1. Introduction
Transport Infrastructure Ireland (TII) has been invited to attend a session of the Committee of Public Accounts. In order to assist the members of the Committee, TII is pleased to present this briefing paper. In this paper we set out some background information on:

2. Background to TII
Transport Infrastructure Ireland
Transport Infrastructure Ireland (TII) is a non-
commercial semi-State body which operates
under the aegis of the Department of Transport,
Tourism & Sport. Our mission is to provide high
quality transport infrastructure and services,
delivering a better quality of life and supporting
economic growth. TII was formed on 31st July
2015 from a merger of the Railway Procurement
Authority and the National Roads Authority.
TII's primary function is to provide an integrated approach to the development, maintenance and operation of the national road network and light rail infrastructure.
In relation to national roads, our key role is to secure the provision of a safe and efficient network of national roads. This includes responsibility for the planning and supervision of construction and maintenance of national roads. TII works with different partners to fulfil this role:
A number of major new motorways have been procured on a Public Private Partnership basis;
The remainder of the motorways and dual carriageways are maintained by contractors under long term contracts; and
Local authorities continue to work as road authorities for their respective areas.
In relation to light rail, the core functions of TII is to secure the provision of such light railway and metro railway infrastructure as may be determined from time to time by the National Transport Authority (NTA). Funding for light rail and metro railway infrastructure is provided by the NTA. This submission is limited to discussing the delivery aspects of light rail, as NTA is responsible for planning and funding of the light rail networks.

One Major PPP contract commenced construction in 2016 which was the N25 New Ross bypass. This project along with the other two PPP projects, the M11 Gorey Enniscorthy and the M17/M18 Gort to Tuam, were the only Major projects at construction in 2016.
The N17/N18 Gort to Tuam opened to traffic on 27th September 2017.
5. National Road Maintenance
The national road maintenance allocation in 2015, 2016 and 2017 has remained largely unchanged and is €39m for 2016.
As recently as 2008 the maintenance budget was €58m, but this figure was cut sharply during the financial crisis and has not been increased subsequently.
The maintenance budget is used for drainage, signs, litter picking, grass cutting, verge trimming, pot hole filling, boundary and safety fence repairs, lighting, and the like, and for winter operations such as road weather information services, salt supply and distribution, and clearance of snow and ice. The maintenance budget also funds

incident response activities on the M50 and other motorways and this is an increasing demand on maintenance funding.
6. Regional & Local Roads
The grant allocations for Regional & Local Roads, administered by TII on behalf of the Department of Transport, Tourism & Sport, totalled €371m in 2016.
7. Public Private Partnerships (PPPs)
TII has entered into thirteen road PPP Contracts and also a PPP contract for the provision of motorway service areas. Following the recent (27th Sept 2017) opening of the N17 Gort to Tuam scheme, PPP operated roads now comprise some 33 per cent of the c.1270km of motorway/dual carriageway network. Two PPP schemes are currently under construction i.e., the M11 Gorey-Enniscorthy scheme and the N25 New Ross Bypass Scheme.
PPP payments in 2016 amounted to circa €109m. PPP payments will increase in the coming years with the opening of the N25 New Ross Bypass and M11 Gorey-Enniscorthy schemes. There are no further road PPPs in procurement at this time.
The thirteen road PPPs comprise:
Eight toll road concession PPP Contracts –
in the case of six of these PPP Contracts, traffic risk rests entirely with the PPP Co. In the case of two of the PPP Contracts, i.e. the M3 Clonee-Kells Scheme and the N18 Limerick Tunnel, the PPP Contract provides for a sharing of downside traffic risk (referred to as Variable Operation Payments) between the PPP Company and TII, and
Five Design Build Finance Operate Maintain (DBFOM) PPP Contracts
- three of which are operational (M50, N7/M11 & M17/M18) and two of which are in the construction phase (M11 Gorey-Enniscorthy & N25 New Ross both of which are to open in 2019). The PPP Companies on these schemes are reimbursed through Availability Payments paid by TII.
Risk Sharing Payments
Variable Operation Payments payable for 2016 amounted to €5.2m of which €0.8m was for the M3 Clonee-Kells scheme and €4.4m was in respect of the N18 Limerick Tunnel scheme
The Variable Operation Payments apply where traffic volumes are below traffic volumes specified in the respective contracts. The Variable Operation Payments contribute to the senior debt service requirements.
Variable Operation Payments, under a low traffic growth scenario, are expected to continue to 2025 (the concession term runs to 2052) on the M3 Clonee-Kells scheme.

Variable Operation Payments are expected to continue throughout the concession term, which runs to 2041, on the N18 Limerick Tunnel scheme.
Risk Sharing Receipts
Amounts receivable by TII under risk share receipts were €6.9m in 2016. These payments arose from traffic related revenue sharing on the M4 Kilcock-Kinnegad and M1 Drogheda Bypass schemes (totalling €3.5m) and on insurance cost savings across a number of schemes of €3.4m.
Traffic related revenue share payments are expected to exceed Variable Operation Payment amounts in future years.
Service Area PPP
TII awarded a Motorway Service Area Contact in 2009.
The Contract includes service stations located on the M1 and on the M4. The service areas have been operational since 2010 and the contract runs to 2034. All revenue risk rests with the PPP Co.
Amounts receivable by TII for revenue share on this contract amounted to €2.0m in 2016 and revenue share payments will continue throughout the concession period.
Motorway Service Areas – Tranche 2
A tender competition was held by TII to procure the fit out, operate the Gorey Service Area and to design, build, fit out and operate two other service areas; on the M6 at Athlone and on the M9 at Kilcullen. In August 2015, prior to the award of the contract, one of the unsuccessful tenderers issued legal proceedings seeking a judicial review of the tender evaluation process leading to the selection of the preferred tenderer. In December 2016 the Applicant requested the Court to put a stay on its judgement and the legal challenge was subsequently withdrawn by the Applicant at the end of April 2017.
TII has now resumed contract discussions with the preferred bidder in order to bring this tender to financial close.
8. Public Transport Construction and Improvement
Works at construction during 2016 included the following:
Luas Cross City.
Luas Green Line Infrastructure Upgrade.
Luas Green Line Capacity Enhancement.
In accordance with the Government’s Capital Investment Plan - Building on Recovery 2016 – 2021, TII assisted the NTA on the planning and design of New Metro North

M11 Gorey to Enniscorthy PPP
The permanent fencing works and the site clearance are now substantially complete. Earthworks operations and culvert construction are now well advanced. Works are ongoing on the bridge structures, including both railway bridges and the River Slaney crossing. The Ballywater wind farm diversion works are complete. Approx. 48% of the works are complete. Permit to Use date is 31 July 2019.
M17/M18 Gort to Tuam PPP
The mainline opened to the public on 27th September 2017 which was two months early.
N25 New Ross Bypass (PPP)
Earthworks are 70% complete. The works include a very large bridge over the river Barrow. Foundation works to all 8 piers and 2 abutments on the River Barrow bridge are completed and pier stem construction has commenced. Work on construction of the bridge deck has commenced. Testing of the cable and saddle system for the bridge has commenced. Approximately 57% of the works are complete. Permit to Use date is 31 January 2019.

CAPITAL INVESTMENT PLAN PROJECTS WITH PLANNING APPROVAL

N4 Collooney to Castlebaldwin
Archaeological works and Ground Investigations are ongoing. Designers have been appointed for the preparation of the tender documents, managing the tender process and construction monitoring. Projected construction start date is Q2/2019.
N5 Westport to Turlough Advanced works including Fencing & Hedge Clearance and Archaeology are completed. Designers have been appointed for the preparation of the tender documents, managing the tender process and construction monitoring. Projected construction start is Q1/2021.
N7 Naas Newbridge Upgrade
The contract for site monitoring has been awarded. Kildare County Council has issued the Letter of Acceptance to the successful tenderer. It is expected that activity will commence on site in the coming weeks. The scope of the Design & Build contract includes the Sallins Bypass and the Osberstown Interchange on the M7. These works are being funded separately by DTTAS
M8/N40/N25 Dunkettle Nine expressions of interest were received. Five candidates have been shortlisted. It is intended that Invitations to Tender will issue in October.
N22 Ballyvourney to Macroom
Archaeological works are 50% complete. EIRGRID and Cork County Council have sought procedural advice from An Bord Pleanála in relation to pylon relocation. Projected construction start is Q1/2020.
N56 Dungloe to Glenties (Rolling Programme)
This scheme is being delivered in 6 sections. Two sections are now complete, from Cloughbolie to Boyoughter and from Boyoughter to Kilkenny. The Letter of Intent to award the construction contract for the third section, from Kilkenny to Letterilly, was issued by Donegal County Council to the successful tenderer on 18th September.
N56 Mountcharles to Inver (Rolling Programme)
Donegal County Council will construct the project in sections commencing with the section from Mountcharles to Drumbeigh. The tender process is underway with tenders due to be returned in October 2017.
N59 Moycullen Bypass Improvements on the line of the existing road are complete. The design and build tender documents for the bypass were completed some time ago. Procurement of technical advisors for the preparation of the tender documents, managing the tender process and construction monitoring is due to commence in Q4/2017. Projected construction start is Q1/2021.

CAPITAL INVESTMENT PLAN PROJECTS REQUIRING PLANNING APPROVAL

N2 Slane Bypass (incl. land)
Designers have been appointed by Meath County Council. Public Consultation in relation to Constraints has been undertaken. Meath County Council and TII have engaged in pre-appraisal discussions with the evaluation unit of DTTAS in compliance with the DTTAS Common Appraisal Framework. The competition for the Ground Investigation contract has commenced.
N6 Galway City Ring Road
The National Park and Wildlife Service (NPWS) have carried out a preliminary review of the Natura Impact Statement and the Biodiversity chapter of the Environmental Impact Appraisal Report. A further pre-application consultation meeting took place with An Bord Pleanála (ABP) on 31st August and this consultation process is ongoing. As advised by ABP, Galway County Council will request more comprehensive feedback from NPWS so that all issues of concern are addressed in advance of the submission of the scheme to ABP. The review of the business case has been completed by DTTAS and DPER and no issues of concern were identified. The scheme will be submitted to An Board Pleanála when NPWS have completed the review of the documents and any issues raised are addressed.
N21/N69 Foynes to Limerick
Preparation of the documentation for planning approval is ongoing. Two Ground Investigation contracts are nearing completion. Limerick County Council will seek a pre-application consultation with An Bord Pleanála in October 2017.
N28 Cork to Ringaskiddy This scheme was submitted to An Pleanála on 15th May 2017 which was in advance of the date for the Introduction of the new Environmental Directive. The date for receipt of submissions to ABP was the 18th August. Over 130 submissions were received. No date has been given for the oral hearing.
N72 Mallow Relief Road (incl. land)
Cork County Council are advancing the feasibility study.

N5 Ballaghaderreen Bypass to Scramogue
Review comments were received from DTTAS. The Business Case has been revised and resubmitted to DTTAS. Revision of the EIAR, NIS and CPO in compliance with the new EIA directive is underway.
N59 Westport to Mulranny
This project has planning approval. Land acquisition is underway, construction of the first two sections of the scheme is complete. Tender documentation has been prepared for a third section.
N11 M50 to Glen of the Downs
The feasibility study was published in April 2017. The project will commence as a Major Scheme in Q4/2017.
N13/14/15 North Donegal TEN-T
Donegal County Council have appointed the designers and work is ongoing on feasibility and design.
N14/N15/A5 Link This scheme is a cross-border project. The section south of the border was approved by An Bord Pleanála in 2014. Progression of the scheme is contingent upon completion of the statutory processes in relation to the A5. Report of Planning Appeals Commission complete.
Limerick, Cork A Project Appraisal Plan has been prepared and will be submitted to DTTAS for review and comment.
N52 Ardee Bypass This project has planning approval. Land acquisition is complete. A competition for the task of preparing the tender documents, managing the tender process and monitoring construction is underway. It is anticipated that the tender documents will be completed in Q4 2017.
N59 Maam Cross to Oughterard and Maam Cross to Clifden
The section of this project from Maam cross to Oughterard has been approved by An Bord Pleanála with a condition that requires the agreement of NPWS and IFI to method statements. Agreement has been reached for ground investigations in the section between Maam Cross and Bunakill which is outside the catchment of the Owenriff river. Pavement works are underway on a 7km section east from Bunnakill. The scheme which covered the section between Maam Cross and Clifden was refused planning approval by An Bord Pleanála.
N69 Listowel Bypass The Business Case was approved by DTTAS and DEPR. Kerry County Council submitted the EIS to An Bord Pleanála on 12 May and published the CPO. The oral hearing was conducted over three days commencing 5th September 2017. The decision of An Board Pleanála is awaited.
N86 Dingle to Tralee This project has planning approval. The first 4km section of the scheme is being constructed as minor scheme, Lispole to Mountoven. The construction completion date is Q2/2018.

PROJECT STATUS October 2017
Luas Cross City Luas Cross City is on schedule to commence passenger operations / service in December 2017. Driver training and traffic signal optimisation commenced in October 2017.
Green Line Infrastructure Upgrade
Green Line Infrastructure Upgrade comprises extension of 11 platforms on the existing Luas Green Line between Sandyford and Harcourt stops with associated power and systems works to facilitate the operation of 55m long trams. The project is on schedule to be completed by end of November 2017
Green Line Capacity Enhancement (Sandyford Depot)
Extension of the existing Sandyford Luas Depot to accommodate 55m long trams is underway with track laying commencing in October 2017.

PROJECT STATUS October 2017
New Metro North The project is currently at Route Selection stage and will commence public consultation in Q1 2018.
