SECTION 101. SHORT TITLE AND EFFECTIVE DATE

A. This Ordinance s h a l l be known and may be ci ted as the “Strausstown Zoning Ordinance of 1991.”

B. This Ordinance sha l l become effective five ( 5 ) days a f t e r its enactment.

SECTION 102. PURPOSES

A. This Ordinance is enacted under and pursuant t o the Municipalities Planning Code, A c t 247 of 1968, as amended, f o r the following purposes:

regulations and d i s t r i c t s contained herein represent reason- able consideration as t o the character of the d i s t r i c t and t h e i r pecul iar s u i t a b i l i t y f o r particular uses of land and have been made w i t h a view t o enhancing the existing environment and assur- ing the development of a future environment t h a t real izes the greatest possible use and enjoyment of land on adjacent proper- t ies, w i t h the objective of promoting and protecting the public welfare through the regulation of land use and the process of land development.

A. This Zoning Ordinance has been enacted i n accordance w i t h the Borough of Strausstown Comprehensive P lan of 1990 and i n

accordance with the following goals and objectives as set forth therein:

1. To preserve the small-town character of the Borough along with the scenic elements which make it unique.

a. Adopt development controls which will accommodate development that is harmonious with the character of the Borough. Included in this objective is the intent to permit development at a density sufficiently high to make community sewage treatment disposal economically feasible.

b. Preserve the sharp distinction between high-density town development and low-density rural development.

c. Preserve and enhance the views of Blue Mountain from the Borough wherever possible.

2. Maintain a full range of land uses and services within the Borough to maintain the character of a true town, accommo- dating the day-to-day retail and service nseds of the sur- rounding rural area.

3. Create a Zoning Ordinance to regvlate the density of devel- opment, to establish permitted uses aizd districts wherein all uses are permitted, to assure proper relation of buildings to each other and of new development to existing development, and to control building bulk and height.

B. In addition to the goals and objectives stated in the Comprehen- sive Plan, this Ordinance has been adopted in order to:

1. Accommodate the provision of efficient and dependable commu- nity facilities and services, meeting the health, safety, and welfare needs of current and future Borough residents.

2. Bring about the gradual conformity of land use patterns to that shown in the future land use element of the Borough Comprehensive Plan.

SECTION 104. APPLICABILITY

A. A l l s t ruc tures , buildings, signs, and uses of land s h a l l conform with the provisions of this Ordinance, including a l l performance standards, general regulations, and a l l regulations f o r the district wherein the par t icu lar structure, building, sign, o r land is located.

Structures, buildings, signs, and uses of land not i n conformance with the provisions of t h i s Ordinance sha l l be permitted only as a l ega l ly non-conforming use, as herein defined and provided for , o r upon the granting of a variance by the Zoning Hearing Board, as herein provided for i n accordance with the Pennsylvania Munici- pali t ies Planning Code.

This Ordinance shall no t create l i a b i l i t y on the par t of the Borough of Strausstown o r upon any o f f i ce r o r employee thereof f o r any damages t h a t r e s u l t from re l iance on t h i s Ordinance o r any administrative decision lawfully made pursuant t o its provisions.

SECTION 108. REPEALER

All ordinances, resolutions, and enactments inconsistent with the provisions of this Ordinance are hereby repealed to the extent of such inconsistency.

ACCESS DRIVE A paved o r unpaved s t r i p of land across public o r pr iva te property designed and intended t o provide a means of vehicular access from a public street t o a tract of land, a s t ruc ture , or a parking area.

ACCESSORY STRUCTURE A bu i ld ing o r s t r u c t u r e subordinate t o the main building, the use of which is customari ly inc iden ta l t o and located i n the same l o t occupied by the p r i n c i p a l bui lding.

ACCESSORY USE A use customarily incidental and subordinate to the principal use of the same lot.

ADMINISTRATIVE OFFICE - A type of non-residential land use which may be either free-standing, subordinate to some other use of land, or a principal use of land on a tract that supports other use(s). This use shall include managerial, secretarial, and clerical functions normally associated with commercial and industrial uses as well as some institutional uses and services.

AERIAL A mast used for the transmission or reception of electromagnetic waves. Dish antennae are specifically excluded from this definition.

AGRICULTURE The cultivation of the soil and the raising and harvesting of the products of the soil, including but not limited to nursery, hortied- ture, forestry, animal husbandry, and mushroom culture.

COMPREHENSIVE PLAN The Comprehensive Plan of the Borough of Strausstown, as duly adopted by the Borough Council and may be amended from time to time.

CONDITIONAL USE A use or activity which is not generally appropriate to a particular zoning district as a whole, but which may be suitable in certain localities within the district only when specific conditions and factors prescribed for such cases within this Ordinance are present and when approved by the Board of Supervisors upon advisement by the Planning Commission.

ARTICLE IX

PERFORMANCE STANDAFUX

SECTION 901. PURPOSE

No land, building, structure or premises in any District shall be used, altered or-occupied in a manner as to create any dangerous, injurious, noxious or otherwise objectionable fire, explosive, radioactive, or other hazard; noise or vibration; smoke, dust, odor, or other form of air pollution; electrical or other disturbance; glare; liquid or solid refuse or wastes; conditions conductive to the breeding of rodents or insects; or other substance, condition or element, in any manner or amount as to adversely affect the surrounding area. The specific performance standards of this Article shall be applicable to all uses.

SECTION 902. VIBRATION

A. No vibration shall be produced which is transmitted through the ground and is discernible without the aid of instruments at or at any point beyond the lot line.

1. The emission of sound for the purpose of alerting persons to the existence of an emergency or associated practice drills.

3. Domestic power tools, between the hours of 8:00 a.m. and 8:00 . -

5. Public celebrations authorized by the Borough.

SECTION 904. AIR QUALITY

A. "here shall be no emission of smoke, ash, dust, fumes, vapors, gases or other matter toxic or noxious to air which violates the Pennsylvania Air Pollution Control Laws, including the standards set forth in Chapter 123 (Standards for Contaminants) and Chapter 131 (Ambient Air Quality Standards), Article 111, Title 25, Pennsylvania Department of Environmental Resources,. Rules and Regulations.

E. I10 use shall operate or maintain or permit to be operated or maintained any equipment, installation or device which by reason of it5 operation or maintenance will discharge contaminants to the air in excess of the limits prescribed herein unless he shall install and maintain in conjunction thercwith such control equip- ment as will prevent the emission into the open air of any air contaminant in a quantity that will violate any pravision of this Ordinance.

C. In no event shall any firm or .corporation permit or cause the discharge of particulate matter into the atmosphere from inciner- ators in excess of 9.1 grain per cubic foot of gas at standard conditions corrected to twelve (12) percent carbon dioxide, except as may be designated under specific contaminants.

D. It shall be unlawful fo r any person to install, alter, enlarge, or make additions to any existing or new facilities, equipment, or operation that may be a source of air contaminants or to install, alter, enlarge, or make additions to any existing or new equip- ment, devices, or apparatus, the use of which may eliminate, reduce, or control the emission of air contaminants, until an application, including plans and specifications, has been filed with the Borough and a permit has been issued following review and approval by the Borough Engineer. Should the Borough require the services of a professional or consultant for review of submitted

plans and specifications, the applicant shall bear all costs for such services.

Two sets of plans shall be submitted with each application. If the plans are approved, one (1) copy shall be retained by the Borough and the second copy shall be kept at the site of construction.

Each application shall be examined by the Borough which-shall approve or reject the application with thirty (30) days from the date of filing thereof.

Where a permit also is required from the Pennsylvania Depart- ment of Environmental Resources, no Borough permit shall be issued until the State permit has been obtained and evidence of the same has been given to the Borough.

After the completion of any work requiring a permit, the applicant shall apply for a certificate of approval. The Certificate shall be issued by the Borough and shall certify that the work has been done in accordance with the approved plans.

The Borough may, at its discretion, require tests to be made of any work before it issues a certificate of approval. Such +_ez:tz shall be made at the expense of the applicant.

SECTION 905. ELEC*TRICAL AND ELECTROMAGNETIC I?FPEU’ZWNCE

SECTION 907. RADIOACTIVE MATERIALS

There shall be no activities which emit dangerous radioactivity at any point. If any use is proposed which incorporates the use of radioac- tive material, equipment, or supplies, such use shall be in strict conformity with Chapters 221, 223, 225, 227, and 229 of Title 25, Article V of the Pennsylvania Department of Environmental Resources Rules and Requlations and the regulations of the Atomic Energy Commis- sion, Title 10 CFR Chapter One, Part 20 - "Standards for Protection Against Radiation. "

SECTION 908. GLARE AND HEAT

A. No direct or sky-reflected glare, whether from floodlights or from high temperature processes such as combustion, welding, or other- wise, shall be visible at or beyond the lot line of the property generating such glare.

B. There shall be no emission or transmission of heat or heated air so as to be discernible at the lot line.

C. These regulations shall not apply to signs or floodlighting of parking areas otherwise permitted by this Ordinance.

SECTION 909. LIOUID AND SOLID 'WASTE (NCN-?AGIV!!CTIVE 1

A. There sm11 be ne discharge at any point into any public or Dri-rat-e sewerage system, watercourse, or into the ground of any materials in such a way or of such a nat!!rt. -IS will contaminate or otherwise cause the emission of hazardous materials in violation of the laws of the Commonwealth of Pennsylvmi~; specifically ChapLers 73, 75, 95, and 97 of Title 25, Pennsylvania Department of Environmental Resources, Rules and Requlations.

A. Enlargement.

1. A non-conforming s t ruc ture o r building may be enlarged o r increased up t o twenty-five (25) percent of i t s gross f l o o r area as of t h e e f fec t ive date of t h i s Ordinance. For pur- poses of i n t e rp re t a t ion of t h i s provision, "gross f l o o r area" is hereby defined as the area of land occupied by the subject s t r u c t u r e o r building, commonly known as the "footpr int" of t h e s t ruc tu re .

2. Enlargement of a non-conforming building or structure shall be permitted only as a conditional use in accordance with the provisions of 81206 of this Ordinance.

3. As may be possible, enlargement of a non-conforming building' or structure shall not worsen the aspect of non-conformity.

4. The enlargement of a non-conforming building or structure shall not create any new aspect of non-conformity.

Moving of structure or building.

If a non-conforming structure or building is moved, it shall be sited in conformance with all applicable regulations of the zoning district to which it is moved.

Discontinuance.

Whenever a non-conforming structure or building is partially or wholly destroyed or damaged, said structure may be built to its original (i.e., non-conforming) dimensions, provided that such reconstruction is substantially completed within eighteen (18) months from the date of the Fartial or complete destruction.

If a period of more than eighteen (18) months has elapsed from the date of partial or complete destnxi-.im and recon- struction is not substantially completed, a l l subsequent reconstni-tion shall be in conformance with ths applicable zoning regulations, unless a variance has been granted by the Zoning Hearing Board in accordance with 41102(F) of this Ordinance.

SECTION 1105. NON-CONFORMING USES OF STRUCTURES OR BUILDINGS

Uses of structures or buildings which are rendered non-conforming by the adoption or amendment of this Ordinance may continue in as long as such use remains otherwise lawful, subject to the following provisions.

A. Extension.

A non-conforming use may be extended throughout any part of an existing structure or building, provided that any structural alterations, extensions, or additions comply with all provisions of this Ordinance with respect to height, area, width, yard area, and lot coverage specified for the zoning district within which the building or structure is located. unnecessary hardship upon the applicant. No variance shall be granted unless and until the applicant can demonstrate to the satisfaction of the Board that:

a. There are unique physical circumstances or conditions (such as irregularity, narrowness, or shallowness of lot size or shape) or exceptional topographical or other physical conditions peculiar to the particular property. Such hardship shall be due to such physical conditions and not the circumstances and conditions generally created by the provisions of this Zoning Ordinance in the district where the property is located.

b. Because of such physical circumstances or conditions, there is no possibility that the property can be devel- oped in strict conformity with the provisions of this Zoning Ordinance and that the authorization of a vari- ance is therefore necessary to enable reasonable use of the property.

c . Such hardship shall not have been cmated by the applicant.

d. The variance, if authorized, shall not result in alter- ation of the essential character of the neighborhood or district in which the property is located, nor substan- tncll.1.;: or. permanently impair rhe appropriate use or aevelopmnt of a3jwcnt prgperty, ?or be detriment.al to the public welfare.

e. The variance, if authorized, sha'li represent the minimum variation from the standards of this Ordinance which will afford relief and vi11 represent tiie least modif i- cation possible thereof.

In grantiiq any variance, the Board may attach such reason- able conditions and safeguards as it may &em necessary t o implement the stated purposes of this Zoning Ordinance.

Unless otherwise specified by the Zoning Hearing Board, a variance which has been authorized by the Zoning Hearing Board shall expire if the applicant fails to obtain a zoning permit within six (6) months from the date of authorization thereof or fails to commence a substantial amount of work within six (6) months from the date of issuance of the permit for such work.

G. Applications for Uses by Special Exception as defined in this Zoning Ordinance.

SECTION 1304. ISSUANCE OF ZONING PERMITS

With the exception of Use and Occupancy Permits, as set forth below, it shall be the duty of the Zoning Officer to either issue or officially deny issuance of a zoning permit within fifteen (15) days of the filing of a completed application and payment of prescribed fees.

The Zoning Officer shall issue a permit only upon determination that the application is in compliance with the terms of this Ordinance, as well as any other governing ordinances, including but not limited to the Building Code and the Subdivision and Land Development Ordinance.

Issuance of Building Permit

A building permit, when issued, shall be accompanied by a placard to be displayed conspicuously upon the premises during the period of construction.

Issuance of Use and Occupancy Permit

SECTION 1308. COMPLAIEJTS REGARDING VIOLATIONS

Whenever a violation of this Ordinance occurs, or is alleged to have occurred, any person may file a written complaint. Such complaint, stating fully the causes and basis thereof, shall be filed with the Zoning Officer, who shall properly record such complaint, immediately investigate, and take action thereon as directed by Borough Council and as permitted by this Ordinance and the laws of the Commolrivrealth of Pennsylvania.

SECTION 1310. P E N X T S

For any and every violation of the provisions of this Ordinance, the owner, general agent, or contractor of a building or premises where such violation has been committed or shall exist; the lessee or tenant of an entire building or entire premises where such violation has been committed or shall exist; the owner, general agent, contractor, lessee or tenant of any part of a building or premises in which part such violation has been committed or shall exist; and the general agent, contractor, architect, builder, or any other person who knowingly commits, takes part, or assists in any such violation or who maintains any building or premises in which any such violation shall exist, shall be liable on conviction thereof to a fine or penalty not exceeding five hundred dollars ($500) for each and every offense. Wherever such persons shall have been officially notified by the Zoning Officer, by service of a summons in a prosecution, or in any other official manner, that he is committing a violation of the Ordinance, each day's contin- uance of such violation after such notification shall constitute a separate offense punishable by a like fine or penalty.
