andwhereyoungpeoplecantaketheirfirstspinonlivinghistory.
A unique architectural statement to energy conservation that will inspire all who visit to be more
responsible energy consumers. The building will be LEED-certified and will serve as a demonstration
building for green, energy-saving technologies. Heat will be provided by solar-heated, radiant floors.
Electricitywill be generatedby solarpanels.Amixof recycledandenvironmentally-friendlymaterials
willbeusedthroughoutthebuilding.
Apositive, signatureattraction for theTownofNederland,BoulderCountyandColorado.Carouselsacrossthecountryhavehadabeneficialimpactintheirrespectivecommunities.Locally,weanticipate
thecarousel’spresencewill attractadditional revenue for localbusinessesaspassers-throughstop to
ride.Webelievethecarouselwillbecomeadestinationattractionformany,andweplantoattractvans
andbusesofvisitorsofallages.
Aunique,participatoryexhibitoffolkart.The36carouselanimalswerebornofScott’simagination–a
laboroflovethattook22yearsandcounting.Hedesignedandcarvedeachofthemfrombasswoodand
decoratedthemwithacrylicpaint–techniquesusedbycarouselcarversformorethanacentury.The

collectionincludesahorse,lion,tiger,pig,dolphin,dragon,greatblueheron,cowandlotsofwhimsical
surprises.
A place where education is fun, where a carefree past meets the modern reality of the need to
conserveenergyforthesurvivaloftheplanet.Scottwillmakeaportionofthepublicspaceavailablefor
educationaldisplaysanddemonstrations.
A community place to share art, poetry and literature. Inspired by Scott’s carved animals and
decorations, the carousel building includes a 992-square feet room dedicated to the sharing and
enjoymentofthearts.ArtistsandauthorsfromNederlandandbeyondwillhaveaplacetosharetheir
talentswiththecommunity.
A destination for people with disabilities honoring the carousel’s history of service. Although thecarouseloriginallywasoperatedatSaltairamusementparknearSalt LakeCity,Utah, from1910until
1959, itgracedthegroundsof theUtahStateHospital forpeoplewithmentaldisabilities for27years
until 1986, when Scott purchased it andmoved it to Nederland in pieces. To honor that part of its
history,Scottenvisionsinvitingpeoplewithdisabilitiestovisitthecarouselingroupsorindividually.The
building is carefully designed to serve people with disabilities. The carousel has been adapted to
accommodateseveralpeoplewithdisabilitiesatonce.Agiganticwoodengorillasitsreadytoputhisarm
aroundriderswhousewheelchairs.
AsustainableoutpostofjoyandgivingforColoradochildren.TheCarouselofHappinesswasconceivedas an instrument of giving. It will give joy to all who ride, watch the galloping art, and listen to the
historicmusic,tobesure.ButitwillalsobeaninstrumentofgivingsuccortoColoradochildrendeprived
ofjoyintheirlivesforamyriadofreasons.Revenueswillcomefromridingfees,asmallgiftshopinside
thecarouselbuilding,andproceedsfromspecialeventsheldinaroomdesignedforthispurpose.
AlivingpieceofAmericanhistory:The1910CharlesLooffcarouselthatistheheartoftheCarouselofHappiness isoneofonly about150 surviving carousels from4,000built during thegoldenageof the
American carousel (1880-early 1930s). American craftsman borrowed the basics from Europe, but
Americancarouselsquickly surpassed theiroldworldcousins in imaginationandstyle.Carversmoved
beyondhorsestoanimalsofthejungle,farm,forestandmythology.TheCarouselofHappinessistrueto
thisquintessentialAmerican tradition. Scott let loosehiswhimsical imagination todesign theanimals
and hand carved themaccording to tradition frombasswood, thewood from the Linden tree.When
Scottthrowstheswitchontheoriginalmotor,andthereborncarousel jumpstolifeforthefirsttime,
theCarouselofHappinesswillrejoinarichlegacyofAmericanculture.

CarouselShopManagerisresponsiblefortheinventorycount,reportstoconsignors,orderingnew
merchandiseandorganizingthegiftshop.Allnewmerchandiseordersthattheshopmanagerplaceswill
beapprovedbytheDirectorbeforeplacement.
OrganizationofitemsintheCarouselShop
NomajorreorganizationofCarouselShopmerchandisewillbeundertakenthatisnotindirectco-
operationandinthepresenceofthegiftshopmanager.Thisincludegiftshopvolunteers,artistsorany
otherinterestedparties.
PurchaseofMerchandise
A. Thephilosophy/businessgoaloftheCarouselShopwillinclude:1. ThattheshopbeamajormeansoffinancialsupportoftheoperationoftheCarouselof
Happiness.
2. Thatthemerchandiseintheshopreflectsthemissionofthecarousel--inthatitpromotes
individualaccomplishment,creativityanduniquecontribution,eitheronthepartofthecreators
ofthemerchandise,orleadtosuchgoalsforthepurchasersofthemerchandise.
3. Thatthemerchandiseintheshopincludeanemphasisonthewell-made,usesustainable
materials/componentswheneverpossible,andthematicallyexpressthewhimseyandfunofthe
carousel.
B. TheCarouselShopwillhavethefollowingprioritiesinpurchasingwholesalemerchandiseforsaleintheshop:1. Locallyproducedbyhandcrafters

BasedupontheoriginalmissionoftheCarouselofHappiness,thepurposeofthebusinessisprimarilyto
makeaplaceofjoyandfun.
Thereforeouroverallcustomerserviceattitudeiskeyedaroundawelcoming,kindandnon-judgmental
atmosphere.This,however,meansthatifanyindividualhasapersonalproblemorisinasituationthat
causesdisruptiontothegroupofcustomersasawhole,thatsituationneedstobediffusedinawaythat
offerstheleastdisrespect,butsolvestheproblemquickly.
EmployeesarethereforeaskedtobringintheadministratoriftheeventisintheAnnex,andthe
OperatoriftheeventisintheHouse,immediatelywhenthereisaproblematicsituationsothatthe
administratorcanusehisorherdiplomaticabilitiestoisolateandsolvethesituation,andtheemployee
cancontinuetomakesuretherestofthevisitorscanbedistractedbacktohavingfun.TheOperatoris
freetobringintheAdministratororCoordinatoratanytimesothats/hecangetbacktooperatingthe
carouselasneeded.
Ifdiplomacywillnotworkonthesituation,thelastresortistocallthepolice.
Refunds
Itishardtoimaginethatanyonewouldeveraskforarefundforacarouselrideaftertheridehastaken
place,butIsupposethatwouldbepossible..Again,ratherthandealwithsuchanegativesituationin
frontofalltheseothervisitors,ifsomeoneisunhappyandwantstheirmoneyback,callthe
administratorandhavethecustomerspokentoseparatelyfromtheotherpeople.Withinreason,give
themtheirmoneyback.
Ourgeneralrefundpolicywillbetotakebackunusedtickets(forexample:webought20ticketsbut
don'thavetimetousethemtodayandaren'tsurewecancomeback–canwereturnthem?Yes.)and
merchandisetothegiftshopifreturnedwiththereceiptandstillinresalableshape.Iftheitemhas
obviouslybeenused,orbeingreturnedwithoutareceipt,itwillbeuptotheadministratortomakethe
callaboutthesituation.Forexample,ifit'sprettyobviousthatthethingwasnotstolenandtheyreally
obviouslylosttheirreceipt,theadministratororoperatorcanmakeanexceptionandrefundthemoney.
Theadministratorshouldusetheirbestjudgmentandrememberthatthecustomerisalwaysright–
exceptwhentheyareobviouslytakingadvantageofus.
Encouragevolunteersthat,iftheyaren't100%comfortablewitharefundrequest,tocallthe
administrator.
Childrenleftunattended
AsignwillbepostedattheentrancetotheCarouselHousethat“Childrenundertheageof8mustbe
accompaniedbyaparentorguardian.”However,shouldtherebepeoplewhoignorethissign,wewill
havetotakespecificmeasures:
Iftheoperatororassistantnoticeachildwhoseemstobespecificallyalone,repeatedlyridingor
hangingaroundwithoutanobviousadultintow,heshouldlettheadministratorknowthatthisisthe
case.Theadministratorshouldcomeandspeaktothechild,anddetermineifthisisindeedthecase.

Theadministratorwillsupervisethechilduntiltheparentsreturn.Ifthechildcanprovideinformation
suchashisnameandaddress,orifheknowswherehisparentshavegone,attemptswillbemadeto
reachtheparents.Whentheparentsdoreturn,theywillhavetocomeuptotheofficetopickuptheir
child,andwillberemindedthatthepolicyisthatchildrenmustbeaccompanied...hopefullythat
exercisewillbeenoughtoconvincetheparentnottoletthishappenagain.
Ifthechildisleftformorethanonehourandthereisnoclueastothechild'sidentification,thepolice
willbecontacted.Outsideofthoseparameters,theadministratorshoulduseherjudgment.
ImageCopyrightPolicyCarouselimages,logoandnameareunique/folkartandtheseimagesbelongtotheCarouselof
Happiness,LLC,organization.
TheCarouselofHappinessBoardofDirectorsherebyestablishesthepolicythatanyartist,manufacturerorprinterthatintendstosellordistributeanymerchandise,printedmaterialorartpieces
thatfeaturetheaboveimagesornameisaskedtocontacttheDirectoroftheCarouselofHappinessto
reachanagreementforthisdistribution.
Theagreementcanconsistofamaximumofa$50orlessflatfeefortheuseofupto500replicationsof
theimage,whetheronthesameitemordifferentitems.Forsomenon-profituse,thefeemaybe
waived.However,inallcases,thewords:“ImageusedwiththepermissionoftheCarouselofHappiness,
Inc.Nederland,Colorado,Carouselofhappiness.org”mustappear.
TheCarouselofHappinessretainstherightofrefusalforanyuseoftheircopyrightimagesthatdoesnot
meettheapprovaloftheCarouselDirector,eitherthroughamatteroftaste,properuseoranyusethat
couldbeviewedasdemeaningorcontrarytothemissionoftheCarouselofHappiness.
ThenegotiationofthesaidflatfeeistheresponsibilityoftheCarouselDirector.Ifanyquestionpersists
orisleftunanswered,applicationmaybemadetotheCarouselBoardofDirectorsforfurther
consideration.

Theanimalsshouldbecopyrightednottrademarked.Weshoulduseasmallcinacirclewhenweusean

IntellectualPropertyPolicyThe Carousel of Happiness, Inc., a 501(c) 3 organization registered with the IRS (20-3584335) and the Colorado Secretary of State, has trademark rights in its name, “Carousel of Happiness” and its circular logo which includes an image of a boy riding a zebra. These trademarks cannot be used without express permission of an authorized representative of the organization, Carousel of Happiness. In addition, the Carousel of Happiness has over 60 uniquely designed and carved wooden sculptures. The environment within the carousel building incorporates other unique designs. We encourage our guests to take photos for private use but ask that any proposed commercial use of photos or art representing the unique aspects within the Carousel of Happiness building be submitted to the office manager at the carousel for approval. The following steps represent our process to protect the use of images derived from the Carousel of Happiness. (We = Carousel of Happiness, Inc.) 1. We require that any person or entity who wants to use one of our images, i.e. a photograph of one of the animals, for commercial purposes, to first ask permission by submitting that image to the office manager at the office of the Carousel of Happiness and to explain the proposed use of the image(s). 2. We will expedite the review and approval/disapproval process for the product/s and their proposed use before commercial use. 3a. Upon approval, we ask that the image is used along with the following attribution: Carousel of Happiness, Nederland, Colorado, www.carouselofhappiness.org or some version which fits with the proposed use of the image. The intention of the organization is to ensure that wherever such an image is used, it will be identified as coming from the Carousel of Happiness. or 3b. If the organization deems that the use of the image from the Carousel of Happiness is not appropriate to the goals and best interests of the Carousel of Happiness enterprise, we require that the proposal not go forward.

ScottHarrisonhasunitedthesmallmountaincommunityofNederlandbehindhisvisionforaproject

childrenofallages.Weinviteyoutobecomeapartofthisextendedcommunitybyjoiningusinbuilding
afacilitytohousethisstatetreasure–TheCarouselofHappiness.

The idea was planted a generation ago in most unjoyful circumstances. As a machine gun squad
leaderintheU.S.MarineCorpsservinginVietnamin1967-68,Scotttookjoyamidgreatsorrowfroma
tiny,hand-heldmusicboxthatplayedTristessebyChopin.Heimaginedhimselfinapeacefulmountain
meadowoperatingacarousel,animagethatsustainedhimthenandinspireshimandadedicatedgroup
ofvolunteerstothisday.
Duringmostofhis31yearsasdirectorofAmnesty International’sUrgentActionNetworkbased in
Nederland – the office that flooded repressive governments with letters and telegrams urging the
releaseofprisonersofconscience–Scottcarvedcarouselanimalsafterhours.Hecarved36different
whimsicalanimals–enoughtooutfitthe1910CharlesLooffcarouselframethatheandvolunteershave
restoredtoworkingorder.
The Looff carousel, built by the man who built the first carousel for Coney Island in 1876, once
delightedridersatSaltLakeCity’sSaltairAmusementPark.Scotthascraftednewwoodenpartsforthe
carousel,and18historicpaintingshavebeenrestoredonroundingboardsthatsurroundthecarousel
abovetheanimals.
Scott retired fromAmnesty International in 2006 and,with an enthusiastic boardof directors and
othercommunityvolunteers, isdevotinghis fullenergies toerecting thecarousel in thecenterof the
townofNederland.
TheCarouselofHappiness isa501(c)(3)non-profitorganizationdedicatedto inspiringhappiness,well-being,andservicetoothersthroughstoriesandexperiences.
Vision(fromtheCaseStatement,Feb2009)InScott’svision,theCarouselofHappinesswillbe:
Anoutpostofsimplejoy.Aplacewherematureriderscanrecapturecarefreemomentsoftheiryouth,
andwhereyoungpeoplecantaketheirfirstspinonlivinghistory.
A unique architectural statement to energy conservation that will inspire all who visit to be more
responsible energy consumers. The building will be LEED-certified and will serve as a demonstration
building for green, energy-saving technologies. Heat will be provided by solar-heated, radiant floors.
Electricitywill be generatedby solarpanels.Amixof recycledandenvironmentally-friendlymaterials
willbeusedthroughoutthebuilding.
Apositive, signatureattraction for theTownofNederland,BoulderCountyandColorado.Carouselsacrossthecountryhavehadabeneficialimpactintheirrespectivecommunities.Locally,weanticipate
thecarousel’spresencewill attractadditional revenue for localbusinessesaspassers-throughstop to
ride.Webelievethecarouselwillbecomeadestinationattractionformany,andweplantoattractvans
andbusesofvisitorsofallages.

Aunique,participatoryexhibitoffolkart.The36carouselanimalswerebornofScott’simagination–a
laboroflovethattook22yearsandcounting.Hedesignedandcarvedeachofthemfrombasswoodand
decoratedthemwithacrylicpaint–techniquesusedbycarouselcarversformorethanacentury.The
collectionincludesahorse,lion,tiger,pig,dolphin,dragon,greatblueheron,cowandlotsofwhimsical
surprises.
A place where education is fun, where a carefree past meets the modern reality of the need to
conserveenergyforthesurvivaloftheplanet.Scottwillmakeaportionofthepublicspaceavailablefor
educationaldisplaysanddemonstrations.
A community place to share art, poetry and literature. Inspired by Scott’s carved animals and
decorations, the carousel building includes a 992-square feet room dedicated to the sharing and
enjoymentofthearts.ArtistsandauthorsfromNederlandandbeyondwillhaveaplacetosharetheir
talentswiththecommunity.
A destination for people with disabilities honoring the carousel’s history of service. Although thecarouseloriginallywasoperatedatSaltairamusementparknearSalt LakeCity,Utah, from1910until
1959, itgracedthegroundsof theUtahStateHospital forpeoplewithmentaldisabilities for27years
until 1986, when Scott purchased it andmoved it to Nederland in pieces. To honor that part of its
history,Scottenvisionsinvitingpeoplewithdisabilitiestovisitthecarouselingroupsorindividually.The
building is carefully designed to serve people with disabilities. The carousel has been adapted to
accommodateseveralpeoplewithdisabilitiesatonce.Agiganticwoodengorillasitsreadytoputhisarm
aroundriderswhousewheelchairs.
AsustainableoutpostofjoyandgivingforColoradochildren.TheCarouselofHappinesswasconceivedas an instrument of giving. It will give joy to all who ride, watch the galloping art, and listen to the
historicmusic,tobesure.ButitwillalsobeaninstrumentofgivingsuccortoColoradochildrendeprived
ofjoyintheirlivesforamyriadofreasons.Revenueswillcomefromridingfees,asmallgiftshopinside
thecarouselbuilding,andproceedsfromspecialeventsheldinaroomdesignedforthispurpose.
AlivingpieceofAmericanhistory:The1910CharlesLooffcarouselthatistheheartoftheCarouselofHappiness isoneofonly about150 surviving carousels from4,000built during thegoldenageof the
American carousel (1880-early 1930s). American craftsman borrowed the basics from Europe, but
Americancarouselsquickly surpassed theiroldworldcousins in imaginationandstyle.Carversmoved
beyondhorsestoanimalsofthejungle,farm,forestandmythology.TheCarouselofHappinessistrueto
thisquintessentialAmerican tradition. Scott let loosehiswhimsical imagination todesign theanimals
and hand carved themaccording to tradition frombasswood, thewood from the Linden tree.When
Scottthrowstheswitchontheoriginalmotor,andthereborncarousel jumpstolifeforthefirsttime,
theCarouselofHappinesswillrejoinarichlegacyofAmericanculture.

AVisionandHopefortheCarouselofHappinessIamwritingthisasapersuasionforthosewhocomeafterme.IhopetoexplainwhyIthinkthis
machine,andthisplace,ismorethanitsnameanditsgenre.Yes,itisacarousel,arideandatourist
attraction.Ihopeitsfutureguardiansthinkofitasmorethanthat.Tomeitisthatbutmoreand
differentthanthat.
Thepurposeofthemachineistospinitsridersandleavethemsomewhereinthecirclebutnowhere
predictableandnowhereuseful.Theanimalsarewoodandpaintyethavespiritsandneedrespect.The
carouselhouseitselfhas12sidesandismeanttoamplifythehappinessandgivetheanimalsaplace
wheretheycanthrive.IthinkitwouldbeniceifriderslefttheCarouselofHappinesswonderingexactly
whattheyjustdid,wheretheyjustspentthelastfewminutesoftheirlives,andeven,whatmightbe
nextforthem.
Iwouldlikeforeverythingthatgoesintothecarouselhousebeplacedtherepurposefully,toamaze,to
enlighten,tobringjoytovisitors.
Ithinkitisimmenselyimportantthattheridebekeptatonedollarandthatthereshouldneverbea
costforvisitorstositinthecarouselhouse.Ifwedoourworkwell,wewillcreateaspacethatwill
renewfolks,willengageandencouragevisitorstotakeadeep,mindfulbreath,andallowthemtogain
strengthtowalkoutandre-engagetheirrealities.
IthinkitismostimportantthatthecarouselbeallowedtobeitselfforthereasonsIhaveexpressed
above.
Whenpossible,Iwouldlikeforthecarouseltohelpothers,howeveritcanusefullydothat.Ifitcanbea
fundraisingplatformforothernon-profitsortheeffortsofotherstodogoodworks,Ibelieveweshould
allowthecarouseltobethatplatform,notworryingaboutanyorganizationalegothatmightwonder
toomuchaboutwhatwegetoutofitorhowitmightmakeuslook.Ihopethosewhofollowmewill
rememberthatthecarouselwasdedicatedtotwoU.S.MarineswhofellintheVietnamWar.Ihopethat
itisnotforgottenthatthecarouselhasahistoryofgivingtopeoplewithspecialneeds.Veteransand
peoplewithdisabilitiesshouldalwaysreceiveawarmwelcomeattheCarouselofHappiness.
Ihopethatthecarouselwillalwayserronthesideofgenerosity.
ItisthepretentionofNederlandanditsresidentsthatthistownismorethanaspotonamap.Andin
factIbelieveitis.Thiscommunity,withitsowncharacteristics,bothcommonandspecial,gainsits
breathfromitsair,itsbeautifulenvironmentandmountains,anditsparticularlywonderfulpeople.Itis
myhopethatpassers-bywillbehelpedbytheirexperienceofthecarouseltotakenoticeofthisplace,
andinsomeway,bebetterpeoplefortheirvisit.

Theframeitselfhasbeeninlargepartrestoredandsomemetalpartshavebeenrebuiltwithnewer
materialsforsafetyreasons.NewwoodhasreplacedoldandIhavedesignednewdecorative
roundingboardswhichincorporate18paintingsfrom1915.Thecarouselisthereforeacombination
ofnewandold:newartdecoratesagrandoldmachine,almost100yearsold.Thesoulofthe
machineremains:turningmillionsoftimesforchildrenscreamingwithdelight.Newanimalsnow
awaitnewchildrentocontinuethecycleoffunandjoy.

ThecarouselwasoriginallybuiltbyCharlesLooff,aDanishimmigrantwho,in1876,builtand
deliveredthefirstmerry-go-round(a.k.a.carousel)fortheConeyIslandamusementparkinNew
York.Mr.Looffwentontobuilddozensofcarousels,manyofwhichhavebeenrestoredandare
stillturninginProvidence,RhodeIsland,SanFranciscoandSantaCruzinCalifornia,Portland,
OregonandSpokane,Washington.In1910,Mr.Looffdeliveredanewly-builtfour-rowcarouseltoSaltairParkjustoutsideofSaltLakeCity,UtahontheshoreoftheGreatSaltLake.

Thereitstayedfrom1910until1958whentheamusementparkwentbankrupt.Duringits48years
atSaltair,itsurvivedtwofiresandthreewindstorms.Onceafiercewindblewtherollercoaster
downonthemerry-go-roundbadlydamagingitstwoouterrows.Soitwasrebuiltasatwo-rowmachine.

In1959,thestateofUtahgavethecarouseltoanewly-builtsmallparkonthegroundsoftheState
TrainingSchool,aresidenceandvocationaltrainingfacilityforindividualswithmentaldisabilities.It
wasputbacktogetherandranfortheschoolresidentsandattimesthecitizensofthenearby
communityofAmericanForkwereinvitedtorideforfree.Severalresidentstoldmethatoncethe
carousel'scenterpolewashitbylightningandindeedIfoundcharredwoodseveralplacedinthemachine'sstructure.
In1986,awomanboughtthecarouselforitsanimalswhichwereauctionedoffseparatelyinNew
York.Thecarouselitselfwasleftforscrap.Ihadpreviouslymetthetruckdriverwhowas
transportingtheanimalstoNewYorkandhecalledmetotellmethatIcouldgetthisoldmachineforlittlemoney.

shape.IhavereplaceditwithSouthernYellowPine,awoodthatcarouselsoftenusedaroundthe
turnofthelastcentury.InfactIhaveusedold-growthpinethatwasgrowingaroundthetimeofthe
AmericanRevolutionandcutdownin1890.ItspentacenturyataSeagram'sfactoryinPeoria,

Abovetheanimalsare18newlydesignedroundingboardswhichframeoriginalpaintingsfroma
1915carousel,whichwasbuiltbyCharlesLooff'sbrother-in-law(Mustbeanotherstorythere.)In
betweentheseroundingboardsare18"stages,"eachofwhichshowsadifferentlycarvedsmall
sculpture.Asthecarouselturns,thesculptureswillformasimpleanimationinwhichasmallgirl
transformsintoawhiteswan,whichchangesintoagreenfrog,whichthenmorphsbackintothegirl.Hereissomethingfortheadultstoenjoywhiletheirkidsridetheanimalsbelow!
TheUniqueValueofCarouselsToday
Therewereover2,500woodencarouselsintheUnitedStatesinthefirstpartofthe20thcentury.
Todaythereareafewhundred.Thosethatremainseemtoelicitamagic,joyfulresponsefromall
whoseeorridethem.Acarouselisasimplemachine,itturnsaroundgoingnowhere,theanimals
goupanddownfornopracticalpurpose,andthehundredsoflightbulbsonlygive11wattsof
powereach,notverypracticalbytoday'sstandards.Butthrowitalltogether,addsomeloud
calliopemusic,andwithoutexception,smilesappear.

Manyofthecarouselsthatsurviveduptothe1970’s,werebrokenupduringaperiodwhen
individualcarouselanimalswereauctionedoffatpricesashighaseightythousanddollars.New
animalshavebeencarvedforsomeofthecarouselstructuresleftbehind,likethisoneandthosenowoperatingintownslikeRepublic,WashingtonandMissoula,Montana.
Carousels,whetherintownparksoramusementparksareacertaindrawforthosethatseeorhearthem.
ProposalforaPartnership
I am proposing a partnership between myself, as the carousel owner/builder, and the Parks andRecreationDepartmentofBoulder,toinstallthiscarouselinanenclosedstructure,onparkproperty,andoperateit,sharingtheproceedsandresponsibilities.In brief, Iwouldoperate andmaintain the carousel on the land and in a buildingwhich theCity ofBoulder provides. The carousel operationwould be insured by the City and the proceeds from thecarouseloperationwouldbesplit50-50.TheBuildingThecarouselwouldliveinitsownbuilding,protectedfromtheextremetemperaturesandweatherweenjoyhere inColorado. Italsoneedstobe lockedupwhennotoperatingforsecuritypurposes.Thecarouseldiameter is41 feet. Italsoneedsa five footsafetyzonearound itwhenoperatingandthisbringsthediameterofthemachinewhenoperatingto51feet.Thereneedstobespaceforpeopletowatchthecarouselsoabuildingwithasixty-footinsidediameterwouldbetheminimumsizeforthiscarousel.Asimpledrawingofaproposeddesign,theverybeginningdesignofastructure,isfoundinAppendixB.InsuranceInsurancecostforoperatingacarouselhasincreasedthree-foldsincethetragiceventsofSeptember11,2001.Thisfactoralonehascausedmanycarouselstoceaseoperation.Thisisdespitethefactthattherehavebeennomajorcarousel-relatedaccidentsduringthisperiod.Mostcarouselsnowoperatingonmunicipalpropertyareincludedintheinsurancecompanyusedbythecityorareincludedinthecity’spolicywhenthecityisself-insured.Iamproposingthatbethecasewiththiscarousel.SafetyConcernsTheCarouselofHappinesswasbuiltin1910byoneofthemajordesignersofcarouselsinAmericafor30years.Thiscarouselwasbuiltasafour-rowmachinebutwasredesignedinthe1940’sasatwo-rowmachineasitremainstoday.Thismeansthatthemachinestructureitselfisoverbuiltforitsridingandcarryingcapacity.Inaddition,whileIhaveusedtheoriginalcenterpoleandsomegears,bearingsandbrackets,insituationswherethereisaquestionabouttheintegrityoftheoriginalpartIhavehadnewparts designed and built tomodern safety standards. still had 4 new crankshaftsmadewhere therewas even a slight question as to the integrity of theoriginal. All other original metal, including the rolled-iron center pole, was also sandblasted andinspectedbeforeadecisionwasmadetousetheoriginalpart.Thecarouselcrankshafts,18-footsweeps,floorplatforms,animalsandriders,areallsupportedfromonerollerbearingatthetopofthecenterpoleandby38metalguyrodswhichconnectthewoodenstructuretothistopbearing.Boththecenterbearingandalltherodshavebeenreplacedusingnewsteel.Thewoodensweeps,cross-braces(whichsupportthecrankshafts)andthefloorplatformshavebeenreplacedwithnewoakand#1fir.Finally, IhavefullyresearchedthecurrentsafetypracticesofoperatingcarouselsaroundtheUnitedStatesbymy18-yearmembershipintheNationalCarouselAssociationandmyattendanceofmostofitsannualNationalTechnicalConferenceswhereissuessuchassafetyarestudiedindetail.DisabilityaccessTheCarouselofHappinesswillhavearamptoitsfloorplatforms,allowingapersonwithawheelchairtoridethecarouselwhileinthechairbyfittingintothefold-upportionoftheGorillaBenchinawaythathasthegorilla’sarmaroundtheriderandtheriderabletoholdthegorilla’shandduringtheride!Twootherbenchesallowolderriderstosafelysittoenjoytheride.HowCarouselsEarnTheirKeepFirst, carousels charge a price for a ride. Some carousels, like the one at Lakeside Park, near St.Catharines,Ontario,Canada,chargeanickel.Others,liketheLooffCarouselinSpokane,Washington,charge$1.00.Themoretheticketcosts,thefewerkidscanride.Thesmallertheticketprice,thelessmoneycanbeusedtokeepthemachineinoperatingintopshape.Iwouldsuggestapriceof50centsperriderofanyage.Second,manycarouselsmakemuchoftheirmoneybyrentingoutthespaceforbirthdaypartiesandwedding receptions, even photo opportunities. The Looff Carousel at Riverside Park in Spokane,Washington,rentstheircarouselfor$300.00athree-hoursession.Ibelievethisisagoodopportunityforthecarouseltoearnmoneyas longasthefacility isnotoftenclosedtothepublicduringregularoperatinghours.Third, the carousel is a draw, a destination attraction for many, bringing business to the area itoccupies.Allthis informationandallthesedetailshavebutonepurpose:tohelpyoudecidethatthiscarouselwillhelppeoplehavealittlefunandenjoythemselvesforawhile.Let’smakethismagichappen.

• TrashaccommodationswillbeprovidedbytheCOHuptothesizeofonestandardblacktrashbagfullofrefuse.AnyadditionaltrashshouldbedisposedofelsewherebytheUser.
Anywillful damage that occurs (not clearly accidental) to the carousel, the building, any building attachments, and any
personalpropertyoftheCOHwillbeassessediftherepaircostisabovetheamountofthesecuritydeposit,andtheUser
agreestoberesponsibleforthatamount.
Userwillabidebyallrulessetforthherein,includingthoseinSection2below,andwilltakecaretobesurethatallEvent
attendeesabidebythem.
Section2.RULES
A.ThefollowingrequirementsmustbeinplaceforphysicaloperationoftheCarousel:
1. AnadministratorortheCarouselDirectormustbepresentonthepremisesandawarethattheCarouselwillbeinuseduringtheperiodoftime.
2. A fully trained, indemnified andRedCross licensedCarouselOperatormustbepresent.Noonewho is notpre-approved(inwritingorviaemail)andtrainedbytheCarouselAdministrationisallowedtooperatetheCarousel.
3. NovisiblyintoxicatedpatronwillbeallowedtoapproachorridetheCarousel,norwillanyotherpersonthatCOHstaff,intheirsolediscretion,determinemightposearisktohimselforothersifallowedtodoso.
B.FoodandAlcohol
1. NoalcoholcanbeservedonCarouselpropertyconcurrentwithphysicaloperationoftheCarousel.Ifalcoholistobeservedthefollowingmusttakeplace:
• If the party is open to the public (not by invitation only), User must obtain proper permits from the Town ofNederlandandtheCountyofBoulder.
• COHmustbenotifiedpriortotheexecutionofthisAgreementthatalcoholwillbeservedattheEvent.Oncethedistributionofalcoholicbeveragesbegins,theCarouselwillbeturnedoffandnotbestartedagainforthecourseoftheEvent,norwillEventattendeesbeallowedinsidethefencethatsurroundstheCarousel.
• Afullylicensedandinsuredbartendermustbehiredtodistributethealcohol,andthatbartender’sinsurancemustcoveranymishaps,injuriesorconsequencesofservicetovisiblyintoxicatedpatrons.
2. FoodmaybeservedinthepartyroomonlyduringoperationalhoursoftheCarousel.IftheentireCarouselBuildingis rented and no patrons other than Event attendees are present, food may be served in the gift shop area.However,undernocircumstancescanfoodordrinkbetakenbeyondtheinnerfencethatsurroundstheCarousel.
• UndertheleaseagreementthattheCarouselmaintainswithCaribouCompanies,nofoodmaybepreparedtobesold on COH premises. Any food or drink provided for an Event at the Carouselmust be brought by the User,purchasedfromalocalbusinessandbroughtin,orcatered.
• The Carousel urges all Event attendees to reduce waste by using reusable china and silverware or at leastbiodegradablepaperproductsforserviceofpartyfood.
C.Animals
NoanimalsotherthanworkingserviceanimalswillareallowedintheCarouselbuildingunlesspre-approvedbytheCarousel
Director inwritingorviaemail.Undernocircumstanceareanimals thatarenotserviceanimalsallowed insidethefence
surroundingtheCarousel.

Section3.RELEASEFROMLIABILITYANDINDEMNIFICATIONAGREEMENT
InconsiderationoftheirwillingnesstoallowUsertheuseofitsfacilityinNederland,Colorado,Userherebyforeverreleases
COH,CaribouCompanies(landowner)itsmembers,employees,assigns,andsuccessors,fromanyliabilityonanyclaimsof
anykindwhatsoeverinanywayarisingoutoftheuseoftheFacility.Thisreleaseisintendedtobethebroadestpossible
releaseallowedbylaw.Itincludes,butisnotlimitedto,strictliabilityclaims,contractclaims(expressorimplied),warranty
claims,andtortclaimsbasedoncommonlaworanystatute,ordinance,orregulation.Italsoincludesanyandallclaimsfor
injuriesordamagessustainedbyUserorUser’sinviteesorlicenseesduringorinconnectionwiththeuseoftheFacilityand
whichareallegedtohavebeensustained,inwholeorinpart,asaresultofthenegligenceofoneormorepersonsprotected
bythisreleaseprovision.
Asusedhereintheterm“Facility”includesthephysicalstructurethatmovesinclusiveofwoodanimals,poles,motorsand
pinefloor,thebuildingthathousestheCarousel,thegiftshop,theofficesandstoragearea,therestrooms,thepartyroom
andthepuppettheatreandroom.Italsoincludestheareaof10feetbeyondthefoundationoftheCarouselBuilding.
Further, if anyEventattendeeorother thirdpartymakesa claimagainstor suesanypersonorentityprotectedby this
releaseprovisionforanydamagesofanykindallegedlysustainedbythemasaresultofuseoftheFacility,Useragreesto
fullydefendandindemnifyCOH,andCaribouCompanies,itsmembers,employees,assigns,andsuccessors,withregardto
anysuchclaimorlitigation.
ThisreleaseprovisionshallbebindingonUserandallUser’sheirs,agents,assignees,successors,andonanyotherperson(s)
whomight otherwise be entitled to file suit ormake a claimonUser’s behalf. This release provision also applies to all
owners,directors,andofficersofCOH,CaribouVillageandCaribouCompanies.
Section4.OTHERTERMS
a.NotAssignable.ThisAgreementmaynotbeassignedbyanypartywithoutthewrittenagreementoftheotherparty.
b.GoverningLaw.ThisAgreementshallbegovernedbythelawsoftheStateofColorado.
c. Reading; Review of Counsel. User represents that User has carefully read every provision of thisAgreement,andthattheyhavehadtheopportunitytohavequalifiedcounselreviewthisAgreement.d.Venue;Waiverof Jury;NoticeRequirement. Theexclusivevenue forany legalactionarisingoutof thisAgreementshallbeintheCountyorDistrictCourtofBoulderCounty,Colorado.Inanysuchactionallpartieswaivetherighttotrialbyjury.BeforefilinganyactionarisingoutofthisAgreement,UsermustprovideCOHwithwrittennoticeofitsclaiminreasonabledetailbeforefilingsuchaction.e. Legal Expenses. In any legal action arising out of this Agreement the losing party shall pay the prevailing party’s
reasonableattorneysfeesandcosts.
f. Interpretation. Should any provision of this Agreement require judicial interpretation, the Court interpreting this
Agreementshallnotapplyapresumptionthatthetermshallbemorestrictlyconstruedagainstonepartyortheother
byreasonoftheruleofconstructionthatadocumentistobeconstruedmorestrictlyagainstthepartywhopreparedit.
g.EntireAgreement;Modification. ThisAgreementcontainsall the representationsbyeachparty to theothersand
expressestheentireunderstandingbetweenthepartieswithrespecttothemattersatissue.ThePartiesagreethatall
priorcommunicationsaremergedintothisAgreement,andthattherearenotermsorconditionsotherthanthoseset

forthherein.Nostatementorpromiseofapartyshallbebindingunlessreducedtowritingandsignedbythatparty.No
modificationsofthisAgreementshallbebindingunlesstheyareinwritingandsignedbyallParties.
h. Section Titles. The section or paragraph titles in this Agreement have been inserted for convenience and easy
reference, and they shall not be interpreted to define, limit, extend or describe the scope of any provision of this
Agreement.
