    This is my beloved niece Lacey Gaines.She was murdered just 6 days after her 20thbirthday on Dec. 7, 2009 in her apartment in

    Justice, Il. She was strangled with a cordand her throat was cut with a 10 kitchenknife. No forced entry, no robbery, nosexual assault, no defensive wounds. Hermurder left her infant son without a motherand her family in possible danger. Therehave been no arrests in her case.Lacey grew up among the cornfields ofGrant Park, Il. She was a polite andkindhearted little girl with a sense ofhumor. She attended a Lutheran DaySchool and went to France as part of astudent exchange program. She spoke

    fluent Spanish.When she was 15 yrs old (under the age ofconsent) she met and began a sexualrelationship with a Latino man who was 10years older than she. A baby was born andshe lived with the father for a time. Butthen Lacey began calling me and telling meshe was being abused. I advised her to go tothe shelter and see a therapist, get an orderof protection, and make police reports. Shedid all of these things.She met and began a relationship with

    another Latino man. She moved to theSunset Apt in Justice in the spring of 2009.Just a short time prior to her murder sheasked her father if she could move back

    home. Unfortunately she was foundmurdered shortly after making the request.My mother called and told me Lacey hadbeen found murdered. It was a horribleshock.Lacey was a treasured daughter, a closesister, a tender mother, an unforgettableniece, a generous cousin, and a foreverfriend. She was unique, full of life andlaughter, she had a spirit which could not bebroken, it was a light she let shine brightly.She still shines ever brighter in our heartsand in Heaven.By Laceys cousin Adam OestmanTrust me when I tell you that my cousinLacey was different from you and I.     When I first heard the news that Lacey waskilled my mind went blank. I didnt knowwhat to think, how to react or how to feel. Iwas in shock. A short time later the realityof what had happened and the sadness inmy heart was all to present. I immediatelybegan to think of all the times I wassupposed to call Lacey and didnt; the timeI was supposed to take her to that concertand cancelled; the times I argued with herand never apologized. . .

    The Victims Voice and Citizens Against Homicide have lost

    a friend in the death of Gail. Gail was devoted to her family,yet found time to be involved in her community.Gail and Jacque met through sorrow when Gails parentswere murdered. She worked tirelessly to keep their story inthe public arena. Gail was also a guest on Jacques showThe Victims Voice. Jacque believed and felt it a greathonor to know Gail and be her friend. In Jacques wordsGail was a lovely, modest, friendly, and extremelyvivacious woman who will be deeply missed by all whoknew her. Jacque and CAH and The Victims Voice willnot allow the public to forget her parents until their case is

    solved.

    Just a few words of thanks for everyone that worked andplayed in the 17th annual CAH Golf Tournament that washeld on Friday the 13th of August. Usually in the issue ofour Newsletter we have photos and all the winners listed.However this month the NL is especially filled with thegreater than usual requests for paroles. One that did nothave time to go into the NL but has been posted on ourwebsite along with the ones featured in this months NL.

    There is also an open letter to the Governor of Californiaregarding a request that the Governor not sign the releasefor a murderer. The letter speaks for itself thus I will notrepeat the details here. What I will say here about that caseis that again we have a Judge, Judge Goethais makingdecisions from the bench and TELLING the Board ofParole Hearings to vacate their decision. The Judge isThomas M. Goethais, Orange County Superior CourtJudge. As of this writing we were not able to gather anyspecific information about this Judge. If anyone has detailsabout him we certainly would like to know. By this ruling

    he is not a friend of victims or the laws that we currentlyhave in place. He supports murderers. Someone we should

    NOT have sitting on the bench.Next month we will have all the details of fun and fundraising that went on at the tournament.

    OPEN LETTER TO GOVERNOR SCHWARZENEGGERRE: GARY ECCHER PAROLE RELEASE

    On August 10, 1985, Gary Eccher murdered Lianne Lando. He bludgeoned her, strangled her, submergedher in bath water, and electrocuted her. Per the Orange County Probation Officers report, Gary Eccherstated, a spur of the moment physical altercation ensued and that escalated into the death of my girlfriend.

    Deputy District Attorney, Rebecca Olivieris statement objecting to parole (page 32, line 13-15),demonstrates a lack of remorse and insight by Gary Eccher into the murder of Lianne Lando. Note thatGary Eccher indicated that this crime is simply an isolated incident between a couple who was livingtogether. Governor Schwarzenegger, murder is NOT a simple isolated incident. Gary Ecchers decisionto murder Lianne Lando has changed lives forever . . . that words cannot describe.Do these statements reflect insight into the commitment offense? Gary Eccher refers to his murder ofLianne as an incident that just so happened to be a spur of the moment physical altercation that escalatedinto the death of my girlfriend. Gary Eccher murdered Lianne Lando and he cannot come remotely closeto using the word murder. He just doesnt get it. There is no remorse or insight into what he chose to do . .. Murder Lianne.On July 15, 2009, Gary Eccher, CDC# D-36746 appeared before the California Board of Hearings Panel for

    a Life Term Parole Consideration Hearing. The Panel concluded that he was not yet suitable for parole,because he posed a present and unreasonable risk of danger to society, or a threat to public safety if releasedfrom prison. Considered were (3) three disciplinary actions and the commitment offense continued to be afactor that influenced the Panels decision of unsuitability. The Panel noted and conceded that thecommitment offense no longer weighed heavily against suitability, but it was a consideration for the panel.The Panel noted that the offense was committed in an especially heinous, atrocious and cruel manner. It wascarried out in a calculated manner that demonstrated an exceptionally callous disregard for humansuffering and the motive certainly was trivial. The Panel mentioned that subsequent to Lianne Lando beingmurdered by Gary Eccher, he showered, took property from the residence and fled to Mexico.The Panel noted their concern about Gary Ecchers issue of being self-absorbed and self-centered. Hefailed to adhere to some direction when cautioned by the Panel about his perceived personal agenda. Heignored the warning and kept going. Only after a second reminder did he divert his course of action. The

    Panel was also concerned about his flawed judgement when confronted with issues of dealing with rightversus wrong.On March 11, 2010, Thomas M. Goethais, Orange County Superior Court Judge, granted Gary Eccherspetition for Writ of Habeas Corpus. He ordered the Board of Parole Hearings (BPH) to vacate its July 2009decision finding Gary Eccher unsuitable for parole and directed the BPH to conduct a new parole suitabilityhearing. He directed that the BPH find Gary Eccher suitable for parole unless either previouslyundiscovered evidence or new evidence subsequent to Gary Ecchers July 2009 hearing regarding hisconduct, circumstances or change in his mental state supports a determination that he currently poses anunreasonable risk of danger to society if released from parole.Judge Goethais notes in his order, that private counsel (appointed by the court) contends there is no evidenceto support the BPH conclusion that Gary Eccher would currently present a danger to society on release.

    Counsel requested that the court order the BPH to vacate its decision denying parole and to hold anotherhearing at which, it is to find Gary Eccher suitable for parole.Gary Ecchers murder of Lianne Lando is described by Judge Goethais as occurring 24 years ago. Also, thatthe crime is both temporally remote and mitigated by circumstances indicating the conduct is unlikely torecur. Therefore, the BPH may not continue to rely solely on the commitment offense to deny parole,because the circumstances of the crime alone no longer support the conclusion that Gary Eccher remain acurrent threat to public safety.How careless for a presiding Superior Court Judge to insinuate that Liannes murder is temporal; Liannesdeath is forever a far cry from being temporary and not eternal. Shame on Judge Goethais fordiscounting the life of Lianne Lando.Judge Gothais, in his decision to grant Gary Ecchers Writ of Habeas Corpus and order for a new parole

    hearing is flawed, as he failed to recognize the considerations the July 2009 BPH Panel made in reaching thei

    decision to deny Gary Eccher parole. The July 2009 BPH Panel did not rely solely on the commitment offense itheir decision to deny parole, as Judge Goethais states in his order of March 11, 2010 (page 4, paragraph 2).On July 8, 2010, Gary Eccher appeared before the California Board of Parole Panel in compliance with a court ordeissued by Judge Thomas Goethais. The Panel concluded that Gary Eccher is suitable for parole.The Panel based its decision for parole suitability on several accomplishments as listed on page 46. However. thPanel also noted for the record, on page 45, the fact that they really could not assess, you chose not to talk to us anwe certainly did not hold that against you. We certainly understand that you have a right not to talk to us anexercised that right. But we really didnt have a lot. And you really didnt talk with clinicians, so we really didnhave a lot to go on today. So, we couldnt do a really good gauge one way or the other. But we did understand whathe court order said and we have absolutely no new information from the last hearing that would prevent you fromgetting a grant, like we were instructed by the judge.

    Presiding Board of Parole Hearing Commissioner John Peck provides an extensive narrative, which clearlydelineates information that justifies denial of a parole date. He provides a brief reference to the issue of oppositiofor suitability. It would appear that together, Commissioner Pecks narrative and the voices of opposition, arsufficient enough to justify a decision that Gary Eccher is not suitable for parole. However, he must have beeintimidated by Judge Goethais order. Additionally, I find it disturbing to read that private counsel appointed by thcourt actually requested that the court order the PBH to vacate its decision denying parole and to hold anothehearing, at which it is to find Gary Eccher suitable for parole.We believe that language used in Judge Goethais order and request made of the court by private counsel intimidatethe July 8, 2010 Panel to render their ill-advised decision to grant Gary Eccher parole.Governor Schwarzenegger, please focus your attention to pages 34, 35 and 36 of the BPH, dated July 8, 2010Clearly, Gary Eccher has yet to fully examine his complicity in the murder of Lianne Lando.Commissioner John Peck states in his decision to grant parole, the positive aspects of your case outweigh the othe

    considerations. Proponents for parole and opponents of parole have submitted written documents and gavtestimony in regard to parole consideration for Gary Eccher. Speaking from those with experience, it is commoknowledge that Laudatory Chronos are handed out like candy on Halloween night.Gary Eccher was found suitable for parole and a decision review at the Board of Parole Hearings is now pendingThe case will go to your office sometime in early November 2010. You will then have approximately 30 days to makyour decision. Our projection is that by early December 2010, your decision should be rendered.Governor Schwarzenegger, Citizens Against Homicide and its entire membership asks that you NOT approve thdecision of the BPH Panel of July 8, 2010 to grant parole to Gary Eccher. Lianne Lando was the victim of murder bGary Eccher leaving her family devastated and victimized..     CANDLELIGHT VIGIL FORLACY MARIE FERGUSON

    On Tuesday, August 24, 2010, Gene, our daughter, Eryn and I attended a beautiful expressionof love, honor and remembrance for Lacy Marie Ferguson in Modesto, California. Lacy is thedaughter of Boni Driskill, a Victim Advocate with Wings of Protection.

    The evening was symbolic . . as the warm winds reminded her family that Lacy was actuallythere, blowing soft kisses to them all. And, of no coincidence, a gorgeous soft yellowswallowtail butterfly floated throughout the entire candlelight vigil ceremony.Lacys life was cut short on August 23, 2003, as she and her boyfriend made a quick trip to alocal convenience store. As they were preparing to return home, Lacy and her boyfriend werecaught in the middle of a rival gang shooting; her boyfriend was shot in the arm . . . and Lacywas shot in the head. An innocent bystander, a beautiful life; a loving daughter and youngmother . . . snatched away by gang violence.Someone knows the details of what happened that night on August 23, 2003 in ModestoCalifornia. The family is still desperately seeking answers and justice. When this employee refused, they began thenext course of action.On March 24, 1992, while Denise Poer, her boyfriend and Lloyd Maddox were socializing, a 9mm handgun, in themurderers position accidentally discharged four (4) times; the latter fatally wounding Lloyd Maddox. DenisePoer had devised what she thought was a very clever story to get away with the perfect murder. This was a crimeof convenience, as Lloyd Maddox was simply an obstacle in this murderers way. She is a cold-blooded murderer,who does not deserve to be released from prison

She had been savagely beaten andstrangled to death. Evidence also showed that the murderer had stomped and left boot imprints on her body. RobertJ. Mahoney, a man with a history of violence against women and the last person to be seen with Cheryl, became theprime suspect. Cheryl had been introduced to Mahoney on the last night that she was seen alive. Her death was anact of extreme brutality by a man that had no reason to harm her.Robert John Mahoney must be held accountable for his personal choice to kill and must accept the consequencesDue to the heinous nature and the brutality of this crime, justice demands that this convicted murderer be denied
