Mission Statement

The Architectural Control Committee (Master ACC) is a permanent committee of the BaywindsCommunity Association (Master Association) pursuant to Section 19 of the Declaration ofRestrictions and Covenants for the Baywinds Community (Master Declaration).

The Master ACC administers and performs architectural review and control functions relating toproposed alterations/improvements to assess conformity with the general plan and scheme ofdevelopment of Baywinds.

The Master ACC may adopt, with the approval of the Board of Directors, Baywirtds CommunityStandards relating to aiterationsyimprovements within Baywinds, including standards governingthe performance or conduct of owners, contractors and their respective employees.

The Master ACC may consider in its review and evaluation of proposed improvements suchfactors as:

* Suitability and Harmony of the proposed alteratibri(s)/improvement(s) with thes'urrounding'area

From the perspective of appearance and aesthetics, the materials of Which theafteration(s}/fmprovernenf(s) are to be built

* The site upon which the alteration(s)/improvement(s) are proposed to be erected

» The effect of the proposed afteration(s)/improvement(s) on adjoining or neighboringproperty

« Conformity With Baywinds Community Standard's as may be adopted by the MasterAGC, from time to'time, with the approval of the Board of Directors.

Organization and Structure

The Architectural Control Committee (Master ACC) is a permanent committee of the BaywindsCommunity Association (Master Association) pursuant to Section 19 of the Declaration ofRestrictions and Covenants for the Baywinds Community (Master Declaration).

The Master ACC administers and performs architectural reviews and control functions relating toproposed alterations/Improvements to assess conformity with the general plan and scheme ofdevelopment of Baywinds.

Baywinds is composed of twelve (l2)Neighborhoods:

Bridgeport at Baywinds* Egret Cove» Harbour Cove« Heron Cove* Lighthouse Pointe* Pelican Cove»• Regatta Cove* Sandpiper Walk« Saiifish Cove

Sapphire Cove* the Estates* Windjammer Cove

The Master ACC shall consist of twelve (12) Members, one representative from eachNeighborhood. Each Neighborhood may also designate an Alternate Member to serve in theabsence of its Member.

Committee officers shall consist of a Chairperson, an assistant Chairperson and a Secretaryejected by the Members of the Committee. Committee Officers shall serve for a term of one '(1)year. Election of officers shall be by secret ballot. Secret ballot may be waived by unanimousvote of the Members.

A quorum for the purpose of conducting the business of the Master ACC shall be a majority of theMembers. In the event of the absence of a Neighborhood Member, the respective AlternateMember in attendance shall be counted in place of the Neighborhood Member for the purpose ofestablishing a quorum.

Each Neighborhood shall have one vote in all .matters before the Master ACC. An AlternateMember may vote in the absence of the respective Neighborhood Member.

Alterations / Improvements Requiring Application to Master ACC

Applications to the Master ACC shall be required for the following 'proposedalterations/improvements by Baywinds Hofrieowners:

• Changes in a Home's roof color, material or design

Installation of Solar Panels

• Installation of Sky Lights

• Installation of Satellite Dishes

• Installation of Permanent Generators and Fuel Tanks

• Any material changes to the footprint or facade of a Home

Forthe purpose of implementing these rules, the following shall appfy:

«• "Footprint" shall mean the original square footage of the ground floor level of theHome, including Its shape/Outline at ground level, as originally constructed by thedeveloper.

» "Facade" shall mean the appearance of any exterior wall of the Home (front, backand'side walls) as originally constructed fay the developer.

The Master ACC will develop, forthe approval of the Board of Directors, Baywinds CommunityStandardgforthe above-noted items that will be used to guide Master ACC review ofApplications. Community Standards developed by the Master ACC and approved fay the Boardof Directors shall be published and distributed to all Baywinds Homeowners.

Requirements for Master Application for Alterations

All applications to. the Master ACC for alterations/improvements shall be accompanied by acompleted form entitled "Master Application for Alterations' (Master Application) established forthis purpose by the Master ACC.

To receive consideration fay the Master ACC, all applications shall consist of the MasterApplication Form and, at a minimum, shall include:

* Copy of the homeowner's Plat Survey indicating the location of the property on whichthe alteration(s)/irhprovement(s) are to be constructed

« Sketch of the requested altefation(s)/impravement(s) with actual dimensions andindicating the design, size, shape, color, etc. of the proposedalteration(s)/improvement(s)

« Copies of all Contractors Licenses,

* Copies of ail Contractors Liability and Workman's Compensation Certificates,

* Neighbofs-Consent Fdrrn, Where applicable, as per Neighborhood Standards.

Further, when considering an Application, the Master ACC may request additional informationthat the Master ACC determines, in its sole discretion, to be necessary for consideration of theApplication.

In addition to the above, the Master ACC may, v/ith the approval of the Board of Directors, amendthese requirements, from time to time. Approved amendments to the requirements shall bepublished and distributed to all Baywinds Homeowners.

Community Standards

ROOES

1. Replacement roofing materials shall be the same color, style and appearance as the original roofingmaterial, unless otherwise approved by the Master ACC.

2. No wood or asphalt roofing materials shall be used. Hurricane-rated, coated steel roofing material may beused, if approved by the Master ACC. and shall have documentation establishing its compliance withFlorida Building Code requirements for Hurricane Protection (Miami-Bade County Product ControlApproval. Notice of Acceptance (NOA)).

3. Changes to the color, material, style or appearance of a roof must be approved by the Master ACC beforeany such change may be made.

4. In certain Bayvrinds 'Neighborhoods, such as Bridgeport, Lighthouse Points and Windjammer Cove,multiple units share a Common or Party Roof, existing rules in the respective Neighborhood Documentsgoverning the repair and maintenance of the roofs shall apply, except that no alteration, addition orstructural change, including change in color, material, style or appearance of the roof, may be made -withoutfirst obtaining the written approval of all unit owners sharing that Common or Parly Roof and die approvalof the Master ACC.

SATELLITE DISHES

In addition to the requirements contained in Section 12,. 18 of the Master Declaration, the following shall apply:

1. Satellite dishes may not exceed one (I) meter in diameter.

2. Satellite dishes shall be installed as close as possible to flic rear of die Home and as close as possible to theroof line.

3. Exposed wiring/cable must be secured to the building in a conduit painted to match flic building color.

4. Satellite dishes shall be installed in a manner such that they are firmly attached to die Home.

5. Master ACC approval is required before a satellite dish may be installed.

TUBTTLAR SKYLIGHTS

1. Tubular skylights may not exceed, twenty-one (21) inches in diameter.

2. The tubular portion, supporting die clear dome must match the color of the roof tiles.

3-. Tubular skylights shall have documentation- establishing its compliance wifll Florida Building Coderequirements for Hurricane Protection (Miami-Dade County Product Control Approval. Notice of

Acceptance (NOA).

4. Master ACC approval is required before a tubular skylight may be installed.

RECTANGULAR SKYLIGHTS

1. Rectangular skylights may not exceed twenty-one (21) indies in width or thirty- six (36) inches In length.

2. Hie rectangular frame supporting the clear portion of die skylight must match the color of the roof tiles.

3. Rectangular skylights snail have documentation establishing its compliance with Florida Building Coderequirements for Hurricane Protection (Miami-Bade County Product Control Approval. Notice ofAcceptance (NOA).

4. Master ACC approval Is required before a rectangular skylight may be installed,

SOLAR PANELS

1, Solar panels must be Installed by a certified contractor using material to meet county requirements.

2. To the extent feasible, solar panels installed on the roof of a Home are to be located at the rear of the Homeso as not to be visible from the street,

3.. Exterior wires and cable must be secured to the building and covered in conduit matching the color of thebuilding.

4. Solar panels shall not be installed in the front (street side) yard of a Home. Solar panels installed on theground or oh a concrete slab shall be a minimum often (10) feet from side or rear property lines or anyeasement line and shall be screened so as not to be visible from neighboring properties. Screening materialmay consist of hedges or other materials as approved by the Master ACC.

5. Solar panels shall have documentation establishing its compliance vvith Florida Building Code requirementsfor'Hurricane Protection (Miami-Dade County Product Control Approval. Notice of Acceptance (NOA).

6. Master ACC approval is required prior to lie installation of solar panels.

MATERIAL CHANGES TO FOOTPRINT OR FACADE OF A HOME

I. As defined in the Master ACC Operations Plan, the following shall apply:

• "Footprint" shall mean the original square footage of the ground floor level of the Home, Including Itsshape/outline at ground level, as originally constructed by the developer.

* "Facade" shall mean the" appearance of any exterior wall of the Home (front back and side walls) asoriginally constructed by the developer.

1, Changes to the'height of a home is not permitted.

3, Changes to tire front facadeof a Home shall not encroach on existing front yard setback.

lines and any easement line.

5. The facade of proposed alterations to a Home shall be the same color, style, design and appearance as theoriginal facade, unless otherwise approved by the Master ACC.

6. Screened enclosures shall have a paved floor (e.g., concrete, block pavers) and the enclosure shall notexceed the dimensions of the paved area. Enclosures containing a swimming pool shall have a paved flooraround the pool.

7. Screened Patio extensions constructed of materials other than standard aluminum framing and supports \vithstandard screening material require the approval of the Master ACC.

S, Any change to the footprint or facade of a Home requires ACC approval except as provided below:

a. Patio extensions consisting solely of a concrete slab or block pavers over a sand base with, no enclosureshall remain within the jurisdiction of the Neighborhood / Cove ACCs.

b. Screened Patio extensions constructed of standard aluminum framing and supports with standardscreening material shall remain within the jurisdiction of the Neighborhood / Cove ACCs.

9. Plans and drawings of proposed changes to the footprint or facade of a home submitted for Master ACCreview shall be signed and sealed by a Florida Arclutcct or Engineer and shall show all existing structureson the properly, existing easements, setbacks and landscaping.

Administrative Procedures for Review of Master Applications forAlterations (1)

Meeting Schedule and Notification

The Master AGO shall meet once per month. An annual schedule stating the date, time and place ofeach monthly meeting shall be prepared by the Committee in January of each year and shall beconspicuously posted in Club Baywinds.

Meetings of the Master ACC shall require a minimum of forty-eight (48) hours prior notice to thecommunity. Notice of a meeting may include posting of a notice in Club Baywinds and/or on BaywindsCommunity Channel 63. Notice may also be posted on the Baywinds Web Site www.Bavwind5HOA.com

If necessary to comply with time frames for Committee action on applications as mandated by the MasterDeclaration, the Master ACC may hold additional meetings. The need for an additional meeting in anymonth shall be determined by the Master ACC Chairperson. AH additional meetings of the Master ACCshall be properly noticed in accordance with the above requirements.

Master Application for Alterations Form

A Master Application for Alterations Form may be obtained at the Management Administrative Officelocated at Club Baywinds. Completed Application forms, with all required attachments and any additionaljnformatlon the Applicant wishes to provide, shall be submitted at the Management Office. ManagementStaff, on accepting ah Application, Will date and initial the Application in the upper right hand comer toindicate the date of receipt of the Application.

Notification to Neighborhoods of Receipt of Application

Upon receipt of a Master Application for Alterations Form, Management shall notify the Master ACCChairperson and Secretary that ah Application Form has been received. Notification may be b.y email ortelephone. The Master ACC Secretary shall, in turn, notify the Master ACC Representative for theNeighborhood from which an Application Form has been received that an Application has been submittedand the nature of the requested alteration/improvement. Notification may be by email or telephone.Notification to the Neighborhood Board shall be the responsibility of the Neighborhood Master ACCRepresentative.

Administrative Review Procedures

A Master Application for Alterations submitted to the Master ACC for consideration shall be acted upon inthe following manner

• All Master Application for Alterations Forms submitted to the Master ACC shall be enteredinto a Register of Applications maintained by the Secretary of the Master ACC.

• The Secretary shall record in the Register of Applications all actions taken on Applications bythe Master ACC

Review for Completeness

« Applications submitted for consideration will be reviewed for completeness by the MasterACC Secretary in consultation with the Chairperson or Co-Chairperson. CompleteApplications shall consist of the items stated in the "Requirements for Master Application forAlterations".

Complete Applications

« Complete Applications shall be recorded in the Register of Applications maintained by theSecretary of the Master ACC. The Application shall then be placed on the next Master ACCagenda for consideration.

» The Secretary shall notify the Neighborhood Representative of the date that the Applicationwill be on the Master ACC agenda and of the nature of the requested alteration/improvement.Notification to the Neighborhood Board shall be the responsibility of the Neighborhood MasterACC Representative.

incomplete Applications

* Applications determined to be Incomplete shall be recorded in the Register of Applicationsand will be returned to the Applicant by the Secretary with a request, in writing, for therequired information.

Incomplete Applications shall be placed "on hold" pending Master ACC receipt of therequested information. The Secretary shall note th'is action in 'the Register of Applications.

* If ho response to the request for information is received from the Applicant within thirty (30)days of the date of the 'written request for information, the Application shall be considered tobe'withdrawn.

Requests for Additional Information

* The Master ACC may request additional information that the Master ACC determines, in itssole discretion, to be necessary for consideration of the Application.

* The Secretary shall request of the Applicant, in writing, the additional information the MasterA6(3 determined is needed for consideration of the Application. The Secretary shall note thisaction in the Register of Applications and the Application shall be placed "on hold" pendingMaster ACC receipt of the requested information.

« A request for additional Information may be made by email, if the Applicant provided an email' address on the Application Form submitted by the Applicant.

* if no response to the request for additional information is received fro-rri the Applicant withinthirty (30) days of the date of the request for information, the Application shall be consideredto be withdrawn.

Review of Applications

Review of a complete application by the Master ACC and notification to the Applicant shall becompleted within thirty (30) days, in compliance with the Master Declaration.

The Secretary shall provide written notification to the Applicant of the Master ACCdetermination with regard to the Application submitted by that Applicant.

The Secretary will provide to the Neighborhood Master ACC Representative a copy of theMaster ACC notification to the Applicant Tor the Neighborhood's records.

It shall be the responsibility of the Master ACC Representative, for the Neighborhood fromWhich an Application was received and acted upon, to notify the respective NeighborhoodBoard of the action taken by the Committee with respect to an Application.

Appea.1 of Master ACG Determinations

In the event of the disapproval of an Application by the Master ACC, the homeowner mayrequest a hearing before the Master ACC for additional review of the Application, pursuant toSection 19,8.5 of the Master Declaration.

In the event that the final decision of the Master ACC Is disapproval of the Application, thehomeowner may appeal the disapproval of the Master ACC to the Board of Directors,pursuant to Section i'9.8.6 of the Master Declaration.

Approval by the Master Architectural Control Committee Is for appearance only and does not imply that any review hasbeeri made of the structural or other adequacy of the requested alteration(s)/irnprovem5nt(s) nor doss it replace or in anyway substitute for approval by appropriate governmental authorities.
