SUBJECT: PAJARO RIVER BENCH EXCAVATION PROJECT STATUS REPORT

Members of the Board:

This staff report serves to update your Board on the Pajaro River Bench ExcavationProject (project). As Board members may recall the Notice of Completion for the project wasapproved at the December 2012 meeting, effectively closing the Phase I portion of the project.

Staff has been actively engaged in addressing milestones pertinent to the construction componentsof the Phase II project, the Pajaro River area upstream ofthe confluence with the tributary.

To meet these milestones, staff has met regularly with landowners in areasidentified for vehicular construction traffc to and from the levees. Staff has also met several timeswith staff and consultants to the Elkhorn Slough Freshwater Marsh Restoration project, theintended recipient of the sediment excavated in Phase II of the project. A small portion of theexcavated sediment is also proposed to be re-used to restore levee crests along Salsipuedes Creekto their original design elevations. Additionally, communication is occurring with the State tobring a final version of the draft Local Levee Assistance Program grant (Proposition 84 -Disadvantaged Communities Award) to your Board for acceptance and execution. Lastly, Zone 7intends to begin communication this month with the Monterey County Water Resources Agencyfor purposes of developing a new Memorandum of Agreement for cost sharing involved in PhaseII of the proj ect.

To date, all of these milestone activities are going well, and the Phase II project hasa projected schedule for a June 3,2013, construction start. An updated schedule of Phase IIplanning items is included as Attachment 1 to this report.

SUBJECT: PAJARO RIVER FLOOD RISK REDUCTION PROJECT, STATUS REPORT

Members of the Board:

On October 16,2012, a status report on the Pajaro River Flood Risk ReductionProject (project) was presented to your Board. That report largely dealt with two issues. The firstwas a new setback levee alternative, Alternative 9D Revised, that amends a portion of Reach 4 inthe project area. The second was the the lack of any final determination for on-going Federalfunding for the project. A copy of that report is included as Attachment 1 to this report.

Since that update, a second Administrative Draft Environmental ImpactStatement/Environmental Impact Report (EIS/EIR) for the project was released for internal reviewin November 2012. It is a comprehensive document with the exception of detailed informationpertinent to Alternative 9D Revised, the Army Corps of Engineers (Corps) likely preferred project.Staff provided specific comment as necessary and five general comments (as detailed below) thatshould be brought to your Board's attention.

1) The project sponsors do not support unequal levels of protection on oppositebanks of the same reach of the river;

2) With the recent release of the 2011 Crop Report from the AgriculturalCommissioner's Office, the Corps should revise the agricultural economics toreflect the significant increased value of berry crops in the Pajaro Valley;

3) To confirm that existing agricultural damage estimates for the project includethe large number of residential dwelling units located on agricultural landbetween the outside levees of the Pajaro River and Salsipuedes Creek;

4) County staff confirmed that the Traffic and Biotic Analysis and Mappingpreviously developed by County consultants was adequately incorporated intothe second Administrative Draft EIS/EIR; and

5) To note that the second Administrative Draft EIS/EIR does not meet California

Environmental Quality Act standards until a preferred project is identified.

In mid-December 2012, a report entitled, "Pajaro River Right Bank USACEAlternative 9D Proposed Modifications" (NHC Inc.), was accepted by staff and transmitted to theCorps. The report details Alternative 9D Revised project features and exhibits comparisons of theinundation areas of different sized flood events. This revised project alternative provides a 50-yearstorm level of protection to an additional portion of the right bank of Reach 4 wherein floodprotection was not previously offered by the Corps. Alternative 9D Revised will now likelybecome the Corps' proposed National Economic Development project, and hence become thepreferred plan in the public draft version of the EIS/EIR scheduled for release later this year.

As discussed in the October 2012 status report, the potential for Federalappropriations for the project in Federal fiscal year 2014, and in any Work Plan re-assignment forFederal fiscal year 2013 is still unresolved, and appears to have a slim chance for funding. InDecember 2012, Congressman Sam Farr transmitted letters to the Office of Management andBudget and to the Assistant Secretary for Civil Works, Department of the Army requesting$300,000 in Federal appropriations for the Federal fiscal year 2013 Work Plan. There has yet tobe either a response to the request or a final determination. These two letters are included asAttachment 2 to this report.

In conclusion, your Board should note that staff has requested revision to theAgricultural Economic Assessment (as noted above) and to the project schedule to reflect anychanges to project milestone dates. Both requests are anticipated to be fulfilled.

It is therefore recommended that the Board of Directors accept and fie this statusreport on the Pajaro River Flood Risk Reduction Project, and direct staff to return with a furtherupdate at your Board's next scheduled meeting.

SUBJECT: STATUS REPORT ON THE P AJARO RIVER FLOOD RISKREDUCTION PROJECT

Members of the Board:

On June 18,2012, your Board was apprised that the U.S. Ary Corps of Engineers

(Corps) would not fuher pursue implementation of Alternative 9D, the Expanded Ring LeveeAlternative, as the National Economic Development (ND) project. This move by the Corps awayfrom Alternative 9D is directly attrbutable to the high probabilty of a right ban failure in Reach4 influenced by the design of Alternative 9D. Equally, the potential situation ofa right banfailure in Reach 4 would now need to be mitigated.

It was also reported on June 18, 2012, that the Corps was potentially looking atdesignating Locally Requested Plan 5 (LRP 5), a 50-foot setback and 50-year storm level ofprotection in Reach 4 or another plan, as the new NED project. Maps of Alternative 9D andLRP 5 are attached for your Board's information. It has since been reported to local sponsor staffthat LRP 5, at an additional $55 milion, is too significant of a cost increase for mitigating a rightban failure. Therefore, the Corps is looking at a mitigation measure that would provide a set back

on the right bank levee in Reach 4, as well as a levee tie back at Coward Creek, near theapproximate location of the proposed tie back levee on the left ban of Reach 4.

To expedite the analysis of this new approach to a NED project, District staffrequested Nortwest Hydraulics Inc., to model the new Corps mitigation proposal. Included in themodeling effort would include the analyses for a 50-foot setback or a 100-foot setback along thelower right bank in Reach 4, and to assess the required levee crest elevations to pass a 25-yearstorm event and a 50-year storm event for both options. A draft report of the requested analysiswas prepared and is under review by District and Corps staff. The analysis must also include arecommendation on how to tie in a new right ban setback levee on the lower section of Reach 4to the existing unimproved levee system.

At the time of this report's preparation, the potential for Federal funding of theproject design has not been secured for either a work plan approach in Federal fiscal year 2013 orin the proposed President's budget for Federal fiscal year 2014. Your Board may recall that thefiscal year 2012113 Zone 7 Budget includes $350,000 in contributions to the Corps to keep theproject moving forward in the absence of Federal funds, and that those contributions are eligiblefor grant reimbursement.

It is therefore recommended that the Board of Directors accept and file this statusreport on the Pajaro River Flood Risk Reduction Project, and direct staff to retur with a further

update at your Board's next scheduled meeting.

On June 18,2012, your Board approved an independent contractor agreement withBauldry Engineering, Inc., to provide Qualified Storm Water Pollution Prevention Plan (SWPPP)Practitioner (QSP) services for the Pajaro River Bench Excavation Project Phase 1 (completedOctober 2012) and Phase 2.

As your Board may recall, Zone 7 is preparing to restore the Salsipuedes Creeklevee crest to its design elevation during summer 2013. Soil to be excavated from the Pajaro RiverBench Excavation Project Phase 2 is planned for use to restore low spots along the SalsipuedesCreek levee. Geotechnical services are needed to evaluate the adequacy of the soil in its currentstate along the Pajaro River as potential fill for restoration, as well as the recommended method offill placement, and monitoring of construction for meeting geotechnical requirements and testing.Due to the urgent nature to restore the levees with soil available from Phase 2 of the BenchExcavation Project, which requires soil investigations to be done immediately, and the recentexperience of Bauldry Engineering, Inc., on the Bench Excavation Project Phase 1, BauldryEngineering, Inc., is uniquely qualified to perform the needed geotechnical services.

Attached for your Board's review and approval is an amendment to agreement withBauldry Engineering, Inc., increasing the scope of work to include geotechnical and QSP servicesfor the Salsipuedes Creek Levee Restoration Project, and increasing compensation by $55,160 fora not-to-exceed amount of $125,160 through December 30, 2013. Sufficient funding for this workwill be available with your Board's approval of a transfer of fuds in the amount of $60,000 within I jthe Zone 7 Budget. 1-,

Salsipuedes Creek Levee Improvement ProjectSanta Cruz County, California

Dear Ms. Duran,

We are pleased to submit this opinion of probable costs for geotechnical consulting andconstruction observation and testing services for the Salsipuedes Creek Levee ImprovementProject in Santa Cruz County, California. To prepare this proposal we reviewed the documentsprovided our offce by the County and discussed the project with you.

The proposed project consists of the raising and/or widening of the existing levee in 7 selectareas. This will involve the construction of fil keyways along the base of the levee andplacement of fill on the existing face and crest of the levee. It is proposed to import soil for thisgrading operation from Phase 2 of the Pajaro River Bench Excavation Project.

Our services will include both a pre-construction investigation of the geotechnical conditionsalong the 7 selected areas of the Salsipuedes Levee, an investigation of the suitability of thesoils proposed for import from the Pajaro River Bench Excavation Project and geotechnicalobservation and testing services during the construction of the Salsipuedes Creek Leveeimprovements. It is our understanding that survey staking will be provided by the County prior toour field investigation. The staking will define the limits of the work area.

We anticipate performing the following scope of services:

1. Observe backhoe trenches excavated along the base of the Salsipuedes Levee in the 7areas selected for improvements. The backhoe and operator will be provided by theCounty.

2. Observe backhoe trenches excavated in the proposed borrow areas of the Pajaro RiverBench Excavation project. The backhoe and operator wil be provided by the County.

3. Collect soil samples from both the Salsipuedes Levee and the Pajaro River BenchExcavation trenches for laboratory testing.

4. Perform the necessary laboratory testing to determine the suitability of the fill for use asengineered fill for the Salsipuedes Creek Levee Improvements

5. Provide a report with our findings and conclusions.

6. Perform construction observation and testing services during placement of the new

engineered fill along the Salsipuedes Levee.

7. Attend meetings

8. Provide consultation and technical reviews

9. Prepare daily and summary reports

The uncertainties connected with the soil and geotechnical conditions at the sites, thecontractor's schedule, the contractor's performance, the project duration and the weatherconditions make it difficult to determine the actual time and costs necessary to perform therequired services. 02 g 6Levee design and slope stability analysis is beyond our scope of service.

In preparing the following opinion of probable costs we have assumed following:

1. The project requires payment of prevailing wage.

2. The grading associated with the construction of the Salsipuedes Creek levee

improvements will require 40 days of fulltime geotechnical observation and testing.

Client's ResponsibiltiesStaking: It is the County's responsibility to provide survey staking to define the limits of the workarea prior to our field investigation.

Trenching and Backfill: It is the County's responsibility to provide a backhoe and an operator forthe geotechnical investigations along the Salsipuedes Levee and Pajaro River BenchExcavation sites. The County is responsible for backfilling the trenches.

Hazardous Wastes: Hazardous wastes are any substance or material so designated by theState of California or the Federal Government. If you are aware of any hazardous wastes onyour site, you are required to inform us in writing prior to entering this agreement. In the eventBauldry Engineering, Inc. encounters hazardous substances or contamination beyond thatoriginally represented by client, Bauldry Engineering, Inc. may suspend its services and enterinto good faith renegotiation of our agreement.

In the past year, the City of Watsonville requested that all meetings be heldin the evening in Watsonvile, and the Board accommodated the request. Historic practicehas been that the Board meets in Santa Cruz, and once a year in Watsonvile for the Junebudget hearing. Given the monetary cost of moving the meetings to Watsonvile,estimated at about $1,000 per meeting, staff is recommending the meeting locationsshould adhere to past practices. However, if significant items come up for consideration,staff would work with the Board Chair to move or schedule special meetings inWatsonvile.

The District's Rules and Regulations allow your Board to select alternativemeeting dates, times, and locations for Zone 7 meetings. Should your Board so desire,any of the proposed meetings or special meetings could be held in Watsonvile or at theSanta Cruz County Board of Supervisors Chambers.
