    Bharat Ratna (Hindi: , Hindi pronunciation:[bart rt n]; Jewel of India)[1] is the highest civilian awardof the Republic of India. Instituted on 2 January 1954,the award is conferred in recognition of exceptional ser-vice/performance of the highest order, without distinc-tion of race, occupation, position, or sex. The award wasoriginally limited to achievements in the arts, literature,science and public services but the government expandedthe criteria to include any eld of human endeavour inDecember 2011. Recommendations for the Bharat Ratnaare made by the Prime Minister to the President, witha maximum of three nominees being awarded per year.Recipients receive a Sanad (certicate) signed by thePresident and a peepal-leafshapedmedallion; there is nomonetary grant associated with the award. Bharat Ratnarecipients rank seventh in the Indian order of precedence,but are constitutionally prohibited from using the awardname as a title.The rst recipients of the Bharat Ratna were politician C.Rajagopalachari, scientist C. V. Raman and philosopherSarvepalli Radhakrishnan, who were honoured in 1954.Since then, the award has been bestowed on 45 individ-uals including 12 who were awarded posthumously. In1966, former Prime Minister Lal Bahadur Shastri be-came the rst individual to be honoured posthumously.In 2013, cricketer Sachin Tendulkar, aged 40, becamethe youngest recipient while social reformer Dhondo Ke-shav Karve was awarded on his 100th birthday. Thoughusually conferred on Indian citizens, the Bharat Ratna hasbeen awarded to one naturalised citizen, Mother Teresain 1980, and to two non-Indians, Pakistan national KhanAbdul Ghaar Khan in 1987 and former South AfricanPresident Nelson Mandela in 1990. Most recently, In-dian government has announced the award to freedomghter Madan Mohan Malaviya (posthumously) and for-mer Prime Minister Atal Bihari Vajpayee on 24 Decem-ber 2014.The Bharat Ratna, along with other personal civil hon-ours, was briey suspended from July 1977 to January1980 during the change in the national government andfor a second time from August 1992 to December 1995when several public-interest litigations challenged theconstitutional validity of the awards. In 1992, the gov-ernments decision to confer the award posthumously onSubhash Chandra Bose met with controversy. Due to thedebate surrounding Boses death, the posthumous men-tion of Bose was much criticised, and his family refused

    to accept the award. Following a 1997 SupremeCourt de-cision, the press communiqu announcing Boses awardwas cancelled; it is the only time when the award was an-nounced but not conferred.

    1 History

    On 2 January 1954, a press communique was releasedfrom the oce of the secretary to the President of In-dia announcing the creation of two civilian awardsBharat Ratna, the highest civilian award, and the three-tier Padma Vibhushan, classied into Pahela Warg(Class I), Dusra Warg (Class II), and Tisra Warg(Class III), which rank below the Bharat Ratna.[2] A yearlater on 15 January 1955, the Padma Vibhushan was re-classied into three dierent awards; the Padma Vib-hushan, the highest of the three followed by the PadmaBhushan and the Padma Shri.[3]

    There is no formal provision that recipients of the BharatRatna should be Indian citizens. It has been awarded toa naturalised Indian citizen, Mother Teresa in 1980, andto two non-Indians, Khan Abdul Ghaar Khan of Pak-istan in 1987 and the late former South African presidentNelson Mandela in 1990.[4] Sachin Tendulkar, at the ageof 40, became the youngest person and rst sportsper-son to receive the honour.[5] Dhondo Keshav Karve wasawarded on his 100th birthday on 18 April 1958 in aspecial ceremony.[6][lower-alpha 1] As of 2015, the awardhas been conferred upon 45 people with 12 posthumousdeclarations.[9][10]

    The award was briey suspended twice in its history.[11]The rst suspension occurred after Morarji Desai wassworn in as the fourth Prime Minister of India in 1977.His government withdrew all personal civil honours on 13July 1977 and past recipients were asked not to use theawards as a title.[12][13] The suspension was rescinded on25 January 1980 after Indira Gandhi again became thePrime Minister.[14] The civilian awards were suspendedagain in mid-1992 when two Public-Interest Litigationswere led, one in the Kerala High Court and another inthe Madhya Pradesh High Court, challenging the con-stitutional validity of the awards.[11] The awards werereintroduced by the Supreme Court of India in Decem-ber 1995 following the conclusion of the litigation.[13][15]

    2 RegulationsThe Bharat Ratna is conferred in recognition of excep-tional service/performance of the highest order,[16] andwas originally conned to the arts, literature, science andpublic services, per the 1954 regulations.[2] But, in De-cember 2011, the rules were changed to include any eldof human endeavour.[17] The 1954 statutes also did notallow posthumous awards but this was subsequently mod-ied in the January 1955 statute and Lal Bahadur Shastribecame the rst recipient to be honoured posthumouslyin 1966.[3][18]

    Although there is no formal nomination process, recom-mendations for the award can only be made by the PrimeMinister of India to the President with a maximum num-ber of three nominees being awarded per year. The re-cipient receives a Sanad (certicate) signed by the Presi-dent and a medallion without any monetary grant. Un-der the terms of Article 18 (1) of the Constitution ofIndia,[lower-alpha 2] the recipients cannot use the award asa prex or sux to their name, although recipients mayuse either the expressions Awarded Bharat Ratna by thePresident or Recipient of Bharat Ratna Award to indi-cate that they have been honoured with the award.[16] Theholders of the Bharat Ratna rank 7th in the Indian orderof precedence.[20]

    As with many ocial announcements, recipients are an-nounced and registered in The Gazette of India, a publi-cation released by the Department of Publication, Min-istry of Urban Development used for ocial governmentnotices; without publication in the Gazette, conferral ofthe award is not considered ocial. Recipients whoseawards have been revoked or restored, both of which re-quire the authority of the President, are also registered inthe Gazette. Recipients whose awards have been revokedare required to surrender their medal, and their name tobe struck from the register.[2][3]

    3 SpecicationsThe original 1954 specications of the award was a cir-cle made of gold 1 38 inches (35 mm) in diameter witha centred sun burst design on the obverse side. The textBharat Ratna, in Devanagari Script, is inscribed on theupper edge in silver gilt with a wreath set along on thelower edge. A platinum Emblem of India was placed inthe centre of the reverse side with the national motto ofIndia, "Satyameva Jayate" (Truth alone triumphs) in De-vanagari Script, inscribed in silver-gilt on the lower edge.A year later, however, the design was modied to theform that is currently in use. The current medal is in theshape of a Peepal leaf, about 2 516 inches (59 mm) long,1 78 inches (48 mm) wide and 18 inch (3.2 mm) thickand rimmed in platinum. The embossed sun burst design,also made of platinum, on the obverse side of the medal

    has a diameter of 58 inch (16 mm) with rays spreadingout from 56 inch (21 mm) to 12 inch (13 mm) from thecenter of the Sun. The words Bharat Ratna on the ob-verse side remained the same as the 1954 design as did theemblem of India and Satyameva Jayate on the reverseside. A 2-inch-wide (51 mm) white ribbon is attached tothe medal so it can be worn around the neck.[3][11][21] In1957, the silver-gilt decoration was changed to burnishedbronze.[2][22]

    4 List of recipients

    5 ControversiesThe Bharat Ratna has been surrounded by several contro-versies and multiple Public-Interest Litigations (PIL) hadbeen led against the conferral of the award.

    Subhas Chandra Bose (1992)

    In 1992, a press release was published to confer the awardposthumously on Bose which was later cancelled by the SupremeCourt of India in 1997.

    On 23 January 1992, a press release was published by thePresidents Secretariat to confer the award posthumouslyon Subhash Chandra Bose. The decision triggered muchcriticism and a Public-Interest Litigation was led in theCalcutta High Court to revoke the award.[70] The peti-tioner took objection to the conferral of the award andits posthumous mention of Bose saying that honouring apersonality higher than the award is ridiculous and wasan act of carelessness to classify such a person with pastand future recipients. It also said that the award cannot

  • 3be conferred to Bose posthumously as the Governmentof India had not ocially accepted his death on 18 Au-gust 1945. The petitioner also requested the whereaboutsof Bose from 18 August 1945 till date, based on the in-formation collected by the 1956 Shah Nawaz Committeeand the 1970 Khosla Commission. The family membersof Bose also expressed their unwillingness to accept theaward.[71][72]

    To deliver the judgement, the Supreme Court of Indiaformed a Special Division Bench with Judge Sujata V.Manohar and G. B. Pattanaik. The Solicitor General ofIndia noted that to confer the award per the appropriateregulations pertaining to the Bharat Ratna, Padma Vib-hushan, Padma Bhushan, and Padma Shri, the name ofthe recipient must be published in The Gazette of In-dia and entered in the recipients register maintained un-der the direction of the President of India.[2] It was alsonoted that only an announcement had been made by presscommunique but the government had not proceeded toconfer the award by publishing the name in the Gazetteand entering the name in the register. Furthermore, thethen presidents of India, R. Venkataraman (198792) andShankar Dayal Sharma (199297), had not conferred aSanad (certicate) with their signature and seal.[71]

    On 4 August 1997, the Supreme Court of India deliveredan order that since the award had not been ocially con-ferred, it cannot be revoked and declared that the presscommunique be treated as cancelled. The court declinedto pass any judgement on the posthumous mention ofBose and his death.[71][73]

    Constitutional validity (1992)

    In 1992, two PILs were led in the High Courts of In-dia; one in the Kerala High Court on 13 February 1992by Balaji Raghavan and another in the Madhya PradeshHigh Court (Indore Bench) on 24 August 1992 by SatyaPal Anand. Both petitioners raised a question about thecivilian awards being Titles per an interpretation ofArticle 18 (1) of the Constitution of India.[lower-alpha 2] On25 August 1992, the Madhya Pradesh High Court issueda notice temporarily suspending all civilian awards.[13] ASpecial Division Bench of the Supreme Court of Indiawas formed comprising ve judges; A. M. Ahmadi C. J.,Kuldip Singh, B. P. Jeevan Reddy, N. P. Singh, and S.Saghir Ahmad. On 15 December 1995, the Special Di-vision Bench restored the awards and delivered a judge-ment that the Bharat Ratna and Padma awards are nottitles under Article 18 of the Constitution of India.[15]

    C. N. R. Rao and Sachin Tendulkar (2013)

    Following the announcement, in November 2013, that C.N. R. Rao and Sachin Tendulkar were to be awarded theBharat Ratna, multiple Public-Interest Litigations wereled challenging the conferring of the award. The PILled against Rao declared that other Indian scientists,

    such as Homi Bhabha and Vikram Sarabhai, had con-tributed more than Rao and his claim of publishing 1400research papers was physically impossible. The suitalso stated that as Rao had proven cases of plagiarism, heshould not be presented with the award but rather shouldbe annulled.[74] The PIL led against Tendulkar to theElection Commission of India under the Right to Infor-mation Act indicated that the awarding him the BharatRatna was a violation of the model code of conduct.The petitioner noted that as Tendulkar was an IndianNational Congress nominated Member of Rajya Sabha,the decision to award him the Bharat Ratna would inu-ence the voters of Delhi, Rajasthan, Madhya Pradesh,Chhattisgarh and Mizoram where the election processwas underway at the time.[75] Another PIL was ledagainst Tendulkar and a few ministers, alleging a con-spiracy to ignore an Indian eld hockey player DhyanChand.[76][lower-alpha 6]

    On 4 December 2013, the Election Commission of Indiarejected the petition stating that conferring the award onpeople from non-polling states did not amount to a viola-tion of the code.[77] Other High Courts of India also re-jected the petitions raised against Rao and Tendulkar.[78]

    6 CriticismSeveral awards of the Bharat Ratna have spurred muchcriticism as they have been considered political awardsto persons who have not necessarily merited the honour.As the recommendations for Bharat Ratna are made bythe Prime Minister of India to the President, the thenPrime Ministers Jawaharlal Nehru (194764) and IndiraGandhi (196677, 198084) have been criticised forhonouring themselves with the awards in 1955 and 1971respectively.[57][79]

    In 1988, then Prime Minister of India Rajiv Gandhi(198489) conferred the Bharat Ratna posthumously onlm actor and former Chief Minister of Tamil NaduM. G. Ramachandran in a bid to inuence voters priorto the Tamil Nadu assembly elections in 1989.[80][81]The decision was also criticised for awarding Ramachan-dran before independence activist B. R. Ambedkar andVallabhbhai Patel, who were bestowed the honour in1990 and 1991 respectively.[82]

    While Ravi Shankar was accused of lobbying for theaward,[57] the decision by Indira Gandhi to posthumouslyhonour K. Kamaraj was said to have been aimed at placat-ing Tamil voters for the Tamil Nadu assembly elections in1977. The seventh Prime Minister V. P. Singh was alsocriticised for posthumously honouring B. R. Ambedkarto please Dalits.[79][80]

    A few of the conferments have been criticised forhonouring personalities only after they received globalrecognition.[83] The award for Mother Teresa was an-nounced in 1980, a year after she was awarded the Nobel

    Peace Prize. Satyajit Ray received an Academy Hon-orary Award in 1992 followed by the Bharat Ratna thesame year.[84][85] In 1999, Amartya Sen was awarded theBharat Ratna, a year after his 1998NobelMemorial Prizein Economic Sciences. The award was proposed by Pres-ident K. R. Narayanan to Prime Minister Atal Bihari Va-jpayee who agreed to the proposal.[86][87]

    7 Popular demandsThough, as per the statutes for the Bharat Ratna, therecommendations for the award can only be made bythe Prime Minister to the President,[16] there have beenseveral demands from various political parties to hon-our their leaders. In January 2008, Bharatiya JanataParty (BJP) leader L. K. Advani wrote to Prime Min-ister Manmohan Singh recommending Singhs predeces-sor Atal Bihari Vajpayee for the award.[33][88] This wasimmediately followed by the Communist Party of India(Marxist) lobbying for their leader, Jyoti Basu, formerChief Minister of West Bengal.[38] Basu, Indias longest-serving chief minister, said that he would decline thehonour, even if awarded.[89] Similar such demands in-clude the Telugu Desam Party leader N. ChandrababuNaidu for N. T. Rama Rao, Bahujan Samaj Party leaderMayawati for Kanshi Ram and the Shiromani Akali Dalfor Parkash Singh Badal.[90]

    Per the original statutes, sportspersons were not eligi-ble for the Bharat Ratna; however a revision of therules in December 2011 made eligible any eld ofhuman endeavour.[17] Subsequently, several sportsper-sons names were discussed; among the most talked-about of these was eld-hockey player Dhyan Chand, whowas recommended multiple times for the posthumoushonour.[91] In 2011, 82 members of parliament recom-mended Chands name for the award to the Prime Min-isters Oce (PMO). In January 2012, the Ministry ofYouth Aairs and Sports forwarded his name again, thistime along with 2008 Summer Olympics gold medallistshooter Abhinav Bindra and mountaineer Tenzing Nor-gay.[92] Bindra had also been recommended for the awardin May 2013 by the National Rie Association of In-dia.[93] In July 2013, the ministry again recommendedDhyan Chand.[92][94] However, in November 2013, crick-eter Sachin Tendulkar became the rst sports-personto receive the honour.[5] The decision to honour Ten-dulkar before Chand gathered much criticism for thegovernment.[95]

    8 Explanatory notes[1] The Bharat Ratna ceremony is usually held at Rashtrapati

    Bhavan, New Delhi but a special ceremony was held atBrabourne Stadium, Mumbai to honour Karve on his100th birthday on 18 April 1958.[7][8]

    [2] Per Article 18 (1) of the Constitution of India: Abolitionof titles, no title, not being a military or academic dis-tinction, shall be conferred by the State.[19]

    [3] In 1960, Ramachandran was awarded the Padma Shri, thefourth highest civilian award, but declined as the invitationwas written in the Devanagari script and not Tamil.[48]

    [4] Desai had earlier abolished the awards while he was inthe oce of Prime Minister for it being worthless andpoliticized.[53]

    [5] Earlier, Abul Kalam Azad had refused the Bharat Ratnawhile he was Education Minister of India (194758) cit-ing that the selection committee members should notthemselves be recipients.[55][56][57]
