www.intertek.com/government 1 Bangladesh Guidelines for Exporters Rev. 30-6-12 In February 2000, the Government of Bangladesh approved new legislation, which made fundamental changes to the importation procedures to be followed in Bangladesh. Pre-shipment Inspection has become mandatory for all exports (as there is no floor value) except those identified as exempt, prohibited or restricted (please see below). Importers are required to complete a pre-shipment inspection order form (IOF) or Inspection Information form (IIF) for all imports subject to inspection. Upon receipt of the IOF from the Importer, Intertek will contact the Exporter and arrange inspection in the country of supply through their network of overseas offices. Upon satisfactory findings, Intertek will issue a Clean Report of Findings (CRF) to the related Customs Authority and certify the Exporter's Final Invoice and packing list. With effect from 1 st July 2011, Intertek is one of four Pre-shipment inspection companies chosen to participate in the program and is responsible for exports supplied from the countries indicated in appendix C. What happens if I ship without inspection? The Bangladesh Customs Authority will hold goods shipped without a Clean Report of Findings (CRF) and impose a penalty to the importer in order to release the goods. Are any goods exempt from inspection? Yes, these are shown in Appendix A and B. What do I have to do? The Intertek office nearest to you will send you a Request for Information (RFI) letter. A prompt reply will start the PSI process. A unique reference number will be shown on the letter know as the RFI number (Example BDH-123456). Please quote the unique RFI number in all communications with Intertek as per above example. If any company other than the Exporter named on the Inspection Order Form or Inspection Information Form (IIF) is to request inspection or act in any way on your behalf, their authority to do so must be confirmed by you in writing. Should I pack my goods prior to inspection? Goods should be presented along with the export packaging, which will be used. Where packaging must be opened to perform physical inspection, repackaging will be observed at the time of inspection. Where goods are to be exported by full container load, Intertek is required to witness loading and seal the container with an Intertek seal. For this to be done, Exporters will be required to present goods for physical inspection at a time and place such that, upon the same visit, the Intertek Inspector may properly inspect the goods, witness container stuffing and perform sealing. At this time the Exporter or Exporter’s Agent will be required to sign the Inspector’s Report confirming that the containers have been sealed. A photograph will be taken, where possible. The Inspection Report will be valid for ninety days. If goods are not shipped within ninety days a further inspection will be required at an additional expense to the exporter. If the Inspector must return to the site to witness stuffing and to seal the container, an additional charge will be made to the Exporter. Are there any specific inspection requirements? There are a number of specific requirements required by the National Board of Revenue of the Government of Bangladesh, which are contained in the Import Policy Order 2006-2009. It is important that exporters and importers are familiar with the applicable product specific requirements as failure to comply may cause serious problems with regard to the production of any certificates. Key requirements are listed below: a) In all cases of import, the Country of Origin must be mentioned clearly on all outer packages, drums or containers as per Import Policy Order If no packaging, drum or container exists, the Country of Origin should be mentioned on the goods. b) In case of import of all kinds of food and beverages, the manufacturing & expiry date shall clearly be embossed on each packages/container of such items. Separate printed labels relate to date(s) are not allowed to apply on packages/container. However, it shall not be necessary to mention the date of expiry in case of import of wine/liquor. Manufacturing and expiry date need to be written/printed on the container/packages of the raw materials of food/Beverage. However, this condition is applicable only for those raw materials, which became unsuitable to use after a limited time. c) For canned fish, the manufacturing - expiry date and net weight shall be embossed or shall be computer printed in permanent ink either in Bangla or English on each tin container. Separate printed labels relate to date(s) are not allowed to apply on the container. d) For the importation of protein concentrate (made from Bone meal/Meat meal or Meat and Bone meal) a veterinary certificate (conforming that the goods is free from Transmissible sopongiform Encephalopathy) need from the exporting country and it should be supplied with the shipping documents. e) It is important that the Importer’s name, address and Tax Identification Number (TIN) is clearly displayed on 2% the biggest box/package of the shipment only. Bulk commodity shipments and consignments with a value below USD 5000 are exempt from this requirement. If all packages are identical in size, then the labelling should be applied on 2% of the packages to be shipped. f) All toy products should be embossed with the child age suitability for use of the product. g) For the BSTI certified BDS products, you must provide us with valid test reports from an internationally approved surveyor which verifies that the product complies with the applicable product standards. (See BSTI list--Appendix D) h) The list of controlled goods can be found in Appendix E. What is Customs Classification? All goods are classified under a customs tariff code, which determines the rate of duty payable for the goods upon importation. Intertek is required to determine the correct tariff code in accordance with the requirements of the Bangladesh Customs Tariff book and all other relevant regulations published by the Government. The Bangladesh Customs Tariff is based on the Harmonized System (HS). Please note that part of our mandate with the Bangladesh Government is to assess and allocate the most applicable HS code for the goods, which we have inspected. Therefore, the HS code(s) allocated by us, may not necessarily be the HS codes quoted on your letter of credit. WWhhaatt iiss CCuussttoommss VVaalluuaatt iioonn?? The customs valuation or price verification undertaken by Intertek seeks to determine whether the price being charged by the Seller, as declared to us in the proforma invoice, corresponds within reasonable limits with export prices generally prevailing in the country of supply. Where the Exporter does not present freight and insurance charges to the IO, Intertek will assess values for customs valuation purposes only. The reference date for customs valuation/ price verification will be the date of the order or proforma invoice. Where our customs valuation/ price verification indicates that your prices are significantly below the reasonable limit for the export prices prevailing in the country of supply, you will be contacted and given an opportunity to comment. Our assessment of the export market price will only be amended if you can provide us with written information enabling us to change our opinion. Price data and all related information supplied to Intertek are held in the strictest confidence. WWhhaatt ddooccuummeennttss ddoo yyoouu rreeqquuii rree ff rroomm mmee?? 1 We require a clean final invoice, with the following information:

• Invoice number and date of issuance; • Names of the Importer and Exporter, as per the

proforma and Letter of Credit. • Detailed quantity and description of goods including

brand names; • All unit prices and extensions; • Total price and applicable incoterms. (e.g. FOB,

CFR, CIF, etc.) Note: Final invoices that show a price adjustment arising from fluctuating exchange rates cannot be accepted unless expressly allowed for under the terms and conditions of the proforma invoice or Letter of Credit. Also Note: Final documents must be produced well in advance of the Letter of Credit expiry date. Failure to pro vide within the required timeframe will result in the issue of a No n Negotiable Report of Findings (NNRF). 2 A copy of the packing list, as we are required to endorse it. Any discrepancies may result in the issue of a Non-Negotiable Report of Findings (NNRF). 3 A “manufacturers certificate of price” for all new cars (under HS Code 8701-8704) is also required. This certificate has to be from the manufacturer under their letterhead stating the actual price of the vehicle. Signed faxed documents are acceptable. IMPORTANT NOTE: Please note that Intertek is not able to add specif ic remarks to the CRF, in order to satisfy individual L/C require ments. The CRF only bears remarks that have been requested by the Bangladesh Authorities. WWhhaatt hhaappppeennss ii ff II ffaaii ll ttoo pprreesseenntt ff iinnaall ddooccuummeennttss?? Presentation of clean final documents should be made to Intertek as soon as they are available. Failure to do so may result in the issuance of a Non-Negotiable Report of Findings (NNRF) and a delay in the clearance of the Importer’s goods from Customs. In order to avoid problems, it is advisable that good final documents be presented to Intertek at the earliest opportunity.

Appendix A

Following goods are considered as exempted from man datory PSI programme under SRO No. 178-Ain /2012 /2406/ Customs dated June 7 th 2012 under Customs Act, 1969 (IV of 1969) section 25B. This SRO cancels earlier SRO: 158-Ain/2011/2344/Customs Date d June 9, 2011.

1. Goods declared Zero (0%) customs duty against the respective H.S. Code in the 1st schedule under Customs Act. 1969.

2. Goods exempted from the revenue by the special consideration of the Government as per section 20 of the Customs Act, 1969.

3. Goods imported by the Government, semi government, Sector Corporation or autonomous bodies.

4. The listed perishable goods as determined by the National Board of revenue.

Appendix E Import Policy Order 2009-2012 (including amended Co ntrolled Goods List)

Chapter – 4 (Meat and Bone Meal) (Earlier clause – 17.0 in IPO 2006-2009)

1) In case of import of fish feed, and animal feed items the shipping documents must be accompanied by radioactivity-test reports from the competent authority of the exporting country and a certificate to the effect that the item are fit for consumption by fish, poultry or animal. The radioactivity-test report mush clearly indicates the level of CS-137 found in such radioactivity-test in each kilogram of the items.

2) The report should indicate the level of Chloromphenicol and Nitrofuran in the imported fish feed.

3) Imported goods shall be released only when their radioactivity levels are found within the acceptable

limits in accordance with the above reports, otherwise the supplier shall be under obligation to take back the consignment at his own expense.

4) Meat and Bone Meal is importable item with prior permission by the Live Stock Ministry.

Condition is Meat and Bone Meal of swine is Import banned. Chapter – 5 (Second-hand or Recondition Capital Mac hineries) (Earlier clause 24.10 in IPO2006-2009) : Second-hand/Reconditioned Capital Machineries and Generator or Generating set used in industry shall be importable without any price limit. Provided a certificate issued by the surveyor company nominated/appointed by National Board of Revenue to the effect that each Machine has at least 10 years economic life except Generator or Generating set. (b) Reconditioned Generator or Generating set shall be permissible by the certificate from appropriate authority of the exporting country to the effect that this generator or generating set are not more than five years old. Chapter 6 (Old Computer) (Earlier clause 26.11.1 in IPO2006-2009) : Computer older than Pentium 4 model will not be imported instead of existing. (All kind of Eggs - Deducted from Foot note of Cont rol List) Eggs of Duck, Chicken and Bird are importable with prior permission of Bangladesh Commerce Ministry under below conditions.

a) Limited quantity of eggs shall be importable from Avian Incluenza or Bird Flue free countries. b) Each consignment mush have a certificate issued by the appropriate authority of exporting country to

the effect that the eggs are free from Avian Incluenza or Bird Flu. Clause – 51 (Old, Reconditioned Engine, Gearbox, Ge nerator or Generating set ) (Earlier clause 26.34 in IPO2006-2009)

a) Commercial import of second hand/reconditioned engines & gear boxes of bus, truck, mini-bus and microbus will be permissible. Provided that "7 (Seven) years economical life guarantee certificate" either from exporting country's recognized chamber of commerce & industry or from an internationally reputed surveyor shall be submitted to the customs authority at the time of release of the goods.

b) Secondhand/reconditioned marine diesel engines above 35 (Thirty Five) horse power used in coaster,

launches and self propelled barges and other watercrafts of this type will be commercially importable. (Common Salt – Deducted from Control List) Common salt is importable if the production level of Salt Boulder for Crushing declared that the goods conform to the standard BDS1326:2007

(2) Importer must inform Bangladesh Petroleum Corporation regarding quantity and quality of the importable Furnace Oil on or before 5th of every month. And

(3) The importer must obtain Explosive Licence and other required licence(s) as per prevailing rules.

(b) In case of import for sale/marketing to other consumers:-

(1) An agreement is to be signed with Bangladesh Petroleum Corporation as Bangladesh Petroleum Act 1974 (Act LXIX of 1974) and rules issued by the Government from time to time, in this respect these rules will be applicable.

(2) Quality of the salable petroleum product must be as per specification of BSTI;

(3) All arrangement is to be made by the importer for collection, storage and marketing of furnace oil,

(4) Representatives of Bangladesh Petroleum Corporation and BSTI can inspect any establishment of the importer to examine the quality of the salable item;

(5) Imported furnace oil is to be sold at the market rate;

(6) The importer must obtain Explosive Licence and other required licence(s) as per prevailing rules.

(7) Furnace Oil is to be sold only to the user industry.

A statement regarding quantity and quality of monthly imported and marketed furnace oil is t obe sent to Bangladesh Petroleum Corporation on or before 5th of every month.

27.11 All Petroleum gas and other gaseous hydrocarbons except liquefied Propane and Butanes (which is part of LPG) are import-banned.

27.13 All All goods including petroleum oil residues except petroleum coke are import-banned.

29.29 2929.90.00 Sodium Cyclamate are import-banned.

29.30 2930.90.90 Artificial mustard oil (Allyl isothlicyonate) is import-banned.

Insecticides namely Heptachlore-40WP, DDT, Dicrotopes, Bidrin Brand in the generic name, Methyle Bromide, Chlorden-40WP and Daildrin are import-banned. However, other goods classifiable against the H.S. Heading No. are importable subject to following conditions :-

(i) Description of the imported insecticides must be communicated to the Agricultural Extension Directorate and it will monitor the use of the imported insecticides.

(ii) Those shall be used as per the approved level provided by the Pesticide Rules 1985.

56.08 All Fishing nets or so called current nets (Gillnet) with meshes of 4.5 centimeters or less in radius or length are import-banned. However, with the prior permission of the Director General of Fishing Department, only deep-sea fishing vessels shall be allowed to import nets with meshes of 4.5 centimeters or above under the Sea Fish Ordinance 1983. The Director General of Fishing Department shall give permission for an importer per trawler to import 4.5 centimeters radius/mesh-net up to maximum 8 (eight) bag/sack per year.

63.05 6305.33 Polypropylene bags are import-banned.

84.08 8408.90 Chesis including two-stroke engines of three-wheeler vehicles (tempo, auto-rickshaw etc.) is import-banned.

(a) Old vehicles and tractors including motor Car of any CC and microbus, mini-bus, and jeep of any cc are importable subject to following conditions :-

(1) At the time of shipment, no vehicle shall be of more than five years old.

(2) Old vehicles are importable only from the country in which the vehicle has been manufactured (country of origin). Old vehicles shall not be importable via a third country.

(3) A certificate regarding the age of the vehicle, model number and chesis number issued by Japan Auto Appraisal Institute (JAAI) in case of import of vehicle from Japan and recognized automobile association in case of import of vehicle from other countries, shall be submitted at customs-level.

(4) In case of determining the manufacturing date/age of the imported old vehicle, the date/age of the vehicle shall start from the first day of the next year of manufacture.

(5) In case of import of vehicle from Japan, the date of manufacture shall be determined from the chesis book published by the Japan Automobile Association.

(6) Actions are to be undertaken about the connection of catalytic converter in case of petrol-driven vehicles and diesel particulate filter in case of diesel-driven vehicles according to the S.R.O. No. 29-Ain/2002, dated 16 February 2002, promulgated by the Ministry of Environment and Forestry.

(7) Without seatbelt vehicle is import-banned

(8) To visible inside of vehicle wind sheet glass and both side of driving seat glass will be prominent.

87.11 All Above 155 CC motor cycle and more than 3 (three) years old are banned. However, above more than 155 CC limit will not be applicable for the Police Department In case of import of 3 (three) years old motor cycles, this 3 (three) years period will be calculated from the first day of the calendar year next to the manufacturing year. To determine the age of old motor cycles, certificate from internationally recognized and National Board of Revenue approved inspection company (PSI) may be accepted as the alternative of registration cancellation certificate.
