BROCHURE FOR AUCTION SALE OF COMMERCIAL PLOTS IN ABHINABA BIDANASI, CUTTACK

TERMS AND CONDITIONS

1. Plots- Provision have been made for different categories of plots as indicated in Schedule-A. i) The sizes/area of the plot are tentative and subject to change. ii) The plots be sold on “ As is where is basis”. iii) The plots can not be used for storage of sale of Alcoholic/Narcotic items/Meat/Egg & Fish. The applicant has to clearly mention

the nature of use of the plot he/she intends to take up.

2. Earnest Money- earnest Money as per Schedule- A mentioned against each plot is to be deposited along with Bid document in shape of

Demand Draft/Banker’s Cheque payable to Cuttack Development Authority, Cuttack-12. The E.M.D shall be adjusted in case of

successful bidders otherwise it will be refunded as per the condition mentioned in clause-II.

3. Registration amount- The Bid shall accompany with Non-refundable fee of Rs.2,000/- (Rupees two thousand) only per bid in shape of

Demand Draft/Banker’s Cheque on any bank payable at Cuttack. 4. The applicant shall submit the application in the enclosed form along with required documents in a separate envelope through Regd.

Post/speed post only so as to reach the undersigned on or before 25.05.2012 by 5.00 . P.M. The envelope containing the application

form shall be clearly super scribed in bold letter “APPLICATION FOR PURCHASE OF COMMERCIAL PLOT AT ABHINABA BIDANASI,

CUTTACK’ addressed to the Secretary, Cuttack Development Authority, Arunodaya Bhawan, Cuttack-12.

5. Separate application form with all required documents/EMD/Registration fee should be submitted in a sealed cover withproper

superscription for each plot applied for.

6. The sealed envelopes containing the offer and other documents will be opened at 11.00 A.M on 26.05.2012 in the Conference Hall of

Cuttack Development Authority, Arunodaya Bhawan, Link Road, Cuttack-12 in presence of the Bidder who wish to attend, person other

than bidder has to produce a letter of authority duly attested by the applicant/bidder.

7. Firms/Company has to produce Registration/Constitution of the Authority duly attested by Gazetted Officer / Notary public.

8. Bid shall be acceptable in multiple of Rs.50/- per sft. Example- For bidding against offset price Rs.1837 /- per sft of plot No-1-com-11/1(H) of Sl. No-01 of Schedule-A one should quote Rs.1850 /- or Rs.1900 /- or Rs.1950 /- sft etc.

9. Other parameters shall be according to the Building Bye-Laws, 2001 of Cuttack Development Authority. 10. The highest bidder shall be required to deposit the 10% of the Bid amount within 72 hours of opening of the bid otherwise the earnest

money will be forfeited. Remaining balance amount shall be deposited within 30 days from the date of issue of Demand Notice. Inability to deposit the balance amount within the prescribed time limit shall rendered the bid invalid and the total EMD amount along with 10% of the Bid amount and registration amount will be forfeited. In such a case the second highest bidder will be allotted the land at the highest bid amount. In case of equal bidding, plot will be allotted by draw of lottery.

11. Refund of EMD shall be made through Account Payee Cheque on receipt of application for refund and surrender of original receipt of deposit from the unsuccessful applicants.

12. The single bid in respect of any plot is not acceptable. 13. The allottee shall be responsible for obtaining water supply and electric connection from the concerned Departments at his/her own

cost and risk. 14. The EMD will be refunded to the unsuccessful bidders after finalization of the Bid. 15. The CDA reserves the right to summerarily rejected any application not fulfilling any or all the conditions mentioned above. The

Authority reserves the right to reject any or all the applications without assigning any reason thereof. 16. Bidders who fail to take over possession of the allotted land within 15 days of allotment shall be required to pay service charges as

would be fixed by CDA till he/she takes over possession. In case possession is not taken within 3 (three) months of allotment being made, CDA shall have the right to cancel the allotment and dispose of the property at its sole discretion. The allottee will have to submit a written undertaking to abide by the above terms and conditions at the time of final payment.

17. The plots shall be allotted on long term lease basis. 18. The applicant will not be entitled to transfer the plot by way of sale or otherwise part with possession of the whole or part of the same

except by way of inheritance without the previous consent of the Authority in writing. The Authority reserves the right to refuse to give such consent in its absolute discretion without assigning any reason thereof. In the event of transfer or otherwise parting with possession of the plots without obtaining previous consent of the Authority in writing, such transfer or parting with possession shall not be recognized by the Authority & it shall be open to the Authority to cancel the allotment/terminate the lease & resume the plot.

-3- In the event of consent being given to such transfer, the Authority reserves the right to impose such terms and conditions for such transfer as it may think fit and the Authority shall be entitled to claim and recover transfer fee as would be decided at its discretion. The decision of the Authority regarding fixing of the transfer fee referred to above, shall be final and binding. In case the Authority feels that the plot, if transferred, will cause inconvenience to neighbour allottee or the plot is required for its own use it shall exercise the right of pre-emption and will pay to the allottee the market value of the plot minus transfer fee realized plus the cost of the plot if any, as would be determined by Authority.

19. The brochure and application form can be obtained from the cash counter of Cuttack Development Authority, Cuttack-12 on submission of the original deposit challan from Orissa State Co-op Bank Ltd, Link Road, Arunodaya Bhawan, Cuttack-12 Rs 500/- (Rupees Five hundred) only and the said application form can be down loaded from the CDA’s web site i.e http://cdacuttack.ori.nic.in and the bidder shall deposit Rs 500/- (Rupees Five hundred) only in shape of Banker’s Cheque/Demand Draft in favour of Finance & Accounts Member, CDA towards the cost of the Brochure alongwith application payable at Cuttack.

20. Lease deed in due course will be executed in favour of the allottees and the cost thereof will be borne by the allottees as per rules. 21. The allottee shall have to take permission of the Cuttack Development Authority before starting of any construction over the plot.
