Pursuant to Section 164 of the Kentucky Constitution, the Fiscal Court of Rockcastle County, hereby creates a franchise of privilege for operating and maintaining a general electric system for the purpose of generating and selling electric current and transporting electrical power throughout the rural section of Rock- castle County. This franchise or privilege shall begin When the purchaser's bid is accepted and the sale of the franchise to the purchaser is approved and confirmed by the Fiscal Court, and if shall continue for a term of twenty years thereafter. Par. 3. This franchise shall not be exclusive. Par, 4. The purchaser of this franchise shall have the right and privilege to do q'ny and all necessary acts required for the operation of electrical lines, in cordance with the purpose of this franchise. Par. 5. The purchaser agrees that if, as a result of its operation of the electrical system, any damage is done to the county roads of Rockcastle County, said damage shall be repaired by the purchaser as soon as reasonably possible, and under the supervision of the County Road Engineer, if there be one, if not, under the County Judge and the Fiscal Court. The electrical system shall be done in such o manner as tp'not reasonabl yinterfere with the free use, drainage and travel of thi» countf roads in Rockcum County. The purchaser further agrees to hold said -county harmless from any and all claims against it by anyone by re< of or resulting from the operating of its electrical system. Par. 6. Prior to, offering said franchise for sale, the Sheriff of Rockcastle County shall advertise the time and place of the sale and the character of the franchise by adr vertisements to be published at least twice in some paper having general circulation in. Rockcastle County, Ken- tucky, the first of such advertisements shall be pub- lished -at least ten days prior to the date of said sale. Under authority granted by the following order of the Fiscal Court of Rockcastle County, I announce a sale of a franchise or privilege to operate a general electric business in Rockcastle County, Kentucky, to the highest and best bidder at the front door of the courthouse in Mt. Vernon, Kentucky on the 18th day of January, 1965, at or about the hour of 1:00 p. m. Sold order as appears recorded in Minute Book of the Rockcastle County Fiscal Court, is in words and figures as follows:

"Thereupon came South Kentucky Rural Electric Cooperative Corporation and moves the court to adver-se* f f tanr i fedt an electric franchise, authorization to operate a general electric business, providing electric ser-vice to consumers in Rockcastle County, over facilities already existing and owned by South Kentucky in Rock-castle County.

Thereupon came James W. Lambert, County AN tomey for Rockcastle County, and presented the follow-ing. franchise which, had been carefully n a m l i H , and approved by him:

For. 1. Pursuant to Section 164 of the Kentucky Constitution, the Fiscal Court of Rockcastle County, hereby creates a franchise of privilege for operating and maintaining a general electric system for the purpose of generating and selling electric current and transporting electrical power throughout the rural section of Rock-castle County.

Par. 2. This franchise or privilege shall begin When the purchaser's bid is accepted and the sale of the franchise to the purchaser is approved and confirmed by the Fiscal Court, and if shall continue for a term of twenty years thereafter.

Par. 3. This franchise shall not be exclusive. Par, 4. The purchaser of this franchise shall have

the right and privilege to do q'ny and all necessary acts required for the operation of electrical lines, in cordance with the purpose of this franchise.

Par. 5. The purchaser agrees that if, as a result of its operation of the electrical system, any damage is done to the county roads of Rockcastle County, said damage shall be repaired by the purchaser as soon as reasonably possible, and under the supervision of the County Road Engineer, if there be one, if not, under the County Judge and the Fiscal Court. The electrical system shall be done in such o manner as tp'not reasonabl yinterfere with the free use, drainage and travel of thi» countf roads in Rockcum County. The purchaser further agrees to hold said -county harmless from any and all claims against it by anyone by re< of or resulting from the operating of its electrical system.

Par. 6. The Sheriff of Rockcastle County, shall of-fer the franchise hereby granted to the highest and best bidder on the 18th day of January 1965, at 1:00 o'-clock p. m.,.at Public Auction at the Rockcastle County Courthouse door in Mt. Vernon, Kentucky, which shall be made to the highest and best bidder, subject to the ap-proval of the Rockcastle Fiscal Court.

Prior to, offering said franchise for sale, the Sheriff of Rockcastle County shall advertise the time and place of the sale and the character of the franchise by adr vertisements to be published at least twice in some paper having general circulation in. Rockcastle County, Ken-tucky, the first of such advertisements shall be pub-lished -at least ten days prior to the date of said sale. The Sheriff shall not receive any bid for this fmnchisa for less than the amount of $1.00 and the costs and ex-pense incident to the sale of said franchise -and the said Sheriff will report his action hereunder to the court on the 19th day of January 1965."
