the field of political, administrative and social science, culture, economy and IT science thus contributing to the national and international transformation and development within the reference domains according to the democratic values and principles, to the opening towards European and international co-operation. Following this purpose the institution has as its main objectives:

to form experts who have theoretic experience and practice abilities of organizing, managing and administrating a sector of activity (political, social or economic in the public or private field).

formarea unor speciali ti înalt profesionaliza"i, români, comunitari i extra-comunitari, în sfera guvern!rii i a managementului public, în domeniul rela"iilor interna"ionale în general i cele europene, în particular;

to form highly specialized experts, Romanian or inside/outside the European Union, in the sphere of governing or state/public management or that of international relations in general and within the European Union in particular.

formarea unor speciali ti înalt profesionaliza"i, români, comunitari i extra-comunitari, în sfera tiintelor IT, a celor sociale i culturale, precum i în domeniul tiin"elor economice;

to form highly specialized experts, Romanian, inside or outside the European Union in the fields of IT science and/or of social, cultural and economic science.

actualizarea permanent! a preg!tirii speciali tilor români, comunitari i extra-comunitari, prin oferirea unor programe de perfec"ionare i specializare în concordan"! cu dinamica cerin"elor pie"ei muncii;

to up-date permanently the Romanian, European (inside or outside the Union) experts granting perfecting programmes, improvement and specializing programmes according to the dynamic and needs of the labour market.

încurajarea spiritului gîndirii libere, al înnoirii cuno tin"elor i al ridic!rii calific!rilor prin promovarea programelor de educa"ie continu!, în special în domeniile cerute de reconversia profesional!;

to encourage free thinking, renewing one's knowledge, improving their qualification by promoting permanent education programmes, especially in the fields required by the professional reconversion as well as of those of distance learning.

to develop scientific research in political, administrative, economic science and in international relations, cultural and IT trough its own strength as well as collaborating with similar institutions in our country or abroad.

promovarea unor rela"ii de colaborare i parteneriat cu alte universit!"i cu profil similar, organisme i agen"ii guvernamentale, organiza"ii neguvernamentale, companii i cercuri de afaceri i orice alte grupuri sau entit!"i ale c!ror cerin"e sau necesit!"i intr! în sfera de interes i activitate a Universit!"ii “LUMINA” din Bucure ti; principiul ce fundamenteaz! acest obiectiv este acela al realiz!rii unei rela"ii de parteneriat, în contextul c!reia ambele p!r"i investesc i ob"in beneficii împreun!;

to promote collaboration – and partnership relations with other universities with a similar profile, organizations and governmental agencies, non-governmental organizations, companies, business circle or other groups and entities whose demands or needs are in the sphere interest and activity of the LU if the fundamental principle of this objective is that of realizing a partnership relation within which both parties invest and obtain benefits together.

to protect and develop the democratic environment founded on guaranteeing the fundamental rights and liberties of the citizen in a democratic state.

CAP. III PRINCIPIILE DE ORGANIZARE %I FUNC#IONARE III Principles of Organizing and Functioning

Art. 13. Universitatea “LUMINA” din Bucure ti este o comunitate academic! a c!rei principal! misiune este aceea de a produce, promova i transmite cuno tin"e prin activit!"ile didactice, de cercetare, dezbatere, documentare, publicare. Criteriile fundamentale ale apartenen"ei la comunitatea academic! sunt competen"a profesional!, validat! prin lucr!ri publicate i/sau experien"! practic! de prestigiu într-un domeniu de specialitate de interes pentru institu"ie, corectitudinea moral! i comportamental!. Admiterea în comunitatea academic! se face prin concurs pentru ocuparea posturilor didactice i de cercetare. Recrutarea

Art.14 The freedom of thinking, researching and expressing is a fundamental principle of the academic life. Following this principle implies intellectual and the moral independence of the members of the academic community towards political authority, groups of interest or economic power. Rejecting intolerance, opening to dialogue and embracing the democratic values of the state represent principles that substantiate the whole academic life of the community.

Art.15 The academic community of the LU is open to Romanian and foreign citizens, without any discrimination according to the conditions of the internal organization and complying with the demands of the professional and scientific competence.

Art. 16. Universitatea “LUMINA” din Bucure ti nu este organizat!, administrat! sau condus! în interesul nici unui partid sau grup!ri politice, economice, religioase sau de orice alt! natur!. Cercetarea i instruirea sunt libere de constrângeri sau condi"ion!ri politice. În activitatea de cercetare, dezbatere i predare, politica poate reprezenta doar un obiect de analiz! i reflec"ie, nu i o form! de ac"iune sau propagand!.

Art. 16. ULB is not organised, administrated or leaded by a political/religious party. Training and research are free from any political constraints.Politics can represent an object of study and reflections not a form of action of propanganda.

Art. 17. Spa"iul academic este inviolabil. El nu poate fi utilizat pentru activit!"i sau confrunt!ri ale partidelor politice sau ale altor grup!ri sau organiza"ii care promoveaz! interese, ideologii i ac"iuni politice. Senate Board or of the Senate.The public order bodies are not allowed to organize raids or any other routine operations without having the permission of the President of the LU, the Rector's or of the Senate Board or the Senate. Except cases of circumstances outside one's control, the free access of the academic community's members within the university area can not be interdicted, limited under any reason and under no circumstances. The right of going on strike can not be exercised by prohibiting and limiting the access of the academic community in the university area. The Senate and the Boards of the faculties can establish the limits of the access at night, or during school or legal holidays.

Art. 18. Membrii comunit!"ii academice pot constitui asocia"ii profesionale i uniuni ale cadrelor didactice, cercet!torilor, studen"ilor i personalului tehnic-administrativ în condi"iile în care scopul i regulamentele lor de func"ionare nu contravin prevederilor prezentei Carte.

Art.18 The members of the academic community can found associations and missions of the faculty members, researchers, students and of technical – administrative staff if their aim and regulations of functioning do not contravene the stipulations of the present Charter.

Art.20 The “Lumina University” has in its framework of organization faculties specializations, sections, departments, teaching departments, libraries, laboratories and research sections.

Art.22 According to the specific duration and purpose of the learning, specializing, researching or perfecting programs corresponding to the assumed mission, the “Lumina University” is organized in faculties, departments, sections, teaching departments, institutes, centers, libraries, laboratories and other specific units.

Art. 23. Fac parte integrant! din Universitatea “LUMINA” din Bucure ti serviciile tehnice i administrative, precum i alte unit!"i (experimentale, sociale, de agrement, etc.).

Art. 23 Technical and administrative services as well as other unities (experimental, social, entertainment, etc.) are an integral part of the “Lumina University”.

Art. 24. Facultatea reprezint! unitatea structural! de baz! a UL i are în componen"a sa una sau mai multe sec"ii de specialitate. Facultatea este organizat! pe departamente, catedre, unit!"i de cercetare, laboratoare, i orice alte structuri organizatorice de instruire i de cercetare ce ar putea sprijini desf! urarea optim! a activit!"ii. Facultatea se individualizeaz! prin: condi"ii de admitere, programe de studiu, domenii de specialitate. Activitatea didactic! în cadrul facult!"ii se desf! oar! pe ani de studii, serii de predare, grupe i subgrupe.

Art. 24 The faculty is the basic frame work unity of the LU and it includes one or more sections of specialization. The faculty is organized in departments, teaching departments, research sections, laboratories or any other structures of organization of learning and researching which may support a perfect development of the activity. The faculty is individualized by: conditions on the entrance examination, curricula, domains of specialization. The didactic activity within the faculty is carried on years of study, teaching series, groups and subgroups.

Art. 25. Facultatea cuprinde personal didactic, studen"i, cercet!tori tiin"ifici i personal auxiliar i administrativ.

The limits of the scientific, didactic, financial and administrative autonomy of a faculty are set by the present legal demands, the “Lumina University” Charter, the institutional organization and administrative coherence of the “Lumina University” , the necessity of active co-operation and the concentration of all the component faculties of the university and of the necessity of promoting those development policies which correspond to its mission. Founding or dissolving the faculty is done only with the Senate agreement on the written proposal of the specialized teaching departments or at the Rector’s written proposal with the notification of the involved faculty

Art. 27 The faculty establishes its own frame work of organization and functioning according to the stipulations of the present Charter with the didactic and scientific needs according to the financial resources and it appoints its own academic administration according to the stipulations of the present Charter, the Senate decisions and the rules and regulations of the faculty.

Art. 28. Facultatea elaboreaz! Regulamentul facult!"ii prin care reglementeaz! condi"iile de admitere i absolvire, programele de studiu i modul de desf! urare a studiilor universitare i a cercet!rii tiin"ifice, domeniile de specializare. Regulamentul facult!"ii devine opera"ional dup! aprobarea sa de c!tre Senat.

Art. 28 The faculty draws up The Regulations of The Faculty by which it establishes the entrance and graduation conditions, the curricula, the carrying on of the university studies of the scientific research and the specialization domains. The regulation of the faculty will operate after being approved by the Senate.

Art. 29. Departamentul este o unitate func"ional! ce poate fi creat! la nivelul Universit!"ii “LUMINA” din Bucure ti sau la nivelul facult!"ilor, reunind dou! sau mai multe catedre componente. Organizarea departamentelor se stabile te de c!tre Senat, la propunerea facult!"ilor.

Art. 29 The department is a functional unity which can be created at the level of U.L. or at the level of faculties, reuniting two or more teaching departments. The organization of the departments is established by the senate at the faculties’ proposal.

Art. 30. Departamentul se organizeaz! pe catedre ce sunt încadrate cu personal didactic, de cercetare tiin"ific! i alte categorii de personal.

Art. 30 The department is organized in teaching departments which have teaching staff, scientific research staff and other categories of personnel .

Art. 31. Departamentul este condus de Consiliul Departamentului, prezidat de directorul departamentului. Consiliul departamentului este constituit din efii catedrelor ce au sus"inut formarea departamentului i care desemneaz!, prin vot, cu majoritate simpl!, directorul departamentului. Consiliul departamentului are un secretar tiin"ific desemnat dintre cadrele didactice ce face parte din departament. În func"ie de buget, departamentul poate constitui un

Art. 32 The department manager is lawfully part of the faculty board to which it is subordinated and of the U.L. Senate.

Art. 33. Catedra este unitatea func"ional! fundamental! a facult!"ii sau, dup! caz, a departamentului, care organizeaz! i coordoneaz! activitatea de înv!"!mânt i/sau cercetare. Catedra cuprinde personalul didactic i, dup! caz, personalul de cercetare i administrativ, corespunz!tor unei discipline sau familii de discipline.

Art. 33 The teaching department is the fundamental functional unity of the faculty or of the department which organizes and coordinates the learning and/or research activity. The department includes the faculty members and the research administrative staff corresponding to a subject or to a set of subjects.

Art. 34. Catedra func"ioneaz! cu cel pu"in 15 posturi didactice. În cadrul catedrelor se pot constitui colective, conduse de responsabili de colective. Desemnarea responsabilului de colectiv se face pe baza Regulamentului catedrei, aprobat de catre Senat.

Art. 34 The teaching department functions with at least 15 teaching positions. Within the teaching departments can be formed groups led by group leaders. The group leader is appointed on the ground of the teaching department regulations approved by the Senate.

Art. 35. Catedrele pot organiza i coordona unit!"i de cercetare cu autofinan"are.

Art. 35 The teaching departments can organize and coordinate research units with self financing.

Art. 36. Conducerea catedrei este asigurat! de biroul catedrei, alc!tuit din eful de catedr! i cel pu"in 2 membri ale i dintre cadrele didactice ale catedrei. Art. 36 The teaching department management is ensured by the department board made up of the leader and at least 2 members elected from the teaching staff of the department . The operative management belongs to the leader of the teaching department. The leader of the teaching department is responsible in front of the teaching department, faculty board, the dean, the senate and the rector.

Art. 38. Hot!rârile în cadrul catedrei se iau cu majoritatea simpl! a membrilor prezen"i dac! num!rul lor reprezint! cel pu"in 2/3 din totalul membrilor catedrei.

Art. 38 The decisions within the teaching department are taken with the simple majority of the present members if their number represents at least 2/3 of the total number of the department members.

Art. 39. Unit!"ile de cercetare sunt structuri organizatorice ce desf! oar! preponderent activitate tiin"ific!, dar î i pot asuma, dup! caz, i activit!"i didactice. Ele pot func"iona cu finan"are din bugetul Universit!"ii sau cu autofinan"are. Unit!"ile de cercetare sunt institute, centre, colective i laboratoare organizate la propunerea catedrelor/departamentelor, Consiliilor facult!"ilor sau a Senatului. Ele reunesc personal didactic, de cercetare i studen"i. %efii unit!"ilor de cercetare sunt desemna"i pe baz! de concurs i sunt confirma"i de Consiliul facult!"ii sau, dup! caz, de Senat.

Art. 39 The research units are frame works of organization which mainly develop scientific activity but they can also develop didactic activities. They can function financed by the UL budget or by self financing. The research units are institutes, centers, collective committees and laboratories organized at the teaching departments/departments the faculty board or the Senate’s proposal. They reunite the faculty, research staff and students. The manager of the research unit is appointed on examination bases and is confirmed by the faculty board or by the Senate.

Art. 42 The Senate and the faculty board/ department analyses and adopts the functioning and the strategic development programs of the UL authorising for execution to their operative boards (the senate board or the faculty council board) which functions under the rector’s respectively the dean’s management.

Art. 46 The position of President of the UL expresses at the highest level the unity of purpose and action between the founding members of the “Lumina” Educational Institutions Foundation and the members of the academic community of the “Lumina University”. The President of the University is also the President of the academic community.

Pre edintele Universit!"ii este ales de Adunarea General! a Funda"iei “LUMINA INSTITU#II DE ÎNV$#$MÂNT”, din rândurile membrilor fondatori, fiind o personalitate cu merite exceptionale în fondarea i dezvoltarea Universit!tii. Alegerea este validat! de c!tre Senatul Universit!tii LUMINA”. Mandatul Pre edintelui Universit!tii este de 5 ani, iar num!rul de mandate este nelimitat. Art. 47 The President of the University is elected by the general assembly of the “Lumina” Educational Institutions Foundation from its members, being a personality with exceptional merits in founding and developing the university. The election is validated by the senate of the UL. The University President’s mandate is for 5 years and the number of mandates in unlimited. The President of the University appoints by order the Rector elected by the University Senate based on the General Assemble proposal of the founding members of the Foundation “Lumina” Educational Institutions.

Art. 54 The President carries out any other prerogatives meant to consolidate the material, financial situation and the prestige of the UL and can hire a number of councillors, assistants and experts to support his activity. Art. 55. Senatul Universit!"ii “LUMINA” din Bucure ti este compus din: Pre edintele Universit!"ii, Rector, Prorectori, Secretar tiin"ific al Senatului, Secretar general al Universit!"ii, Directori de departamente, Decani, Prodecani ai facult!"ilor, alte cadre didactice, personalit!"i de prestigiu ale vie"ii universitare i tiintifice na"ionale i interna"ionale, sponsori din "ar! i str!in!tate, reprezentan"i ai institu"iilor cu care colaboreaz! Universitatea i din reprezentan"i ai studen"ilor.

Art. 55 The Senate of the UL is made up of: the President of the University, the Rector, the Pro rector’s, the scientific secretary of the senate, the general secretary of the university, managers of the departments deans, pro deans of the faculties and other teaching staff, important personalities of the academic life and of the national and international scientific life, sponsors from our country and abroad, representatives of the institutes with which the university collaborates and representative of the students.

Art. 56. Senatul se constituie conform metodologiei de alegeri proprii.

Throughout the school year the Senate can gather in ordinary meetings according to a pacification established at the beginning of the academic year, for ratifying the decisions that have been given to the boarders or for taking decisions due to specific situations. The Senate can gather in extraordinary meetings at the UL President, the Rector or of the Senate Boarder’s convening and at least 1/3 of its members.

Art. 65. Conducerea compartimentului de asigurare a calit!"ii revine unui director pentru asigurarea calit!"ii (DAC), desemnat pe baz! de concurs i validat de c!tre Senatul universitar. La concurs particip! i un reprezentant al Consiliul Na"ional al Managementului Calit!"ii în Înv!"!mântul Superior (CNMCIS), iar numirea pe post se face de c!tre Rector. Rectorul poate suspenda din func"ie, din motive justificate, directorul pentru asigurarea calit!"ii. Hot!rârea de revocare sau men"inere în func"ie se ia de c!tre Senatul universitar în cel mult 30 de zile de la data comunic!rii ordinului de suspendare.

Art 65 The management of the quality assurance department belongs to a manager for a quality assurance (DAC) appointed on examination basses and made valid by University Senate. At the examination also takes part an official of CNMCIS and he is appointed by the Rector. The Rector can suspend on righteous motives the manager for quality assurance. The decision of revoking or maintaining in position is taken by the University Senate within at the most 30 days from the date of communicating the suspending order. The person who takes the position of DAC has to be a professor in ordinary, having the title of professor or lecturer. The

Persoana ce ocup! postul de Directorul pentru asigurarea calit!"ii trebuie s! fie cadru didactic titular, având titlul de profesor sau conferen"iar. Directorul pentru asigurarea calit!"ii particip! la edin"ele Biroului Senatului, cu statut de invitat. Coordonatorii pentru asigurarea calit!"ii sunt desemna"i în cadrul diferitelor compartimente (departament/catedr!/ compartiment administrativ) de conducerea acestora, fiind confirma"i de compartimentul de asigurare a calit!"ii. Lor le revine responsabilitatea desf! ur!rii corespunz!toare a activit!"ilor specifice, referitoare la calitate.

Art 66. The ethics commission is made up of one official of each faculty appointed by the faculty board and the representative of the students and the representative for the juridical compartment of the university. The senate approves by decision the nominal component of the commission and the code of university ethics.

Art. 67. The Senate awards titles and honorary distinctions: Doctor Honoris Causa, Professor Honoris Causa and Honorary Senator of the LU. The procedure of awarding these titles is established by the Senate. The personalities awarded with a title of Professor Honoris Causa are honorary senators of the LU. The honorary senators can be invited to the important meetings of the senate. They have the right to a consultative vote upon matters of strategy for LU development.

Art. 71. Senatul ia deciziile cu majoritatea membrilor prezen"i, dac! num!rul lor reprezint! cel pu"in 2/3 din totalul membrilor Senatului. La începutul fiec!rei edin"e a Senatului se distribuie procesul verbal con"inând deciziile din cadrul edin"ei precedente i se aduc amendamente dac! se consider! necesar.

Art. 71 The Senate takes decisions with the majority of the present members only if the number represents at least 2/3 of the total number of members in the Senate. At the beginning at each meeting of the Senate minutes containing the decisions of the previous meeting are distributed and if necessary amendments are made.

Rectorul poate invita la lucr!rile Biroului Senatului persoane a c!ror prezen"! o consider! necesar!. Biroul Senatului este convocat de c!tre Pre edinte sau de c!tre Rector. Hot!rârile Biroului Senatului se adopt! cu votul majorit!"ii membrilor s!i prezen"i, exprimat în mod direct i deschis.

Art. 74 The Senate Board is made up of the President of the UL the Rector, Pro- rectors, the scientific secretary of the senate, Deans and the President of the commission for evaluating and ensuring department managers, the general director, the administrative manager and the representative of the students. The Rector can invite at the meetings of the senate board people whose presence is considered to be necessary. The Senate Board is convoked by the President or the Rector. The decisions of the Senate Board are adopted with the vote of the majority of its present members expressed directly and openly.

Art. 77 The Rector manages the whole academic activity of the UL and represents the institutes in front of the Ministry of Education and Research, in the National Board of the Rectors in the relations with other universities from our country or abroad, with a central and a local administration or with national or international bodies

Art.88 The faculty council/board organizes and manages the whole activity in the faculty. The operative management of the faculty is ensured by the council board and by the Dean.

Art. 89. Consiliul facult!"ii este alc!tuit din cadre didactice, cercet!tori i studen"i i care este condus de decan. În Consiliu sunt reprezentate toate sec"iile, catedrele i unit!"ile de cercetare arondate facult!"ii respective.

Art. 89 The faculty council is made up of teaching staff, researchers, students and it is led by the Dean. In the council are represented all the sections, departments and research unities belonging to the respective faculty.

Art. 90. Consiliul facult!"ii se întrune te în sesiune ordinar! lunar, conform program!rii stabilite la începutul fiec!rui semestru academic, i în sesiuni extraordinare, la convocarea decanului, a biroului Consiliului facult!"ii sau la cererea a cel pu"in 1/3 din num!rul membrilor Consiliului.

Art. 90 The faculty council gathers in ordinary session monthly according to the established planning at the beginning of each academic semester, and in extraordinary sessions convoked by the Dean and the faculty council board or at the demand of at least 1/3 of the number of the council members.

Art. 94 The faculty council board applies the decisions of the faculty council and takes decisions in current matters between the reunions of the faculty council and based on its decisions

Art. 95. Decanul reprezint! facultatea. Decanul r!spunde în fa"a Consiliului facult!"ii, a Senatului i a Rectorului prin prezentarea anual! a unui raport privind activit!"ile i rezultatele ob"inute în anul universitar curent i a obiectivelor pentru perioada viitoare.

Art. 95 The Dean represents the faculty. The Dean is responsible in front of the faculty council the senate and the rectorship by annual presentation of a report regarding activities and results obtained during the current university year and of the objectives for and the future period.

Art. 105 The head of the teaching department is responsible for ensuring academic and scientific competitively within his department

Art. 109. Func"iile de conducere de rector, de prorector, de decan, de prodecan, de director de departament sau unitate de cercetare i de ef de catedr! nu se cumuleaz!. Aceste func"ii pot fi ocupate conform legii.

Art. 109 The leading function of rector, pro rector, dean, pro dean, department or research unit manager and teaching department head are not to be cumulated. These positions can be occupied according to the law.

Art. 110. Durata mandatului organismelor de conducere este de patru ani. O func"ie de conducere nu poate fi ocupat! de aceea i persoan! mai mult de dou! mandate succesive.

Art. 110 The duration of the mandate of the leading bodies is 4 years. A leading position can not be occupied by the same person more than 2 consecutive mandates.

Art. 111. Alegerile se fac pe baz! de vot direct i secret. Se declar! alese în func"iile de conducere persoanele care au ob"inut majoritatea simpl! din totalul celor prezen"i.

Art. 111 Elections are done by direct and secret voting. The people who have obtained the simple majority of the total of those present are declared elected in the leading positions.

Art. 112. Func"iile de conducere la nivelul facult!"ilor i al UL se ocup! pe baz! de candidatur! explicit! prezentat! sub forma unei declara"ii scrise de candidatur! fie de c!tre persoana în cauz!, fie de c!tre colectivul de conducere care îl recomand!. Al!turi de declara"ia scris! de candidatur!, candida"ii la func"iile de decan i rector trebuie s! depun! la Secretarul %tiin"ific al Senatului, înainte de scrutin, programul pe care îl vor urm!ri, înso"it de un curriculum vitae.

Art. 112 The leading positions at the faculty and the UL level are occupied on the bases of explicit candidature presented as a written declaration to candidature either by the candidate himself or by the leading collective that recommends him together with the written declaration to candidature, the candidates to the position of dean and rector have to hand in at the scientific secretariat of the senate, before the voting, the program they will follow along with their curriculum vitae .

Art. 114. Alegerea în func"ii de conducere se face prin respectarea urm!toarelor proceduri i norme de reprezentare:

Art. 114 The election for leading positions is done by observing the following procedures and representations norms:

a) organizarea alegerilor la fiecare nivel de conducere se face de c!tre conducerile în exerci"iu, în conformitate cu calendarul stabilit de Senatul universitar. Data edin"elor de alegeri se anun"! cu cel pu"in 15 zile înainte de convocarea reuniunii respective;

Organizing elections at each leading level is done by the present leadership/management according to the calendar established by the University Senate. The date of the meetings for the elections shall be announced with at least 15 days before convoking the respective reunion

b) dup! prezentarea raportului de activitate i declara"ia de încetare a mandatului de c!tre un organism de conducere, reuniunea organismului consacrat alegerii este prezidat! de decanul de vârst! al corpului profesoral, cu condi"ia ca acesta s! nu candideze la o func"ie de conducere;

After handing in the activity report and the declaration of the ending mandate by a leading body , the meeting of the body that is to be elected is presided by the Dean of age of the professors’ body on condition that he does not candidate for a leading position

c) în lipsa unor candidaturi explicite, concretizate în declara"ii scrise de candidatur!, la începutul edin"ei respective de alegeri se discut! i se aprob! procedeul de alegere: fie se instituie o comisie de propuneri, fie se recurge la varianta propunerilor prin vot secret înaintate de mai mul"i membri ai colectivului;

If there are not explicit candidatures materialized in written candidature declarations at the beginning of that election meeting, the procedure of election is discussed and approved: either a proposal commission is set up or it is resorted to the variant of a secret vote proposal handed in by more members of the respective group.

g) num!rul reprezentan"ilor facult!"ilor în Senat este propor"ional cu num!rul posturilor didactice ocupate i cu num!rul studen"ilor fiec!rei facult!"i. Num!rul reprezentan"ilor facult!"ilor în Senat se stabile te de c!tre Senatul în func"iune la data alegerilor;

The teaching staff can candidate and can be elect in leading positions if they do not have the legal retiring age at the date of the elections. The teaching departments, the faculty councils, the Senate can elaborate for each legislature, before the start of the elections, other age criteria regarding academic leading positions at the respective level.

Art. 117. Calitatea de membru în organismele de conducere se pierde ca urmare a încet!rii contractului de munc! sau a încet!rii calit!"ii de student. Locurile r!mase vacante în organismele de conducere se ocup! prin alegeri, conform procedurii stabilite.

Art. 117 The quality of member of the leading bodies is lost if the working contract or the position of student ceases. The vacant places in the leading bodies are occupied through election according to the established procedures.

Art. 118. Persoanele care, din diverse motive, nu- i exercit! atribu"iile de conducere asumate o perioad! mai lung! de 3 luni vor fi considerate demisionare din func"iile de conducere pe care le de"in i se va trece la procedura de înlocuire a lor.

Art. 118 People who due to different motives do not exert their assumed leading prerogatives for a period longer than 3 months will be considered as resigned from the leading position which they have and it will be passed to the procedure of replacing them.

Art. 119. În cazul în care de"in!torul unei func"ii de conducere, dintr-un motiv obiectiv, care nu justific! schimbarea, nu- i poate îndeplini atribu"iile pe o perioad! mai lung! de 2 luni, va delega responsabilit!"ile func"iei respective unei alte persoane, cu titlu de interimat, pentru o perioad! de maximum dou! semestre. Desemnarea interimarului se va face conform ierarhiei func"iilor de conducere i cu aprobarea organismului care l-a ales.

Art. 119 If a person who has a leading position due to an objective motive, which does not justify the change, can not fulfill his prerogatives for a period longer than 2 months, will delegate the respective function responsibilities to another person considered ad interim for a period of maximum 2 semesters. The interim will also be done according to the leading positions hierarchy and with the approval with the body that has elected him.

Art. 120. Mandatul noilor organisme de conducere începe în termen de cel mult 30 de zile de la data valid!rii alegerilor. În perioada dintre data alegerilor i cea la care î i preiau prerogativele noile organisme, conducerea curent! este exercitat! de organismele în func"ie la data alegerilor.

Art. 120 The mandate of the new leading bodies starts within at the most 30 days from the date of the election validation. During the period between the date of the elections and that of taking the prerogatives by the new bodies, the present management is exerted by the functioning bodies at the date of the elections.

Art. 121 The election of the head of the teaching department is done by the didactic and research staff of the respective department .The people who candidate for the position of head department have to have the didactic grade of professor or lecturer. In extraordinary situations lecturers can be also elected with the faculty council agreement.

Dac! nici unul dintre candida"i nu a ob"inut num!rul voturilor necesare, se organizeaz! un nou tur de scrutin la care particip! candida"ii clasa"i pe primele dou! locuri, în ordinea descrescând! a num!rului de voturi favorabile.

Art. 124 The candidate for whom the simple majority of those present vote is elected as the head of the teaching department. If none of the candidates has obtained the necessary number of votes a second ballot will be organized in which will participate the candidates from the first two places, in the decreasing order of the number of favourable votes.

Art. 125. În cadrul edin"ei de alegere a efului de catedr! se procedeaz! i la alegerea biroului catedrei i a reprezentan"ilor catedrei în consiliul facult!"ii. %eful catedrei care î i începe mandatul este membru de drept al noului Consiliu al facult!"ii.

Art. 125 During the election meeting for the head of the teaching department, it will also be elected the teaching department board and the teaching department representative in the Faculty Board. Art. 126. Cu prilejul desf! ur!rii edin"ei de alegeri se încheie un proces verbal care con"ine rezultatele votului, numele efului de catedr! i al reprezentan"ilor catedrei ale i în Consiliul facult!"ii. Procesul verbal, semnat de cel care l-a întocmit, precum i de to"i membrii catedrei, va fi depus la decanatul facult!"ii, unde se p!streaz! toat! perioada mandatului.

Art. 126 During the election meeting a minute will be written and it will contain the results of the poll the name of the teaching department head and the names of the teaching department representatives elected in the Faculty Board. The minute signed by the person who wrote it as well as by all the members of the teaching department will be handed in to the Decanate of the faculty where it will be kept during the whole period of the mandate.

Art. 127. Consiliul în func"iune la data organiz!rii alegerilor analizeaz! modul de desf! urare a alegerilor de la nivelul catedrelor i confirm! legalitatea alegerii efilor de catedre i a reprezentan"ilor catedrelor în consiliul facult!"ii. Art. 127 The council in function at the date of the elections analyses the way they took place from the level of the teaching departments and confirms the legality of the elections for the heads of the teaching departments and the representatives of the teaching departments in the Faculty Board. If any breaking of the stipulations of the university charter are found, the Faculty Board is authorized to decide organizing new elections within a week from the date of deciding the invalidation.

By electing the council members by the community of the professors in ordinary, belonging to the faculty, on the bases of proposal made by teaching departments, departments and in the colleges in the faculty structure.

Art. 131. În Consiliul facult!"ii pot fi alese persoane din toate categoriile de personal didactic titular i de cercetare, cuprinse în statele de func"ii.

Art. 131 In the Faculty Board can be elected people from all categories of faculty members in ordinary and research stuff found in the personnel establishment.

Art. 132. Reprezentan"ii studen"ilor în consiliul facult!"ii vor fi desemna"i de comunitatea studen"ilor, în baza unor proceduri stabilite de ace tia, dar care sunt f!cute publice cu cel pu"in 10 zile înainte de data alegerilor. Efectivul studen"ilor în Consiliul facult!"ii reprezint! o p!trime din num!rul membrilor Consiliului.

Art. 132 The representatives of the students in the Faculty Board will be appointed by the student community according to certain procedures established by the latter, but which are brought to public knowledge with at least 10 days before the elections. The number of students in the Faculty Board represents ¼ of the number of the council members.

Cadrele didactice i studen"ii, având calitatea de membri ai Consiliului, î i aleg separat proprii reprezentan"i în Senatul universitar.

Art. 136 The Faculty Board elects its representatives in the university senate from the council members (teachers and students) according to the norms of representation established by the university charter. The professors and the students being members of the board can elect separately their own representatives in the University Senate.

Art. 137. Decanii i directorii departamentelor din subordinea Universit!"ii “LUMINA” din Bucure ti sunt membri de drept ai Senatului nou ales.

Art. 137 The Deans and the managers of the departments subordinated to the UL are the members by right of the newly elected Senate.

If one of the candidates has from the first poll the simple majority (half + 1 of the number of those who are present on condition of being present for the poll at least 2/3 of the total number of the members), this is declared elected. If none of the candidates has the necessary number of votes it will be organized a second ballot at which will participate the candidates found on the first 2 places.

Art. 143. Alegerea prorectorilor i a secretarului tiin"ific se face dup! urm!toarea procedur!:

b) The Rector can suggest a list of candidates respecting the demand that the candidates to those positions should represent the variety of specializations of the faculty within UL

Art.144 The UL Senate has at least one prorector. Responsibilities specific to the prorector(s) are established in the first meeting of the new-elected Board of the Senate and notified by the rector to all the faculties.

Art. 145. Rectorul ales de Senatul universitar se confirm! prin ordin al Ministrului Educa"iei, Cercet!rii i Tineretului.

Art.145 The Rector elected by the University Senate is confirmed by order of the Minister of the Education and Research.

4. Schimbarea din func"ii de conducere 4.Changhing from leadership post

Art. 146. Persoanele aflate în func"ii de conducere de la orice nivel pot fi suspendate sau revocate din func"ie în urm!toarele cazuri:

Art.146 People in leading positions at any level can be suspended or revoked in the following cases:

a) sunt numi"i sau ale i în func"ii administrative (primari, viceprimari, prefec"i, subprefec"i, pre edin"i i vicepre edin"i de consilii locale sau jude"ene, directori generali, secretari de stat, mini tri etc.);

a) are appointed or elected in administrative positions (mayor, vice-mayor, prefects, sub-prefects, presidents, vice-presidents of local or county councils, general managers, state secretary, ministers etc)

b) sunt ale i senatori sau deputa"i în Parlamentul României; b) are elected senators or deputies in the Romanian Parliament

c) devin lideri (pre edin"i, vicepre edin"i, secretari) locali, regionali sau na"ionali ai unor partide politice.

Art. 147. În cazurile de mai jos revocarea din func"iile de conducere este obligatorie:

Art.149 The people in leading positions can be revoked from their position through the procedure used in the elections at the initiative of a 1/3 of the number of the voters. The hearing of that person is compulsory.

Art. 150. Hot!rârea de revocare din func"ie a persoanelor de la orice nivel de conducere se ia cu majoritatea simpl! din num!rul total al electorilor.

Art.150 The decision of revoking people at any leading level from their position is taken with the simple majority of the total number of the voters

Art. 151. Rectorul poate fi suspendat din func"ie de c!tre Ministrul Educa"iei, Cercet!rii i Tineretului, în conformitate cu procedura stabilit! de Statutul personalului didactic.

Art. 173. Catedrele, facult!"ile i departamentele pot angaja, în regim de cadru didactic asociat, speciali ti cu valoare recunoscut! în domeniu, din "ar! sau str!in!tate. Angajarea se avizeaz! de Consiliul departamentului sau al facult!"ii i se aprob! de Senatul universitar.

Art.173 The teaching departments, faculties and departments can hire as an associate professor experts with a knowledge value in his domain in our country or abroad. The hiring is notified by the department or the faculty board and is approved by the Universitary Senate.

2. Perfec"ionarea preg!tirii i evaluarea personalului didactic 2. Perfecting the training and evaluating the faculty members

Art. 174. Perfec"ionarea personalului didactic se realizeaz!, în principal, prin formele prev!zute la art. 164 din Legea înv!"!mântului nr. 84/1995, cu modific!rile i complet!rile ulterioare i anume:

Ponderea fiec!rui criteriu în evaluarea performan"elor profesionale individuale va fi determinat! prin raportare la normele metodologice pentru evaluarea performan"elor profesionale individuale ale personalului didactic din înv!"!mântul superior i în func"ie de politica de dezvoltare institu"ional! a Universit!"ii. Suma ponderilor criteriilor va fi de 100%.

Art. 177 The disputes regarding evaluation of the professional, individual performances are done within 5 days from communicating the result of the evaluation and are resolved by the university senate board. The result of analyzing the dispute will be handed over within 5 days from registering the dispute.

Periodic, Compartimentul de evaluare i asigurare a calit!"ii Universit!"ii “LUMINA” din Bucure ti (condus! de Rector) va aprecia activitatea structurilor universitare (catedre, departamente, facult!"i, laboratoare, grupuri sau colective de cercetare) potrivit normelor i uzan"elor practicate în via"a academic!, standardelor fixate de Agen"ia Român! de Asigurare a Calit!"ii în Înv!"!mântul Superior (ARACIS). Aceea i comisie va analiza i aviza, înc! din faza de proiectare i dup! încheierea primului an de înv!"!mânt al ciclului de studii, formele de înv!"!mânt i specializ!rile noi.

Art. 179 Periodically the evaluation and certification commission of the UL (led by a pro rector) will evaluate the university structures’ activity (teaching departments, departments, faculties, laboratories, groups or collectives of research) according to the norms and usages practiced in the academic life, standards settled by ARACIS. The same commission will analyse and notify even from the stage of design and after the first studying year of the cycle, the forms of learning and new specializations.

3. Personalul tehnic-administrativ i personalul didactic auxiliar 3. Technical and administrative staff and the auxiliary didactic staff

Art. 180. Personalul tehnic-administrativ este alc!tuit din totalitatea angaja"ilor Universit!"ii care nu este încadrat! pe func"ii didactice i nu îndepline te activit!"i didactice. Criteriile de angajare i remunerare, precum i modul de organizare, control i evaluare a acestei categorii de personal intr! în atribu"iile serviciului financiar-contabil i serviciului resurse umane, aflate sub conducerea directorului.

Art. 180 The technical administrative staff is made up off all the employees of UL who are not functioning on teaching positions and do not perform teaching activities. The criteria of hiring and payment as well as the way of organizing, controlling and evaluating these categories of staff is the prerogative of the administrative economical department under the management of the administrative manager.

Art. 181. Personalul didactic auxiliar este alc!tuit din totalitatea persoanelor de specialitate cu studii superioare (tehnicieni, laboran"i, operatori de teren, etc.), angajate de catedre i facult!"i în vederea sprijinirii procesului didactic i activit!"ii de cercetare. Catedrele i facult!"ile pot angaja personal didactic auxiliar, în func"ie de resursele financiare suplimentare.

Art. 181 The auxiliary didactic staff is made up of the total number of specialized people having university education (technicians, laboratories assistants, field operators, etc.) hired by the teaching departments and faculties in order to support the didactic process and research activities. The teaching departments and faculties can hire auxiliary didactic staff according to supplementary financial resources.

1. Admiterea Entrance Examination

Art. 183. Înv!"!mântul universitar din Universitatea “LUMINA” din Bucure ti, organizat în acord cu Declaratia de la Bologna, este deschis tuturor absolven"ilor de liceu cu diplom! de bacalaureat. Accesul se decide în limita locurilor stabilite de fiecare facultate, cu aprobarea Senatului.

Art. 183 University education in UL organized according to the Bologna Declaration is open for all of the high school degrees Baccalaureate Diploma . the entrance is decided according to the limit of places established by each faculty with the senate’s approval.

Art. 184. În conformitate cu reglement!rile legale, locurile scoase la concurs sunt locuri în regim cu tax! pentru înv!"!mântul de zi.

Art. 184 According to the legal regulations the places that are for competitive examination are places with a fee for day learning.

Art. 185. Pentru admiterea la studii universitare de licen"! se organizeaz! concurs de admitere. Facult!"ile pot decide alocarea unor locuri speciale pentru politicile affirmative.

Art. 186. Condi"iile specifice de admitere i cifrele de colarizare ale fiec!rei facult!"i/departament sunt f!cute publice cu cel pu"in 6 luni înainte de începerea anului universitar.

Art 186 The specific entrance conditions and the figures of number of students for each faculty/department are made public with at least 6 months before the beginning of the university year.

Art. 187. Candida"ii declara"i admi i pot urma concomitent dou! specializ!ri în cadrul Universit!"ii, potrivit deciziei Senatului universitar. Cuantumul taxei anuale de studiu pentru aceast! categorie de studen"i va fi stabilit de Senat i va fi anun"at candida"ilor înainte de începerea examenului de admitere, prin Taxele speciale, aprobate de Senatul universitar.

Art. 187 The candidates who are declared admitted can follow to specializations within UL at the same time, according to the decision of the university senate. The quantum of the annual studding fee for these categories of students will be established by the senate and the candidates will be informed aborted before the beginning of the entrance exam.

2. Evaluarea Evaluation

Art. 190. Examenele (scrise i orale), colocviile sau verificarea pe parcurs reprezint! forme obligatorii de evaluare a preg!tirii studen"ilor. Organizarea examenelor sau a altor probe de evaluare, precum i compatibilizarea sistemului de examinare din facult!"i cu sistemul de credite transferabile reprezint! responsabilitatea Consiliilor facult!"ilor i a catedrelor.

Art. 190 Exams (written or oral) preliminary examinations or permanent evaluation are compulsory ways of evaluating the students. Organizing exams or other evaluation tasks ass well as making compatible the examining system of the faculties with the system of transferable credits is the responsibility of the faculty’s boards and teaching department.

Art. 191. Examenele se stabilesc i se sus"in în sesiuni propuse de conducerile facult!"ilor. Datele de sus"inere a examenelor în sesiuni se stabilesc de c!tre studen"i, cu acordul cadrului didactic titular. Pentru motive temeinice, la cerere, examenele se pot sus"ine i în afara sesiunilor prev!zute, cu aprobarea decanului, pe baza acordului cadrului didactic titular.

Art 191 Exams are established and held in sessions proposed by the faculty’s boards. The dates of the exams during a session are established by the students with the agreement of the professor in ordinary. On justified grounds and if required exams can be held after the established period or session with the dean’s agreement based on the agreement of the professor in ordinary.

Art. 192. Promovarea examenelor se face în concordan"! cu sistemul de credite transferabile specifice facult!"ii. Nota minim! pentru ob"inerea creditelor alocate fiec!rei discipline din planul de înv!"!mânt este 5 (cinci). Studen"ii au dreptul s! sus"in! cel mult dou! examene la fiecare disciplin!, în sesiunile curente ale anului universitar. Neprezentarea studentului la data i ora anun"at! pentru un examen implic! renun"area la una din cele dou! posibilit!"i de promovare a examenului. În cazul nepromov!rii examenului la una (sau mai multe) din discipline, studentul poate solicita reînscrierea sa la cursul (cursurile) respectiv(e) i sus"inerea unui nou examen în regim cu tax!. Într-un astfel de caz, titularul unei discipline poate solicita studentului s! participe la toate activit!"ile i s! r!spund! tuturor exigen"elor impuse de planul de înv!"!mânt pentru disciplina respectiv!.

Art 192 Passing exam is done according to the system of transferable credits specific to the faculty. The lowest grade for getting the credits allotted to each subject in the educational plan is 5 (five). The students have the right to take utmost 2 exams for each subject. The student’s absence at the announced date and hour for an exam implies giving up one of the 2 possibilities of passing the exam. If the student dose not pass an exam at one (or more) of the subjects he can ask to be enrolled again at the respective course (courses) and giving a new exam with played fee. in a case as such the professor in ordinary can ask the student to take part in all the activities and face all the existences required by the studding plan by the respective subject.

Art. 193. Studen"ii pot beneficia, la cerere, de examene suplimentare în vederea m!ririi de note, prev!zute cu taxe. Studentul poate beneficia de m!rire de note la cel mult trei discipline. Examenele pentru m!riri de note se vor programa în cadrul sesiunii de restan"e (sesiunea de toamn!).

Art 193 Students can beneficiate on demand, supplementary exams for upgrading their mark with paid fees. The students can beneficiate for upgrading at the most 3 subjects. Exams for upgrading will be programmed within the sessions of failed exams.

Art. 194. Modul de evaluare a preg!tirii studen"ilor va fi adus la cuno tin"a acestora la începutul semestrului, odat! cu prezentarea programei analitice a disciplinei de studiu. Fiecare titular de curs va face publice cerin"ele sale cu privire la: frecven"a particip!rii la cursuri/seminarii; implicarea studen"ilor în discu"ii/dezbateri; gradul de importan"! al elabor!rii de referate, eseuri etc. Se va specifica totodat! ce pondere de"in diferitele forme de evaluare pe parcurs în nota final!. Se va indica i tipul de examinare final! (examen scris, oral, colocviu etc.). Examenul se desf! oar! în prezen"a titularului de curs i a conduc!torului de seminar.

Art. 194 The way of evaluating the students will be brought to their notice at the beginning of the semester together with the analytical curriculum of the subject. Each professor in ordinary of the course will informed about his demands and requirement with a view to presence at courses/seminaries, the students evolvement in discussions / debates, the degree of importance of elaborating reports essay, etc. It will also be specified the rate of the different forms of permanent evaluation in the final grade. It will also be indicated the type of final examination written, oral, exam, preliminary examination, etc. the examination will be held in the presence of the professor in ordinary of the course and the leader of the seminary.

Art. 195. Frauda la examen se sanc"ioneaz! cu suspendarea pe un an a studiilor. Recidivarea în fraud! se pedepse te cu exmatricularea. Comisia de examinare întocme te, pe loc, un proces verbal de constatare a fraudei, pe care îl înainteaz! conducerii facult!"ii. În borderoul de examen se specific!, în dreptul numelui studentului, cuvântul “fraud!”.

Art. 195 Fraud during the exam will sanctioned with being suspended for a studying year. Repeating the offence is punished by expulsion. The examination board writes a minute of recording the fraud which is handed in to the faculty board. In the examination roll is specified next to the name of the student the word “fraud” .

Pentru absolven"ii care au promovat examenul de licen"! se elibereaz! diplom! de licen"!/de absolvire, iar celor care nu au promovat examenul de licen"! - un certidicat de absolvire. În acest ultim caz, certificatul de absolvire se elibereaz! la cerere.

University training for licentiate’s degree : Graduate of university studies for licentiate’s degree with a diploma for those who have passed the university licence exam and with a graduation certificate for a long term university studies fore those who have passed the licence exam. For latter the graduation certificate is issued on demand.

Formularele tip (avizate de Ministerul Educa"iei, Cercet!rii i Tineretului) pentru diploma de licen"!/de absolvire, certificat absolvire, supliment la diplom! (anex! obligatorie la diplom!), atestat, adeverin"! de absolvire se asigur! de Secretariatul Rectoratului, cu num!r de înregistrare de la Rectorat.

Art. 201 the diploma the licentiate’s degree the certificate are drawn up only with the heading and the stamp of the UL and the signature of the rector who has the whole responsibilities of verifying the premises and the studies legally supposed by the diploma which is given. The standard forms for diploma, licentiate’s degree and the certificate, registration certificate, are ensured by the rector’s secretariat and their drawn up is registered at the rector ship and respectively at the dean’s board. Se va asigura o responsabilizare a studen"ilor în ceea ce prive te alegerea rutelor de preg!tire i a disciplinelor.

Art. 205 For all the forms of university training the studying plans are created in strict accordance with the objectives of the specialization offering students the possibility of choosing different sets of optional subjects and of completing their training by facultative courses. It will be ensured a responsibilisation of the students regarding their choice upon the routes of training and subjects.

Art. 206. Planurile de înv!"!mânt cuprind discipline obligatorii, op"ionale i facultative. Disciplinele obligatorii au în vedere acumularea de c!tre studen"i a cuno tin"elor de baz! specifice domeniului. Disciplinele op"ionale vizeaz! aprofundarea unor direc"ii particulare, precum i specializarea studen"ilor. Disciplinele facultative urm!resc l!rgirea orizontului de cunoa tere a studen"ilor, angajând domenii complementare.

Art. 206 The studying plans include compulsory optional and facultative subjects. The compulsory take into account the student’s accumulation of basic knowledge specific for their domain. The optional subjects regard a profound study in certain directions and the student’s specialization. The facultative subjects aim to enlarging the know aging orisons of the students pointing to complementary domains.

Art. 207. Planurile de înv!"!mânt aferente formelor de preg!tire universitar! de licenta se concep astfel încât s! ofere studen"ilor suficient timp pentru studiu individual i pentru reflec"ie creativ!. În acest sens, planul de înv!"!mânt nu poate dep! i limita a 20 de ore s!pt!mânal pentru o singur! specializare (major!) i 24 ore s!pt!mânal în cazul alegerii unei specializ!ri minore.

Art. 207 The studying plans due to forms of university training for the licentiate’s degree are created in order to offer the students enough time for individual studying and for the creative reflection. Thus the studying plan can not exceed the limit of 24 hours per week for a single major specialization and 24 hours per week for a minor specialization.

Art. 208. Universitatea “LUMINA” din Bucure ti aplic! sistemul de credite transferabile pentru a crea premisele intensific!rii mobilit!"ii interne i interna"ionale a studen"ilor. Creditele sunt valori numerice (considerate de obicei pe o scal! de la 1 la 30) ce reflect! volumul de munc! necesar asimil!rii de c!tre studen"i a unei discipline specifice, sub forma diferitelor activit!"i (curs, seminar, laborator, referate, activitate practic!, proiecte, etc.). În cadrul acestui sistem, semestrul reprezint! unitatea academic! de baz! i fiec!rei discipline i se aloc! un num!r de credite de studiu.

Art. 208 UL uses the system of transferable credits for enabling the intensification of a national and international mobility of the students. the credits are usually a numerical value (usually considerate on a scale from one to 30) which reflect to a necessary quantity of work necessary for the students to assimilated a certain subject and it is under the form of different activities ( course seminary, laboratory, reports or practice). Within this system the semester represents the basic academic unity and each subject is allotted a number of studding credits.

Art. 210 Depending on the importance for acquiring a qualification ( diploma, certificate, etc..) each discipline is allocated a number of credits. The total number of credits of study for a minor or major qua university qualification is proposed by the teaching department or the specialized department , is approved by the superior body and made valid by the Senate

Art. 211 The system of studying credits is able to orient the way of drawing the studying plans so that these may be centered on the objectives of stimulating the offer of transferable credits and creating the actual possibility for the students to choose certain subjects.

Art. 212. Programele analitice corespunz!toare disciplinelor din planul de înv!"!mânt se elaboreaz! la începutul fiec!rui an universitar de c!tre titularii de discipline i se aprob! de c!tre catedr! sau departament. Programele analitice sunt elaborate într-o form! unitar!, astfel încât s! existe posibilitatea compar!rii, evalu!rii i coordon!rii con"inutului disciplinelor oferite pe parcursul unui an de studiu i al întregului ciclu de înv!"!mânt.

Art. 212 The analytical curricula corresponding the subjects in the plan of study are elaborated at the beginning of each university year by the professor’s in ordinary for each subject and are approved by the teaching department or the department. The analytical curricula are elaborated in a unitary form so that there will be a possibility of comparison evaluation and coordination of the content of the subjects offers during a studying year and of the whole cycle of learning.

VIII SCIENTIFIC RESEARCH AND INTERNATIONAL COOPORATION

Art. 213. Cercetarea tiin"ific! reprezint! obliga"ia de baz! a fiec!rui cadru didactic. Activitatea de cercetare poate fi realizat! individual sau în colective de cercetare constituite la nivelul catedrelor, facult!"ilor, departamentelor sau unit!"ilor de cercetare. La activitatea de cercetare din catedre i colectivele de cercetare pot participa, al!turi de cadrele didactice, cercet!tori i studen"i. Conducerile facult!"ilor, departamentelor i catedrelor au responsabilitatea stimul!rii particip!rii i integr!rii studen"ilor în

Art. 214. Activitatea proprie de cercetare tiin"ific!, validat! prin lucr!ri publicate, reprezint! criteriul fundamental de evaluare a calific!rii i performan"ei academice. Pozi"iile în ierarhia didactic! sunt stabilite în func"ie de performan"ele de cercetare tiin"ific!.

Art 214 one’s own scientific research activity certified by published works represents the fundamental criteria of evaluation of the academically qualification and performance. The positions in the didactical hierarchy are established according to scientific research performance.

Art. 215. Cadrele didactice care au rezultate remarcabile în cercetare pot fi sprijinite, prin finan"!ri cu prioritate, s!- i desf! oare i s!- i dezvolte programele de cercetare tiin"ific!. De asemenea, studen"ii care au demonstrat o preocupare deosebit! pentru activitatea de cercetare pot fi sus"inu"i i încuraja"i în efortul de cercetare prin acordarea cu prioritate a unor burse na"ionale i interna"ionale.

Art. 215 The professors that have the remarkable results in research can be financially supported with priority in order to carry on and develop the programs of scientific research. Students who have proved a special concern for the research activity can also be supported and encouraged in their research effort by being awarded with priority national and international scholarships

Veniturile ob"inute din realizarea programelor de cercetare tiin"ific!, a contractelor i granturilor de cercetare, precum i a altor activit!"i (prest!ri servicii, consultan"! etc.) sunt utilizate cu prioritate pentru dezvoltarea bazei materiale proprii de cercetare, pentru remunerarea personalului care a efectuat cercetarea, pentru deplas!ri, organizarea de simpozioane sau conferin"e, subven"ionarea apari"iei unor c!r"i i reviste, premierea cadrelor didactice, studen"ilor sau doctoranzilor, etc. Dot!rile ob"inute de cadrele didactice sau cercet!tori în cadrul unor programe de cercetare r!mân la dispozi"ia catedrei sau unit!"ii de cercetare prin intermediul c!reia a fost realizat programul sau contractul de cercetare respectiv.

Art. 217 The revenue obtained by carrying out scientific research programs contract research grants as well as other activities (services and consultancy etc) are used mainly for developing the own source research materials for remunerating the staff who have carried out the research travelling, organizing symposiums and conferences for financing the publishing of books and magazines for awarding the teaching staff, students or candidates for a doctor’s degree etc. The endowments obtained by the teaching staff or the researchers within the research program are at the disposal of the teaching department or of the research unit that has carried out the program or the research contract.

The activity of international cooperation can be carried on through a lot of forms: participation in academic scientific educational cultural international programs; cooperation agreements with other universities ; participation in international competitions for obtaining research scholarships perfectioning studies; participation in international scientific events; mobility of the teaching staff , researchers and students within pregame or agreements with other universities; organizing lectureships and inviting foreign experts in specific domain of interest, etc.

Art. 219. Rezultatele particip!rii la diferite forme de cooperare interna"ionale sunt evaluate anual de c!tre Consiliile facult!"ilor/departamentelor i de c!tre Senat. Criteriile de evaluare au în vedere gradul de ameliorare a propriilor performan"e didactice i tiin"ifice, precum i alte tipuri de beneficii raportabile la cre terea credibilit!"ii i a presigiului tiin"ific interna"ional.

Art. 219 The results of participation in different forms of international cooperation are annually evaluated by the boards of the faculties/departments and by the senate. The criteria of evaluation aim to the degree of improving their own teaching and scientific performance as well as other types or benefits which will increase the international scientific prestige and credibility etc.

Art. 220. Finan"area cooper!rii interna"ionale se realizeaz! din resurse extrabugetare. În func"ie de bugetul alocat, la începutul fiec!rui an universitar se poate aloca fiec!rei facult!"i/ departament o sum! (inclusiv în valut!) în vederea desf! ur!rii ac"iunilor interna"ionale (deplas!ri, organiz!ri de sesiuni etc.). Modul de cheltuire a sumei respective va fi decis la nivelul Consiliului facult!"ii.

Art. 220 Financing the international cooperation are carried out by extra budget resources. According to the allotted budget at the beginning at each university year assume (foreign currency included) can be allotted to each faculty / department in order to carry on international activities (traveling organizing sessions etc) .the way of spending the respective sum of money will be decided by the faculty board

Veniturile Universit!"ii “LUMINA” din Bucure ti se compun, pe de o parte, din sumele alocate de Fundatia “LUMINA INSTITU#II DE INV$#$MÂNT” i, pe de alt! parte, din resurse financiare proprii ob"inute din subven"ii, dona"ii, sponsoriz!ri i taxe percepute în condi"iile legii de la persoane fizice i juridice române i str!ine, venituri din activitatea de expertiz!, consultan"!, alte venituri.

Art 221 The UL revenue is made up of the sums allotted by the Lumina educational institutes foundation, on one hand, and on the other hand, by own resources of financing obtained from subventions, donations, sponsorship and fees collected according to the law from Romanian and foreign natural persons or juristic persons, revenues from the activity of expertise and consultancy, other revenues.

Art. 222. Autonomia financiar! a facult!"ilor privind folosirea fondurilor alocate i dobândite implic! respectarea prevederilor legale în vigoare.

Art 222 the financial autonomy of the faculties regarding using the allotted and obtained funds impels observing the legal regulations in force.

Art. 223. Fondurile proprii pot proveni din urm!toarele surse: Art. 223 The own funds can be from the following sources:

taxe de studiu pentru studen"ii str!ini înscri i în forme de preg!tire universitar!;

studying fees for foreign students enrolled in departments of university training

taxe ce pot fi solicitate studen"ilor pentru înscrierea la examenul de admitere într-unul din programele de instruire oferite de facult!"i/departamente;

fees which can be requested from students for enrolling for the entrance examination in one of the training programs offered by the faculties/departments

taxe pentru m!rire de not!; fees for upgrading the marks

taxe pentru reînmatriculare; fees for reenrolling

taxe pentru organizarea i predarea unor discipline ce nu sunt incluse în planul de înv!"!mânt;

fees for organizing and teaching subjects which are not including in the studying plan

Art. 224. Taxele de studii, precum i toate celelalte taxe se instituie, se modific! sau se anuleaz! de c!tre Senat, la propunerea Consiliului de Administra"ie, în cadrul legal existent. Pentru instituirea oric!rui tip de taxe este necesar! precizarea destina"iei i a modului de utilizare.

Art 224 studying fees as well as all other fees are established , modified or canceled by the senate at the administration boards proposal within the existent legal frame . For establishing any type of fee it is necessary to specify its destination and the way of usage.

Art. 225. Taxele administrative sunt calculate în func"ie de cheltuielile implicate de activit!"ile suplimentare solicitate personalului didactic sau administrativ responsabil de realizarea acestora.

Art 225 administrative fees are calculated according to expenses due to supplementary activities solicitated by the teaching or administrative staff responsible for carrying out these.

Art. 226. În func"ie de resursele disponibile, Universitatea “LUMINA” din Bucure ti repartizeaz! la începutul fiec!rui an universitar o sum! (inclusiv în valut!) fic!rei facult!"i/departament în vederea desf! ur!rii ac"iunilor interna"ionale (deplas!ri, manifest!ri tiin"ifice, etc.). Au prioritate de finan"are acele ac"iuni care probeaz! ob"inerea unor beneficii certe pentru institu"ie din perspectiva extinderii cooper!rii academice i tiin"ifice sau a particip!rii în programe de cercetare interna"ionale.

Art. 226 Taking into account available resources UL allocate at the beginning at each of the university year a sum of money (foreign currency included) for each faculty department in order to carry on international activities(traveling scientific events etc). Those actions which prove to obtain certain benefits for the institution from the prospective of extending academic and scientific cooperation or participating in international research programs are prior in being financed

Art. 228 The ULB material base consists of the estate allocated by the “Lumina Educational Institut” Foundation.

CAP. XI PROCEDURA DE ADOPTARE I MODIFICARE A CARTEI X. THE PROCEDURE OF ADDOPTING AND MODIFING THE CHARTER

Art. 232. Proiectul prezentei Carte se supune dezbaterii de c!tre Consiliului de Administra"ie catedrelor, Consiliilor facult!"ilor, studen"ilor i tuturor serviciilor i unit!"ilor administrative ale Universit!"ii “LUMINA” din Bucure ti. Carta universitar! se adopt! de c!tre Senat prin vot uninominal, cu majoritatea i în prezen"a a 2/3 din membrii Senatului.

Art. 232 The project of the present charter is presented for debate by the administration board of the teaching departments faculty boards students and all the administrative departments and unites of the UL. The university charter is adopting by the senate by uninominal vote with majority and in the presence of 2/3 of the senate members.

Art. 233. Propunerile de ameliorare sau amendare a proiectului pot fi f!cute de orice membru al comunit!"ii academice i vor fi înregistrate în procesele verbale încheiate în cadrul dezbaterilor ini"iate la nivelul tuturor structurilor academice sau administrative ale Universit!"ii “LUMINA” din Bucure ti.

Art. 233 The proposals of improving or amending the project can be made by any member of the academic community and will be recorded in the minutes concluded during the debates at the level of all the academic or administrative structures of the UL.

Art. 234. Modificarea Cartei se face la propunerea a cel pu"in dou! facult!"i/departamente sau la ini"iativa unei treimi din membrii Senatului sau la propunerea Consiliului de Administra"ie. Ea se anun"! Senatului cu cel pu"in o lun! înainte de a fi supus! la vot.

Art. 234 Modifying the charter is done at the proposal of at least 2 faculties / departments or at the initiative of 1/3 of the senate members or at the AB’ proposal. It is notified to the senate with al least a month before being voted.

Art. 235. Prezenta Cart!, împreun! cu regulamentele men"ionate la art. 10, formeaz! statutele constitutive ale Universit!"ii “LUMINA” din Bucure ti. Regulamentele catedrelor se valideaz! de Consiliile facult!"ilor, iar regulamentele facult!"ilor se valideaz! de Senat. În termen de 90 de zile de la data adopt!rii prezentei Carte, se vor elabora regulamentele prev!zute la art. 10.

Art. 235 the present charter together with the regulations mentioned in art. 9 section a form the constitutive statute of UL. The regulations of the teaching departments are made valid by the faculty boards and the regulations of the faculties are made valid by the senate. Within 90 days from the date of adopting the present charter the regulations stipulated in art. 9 will be elaborated.

Art. 236. Prezenta Cart! intr! în vigoare la data de data adopt!rii sale de c!tre Senatul Universit!"ii “LUMINA” din Bucure ti.

Art. 236 The present charter comes into effect/operation at the date when it is adapted by the senate.
