But for those who were at the President’s Pro Bono Service Award reception at this year’s annual meeting, it felt like a bit of Orange County had moved north temporarily. That’s because three of the ten statewide awards handed out by Chief Justice Ronald M. George and State Bar President Jim Heiting were given to Public Law Center volunteers. This unprecedented recog- nition came about because of the hard work of some extraordinary PLC volun- teers. The award recipients were: Orange County Public Defender’s Office – Government category. The Orange County Public Defender is a critical pro bono partner in the Public Law Center’s Homeless Legal Clinics, held twice a week from December through March at Orange County’s two armory based temporary homeless shelters. At each clinic a team consisting of Public Law Center staff and volunteers serves approximately ten homeless individuals. Homeless individuals at these clinics have a variety of different civil legal problems, including family law, consumer law and government benefits issues. In addition, many of the homeless individu- als at these clinics have questions concerning criminal justice related issues, including concerns about outstanding warrants for minor criminal law offenses. These warrants often stand as a barrier to the homeless person’s attempts to secure a more stable living environment. Public defenders who volunteer at these clinics assist homeless clients by pro- viding brief advice and counsel on minor criminal matters. Often times cases require additional follow up work, which the public defender volunteers then handle as part of their regular case load. Additionally, public defender volunteers will often route homeless persons at the clinic to Orange County’s Homeless Outreach Court where they can resolve, in a non-threatening environment, their outstanding warrants on minor criminal law matters. Dennis Connelly – Corporate Counsel. Dennis Connelly, former Legal Director and Corporate Counsel of Beech Street, a Preferred Provider Organization (PPO) and Healthcare Management Company, has been an indis- pensable volunteer in providing bankruptcy assistance to Public Law Center clients. Dennis had no prior experience with bankruptcies, but was mentored by an experienced PLC volunteer bankruptcy attorney (who was previously hon- ored as our Volunteer Attorney of the Year) and quickly became one of PLC’s most dedicated and dependable bankruptcy pro bono attorneys. Bankruptcy clients come to PLC feeling overwhelmed, guilty, frightened and ashamed. Many of them face wage garnishments or are in danger of becoming homeless. They are indeed among some of PLC’s most vulnerable clients. Exacerbating their problems, it is exceedingly difficult to find volunteers willing to take these types of cases. Dennis has consistently and repeatedly provided PLC bankruptcy clients with desperately needed assistance that they otherwise would not have received. PLC Volunteers Honored at State Bar Annual Meeting

Anyone who attended the State Bar annual meeting this October inMonterey can tell you that next year’s annual meeting is here in OrangeCounty. But for those who were at the President’s Pro Bono Service

Volunteer attorneys from Gibson, Dunn &Crutcher recently obtained a court ordergranting class certification in a Santa Ana

slumlord case. The court found that a class action isproper as to all causes of action in the tenants'complaint, including claims for breach of thewarranty of habitability, negligence, nuisance,fraudulent misrepresentation, wrongful entry, andretaliation. Under the court's order, all current andformer tenants who have lived in the Santa Ana slumapartment complex since 2001 now have anopportunity to recover damages.

The court's recent grant of class certificationfollows on the heels of other significant pre-trialvictories in the tenants' favor. Late last year, GibsonDunn successfully obtained the appointment of ahabitability receiver – a procedure rarely used in

Orange County – to take over control of theapartment complex and see that necessaryrehabilitation work is promptly completed. In mid-2006, the receiver was allowed to take out a loan onthe property of over one million dollars to repair thecomplex, and as of September 2006, repairs there arewell under way. In addition, the court recently foundthat the tenants have a "substantial probability" ofsuccess on their punitive damages claims and,accordingly, granted the tenants' motion to permitthe discovery of the landlords' financial information.

Although a trial date has not yet been set for theclass action, the Gibson Dunn team is close tocompleting its discovery and looks forward topursuing damages for the tenants, along with aninjunction preventing the landlords from continuingtheir bad business practices.

As we approachthe end ofanother year, we

complete a milestonefor the Public LawCenter. Our 25thA n n i ve rs a r y ye a rhas included manyhighlights. We’re on

track for serving more clients than ever before andinvolving greater numbers of volunteer lawyers, lawstudents and others in our efforts. We’ve addeddedicated staff positions to address housing andhomelessness issues and to manage our growingnumber of volunteers. We’re helping moreimmigrant victims of domestic violence, humantrafficking and trauma achieve stability in theirlives. We’re continuing to find ways to assistlawyers, in an array of practice areas, to enter theworld of pro bono by developing new clinics andcommunity legal education programs.

Our efforts are being recognized. Our volunteershave received a variety of awards this year, includingthree prestigious State Bar President’s Pro BonoService Awards. Numerous articles in the local presshave noted our efforts to make Orange County abetter place to live for everyone. Our supportershave recognized our efforts as well. Our JulyVolunteers for Justice Dinner brought in recordrevenues while providing the nearly 700 attendeesan extremely special celebration recognizing PLC’s25 years of service to the community.

While we welcome all this good news, we can’tforget for even a moment the growing needs of our

clients. Housing costs continue to soar forcingmultiple families into crowded quarters. Currentestimates are that an individual would have to earn$26.77 per/hour in order to afford a two bedroomunit in Orange County. Orange County continues tohave one of the largest homeless populations of anycounty in the nation. As winter approaches, thesearch for housing becomes more desperate.Housing isn’t the only crisis our clients face.Accessing affordable health care, avoiding consumerscams and escaping the cycle of domestic violenceare the stuff of our clients’ every day lives.

Closer to home, this celebratory year also sawsome sad losses. Gar Shallenberger, a long timeleader in the Orange County legal community whowas one of our founders and early board presidents,passed away in September. In August, we lostLonnie Watson, the former County Counsel ofOrange County, who during the last two years of hislife was a regular volunteer at our office. And earlierin the year, the California legal services communitylost a giant when Tanya Neiman, the head of SanFrancisco’s equivalent of the Public Law Center, losta long bout with cancer.

We note their passing not to dwell on our losses,but to continue to be inspired by the passion,dedication, commitment, vision and wisdom thatcaused all of them to focus their time and talent onaddressing the legal needs of the low incomecommunity. We hope their efforts, as well as theefforts of the thousands who have volunteered forthe Public Law Center over the past 25 years,continue to inspire you too.

Berman represented a 73 year old widow, who sur-vives on Social Security and a small pension, in adispute with a contractor. Earlier in the year, theclient had a new roof installed on her home.Immediately following installation she experiencedproblems with the roof leaking. A city inspectorfound that the job had been poorly performed andthe roof needed to be removed and remedial workdone. The client’s calls to the contractor wereignored. Another contractor estimated it would cost$6,500 to correct the job. The client had depleted hersavings on the first roof job. Sam came to the client’sassistance and was able to negotiate a settlement bywhich the contractor installed a new roof.

Solo practitioner Tom Bellamore assisted animmigrant woman who was referred to PLC byHuman Options, one of Orange County’s compre-hensive domestic violence shelters. The client hadbeen in the U.S. for 17 years, all the while living witha very abusive husband. The most recent incidentrequired the client to be hospitalized for a swollenface and to obtain stitches in and near her eye whereshe had been cut during her beating. Soon after, theclient testified in a criminal case against her hus-band, which resulted in a guilty verdict and a 6months sentence in jail. Tom, in turn, obtained therequired certification form from the Buena ParkPolice Department and then sought U visa interimrelief for the client. The relief was granted in July.Tom reports that the client's entire demeanor haschanged dramatically since her life and futureprospects are much brighter and safer.

Michael Lee and Candice Lee of McDermott,Will, & Emery assisted a new community-basedorganization start-up and obtained nonprofit taxexempt status. The group, named Greet the Day,assists people affected by cancer in enhancing theirhealth and well-being through participation in a freeprofessional program of education, support andbody work. Michael and Candice assisted theorganization in preparing Articles of Incorporation,Bylaws, and other corporate governance documents.Additionally, they assisted Greet the Day in obtain-ing federal tax-exempt status, which the organiza-tion received in July. With its tax-exempt status,Greet the Day will now be able to apply for grantsand otherwise strengthen its fundraising programs,which will allow the organization to increase itsactivities and services for cancer patients in OrangeCounty.

Russ Hill of Howrey represented a client whowas awakened in the early morning hours by thepolice who had found his vehicle. The vehicle hadbeen stolen from his garage and torched. The clientstill owed over $20,000 on the car. He submitted aclaim to his insurer. They apparently took the posi-tion that either the client, or persons acting for him,burned the car so he could get out from under theloan and so they refused to pay his claim. Russ,along with Sharla Manley, Douglas Gastelum andJames Bernald of the firm’s Los Angeles office, fileda lawsuit asserting various causes of action includ-ing bad faith and civil rights violations. The casewas settled, allowing the client to pay off the loanand receive some money for himself.

During the summer of 2006, PLC workedclosely with several OC law firms to offertheir summer associates a chance to experi-

ence pro bono work. Law firms including Crowell &Moring, Irell & Manella, Jones Day, Manatt, Phelps& Phillips, McDermott, Will & Emery, Sheppard,Mullin, Richter & Hampton, and Snell & Wilmerexemplified their commitment to providing access tojustice by encouraging their summer associates tomake use of their legal training to help OrangeCounty’s low income residents. These summerassociates provided pro bono assistance by conduct-ing intake at community legal clinics and providingclients with direct pro bono legal representation.

PLC conducts multiple legal clinics each monthat community centers throughout Orange County.During the summer of 2006, 15 summer associates,under the supervision of PLC staff attorneys, partic-ipated in these clinics by interviewing clients, iden-tifying their legal needs, and then, communicatingclients’ facts and needs via memorandum to PLC.Summer associates reported that they found theirtime at the legal clinics both interesting and reward-ing. In particular, Laura Goodwin, associate at JonesDay, stated that “the summer associates (and thefirm associates who accompanied them) reallyenjoyed the hands-on experience of working withclients at the Homeless Outreach Court legal clinic

and look forward to continuing to work with PLC.”PLC, in partnership with Snell & Wilmer, also

started a pilot program this summer to offer summerassociates the opportunity to provide direct pro bonolegal representation. Under the supervision of Snell& Wilmer associates, their summer associatesassisted six PLC clients with U Visa immigrationapplications. A U Visa immigration application pro-vides victims of severe violence who have cooperat-ed with law enforcement in the investigation or pros-ecution of the crime a means to temporarily gainlegal immigration status. As this area of law wasnew to both Snell’s associates and summer associ-ates, PLC provided a 2-hour substantive training onthe subject, a comprehensive “how to” manual, andsamples of previous U Visa applications. In addi-tion, PLC staff attorneys were available to provideadditional guidance as needed. Deborah Mallgrave,associate at Snell & Wilmer, stated that the “directclient contact and the ability to take a case frombeginning to end provided a memorable experiencefor each summer associate.”

In early 2006, PLC created a new staff position toprovide leadership in PLC’s pro bono outreach tothe legal community. This position, Pro Bono

Managing Attorney, is an effort to further developand improve PLC’s recruitment, retention andrecognition efforts of the many volunteers commit-ted to providing access to justice. Peri Doshi-O’Neill, previously a PLC staff attorney, wasappointed to this position earlier this year. Since thattime, PLC has made strides in facilitating theinvolvement of pro bono volunteers. In particular,PLC has coordinated four MCLE Legal Trainings

accompanied with PLC- developed substantive legalmanuals specifically for volunteer attorneys; piloteda pro bono program for summer associates at largeOC law firms; developed internal infrastructure toimprove communication and recognition with volun-teers; and hosted a Volunteer AppreciationReception in late September. With this new posi-tion, PLC will continue to increase its support to vol-unteers. On September 28, 2006, PLC hosted anevening reception to recognize the hardwork of our many pro bono attorneys. The

event was held in the garden setting of the SantaAna Country Club. The Treasures of OC themewas played out in the tropical-tasting hors d’oeu-vres buffet, drinks, music by a steel drum bandand decorations. Attorneys who attended thereception met and mingled with PLC staff andother pro bono lawyers committed to providingaccess to justice for Orange County’s low incomecommunity. The evening concluded with anopportunity drawing with prizes donated byBeatriz Gordon of Morrison Forester, Roman

Darmer of Howrey, Michael Williams of Irell &Manella, Mark Minyard of Minyard Morris andPeets Coffee.

On Monday, October 16, 2006, the SouthernCalifornia Chapter of the Association ofCorporate Counsel America (ACCA-SoCal)

hosted its 8th annual Charity Golf Classic at thespectacular Trump National Golf Club in PalosVerdes. The proceeds of this sold-out tournamentbenefited both the Public Law Center (PLC) and theLos Angeles County Bar Foundation.

During a lively dinner program, ACCA-SoCalBoard President Jonathan Block of SalemCommunications presented PLC Executive Director

& General Counsel Kenneth Babcock with a $10,000check raised by the Charity Golf Classic. PLC isdeeply grateful to the ACCA-SoCal for its steadfastsupport of PLC’s programs and services and thanksHarry Field of the Boeing Company, tournamentchair, as well as the rest of the tournamentcommittee.

On June 7th, the Orange County Chapter ofthe Association of Business Trial Lawyersheld its 7th Annual PLC Wine Tasting Event

at the Westin South Coast Plaza. Well known legalethicist Michael Josephson spoke to the group chal-lenging the more than 300 in attendance to gobeyond success to significance. “While being a suc-cessful lawyer in the traditional business sense ofthe word is a laudable goal, being a significant per-son can be a loftier goal,” said Josephson.

This annual ABTL Wine Tasting Fundraiserpacked a lot into the evening; active networkingreception, fine wines and food, and an excellent pro-gram. It also was successful in raising $17,500 tosupport PLC’s work on behalf of low income fami-lies, children and seniors in Orange County. ABTL fills the house and raises $17,500 for PLC

PLC staff and volunteers joined together onSunday, June 4, 2006, at the University ofCalifornia, Irvine for AIDS Walk Orange

County, which celebrated its 20th anniversary. Theefforts of participants and sponsors are still essentialto the fight against HIV and AIDS. In OrangeCounty, 10,000 people are currently living with HIVor AIDS, but one-third do not know they are infect-ed. New HIV cases are showing a sharp increaseamong females, minorities, and heterosexuals, andover half of all new infections in Orange County arein those under the age of 25.

PLC was again both a beneficiary of and partici-pant in the Walk. The efforts of the PLC Walk Teamand its supporters helped the Walk Team raise$3,400 and place 9th in the Small Business/Social

Organization category. Also, a PLC volunteer attor-ney won the AIDS Walk pie-eating contest for thesecond year in a row! Overall, the Walk raised$572,000, of which PLC was granted $13,300.These funds will support PLC's AIDS LegalAssistance Project (ALAP), which provides freelegal services to over 350 Orange County residentsliving with HIV and AIDS each year.

PLC appreciates the efforts of our Walk Teammembers and supporters, as well as AIDS ServicesFoundation Orange County, which coordinates theWalk and continues to recognize the importance oflegal services. We look forward to next year’s Walkand hope you will join us in the fight against HIVand AIDS!

It was a memorable night. The Public LawCenter’s annual Volunteers for Justice Dinner,held July 20, 2006 at the Hyatt Regency Irvine,

hit new highs in attendance, proceeds raised, andnotable features. Nearly 700 attendees enjoyed thisspecial evening that celebrated PLC’s 25th years ofservice to the community. Mingling with thehundreds of lawyers and business leaders presentwere over 30 judges and a host of state, county, andcity dignitaries.

The event raised a record $443,000 to supportPLC’s work in providing access to justice for lowincome children, families, adults and seniors inOrange County. The majority of contributions came

from 58 generous Dinner Sponsors – firms andcompanies committed to PLC’s mission. Gifts fromanother 20 Underwriters, mostly smaller firms andsome individuals, helped to offset various costs ofthe event.

The evening was emceed by Justice Kathleen E.O’Leary of the California Court of Appeal. OrangeCounty Bar Association President Julie M. McCoyand U.S. District Court Judge Andrew J. PLC’s Executive Director, Ken Babcock,conveyed heartfelt thanks to the volunteers andsupporters who make it possible for PLC to assist

He then introduceda video that showed the impact of pro bono service.The volunteers who shared their experiences in thevideo spoke of professional responsibility and greatpersonal satisfaction in helping those who arevulnerable to injustice. recount all of their successes on behalf of OrangeCounty’s low-income population, but thefollowing stories provide a glimpse of our lawstudents’ impact.

Henry Tsai (Whittier) successfully recoveredthe full available amount of a Spanish speakingclient’s security deposit. He negotiated persistently,working hard to make sure our client came out ontop. In addition to gaining fundamental legal skills,Henry also gained a greater appreciation of thecommunities we serve. He said, “Volunteering atPLC has made me more conscientious of the not toouncommon economic inequalities and socialinjustices in Orange County.”

Leann Jandron (Chapman) provided vitalprogram management and client assistance in thefirst ever legal clinic for nonprofit organizations inJune. She also provided direct legal assistance to anumber of clients, including a child care providerin Laguna Hills that, thanks in part to Leann’shard work, received a Conditional Use Permit tooperate her large family day care.

Christine Dzida (Loyola) received a HowreyHELPS stipend in conjunction with her work atPLC. This funding allowed Christine to providelegal assistance to mainly monolingual Spanish-speaking clients with immigration and family lawissues. Christine hopes to continue in the field of

public interest law and thanks Howrey LLP forgranting her the opportunity “to get a glimpse ofall the good that can be done with a law degree.”

The final treat of the evening was thekeynote speaker, Justice Carol A. Corrigan ofthe California Supreme Court. Justice Corriganissued a call to action, reminding us of theprivileges of living in our time and in ourcountry, and also of the responsibilities thatcome with being well educated and working in aprofession that carries obligations to help thoseless fortunate. She challenged everyone to makea difference in the lives of others, much in thesame way that the honorees had.

PLC. These invaluable clinics are held at theOrange County Bankruptcy Court and help low-income pro se debtors who have filed for bankrupt-cy understand their rights regarding reaffirmationagreements and Chapter 7 filings.

Cynthia Holton – Solo Practitioner. Family lawcases are traditionally some of the most difficultcases for pro bono organizations to place with vol-unteer attorneys. Cynthia Holton has proven to bean essential volunteer for the Public Law Centerbecause of her willingness to take on, time andtime again, family law cases that we have not beenable to place with other volunteers. Since 2004when Cynthia began volunteering with PLC, shehas taken 24 separate family law matters. In 2005alone, Cynthia individually has handled 16 casesdealing with guardianship, marital dissolution anddomestic violence.

Contributing 491 hours of pro bono legal serv-ices for PLC clients just in 2005, Cynthia has beenan invaluable asset not only to PLC but also tonumerous families and children in the most desper-ate of circumstances. Without Cynthia’s dedica-tion, it is foreseeable that many of the clients shehas helped would have gone without much neededlegal services. It is only with the commitment ofvolunteers like Cynthia Holton that PLC is able tooffer life-sustaining and often life-changing assis-tance to some of our community’s most vulnerablemembers.

Congratulations to these and all the otherrecipients for a job very well done. None of themvolunteered for PLC because of the potential forfuture recognition, but we’re happy that we wereable to secure for them the recognition they sodeeply deserve.
