1. Invitations related to decision OEWG-10/1 on the preparation of the
midterm evaluation of the strategic framework
Decision: OEWG-10/1: Preparation of the midterm evaluation of the strategic framework
Background:
1. Following the tenth meeting of the Conference of the Parties, the Secretariat initiated work to support
the development of mid-term and final evaluations of the strategic framework through the creation of a baseline
based on year 2011 information to be submitted by parties.
2. By decision OEWG-10/1, the Open-ended Working Group invited Parties to provide to the Secretariat,
by 30 September 2016, information for the year 2015 relevant to the indicators listed in section V of the
strategic framework set out in the annex to decision BC-10/2, as requested in paragraph 17 of the strategic
framework, using the format for reporting developed by the Secretariat.
3. The Open-ended Working Group requested the Secretariat, on the basis of the information received
from Parties, to prepare a draft report on the mid-term evaluation of the strategic framework to be available by
15 November 2016 on the Basel Convention website.
4. Furthermore, the Open-ended Working Group invited Parties and others to provide comments to the
Secretariat on the draft report by 15 January 2017. The Secretariat was requested to prepare a revised draft
report, taking into account the comments received from Parties and others, for consideration by the Conference
of the Parties at its thirteenth meeting.

2. Invitations related to decision OEWG-10/2 on developing guidelines for
environmentally sound management
Decision: OEWG-10/2: Developing guidelines for environmentally sound management
Background:
By decision BC-12/1 on follow-up to the Indonesian-Swiss country-led initiative to improve the effectiveness of
the Basel Convention, the work programme of the expert working group on environmentally sound management
was adopted. Since COP-12, the expert working group has continued its work to develop an ESM toolkit that
includes practical manuals for the promotion of the environmentally sound management of wastes and fact
sheets on specific waste streams.
The tenth meeting of the Open-ended Working Group expressed its appreciation to the expert working group
and requested it to continue to develop activities, subject to the availability of resources, to implement its work
programme.
Following an opportunity for comments by Parties and others, the expert working group has been requested to
revise the set of draft practical manuals for the promotion of the environmentally sound management of wastes
and the draft fact sheets on specific waste streams and to submit them for consideration and possible adoption
by COP-13, and to revise the draft practical manuals on extended producer responsibility and financing systems
for environmentally sound management and to submit them for consideration by COP-13.
Additionally, the Secretariat has been requested to develop an online survey to assess the relevance and utility of
the Basel Convention documents related to environmentally sound management, and to prepare a report on the
responses received from Parties and others for submission to COP-13

Decision: OEWG-10/3: Cartagena Declaration on the Prevention, Minimization and Recovery of
Hazardous Wastes and Other Wastes
Background:
1. By decision BC-12/2, the Conference of the Parties adopted the road map for action on the
implementation of the Cartagena Declaration set out in the annex to that decision and invited parties and other
stakeholders to undertake activities to implement the road map and to provide information on such activities to
the Secretariat.
2. In addition, by the same decision, the Conference of the Parties mandated the expert working group on
environmentally sound management to develop guidance to assist parties in developing efficient strategies for
achieving prevention and minimization of the generation of hazardous and other wastes. A draft outline of this
guidance was submitted to the tenth meeting of the Open-ended Working Group in document
UNEP/CHW/OEWG.10/INF/5.
3. The expert working group has been requested to continue its work to develop the draft guidance on the
basis of the revised outline set out in the annex to decision OEWG-10/3, and, following an opportunity for
comments by Parties and others, to revise the draft guidance and submit it for consideration by the Conference
of the Parties at its thirteenth meeting.

4. Invitations related to decision OEWG-10/4 on the technical guidelines
on the environmentally sound management of wastes consisting of,
containing or contaminated with persistent organic pollutants
Decision: OEWG-10/4: Technical guidelines on the environmentally sound management of wastes
consisting of, containing or contaminated with persistent organic pollutants
Background:
1. The following activities relating to the technical guidelines on persistent organic pollutants (POPs)
were included in the work programme of the Open-ended Working Group for the biennium 2016–2017:
(a) Undertake work towards a review of all provisional low POP content values in the technical
guidelines referred to in paragraph 2 of decision BC-12/3;
(b) Update the general technical guidelines for the environmentally sound management of wastes
consisting of, containing or contaminated with POPs and prepare or update specific technical guidelines with
regard to the chemicals listed in Annexes A and C to the Stockholm Convention by decisions SC-7/12–SC-7/14,
including the following:
(i) Establishment of levels of destruction and irreversible transformation for the chemicals
necessary to ensure that when disposed of they do not exhibit the characteristics of POPs
specified in paragraph 1 of Annex D to the Stockholm Convention;
(ii) Determination of which disposal methods constitute environmentally sound disposal as
referred to in paragraph 1 (d) (ii) of Article 6 of the Stockholm Convention;
(iii) Establishment, as appropriate, of the concentration levels of the chemicals in order to
define for the Stockholm Convention low POP content as referred to in paragraph 1 (d)
(ii) of Article 6 of the Convention.
2. At its tenth meeting, the Open-ended Working Group reviewed the following draft technical guidelines
and a compilation of comments on low POP contents:
(a) UNEP/CHW/OEWG.10/INF/18: Draft technical guidelines on the environmentally sound
management of wastes consisting of, containing or contaminated with hexachlorobutadiene
(b) UNEP/CHW/OEWG.10/INF/19: Draft technical guidelines on the environmentally sound
management of wastes consisting of, containing or contaminated with pentachlorophenol and its
salts and esters
(c) UNEP/CHW/OEWG.10/INF/20: Draft updated technical guidelines on the environmentally
sound management of wastes consisting of, containing or contaminated with polychlorinated
biphenyls, polychlorinated terphenyls, polychlorinated naphthalenes or polybrominated
biphenyls including hexabromobiphenyl
(d) UNEP/CHW/OEWG.10/INF/21: Draft updated technical guidelines on the environmentally
sound management of wastes containing or contaminated with unintentionally produced
polychlorinated dibenzo-p-dioxins, polychlorinated dibenzofurans, hexachlorobenzene,
polychlorinated biphenyls, pentachlorobenzene or polychlorinated naphthalenes
(e) UNEP/CHW/OEWG.10/INF/23: Compilation of comments on low persistent organic pollutant
contents
3. By its decision OEWG-10/4, the Open-ended Working group invited Parties and others to provide
comments and information on the various technical guidelines on POPs and on the low POP content values in
accordance with the workplans set out in the annex to that decision. The Secretariat was requested to publish
sets of comments and revised versions of the technical guidelines on the website of the Convention.

waste and used electrical and electronic equipment, in particular regarding the distinction
between waste and non-waste under the Basel Convention
Background:
1. At its twelfth meeting, by decision BC-12/5, the Conference of the Parties adopted on an interim basis
the technical guidelines on transboundary movements of electrical and electronic waste and used electrical and
electronic equipment, in particular regarding the distinction between waste and non-waste under the Basel
Convention.
2. In paragraph 5 of decision BC-12/5, the Conference of the Parties acknowledged the need to look
further into the guidance on the distinction between waste and non-waste, and agreed to include the further
elaboration of work on this issue in the work programme of the Open-ended Working Group for 2016–2017 in
order to prepare draft revised guidelines for consideration by the Conference of the Parties at its thirteenth
meeting, in particular with reference to paragraphs 31 (a) and 31 (b) of the technical guideline on the following
issues:
(a) Residual lifetime and age of used equipment;
(b) Management of hazardous wastes from failure analysis, repair and refurbishment operations in
developing countries;
(c) Obsolete technologies, including cathode ray tubes; and
(d) Presence of hazardous components in used equipment.
3. At its tenth meeting, the Open-ended Working Group took note of the compilation of comments
received from Parties and others on the outstanding issues regarding the technical guidelines set out in document
(UNEP/CHW/OEWG.10/INF/22).
4. By decision OEWG-10/5, the Open-ended Working Group invited Parties and others to join the small
intersessional working group on e-waste and invited Parties to consider serving as lead country or to provide
financial support for further development of the technical guidelines. Additionally, the Working Group invited
Parties to provide responses to an online questionnaire, to be prepared by the Secretariat, in consultation with
the small intersessional working group on e-waste, which would aim at gathering information on their
experiences in the implementation of the technical guidelines. Parties and others were also invited to provide
comments on the issues mentioned in paragraph 5 of decision BC-12/5.

clarity

Background:
1. By decision BC-12/19, the Conference of the Parties adopted the work programme of the Open-ended
Working Group for 2018-2019 whereby it, among other things, mandated the Working Group to:
(a) Consider the revised version of the draft glossary including explanations prepared by the small
intersessional working group on legal clarity, finalize the glossary and prepare a draft decision for the
Conference of the Parties at its thirteenth meeting for its consideration and possible adoption; and
(b) Consider recommendations on the review of Annex IV and related issues under Annex IX to the
Convention; and consider views from parties and others on the review of Annexes I and III to the Convention.
2. Following its consideration of the matter, the Working Group adopted decision OEWG-10/8 whereby
it, among other things:
(a) Invited Parties and others to provide by 15 July 2016 further views on the options identified in
section II of Annex II to document UNEP/CHW.12/INF/52;
(b) Invited Parties to nominate to the Secretariat by 15 July 2016 further experts for participation in
the small intersessional working group on legal clarity; and

and supported the proposal of the informal group for the Conference of the Parties to establish a household
waste partnership under the Basel Convention.
2. By decision OEWG-10/10, the Working Group invited Parties and others to submit comments on the
draft concept note on the household waste partnership (UNEP/CHW/OEWG.10/INF/14) to the Secretariat by 15
September 2016 and requested the informal group to finalize the draft concept note, including terms of reference
and a workplan for the biennium 2018–2019, taking into account the discussions during the tenth meeting of the

Background:
1. In its decision BC-12/16, the Conference of the Parties requested the Secretariat to prepare a draft
guidance manual on how to improve the sea-land interface, taking into account the revised version of the IMO
Comprehensive Manual on Port Reception Facilities comments received from Parties and others and submit it to
the Open-ended Working Group for consideration at its tenth meeting.
2. At its tenth meeting, the Open-ended Working Group adopted decision OEWG-10/11 by which it
invited Parties and others to submit comments on the draft guidance manual set out in document
UNEP/CHW/OEWG.10/INF/15 to the Secretariat by 31 October 2016. The Working Group requested the
Secretariat to revise the draft guidance manual, taking into account the discussions at the tenth meeting of the
Open-ended Working Group and the comments received from Parties and others, and to submit it as so revised
to the Conference of the Parties for consideration at its thirteenth meeting.

Background:
1. At its thirteenth meeting, the Conference of the Parties is expected to adopt the work programme of the
Open-ended Working Group for the biennium 2016–2017. In preparation for that, and in accordance with its
usual practice, the Secretariat prepared a draft work programme for consideration by the Open-ended Working
Group as set out in the annex to document UNEP/CHW/OEWG.10/12.
2. At its tenth meeting, the Open-ended Working Group took note of the draft work programme of the
Open-ended Working Group for 2018–2019 and invited Parties and others to submit to the Secretariat comments
on the draft work programme by 30 September 2016. It also requested the Secretariat to make the comments
available on the website of the Basel Convention and to revise the draft work programme, in consultation with
the Bureau of the Open-ended Working Group and the Bureau of the Conference of the Parties and taking into
account the discussions at the tenth meeting of the Working Group, for consideration and possible adoption by
the Conference of the Parties at its thirteenth meeting.

Decision: BC-12/19: the Work programme of the Open-ended Working Group for 2016–2017
Background:
1. At its twelfth meeting, the Conference of the Parties adopted decision BC-12/19 on the work
programme of the Open-ended Working Group for 2016–2017, by which it decided that the tenth meeting of the
Open-ended Working Group would be of four days’ duration, with up to three days of plenary sessions with
simultaneous interpretation provided to be applied flexibly by the Executive Secretary.
2. Furthermore, the Conference of the Parties invited Parties and others to submit to the Secretariat,
within two months of the end of the tenth meeting of the Open-ended Working Group, comments on
experiences with regard to the arrangements for that meeting and requested the Secretariat to compile any
comments received from Parties and others as well as comments made during the tenth meeting and to submit
them to the Conference of the Parties at its thirteenth meeting for its consideration.
3. To collect the feedback from meeting participants about the arrangements of the tenth meeting of the
Open-ended Working Group, the Secretariat carried out an online survey on the last day of that meeting. The
online survey may be accessed in French, English or Spanish from http://fs.pops.int/fs-oewg10.aspx until 30
June 2016.
