Menston, Yorkshire

1 Two late thirteenth (or early fourteenth) century deeds relating to the land of WilliamAttebeck of Mensynton written on vellum. The first being a grant by William, son ofWilliam Attebeck to Walter, Lord of Hawksworth of - the messuage and land in Menston which decended hereditarily to the grantor from hisfather.- a toft with croft in Menston called Fontayns Garth, between the messuage of Walter deBayld[o]n on one side and that of John Stot of Menston on the other side.- The homage and service of the following individuals who hold land in Menston fromthe grantor, Walter de Bayld[o]n; Alexander de Brerhag; William son of Gilbert; Williamson of Richard fil. S[er]lonis; John Walker de Burlay; William Helbe (but excluding landsin Menston given by the grantor to his son John, and to William his son).Undated, but after 1290 (as to be held of the chief lord of the fee) and is probably acontemporary copy as it ends, “In cui[us] rei test[imonium] & c”; presumably omittingthe customary list of witnesses, and allusion to sealing but with the seal or fragment nowin a paper cover with binding cord.

The second document is an quitclaim by Alice, widow of Alexander de Mensyngton, toWilliam son of William Attebeck of Mensyngton of all rights in a toft with croft inMenston, between a toft of Walter de Haukesword west and a toft of William Attebecksenior east, which toft and croft Michael Attebek and the said William his son had by grantof Robert Stotte of Menston.Witnessed by Walter de Haukesword, Peter de Marthelay, Thomas de Monte also, Ralphde Ilketon, Robert de Burlay, Michael de Rondon and John de Carleton. 2 1469 (1 December) vellum document in latin being a quitclaim by Thomas Watson ofRipon, Yorkshire, and his wife Beatrix, to Thomas Hawkisworth of Hawksworth,Yorkshire “Gentylman”, of all rights in property granted by Watson to Hawkisworth, inMenston, Yorkshire.

Two small seals of Watson and his wife in red wax, largely complete; on seal tags cut froma document of the period.

LETTERS PATENT GRANTED BY KING EDWARD VI

3 1552 (6 October) on one skin of vellum and written in an attractive official hand.

A licence for 42s. 21⁄2d. paid in the Hanaper to lady Elizabeth Fane (widow) to grant hertithes of grain and hay and other tithes within the ward of Hilden, commonly calledHilden Warde, within the parish of Tunbrydge (Tunbridge), Kent, late parcel ofTunbrydge rectory to Humphrey Dixson and John Dixson and their heirs and assigns ofthe said John. Witnessed at Westminster the 27th day of October 6.

On the fold of this patent the costs are broken down as follows: 13s. 21⁄2d for a fine or thetax, 20s. 4d for the seal, 4s. for the enrollment and further entries.

The document bears the Great Seal of Edward VI which is in remarkably fine condition,clearly showing all of the lettering and the fine detail of the seal. A couple of minor edgeknocks do not detract from this magnificent seal.

This is the second seal of Edward VI used between 1548 and 1553. It shows the Kingenthroned, royal robes, tippet, crown, royal sceptre and orb, on carved throne, with shellshaped back, on which the initials E. R. beside king’s head with cherub’s head and wingsabove them, and circular baldachin having curtains at sides looped up in a large bunch,scroll work at sides (panels with trophies), carved footboard, on the arm piece on eachside a lion. In the field on each side an ornamental shields of arms of France and Englandquarterly, encircled with garter inscribed with the motto and ensigned with the crownroyal. EDWARDI SEXTI DEI GRATIA ANGLIE FRANCIE / ET HIBERNIE REXFIDEI DEFE[N]SOR ET IN TERRA ECCLESIE ANGLICANE ET HIBERNICESVPREMVM CAPVT (Edward the Sixth, by the grace of God of England, France / andof Ireland King, Defender of the Faith, and on Earth, of the English and Irish Church,Supreme Head).

The reverse is the King on a horse, plumed and crested helmet, shield of arms as before,sword held over head, horse trapping richly flowered, and having two shields of arms asbefore, one shoulder and one on thigh; greyhound running beside horse in foreground,between two lopped trees, Background ornamented with scrolls of foliage, four smallfleur-de-lis, three cinquefoil roses, large rose ensigned with crown over tail of horse, andfleur-de-lis similarly ensigned, in front of horse’s head.

Hilden is a manor situated at about a mile’s distance from Tunbridge town, and wasantiently part of the possessions of the family of Vane, written a-Vane in antient deeds, beforethe reign of King Edward III. One of them, John Vane, esq. had two sons of the name ofHenry; the eldest of which left an only daughter and heir, married to Sir Peter Blondevil; theyoungest Henry Vane, was of this place, esq. and had three sons; John Vane, esq. of Hilden,and afterwards of Tudeley, ancestor of the several branches of this family since enabled;Thomas, whose son Humphry died without issue; and Henry, who was father of Sir RalphFane, attainted in the reign of King Edward VI. By his will in the 34th year of King HenryVI he devised this manor to his eldest son John, and the parsonage of Hilden to his youngestson Henry. John Vane, esq. sold the manor in the 10th year of King Henry VII to Tattersal,one of whose descendants possessed it at his death in the 6th year of King Edward VI. anno1551, when it was sound that he died possessed of this manor, and five hundred acres of land,in Hilden and I unbridge, held of the honor of Tunbridge, by knight’s service, and that JohnTattersal was his son and heir. He alienated it to Humphry Dixon, who in that reign hadpurchased the parsonage of Hilden of Elizabeth, Lady Vane. He was the second son of ThomasDixon, esq. of North-frith, in this parish, descended of a family of good account of this namein Scotland, who bore for their arms, or, a cross formee or palee throughout the shield, gules,between four eagles displayed, sable. John, the eldest, succeeded him in this manor, and residedhere, he left two sons; Henry, who was of Hilden, esq. and justice of the peace; and William,who was of Darent, in this county. Henry Dixon, esq. the eldest son of Humphry, resided here,as did his grandson of the same name, who died in 1669, leaving two daughters his coheirs,who possessed this manor in undivided moieties. Jane, the eldest, married Nathaniel Booth,esq. and Sarah, the youngest, Percival Hart, esq. of Lullingstone. Percival Hart, esq. died in1738, leaving an only daughter and heir Anne, then married to Sir Thomas Dyke, bart. ofHoreham, in Suffex, who became possessed of one undivided moiety of this manor, as he didlikewise of the other moiety on the death of Mrs. Jane Booth, widow, above mentioned, withoutissue, in 1743. Sir Thomas Dyke died in 1756, leaving his widow surviving, who possessed thewhole of this manor till her death in 1763, when it descended to their only son and heir SirJohn Dixon Dyke, bart. of Lullingstone, who procuring the authority of parliament, sold it,in 1767, to Thomas Harvey, esq. of Tunbridge, the son of Thomas Harvey, of Deal, descendedof the family of Harvey, settled so early as King Edward the IV’s reign, at Tilmanstone, inEast Kent, and afterwards dispersed over the several parishes in that neighbourhood, in thedescription of which parish a full account of them may be seen, whose arms being, Argent, ona chevron gules, three crescents or, between three lions gambs erased, sable, are likewife borneby this branch of it. Mr. Harvey, of Tunbridge, married Charlotte, youngest daughter of theRev. William Davis, vicar of this parish, by whom he had two sons, Thomas, now of Redleaf,in holy orders, and William Thomas; and three daughters, Charlotte, Sophia, and Frances.He died in 1779, leaving his widow Mrs. Harvey, surviving, who is by his will possessor of thisestate for her life, after which it will devolve, by his devise, to this eldest son, the Rev. ThomasHarvey. At a small distance from Hilden-green, stood the manor-house, the ruins of whichwere entirely erased some years ago, by Sir Thomas Dyke. A court baron is held for this manor.

LETTERS PATENT GRANTED BY QUEEN ELIZABETH I

4 1600 (2 September) on one piece of vellum, written in a very neat official hand.

A licence for 53s. 4d. paid in the Hanaper to John Dixon gentleman and Joan his wifeand Henry Dixon all their tithes of grain and hay and all other tithes whatsoever withinthe ward of Hylden in the parish of Tunbridge in the county of Kent late parcel of therectory of Tunbridge. Held for the use and behoof of Mary Dixon wife of the aforesaidHenry during her natural life for her jointure and after her decease to the use of the saidHenry. Granted to Peter Blower gentleman and William Blower gentleman and to theheirs and assigns of the said Peter. Witnessed at Westminster the 2nd day of September42 Elizabeth.

The document bears the Great Seal engraved by Nicholas Hilliard.

Elizabeth I used this great seal during the second half of her reign - from 1586 to 1603.It is an impression from seal matrix made of bronze and was engraved by NicholasHilliard, who was famous for his small paintings or miniatures. The matrix was used tocreate wax impressions that were used to ‘seal’ documents. This was a means of provingthat the accompanying document had been written or approved by the owner of the seal.Seals were widely used by statesmen, nobles, judges, churchmen and even ordinarypeople. The great seal was the most important of all as the monarch used it to approvepublic acts and announcements. It was a powerful political tool.

The great seal of Elizabeth gives an insight into how the queen wanted to be seen. Onone side, she is shown holding the sceptre and orb that are the traditional symbols of royalpower. Heavenly rays above her head are a sign of her divine status. On the reverse side,Elizabeth is shown on horseback riding across a field of flowering plants. This symboliseshope and prosperity, as well as the queen’s femininity. Her image is one of strength, butunlike her predecessors she is not wearing military dress. She is flanked by the symbols ofher lands: the Tudor Rose of England, the Harp of Ireland, and the Fleur-de-Lys ofFrance. The inscription around the edge reads: ‘Elizabetha dei gracia Anglie Francie etHibernie Regina Fidei Defensor’ (Elizabeth, by grace of God, Queen of England, Franceand Ireland, Defender of the Faith).

The seal is in a superb state of preservation, with complete inscription and comes in itsoriginal leather and wood box which is lined by printed religious text and a piece offourteenth century religious manuscript.

Related to the same land as the previous Letter Patent, this is a very important item ofKent history. Photo £2,000-2,500

King Charles II

5 1667 (20 May) a Grant of Arms issued by Sir Edward Walker, Garter King of Arms toJohn Wadman of Brooke, Wiltshire, an attorney in the Court of Common Pleas. An English illuminated manuscript with three-sided foliated border and large foliateinitial, granting his “Coate of Armes” which includes three roses argent. The Coat of Armshas been stitched onto the manuscript (some threads are broken) and with broken seal ofSir Edward Walker in tin skippet. Signed “Edw Walker, Garter” at foot. Some staining inthe upper right corner, folded with some resultant soiling. Photo £400-500

Sir Edward Walker (1611-77). He followed Charles II into exile and was with himconstantly, not only as his Garter King of Arms but as Clerk of his Privy Council and afterthe King’s return from exile in 1660

King James II

6 1686 (23 June) an Exemplification of Common Recovery. A fine indenture on vellumwith large printed head of the monarch with large initial capital, armorial animals andbirds.

The recovery is by Samuel Westerne from Nathaniel Bard of one messuage, four gardens,200 acres land, 30 meadow, 300 pasture, 20 wood, 20 marsh, 200 scrub and heath, inMilborne Port, Goathill, Henstridge Ash and Bowen in Henstridge, Dorset and Somerset.The seal tag has been cut, offered with fragments of the seal.

7 1689 (19 June) an Exemplification of Common Recovery. An indenture on vellum inLatin with engraved portrait of William and Mary (heads and shoulders) with large initialcapital, nautical allegorical figures and armorial devices.

Thomas Townshend, First Viscount Sydney

17 1765 (10 December) Treasury Order for payments to Francis Earl of Hertford, “One ofthe Gentlemen of his Majesty’s Bedchamber”, signed by Thomas Townshend, J.Cavendishand William Dowdeswell, Lords of the Treasury. Single page (131⁄2 x 9 inches), cancelledwith a broad pen stroke as is customary with these Exchequer documents, integral blankleaf, a few minor marginal tears only. Marked at foot as paid on 31st December 1765 andsigned “Lincoln” £200-240

Thomas Townshend, 1st Viscount Sydney (1733-1800) was brought back into office byRockingham as a Lord of the Treasury on 12 July 1765. He became Secretary of State for theHome Office in July 1782, after a few months as secretary at war under Rockingham. Inthose days the home department included responsibility for the colonies. He is famous for hissupport of the plans for a convict settlement in New South Wales. On 26 January 1788Arthur Philip named Sydney in New South Wales in his honour.

Francis Edward Rawdon-Hastings, 1st Marquess of Hastings

x20 1793 (28 November) A.L.S. written in Portsmouth to Augustus Rogers, he is requestingthat the guns and howitzers which he ordered be obtained from other stores (these notbeing available in Portsmouth), “Sir Charles Grey has left some of the sixteen Light Six-pounders attached to the Regiments with their amunition. He has also made over to me two51⁄2 inch howitzers ...” and concludes, “Admiral Macbride is at Spithead. If, when I canconverse with him on the subject I find that I must not reckon of the assistance of heavycannon from the ship ...” and is signed “Moira”. Included with this letter is a reply fromthe Office of Ordnance to The Earl of Moira on the subject of the revised and agreedordnance for the expedition and lists the guns, howitzers and mortars which are to besupplied from Portsmouth and from Woolwich.

On the death of the first Earl, he became The Earl of Moira from June 1793 to 1816. He wasa British soldier and colonial administrator. He served as Governor-General of India from1813 to 1823. He had also served with British forces for years during the AmericanRevolutionary War and in 1794 during the French Revolutionary Wars. He took theadditional surname ‘Hastings’ in 1790 in compliance with the will of his maternal uncle,Francis Hastings, 10th Earl of Huntingdon Following the declaration of war in 1793 ofFrance upon Great Britain, Rawdon-Hastings (as he was now known) was appointed majorgeneral, on 12 October 1793. Sent by the Pitt ministry, Rawdon-Hastings launched anexpedition into Ostend, France, in 1794. He marched to join with the army of the Duke ofYork, at Alost. The French general Pichegru, with superior numbers, forced the British backtoward their base at Antwerp. Rawdon-Hastings left the expedition, feeling Pitt had brokenpromises

Thomas Grimston (1753-1821). In about 1781 he began rebuilding the family house atGrimston Garth (which still exists) to the Georgian Gothic design of John Carr of York andhe then divided his time between Kilnwick and Grimston Garth. The threat of a Frenchinvasion of England loomed large during the years of the Napoleonic wars and so the bigwigsin the East Riding of Yorkshire set about raising companies of volunteers to swell the militarynumbers. In 1795, at a huge expence, established the Grimston Yeomanary Cavalry. Hestruggled to recruit enough men as there was no pay. However, for the next 20 years theycharged up and down Holderness (East Yorkshire) coast looking for those demmed Frenchies.They were popular in the inns with locals for their generosity in standing the drinks

General Sir George Beckwith

23 * 1803 (16 August) an autograph letter signed, as Major-General sent from “DanburyCamp” to Colonel Stanley of the 1st Royal Lancashire Regiment about the disposition ofregimental officers; some paper loss at seal opening, clear of signature, (9 x 7 inches) andaffixed to old album page, light stains. An elusive Revolutionary War signature. Photo £280-350

General Sir George Beckwith (1753-1823). Beckwith was commissioned into the 37thRegiment of Foot in 1771. He distinguished himself as a regimental officer in the AmericanRevolutionary War. He fought with distinction in the New York and New Jersey campaignsin 1776, leading the British advance into Elizabethtown and Brunswick. In 1780 he tookcharge of British military intelligence in New York. After the war he worked for Sir GuyCarleton in Canada. His efforts were aimed at stirring up trouble in Vermont, Florida,Kentucky and Tennessee. At the time Britain thought the weak American government mightask for British help. He was then appointed Governor of Bermuda in 1797, Governor of SaintVincent in 1806 and Governor of Barbados in 1810. He was made a K.B. for his Capture ofMartinique in 1809 and also led a successful expedition against Guadeloupe, the last Frenchpossession in the area, in 1810. He attained the full rank of General in 1814. Sir GeorgeBeckwith was Commander-in-Chief, Ireland from 1816 to 1820. He has an entry in Spies,Wiretaps, and Secret Operations: An Encyclopaedia of American Espionage

Lieutenant General Colin Campbell (1754-1814) was commissioned into the 71st Regimentof Foot in 1771 and then transferred to the 6th Regiment of Foot in 1783. In 1796 he wentto Ireland and fought, two years later, at the Battle of Vinegar Hill. In 1810 he wasappointed Lieutenant Governor of Gibraltar. During the Peninsular War he insisted onkeeping Gibraltar well garrisoned and also regarded Tarifa as within his command anddenied it to the French invading force there

John Yule, 4th Lieutenant in the Victory at Trafalgar, one of the carriers of the bannerollsof lineage at Nelson’s funeral and features in the “Death of Nelson” by Devis. Yule waspromoted to Captain after Trafalgar and had served at the Battle of the Nile prior to joiningthe Victory in 1805. He retired in 1835 and died in 1840. There is a grade II listed house inBranscombe which was originally named “Trafalgar” and was built by Captain Yule

In Brighton Mr. Crunden took £125.14.0d infares and had £4 in expenses. The combined profit was shared amongst the variousinnkeepers who horsed the coach on the Brighton road. William Chaplin was probablythe most important of the great stage coach proprietors, with four major coaching innsand a stud of over 400 horses. 37 * 1870 (11 January) A.L.S. and envelope sent from his home in Avignon addressed to TheRight Hon. Russell Gurney M.P. The letter gives an account reported in the Daily Newsof a policeman, William Smith, who was taken before a magistrate for striking a man withhis staff after seeing him knock a woman down in the street at one in the morning.Sentenced to one month in prison, the policeman was dismissed from the force, loosinghis livelihood. He argues that other policemen will be inhibited in their legitimate workif the risk of prosecution hangs over them and that William Smith should be restored tothe force. The envelope bears Laureated Napoleon 40c. tied by gross chiffres with thedespatch c.d.s. alongside; redirected on arrival the envelope bears a good strike of thediminutive “R.” in crowned circle (denoting the parliamentary privilege of no fee forredirection) and London E.C. Edith Cavell

43 1894 (c.) a family album of questions with written answers by members of the Francoisefamily and friends, includes a page written in her hand and signed “Edith Cavell, 21st Sept.1894”. A black felt cloth with embroidered signatures of family members included “E Cavell”. An 1895 photograph 280 x 230mm of a large (family?) group of over sixtyon an outing which includes Edith Cavell near the centre (believed to be unpublished)and a small photograph with Miss Cavell with the youngsters of the family. A very unusualand important group.

Edith Cavell took a post as governess with the Francoise family in Brussels in 1890 andstayed there for five years. She became a family favorite. Photo £1,000-1,200

Edith Cavell was the World War I British nurse who is celebrated for saving the lives ofsoldiers in Brussels from all sides without distinction. She and Belgian and French colleagueshelped over 200 Allied soldiers escape from German-occupied Belgium. She was arrested, triedwith 33 others by a German military court, found guilty of ‘assisting men to the enemy’ andshot by a German firing squad on October 12 1915

He served as a model Governor General of Canada,Viceroy of India, Secretary of State for War and Secretary of State for Foreign Affairs. JamesKnowles was later to serve as A.D.C. to Field Marshal Roberts

He fought in the Egyptian Campaign of 1882 and wasawarded a medal for his actions

Colonel Ahmed ‘Urabi (1841-1911), widely known in English as Ahmad Arabi or ArabiPasha, was a nationalist Egyptian and an officer of the Egyptian army. The first politicaland military leader in Egypt to rise from the fellahin, ‘Urabi participated in a 1879 mutinythat developed into a general revolt against the Anglo-French dominated administration ofKhedive Tewfik. He was promoted to Tewfik’s cabinet and began reforms of Egypt’s militaryand civil administrations, but the demonstrations in Alexandria of 1882 prompted a Britishbombardment and invasion that deposed ‘Urabi and his allies in favor of a Britishoccupation

Imperial Trans-Antarctic Expedition

x54 1913 (5 August) A.L.S. by Ernest Shackleton on letterhead from 4, New BurlingtonStreet, Regent Street with the telegraphic address “ANTEXPEDI, LONDON”, written to afriend, Fell.

“The gist of my long letter is that I want to be guaranteed £5000 for one year and I pay theinterest to the Bank and deposit with the guarantors the securities I referred to so that therewill be little risk and I can have and clear mind to go ahead ... Ernest Shackleton”. Central and other folds plus small paper split at top.

An early fund-raising letter from The Imperial Trans-Antarctic Expedition (1914-17),also known as the Endurance Expedition, which is considered to be the last majorexpedition of the heroic age of Antarctic exploration. Photo £1,200-1,500

Shackleton estimated that he would need £50,000 for this expedition. He did not believe inappeals to the public which he felt caused needless book-keeping worries. He chose to raise fundsby soliciting contributions from wealthy backers, beginning this process early in 1913. The firstsignificant encouragement came in December 1913, when the Government offered him£10,000, provided he could raise an equivalent amount from private sources. The RoyalGeographical Society, from which he had expected nothing, gave him £1,000, Lord Rosebery,who had previously expressed his lack of interest in polar expeditions, gave £50. In February1914 The New York Times reported that playwright J. M. Barrie - a close friend of CaptainScott - had confidentially donated $50,000. With time running out, contributions wereeventually secured during the spring and early summer of 1914. Dudley Docker of theBirmingham Small Arms Company (BSA) gave £10,000, wealthy tobacco heiress JanetStancomb-Wills gave a “generous” sum (the amount was not revealed), and, in June, Scottishindustrialist Sir James Caird donated £24,000. Shackleton informed the Morning Post that“this magnificent gift relieves me of all anxiety”

Lord Byng of Vimy

Field Marshal Julian Hedworth George Byng, 1st Viscount Byng of Vimy, GCB GCMGMVO (1862-1935) served as Governor General of Canada. Known to friends as “Bungo”,he was born to a noble family at Wrotham Park in Hertfordshire, England, and educated atEton College. Byng received a commission as a militia officer and thereafter saw service inEgypt and Sudan before he enrolled in the Staff College at Camberley. Followingdistinguished service during the First World War - specifically, with the British ExpeditionaryForce in France, in the Battle of Gallipoli, as Commander of the Canadian Corps at VimyRidge, and as Commander of the British Third Army - Byng was elevated to the peerage in1919.

In 1921 he was appointed as Governor General of Canada by King George V to replace theDuke of Devonshire as viceroy, and occupied that post until succeeded by the ViscountWillingdon in 1926. Byng proved to be popular with Canadians.

After the end of his viceregal tenure, Byng returned to the United Kingdom and there servedas the Commissioner of Police of the Metropolis and was promoted within the peerage tobecome Viscount Byng of Vimy. Three years after being appointed as a Field Marshal, Byngdied at his home on 6 June

The first dated 18th October is a typewritten letter signed “A. Bonar Law” (later PrimeMinister), “We have now heard that the Spanish Government have at last grantedpermission for the issue of the Rio Tinto Company’s loan in Spain. It has been a long andtiresome business ...The negotiations could not have been carried through without yourhelp.”

The second dates 17th December is a typewritten letter signed “J M Keynes”, “I havespoke to Sir John Bradbury since you were here, on the question of whether the time hasnot now come for exercising our option over a further 50,000,000 pesetas Tinto loan...We are not in any very urgent need for the proceeds of the loan and the exact date cantherefore be left to suit your convenience”.

The final letter dated 20th December is an autograph letter signed “J M Keynes”, “I amvery glad the the King (or whoever acts for him) has heard the ... of the Treasury. But I amsure your real reward for the great trouble you took for us is that you were of assistance to thecountry at a moment when our financial affairs were not of the highest”. He built on and greatly refined earlier work on the causes of businesscycles, and is widely considered to be one of the most influential economists of the 20th century.His ideas are the basis for the school of thought known as Keynesian economics and its variousoffshoots

57 1939-40, a file of correspondence Sir William Davidson, M.P. relating to the LondonBalloon Barrage Section of the Royal Air Force fixing a balloon in Ladbroke SquareGarden. A detailed compilation with top copies and duplicates, some signed, and includesproblems associated with the removal of trees (instead of just lopping), claims forcompensation for damage to property, the keeping of chickens for the unit. A wonderfulinsight into the problems on the ground of setting up these defensive units. Apparentlythis Garden was considered by the locals as a particularly poor choice as it was wellwooded, not apparent from a scan of an Ordnance Survey map £150-200

59 1956-75, three typewritten letters to Joe (Whitlock Blundell) from his home inRemsenburg in New York.

The first letter, dated 3 February 1956 tells how he had handed a script to Simon andSchuster editor, but he did not like it. Also how much he enjoyed living in the country.It is signed “Plummy”

The second letter dated 18 April he asks where the Macall book is that was promised andhow they had just purchased the plot of land next to theirs to prevent building on it, “Itwas a very sound move, really, because land down here is getting more and morevaluable”. He had also just finished a new novel but was astounded that The Ladies HomeJournal turned it down as it was not funny enough! 71 An album compiled by Lieut. Col. F.R. Trench-Gascoigne; a quarto sized album boundin dark green, straight-grain Morocco leather (some wear, particularly at the extremities)with gilt title.

One of the initial photographs in the album include the colonel with twelve other militaryofficers, a diplomat and some wives. There are a total of 27 panoramic images (7 x 21⁄4inches) taken with a Kodak Panorama no.1 camera, which include other views of thetented camp with various civilians or soldiers, five views of the procession route includingpictures of some of the elephants, and nine showing the military displays. There are sixlarge plate images (11 x 8 inches) with the elephant procession near Jama Masjid (2), theDurbar stands with the mounted heralds in position, a view of the eastern stand (9 x 7inch), a view of the audience hall in the Red Fort and a good view of the Chief’s elephantat rest, a close up of two elephants with their mahouts.

There are also invitations, tickets, etc, each centrally mounted, with an invitation to theDelhi Durbar (block B), two tickets, one pasted face down to show the plan of theamphitheatre, invitations to the Chapters of the Orders of the Star of India (2), the DelhiCoronation Assembly (creased) plus a dinner menu and dance card for the same event,illustrated Delhi Durbar military display plus others. Also 18 pages of cuttings fromEnglish newspapers, mainly the Yorkshire Post.

72 An impressive, four bound volumes, being Correspondence concerning particulars,equipment and maintenance of the Camp of the Lieutenant-Governor of Bengal at theImperial Coronation Durbar at Delhi in 1902-03. This unique collection withcorrespondence, plans, photos and ephemera relating to the Delhi Durbar of 1903 wascollected by Major J. Strachey, Private Secretary to the Lt.-Governor of Bengal.

This is an astonishing and comprehensive collection, mostly printed documents relatingto all aspects and requirements for the good operatin of this important event. It covers allaspects from committee reports, ordering of native flags, the organising of the military,seating arrangements and protection of dignitaries along with background informationabout them, arrangements of temporary telegraph offices, camp plans and maps, paradestrengths and regulations. A huge amount of information with regard to the camp withorders for tents and fittings, furniture, stoves, eating utensils, etc. Railway transport withexamples of the different labels used, a train plan with the seating arrangements for thedignitaries plus the shipment of horses and carriages. A mine of information about thefinancial accounts with a pencil note indicating that the total cost was R,253,196: receiptsfrom the Army & Navy Co-operative Society, detailed lists of the amount of individualitems of food consumed for each day of the camp, guest lists for various dinner parties. A booklet of Notes and Information for Guests, examples of special postmarks, furtherCamp plans and blueprints, lighting including a plan of a street lamp and examples of thespecial camp stationery. The final volume with ephemera including postage stampscancelled by the special postmark, special playing cards (court cards from all four suits),examples of illustrated menus and a fine selection of photographs, both large and small,including the procession, including local dignitaries on elephants, mounted soldiers;general views of the Viceroy’s Camp, Bengal Camp, group picture of the Europeandignitaries with key, the ‘Drawing Room’ and ‘Dining Room’, group pictures of theMutiny Veterans and a similar for the native soldiers; a wide range of pictures of theprocession at the Durbar with the dressed elephants, elaborate carriages and others.

“with much regret, where we spent a delightful & most interesting time. We certainly hadvery hard work, but if our visit has been a success & it has done some good we are amplyrewarded. I think what Sir H. Fowler said about Curzon is quite correct. He may have donesome good things but he also made a great number of mistakes & certainly was one of the mostunpopular Viceroys India has had for years. Wait till we meet & I can tell you a lot about it.One of his greatest mistakes was his speech at Bombay just before we left + his letter to the Timeswas about as bad. The envelope, carried in the diplomatic bag is addressed to St. James’ Palace and redirecedto Buckingham Palace, and initialled “G” in lower corner.

Also 1906 (27 Feb.) an autograph signed letter from The Princess of Wales on her specialletterhead titled “Prince of Wales’s Camp, India” thanking the recipient for theirexplanation of all the special buildings in Agra and signed “Victoria Mary”. With theoriginal envelope which was delivered by hand.

131 * 1891 (May) two autograph notes signed on his visiting cards to J.T. Grein (a Dutch borntheatre impresario and drama critic) with one autograph envelope addressed within Paris.

Translations of the notes, “My dear colleague, I will happily receive you on whatever day youlike, at 6 o’clock, Sunday excepted. Cordially, Émile Zola” and “I shall only be hometomorrow, Monday, after 8 in the evening, and will be pleased, sir, to shake your hand if youcan step out at such a late hour. Émile Zola”.

It is possible that these invitations were to discuss arrangements for that autumn’sproduction of Thérèse Raquin in London. Photo £500-600

Émile Zola (1840-1902), a French novelist, critic, and political activist who was the mostprominent French novelist of the late 19th century. He was noted for his theories ofnaturalism, which underlie his monumental 20-novel series Les Rougon-Macquart, and forhis intervention in the Dreyfus Affair through his famous open letter, ‘J’accuse.’

Jacob Thomas Grein moved to London in 1885 and became a naturalised British subject in1895. His greatest achievement was founding the Independent Theatre Society in 1891. Theirfirst production was Henrik Ibsen’s Ghosts in 1891. Their performances were held as“private” subscription performances, which allowed them to present plays that were notofficially licensed by the Lord Chamberlain’s Office. In 1892 the Society produced GeorgeBernard Shaw’s first play, Widowers’ Houses.[2] Grein married the actress Alice AugustaGreeven in 1904; she later wrote and edited a biography of him under the pseudonym MichaelOrme

While Albert Einstein was visiting the United States in 1933, the appointment of AdolfHitler as chancellor took effect and the Jewish theoretical physicist decided he would not returnto his home in Germany where he had been a professor at the Berlin Academy of Sciences.Einstein had been in the US for a visiting professorship at the California Institute ofTechnology in Pasadena at the time. He and his wife Elsa returned by ship to Belgium inMarch 1933 to find that that their cottage had been raided. Einstein turned in his passportto the German consulate and formally renounced his German citizenship. By the summer,Einstein learned that his name was on a list of assassination targets. He resided in Belgiumfor some months and then moved to England for a short period. On October 17, 1933, hereturned to the US and took up a position at the Institute for Advanced Study at Princeton,New Jersey. The Princeton agreement required he stay for six months. With offers fromnumerous universities, including Oxford, Einstein was undecided on his future

Dona Maria II (1819-53) “the Educator” or “the Good Mother”. She was Queen regnant ofthe Kingdom of Portugal and the Algarves from 1826 to 1828 and again from 1834 to 1853.When Maria’s grandfather King João VI died in March 1826, there was a succession crisisin Portugal. The king had a male heir, Pedro, but Pedro had proclaimed the independenceof Brazil in 1822 and he was then Emperor Pedro I of that country. The late king also had ayounger son, Miguel, but he was exiled in Austria after leading a number of revolutionsagainst his father and his liberal regime. Before his death, the king had nominated hisfavourite daughter, Isabel Maria, to serve as regent until “the legitimate heir returned to theKingdom” - but he had failed to specify which of his sons was the legitimate heir: Peter, theliberal Emperor of Brazil, or Miguel, the absolutist exiled prince.

Thus, after his accession, Joseph was content to leave decisions to his ministers,devoting himself to his pleasures, the opera and the chase. He appointed Sebastião deCarvalho, who soon gained an ascendancy over him and became all-powerful after the Lisbonearthquake of 1755

From 1554 he was King of Naples and Sicily as well as Duke of Milan.During his marriage to Queen Mary I (1554-58), he was also King of England and Ireland.From 1555, he was lord of the Seventeen Provinces of the Netherlands. Known in Spanish as“Philip the Prudent”, his empire included territories on every continent then known toEuropeans, including his namesake the Philippine Islands. During his reign, Spain reachedthe height of its influence and power. This is sometimes called the Golden Age. The expression,“the empire on which the sun never sets,” was coined during Philip’s time to reflect the extentof his dominion. Princess Zainab Nazli Khanum Effendi (Princess Nazli Fazl) (1853-1913) was anEgyptian princess from the dynasty of Muhammad Ali of Egypt. She was born in Istanbul, theeldest child of Mustafa Fazl Pasha, son of Ibrahim Pasha of Egypt and brother of the futureKhedive Isma’il Pasha, and Dilazad Hanim. Her mother was Dil-azad Khanum Effendi.At the age of 13, she left Egypt for Istanbul upon her father’s falling out with his brother, theKhedive, in 1866. In Istanbul, she was highly educated, against prevailing tradition, andentertained foreign visitors. A well educated and cultured lady who spoke Turkish, Arabic,French and English, and also Italian and German. In December 1872, she married Turkishambassador Halil Serif Pasa (Khalil Bey), and moved briefly to Paris with him in 1873

Marianna Török de Szendro (1877-1968). Daughter of Sofie Countess Vetter von der Lilieand stepdaughter of Hungarian inventor Tivadar Puskás. She spent most of her youth atWassen Castle South of Graz, Austria. Her elder brother Count József Török de Szendro(1873-98), following Austrian tradition, was enrolled at the Theresianum, where hebefriended Abbas Bey, an Egyptian prince. Marianna and Abbas met at a ball given by theAcademy. Shortly thereafter, he was made ruler in Egypt. They met the second time in Parisin 1900, where they fell in love, and Abbas invited her to Egypt. The visit developed into along romance culminating into a secret marriage contracted in Alexandria’s MontazahPalace, witnessed by two sheiks. The official marriage took place on February 28, 1910

Field Marshal Horatio Herbert Kitchener, 1st Earl Kitchener (1850-1916) was a seniorBritish Army officer and colonial administrator who won fame for his imperial campaignsand later played a central role in the early part of World War I, although he died halfwaythrough it. Having become Sirdar (Commander-in-Chief) of the Egyptian Army with thelocal rank of brigadier in April 1892, he won victories at the Battle of Ferkeh in June 1896and the Battle of Hafir in September 1896 earning him national fame in the UnitedKingdom and promotion to major-general on 25 September 1896. He achieved furthersuccesses at the Battle of Atbara in April 1898 and then the Battle of Omdurman inSeptember 1898. He quite possibly prevented war between France and Britain when he dealtfirmly but non-violently with the French military expedition, under Captain Marchand,intending to claim Fashoda, in what became known as the Fashoda Incident (See Spinkauction 15 November 2013, lot 2098)

Evelyn Baring, 1st Earl of Cromer (1841-1917), was a British statesman, diplomat andcolonial administrator. He was British controller-general in Egypt during 1879, part of theinternational Control which oversaw Egyptian finances after the khedives’ mismanagement,and during the British occupation prompted by the Urabi revolt, agent and consul-generalin Egypt from 1883 to 1907. Cromer ran the territory with great drive and his effectivegovernance inhibited British intentions to withdraw from Egypt

General Sir Francis Reginald Wingate, 1st Baronet (1861-1953) was a British general andadministrator in Egypt and the Sudan. As director of military intelligence he served in thecampaigns of 1896-98 which resulted in the reconquest of the Sudan. In 1917, Wingatesucceeded Sir Henry McMahon as High Commissioner in Egypt, a post he held until 1919.He was not a successful administrator in the very different political climate in that country

As British Agent and Consul General in Egypt, Gorst quickly improved the Agency’srelationship with Khedive Abbas Hilmi II, brought more Egyptians into responsiblegovernment positions, and weakened the Egyptian National Party

King Abdullah bin Al-Hussein, 1883-1951, founder of the Hashemite Kingdom of Jordan.The King supported the Peel Commission’s report of 1937 which proposed that Palestine besplit into a small Jewish state (20% of the British Mandate for Palestine) and the remainingland be annexed to Transjordan. The Jews reluctantly accepted this but the surroundingArab countries rejected it. This document is a reminder of the attempts in the interim to movetowards peace with the Jewish Colonies (The Yishuv), in Palestine. When the United Nationssupported a partition of Palestine in 1947, Abdullah was the only Arab leader to support thedecision. Abdullah, alone among the Arab leaders of his generation, was considered amoderate by the West. It was possible that he may have been willing to sign a separate peaceagreement with the pre and post State of Israel

158 1873 (December) a highly attractive illuminated sheet (46 x 62cm) headed “Sultan ofexalted Dignity whom God preserve” and proceeds to offer their congratulations to theSultan’s accession to the thrown and is signed by the Lord Mayor of London, the sheriffof London, several aldermen and others. Also two similar size documents to The GreatGovernors of Tangiers and Mogador informing them that General Seager had beenappointed to present their congratulations to the Imperial Majesty’s the Emperor ofMorocco. Also two supporting documents, one signed by John Richard Summers Vinethat he witnessed the signatures on the previous document, also signed by the LordMayor with Justice Room 1/6d. revenue and impressed general duty 2/6d., and anotherdocument signed by Andrew Lusk, the Lord Mayor with the Mayor’s seal. 167 * 1843 (6 February) letter written in Portuguese, to “The Very High and Very PowerfulPrince Fernando II, King of the Two Sicilies, my good cousin brother and brother in law”,signed “Pedro”. The wrapper without postal markings and with plain red wax seal on thereverse. A rare letter from Pedro the magnificent who ruled Brazil for 58 years. Photo £300-400

Dom Pedro II (1825-91), nicknamed “the Magnanimous”, he was the second and last rulerof the Empire of Brazil, reigning for over 58 years. Born in Rio de Janeiro, he was the seventhchild of Emperor Dom Pedro I of Brazil and Empress Dona Maria Leopoldina and thus amember of the Brazilian branch of the House of Braganza. His father’s abrupt abdicationand flight to Europe in 1831 left a five-year-old Pedro II as Emperor and led to a grim andlonely childhood and adolescence. Obliged to spend his time studying in preparation for rule,he knew only brief moments of happiness and encountered few friends of his age. Hisexperiences with court intrigues and political disputes during this period greatly affected hislater character. Pedro II grew into a man with a strong sense of duty and devotion towardhis country and his people. On the other hand, he increasingly resented his role as monarch

The front cover is a silver embossedillustration of the Zeppelin and Arms of the Hotel. On opening the menu, there are somesignatures and comments by guests. The centre page, in gothic script, each coursededicated to an individual on the flight. On the left of the page is the signature ofLieutenant Commander Kusaka Ryunosuke. Size 6” x 9”; folded. Lieutenant Commander Kusaka Ryunosuke had graduated from the Japanese Naval StaffCollege in 1925 as a specialist in Naval Aviation. By 1941 he had commanded two ofJapanese Aircraft Carriers (Hoso and Akagai) but was promoted to Chief of Staff of the 1stAir Fleet in April taking part and being instrumental in the strategic and tactical planningfor the Pearl Harbour attack. Promoted to Vice Admiral in 1944 he survived the war

TERMS AND CONDITIONS FOR BUYERSThese conditions set out the terms on which we (Spink and Son Limited of 69 Southampton Row, Bloomsbury London WC1B 4ET (company no. 04369748)) contractwith you (Buyer) either as agent on behalf of the Seller or as principal if we are the Seller. You should read these conditions carefully.

1 DEFINITIONS The following definitions apply in these conditions:Auctioneers’ Margin Scheme means a VAT margin scheme as defined by HM Revenue & Customs;Buyer’s Premium means the charge payable by you as a percentage of the Hammer Price, at the rates set out in clause 5.1 below; Certificate of Authenticity means a certificate issued by an Expert Committee confirming the authenticity of a Lot; Expert Committee means a committee of experts to whom a Lot may be sent for an extension in accordance with clause 3.4.3; Forgery means a Lot constituting an imitation originally conceived and executed as a whole with a fraudulent intention to deceive as to

authorship, origin, age, period, culture or source where the correct description as to such matters is not reflected by the descriptionin the catalogue and which at the date of the auction had a value materially less than it would have had if it had been in accordancewith the description in the catalogue. Accordingly, no Lot shall be capable of being a Forgery by reason of any damage and/orrestoration work of any kind (including re-enamelling);

Hammer Price means the amount of the highest bid accepted by the auctioneer in relation to a Lot;Lot means any item deposited with us for sale at auction and, in particular, the item or items described against any Lot number in any

catalogue;Reserve the amount below which we agree with the Seller that the Lot cannot be sold;Seller means the owner of the Lot being sold by us; Spink Group Spink and Son Limited, our subsidiaries and associated companies.VAT value added tax chargeable under VAT and any similar replacement or additional tax; andVAT Symbols means the symbols detailing the VAT status of the Lot details of which are set out at the back of the catalogue.

2 SPINK’S ROLE AS AGENT

2.1 All sales undertaken by us either at auction or privately are undertakeneither as agent on behalf of the Seller or from time to time, as principalif we are the owner of the Lot. Please note that even if we are acting asagent on behalf of the Seller rather than as principal, we may have afinancial interest in the Lot.

2.2 The contract for the sale of the Lot will be between you and the Seller.

3 BEFORE THE SALE3.1 Examination of goods

You are strongly advised to examine personally any goods in which youare interested, before the auction takes place. Condition reports areusually available on request. We provide no guarantee to you otherthan in relation to Forgeries, as set out in clause 5.13 of these Termsand Conditions.

3.2 Catalogue descriptions3.2.1 Statements by us in the catalogue or condition report, or made

orally or in writing elsewhere, regarding the authorship, origin,date, age, size, medium, attribution, genuineness, provenance,condition or estimated selling price of any Lot are merelystatements of opinion, and are not to be relied on as statements ofdefinitive fact. Catalogue and web illustrations are for guidanceonly, and should not be relied on either to determine the tone orcolour of any item. No lot shall be rejected on the grounds ofinaccurate reproduction. No lot illustrated in the catalogue andonline shall be rejected on the grounds of cancellation, centring,margins, perforation or other characteristics apparent from theillustration. Estimates of the selling price should not be relied on asa statement that this price is either the price at which the Lot willsell or its value for any other purpose.

3.2.2 Many items are of an age or nature which precludes their beingin perfect condition and some descriptions in the catalogue or givenby way of condition report make reference to damage and/orrestoration. We provide this information for guidance only and theabsence of such a reference does not imply that an item is free fromdefects or restoration nor does a reference to particular defectsimply the absence of any others.

3.2.3 Other than as set out in clause 5.13, and in the absence of fraud,neither the Seller nor we, nor any of our employees or agents, areresponsible for the correctness of any statement as to theauthorship, origin, date, age, attribution, genuineness orprovenance of any Lot nor for any other errors of description or forany faults or defects in any Lot. Every person interested shouldexercise and rely on his own judgment as to such matters.

3.3 Your ResponsibilityYou are responsible for satisfying yourself as to the condition of thegoods and the matters referred to in the catalogue description.

3.4 Extensions – Stamps only3.4.1 If you wish to obtain an expert opinion or Certificate of

Authenticity on any Lot (other than a mixed Lot or Lot containingundescribed stamps) you must notify us in writing not less thanforty-eight hours before the time fixed for the commencement ofthe first session of the sale. If accepted by us, such request shall havethe same effect as notice of an intention to question thegenuineness or description of the Lot for the purposes of clause5.13 (Refund in the case of Forgery) of these Terms andConditions and the provisions of clause 5.13 (Refund in the case ofForgery) shall apply accordingly.

3.4.2 Notice of a request for an expert opinion or Certificate ofAuthenticity must give the reason why such opinion is required andspecify the identity of your proposed expert which will be subjectto agreement by us. We reserve the right, at our discretion, torefuse a request for an expert opinion or Certificate of Authenticityincluding (without limitation) where the proposed expert is notknown to us.

3.4.3 If we accept a request for an expert opinion or Certificate ofAuthenticity we will submit the Lot to the Expert Committee. Youacknowledge and accept that the length of time taken by an ExpertCommittee to reach an opinion will vary depending on thecircumstances and in any event is beyond our control.

3.4.4 We will not accept a request for an extension on account ofcondition. Any Lot described in the catalogue as having faults ordefects may not be returned even if an expert opinion or Certificateof Authenticity cites other faults or defects not included in thecatalogue description, other than in the case of a Forgery.

3.4.5 Should Spink accept a request for an extension under theforegoing provisions of this paragraph, the fact may be stated by theAuctioneer from the rostrum prior to the sale of the Lot.

3.4.6 It should be noted that any stamp accompanied by a Certificateof Authenticity is sold on the basis of that Certificate only and noton the basis of any other description or warranty as to authenticity.No request for an extension will be accepted on such a stamp andthe return of such a stamp will not be accepted.

3.4.7 If you receive any correspondence from the Expert Committeein relation to the Lot, including but not limited to a Certificate ofAuthenticity, you must provide us with copies of suchcorrespondence no later than 7 days after you receive suchcorrespondence.

4 AT THE SALE4.1 Refusal of admission

Our sales usually take place on our own premises or premises overwhich we have control for the sale, and we have the right, exercisableat our complete discretion, to refuse admission to the premises orattendance at an auction.

4.2 Registration before biddingYou must complete and sign a registration form and provideidentification before making a bid at auction. Please be aware that weusually require buyers to undergo a credit check.If you have not bid successfully with Spink in the past, or you areregistering with us for the first time, we reserve the right to require adeposit of up to 50% of the amount you intend to spend. Such depositwill be deducted from your invoice should you be successful. If you areunsuccessful at auction, your deposit will be returned by the samemeans it was paid to Spink.Some lots may be designated, prior to the auction, as “Premium Lots”,which means a deposit may be required before placing a bid on theitem for sale. Information will be posted on our website in such anevent.

4.3 Bidding as PrincipalWhen making a bid (whether such bids are made in person or byway of telephone bids operated by Spink, commission or online oremail bids), you will be deemed to be acting as principal and will beaccepting personal liability, unless it has been agreed in writing, at thetime of registration, that you are acting as agent on behalf of a thirdparty buyer acceptable to us.

4.4 Commission BidsIf you give us instructions to bid on your behalf, by using the formprovided in our catalogues or via our website, we shall use reasonableendeavours to do so, provided these instructions are received not laterthan 24 hours before the auction. If we receive commission bids on aparticular Lot for identical amounts, and at auction these bids are thehighest bids for the Lot, it will be sold to the person whose bid wasreceived first. Commission bids are undertaken subject to othercommitments at the time of the sale, and the conduct of the auctionmay be such that we are unable to bid as requested. Since this isundertaken as a free service to prospective buyers on the terms stated,we cannot accept liability for failure to make a commission bid. Youshould therefore always attend personally if you wish to be certain ofbidding.

4.5 On-line BiddingWe offer internet services as a convenience to our clients. We will notbe responsible for errors or failures to execute bids placed on theinternet, including, without limitation, errors or failures caused by (i) aloss of internet connection by either party for whatever reason; (ii) abreakdown or problems with the online bidding software and/or (iii)a breakdown or problems with your internet connection, computer orsystem. Execution of on-line internet bids on www.spink.com andSpink Live is a free service undertaken subject to other commitments atthe time of the auction and we do not accept liability for failing toexecute an online internet bid or for errors or omissions in connectionwith this activity. Buyers who acquire lots on the-saleroom.com willhave a fee of 3% on the hammer price added to their invoice for usingthis facility.

4.6 Telephone BidsIf you make arrangements with us not less than 24 hours before thesale, we shall use reasonable endeavours to contact you to enable youto participate in bidding by telephone, but in no circumstances will webe liable to either the Seller or you as a result of failure to do so.

4.7 Currency ConverterAt some auctions, a currency converter will be operated, based on theone month forward rates of exchange quoted to us by Barclays BankPlc or any other appropriate rate determined by us, at opening on thedate of the auction. Bidding will take place in a currency determined byus, which is usually sterling for auctions held in London. The currencyconverter is not always reliable, and errors may occur beyond ourcontrol either in the accuracy of the Lot number displayed on theconverter, or the foreign currency equivalent of sterling bids. We shallnot be liable to you for any loss suffered as a result of you following thecurrency converter.

4.8 Video imagesAt some auctions there will be a video screen. Mistakes may occur in itsoperation, and we cannot be liable to you regarding either thecorrespondence of the image to the Lot being sold or the quality of theimage as a reproduction of the original.

4.10 Bidding by Spink4.10.1 We reserve the right to bid on Lots on the Seller’s behalf up to

the amount of the Reserve (if any), which will never be above thelow estimate printed in the auction catalogue.

4.10.2 The Spink Group reserves the right to bid on and purchaseLots as principal.

4.11 The Auctioneer’s DiscretionThe auctioneer has the right at his absolute discretion to refuse any bidto advance the bidding in such manner as he may decide to withdrawor divide any Lot, to combine any two or more Lots and, in the case oferror or dispute, to put an item up for bidding again.

4.12 Successful BidSubject to the auctioneer’s discretion, the striking of his hammer marksthe acceptance of the highest bid, provided always that such bid ishigher than the Reserve (where applicable), and the conclusion of acontract for sale between you and the Seller.

4.13 After Sale Arrangements If you enter into any private sale agreements for any Lot with the Sellerwithin 60 days of the auction, we, as exclusive agents of the Sellerreserve the right to charge you the applicable Buyer’s Premium inaccordance with these Terms and Conditions, and the Seller acommission in accordance with the terms of the Seller’s agreement.

4.14 Return of Lot4.14.1 Once your bid has been accepted for a Lot then you are liable

to pay for that Lot in accordance with these Terms and Conditions.If there are any problems with a Lot then you must notify us within7 days of receipt of the Lot, specifying the nature of the problem.We may then request that the Lot is returned to us for inspection.Save as set out in clause 5.13, the cancellation of the sale of any Lotand the refund of the corresponding purchase price is entirely atour sole discretion. We will not normally exercise that discretion ifthe Lot is not received by us in the same condition that it was in atthe auction date.

4.14.2 No lot may be returned on account of condition if thecondition was stated by a third party grading company (including,but not limited to PCGS, NGC, ANACS, ICG, PMG, WBG).

5 AFTER THE AUCTION5.1 Buyer’s Premium and other charges

In addition to the Hammer Price, you must pay us the Buyer’sPremium at a rate of 20% of the final Hammer price of each lot, a feeof 3% on the hammer price total for using the-saleroom.com and a feefor paying by credit card.

5.2 Value Added TaxOther than in respect of Zero-rated Lots (o) VAT is chargeable on theHammer price and the Buyer’s premium of daggered (†) and (Ω) lotsat the standard rate (currently 20%), and on lots marked (x) at thereduced rate (currently 5% on the Hammer price and 20% on theBuyer’s premium). VAT on Margin scheme lots (identified by theabsence of any VAT symbol next to the lot number) is payable at 20%on the Buyer’s premium only.

5.3 VAT RefundsGeneral5.3.1 As we remain liable to account for VAT on all Lots unless they

have been exported outside the EU within 3 months of the date ofsale, you will generally be asked to deposit all amounts of VATinvoiced. However, if a Spink nominated shipper is instructed, thenany refundable VAT will not be collected. In all other cases creditswill be made when proof of export is provided. If you export theLot yourself you must obtain shipping documents from theShipping Department for which a charge of £50 will be made.

5.3.2 If you export the Lot you must return the valid proof of exportcertificate to us within 3 months of the date of sale. If you fail toreturn the proof of export certificate to us within such period andyou have not already accounted to us for the VAT, you will beliable to us for the full amount of the VAT due on such Lot and weshall be entitled to invoice you for this sum.

5.3.3 To apply for a refund of any VAT paid, the proof of exportcertificate must be sent to our Shipping Department clearly marked‘VAT Refund’ within 3 months of the date of sale. No payment willbe made where the total amount of VAT refundable is less than £50and Spink will charge £50 for each refund processed.

VAT Refunds - Buyers from within the EU5.3.4 VAT refunds are available on the Hammer Price and Buyer’s

Premium of Daggered (†) and Investment Gold (g) Lots. You mustcertify that you are registered for VAT in another EU country andthat the Lot is to be removed from the United Kingdom within 3months of the date of sale.

5.3.5 Where an EU buyer purchases a Lot on which import VAT hasbeen charged, no refund of VAT is available from us. It may bepossible to apply directly for a refund on form VAT 65 toHM Revenue & Customs Overeseas Repayment Section,Londonderry.

VAT Refunds – Buyers from outside the EU5.3.6 Where a Lot is included within the Auctioneers’ Margin Scheme

and evidence of export from the EU is produced within 3 monthsof the date of sale, the VAT on Buyer’s Premium may be refunded.

5.3.7 Where the Lot is marked as a Daggered (†) or Investment Gold(g) Lot the VAT charged on the Hammer Price may be refundedwhere evidence of export from the EU is produced within 3months of the date of sale. A refund of VAT charged on the Buyer’sPremium can also be made on receipt of proof of business as acollectibles dealer.

5.3.8 Where the Lot is marked as an Omega (Ω) Lot or an ImportVAT (x) Lot and evidence of export from the EU is producedwithin 3 months of the date of sale, the VAT charged on both theHammer Price and Buyer’s Premium may be refunded. Whererequired, we can advise you on how to export such Lots as a specificform of export evidence is required. Where we advise you on theexport of the Lots, please be aware that the ultimate responsibilityin respect of obtaining a valid proof of export certificate will lie withyou and we will not be responsible for your failure to obtain suchcertificate.

5.4 Payment5.4.1 You must provide us with your full name and permanent address

and, if so requested, details of the bank from which any paymentsto us will be made. You must pay the full amount due (comprisingthe Hammer Price, the Buyer’s Premium and any applicable VAT)within seven days after the date of the sale. This applies even if youwish to export the Lot and an export licence is (or may be)required.

5.4.2 You will not acquire title to the Lot until all amounts due have been paid in full. This includes instances where specialarrangements were made for release of Lot prior to full settlement.

5.4.3 Payment should be made in sterling by one of the followingmethods:II(i) Direct bank transfer to our account details of which are set

out on the invoice. All bank charges shall be met by you.Please ensure that your client number is noted on thetransfer.

i(ii) By cheque or bank draft made payable to Spink and Son Ltdand sent to Spink at 69 Southampton Row, Bloomsbury,London WC1B 4ET. Please note that the processing chargesfor payments made by cheques or bank drafts drawn on anon-U.K bank shall be met by you. Please ensure that theremittance slip printed at the bottom of the invoice isenclosed with your payment.

(iii) By Visa or Mastercard. A fee of 2% will be applied. Paymentsmade by American Express are subject to a 4% fee. Paymentsexceeding £5,000 can normally only be made by the cardholder in person whilst on our premises.

5.4.4 Payments should be made by the registered buyer and not bythird parties, unless it has been agreed at the time of registrationthat you are acting as an agent on behalf of a third party.

5.5 InvoicesInvoices may consist of one or more pages and will show: Zero ratedLots (o); no symbol Lots sold under the Auctioneers’ Margin Scheme;Lots marked (g) special scheme Investment Gold; Daggered Lots (†),imported Lots marked (x) and (Ω), (e) Lots with Zero rated hammerfor EU VAT registered buyers.

5.6 Collection of Purchases5.6.1 Unless specifically agreed to the contrary, we shall retain lots

purchased until all amounts due to us, or to the Spink Group, havebeen paid in full. Buyers will be required to pay for their lots whenthey wish to take possession of the same, which must be within 7days of the date of the sale, unless prior arrangements have beenmade with Spink. Without prior agreement, lots will not be releaseduntil cleared funds are received with regard to payments made bycheque.

5.6.2 Unless we notify you to the contrary, items retained by us willbe covered in accordance with our policy which is available forinspection at our offices from the date of sale for a period of sevendays or until the time of collection, whichever is sooner. After sevendays or from the time of collection, whichever is the earlier, the Lotwill be entirely at your risk.

5.6.3 Our policy will not cover and we are unable to acceptresponsibility for damage caused by woodworm, changes inatmospheric conditions or acts of terrorism.

5.7 NotificationWe are not able to notify successful bidders by telephone. WhileInvoices are sent out by mail after the auction we do not acceptresponsibility for notifying you of the result of your bid. You arerequested to contact us by telephone or in person as soon as possibleafter the auction to obtain details of the outcome of your bids to avoidincurring charges for late payment.

5.8 Packing and handling5.8.1 We shall use all reasonable endeavours to take care when

handling and packing a purchased Lot but remind you that afterseven days or from the time of collection, whichever is sooner, theLot is entirely at your risk. Our postage charges are set out at theback of the catalogue.

5.8.2 It is the responsibility of the Buyer to be aware of any ImportDuties that may be incurred upon importation to the finaldestination. Spink will not accept return of any package in order toavoid these duties. The onus is also on the Buyer to be aware of anyCustoms import restrictions that prohibit the importation ofcertain collectibles. Spink will not accept return of the Lot(s) underthese circumstances. Spink will not accept responsibility for Lot(s)seized or destroyed by Customs.

5.8.3 If the Buyer requires delivery of the Lot to an address other thanthe invoice address this will be carried out at the discretion ofSpink.

5.9 Recommended packers and shippersIf required our shipping department may arrange shipment as youragent. Although we may suggest carriers if specifically requested, oursuggestions are made on the basis of our general experience of suchparties in the past and we are not responsible to any person to whomwe have made a recommendation for the acts or omissions of the thirdparties concerned.

5.10 Remedies for non-payment or failure to collect purchases5.10.1 If you fail to make payment within seven days of your stipulated

payment date set out in your invoice, we shall be entitled to exerciseone or more of the following rights or remedies:5.10.1.1 to charge interest at the rate of 2% per month compound

interest, calculated on a daily basis, from the date the fullamount is due;

5.10.1.2 to set off against any amounts which the Spink Group mayowe you in any other transaction the outstanding amountremaining unpaid by you;

5.10.1.3 we may keep hold of all or some of your Lots or otherproperty in the possession of the Spink Group until you havepaid all the amounts you owe us or the Spink Group, even if theunpaid amounts do not relate to those Lots or other property.Following fourteen days’ notice to you of the amountoutstanding and remaining unpaid, the Spink Group shall havethe right to arrange the sale of such Lots or other property. Weshall apply the proceeds in discharge of the amount outstandingto us or the Spink Group, and pay any balance to you;

5.10.1.4 where several amounts are owed by you to the SpinkGroup in respect of different transactions, to apply any amountpaid to discharge any amount owed in respect of any particulartransaction, whether or not you so direct;

5.10.1.5 to reject at any future auction any bids made by you or onyour behalf or obtain a deposit from you before accepting anybids.

5.10.2 If you fail to make payment within thirty-five days, we shall inaddition be entitled:

5.10.2.1 to cancel the sale of the Lot or any other item sold to youat the same or any other auction;

5.10.2.2 to arrange a resale of the Lot, publicly or privately, and, ifthis results in a lower price being obtained, claim the balancefrom you together with all reasonable costs including a 20%seller’s commission, expenses, damages, legal fees, commissionsand premiums of whatever kind associated with both sales orotherwise, incurred in connection with your failure to makepayment;

5.10.2.3 when reselling the Lot, place a notice in our cataloguestating that you successfully purchased the Lot at auction buthave subsequently failed to pay the Hammer Price of the Lot; or

5.10.2.4 take any other appropriate action as we deem fit.5.10.3 If you fail to collect within fourteen days after the sale, whether

or not payment has been made, you will be required5.10.3.1 to pay a storage charge of £2 per item per day plus any

additional handling cost that may apply. 5.10.3.2 you will not be entitled to collect the Lot until all

outstanding charges are met, together with payment of all otheramounts due to us.

5.11 Uses of default informationIf you fail to make payment for a Lot in accordance with these Terms andConditions:5.11.1 We reserve the right to refuse you the right to make bids for any

future auction irrespective of whether previous defaults havebeen settled; and

5.11.2 You consent to us disclosing details of such default to otherauctioneers and live bidding platforms, which will include yourname, address, nature of the default and the date of the default.

Auctioneers or live bidding platforms who receive details of the defaultmay rely on such information when deciding whether to enter into atransaction with you in the future.

5.12 Export Licence5.12.1 If required we can, at our discretion, advise you on the detailed

provisions of the export licensing regulations. Where we advise youin relation to export licensing regulations the ultimate responsibilityin respect of any export will lie with you and we will not beresponsible for your failure to apply for any necessary licences.

5.12.2 If the Lot is going to be hand carried by you, you may berequired to produce a valid export licence to us or sign a waiverdocument stating that a licence will be applied for.

5.12.3 You should always check whether an export licence is requiredbefore exporting. Export licences are usually obtained within twoor three weeks but delays can occur.

5.12.4 Unless otherwise agreed by us in writing, the fact that you wishto apply for an export licence does not affect your obligation tomake payment within seven days nor our right to charge interest onlate payment.

5.12.5 If you request that we apply for an export licence on yourbehalf, we shall be entitled to recover from you our disbursementsand out of pocket expenses in relation to such application, togetherwith any relevant VAT.

5.12.6 We will not be obliged to rescind a sale nor to refund anyinterest or other expenses incurred by you where payment is madeby you despite the fact that an export licence is required.

5.13 Refund in the case of Forgery5.13.1 A sale will be cancelled, and the amount paid refunded to you

if a Lot (other than a miscellaneous item not described in thecatalogue) sold by us proves to have been a Forgery. We shall nothowever be obliged to refund any amounts if either (a) thecatalogue description or saleroom notice at the auction datecorresponded to the generally accepted opinion of scholars orexperts at that time, or fairly indicated that there was a conflict ofopinions, or (b) it can be demonstrated that the Lot is a Forgeryonly by means of either a scientific process not generally acceptedfor use until after publication of the catalogue or a process which atthe date of the auction was unreasonably expensive or impracticableor likely to have caused damage to the Lot. Furthermore, youshould note that this refund can be obtained only if the followingconditions are met:5.13.1.1 you must notify us in writing, within seven days of the

receipt of the Lot(s), that in your view the Lot concerned is aForgery;

5.13.1.2 you must then return the item to us within fourteen daysfrom receipt of the Lot(s), in the same condition as at theauction date; and

5.13.1.3 as soon as possible following return of the Lot, you mustproduce evidence satisfactory to us that the Lot is a Forgery andthat you are able to transfer good title to us, free from any thirdparty claims.

5.13.1.4 you must provide to us all evidence obtained by you thata Lot is a Forgery no later than 7 days after you receive suchevidence.

5.13.2 In no circumstances shall we be required to pay you any morethan the amount paid by you for the Lot concerned and you shallhave no claim for interest.

5.13.3 The benefit of this guarantee is not capable of beingtransferred, and is solely for the benefit of the person to whom theoriginal invoice was made out by us in respect of the Lot when soldand who, since the sale, has remained the owner of the Lot withoutdisposing of any interest in it to any third party.

5.13.4 We shall be entitled to rely on any scientific or other process toestablish that the Lot is not a Forgery, whether or not such processwas used or in use at the date of the auction.

6 LIABILITY Nothing in these Terms and Conditions limits or excludes our liability for:6.1 death or personal injury resulting from negligence; or 6.2 any damage or liability incurred by you as a result of our fraud or

fraudulent misrepresentation.

7 USE OF YOUR PERSONAL INFORMATION7.1 We will use the personal information you provide to us to:

7.1.1 process the bids you make on Lots (whether successful orotherwise) and other auction related services we provide;

7.1.2 process your payment relating to a successful purchase of a Lot;7.1.3 arrange for delivery of any Lot you purchase, which will include

passing your details to shipping providers and, on overseasdeliveries, to customs where they make enquiries regarding the Lot;

7.1.4 inform you about similar products or services that we provide,but you may stop receiving these at any time by contacting us.

7.2 In accordance with clause 4.2, you agree that we may pass yourinformation to credit reference agencies and that they may keep a recordof any search that they do.

7.3 In accordance with clause 5.11, you agree that where you default onmaking payment for a Lot in accordance with these terms and conditionswe may disclose details of such default to other auctioneers and livebidding platforms.

7.4 We are also working closely with third parties (including, for example,other auctioneers and live bidding platforms) and may receiveinformation about you from them.

8 COPYRIGHT 8.1 We shall have the right (on a non-exclusive basis) to photograph, video

or otherwise produce an image of the Lot. All rights in such an imagewill belong to us, and we shall have the right to use it in whatever waywe see fit.

8.2 The copyright in all images, illustrations and written material relatingto a Lot is and shall remain at all times our property and we shall havethe right to use it in whatever way we see fit. You shall not use or allowanyone else to use such images, illustrations or written material withoutour prior written consent.

9 VATYou shall give us all relevant information about your VAT status and that ofthe Lot to ensure that the correct information is printed in the catalogues.Once printed, the information cannot be changed. If we incur any unforeseencost or expense as a result of the information being incorrect, you willreimburse to us on demand the full amount incurred.

10 NOTICESAll notices given under these Terms and Conditions may be served personally,sent by 1st class post, or faxed to the address given to the sender by the otherparty. Any notice sent by post will be deemed to have been received on thesecond working day after posting or, if the addressee is overseas, on the fifthworking day after posting. Any notice sent by fax or served personally will bedeemed to be delivered on the first working day following despatch.

11 ADDITIONAL PROVISIONSThe following provisions of this clause 10 shall apply only if you are acting forthe purposes of your business. 11.1 Limitation of Liability

Subject to clause 6, we shall not be liable, whether in tort (includingfor negligence) or breach of statutory duty, contract, misrepresentationor otherwise for any:11.1.1 loss of profits, loss of business, depletion of goodwill and/or

similar losses, loss of anticipated savings, loss of goods, loss ofcontract, loss of use, loss of corruption of data or information; or

11.1.2 any special, indirect, consequential or pure economic loss,costs, damages, charges or expenses.

11.2 SeverabilityIf any part of these Terms and Condition is found by any court to beinvalid, illegal or unenforceable, that part may be discounted and therest of the conditions shall continue to be valid and enforceable to thefullest extent permitted by law.

11.3 Force majeureWe shall have no liability to you if we are prevented from, or delayedin performing, our obligations under these Terms and Conditions orfrom carrying on our business by acts, events, omissions or accidentsbeyond our reasonable control, including (without limitation) strikes,lock-outs or other industrial disputes (whether involving our workforceor the workforce of any other party), failure of a utility service ortransport network, act of God, war, riot, civil commotion, maliciousdamage, compliance with any law or governmental order, rule,regulation or direction, accident, breakdown of plant or machinery,fire, flood, storm or default of suppliers or subcontractors.

11.4 Waiver11.4.1 A waiver of any right under these Terms and Conditions is only

effective if it is in writing and it applies only to the circumstancesfor which it is given. No failure or delay by a party in exercising anyright or remedy under these Terms and Conditions or by law shallconstitute a waiver of that (or any other) right or remedy, norpreclude or restrict its further exercise. No single or partial exerciseof such right or remedy shall preclude or restrict the further exerciseof that (or any other) right or remedy.

11.4.2 Unless specifically provided otherwise, rights arising underthese Terms and Conditions are cumulative and do not excluderights provided by law.

11.5 Law and Jurisdiction11.5.1 These Terms and Conditions and any dispute or claim arising

out of or in connection with them or their subject matter, shall begoverned by, and construed in accordance with, the law of Englandand Wales.

11.5.2 The parties irrevocably agree that the courts of England andWales shall have exclusive jurisdiction to settle any dispute orclaim that arises out of, or in connection with, Terms andConditions or their subject matter.

Shipments of more than 2kg or volumetric measurement of more than 2kg have tobe sent by courier. Certain countries may incur extra charge when courier servicesare required by our insurance policy. Value Added Tax (VAT)

Charging of (VAT) at AuctionThe information shown on this page sets out the way in which Spink intends toaccount for VAT.

i. Auctioneers’ Margin Scheme1. Where possible, we will offer Lots for sale under the Auctioneers’

Margin Scheme. Such Lots can be identified by the absence of anyVAT symbol next to the Lot number in the catalogue and will not besubject to VAT on the Hammer Price.

2. Where Lots are sold using the Auctioneers’ Margin Scheme to UKVAT–registered businesses, the VAT on Buyers’ Premium is notrecoverable as input tax. Upon request on sale day, we will issueinvoices that show VAT separately on both the Hammer Price andthe Buyer’s Premium. This will enable VAT-registered businesses torecover the VAT charged as input tax, subject to the normal rules forrecovering input tax.

ii. Zero-Rated LotsLimited Categories of goods, such as books, are Zero-rated (o) for VAT inthe United Kingdom. Such Lots are offered under the Auctioneers’ MarginScheme. In these circumstances no VAT will be added to the Buyer’spremium.

iii. Daggered LotsLots which are Daggered (†) in the catalogue are subject to VAT at 20%on both the Hammer Price and the Buyer’s Premium.

iv. Imported and Omega LotsLots which are marked (x) in the catalogue are subject to VAT at 5% onthe Hammer price plus 20% on the Buyer’s premium. Lots which bear theOmega symbol (Ω) are subject to VAT at 20% on the Hammer Price andon the Buyer’s Premium. This VAT is payable on items imported fromoutside the EU. In these cases we have used a temporary importationprocedure, which in effect means that the point of importation is deferreduntil the Lot has been sold. At this point the Buyer is treated as theimporter and is liable to pay the import VAT due. We will collect the VATfrom you and pay it to HM Customs and Excise on your behalf.

v. Investment Gold LotsLots marked (g) in the catalogue are exempt from VAT on the HammerPrice and are subject to VAT at 20% on the Buyer’s Premium. A refund ofVAT charged on the Buyer’s Premium can also be made on receipt of proofof business as a collectibles dealer outside of the EU.
