DAY 1 ADELAIDE

Departing Adelaide, what lies ahead is rugged, beautiful and spectacular — through the Red Centre to the tropical north of Australia. Before long some of the oldest rock formations in the world, the Flinders Ranges, come into view. As darkness envelops the rugged outback, it’s time to indulge in a multi-course regionally-inspired dinner and fine wines.

DAY 2 ALICE SPRINGS

Begin with a freshly brewed coffee or juice as you take in the stunning sunrise in outback South Australia. All aboard for brunch as you make your way through the MacDonnell Ranges to Alice Springs where a choice of Off Train Excursions awaits. Alice is an iconic Red Centre outpost – home to doctors who fly, rivers that run dry and a cast of colourful characters.

DAY 3 KATHERINE AND DARWIN

Your final day dawns in the tropical north. In Katherine, cruise the Nitmiluk Gorge, learn more about Indigenous rock paintings and culture, or learn a few working dog tricks on your selected Off Train Excursion. As evening falls, arrive in Darwin to complete your epic Australian journey.

From Darwin, take in the Top End views before stopping in Katherine for an afternoon of touring.

DAY 2 ALICE SPRINGS AND MANGURI

In the morning, you are greeted with breakfast and views of the dramatic and ancient Flinders Ranges, before passing through the mid north of South Australia for a late-morning arrival in Adelaide.

DAY 1 ADELAIDE

From Adelaide, travel through the pastoral fields of South Australia’s mid north. Indulge in a pre-dinner drink or two and some lively discussion with fellow diners as you anticipate tomorrow’s breathtakingly beautiful outback experience.

DAY 2 MARLA AND ALICE SPRINGS

Alight the train to watch the sun come up over the desert. You have never truly experienced a sunrise until you have seen one in the heart of the Australian outback. As you look to the horizon and its dramatic, beautiful colours, you realise the earth beneath you — vivid red — is equally awe-inspiring. Brunch is served on the train and soon you are crossing the state border and into the Northern Territory. Then glide through the MacDonnell Ranges and arrive at Alice Springs (or The Alice, as it is known by the locals) in the afternoon.

DAY 2 LITCHFIELD NATIONAL PARK

Litchfield National Park contains several types of typical Top End habitats including lush monsoon forests, termite mounds, unusual rock formations, waterfalls and cascades. First stop of the day is Florence Falls, where you have the opportunity for a scenic and interpretive bush and monsoon vine forest walk. There is also a chance for a swim by making your way down the stairs to the plunge pool below. Travel on to Tolmer Falls for a magnificent view of the water cascading down to the deep waterhole. To finish the day, you will visit Wangi Falls, with its large crystal clear pool, another relaxing spot for a swim. A great day for taking many fascinating photos, including the amazing stand of termite mounds. (B,L)

DAY 3 LEISURE DAY

Today is yours to explore Darwin at your own pace. Take in a spot of souvenir shopping or simply relax at your accommodation. (B)

DAY 4 JUMPING CROCODILES

This morning is free for you to explore Darwin at your leisure. Perhaps make your way down to the waterfront and enjoy the tropical Darwin weather. Much of Darwin’s action happens along its revitalised waterfront, which is lined with restaurants, shops, sandy lagoons and parklands.

This afternoon, your jumping croc adventure begins. ust 60 kilometres from Darwin lies the Adelaide River, home to more than 1,600 crocodiles and the location of the famous Jumping Crocodiles. Travel down the Stuart Highway to the Adelaide River. Cruise the river and thrill as these awesome creatures launch themselves out of the water. The cruise will enable you to see these prehistoric creatures at close range. Afterwards, continue to the Window on the Wetlands Visitor Centre for views over the Marrakai Plains, and then it’s onto Fogg Dam Nature Reserve to see a wetland ecosystem up close. (B)

1. GENERAL

These terms & conditions are a summary of our main terms & conditions which are fully outlined on the Journey Beyond Rail Expeditions (JBRE) website. To view our full terms & conditions visit: journeybeyondrail.com.au

Prices in this brochure are valid as of July 15, 2019, for travel 01 April 2020 to 31 March 2021. All train travel, trip/holiday package, accommodation, day tour or overnight tour prices are quoted in Australian dollars inclusive of GST. Fares, packages and prices in this brochure are subject to change without notice prior to booking. If a guest has booked a rail journey that includes flights, hotel accommodation, car hire or touring, these components will not be booked until a booking deposit is received.

2. BOOKINGS AND PAYMENT TERMS & CONDITIONS

DEPOSITS

For Gold Everyday and Everyday Saver fares the booking deposit will be $500.00 per person rail journey.

For Advance Purchase rail only fares payment in full is required.

For Advance Purchase Holiday Package fares the booking deposit will be $1000.00 per person per rail journey.

For Platinum Everyday fares the booking deposit will be $1000.00 per person per rail journey.

All amounts payable per fare type must be received by JBRE within 14 days of the booking being made.

(A rail journey is defined as: The Ghan, Adelaide to Alice Springs or vice versa (vv), Alice Springs to Darwin or vv, or Adelaide to Darwin vv; on the Indian Pacific, Sydney to Adelaide or vv, Adelaide to Perth or vv, or Sydney to Perth or vv; on the Great Southern, Adelaide to Brisbane or vv.

Special Offer Fares are instant purchase fares and immediate payment at the time of booking is required. These special offers may also have different terms and conditions relating to when payment is due, cancellation of bookings and whether or not amendments can be made to the booking.

PAYMENT DUE

The full balance of payment will be due at 45 days prior to the date of travel. (Unless booking conditions state otherwise, such as special offers, third party supplier conditions.) For bookings made at 45 days or less prior to travel, full payment is required at the time of booking. If payment is not received, the booking will be cancelled.

For Advance Purchase Holiday Packages full payment is required six months prior to the travel date.

SINGLE SUPPLEMENT

A single supplement will be applied when a guest occupies a twin or double cabin on their own. Single Supplement on Holiday Packages will be applied and advised at the time of booking.

BOOKING CONFIRMATIONS

Components of Holiday Packages may not be confirmed immediately at the time of booking and may be placed on request through a third party supplier. Cancellation and amendment fees will not apply if that booking cannot be confirmed. An ‘on request’ booking will not be accepted until confirmed by the third party supplier.

LATE BOOKINGS

Holiday package bookings cannot be made less than 4 days prior to the date of travel.

3. CONFIRMED BOOKINGS FOR TRAVEL

The guest will only be permitted to travel on a JBRE Train if the guest has a specified reservation in a specified class of service, on a specified date and journey, and has fully paid the fare in line with the fare terms and conditions. This is known as a confirmed booking for travel, which may also be known as a ‘Travel Right’.

HOLIDAY PACKAGES

JBRE does not own, operate or control third party suppliers of services that are not included in their rail fares or purchased in addition to rail travel (for example airlines, hotels/accommodation, sightseeing, tour operators, transportation companies, cruise and restaurants or hire car operators). Bookings including third party suppliers may incur additional conditions such as payment and cancellations terms that fall outside the general terms of JBRE. Any additional terms will be outlined at the time of booking your JBRE Holiday Package.

4. AMENDMENTS

• Amendments of an Everyday or Everyday Saver guest booking cannot be made less than fourteen (14) days prior to the date of travel and may incur amendment fees from any third parties who are supplying components of the booking (for example hotels or tour providers).

• Advance Purchase amendments cannot be made less than fourteen (14) days prior to travel date and can only be made to travel dates if the change is greater than six (6) months prior to the new proposed departure date, subject to Advance Purchase fare type availability.

• Special Offer Fares amendments of a confirmed booking are not permitted.

• A request to reduce the number of guests travelling or the components of the holiday/rail package will incur a cancellation fee.

• A request to amend the booking to increase the number of guests travelling or the number of components of the holiday/rail package will not incur an amendment fee but will require the payment of the additional fare/s.

• Amendment of a confirmed Holiday Package booking (including rail and accommodation/touring together) will result in you incurring an amendment fee of $50 per person per travel journey, in addition to any costs charged by operators, and cannot be made less than fourteen (14) days prior to the date of travel.

• An amendment to a confirmed booking cannot extend the date of travel beyond twelve (12) months from the original travel date.

5. GUEST CANCELLATION

A cancellation arising from the actions of a guest, through no fault of JBRE, is considered a ‘Guest Cancellation’, and is covered in this section. A cancellation arising from the actions of JBRE or another entity other than the customer is considered a ‘Service Disruption’ and covered in Section 6.

6. REFUNDS & SUBSTITUTE SERVICES POLICY

If, during your travel, you decide not to complete all components of your booked journey, this will be treated as a Guest Cancellation and unused trip/holiday/package components are not refundable. Refunds made will be at the discretion of JBRE management and/or third party suppliers.

SERVICE CANCELLATION PRIOR TO DEPARTURE

If a rail service is cancelled by JBRE prior to the customer departing on the initial JBRE rail sector on their journey, for any reason, then, in addition to any remedies available under any Non-Excludable Terms, JBRE will provide the option to:

• rebook an alternate rail service of the same value, in lieu of any refund; or

• if the customer agrees at the time and in lieu of any refund, travel on an alternative non-rail holiday package of similar value, that gets them to their original end destination as originally scheduled, where available; or

• receive a full refund of the fare paid to JBRE.

SERVICE DISRUPTIONS

A Service Disruption is:

• a full or partial rail journey cancellation arising from the actions of JBRE or another entity, or from Force Majeure; or

• a major change in a booked rail journey which occurs due to the actions of JBRE or another entity, other than the guest.

SERVICE DISRUPTION DURING YOUR RAIL JOURNEY

When a rail service has a minor/major disruption or is cancelled after the guest has commenced their JBRE rail journey (the train has departed the station on the initial sector of their journey), JBRE will endeavour to provide continuity of service (by some other means of transport if required) to our guests’ end destination within 24 hours of your scheduled arrival, without refund.

In addition to any remedies available under any Non-Excludable Terms, JBRE will use its reasonable endeavours to provide the following options (without refund), where available:

a) Reroute the guest to the next stopover or destination on the guest’s Ticket by any form of transport, at no additional cost to the guest; or

b) Carry the guest on another scheduled train service on which space is available; or

c) Give the guest the option to travel on an alternative non-rail holiday package of similar value that gets them to their original end destination as originally scheduled; or

d) Give the guest the option to cease their journey and provide a pro rata refund of the distance not travelled.

REFUND PAYMENT

Subject to any Non-Excludable Terms, when a refund is to be provided by JBRE, this will be:

a) If no part of the booking has been used – an amount equal to the amount paid to JBRE; or

b) If part of the booking has been travelled, the difference between the booking amount and the components used. The refund will be paid to the person who paid for the booking or to the lead person named on the booking. If a booking was made through a Travel Agent, any refund will be returned to that Travel Agent for their payment to the guest.

OFF TRAIN EXCURSIONS (OTEs)

Minimum numbers may apply to some OTEs. The content of OTEs is subject to change without notice. All arrangements are subject to cancellation or modification due to inclement weather, late running of train or other unforeseen circumstances.

Refunds will not be given for cancelled or modified excursions.

7. TRAVEL INSURANCE

It is highly recommended that travel insurance is taken out when travelling on JBRE’s Train journeys. Your journey travels through remote parts of Australia, this sometimes means that unexpected events can occur that are outside the control of JBRE, for example severe weather events, flash flooding, bushfires, remote location medical evacuations. These events can interrupt the journey being undertaken.

8. FITNESS FOR TRAVEL

JBRE seeks to ensure that its guests are able to experience unique areas of Australia. This means JBRE travels to areas that may not have the infrastructure support that may generally be found in urban areas. This can mean that guests with medical conditions, fitness and/or mobility issues are unable to experience some aspects of our journeys and, in some instances, may not be able to journey at all.

OBLIGATION TO INFORM

You must ensure that you are medically and physically fit for travel, and that such travel will not endanger yourself or anyone else. At the time of booking (or as soon as possible after booking), please advise JBRE if you have any medical or physical condition that will or may require medical attention, medication or special treatment during your rail holiday. JBRE may also ask you to complete a health questionnaire. If a guest has a condition that JBRE decides may significantly affect the enjoyment, health or safety of themselves or any other person on board, JBRE can refuse or cancel a booking.

NO SMOKING POLICY

All JBRE Trains are entirely smoke free in accordance with relevant state government regulations. This includes the use of e-cigarettes.

9. WARRANTIES, EXCLUSIONS AND LIMITATION OF LIABILITY

Except as expressly set out in this document, and to the extent permissible by law (but without limiting the operation of any non-excludable laws or regulations), JBRE will not be liable for any death or personal injury, loss of or damage to luggage or goods, incidental damages, consequential losses, loss of profit or any like claims whatsoever arising from any use of, or incidental to, the Services or arising out of JBRE’s negligence in any way, whatsoever, including delay, or any inaccuracy with respect to information relating to transport, Services or pricing.

To the extent that the Services, or any component part of the Services, are supplied to the guest by a third party, any warranty offered by JBRE in relation to the Services or component part of the Services will be limited to JBRE’s right of redress (if any) against the third party supplier arising out of any alleged fault/defect in the Services, subject only to any Non-Excludable Terms.

10. TICKETS

CABIN ALLOCATION

JBRE will allocate cabins prior to your scheduled departure date. JBRE will do its best to accommodate requests, but unfortunately JBRE cannot guarantee it will be able to accommodate all requests made.

CHECK-IN

JBRE check-in opens 2.5 hours prior to departure and closes 60 minutes prior to departure. The guest must not board a JBRE Train without first checking-in with the JBRE representative/employee at the applicable place of boarding. Photo identification must be shown to the JBRE Team Member or authorised agent who is completing the guest’s check-in prior to boarding.

NO GUARANTEE

Subject only to any Non-Excludable Terms, JBRE does not guarantee any particular cabin to any guest. Should JBRE be unable to accommodate a guest in the service level purchased, this will be considered a Major Service Disruption and dealt with in accordance with Clause 6.

If a guest chooses to cancel due to not receiving their preferred cabin allocation, this will be treated as a Guest Cancellation and dealt with in accordance with Clause 5.

LOST, STOLEN OR DAMAGED TICKETS

a) JBRE tickets are called ‘Travel Documents’.

b) In the event that a guest loses their Travel Documents, replacement documents will be issued upon the appropriate identification of the person requesting the document.

11. LUGGAGE

CABIN LUGGAGE

JBRE recommends you take the following luggage on board:

– one piece of hand luggage plus a garment bag and/or briefcase per person.

CHECKED LUGGAGE

Platinum Service (per person) 3 x 30 kg

Gold Service (per person) 2 x 30 kg

Luggage check-in opens 2.5 hours prior to departure and closes 60 minutes prior to departure. Checked luggage cannot be accessed during the journey. Your luggage must not contain any items which in our opinion are dangerous, illegal, liable to harm or annoy other guests, or otherwise unsuitable. Animals and livestock will not be carried, except guide dogs.

SEARCHES

If JBRE has reasonable cause to believe that the guest is carrying a prohibited item either in their luggage or on their person, JBRE, government and authorised officers may, subject to applicable laws, search or inspect the guest’s luggage and/or require the guest to submit to clothing and/or body searches.

12. TIMETABLES AND SCHEDULES

DEPARTURE AND ARRIVAL TIMES

JBRE does not guarantee departure or arrival times or the operation of any service, although JBRE will endeavour to run all services as scheduled on time. JBRE does not own any of the tracks our journeys run on, and as such are subject to their operational delays from time to time.

NO LIABILITY FOR OTHER CARRIERS

Subject only to any Non-Excludable Terms, JBRE is not liable for any loss or damage suffered in relation to a guest missing a connecting journey on another carrier, as a result of any cancelled or delayed JBRE journey.

RECOMMENDED CONNECTION TIME

From time to time, JBRE’s rail services may be disrupted or cancelled due to operational issues outside JBRE’s control. It is recommended that guests allow at least a four hour buffer (and preferably longer) between the scheduled departure and arrival times of their booked rail journey and other onward travel plans. If the next component (or previous component) of a guest’s journey is an international flight or a cruise, overnight accommodation is recommended.

13. MISCELLANEOUS

WAIVER

A provision of the Booking and Travel Conditions may not be waived except in writing signed by JBRE.

NO VARIATION

No employee of JBRE or other person is authorised to vary the Booking and Travel Conditions.

Booking a rail adventure should be a time of excitement and anticipation. We can appreciate however, that in this current climate, clients may be wary of committing to their next holiday. That’s why we’re launching part of our 2021 season with booking conditions that offer your clients peace of mind and flexibility.

PRICING

We are pleased to announce that all prices will hold as per the 20/21 travel season for The Ghan, The Ghan Expedition and Indian Pacific. This includes our Rail Journeys and Signature Holiday Packages.

INCREASED FLEXIBILIT Y

All guests booking into the newly launched travel season will receive increased peace of mind with no fees associated with date changes for their rail journey as outlined below. Date changes for Holiday Packages and third party components will incur a $50 fee plus any fare difference. Supplier conditions may vary and will be passed on as applicable.

Advance Purchase Fares date changes must be made up to 45 days before departure (and are now at no extra cost)*

Everyday Fares date changes must be made 14 days before departure at no extra cost.*

*No amendment fees will apply however, guests will be subject to pay any fare differences which may apply.

PAYMENT DEADLINES

Advance Purchase and Advance Purchase Holiday Fares will no longer require 100% of the booking to be paid within 14 days. 50% is now required within 14 days of booking with the remaining 50% due 30th November 2020.

Everyday and Everyday Holiday fares no longer require a $500 or $1000 deposit. Instead, a 10% deposit must be paid within 14 days of making the booking with the balance due no later than 45 days prior to departure.

CANCELLATION FEES

Cancellations within 14 days of booking remain fully refundable

Everyday Fares cancelled more than 45 days prior to departure will forfeit the deposit value.

Advance Purchase Fares cancelled prior to 30th November will incur 50% cancellation fees (loss of deposit). After 30th November 100% cancellation fees apply.

I N T E R I M T E R M S A N D C O N D I T I O N S

2 0 2 1 P R E - S E A S O N P A R T I A L R E L E A S E

1. BOOKING

CONFIRMED BOOKING

Your booking of a Rail Journey or Holiday Package is confirmed when:

(1) you have made the booking and have provided Journey Beyond Rail Expeditions (JBRE)with all necessary information to complete the booking; and

(2) you have paid us the Deposit (or other amounts owing at the time of booking), accordingto the terms of this agreement; and

(3) we have sent you a Booking Confirmation.

FEE

The Fee for your Rail Journey or Holiday Package is the amount stated in your Booking Confirmation. You may also be required to pay other amounts in accordance with the terms of this agreement.

INCLUSIONS

Your Booking Confirmation sets out the details of all goods and services that are included in your Rail Journey or Holiday Package, and the class of travel of your booking.

2. PAYMENT

‘EVERYDAY FARES’

For Everyday Rail Journeys and Everyday Holiday Packages, you must pay the Fee in two parts:

(1) Deposit - this payment is per booking, non-refundable and payable within 14 days afterbooking; and

(2) Balance - the difference between the deposit and the total fee. For Everyday Rail Journeysand Everyday Holiday Packages the balance must be paid, in all cases no later than 45 days prior to the date of travel.

Failure to make any of the payments associated with the above fares by the time outlined in this agreement will result in the cancellation of the booking

‘ADVANCE PURCHASE’ FARES

Advance Purchase fares are not available within 6 months of travel date and are not available on every departure. For Advance Purchase Rail Journeys and Advance Purchase Holiday Packages, the deposit must be paid within 14 days after booking with the balance due 30th November 2020

(1) Deposit - this payment is per booking, non-refundable and payable within 14 days afterbooking; and

(2) Balance - the difference between the deposit and the total fee. For Advance Purchase RailJourneys and Advance Purchase Holidays Packages must be paid in all cases no later than 30th November 2020.

(3) Failure to make any of the payments associated with the above fares by the time outlinedin this agreement will result in the cancellation of the booking

‘SPECIAL OFFER’ FARES

For Special Offers, the Fee is paid in full at the time of booking unless stated otherwise in the Special Conditions. Special Offers may have other terms and conditions included in the Booking Confirmation.

Failure to make any of the payments associated with the above fares by the time outlined in this agreement will result in the cancellation of the booking

3. BEFORE YOU CAN TRAVEL

CABIN ALLOCATION

Prior to your scheduled departure date, JBRE will allocate cabins to you according to the service of your booking. JBRE will also do its best to accommodate any request you might have for a particular cabin but does not guarantee it.

If JBRE is unable to accommodate you in the service of your booking, you will receive the options set out in the clause ‘JBRE cancellation’. If JBRE is unable to accommodate your request for a particular cabin allocation and you elect to cancel your booking, this will be considered a ‘Guest Cancellation’ and dealt with in accordance with the clause ‘Guest Cancellation’.

LUGGAGE

Guests must comply with the relevant luggage requirements set out on the Website and/or booking confirmation.

TRAVEL INSURANCE

Our rail journeys go through remote Australian regions, which sometimes results in severe weather events, flash flooding, bushfires and remote location medical evacuations. As a result, we highly recommended you purchase travel insurance to protect you in unforeseen circumstances

FIT TO TRAVEL

You must ensure that you are medically and physically fit for travel. Before you confirm your booking, you must advise JBRE of any medical or physical condition that will or may require medical attention, medication or special treatment during your rail journey. JBRE may also ask you to complete a health questionnaire. If a guest has a condition that JBRE decides may significantly affect the enjoyment, health or safety of themselves or any other person on board, JBRE can refuse or cancel a booking.

4. ON THE DAY OF TRAVEL

CHECK IN

You must check in with a JBRE representative at the location stated on your Travel Documents no more than 2.5 hours and no later than 1 hour prior to scheduled departure. You must show suitable photo identification to the JBRE representative when checking in.

DANGEROUS GOODS

Your luggage must not contain any items which in our opinion are dangerous, illegal, liable to harm or annoy other guests, or otherwise unsuitable. Animals (except guide dogs) are not permitted on board. JBRE reserves the right to eject any Guest that fails to comply with this clause.

5. ON THE TRAIN

NO SMOKING POLICY

All JBRE trains are entirely smoke free in accordance with relevant state government regulations. Guests are not to smoke (including e-cigarettes) on the train.

SEARCHES

If JBRE has reasonable cause to believe that the guest is carrying a prohibited item, an authorised representative of JBRE may, subject to applicable laws, search or inspect the guest’s luggage.

OFF TRAIN EXCURSIONS (OTES)

We may cancel or modify OTEs due to inclement weather, train scheduling or other circumstances. There are no refunds for any such cancellations or modifications.

7. CANCELLATIONS

Your Rail Journey or Holiday Package could be cancelled under one of the following three circumstances:

(1) A cancellation arising from your actions, through no fault of JBRE – see ‘Guest Cancellations’in section 6.

(2) A cancellation by JBRE arising from external consequences that make our performance of the agreement impossible (for example a Force Majeure event, or the actions of a thirdparty e.g. new government regulation) – see ‘Force Majeure Cancellations’.

(3) Any other cancellation by JBRE – see ‘JBRE Cancellations’.

FORCE MAJEURE CANCELLATIONS

For all fare types, in the event of a Force Majeure Cancellation, JBRE will provide you with a credit note of an amount equal to the monies paid to JBRE under the booking. The credit note can be applied to the cost of a future Rail Journey or Holiday Package with us. Time limits and other criteria and conditions may apply.

JBRE CANCELLATIONS

For all fare types, in the event of a JBRE Cancellation, JBRE will provide you with the option to receive one of the following:

(1) (where available) travel on an alternative non-rail holiday package of similar value, thatgets you to the scheduled end destination;

(2) an alternate rail service of the same value at a later date;

(3) a full refund of monies paid to JBRE under the booking; or

(4) a credit note of an amount equal to the monies paid to JBRE under the booking.

REFUND PAYMENT

Any credit note or refund payable by JBRE under this agreement will be calculated to take into account the monies actually paid under the booking and the amount of the Rail Journey or Holiday Package that has been used.

Any refund will be payable to the person who paid for the booking or to the first person named on the booking. If a booking was made through a Travel Agent, any refund will be returned to that Travel Agent for their payment to the guest.

SERVICE DISRUPTION

A Service Disruption is a full or partial cancellation of your Rail Journey after your Rail Journey has commenced.

In the event of a Service Disruption, JBRE will, subject to its obligations under the Australian Consumer Law, use reasonable endeavours to re-route you to the next destination by any form of transport at JBRE’s cost. No refunds are payable for Service Disruptions.

8. OUR OPERATIONS

CONNECTIONS

We cannot guarantee our schedule and we are not liable for any costs deriving from the failure of a Guest to connect with other services. As a result, Guests should allow ample time for connections.

NO LIABILITY FOR OTHER CARRIERS

To the extent permitted by law, JBRE is not liable for any loss or damage suffered in relation to a guest missing a connecting journey on another carrier, as a result of any cancelled or delayed JBRE journey.

WARRANTIES, EXCLUSIONS AND LIMITATION OF LIABILITY

To the extent permissible by law (and without limiting the operation of any statutory guarantee under the AUSTRALIAN CONSUMER LAW), JBRE will not be liable for any death or personal injury, loss of or damage to luggage or goods, consequential losses, loss of profit or any similar claims arising from any use of the services or arising out of JBRE’s negligence, including delay, or any inaccuracy with respect to information relating to transport, services or pricing.

To the extent that part of the services are supplied to the guest by a third party, any warranty offered by JBRE in relation to those services will be limited to JBRE’s right of redress against the third party arising out of any alleged fault or defect in the services.

Whilst every effort is made to ensure details of holiday packages remain accurate, situations may arise outside of JBRE’s control where a third-party holiday component must be substituted or amended. JBRE will not be liable to refund guest payments as a result of amended itineraries, which are subject to change without notice.

Nothing in this agreement restricts, limits or modifies your rights or remedies as a consumer against JBRE for failure of a statutory guarantee under the AUSTRALIAN CONSUMER LAW.

9. MISCELLANEOUS

SURCHARGES

We are entitled to charge up to 1.55% surcharge depending on your payment method.

WAIVER AND AMENDMENT

A provision of this agreement may not be amended or waived except in writing signed by an authorised representative of JBRE.

ENFORCEABILITY

If a term of this agreement is unenforceable it shall be read down to be enforceable or, if it cannot be read down, the condition shall be severed from this agreement without affecting the enforceability of the remaining conditions.

THIRD PARTIES

In order to provide you with the goods and services that are included in your Rail Journey or Holiday Package, we may use third party providers. You agree that we may pass on to you any costs,fees or terms that they apply to us under our agreement with them.

10. DEFINITIONS

AUSTRALIAN CONSUMER LAW means the Australian Consumer Law as that term is defined in the Competition and Consumer Act 2010 (Cth).

Booking Confirmation means the notification from us to you containing the details of your booking.

Deposit means the amount of money payable for certain fares as set out in clause 2.

Dollars or $ means Australian Dollars.

Force Majeure event means an event or circumstance which is beyond our control and without our fault or negligence and which was not reasonably preventable, including:

(a) riot, war, invasion or acts of terrorism;

(b) requisition or compulsory acquisition by any governmental or competent authority, amaterial change in legislation or directions by a government authority;

(c) medical outbreak, or contamination of any kind;

(d) earthquakes, flood, fire or other physical natural disasters; and

(e) strikes or industrial disputes which affect an essential part of the service.

Holiday Package means any holiday package offered by us comprising a Rail Journey component and other components provided to you by third parties.

Guest means anyone travelling with us under your booking.

Rail Journey means any interstate one-way rail journey operated by us, including:

6. GUEST AMENDMENTS, PAYMENTS AND CANCELLATIONS

The tables below set out the consequences that the parties agree will apply in the event of a Guest Cancellation. A reduction in guests or name change will be treated as a guest cancellation. Subject to availability, you may amend your booking (the date of travel, the components of your package or the number of Guests) as follows:

Travel Documents means your ticket or other proof of your confirmed booking.

We/us means Experience Australia Group Pty Ltd ACN 614 713 003.

You means the person or entity that made the booking and is named in the Booking Confirmation.
