    Lecture Meetings

    Dear Members,

    Let me begin this communiqu by paying a tribute to the martyrs in

    Mumbai on 26th November 2008s terrorist attack. In the past one year,

    citizens of this City of Hope displayed solidarity and resilience as never

    before. On 25th November 2009, BCAS joined other organisations in

    paying a fitting tribute to the martyrs as well as victims of that tragedy.

    Keeping its tradition of innovation, BCAS has launched a month-long

    activities in December 2009 in the upcoming field of International Financial

    Reporting Standards (IFRS). December 2009 has been declared as the

    IFRS Month. The inaugural address of IFRS Month was delivered by

    Narendra P. Sarda on 25th November at K. C. College auditorium at which

    global developments in IFRS were dealt with.

    On 7th November 2009, a half-day seminar was organised on the subject

    of Information Technology Changing Ways, Fraud Detection and Data

    Mining at the BCAS premises. The seminar was addressed by Shariq

    Contractor, Chetan Dalal and Nikunj Shah and received an overwhelming

    response. BCAS again pioneered a seminar on Standards of Internal

    Audit on 21st November 2009, at which more than 60 people enrolled

    and benefited. Ashutosh Pednekar and Nandita Parekh enlightened the

    participants on 16 Standards on Internal Audit which are issued by the

    Internal Audit Standard Board of the ICAI. Though recommendatory, these

    Standards provide comprehensive guidelines for conduct of Internal Audit

    and thereby help members improve on quality, efficiency and consistency

    in the conduct of internal audit.

    The year 2009 has been a mixed bag for India. The worlds largest

    democracy voted the UPA Government to power for the second

    consecutive term. India has almost come out of global recession, with

    recruitments back on track and economy poised to grow at 6-7% p.a. India

    has remained one of the favourite destinations for foreign direct

    investments. On the other hand, food and water shortage and inflation are

    worrisome. The gap between the haves and the have not has widened

    leading to the conclusion that the fruits of liberalisation have not percolated

    down. Let us usher in the New Year with the fond hope of more balanced

    and inclusive growth for all sections of society.

    The much awaited ICAI elections are over. The attempt by BCAS to

    strengthen the democratic process by seeking views of the candidates on

    some of the burning issues of the profession could not be carried through

    for reasons beyond our control. Nevertheless, the spirit of members of

    BCAS cannot be dampened by such developments and BCAS will continue

    to act proactively for the betterment of the profession and its members.

    Right to Information Clinic

    BCAS Foundation operates Right to Information (RTI) Clinic on a

    regular basis. RTI Clinic is operated by Mrs. Hema Sampat, a

    research scholar on the subject of RTI, Mr. A. K. Asher, Advocate

    & RTI activist and Mr. Narayan Varma, past President, BCAS.

    The Clinic provides help and guidance to BCAS members as alsoto non-members, i.e., all citizens, for making applications under

    the RTI Act and also assists in resolving any related difficulties

    on the subject of RTI.

    The RTI Clinic operates on every 2nd, 3rd and 4th Saturday

    from BCASs office 11 a.m. to 1 p.m.

    The next RTI Clinic days accordingly are 19th and 26th

    December and 9th, 16th and 23rd January 2010. Please call

    the Societys office (Ms. Shernaaz : 61377600) to obtain a prior

    appointment.

    Study Group onInternational Tax Decisions

    The current incessant and often conflicting and divergent flow of judicial

    decisions in the arena of International Taxation have unsettled many of

    our understandings, making it imperative for us to keep constant track

    of the developments in the field. With this objective in mind, it is proposed

    to set up a Study Group on International Tax Decisions to be led by

    experts in the field of international taxation to have threadbare

    deliberations on the decisions by various Tribunals, Authority for Advance

    Rulings (AARs) and Courts (including some important decisions by

    foreign courts) in the arena of international taxation.

    The Study Group is a joint initiative with the Chamber of Tax Consultants.

    Membership contribution for the group will be Rs.1,750 for the Calendar

    year 2010.

    The Study Group will start functioning from January 2010. It is proposed

    to hold about 8 to 10 meetings in a year.

    This Study Group will be ideal for Chartered Accountants practising or

    specialising in the filed of International taxation and/or in industry having

    to deal with non-residents on regular basis.

    Membership of the Study Group will be restricted to total of 150 members

    enrolled by both the organisations on First-Come-First-Enrol basis.

    The Reserve Bank of India has issued the following 4 Circulars during

    Notification No. 13/2009/F. No. 6/8/2009 ES issued by the

    Government of India, Ministry of Finance (Department of

    Revenue) dated November 12, 2009.

    Know Your Customer (KYC) norms/Anti-Money Laundering (AML)

    Standards/Combating of Financing of Terrorism (CFT)/Obligation

    of Authorised Persons under Prevention of Money Laundering

    Act, (PMLA), 2002, as amended by Prevention of Money

    Laundering (Amendment) Act, 2009 Money Changing Activities

    Suspicious Transaction Reporting Format.

    The amendments to the Prevention of Money Laundering Act coming

    into force, with effect from June 1, 2009, vide the Prevention of

    Money Laundering (Amendment) Act, 2009 (21 of 2009), has brought

    Authorised Persons within the definition of Financial Institutions under

    Section 2(l) of the said Act. As a result, in terms of Section 12 ofthe Act and the rules made thereunder, Authorised Persons are

    required to furnish information to Financial Intelligence Unit-India (FIU-

    IND) in the prescribed format.

    The Government of India has, vide its Notification No. 13/2009/F.No.6/

    8/2009-ES, dated November 12, 2009, also amended Prevention of

    Money Laundering (Maintenance of Records of the Nature and Value

    of Transactions, the Procedure and Manner of Maintaining and Time

    for Furnishing Information and Verification and Maintenance of

    Records of the Identity of the Clients of the Banking Companies,

    Financial Institutions and Intermediaries) Rules, 2005. A copy of the

    amendment Notification is annexed to this Circular.

    This Circular advises all Authorised Persons (including franchisees of

    Authorised Persons) to furnish Suspicious Transaction Report (STR)

    to FIU-IND in respect of their money-changing activities within 7 days

    of arriving at a conclusion that a transaction, including attempted

    transaction, whether or not made in cash, or a series of transaction

    integrally connected are of suspicious nature. The formats of STR,

    both manual and electronic, are available on the website of FIU-IND,

    viz. http://fiuindia.gov.in.

    Tenth Intensive Study Course on

    Double Tax Avoidance Agreement

    The 10th batch of the Intensive Study Course on Double Tax

    Avoidance Agreement (DTAA) would be held from 19th December

    2009 to 13th March 2010.

    This intensive course would be conducted in classroom style. There

    will be around 28 lectures in all, covering each article of DTAA with

    special emphasis on features like force of attraction, most favoured

    nation and triangular cases and a test thereafter. The UN Model

    Convention will form the basis of the course.

    Faculty will comprise senior professionals having expertise in the fieldof International Taxation. This may include the following persons,

    India has embarked on an ambitious and yet achievable growth

    trajectory, more particularly in the Infrastructure sector apart from

    various other sectors of the economy. This necessitates significant

    activities for construction, engineering, consultancy and related

    activities for various such projects.

    The purpose of the seminar is to understand the various aspects

    relating to EPC Contracts such as legal and contracting structures,

    its documentation, efficient planning, direct and indirect taxation, etc.

    The recent judicial pronouncements and the undercurrent of inter-

    national practice, which have a bearing on such contracts will also

    be discussed. It would be our endeavour to allow some interactionat the Seminar.
