By now most of you must have seen or heard all the discussion on mineral rights and the cash payouts being paid out to homeowners by oil companies for the rights to drill and pump oil. Also, you might have also seen the many signs around our area regarding the BCMRC: Bedford Colleyville Mineral Rights Coalition. As the President of the BMHA, I was invited to attend the initial meeting of the BCMRC as the representative of the Brook Meadows Homeowners Association along with other HOA representatives and selected members of non HOA neighborhoods. The purpose of the meeting was to form and organize a coalition of home, church and business owners within a 2000 acre demographic that encompasses all areas north or Harwood to Hal Johnson and between Hwy 26 and the 121. This coalition would represent all of those who sign a Letter of Intent to join the coalition in negotiating with the oil companies for the best deal possible. Here are some bullet points on what is what:• Power comes in size, the bigger we are and the more organized we

are the more power we will have to get the best deal possible.• This is a total volunteer organization.• Costs: would be negotiated into the settlement• Myth: only one oil company has the rights to drill in this area.

each segment comprises the various associations within that area and will have a team leader.

• Letter of Intents: Non-binding letters of intent can be withdrawn but a signed lease cannot. So know your facts before you sign.

• The coalition only negotiates the deal for the best price. When the time comes and a signing date is set, each homeowner will have to sign an individual lease. The idea here is again the bigger the better.

• The coalition will form various committees to help organize the effort and to hire a lawyer to represent the coalition.

• Mineral Rights: There are a lot of questions as to who owns the mineral rights to your home and there have been a lot of vague answers to that question. There are also some legal aspects that can determine what has or can be transferred from owner to owner. Everyone must check their own deed to find out.

• However, regardless of what your deed says do not assume that is the final answer.

• A complete title search has to be done and the recommendation was that you should not to worry about doing the search for yourself because the land managers are already doing that. If they have already contacted you then they have most likely found out that you have some portion if not all of the mineral rights to your land.

• The two thousand acre area has been divided into 6 segments and

BMHA Legal Update The BMHA Board is pleased to announce, an end to the legal bills for BMHA. The lawsuit brought by a small group of Brook Meadows homeowners has been settled. An Agreed Order was signed by Judge Jeff Walker and filed with the Tarrant County Court. The Board elected to settle the lawsuit with an Agreed Court Order, for the following reasons: - Avoids legal fees starting at $50,000.00 with estimates to $150,000.00 to defend the case.

- Complies with the expressed wishes of the majority of the homeowners

- Retains the original status of BMHA incorporation papers and CC&Rs as filed with Tarrant County in 2006.

- Prevents the Board and the Plaintiffs from discussing any further details of the settlement

- Prevents Plaintiffs from refilling similar lawsuits- Keeps membership levels higher than when it was a voluntary association

- Keeps the BMHA insurance at lower rates.- Allows the sub-division to move forward adn build opportunities to live and work together in a neighborly fashion.

Due to the request of several homeowners in Brook Meadow, BMHA will be sponsoring a second Neighborhood

It is growing season, so keep your yard looking good by mowing and trimming at a minimum of every other week this time of year. Also, have you read what other cities in the metroplex have added to their list of residents’ yard requirements? If you said required trimming of curbs and sidewalks, you would be correct. Let’s make sure we do these things on our own, and don’t give the city a reason to create a new code.From the City of Colleyville website. “Q. What is considered “too tall” for grass or weeds? A. 'It is unlawful to allow weeds, grass or any plant that is not cultivated to grow to a height in excess of 12 inches upon any property within the corporate limits of the City of Colleyville.' Chapter Two of the City Code of Ordinances establishes a $50.00 notification fee.” The minimum height requirement for tree limbs overhanging city streets is 14-feet above the street and 7-feet above the city sidewalk. BMHA recently trimmed all of the trees it maintains along Glade Road and suggests homeowners who back up to Glade and have trees inside their fenced area, whose limbs reach out to the city sidewalks inspect your tree limbs and trim them to meet city code too. Cars parked on the street and in driveways in front of homes should be in good running order have current inspection stickers and registration and be moved every 24 hours.

How many of you have noticed an increased interest in the appearance and safety of Brook Meadow this summer? We sure have, emails, phone calls and personal visits by those of you living in Brook Meadow to the Board and your neighbors have kept us busy and on our toes. So at the request of many of you, we are posting a few of the City of Colleyville ordinances and guidelines that help keep Brook Meadow a safe and beautiful place to live.Garbage & Recycling CollectionFrom the City of Colleyville website. “Most trash and debris, when properly bundled and/or acontained properly, can be disposed of at curbside with your regular Monday and Thursday garbage service. To report a missed trash pickup on your street, click here or call 817-503-1113.The following is a brief description of the disposal services provided to Colleyville residents by Independent Environmental Services, Inc. (IESI). All containers and bags must be left at curbside no later than 7:00 a.m. on pick-up day. The Fountain at Jackson & Lakeside is now under contract with a pool maintenance company to keep the water clean and wholesome.
