We have heard Mr. M. C. Mehta and Dr. A. Kishan Rao, who
was appointed as a Member of the Supreme Court Monitoring
Committee, apart from Mr. T. Sai Krishnan, learned counsel
appearing for the Andhra Pradesh Pollution Control Board (Board)
as well as the Andhra Pradesh State Government and the officials
who accompanied him, extensively.
2. From the submissions made by the above said persons. it is
clear that in spite of the order having been passed by the Apex
Court as early as in the year 1992, directing to provide potable water
supply to all the villagers of the 20 villages which are affected, even
as on date, certain villages have not been provided with drinking
water either in sufficient quantity or in quality.
3. Mr. M.C Mehta as well as Dr. Kishan Rao have produced the
samples of water taken from Chidruppa as well as Khazipalli. The
very colour and the suspended materials seen in the samples show
the pathetic situation. The so called water supplied to the people is
absolutely not drinkable in nature. In spite of it we do not
understand as to how the note of the Board shows that in respect of
all the 20 villages potable drinking water has been supplied. It is
stated that in a village having a population of 4,000 people, 40,000
litres of water is supplied every day. Even if minimum requirement of
40 litres per person per day is taken, the supply has to be 1,60,000
litres per day. If that is so, we do not understand as to how the
supply of 40,000 litres of water for a village having population of
4,000 people is sufficient per day. This is grossly inadequate, apart
from the demonstration made that such water is not drinkable in
terms of quality also.
4. In our view, there is a total defiance of the order of the
Hon’ble Supreme Court of India even in respect of the supply of
water which is a basic necessity. In such view of the matter, as an
urgent measure, we issue the following directions to be scrupulously
implemented both by the Andhra Pradesh Government as well as
the Board and report the status of implementation on the next date
of hearing.
(i) In respect drinking water, adequate water supply should be
made by the Government through lorries, to be supplied to each of
the following 20 villages in Medak District:
(1) Baithole (2) Arutla (3) Chidruppa (4) Ismailkhanpet (5)
Gandigudem (6) Sulthanpur (7) Khazipalli (8) Kistareddypet (9) Inole
(10) Peddakanjarla (11) Patancheru (12) Lakdaram (13) Muthanghi
(14) Isnapur (15) Kandi (16) Rudraram (17) Ramachandrapuram
(18) Kalabgoor (19 Chitkul (20) Pocharam
(ii) In the outskirts of all the 20 villages, water tanks are to be
constructed and filled up with water to enable the cattle and other
animals to drink. The construction of the tanks and regular storage
of water are to be monitored by the Board on a regular basis.
(iii) The Government shall immediately initiate action for the
purpose of establishing Detoxification and Health Rehabilitation
Centres with required facilities and trained personnel in each of the
villages.
5. The above said preliminary steps are to be taken forthwith on
war footing basis and the progress on the same has to be reported
to this Tribunal on the next date of hearing.
6. To report the above said preliminary steps, we direct the
matter to be posted on 6.11.2015.
7. Taking note of the elaborate submissions made by Dr. Kishan
Rao, we are fully satisfied that none of the industrial unit is following
the standard in respect of the discharge of the industrial effluents
into the water bodies and other places. There are instances which
are pointed out by Dr. Kishan Rao, especially in Khazipalli where the
industrial estate was established in the year 1993 without following
proper site selection process and without planning the water
sourcing and wastewater disposal systems. It is alarming to note
that in Khazipalli industrial area which is stated to be on a hillock,
there is no waste disposal system from 1993 till date. Moreover,
there are other instances to show that the industrial units are
discharging effluents in spite of the fact that the Board has taken a
stand that there is “zero” discharge.
8. In these circumstances, we are of the view that it is
absolutely necessary to appoint a High Level Fact Finding
Committee for the purpose of finding out the factual situation in
respect of nearly 240 industrial units said to be situated in
Patancheru and other surrounding areas. The Committee shall give
a detailed report on each of the industrial units, their performance,
discharge of effluents and also the quality of water drawn by those
industries and discharged by them. The Committee shall be given
all assistance by the State of Andhra Pradesh as well as the Board
and we make it very clear that whatever recommendation given by
the Committee shall be implemented by the State in respect of the
day to day administration of the units after placing the same before
this Tribunal and the orders having been obtained. The Committee
shall be headed by Hon’ble Shri P. Laxmana Reddy (Cell
No.9989222217), a retired Judge of the Andhra Pradesh High Court
who has graciously accepted to act as the Chairman of the
Committee. The Committee shall consist of the three Members
viz.,(1) Dr.A. Kishan Rao (Tel:08455 – 242406, Mobile:
9849648755); (2) Shri Kaushik N. Sharrma, Advocate (Mobile:
9962516118 and the 3rd Member will be nominated after the name
furnished by the project proponent on the next date of hearing.
9. We request the said Committee to visit the entire area. As
and when the Committee decides to visit the spot, the Committee
Members are entitled to make visits of their own and in cases where
they want to collect relevant particulars as well as any of their
needs, notices shall be issued to the industrial units and the State as
well as the Board shall give all their assistance. The Board shall
also provide all required facilities to the Members of the Committee.
We make it clear that whenever the committee decides to visit after
giving notice to the units, necessary intimation may be given to the
learned counsel appearing for the Board Mr. Sai krishnan and
Mr.M.C. Mehta, to enable them to be present, depending upon their
convenience. The committee may also inspect the PETL as well as
the JETL and then give the report within a period of eight weeks.
The Board shall provide a separate ‘’Office Establishment’’ for the
functioning of the Fact Finding Committee and all other incidental
expenses shall be borne by the Board. We also direct that the
Committee is entitled to take the assistance from any of the Experts
of their choice, including the Central Environmental Department and
NEERI and whatever expenses is required in that regard shall be
borne by the Board.
