1. The parties, by counsel, have announced to the Court their agreed

resolution of all matters in controversy in this action for determination of the ownership

of the coal bed methane attributable to two tracts of land (a 13.17acre tract and a 10.0

acre tract), and for the determination of entitlement to any royalties or other proceeds

being held in an escrow account by the Virginia Oil and Gas Board attributable to the

production of coal bed methane attributable to these two tracts of land.

2. In their Complaint in this action, the plaintiffs allege that they own the

surface rights, and that the defendant owns the coal rights, with respect to both of these

tracts.

3, As a term of this resolution, the plaintiffs release all claims of ownership by

them to the coal bed methane attributable to the 13.17 acre tract, and in turn they also

release all claims of entitlement by them to any royalties or other proceeds being held in
