CREATION OF RESTRICTION
The following restriction is to be created upon registration of the Plan of Subdivision No. PS 644415C (Plan ofSubdivision)
by way of a restrictive covenant and as a restriction as defined in the Subdivision Act 1988.
For the purposes of this restriction:
a A dwelling means a house.b A building means any structure except a fence.c Front Boundary means:
( i ) In the case of any lot where only one boundary of that lot abuts a road, the boundary which abutsthe road.
( ii ) In the case of any lot where two boundaries of that lot each abut a road or open space reserve,the shorter boundary that abuts the road.
d A secondary boundary means a road boundary or open space reserve boundary other than a frontboundary.
e A wing fence is that part of a fence constructed on a side boundary forward of the façade of the dwelling.f A public view is a view from a road or from an open space reserve.

DESCRIPTION OF RESTRICTION
Except with the written consent of Dalgo Pty Ltd and Libnom Pty Ltd or their authorised representative National PacificProperties Proprietary Limited (NPP) and in all other instances with the written consent of each and every registeredproprietor of a benefiting lot on the Plan of Subdivision the registered proprietor or proprietors for the time being of anyburdened Lot on the Plan of Subdivision shall not:
1 Apply for a building permit until the siting and design of the dwelling is endorsed by NPP.2 Construct a dwelling other than in accordance with the Bayview on the Bellarine Estate Design Guidelines3 Subdivide or allow a Lot to be subdivided.4 Construct more than one dwelling on any Lot.5 Allow more than 60% of the Lot to be covered by buildings.6 Construct a plain concrete driveway.7 Construct a driveway closer than 400 millimetres from a side boundary or a secondary boundary.
House and Garage Siting
8 For Lots greater than 25.0 metres in depth construct a dwelling closer than 4.5 metres from thefront boundary with the exception of verandahs, portico's and entries which are not excluded from the setback.
9 For Lots equal to or less than 25.0 metres in depth construct a dwelling closer than 3.0 metres from the frontboundary with the exception of verandahs, portico's and entries which are not excluded from the setback.
10 Construct a building closer than 2.0 metres from a secondary boundary.11 Construct a dwelling unless at least one side boundary is set back a minimum of one metre.12 Construct a dwelling unless any reserve boundary is set back a minimum of one metre.13 Construct a garage closer than 5.5 metres from the front boundary and 0.84 metre behind the facade of the

Primary Dwelling Construction
16 Construct a dwelling on a corner Lot without a minimum of 5.0 metres of the facade facing the secondaryboundary incorporating elements of the front façade of the dwelling commencing from the front façade of
the dwelling.17 Construct a dwelling without a front facade incorporating a verandah, entrance portico or covered porch at
the front door.18 Construct a dwelling with a front verandah unless it has an area of at least 4 square metres and a depth of
at least 1 metre.19 Construct a dwelling with an entrance portico unless it has an area of at least 4 square metres and a depth
of at least 1.5 metres.20 Construct any single storey dwelling unless the dwelling has a minimum ceiling height of 2.55 metres.21 Construct a dwelling without eaves with a roof pitch of less than 25 degrees without the approval of NPP.22 Construct a dwelling with a floor area less than 120m² (excluding garages, porticos, verandas and other
enclosed areas) on a lot of less than 450m² in area.23 Construct a dwelling with a floor area less than 150m² (excluding garages, porticos, verandas and other
enclosed areas) on a lot of 450m² or greater in area.24 Construct a dwelling on stumps unless the stumps are concealed.

External Fixtures and Garden Sheds
26 Erect or allow to be erected on any Lot any advertising hoarding except for the erection of a signboard thatthe Lot or house is for sale.
27 Erect or allow to be erected any builders' or trade signs except for during the actual construction of thedwelling.
28 Erect or allow to be erected any home occupation signage unless that signage is in accordance with theCity of Greater Geelong planning scheme.
29 Install or allow to be installed any air conditioners or evaporative coolers that extend above the ridge line ofthe dwelling and that are not coloured to match the roof and are not located away from direct public view.
30 Install or allow to be installed a television antenna or satellite dish that is not located away from direct publicview.
31 Install or allow to be installed a solar hot water system unless the collector panels and piping are locatedaway from direct public view.
32 Allow general service areas such as rubbish bins, storage areas and clothes lines to be positioned unlessthey are not visually obtrusive to the neighbours or the road.
33 Install or allow to be installed a letterbox unless it forms part of the integrated landscape treatment andcomplements the house, front fence (if installed) and the general streetscape.
34 Erect or allow to be erected more than one garden shed.35 Erect or allow to be erected a garden shed exceeding 20 square metres in area and having a maximum
roof height of 2.5 metres unless constructed of the same material as that of the dwelling.36 Erect or allow to be erected a garden shed that is not situated behind the rear facade of the dwelling.37 Erect or allow to be erected any storage area other than the garden shed that is not integrated into the
design of the dwelling and garage.38 Erect or allow to be erected any retaining walls exceeding 1.2 metres in height without the approval of NPP.

CREATION OF RESTRICTION
40 Except for a secondary boundary erect or allow to be erected a wing fence on any Lot with a height greaterthan 1.2 metres including piers and posts and with a transparency ratio of at least 40% including pierscolumns and bases or a wing fence constructed of solid masonry to a maximum height of 400 millimetres.
41 Except for a secondary boundary erect or allow to be erected a fence constructed from timber palings onany front boundary or side boundary forward of the facade of the dwelling.
42 Construct the transition between timber paling fences and wing fences of raked timber palings eitherforward of or behind the facade of the dwelling.
