Behavioral Health Care

County Commission Report:

Update on Valeo Behavioral Health Care, Inc.

(Calendar, 2015 and 2016 YTD)

Data in Brief: Unduplicated count of persons served in 2015 = 7,335. This is a 6% increase, compared to

2014. 57% were male, and 43% were female. Client satisfaction ratings averaged 95%, "satisfied" and

"very satisfied". More data will be available in the near future, and will be reported.

Financial: 2015 ended on a positive note. Financial reports are filed with the county each quarter. A copy

of the 2015 Audit will be submitted upon completion. We have been successful in obtaining grants for

services, such as to the homeless and for services that will help adults and their families in crisis situations. Valeo also continues its campaign to raise private donations.

Corrections and Behavioral Health Care: Valeo has been working with Shawnee County Department of

Corrections on ways to enhance behavioral health care (mental health & substance abuse) for inmates.

Law Enforcement & Street Outreach: We added a 2"d Outreach Co-Responder to work fulltime alongside

law enforcement on the street, helping adults with mental illness in crisis, or who are homeless. Also,

added a Pe.er Support Specialist to this team with a grant from KDADS aimed at helping divert individuals

from hospital placement.

Supported Employment: Added another fulltime Supported Employment Specialist. Please see "Homelessness" below.

Breakthrough House: Awarded Breakthrough House $5,000 over their usual allotted affiliate amount to

be used for employment supports for consumers seeking work, training, or further education.

Prescribing Services After Hours at The Residence: Valeo will be seeking to find a way to increase access

to prescription medications for consumers in our 24/7 crisis facility. Increased access to psychiatric/behavioral medications will enhance recovery, as well as further reduce reliance on hospital

placements.

Collaborative Work with Qther Health Providers: We are increasing collaborative health and behavioral

health efforts with community partners, including, but not limited to the Shawnee County Health

Department, St. Francis Hospital, Stormont-Vail Hospital, and Washburn University. Focus areas include

crisis services, continuity of care (outpatient to inpatient and vice versa), primary care, and dental care.

Homelessness: Valeo was awarded a grant through KDADS for $975,000 ($325,000/yr) for three years to

enhance services to homeless adults with mental illness. Grant is entitled Cooperative Agreement to

Benefit Homeless Individuals, or CABHI. We added eight (8) fulltime staff: three case managers, two peer

support specialists, a supported employment specialist, and a supported education specialist. These staff

work alongside many other agencies In the county.

Recovery Centers: We have joined with stakeholders in Shawnee, Sedgwick, and Wyandot Counties, and

elsewhere, in promoting legislation and programming that would extend the involuntary hold on certain

persons with mental illness from 24 hours to 72 hours in specialized facilities, locally, that have become

known as Recovery Centers (also known as Emergency Observation and Treatment, or EOT).

Health Home: The KDHE has announced that Health Homes for adults with mental illness who are

Medicaid Recipients are to cease operations on 6/30/2016, statewide. Our Health Home employs 10

persons fulltime, and has served just under 900 persons (un-duplicated estimate). The mission is to help

participants improve their health status.

AN AGREEMENT relative to performing certain work and/or the occupancy of the County's

Highway Right-of-Way by the facilities of a utility

THIS AGREEMENT, made and entered into by and between Osage County Rural Water District

No. 8 hereinafter referred to as the Company, and the Board of County

Commissioners, Shawnee County, Kansas, hereinafter referred to as the County.

WHEREAS, the County proposes to construct Bridge Replacement Project No. 89 C-0066-01 NW Carlson Road over Kansas River, at Willard Kansas

WHEREAS, the County and the Company enter shall enter into an agreement relative to occupancy of County Highway right-of-way or the vacating of additional right-of-way to be acquired by the County for the construction of this project; and

WHEREAS, Kansas Statutes, K.S.A. 17-1901 and Case Law provide that certain facilities may occupy space on the County's right-of-way.

NOW THEREFORE, BE IT AGREED:

That the construction or alterations of the Company's facilities, if any, shall be completed within QQ_ days after the County furnishes to the Company the information indicated in Items 7 and 8 of this agreement and notifies the Company in writing that the right-of-way has been acquired and any necessary alterations may proceed.

4. That the Company will repair Cl!1Y damage to the County's right-of-way by the Company or its contractor.

5. That the Company will maintain its facilities in a manner which will not endanger the vehicular traffic on the highway.

6. That, in the ~vent future highway improvements necessitate the removal or adjustment of said facilities now located on highway right-of-way and/or such facilities relocated on newly acquired right-of-way for the construction of this Project, the Company will, upon request of the County, make such adjustments as required to accommodate any future highway improvement at no cost to the County. This provision will not apply to locations where the facilities are presently located on private easement which is included in any additional right­of-way acquired for this project and on which no alterations in the facilities are presently required.

7. That the County will furnish the Company copies of the plans for the Project.

8. That the County will provide alignment points for the use of the Company in locating its facilities.

IN WI1NESS WHEREOF the parties hereto have duly executed this agreement, in triplicate, on

Re: NRA returned check

The property at 1820 SW Fillmore St. in the name of Thomas & Bridget Garvin is in the Neighborhood Revitalization Act program. There was a deed filed on May 15, 2015 requesting the taxes to be sent to Topeka Habitat for Humanity. The system picked up the in care of name as the owner when the checks were printed. Topeka Habitat contacted my office to let us know that we need to take their address off and mail future billings to the owner. According to Topeka Habitat, the Garvin's paid the tax. Can there be a new check issued for the Garvin's or do the Garvin's need to request the reissue?

I have attached the return check in the amount of $633.58.

SECTION 1.0 PARTIES

1.1 This permit, made and entered into on FEBRUARY 15th, 2016, with KANSAS EXPOCENTRE of Shawnee County, Kansas and:

1.2 Pursuant to home rule resolution No. HR.-84-4-A of Shawnee County Commission and this permit and subject to the conditions, limitations and restrictions contained in said resolution or hereinafter set forth, permission is hereby granted for PERMITTEE to use and occupy the EXPOCENTRE as detailed hereinafter.

Approval of Permit: This permit will not be in force until it has been approved by the General Manager of the KANSAS EXPOCENTRE. Before the General Manager will sign, the PERMITTEE shall endorse the same "accepted" in the space hereinafter provided, and return to the KANSAS EXPOCENTRE no later than FEBRUARY 29TH, 2016, accompanied by any payment required.

This Permit shall have no force or effect whatsoever unless and until PERMITTEE endorses the same "accepted" in the space hereinafter provided. By said acceptance, PERMITTEE shall covenant and agree to well and truly perform or abide by each and every provision, condition, restriction and limitation of this permit. Said compliance shall be a condition subsequent to the continuance in effect of this permit.

SECTION 2.0- FEE TERMS

2.1 PERMITTEE agrees to pay the KANSAS EXPOCENTRE, for use ofleased space, a guarantee of NINE HUNDRED THIRTY-FIVE DOLLARS & 00/100 ($935.00).

Facility Rental (Agricultural Hall) $ 935.00

Facility Rental (Heritage Hall) $ 660.00

2.2 PERMITTEE agrees that if the KANSAS EXPOCENTRE incurs any costs in the collection or enforcement of payment of this agreement, including, but not limited to, collection agency fees, costs of filing suit and reasonable attorney fees, PERMITTEE agrees to pay such costs.

SECTION 3.0- INDEMNIFICATION- N/A

3.1 PERMITTEE agrees to indemnify, defend and save harmless the COUNTY, SMG, a Pennsylvania Joint Venture Partnership, its partners, agents, and employees, and the KANSAS EXPOCENTRE, its officers and representatives, against any and all claims for injury to person or damage to property, including claims of volunteers, participants in the event or employees of PERMITTEE, any contractor or subcontractor, resulting directly or indirectly from any act, incident or accident occurring in, upon or about the premises of the KANSAS EXPOCENTRE as a result of the acts, errors or omissions of the PERMITTEE or its agents or arising in connection with operations, use or occupancy of the premises by PERMITTEE.

SECTION 4.0- RULES AND REGULATIONS

4.1 PERMITTEE will abide by and conform to all rules and regulations adopted or prescribed by the COUNTY, KANSAS EXPOCENTRE and GENERAL MANAGER for the protection, control and management of the premises. The aforementioned premises and keys thereof shall be at all times, under the charge and control of the GENERAL MANAGER. PERMITTEE shall not allow the premises to be used for lodging rooms nor for any improper, immoral, illegal or objectionable purpose and will not sublet any space hereby leased without the written approval. PERMITTEE will not in any way obstruct, or interfere with the occupancy of other tenants on the premises, not in any way injure or annoy them.

4.2 PERMITTEE will comply with all laws of the United States and the State of Kansas; all City of Topeka ordinances; Shawnee County resolutions; and all lawful orders of law enforcement, health and fire departments. PERMITTEE will obtain and pay for all necessary permits and licenses. PERMITTEE will neither do, nor suffer to be done, anything on said premises during the term of this permit in violation with such laws, ordinances, resolutions, rules or orders. This permit is fully executed in the State of Kansas, and Kansas law is applicable.

SECTION 5.0- GENERAL TERMS AND CONDITIONS OF USE AND OPERATION (PUBLIC SAFETY)

5.1 PERMITTEE agrees at all times to conduct activities with full regard to public safety and will observe and abide by -all applicable regulations and request by duly authorized governmental agencies responsible for public safety.

SECTION 6.0- FIRE AND OTHER UNFORESEEN OCCURRENCES

6.1 That in case the said premises, or any part thereof, shall not be ready for occupancy due to incomplete construction, or shall be destroyed or damaged by fire, storm, flood or any other cause, or if any other casualty of unforeseen occurrence shall render the fulftllment term of this permit by the KANSAS EXPOCENTRE impossible, including without limitation thereto, the requisition of the premises by the United States Government, or any arm or instrumentality thereof, or by reason of labor disputes, then and thereupon this permit shall terminate, and the PERMITTEE shall pay rental for said premises only up to the time of such termination, and at the rate herein specified, and the PERMITTEE hereby waives any claim for damages or compensation should this permit be so terminated.

SECTION 7.0- RESPONSIBILITY FOR PROPERTY IN BUILDING

7.1 The KANSAS EXPOCENTRE assumes no responsibility whatsoever for any property placed in said premises by PERMITTEE, PERMITTEE'S agents, exhibitors or others related to this event. PERMITTEE hereby expressly relieves and discharges the KANSAS EXPOCENTRE from any and all liability for any loss, injury or damage to persons or property that may be sustained by reason of the use or occupancy of said premises, or any part thereof under this permit. All watchmen, or other protective service, desired by PERMITTEE, must be arranged for special agreement with the KANSAS EXPOCENTRE at the sole cost and expense of the PERMITTEE or as stipulated in such permit.

7.2 In the event the above-described portion of the said premises is not vacated by PERMITTEE, on the date named at the end of the term for which said portions of said premises are to be used, the KANSAS EXPOCENTRE is hereby authorized to move from said premises at the expense of PERMITTEE, all goods, wares, merchandise and property of any kind and all kinds and description which may then be occupying the portion of said premises on which the term of this permit has expired. The KANSAS EXPOCENTRE shall not be liable for any damage or loss to said goods, wares, merchandise or other property which may be sustained by reason of such removal or the place to which it may be removed. The KANSAS EXPOCENTRE is hereby expressly released from any and all claims for damage or whatever kind of nature. For such additional period beyond the term of this permit, that any effects ofPERMITTEE remain in or on said premises, County shall be entitled to charge the standard sum per day as the payment to be made for this type of event.

SECTION 8.0- DAMAGE OR DEFACEMENT OF BUILDING OR PREMISES

8.1 PERMITTEE shall not injure, mar or in any manner deface said building or premises and shall not cause nor permit anything to be done whereby said buildings or premises shall be in any manner injured or marred or defaced; nor shall he/she drive, nor permit to be driven nails, hooks, tacks, or screws in any part of said building; nor shall he/she make nor allow to be made any alteration of any kind therein. If said premises or any portion of said building or grounds during the term of this permit shall be damaged by the act, default or negligence of PERMITTEE or by the PERMITTEE'S agents, employees, patrons or any person or persons admitted to said premises by said PERMITTEE, PERMITTEE will pay to the County upon demand, such sum as shall be necessary to restore said premises to their original condition. It is PERMITTEE'S responsibility to inspect the KANSAS EXPOCENTRE at move-in and notify the General Manager in writing of all damage present at the time of inspection. SECTION 9.0- SIGNS AND POSTERS

9.1 PERMITTEE shall not do, or permit to be done upon said premises, anything that will tend to injure, mar or in any manner deface said premises, and will not drive or install, or permit to be driven or installed, any nails, hooks, tacks or screws, into any part of the KANSAS EXPOCENTRE and will not allow to be made any alterations of whatsoever kind to said building or any equipment or facilities thereof. PERMITTEE will use, post or exhibit only such signs, advertisements, show bills, lithographs, posters or cards as related to the performance of exhibition to be given the premises under this permit and which meet with the approval of the GENERAL MANAGER.

SECTION 10.0- ADDITIONAL PROVISION

10.1 PERMITTEE agrees that he/she not stage any act or performance in which fire or flame is involved without first having obtained the prior written permission of the Fire Chief or Fire Marshall. PERMITTEE further agrees that he/she will not use

·any decorative materials prohibited by City ordinances, Country resolutions, State or Federal laws and building regulations, including but not limited to: crepe paper, cellophane, confetti, cotton, cornstalks, leaves, evergreen boughs, sheaves of grain, streamers, straw, paper, vines, moss or any similar flammable or combustible materials in or about the premises of the KANSAS EXPOCENTRE. All decorative materials must have the prior approval of the Fire Chief or Fire Marshall. PERMITTEE shall not, without written consent of the Fire Chief of Fire Marshall, put up or operate and engine or motor or machinery on the premises or use oils, burning fluids or gases, camphene, kerosene, naphtha or gasoline inside or on the grounds of the KANSAS EXPOCENTRE.

SECTION 11.0- NON-EXCLUSIVE RIGHT

11.1 The KANSAS EXPOCENTRE shall retain the right to use and/or license use of such portions of its facility, as many not be covered by this permit. The KANSAS EXPOCENTRE also retains the right to re-enter any part of the premises covered by this permit should such part become vacant and to determine that such unused portion may be offered for other use with receipts therefrom going to the KANSAS EXPOCENTRE with an appropriate adjustment on PERMITTEE'S rental rate.

SECTION 12.0- DEFAULT OF PERMITTEE

12.1 PERMITTEE further agrees that if any default is made in the payment or the rent or any part thereof at the times above specified, or if any default is made in the permit herein contained, this permit and the relationship of the parties, at the option of the KANSAS EXPOCENTRE, shall cease and terminate. The relationship of the parties, may at the option of the GENERAL MANAGER, cease and terminate. PERMITTEE shall be liable for the full amount of the rent provided herein, plus actual expenses incurred by the KANSAS EXPOCENTRE which normally would be considered reimbursement expenses in the final settlement. In case suit or action is instituted by the KANSAS EXPOCENTRE to enforce compliance with this permit, the KANSAS EXPOCENTRE shall be entitled, in addition to the costs and disbursements provided by statute, to such additional sums in lawful money of the United States as the court may adjudge reasonable for attorney's fees to be allowed in said suit or action.

SECTION 13.0- LOST ARTICLES

13.1 The KANSAS EXPOCENTRE shall have the sole right to collect and have the custody of articles left in the building by persons attending any performance, exhibition or event given or held in the aforesaid premises. The PERMITTEE or any person in the PERMITTEE'S employ shall not collect or interfere with the collection or custody of such articles.

SECTION 14.0- RIGHT TO ENTER

14.1 The KANSAS EXPOCENTRE does not relinquish and does hereby retain the right to enforce all necessary laws, rules, resolutions and regulations for the management and operation of said premises. The KANSAS EXPOCENTRE retains the right to enter the aforesaid premises at any time and on any occasion without any restrictions whatsoever.

SECTION 15.0- SEATING CAPACITY AND FLOOR PLANS

15.1 PERMITTEE shall not admit to said premises so large a number of persons that they cannot safely and freely move about in said premises. The decision of the KANSAS EXPOCENTRE in this respect shall be fmal. It is further understood and greed the PERMITTEE will permit no chairs or seats to be or remain in the passageways. The sidewalks, grounds, entry passages, vestibules, halls, elevators, abutting streets and all ways of access to public utilities of said premises shall not be obstructed by PERMITTEE or used for any purpose other than for ingress to and egress from the aforementioned premises. The sale of standing room is prohibited.

15.2 PERMITTEE, at the GENERAL MANAGER'S request, may be required to submit two (2) copies of a full and complete floor plan for an exhibit show no less than thirty (30) days before the first move-in day, and no move-in may begin without authorization of said floor plan by the KANSAS EXPOCENTRE.

SECTION 16.0- SPECIAL RESTRICTIONS

16.1 No taping, tacking, stapling, nailing, gluing, etc. on walls. Banners, if applicable, are to be hung at locations approved by the General Manager.

16.2 It is policy that no tools, equipment, and/or materials other than those specified in the contract be made available to the PERMITTEE. Rates for tools, equipment, materials and/or services not specified in the contract are available upon request.

SECTION 17.0- INSURANCE- COUNTY SELF-INSURED

17.1 The KANSAS EXPOCENTRE requires PERMITTEE to procure and maintain in full force, a policy of public liability and property damage insurance, throughout move-in, event, and move-out. Said policy shall be procured from a reliable insurance company authorized to transact business in the State of Kansas, and subject to suit in Shawnee County, Kansas. A copy of said policy, or a certificate that a policy of insurance has been issued, shall be placed on file with the KANSAS EXPOCENTRE no later than (COUNTY SELF- INSURED.)

17.2 PERMITTEE agrees that the KANSAS EXPOCENTRE will acquire insurance utilizing the MASTER VENUE INSURANCE PROGRAM as administered by Marsh USA, Inc. should PERMITTEE fail to supply proper insurance as detailed on SCHEDULE A (insurance requirements) of this contract prior to thirty (30) days before the first use date listed under section 1.2 of this permit. PERMITTEE also agrees to pay the KANSAS EXPOCENTRE for this insurance at the standard rate billed by the KANSAS EXPOCENTRE for this insurance coverage at the time of the event.

17.3 PERMITTEE is to be named insured, and the Board of Commissioners of Shawnee County, Kansas; SMG, a Pennsylvama Joint Venture Partnership, its partners, agents and employees, and the Kansas Expocentre shall be named as additional insured in a policy for minimum premises, bodily injury, liability in $1,000,000.00 per occurrence. Said policy shall also provide for a thirty (30) day notice to the GENERAL MANAGER'S office, prior to cancellation.

SECTION 18.0- PERSONNEL AND EQUIPMENT

18.1 The KANSAS EXPOCENTRE will furnish at its expense:

1. Heat and/or air conditioning as available at the aforesaid premises when required by the season and for the use of said premises for the purpose aforesaid, on event days only. Heat and/or air conditioning will be supplied on move­in and move-out days only if a building rental fee has been paid by PERMITTEE.

2. Light and water for ordinary use for said premises when required in the opinion of the GENERAL MANAGER for the purpose aforesaid.

3. Tum over a clean building and furnish agreed set-up. PERMITTEE must supply a signed floor plan to the KANSAS EXPOCENTRE no later than 10 days prior to the first move-in day.

4. PERMITTEE shall have access to staff to provide custodial services throughout move-in, event and move-out hours of the event.

18.2 PERMITTEE hereby agrees that all personnel, such as public service directors, ushers, ticket takers, doorman, security personnel, sound technicians, stage managers, stage hands and electricians necessary to operate the premises for the event herein specified shall be provided by the KANSAS EXPOCENTRE but shall be paid for by PERMITTEE as an additional service by the KANSAS EXPOCENTRE. The minimum number of personnel necessary for this event shall be fixed by the GENERAL MANAGER.

SECTION 19.0- FORCE MAJEURE

19.1 PERMITTEE, KANSAS EXPOCENTRE, COUNTY, BOARD, GENERAL MANAGER, EMPLOYEES, VOLUNTEERS, THEIR DESIGNEES and parties shall not be liable in damages and have the right to terminate this Agreement for any delay or default in performing hereunder if such delay or default is caused by conditions beyond its control including, but not limited to Acts of God, Government restrictions (including the denial or cancellation of any export or other necessary license), wars, insurrections and/or any other cause beyond the reasonable control of the party whose

performance is affected. General Manager shall have the final authorization in the cancellation of the event due to the above items.

SECTION 19.0- ADDENDUM 1

~ PERMIITEE must spell "KANSAS EXPOCENTRE" correctly when used in any advertising or marketing done in support of any event. Non-compliance with this regulation may result in PERMIITEE being charged for any correct reproduction of advertising or marketing materials.

~ The consumption of alcoholic beverages shall take place only within the confines of the building. The sale of alcoholic beverages is possible only with a valid license. A copy of said license shall be furnished to the KANSAS EXPOCENTRE a minimum of 5 days prior to the event.

~ The KANSAS EXPOCENTRE is a non-smoking facility. The facilities include: Landon Arena, Exhibition Hall, Agricultural Hall, Heritage Hall, and the R.R. Domer Livestock Pavilion. No smoking whatsoever is allowed in the buildings. Designated smoking sections are stationed on the outside of the buildings. This policy will be enforced by KANSAS EXPOCENTRE staff and the show management.

PURPOSE OF THE PLAT: The subject property comprises 44.44-acres, is currently undeveloped, and accessible by two (2) 60-foot wide "legs" extending one-quarter mile east ofSW Docking Road to the main _ body of the property. The two (2) parcels split-off from the subject property (5324 and 5440 SW Docking Road) were not completely recorded until after 1992 when the 200-foot frontage requirement took effect. ACCESS TO THOROUGHFARES: SW Docking Road is a township maintained roadway that is classified as a rural collector roadway. Access consists of two (2), 60-foot wide frontages on SW Docking Road spaced approximately 1 ,200-feet apart.

APPLICATION/CONFORMANCE TO INTERIM DEVELOPMENT GUIDELINES: The subject property is part of a rural/agricultural area in northwest Shawnee County. Pursuant to the general development policies of the Interim Development Guidelines, the predominant emphasis for development in the Rural Area should be the retention of commercial agriculture and its supporting land use, and single­family dwellings at low and moderate densities with adequate public facilities and services. The general land use policy for residential land use within the Rural Area indicates that residential uses which are compatible with farm operations, and which can be adequately served by rural water districts, on-site sewage disposal systems and have access to properly designed public streets shall be permitted on minimum lot sizes. A proposal will be considered appropriate if it does not conflict with the land use policies of the area.

UTILITIES/SERVICES:

1. WATER SERVICE: The property is to be serviced by Osage County Rural Water District No. 8 by means of connection to an existing water main located in SW Docking Road.

2. SEW AGE DISPOSAL: Both lots are to be served by individual septic tank and later field systems as approved by the Shawnee County Health Agency.

3. WASTEWATER PLAN SERVICE AREA: The property is located within the Rural Service Area as reflected by the Shawnee County Wastewater Management Plan; and the proposal appears to be in full compliance with said Plan.

4. DRAINAGE CONDITIONS: A drainage report has been submitted by the applicant's engineer and has been approved by the Shawnee County Public Works Department. No storm sewer system or on-site detention will be required in conjunction with the plat of subdivision.

Action requested: Approval to fill two (2) Office Assistant II (OAII) positions in the SCHA-CHC as outlined below and any subsequent positions that result from filling these positions for the Shawnee County Health Agency (SCHA).

In an effort to ensure appropriate levels of staff to support clinical operations this request is to fill two Office Assistant II positions. These positions are vital to patient flow in the clinics and in providing strong customer service. The major responsibilities of these positions include checking patients in and out for appointments, obtaining and entering data into the patient management system, reviewing income documentation, verifying insurance coverage, collecting and posting appropriate payments to patient accounts as well as addressing patient questions and requests for information. This staffing is consistent with future organizational plans for the Community Health Center.

This request has been reviewed with County Human Resources and the Teamsters. The total annual cost for the two positions is $64,606 including benefits based on current pay schedule. The annual salary for each position is outlined in the table.

Please place this item on the Monday, February 22, 2016 Commission agenda.

The County currently utilizes Berlin-Wheeler for debt collection services for the Shawnee County Treasurer and Zimmerman & Zimmerman, PA for debt collection services for other County departments. The County has been on a month-to-month basis with both agencies since January, 2012. In order to insure that the County is getting the best value possible, our office requests the Board's approval to solicit bids for debt collection services via the attached RFP.

The RFP would solicit bids for debt collection services for the following Shawnee County Departments:

SECTION 1.0- PURPOSE

Shawnee County seeks proposals for ongoing collection of accounts referred to the successful bidder by Shawnee County and to perform all investigation necessary in connection with such debt collection cases. The successful bidder will be engaged by the County in accordance with the agreement set forth as Appendix "A" below to pursue all accounts referred for collection, regardless of the size of the account.

The Shawnee County Departments that will be forwarding accounts for collection include:

• Shawnee County Department of Corrections ·- delinquent accounts for offsite medical services and processing fees.

• Shawnee County Health Agency - delinquent accounts for patient medical services.

• Shawnee County Parks and Recreation Department - delinquent accounts for program registrations, shelter/campsite reservations, and additional shelter fees for cleaning time/damages incurred.

• Shawnee County Public Works - delinquent accounts for sewer fees. • Shawnee County Solid Waste - delinquent bills for commercial trash service,

residential trash service outside of the City of Topeka (The City of Topeka will continue to collect delinquent residential accounts inside City of Topeka), recycling services and roll-off container fees.

SECTION 2.0- MINIMUM QUALIFICATIONS

2. Have a minimum of five (5) years experience providing debt collection services;

3. Provide contact name(s), title(s), qualification(s), phone number(s), and e-mail address( s) of staff assigned to the County account;

4. Provide three (3) references verifying exemplary service. These references MUST have received debt collection service(s) similar to those proposed under this RFP. Provide the business name, address, contact name, phone number, length of service for each client, and a brief description of services provided;

Selected proposers may be asked to provide a presentation to explain their proposals during the evaluation process. The County may elect to waive minor technicalities and further may elect to accept or reject any or all proposals received.

SECTION 4.0 - SUBMISSION OF PROPOSALS

4.1 Envelopes containing proposals must be sealed and marked on the face with the name and address of the submitter and the words, "DEBT RECOVERY SERVICES PROPOSAL FOR SHAWNEE COUNTY"

4.2 Each proposal shall consist of a completed bidform as set forth in Section 5.0 below. Any additional information deemed beneficial may be provided in writing by the submitter.

4.3 All proposals must remain in effect for ninety (90) days after the proposal due date.

SECTION 5.0- MISCELLANEOUS CONDITIONS

5.1 The Board of County Commissioners of the County of Shawnee, Kansas (or their designee) reserves the right to reject any and all proposals.

5.2 No interpretation ofthe meaning of the request for proposals will be made to any submitter orally.

5.3 Each request for such interpretation should be in writing, addressed to the Shawnee County Counselor, Shawnee County Courthouse, 200 SE 7th Street, Room 100, Topeka, Kansas 66603. To be given consideration, the request must be at least 5 calendar days prior to March 15, 2016.

5.4 Any and all such interpretations, and any supplementary instructions which the . County Commission or County Counselor may issue shall be in the form of written addenda to the request for proposals and, if issued, shall be sent by first class mail or faxed to all parties of record having received such requests for proposals.

5.5 Failure of any submitter to receiye any such addenda or interpretations shall not relieve the submitter of any obligations under the proposal as submitted.

5.6 To ensure receipt of any such addenda referred to above, any and all interested parties should make sure their name and address is on file with the Shawnee County Counselor's Office, Shawnee County Courthouse, 200 SE 7th Street, Room 100, Topeka, Kansas 66603.

5. 7 The County and any person or entity hired to perform debt recovery services will agree to be bound by Kansas law, and the agreement between the parties shall be interpreted in accordance with Kansas law.

5.8 The County and the successful proposer will agree that their relationship is an independent contractor relationship only. No joint venture, master/servant, employer/employee or other agency relationship shall be created between the parties.

5.9 The County reserves the right to request additional contract provisions in the final written agreement with the successful proposer.

5.10 Alternate proposals will be considered for an award. The County reserves the right to make the fmal determination of actual equivalency or suitability of such proposals with respect to requirements outlined herein.

5.11 The County may award a contract, based on proposals received, without discussion of such proposals. A proposer's initial offer should therefore be based on the most favorable terms available from a price and technical standpoint. The County may, however, have discussion with those proposers that it deems in its discretion to fall within a competitive range. It may also request best and final offers from such propo!?ers, and make an award and/or conduct negotiations thereafter.

5.12 The County reserves· the right to negotiate separately with any proposer after the opening of this Request for Proposal when such action is considered in its best interest. Subsequent negotiations may be conducted, but such negotiations will not constitute acceptance, rejection, or a counteroffer on the part of the County.

5.13 Proposals may riot be withdrawn for a period of 90 days following the opening of this Request for Proposal. Prices MUST also be free of duties, federal, state, and local taxes unless otherwise imposed by a governmental body, and applicable to the material on the proposal.

5.18 Domestic (Kansas) corporations shall: 1) furnish evidence of good standing in the form of a Certificate signed by the Kansas Secretary of State. Foreign (non-Kansas) corporations shall furnish evidence of authority to transact business in Kansas, in the form of a Certificate signed by the Kansas Secretary of State; and 2) a copy of the Corporation Resolution evidencing the authority to sign the Contract Documents, executed by the Corporation's Secretary or Assistant Secretary.

5.19 The Proposer hereby certifies that he or she has carefully examined all of the documents for the RFP, has carefully and thoroughly reviewed this RFP, understands the nature and scope of the work to be done; and that this proposal is based upon the terms, specifications, requirements, and conditions of the RFP. The proposer further agrees that the performance time specified is a reasonable time, having carefully considered the nature and scope of the project as aforesaid.

5.20 Any confidential or proprietary information should be clearly marked. It will be understood that any proposal and any/all referencing information submitted in response to this RFP will become the property of the County, and will not be returned. The County will use discretion with regards to disclosure of proprietary information contained in any response, but cannot guarantee that information will not be made public. As a governmental entity, the County is subject to making records available for disclosure after Board of Shawnee County Commission approval of the recommendation.

5.21 The County reserves the right to cancel the work described herein prior to issuance and acceptance of any contractual agreement/purchase order by the recommended vendor even if the County has forinally accepted a recommendation.

5.22 The County will issue a contract for the acquisition of services specified as a result of an award made in reference to this document. Contract documents will be subject to any regulations governed by the laws of the State of Kansas and any local resolutions specifically applicable to the purchase. Any dispute arising out of the contract documents or their interpretation will be litigated only within the courts ofthe State of Kansas.

5.23 The County reserves the right to enter into agreements subject to the provisions of the Cash Basis Law (K.S.A. 10-1112 and 10-1113) and the Budget Law (K.S.A. 79-2935). Agreements shall be construed and interpreted so as to ensure that the County shall at all times stay in conforn.Vty with such laws, and as a condition of agreements the County reserves the right to unilaterally sever, modify, or terminate agreements at any time if, in the opinion of its legal counsel, the Agreement may be deemed to violate the terms of such law.

5.24 Successful proposer may have access to private or confidential data maintained by the County to the extent necessary to carry out its responsibilities of the contract. Proposer shall be responsible for compliance with the privacy provision of the Health Insurance Portability and Accountability Act (HIP AA) and shall comply with all other HIP AA provisions and regulations applicable. Proposer shall execute a Business Associate Agreement.

5.25 The proposer agrees all data, records and information, which the proposer, including its agents and employees, obtains access to for the purposes of this proposal, remains at all times exclusively the property of the County. Proposer agrees it will take all reasonable steps and the same protective precautions to protect the County's proprietary information from

disclosure to third parties as with proposer's own proprietary and confidential information. Proposer agrees that all data, regardless of form that is generated as a result of this Request for Proposal is the property of the County.

5.26 The Proposer agrees:

He or she will observe the provision of the Kansas Commission on Human Rights and will not discriminate against any person in the performance of work under the present contract because of race, religion, color, sex, national origin, ancestry, or physical disability;

In all solicitations or advertisements for employees, he or she will include the phrase, 'Equal Opportunity Employer,' or a similar phrase to be approved by the Kansas Commission on Human Rights;

If he. or she fails to comply with the manner in which he reports to the Kansas Commission on Human Rights, he will be deemed to have breached the present contract, and it may be canceled, terminated, or suspended, in whole or in part, by Shawnee . County, Kansas;

If he or she is found guilty of a violation of the Kansas Act Against Human Rights under a decision, or order of the Kansas Commission on Human Rights which has become fmal, he or she will be deemed to have breached the present contract, and it may be canceled, terminated, or suspended, in whole or in part, by Shawnee County, Kansas; and,

He or she will include the provisions of subsections (a) through (d) inclusively of this paragraph in every subcontract or purchase order so that such provision will be binding upon such subcontractor or vendor. K.S.A. 44-1030

5.27 By submission of a response, the proposer agrees that at the time of submittal, it: 1) has no interest (including financial benefit, commission, fmder's fee, or any other remuneration) and will not acquire any interest, either direct or indirect, that would conflict in any manner or degree with the performance of proposer's services, or 2) benefit from an award resulting in a "Conflict of Interest." A "Conflict of Interest" will include holding or retaining membership, or employment, on a board, elected office, department, division, or bureau, or committee sanctioned by and/or governed by the Board of Shawnee County Commissioners of the County of Shawnee, Kansas. 5.28 No gifts or gratuities of any kind shall be offered to any County employee at any time.

APPENDIX "A" Example Contract for Debt Collection Services for the Shawnee County

A CONTRACT FOR DEBT COLLECTION BETWEEN

SHAWNEE COUNTY AND ------THIS CONTRACT is entered into on this ___ day of _____ , 20_,

by and between THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF

SHAWNEE, KANsAS (hereinafter "County") and --------- (hereinafter

"Company"). The parties agree to be bound by the following terms and provisions of this

Agreement:

1. County and Company agree to implement a mutually agreeable method of

exchanging and acquiring necessary information on the accounts from the County that

will allow a seamless transition for agency collections from the current collection agency.

2. County authorizes Company to represent the County in ongoing collection

of accounts referred to Company by the County and to perform all investigation

necessary in connection with such collection cases. Company agrees to pursue all

accounts referred for collection, regardless of the size of the account.

3. County authorizes Company to represent the County in the aforesaid

collection cases, and claims arising there from, and to commence such actions or file such

claims as in its judgment it deems to be in the County's best interest. Provided however,

the parties agree and understand that in the event the need arises pursuant to Paragraph 12

of this Agreement, the County will be notified in advance of such work being performed

and expressly approve of such work prior to such work being performed.

4. County agrees the Company shall receive and retain ___ percent

( %) of any and all monies collected, the "recovery," from any sources. If, in the

future, it becomes necessary to pay court costs, per statute, the Company may charge

those expenses against the recovery.

5. It is further understood expenses do not include credit bureau checks, long

distance phone calls, or mileage. Court costs would be reimbursed from the first payment

received from the defendant. Currently by statute, Shawnee County does not have to pay

court costs.

6. A "recovery" for fee purposes is effective the date the demand letter goes

out pfthe office of the Company. It is further understood that regardless where the funds

come from, the contingency fee shall apply. In addition, Company shall retain all court

ordered attorney fees.

7. In the event that these collection cases are referred out-of-state, then the

contingency fee agreement shall be increased to __ percent L__%) of the proceeds

collected, plus expenses. In states where the sending of a demand letter by Company is

prohibited, Company will immediately forward the case to local counsel at the same

contingency rate.

8. County will grant Company a lien on any and all claims or causes of

action that are the subject of representation by Company, under this Agreement. The lien

will attach to any recovery the County may obtain, whether by arbitration award,

judgment, settlement, or otherwise, from any of the cases given to Company under this

Agreement no matter how said funds are recovered.

9. Shawnee County may cancel this Agreement at any time without showing

cause. Such cancellation will be in writing and apply prospectively only. It is

Uiiderstood that Company has the right to collect all judgments obtained on previously

held cases, and is entitled to the contingency fee on any previously held judgment. This

Agreement shall expire on December 31, 20_, unless cancelled by either party prior to

such date. The County may renew the contract for two (2) additional one (1) year terms

by giving written notice sixty (60) days prior to the expiration of the one (1) year terms

10. It is understood that, should collection cases not result in recovery, the

County will not owe Company for their services, however, the County will still be

responsible for reasonable out-of-pocket expenses, as defmed by this Agreement.

11. It is further understood that in the event of recovery in this matter, all out­

of-pocket expenses advanced and paid by Company shall be repaid first from the total

recovery. The percentage of recovery, from which Company shall retain the fee, shall be

calculated on the remainder, including interest that is recovered, after deducting the out­

of-pocket expenses as aforementioned.

12. Any work performed on bankruptcy appeals or counterclaims shall be

billed on an hourly basis, provided timely notice to the County has been given prior to the

work and written approval has been given in accordance with Paragraph 3 above.

13. County agrees to send accurate and legitimate debts for collection and

agrees to update Company with any changes, which may occur including but not limited

to payments, bankruptcy, settlements, etc. It is understood that, prior to forwarding

delinquent personal property tax accounts to · Company for collection, the Shawnee

County Treasurer shall certify in writing that the County has exhausted its ability to

collect the taxes pursuant to K.S.A. 8-173 and that individuals referred for collection do

not have active Shawnee County license tags. The Treasurer will notify by· Board of

County Commissioners of all such delinquent personal property tax accounts referred for

collection at the time of referral.

14. The Company may destroy all paid in full files and all lost defendant files

after five (5) years.

15. Company agrees to indemnify, sav~ and hold harmless the County from all

loss, cost, and expenses arising out of any liability, or claim of liability, for injury or

damages to person or property sustained, by anyone whomsoever, by any act or omission

of Company or any of its agents or employees, or other similar claims.

16. Company may have access to private or confidential data maintained by

the County to the extent necessary to carry out its responsibilities of the contract.

Proposer shall be responsible for compliance with the privacy provision of the Health

Insurance Portability and Accountability Act (HIP AA) and shall comply with all other

HIP AA provisions and regulations applicable. Proposer shall execute a Business

Associate Agreement prior to providing services.

1 7. This Agreement along with the attached Business Associate Agreement,

Contractual Provisions Attachment and the County's Request for Proposals represents the

entire agreement and understanding between Company and the County. No terms,

conditions, course of performance, usage of trade, understanding, or agreements
