XXXX ALE HOUSE FUNCTION HIRE - GENERAL TERMS & CONDITIONS
In this Agreement, “XXXX Ale House” means the XXXX Ale House located at the corner of Black and Paten Streets, Milton, Brisbane QLD 4064.We will endeavour to make your function in the XXXX Ale House Restaurant or Theatrette (each a“function room”) a complete success.The agreement includes:
(a) these general terms and conditions (“Terms and Conditions”);
(b)
(c) the XXXX Ale House Policy set out in Schedule 1 these Terms and Conditions (“House Policy”).
(“Agreement”).The Terms and Conditions will prevail in the event of any inconsistency.Please feel free to discuss this Agreement with our Function Manager.1. PARTIES TO THIS AGREEMENT
1.1
Castlemaine Perkins Pty Limited (ABN 26 009 656 713) (“we, us, our”).
1.2 you agree to be bound by the terms of this Agreement.
2. TENTATIVE BOOKINGS2.1 If you have contacted us to arrange a tentative booking
(“Initial Enquiry”), we will hold a tentative booking for you for a period of 5 working days or as otherwise arranged with the Functions Manager (“Booking Period”).
2.2 As soon as possible following the date of Initial Enquiry, we will:(a) (b) quote an estimate of the hire fee based on the information
regarding the function provided by you;(c) quote a deposit which will be a reasonable proportion of
the estimated hire fee (“Deposit”); and(d) advise you of any Bond or additional charges payable
under clause 5.2.3

we will try to contact you. If we are unable to reach you via the details you have provided to us, we are no longer obliged to continue holding the function room for you.
2.5 Any quote we provide you under clause 2.2(b) is an estimate only and may vary between the date we provide the quote

3. HIRE FEE3.1 The hire fee is the greater of:
(a) the “Actual Costs” (being the room hire fees and actual fees for catering and beverages), based on the actual number of guests in attendance at the function,

(b) the Minimum Spend Amount, Plus any costs you incur for the following:
(c) use of the standard audio-visual equipment;(d) personnel and security (including any additional security
charges under clause 5);(e) any displays or decorations in the function room prepared
by us; and(f) linen required (if “Restaurant” is ticked on the Booking
3.2 You must pay the Hire Fee, less the Deposit.4. MINIMUM SPEND AMOUNT
4.1 The Minimum Spend Amount is:(a) $5,000.00 including GST, if your function will be held in
December or January
5. SECURITY BOND AND CHARGES5.1 We may require you to pay an additional charge for security
if we decide, in our absolute discretion, that your function is !high risk" (!High Risk Event").
5.2 If we require you to pay an additional charge under clause 5.1, we will state the amount of the charge in the quote we give you under clause 2.2(b), and you must pay that additional charge as part of your Hire Fee under clause 10.1.
5.3 We may also require you to pay us a bond of an amount
right or remedy available to us, we may apply the Bond if we suffer additional cleaning or repair costs in connection with a High Risk Event. The Bond is not part of the Hire Fee and is not taken into account in calculating the actual hire costs under clause 3.1.
5.4 Subject to clause 16.5, we will refund any balance of the Bond to you within 30 days of the function date (or
6. CANCELLATIONS6.1 You must notify the Function Manager in writing if you decide
6.2 (a) more than 12 weeks prior to the function date - you will be
refunded the Deposit, In full;(b) between 12 weeks and 4 weeks prior to the function date
(both inclusive) - we will retain your Deposit in full;(c) less than 4 weeks, but more than 15 days prior to, the
function date - we will retain your Deposit in full and you must pay us 25% of the Cancellation Amount; and
(d) 15 days or less prior to the function date we will retain your Deposit in full and you must pay us 50% of the Cancellation Amount.
6.3 We will calculate the Cancellation Amount based on the reasonable estimate of our catering and beverage costs for your function.
6.4 clause 6 and a third party books an equivalent replacement function for the function date, we will not charge you any Cancellation Amount under clause 6.2.
6.5 Where circumstances beyond our reasonable control prevent us from hosting the function, we may cancel the function.
6.6 If we cancel the function under clause 6.5, you acknowledge and agree that we are immediately released from all our obligations under this Agreement without any further liability to you. In the event of such a cancellation, any Deposit which has been paid by you will be refunded in full.

7. MENU SELECTIONS7.1 Our liquor licence requires that food be served during a
function.7.2 You must submit menu selections to us no later than 10
working days prior to the function. Please discuss any
Manager.8. FINAL NUMBERS
8.1 to the function.
8.2 (a) Band members;(b) DJs;(c) other personnel in attendance at the function and who will
require catering during the function.
9. FUNCTION TIMES9.1 The function room will close at Midnight. Bar will be closed
at 11.30pm.9.2 From Monday to Friday, exclusive use of the function room is
only available after 7pm, unless otherwise arranged with the Function Manager.
10. PAYMENT10.1 You must pay the Hire Fee in full on the day of the function10.2 We accept Mastercard and Visa cards only. Invoices will be
Issued only as arranged with the Function Manager.10.3 Cleaning costs and any other additional costs incurred on the
day will be charged separately to the Hire Fee and after the function has been held (!"Additional Fees”). The Additional Fees will be payable by you within 7 days after the receipt of an invoice from us.
10.4 If you have paid the Minimum Spend Amount (rather than the Actual Costs) by the day of the function under clause 10.1 and the Actual Costs are less than the Minimum Spend Amount (the difference being the !Credit Amount"), you will:(a) receive credit on the bar up to the Credit Amount for use
on the day of the function only; and(b) be liable for any bar costs not covered by a beverage
package exceeding the Credit Amount (which are to be paid by running a cash bar or providing to us an accepted credit card with which to run a bar tab).
10.5 There will be no refund if bar costs do not exceed the Credit Amount.
11. RESPONSIBLE SERVICE OF ALCOHOL11.1 Our staff must comply with all laws, regulations and codes
requiring Responsible Service of Alcohol (“RSA Laws”) and are bound by the terms of our liquor licence.
11.2 Our staff must not:(a) serve alcoholic beverages to guests:
(i) who are under the age of 18 years; or(ii) deemed (in the absolute discretion of staff) to be in a
state of intoxication;(b) serve “shooters”;(c) serve double or triple shots of spirits; or(d) otherwise allow rapid or excessive consumption of alcohol.
11.3 To maintain compliance with the RSA Laws, you also acknowledge and agree that our staff:(a) will only serve a maximum of 4 drinks per person at any
one attendance at the bar; and(b) may restrict the overall number of drinks serviced to
guests at a function, in their absolute discretion.11.4 We may request proof of age of any person seeking entry
to the premises and may refuse entry to any person who is unable to satisfy us that they are not a Minor unless the

11.6 If you fail to notify us of the attendance of Minors in accordance with clause 11.5, we may refuse entry to Minors.

(a) be accompanied by a parent or guardian;(b) be presented to security on arrival to be wrist banded;(c) stay in the designated function area; and(d) depart the premises by no later than 10.00pm
11.9 We reserve the right to require a Minor and their accompanying parent or guardian to leave the premises immediately if the requirements of this clause 11 are not
12. WARRANTIES AND INDEMNITY12.1 You warrant and represent to us that:
(a) you will comply with all laws and regulations applicable to the staging of the function;
(b) you and your guests will comply with all directions issued by our staff during the function;
(c) by entering into this Agreement you will not breach any oral, or written agreement or arrangement that you are a party to; and
(d) any music you use or supply in connection with the function will not infringe any third party intellectual property rights.
12.2 You agree to indemnify us and our related bodies corporate
liability claim (including any third party claim), loss, liability, expense or damage (together, Damage) whatsoever (whether foreseeable or not) arising directly or indirectly as a result of, and all costs, charges or expenses incurred directly or indirectly as a result of:(a) your use of the XXXX Ale House for the purpose of the
function (including without limitation the acts of the guests or your representatives attending those premises for the purpose of that function); or
(b) a breach of this Agreement by you (including the warranties in clause 12.1);
(c) any claim, proceeding, suit, demand or action brought against us by you or a third party in connection with your use of the XXXX Ale House,
except to the extent such Damage is caused or contributed to by us.
13. RELEASE13.1 You acknowledge and agree that you (and your guests)
use the XXXX Ale House at your own risk and have sole responsibility for any goods, equipment, or materials brought into the XXXX Ale House by you or on your behalf, including responsibility for setting up the function in and removal of any materials from the XXXX Ale House at the end of the function.
13.2 To the fullest extent permitted by law, you (and your guests) agree to release us from and against any loss, cost, claim, damage or expense incurred directly or indirectly in connection with:(a) any personal injury suffered by you or your guests whilst
In attendance at the XXXX Ale House; and(b) the loss, or theft of the property brought into the XXXX
Ale House by you or your guests, agents, employees or contractors during or after the function.

14. LIMITATION OF LIABILITY14.1 You agree that our liability for any loss or damage you suffer
arising from, or in connection with, this Agreement, (other than personal injury) is limited to the Hire Fee.
14.2 To the fullest extent permitted by law, all express and implied terms, conditions and warranties other than the ones set out in this agreement are excluded. To the extent such conditions or warranties are required by law, our liability for breach is limited to the re- supply of our function services or the payment of the cost of having such services supplied again.
15. INSURANCEYou must fully insure yourself against any risk, loss, damage or theft of property on the premises arising as a result of your use of the function room for the purpose of the function, including (without limitation) damage or loss caused to our buildings, furniture,
16. MISCELLANEOUS16.1 We may, at our sole discretion, subcontract the performance
of any of our obligations under this Agreement to third parties. You must not assign your rights under this agreement without our consent.
16.2 This Agreement constitutes the entire agreement of the parties about its subject matter and any previous agreements,
understandings and negotiations on that subject matter cease to have any effect.
16.3 Each release and indemnity in the Agreement is a continuing obligation, separate and independent from other obligations of each party and survives the termination of this Agreement
16.4 This Agreement is governed by the law in force In Queensland, Australia and each party Irrevocably and unconditionally submits to the exclusive jurisdiction of the courts of Queensland and courts of appeal from them determining any dispute.
16.5 We may set off any amount we owe you under this Agreement (including the Bond under clause 5.4) against any Hire Fee or other amount you owe us under this Agreement.
16.6 We may exercise a right, remedy or power in any way we consider appropriate. If we do not exercise a right, remedy or power at any time, this does not mean that we cannot exercise it later.
16.7 No rule of construction will apply to the disadvantage of a party on the basis that it put forward this agreement.
16.8 You must inform your guests, personnel, agents and subcontractors involved in or attending the function of the terms of this Agreement.
16.9 You and your guests agree to be bound by the House Policy and to comply with the House Policy at all times during the function.
SCHEDULE 1 - XXXX ALEHOUSE POLICYSMOKING

We will clean the function room before and after your function.We will charge you any reasonable additional costs of additional/non-routine cleaning required to restore the function room to the condition it was in prior to your function.

MUSICYou are welcome to bring your own CDs or music collection contained on a portable music device (e.g. an ipod or MP3 player) to be played during the function.You acknowledge and agree that all music must be:(a) original CDs purchased by you; or(b) non-infringing copies of music (downloaded from your personal
collection of original CDs to your ipod or other portable music device).
DECORATION/DISPLAYSYou must notify our staff within a reasonable time prior to the function of any display and decoration requirements.Displays or decorations are subject to the following restrictions:(a)
the function room;(b) material may only be displayed on brick walls, however use of
adhesive materials is not allowed on painted walls; and
(c) of any kind are not allowed in the function room (excluding sparklers and birthday candles).
LINEN
(including white or coloured tablecloths and napkins) will only be provided for sit down menus on terms agreed with the Function Manager.
DELIVERIES TO THE XXXX ALE HOUSEFor occupational health and safety reasons, all people delivering to, or setting up in, the XXXX Ale House must wear fully enclosed shoes.While on the XXXX Ale House premises you and your personnel, agents, subcontractors and representatives must exercise due care and skill in complying with all occupational health and safety laws, regulations, standards and codes of practice and all signage, security requirements and reasonable directions given by us or our representatives.Deliveries must be arranged with the Functions Manager to ensure access to the site is organised.
ELECTRICAL EQUIPMENTYou acknowledge and agree that all electrical equipment being brought into the XXXX Ale House for use during a function must

All patrons must be clean, neat and tidy at all times whilst on the premises, and must be wearing shoes, a shirt and appropriate trousers or skirt.We reserve the right to refuse entry to any person who is not suitably dressed, in our absolute discretion.Fancy dress is generally permitted, but you must advise us of the theme when booking your function, and we reserve the right to reject any theme we think (in our absolute discretion) is inappropriate.
