Bullying defined

• Any willful attempt or threat to inflict on another person when accompanied by an apparent present ability to do so OR an intentional display of force such as would give the victim reason to fear or expect immediate bodily harm.

• Three documented bullying offenses in the same school year will result in a Level III Misconduct, a Student Disciplinary Hearing, a recommendation of expulsion, or placement in the Alternative School Program.

Simple Assault

• OCGA 16-5-20 defines Simple Assault as:

1. Attempts to commit a violent injury to the person of another; or

2. Commits an act which places another in reasonable apprehension of receiving a violent injury.

* A person who commits the offense of Simple Assault shall be guilty of a Misdemeanor.

Simple Battery

• OCGA 16-5-23 defines Simple Battery as:

A person commits the offense of Simple Battery when he or she either:

1. Intentionally makes physical contact of an insulting or provoking nature with the person of another; or

2. Intentionally causes physical harm to another.

*A person who commits the offense of Simple Battery shall be guilty of a Misdemeanor.

Battery

• OCGA 16-5-23.1 defines Battery as:

A person commits the offense of Battery when he or she intentionally causes substantial physical harm to another.

*Visible bodily harm is defined as bodily harm capable of being perceived by a person other than the victim and

may include, but is not limited to, substantially blackened eyes, substantially swollen lips or other facial body parts,

or substantial bruises to the body. * A person who commits the offense of Battery shall be

guilty of a Misdemeanor.

ROBBERY• OCGA 16-8-40• (a) A person commits the offense of robbery when, with intent to

commit theft, he takes property of another from the person or the immediate presence of another: (1) By use of force; (2) By intimidation, by the use of threat or coercion, or by placing such person in fear of immediate serious bodily injury to himself or to another; or(3) By sudden snatching. (b) A person convicted of the offense of robbery shall be punished by imprisonment for not less than one nor more than 20 years. (c) Notwithstanding any other provision of this Code section, any person who commits the offense of robbery against a person who is 65 years of age or older shall, upon conviction thereof, be punished by imprisonment for not less than five nor more than 20 years.

Disorderly Conduct• OCGA 16-11-39.

(a) A person commits the offense of disorderly conduct when such person commits any of the following: (1) Acts in a violent or tumultuous manner toward another person whereby such person is placed in reasonable fear of the safety of such person´s life, limb, or health; (2) Acts in a violent or tumultuous manner toward another person whereby the property of such person is placed in danger of being damaged or destroyed; (3) Without provocation, uses to or of another person in such other person´s presence, opprobrious or abusive words which by their very utterance tend to incite to an immediate breach of the peace, that is to say, words which as a matter of common knowledge and under ordinary circumstances will, when used to or of another person in such other person´s presence, naturally tend to provoke violent resentment, that is, words commonly called 'fighting words';

• (4) Without provocation, uses obscene and vulgar or profane language in the presence of or by telephone to a person under the age of 14 years which threatens an immediate breach of the peace. (b) Any person who commits the offense of disorderly conduct shall be guilty of a misdemeanor. (c) This Code section shall not be deemed or construed to affect or limit the powers of counties or municipal corporations to adopt ordinances or resolutions prohibiting disorderly conduct within their respective limits.

Terroristic Threats

• 16-11-37. (a) A person commits the offense of a terroristic threat when he or she threatens to commit any crime of violence, to release any hazardous substance, as such term is defined in Code Section 12-8-92, or to burn or damage property with the purpose of terrorizing another or of causing the evacuation of a building, place of assembly, or facility of public transportation or otherwise causing serious public inconvenience or in reckless disregard of the risk of causing such terror or inconvenience. No person shall be convicted under this subsection on the uncorroborated testimony of the party to whom the threat is communicated.

Punishments

• Most of the crimes talked about are punished by one year of confinement or less. These are called misdeameanors

• Some of the crimes discussed are called felonies and carry punishment of more than a year (+) in prison.

EXAMPLES OF BULLYING

• Touching other students/ horse-playing.

• Gossiping/ Spreading malicious rumors can move from harassing to bullying if cause to physical harm.

• Taking items away from a student by using threatening tactics.

• Showing acts/ signs of gang behavior.

• Throwing items at other students.
