Collectors. First-day cover cancel-lations may be obtained by one of thefollowing methods:

a. Customers Affixing Stamps.Collectors may purchase stamps attheir local post offices and affix themto their envelopes. All envelopes mustbe addressed. Peelable address labelsare recommended and a filler card ofpostal card thickness should be in-serted in each cover. Orders must bepostmarked by October 21, 1977,and should be addressed to: First DayCancellations, Postmaster, Holly-wood, CA 90028. No remittance isrequired.

NOTE: The due date differs fromthat specified in Handbook P-6 be-cause of the change in the FiscalYear, which began October 9, 1976.This report will include all incentiveaward transactions through A/P 13ending October 7,1977.

Discontinuance ofAPO/FPO Numbers inHawaii & AlaskaEffective September 3,1977

The Department of Defense hasdetermined that some of their mili-tary post office operations in Hawaiiand Alaska are a duplication of serv-ice provided by the U.S. Postal Serv-ice. Therefore, effective September 3,1977, the following APO/FPO num-bers will be discontinued:

This change should be brought tothe attention of all window clerks, toprevent continuing acceptance ofSAM/PAL mail to these APO/FPOunits. Special instructions will be is-sued to Postal Concentration Centerson interim handling of mail ad-dressed to these discontinued APO/FPO addresses.

Idaho and NebraskaState Tax Changes

COST-OF-LIVING ANNUITY INCREASEThe Civil Service Commission has

announced that civil service annuitieswill be increased by 4.3 percent ef-fective September 1, 1977. This in-crease is based on the full percentagechange in the Consumer Price Index(CPI) from December 1976 throughJune 1977.

A. Notice to Employees

1. Installation heads should informeligible employees contemplating re-tirement that a 4.3 percent cost-of-living increase is payable effectiveSeptember 1, 1977. Eligible employ-ees should also understand, however,that the retirement law guaranteesthat an immediate (not a deferred)annuity which begins after the effec-tive date of a cost-of-living increasewill be no less than it would havebeen had it commenced on the effec-tive date of the increase. In essence,this law removes the requirementthat an employee's annuity must be-gin on or before the effective date ofa cost-of-living increase in order forthe employee to benefit from theincrease.

2. The annuity paid to an em-ployee who retires on an immediateannuity no later than August 31,1977, with annuity beginning on orbefore September 1, 1977, will bedetermined by comparing:

(a) The annuity that would havebeen payable based on service andhigh-three average pay as of Febru-ary 28,1977, plus the 4.8 percent cost-of-living increase that was effectiveMarch 1, 1977, with

(b) The amount of annuity earnedas of the date of retirement. The em-ployee is entitled to whichever rate ishigher. That higher rate will be in-creased by 4.3 percent effective Sep-tember 1,1977.

3. Employees who separate for re-tirement on an immediate annuity onor after September 1, 1977, with an-nuity beginning on or after Septem-ber 2, 1977, and before the effectivedate of the next following cost-of-living increase, will be entitled only tothe larger of:

(a) The annuity actually earnedas of the separation date, or

(b) The annuity earned as ofAugust 31, 1977, plus the 4.3 per-cent cost-of-living increase effectiveSeptember 1,1977.

B. Disposition of Annual LeaveBalance

1. Bargaining Unit EmployeesUnused current accrued annual

leave which exceeds the amount thebargaining unit employee is author-ized to carry-over from year to yearmust be used before retirement or itwill be forfeited. The provisions inold POSTAL MANUAL 721.34 on pay-ment for accumulated and currentaccrued annual leave are applicableto employees covered by collectivebargaining agreements.

2. Non-Bargaining Unit Em-ployees

Non-bargaining unit employeeswill be paid a lump sum for unusedannual leave up to the authorizedcarry-over and for accrued annualleave earned in the year of retirement(separation).

C. Granting LWOP in CertainPending Disability RetirementCases

1. A disability annuity begins theday after the employee's separation,or the day after his or her last day in apay status if disability and service re-quirements are met.

2. There will probably be somepending disability retirement cases inwhich the Civil Service Commissionwill be unable by August 31, 1977, todetermine and notify interested par-ties whether the applicant is totallydisabled. If the applicant is carriedin a pay status after August 31, 1977,the employee will not be eligible forthe comparative computation of an-nuity back to February 28, 1977 (seepar. A-2). To avoid this situation,applicants may request, and installa-tion heads may grant, leave withoutpay beginning September 1,1977.

If the disability claim is disallowed,sick or annual leave with pay may beretroactively substituted for the leavewithout pay. If the claim is allowed,the annuity begins September 1,1977; unused accumulated annualleave is payable in a lump sum (seepart B above); and unused sick leaveis included in the annuity computa-tion as in other retirement cases.

3. Where a large amount of sickleave is involved, it may be more ad-vantageous for the employee to re-main in a pay status on sick leave andbe separated when the sick leave ex-pires. Although the employee wouldnot be eligible for a comparative an-nuity computation back to February

28, 1977, he or she would be eligiblefor a comparative computation backto August 31, 1977 (see par. A-3).

D. Retirement CounselingForm 2411, Check List for Prere-

tirement Interviews, provides a guideon information that should be of in-terest to prospective retirees. Someinformation of general interest is re-peated here for convenience.

1. Federal Income Tax(a) A civil service annuitant does

not pay Federal income tax on annu-ity until he or she has received an-nuity payments equal to the amountcontributed to the Civil Service Re-tirement Fund.

(b) The Tax Reform Act of 1976(Public Law 94-455), enacted Octo-ber 4, 1976, amends the Federal taxlaw dealing with the sick pay exclu-sion for individuals who retire on dis-ability.

(c) Based on new Internal Reve-nue Service rules, an individual mustmeet all the following provisions toexclude up to $5200 of disability an-nuity from Federal income tax underthe sick pay/disability exclusion:

(1) The taxpayer must retire ondisability, and be permanently andtotally disabled for any substantialgainful employment.

(.2) The taxpayer must be underage 65 during any year in which theexclusion is claimed. The exclusionends at the beginning of the year inwhich age 65 is attained or at the be-ginning of an earlier year in whichthe taxpayer makes an irrevocableelection not to have the exclusionapply.

(3) If the taxpayer's income fromall sources exceeds $15,000, theamount of annuity which may be ex-cluded from tax is reduced one dollarfor each dollar of income over$15,000. If the taxpayer is married atthe close of the taxable year, the dis-ability exclusion is available only ifthe taxpayer and his or her spouse filea joint return for the taxable year, ex-cept in the case of a husband and wifewho lived apart at all times duringthe taxable year.

(d) An employee who retires un-der the disability provisions of theCivil Service Retirement Law (totaldisability for the position held at re-tirement) must prove to the satis-faction of the Internal RevenueService that he or she meets thedefinition of disability contained inthe new tax law (total and perma-

nent disability for any substantialgainful employment).

(e) Under the Tax Reform Actof 1976, there is no income tax ad-vantage for disability retirement ofan employee who will be 65 or overin the calendar year in which he orshe retires, since the sick pay/disability exclusion ends no laterthan the beginning of the year inwhich age 65 is attained. For em-ployees under age 65, clearcut advicecannot be offered regarding the in-come tax advantage of disabilityretirement versus optional retirementbecause the definition of disability inthe new tax law is different and morestringent than the definition of dis-ability in Civil Service retirement law.From a retirement standpoint, op-tional retirement can be processedmore rapidly as the employee is notrequired to go to the time and ex-pense of documenting his or herdisability for retirement purposes.Disability retirement is still advan-tageous to the disabled employee whohas less than the 12 years of credit-able service required to continuehealth and life insurance coverageinto retirement. (See sections D-2andD-3.)

(f) Questions relative to anyaspect of Federal income tax are tobe referred to the District Director ofInternal Revenue.

2. Federal Employees Group LifeInsurance

(a) Regular (basic) life insurancecontinues free after retirement on animmediate annuity with 12 or moreyears of service, or for disability.

(b) If the employee has had op-tional insurance for all service duringwhich it was available to him or her,it may also be continued into retire-ment. However, optional insurancepremiums are paid (by automatic de-ductions from monthly annuity)until age 65. After age 65, optionalinsurance also continues free.

(c) When an employee retires atage 65 or over, or when he or shereaches 65, if he or she retires beforethat age, both regular and optionalinsurance reduce by 2 percent amonth. These reductions continueuntil the amount of insurance reaches25 percent of the amount in force atretirement.

3. Health Benefits (Hospitalizationand Medical)

-An employee who retires on animmediate annuity with 12 or moreyears of creditable service, or for dis-ability, may continue health benefits

coverage into retirement if he or shehas been enrolled (or covered as afamily member) in a Federal healthplan:

(a) During the 5 years of serviceimmediately preceding retirement, or

(b) During all service since his orher first opportunity to enroll.

4. Election of Survivor Annuity(a) Retiring employees who are

married should be made aware ofthe small reduction in annuity forproviding survivor benefits for spouse.Married employees (male and fe-male) who elect an annuity withoutsurvivor benefits to spouse will be- re-to their retirement application con-firming this election and indicatingthey understand the monetary differ-ence involved.

(b) Retirement counselors are ad-vised that a recent change in the re-tirement law provides that an an-nuity will again be reduced by thesurvivor benefits to spouse will be re-computed and paid at the unre-duced rate when the retired em-ployee's marriage to the designatedspouse ends. The higher unreducedannuity rate will be paid for eachfull month during which the retiredemployee is not married. When theretired employee remarries, die an-nuity will again be reduced by thesame percentage reductions whichwere in effect at the time of theretirement.

(c) Annuity increases based onthis change in law will be paid onlyfor applicable periods which beginon or after November I, 1974. As inall matters involving retired employ-ees, inquiries concerning annuity ad-justments should be directed to dieU.S. Civil Service Commission.

E. Processing Retirement Applica-tions

Installations should accuratelyprocess all retirement applicationsand related documents through ap-propriate channels to postal datacenters as soon as possible.

F. Documents Required

The following forms (or informa-tion) must be completed and sentto respective personnel service cen-ters for forwarding to postal datacenters in all retirement cases:

1. SF 2801, Application forRetirement.

2. Form 2526, Request for Person-nel Action, and Form 50, Notificationof Personnel Action.

The prohibition against mailing atspecial third-class rates by religious,educational, scientific, and philan-thropic action organizations, in sec-tion 134.53, POSTAL SERVICE MAN-UAL, is no longer valid. ANNUAL OWNERSHIP, MANAGEMENT, AND CIRCULATION STATEMENTPublishers of second-class publica-

tions must file Form 3526, Statementof Ownership, Management, and Cir-culation, at post offices of originalentry on or before October 1, 1977.Important—Use ONLY April 1976or March 1977 editions of Form3526. Publishers authorized to mailunder the provisions of section132.22, POSTAL SERVICE MANUAL(PSM), must also publish such state-ments as required by section 132.6,PSM. Specific instructions are givenon the reverse of Form 3526.

Publishers authorized to mail pub-lications at the postage rates in132.121, PSM (regular rate publica-tions) , are also required to submit anannual written request for authorityto mail matter at the phased rates ofpostage provided pursuant to 39United States Code 3626. Provisionhas been made on the April 1976 andMarch 1977 editions of Form 3526for publishers to comply with this re-quirement when submitting the state-ment of ownership and circulation.

Responsibility of Postmasters

Postmasters at original entry officesmust:

1. Assure that all publishers fileproperly completed statements on orbefore October 1, 1977. Only theApril 1976 and March 1977 edi-tions of Form 3526 are to be used.Other editions of Form 3526 will bereturned.

2. Promptly report publicationsthat have been discontinued to theOffice of Mail Classification, Ratesand Classification Department,Washington, DC 20260.

3. Determine whether there havebeen unauthorized frequency of is-sue and title changes or any otherchanges in qualifications underwhich authorization to mail at thesecond-class rates was originally is-sued. The title and frequency infor-mation as shown on the Form 3526must be in agreement with file copiesof authorizations for second-classpublications received from Head-quarters. If there have been unau-

thorized changes, have publishersobtain appropriate authorization byfollowing prescribed procedures formaking such changes.

4. On April 1976 editions of Form3526, record the publication num-ber on page one near the title. OnMarch 1977 editions of the form,check item 1A for the correct publi-cation number.

5. Review completed Forms 3526for completeness and accuracy to as-sure that the following points arecovered:

a. The known office of publication(item 4), as defined in section132.222, PSM, must be located at theoffice where the publication has origi-nal entry.

b. Item 12 must be completed if thepublisher wishes to mail at less thanthe full rates established pursuant tothe provisions of the Postal Reorgani-zation Act.

c. Complete circulation data mustbe shown in item 10 for all publica-tions.

d. Make sure item 10B2 is in sub-stantial agreement with the copies de-clared on Form 3541, Statement ofMailing—Second-Class Publications,if the publication has no additionalentry offices. If the publication doeshave additional entries, compare item10B2 with the findings of your veri-fication of publisher's records (section125.66, PSM). Determine the rea-sons for any significant differences.

e. Publications authorized undersection 132.22 must meet the circu-lation requirements of sections132.225 and 132.227, PSM; therefore,they must have a paid subscriptionlist and may not be designed pri-marily for free circulation. It is re-quired that over one-half of the totalcopies circulated of such publicationsbe circulated to persons who havepaid for the copies at a rate abovenominal.

f. Publications authorized undersection 132.23 which are authorizedto carry general advertising, must alsobe circulated primarily to personswho have paid for the copies at arate above nominal. (See section

132.232 a through d, PSM.) Forauchpublications, item IOC of Form 3526,should be greater than 50 percent ofitem 10E. If item 10G is not greaterthan 50 percent of item 10E, a veri-fication of the publication's circula-tion should be made in accordancewith section 125.66, PSM.

g. Both columns of item 10 dataare to be based upon all mailings. Forexample, if a publication is pub-lished daily including Sunday, datain item 10 should be the average ofthe seven issues.

6. After Forms 3526 are reviewedthey are to be submitted to the Officeof Mail Classification in accordancewith the instructions on the form. Ifthere are any deficiencies in the formssubmitted by the publishers, a memo-randum explaining the actions beingtaken to have them corrected shouldbe attached. Envelopes containingonly Forms 3526 without deficienciesmust be endorsed: 1977 Forms 3526enclosed.

Envelopes submitted to the Officeof Mail Classification containingForms 3526, which also contain mem-orandums, Forms 3548, Postmasterand Publisher Joint Review andVerification of Circulation, or reen-try applications, should not bear theendorsement

When submitting Forms 3526 forprevious years, the envelope shouldbe endorsed Forms 3526 enclosed,preceded by the year for which theyare being submitted.

Supplies of Form 3526

Forms may be ordered as requiredfrom supply centers using Form 4750,Special Requisition for Supplies. Donot order any other form or item onthis requisition. These forms, whichshould be completed in triplicate, areonly required at post offices whichserve customers having publicationsfor which original entry second-classmailing privileges have been author-ized as of October 1.
