The NCBVA Board meets face-to-face at least once a year, and always at the annual meeting. A number of important actions were taken by the Board at its February 3rd meeting in Las Vegas:
NCBVA Makes “Goodwill” Payment Out of Legal Fund
Legal and Regulatory Fund so that NCBVA would be able to offer financial assistance in potentially precedent-setting court cases, such as the on-going case in Savannah, GA. The Board was apprised by Attorney Scott Calkins on the status of the Savannah case and Executive Director Tom Monahan reported that, as a result of fundraising efforts,

really missed a good experience—all the way around. You’re go-ing to read it elsewhere in this issue, but it bears repeating that we had a 55 percent increase in companies represented, and we be-lieve that’s due to NCBVA partnering with the World of Concrete. Those industry members who came to Las Vegas really appreciated that they could lit-erally do two things at the same time—take in an outstanding tradeshow AND meet with fellow burial vault manufacturers.
Notwithstanding the obvious benefits of mega tradeshows, the importance of spend-ing time with people who are also involved in your line of work cannot be overstated. In recent years our industry has been tak-ing some hits: from cremation, which was originally thought to be a passing fad; from aggressive steel and plastic manufacturers of burial vaults; from foreign competition; from Internet-based competition; and now, from the “green burial” trend.
The opportunity to get together and share ideas for meeting any current challenge is the strength of our organization. I’m pleased that, on the whole, we don’t whine about the economy or forces that may be having a negative impact on us. We look for solutions
to our common problems—as some say, “How to make lemon-ade out of lemons.”
Arriving at a game plan for meeting the “green burial” challenge was an excellent seminar sponsored by NCBVA and facilitated by Maureen O’Brien. (More details are covered in the

One key point is that our industry has been “green” for years, but that message isn’t coming out loud and clear—especially to funeral home directors on whom we’ve been depending, more or less, to point out the benefits of concrete burial vaults (composed of natural ingredients that come from the earth; the ability to prevent chemicals from escaping into the earth; and capable of doing the ultimate job of efficiently protecting loved ones).
Those of us who participated in Mo’s seminar came to the conclusion that no clear definition of “green” exists, however; that there are “shades” of “green;” and that education is the key to helping the public and funeral home directors think of the concrete burial vault as the best and “green-est” choice.
Kermit the Frog, one of Jim Henson’s most popular and loved Muppets, immortalized individuality with the song, It’s Not Easy Being Green. Remember it? It ended with the words, “I am green and it’ll do fine, it’s beautiful, and I think it’s what I want to be.”
If NCBVA can collectively come up with an excellent defini-tion of green and shades of green, we have the means as a mem-ber of the Funeral and Memorialization Information Council (FAMIC) to get the word out to everyone. This calls for action: Who is willing to step forward and be part of a task force to take on this challenge for the benefit of all our members? Or do you have a better idea? Call me.

One of the most frequent issues I find dur-ing plant visits for certification purposes is the lack of an evacuation map and plan. When I enter a building for the first time, my mind paints a scenario in which all the occupants and I must exit in a hurry. I strongly recommend that you engage in this mental exercise, too, and prevent a potential business nightmare. Don’t guess! Plan for safety in any emergency.
When to EvacuateHere are just a few reasons that an emer-gency evacuation might be necessary:

Simple Evacuation Plans Evacuation plans must be simple and easy to follow in the event of an emergency.Every employee must be familiar with the building layout and be able to exit safely from anywhere in the building. Training is required to insure that every employee understands emergency evacuation proce-dures.

According to the National Funeral Directors Association (NFDA), the Haitian government has taken control of the mortuary response in Haiti and has not asked for or authorized assistance from any government or private organization. NFDA expressed outrage and concern to federal officials about media reports of how the Haitian government is handling the large number of casualties.
The federal government and mass-fatality response community share NFDA’s concern and displeasure and are working to communicate this to Haitian officials.
In particular, the federal government is concerned with the identification and repatriation of the bodies of U.S. citizens who died in the earthquake.
DMORT assessment teams are on the ground in Haiti and are only able to appraise the situation and provide reports to the federal government; DMORT has not been authorized to assist in the Haitian government’s mass-casualty response.
The federal government’s mass-casualty resources have been activated and are on stand-by, ready to deploy as soon as the Haitian government asks for and authorizes assistance. Additionally, more

Update on Georgia LitigationBy J. Scott Calkins, Esq.NCBVA Counsel
For more than a year now, NCBVA President Steve Hatfield, Execu-tive Director Tom Monahan and I have attempted to keep you all informed regarding the serious concrete burial vault litigation now taking place in Georgia.
Counsels for the parties to the litigation were advised by the
the trial-court-granted injunctive relief based on its legal determina-tion that the appellants’ concrete vault ban was unreasonable under Georgia Cemetery Law, the appeal does not fall within this Court’s equity jurisdiction. Accordingly, the appeal is transferred to the Court of Appeals.”
In my discussion with Georgia counsel for the concrete burial vault companies involved, I was advised by him that the cemeteries’ counsel may file a reply brief and that the vault counsel may need to file a short response. After the filing of the briefs, the Court of Appeals will either request oral arguments in the case or simply rule, based on the record and briefs submitted. It is expected that a ruling will be forthcoming by that Court in the fall of this year.
Through my columns in The Bulletin over the course of the past year, I have advised NCBVA members of the seriousness of this litigation. An adverse decision in Georgia could well be used as precedent in litigation in other states.
I surely don’t need to remind you that litigation can be very expensive. The vault manufacturers in the Savannah area have already expended in excess of

Partnering NCBVA’s annual convention with the World of Concrete (WOC) proved to be an enticing carrot for members of the concrete burial vault industry. Although most would still agree that the economy is sluggish,

Discussion of Hot IssuesSpeaker Maureen (“Mo”) O’Brien, founder and CEO of Maureen O’Brien & Sons, was brought in to facilitate a discussion on the question, “What is the best way for concrete burial vault manu-facturers to compete in the green burial market?”
“The green burial trend is the current pain in this indus-try, and we have to talk about it,” Mo announced at the start of her session. She then established what she described as a cafe scenario, a coffee-house discussion-group situation. In addition to the primary discussion question, Mo encouraged participants

to think further outside the box and expanded the question to include: Are there secondary markets in which you are already involved or that you could enter?

He said it would be a logical step for NCBVA to come up with a comprehensive definition of a “green burial,” including “shades of green,” and present it to FAMIC for industry-wide adoption
