PART A - APPLICATION INFORMATION

1. OVERVIEW OF REQUIREMENT1.1 The overall objective is to seek Expressions of Interests (EOIs) from experienced

individuals/consultants or organisations to join a Multi-User List (MUL), for the provision of facilitation services for the Australia Council leadership programs.

1.2 The facilitation can either be for the lead facilitation for a specific program or co-facilitation for various program components.

2. INFORMATION FOR APPLICANTS2.1 This MUL process aims to provide the Australia Council with a pool of pre-qualified

suppliers who have satisfied the conditions for inclusion on the list and who can provide the Services outlined at Attachment A - Statement of Requirement.

2.2 Inclusion on this MUL does not guarantee a potential supplier that they will be included in any future tender processes. It only provides certainty that potential suppliers have been recognised as meeting the conditions for participation.

2.3 The MUL is intended to be used in more than one procurement.

2.4 Inclusion on the MUL may be used as a condition of participation in an open tender process, or as the basis for selecting suppliers to participate in a restricted tender process.

2.5 Once the MUL is established, we may seek submissions for specific scopes of work from members of the MUL. A more detailed description of the type of Services the Council anticipates it is likely to require is at Attachment A - Statement of Requirement.

2.6 In seeking submissions from members of the MUL we will aim to identify a supplier with whom we will then enter into a contract with for the provision of those specific Services.

2.7 We may, at our discretion, conduct either an open tender process or approach a select number of suppliers from the MUL where such an approach is commensurate with the value of the contract to be entered into. We may also exercise our discretion and approach just a single member of the MUL for a specific requirement where we consider this method is appropriate.

2.8 We may, at our discretion, conduct financial checks on any of the members of the MUL.

2.9 Applicants are required to read the MUL Rules (Attachment B) before completing and submitting their Application (Part B).

3. APPLICATIONS3.1 Applicants should respond to this MUL by completing Part B and providing a response

to each of the matters identified.

3.2 Applicants must indicate whether they are applying for the lead facilitation, the co-facilitation or both. Applicants must indicate which role they are applying for in Part B.

3.3 Applicants can apply directly for a specific leadership program or apply for general facilitation across any of the programs. Applicants must indicate which programs or option they are applying for in Part B.

3.4 The Australia Council may choose to create a shortlist of potential MUL facilitators and progress to interviewing or facilitation observation.

4. FACILITATION OBSERVATION4.1 The Australia Council may choose to verify your facilitation skills by observing your

facilitation approach.

4.2 The Australia Council may choose to only observe the facilitation of a short list of facilitators.

4.3 The Australia Council will work with the shortlisted MUL facilitators to find the most appropriate opportunity to monitor your facilitation.

5. SELECTION CRITERIA5.1 The facilitators will be pre-qualified using the following essential criteria:

Demonstrated cultural competence when engaging with Aboriginal and Torres Strait Islander people(s), people of culturally and linguistically diverse background and people with disability.

Professional facilitation and/or teaching experience with the ability to support a range of learning levels including senior arts leaders.

Knowledge and experience in designing and delivering leadership development programs.

Deep understanding of contemporary leadership practices within an arts and cultural context.

Expertise in a range of relevant topics such as innovation, strategy, new business models, governance, engagement and partnerships.

Strong arts management acumen with a good understanding of the opportunities and challenges faced by arts leaders today.

Value for money.

5.2 In addition to the above criteria, the lead facilitator for the First Nations Leadership Program (working title) must be an Aboriginal or Torres Strait Islander person/s.

ATTACHMENT A – STATEMENT OF REQUIREMENT

1. BACKGROUND TO THE REQUIREMENT

The Australia Council for the Arts has a strong history in providing professional development opportunities to Australian arts leaders and organisations. The Australia Council launched its first leadership program, the Emerging Leaders Development Program (ELDP), in 2010. The ELDP was developed to support the development of emerging leaders and in response to a lack of succession within large Australian arts and cultural institutions. The program ran for five successful years and supported over 130 leaders over that period.

In 2015, the Australia Council completed a detailed needs analysis by consulting with various arts leaders including alumni from existing programs. These arts leaders identified the need for a bespoke program to develop their leadership capabilities.

The Australia Council launched the current suite of leadership programs in 2016 with over 1,500 leaders having benefited from the activity under the program. The program aims to build capacity and enrich arts and cultural sector leaders through knowledge sharing and network building across the region and areas of specialisation.

The Australia Council is planning to acknowledge the 10-year anniversary of the program in 2020. The aim of this reflection year will be to activate the growing alumni, review the development needs of arts leaders and assess the longer-term impact of this program.

2. ABOUT THE LEADERSHIP PROGRAMS

The Australia Council leadership programs are dedicated to transforming our sector’s knowledge, skills and capabilities by supporting emerging and established leaders.

Our programs recognise the diverse nature of leadership and builds on the rich knowledge and experience already within our sector. We partner with respected facilitators to foster personal and professional development through sharing and connecting people across Australia and internationally.

Grounded in respect, generosity and listening, we tackle the big issues and opportunities faced by our sector. The program is designed to explore new ways of thinking and enact the potential of the arts for change. We are guided by a commitment to our First Nations people(s) as our cultural Elders and leaders.

Our participants share experiences, form new connections, develop skills and build confidence in their own capabilities. They benefit from longer-term outcomes for their practice, their organisation and their community.

We host a suite of programs to nurture creative development and ongoing sustainability within the arts. These programs are designed to address the needs of our diverse sector, from small

to large, emerging to established, from independent to organisations. We invite leaders from various backgrounds, careers levels and geographies to get involved.

The leadership programs include the core programs including the First Nations Leadership Program (working title), Arts Leaders Program, Future Leaders Program and the International Leadership Program (Indo-Pacific).

To learn more about the First Nations Leadership Program (working title) and the progress of its development please refer to Appendix A in this document.

3. PROCUREMENT OBJECTIVE

The Australia Council is seeking to appoint several facilitators for the core leadership programs. The facilitators will be pre-approved through this MUL procurement process and facilitators will be engaged on a program and needs basis.

Together with professional facilitation and/or training expertise, the facilitators will have strong arts management acumen and a deep understanding of contemporary leadership practices within an arts and cultural context.

The facilitators will be able to maximise the outcome for our participants because they are well connected within the arts and cultural sector, have a diversity of unique perspectives and will be able to link themes and emerging issues across the program. Please also refer to the Selection Criteria in Part A Section 5.

4. SERVICES REQUIRED

The leadership programs will be delivered by experienced facilitators consisting of at least three (3) lead facilitators and eight to ten (8–10) co-facilitators. These facilitators will work together as a group to enhance the outcomes across the various programs.

Lead facilitation services are required across the following programs:

Co-facilitation will be required across the above programs and will have a focus on:

Joining the MUL

Submissions to join the MUL can be for any of the above roles or can be for more than one. E.g. you can submit a proposal to join the MUL as either a lead facilitator or co-facilitator (or both). You can also submit a proposal to join the MUL for a specific program e.g. for the Arts Leaders Program or for any. Please note that only Aboriginal and Torres Strait Islander facilitators are eligible to apply for the lead facilitation role for the First Nations Leadership Program (working title).

Facilitation services required

Once appointed, MUL members will be invited to submit specific proposals based on the role and the selected program. The services may include the following:

Co-design, preparation and facilitation of residential leadership intensives (normally five days per session); these are typically delivered in regional locations across Australia and for the Arts Leaders Program, one session in Indonesia.

The Arts Leaders Program includes three residentials, the Future Leaders Program two residentials per year. The First Nations Leadership Program (working title) is yet to be confirmed with a potential for four sessions per year.

Online sessions, normally two in between each session. These normally last three hours.

Each session will require detailed planning and co-design with Australia Council staff and other co-facilitators or guests.

Curation, planning and briefing of guest speakers throughout the program.

Co-creation of learning experiences including cultural learning and artistic expression activity.

Individual and group leadership development focusing on individual development through capabilities, knowledge and skills transformation.

Co-facilitators will join lead facilitators across the core programs to deliver components of the program. Co-facilitators will focus on key topic areas and will support the lead facilitation.

Panel to provide advice and support across the program

We encourage the following facilitators to submit a proposal to join the MUL:

Emerging facilitators with working experience and interested in developing their skills in this area.

Facilitators based in Indonesia that have arts leadership development experience. Facilitators based in the Indo Pacific region that have arts leadership development

experience and are willing to travel to Australia to facilitate programs. First Nations facilitators with arts leadership development experience. Facilitators with experience working with senior arts leaders including coaching and

mentoring experience. Facilitators from culturally and linguistically diverse backgrounds, facilitators with

disability, facilitators living in regional and remote areas.

Advice panel

The Australia Council may choose to invite members of the MUL to join an advice panel to support the overall program design and development. This will be a separate invite and will not necessarily be extended to all MUL members. The advice panel will meet at least twice a year to review the leadership programs and provide high-level feedback on the development of various aspects of the programs. MUL members must be willing and available to potentially join this panel.

5. QUALITY AND STANDARDS

MUL members must maintain consistency and high quality in the provision of any services. For any particular scope of work, we may set a level of quality or standards which must be adhered to in performing those services. These quality levels of standards, where applicable, will be used as performance indicators in assessing the work provided by a member of the MUL.

6. TIMING

The leadership programs will be delivered over a three-year period and not all components will be included in each year. The MUL will be reviewed every three years.

Members of the MUL will be asked to provide specified personnel who can provide the services within timeframes set by the Australia Council. Members of the MUL may be asked to

provide services in urgent timeframes or over a planned program of work including milestones or phases.

It is expected that the lead facilitators will be appointed for a specific program for a three-year period and the co-facilitators will be contracted to do specific components of the program. This will be a separate procurement process and not included in the MUL appointment.

The dates for residentials are normally set a year in advance and the MUL members must be available for the dates already set for the next roll-out of the programs. They are:

7. LOCATION OF SERVICES

The programs will be delivered in both Australia and in international locations, such as Indonesia. Members of the MUL must be able to deliver in the multiple locations set by the Australia Council. Applicants can also be based outside of Australia.

8. GOVERNMENT LEGISLATION AND POLICIES AFFECTING THE SERVICES

Members of the MUL will be required to adhere to all relevant Australian Government legislation as outlined in Attachment B (Multi-Use List Rules). This legislation covers areas such as occupational health and safety, privacy, records and record keeping and confidentiality. Failure to adhere to all relevant Government legislation as outlined in Attachment B will prevent a potential supplier from gaining inclusion on the MUL.

ATTACHMENT B – MULTI-USE LIST RULES

1. INVITATION DOCUMENTS1.1 The invitation for inclusion on this MUL consists of the following documents:

Part A (Application Information).

Part B (Application Form).

Appendix A (Introduction to the First Nations Leadership Program (working title)).

2. APPLICATION LODGEMENT2.1 Applications must be lodged in accordance with the Statement of Requirement

(Attachment A) and must include:

A completed Part B.

Copies of any requested documentation.

2.2 The MUL remains open until we determine there is no longer a need for the services. At this time we will advise all members of the MUL that the list will be terminated.

3. PRIVACY LEGISLATION3.1 The MUL will require successful applicants to comply with the Australian Privacy

Principles contained in the Privacy Act 1988 (Cth), in relation to personal information if handled by the supplier.

4. MODERN SLAVERY ACT4.1 Applicants, if appointed to the MUL and asked to provide facilitation services, will be

required to comply with, and assist the Australia Council to ensure its supply chains do not breach, the Modern Slavery Act 2018.

5. DISCLOSURE OF INFORMATION5.1 Subject to clause 4.2 we will keep all applications submitted confidential.

5.2 Applicants should note that we may disclose any information contained in or regarding an application without your written authority to:

Parliamentary Committees.

Employees and advisers engaged by the Commonwealth.

Commonwealth departments, agencies, bodies, enterprises, authorities and Ministers, for the purposes of this application process.

Any legal, policy or other Australia Council accountability requirements.

6. FREEDOM OF INFORMATION6.1 Applicants should be aware that the Freedom of Information Act 1982 gives members

of the public certain rights of access to documents in the possession of the Commonwealth and its agencies. This Act extends as far as possible the right of the Australian community to access information (generally documents) in the possession of the Commonwealth, which may include the application, any subsequent contract and related documents.

7. COMPLIANCE WITH COMMONWEALTH POLICIES AND LEGISLATION7.1 The successful applicants must, when using our premises or facilities, comply with all

reasonable directions and procedures relating to occupational health (including its smoke free work place policy), safety and security in effect at those premises or in regard to those facilities, as notified by us, or as might reasonably be inferred from the use to which the premises or facilities are being put.

7.2 Applicants should be in compliance with their obligations under the Equal Opportunity for Women in the Workplace Act 1999 and not be proposing to enter into any subcontracting arrangements with a subcontractor named by the Equal Opportunity for Women in the Workplace Agency as an employer currently not complying with this Act. It is also Australian Government policy not to contract with parties engaging illegal workers.

8. AUSTRALIAN BUSINESS NUMBER (ABN)7.1 Your ABN must be stated in Part B.

9. APPLICABLE LAW9.1 The law applying in the State of New South Wales applies to the MUL, and the

application process. Each applicant must comply with all relevant laws in preparing and lodging its application and taking part in the MUL process.

10. OWNERSHIP OF APPLICATION10.1 All documents submitted in response to this MUL shall become our property. We may

use, reproduce, communicate or modify any application for the purposes of assessment, but will keep applications confidential (subject to Attachment B Clause 4).

11. FINANCIAL VIABILITY11.1 Applicants should provide financial data as specified in the MUL. We may conduct

detailed evaluations of your financial position. For this purpose, you should be prepared to provide details of relevant financial data when requested by us.

11.2 In agreeing to supply relevant financial statements, you also agree that the information supplied represents a true and fair statement of your affairs.

12. APPLICANTS TO MEET OWN COSTS12.1 An applicant's participation in any stage of the MUL process is at your sole risk, cost

and expense. The onus is on you to inform yourself appropriately.

13. RIGHT TO TERMINATE13.1 We may terminate this MUL process at any time.

14. RIGHT TO REQUEST FURTHER INFORMATION14.1 Notwithstanding any other requirement of the MUL, we may require you to submit

additional information to allow further consideration of your application.

14.2 Should you fail to submit any of the information we require by the date and time stipulated, your application may be excluded from further consideration.

14.3 Any request by us for further information is not, nor deemed to be, a representation by us that the application is, or is likely to be, accepted.

15. COUNCIL’S RIGHT TO NEGOTIATE15.1 We may negotiate the contents of an application with any applicant.

15.2 Any request by us to negotiate all or any part of an application is not, nor deemed to be, a representation by us the application is, or is likely to be, accepted.

16. ADDENDA16.1 If we amend details of the MUL once it has been established and members selected,

electronic advice will be issued to the MUL members. You should ensure details provided in your application are correct and up to date.

17. NO CONTRACT17.1 Nothing in this MUL shall be construed so as to give rise to any contract between us

and any applicant until a contract is entered into with a successful applicant.

18. REMOVAL FROM THE MULTI-USE LIST18.1 We may at any time after the establishment of the MUL, exercise our discretion to

remove a successful applicant from the MUL if we become aware that the successful applicant ceases to meet the conditions for participation.

19. EVALUATION PROCESS19.1 Applications will be assessed on a pass/fail basis and compliance with the

requirements of this MUL and will be consistent with Australia Council procurement policies.

19.2 You must complete Part B and submit the completed document as your application. You must provide the evidence required at a particular item and confirm compliance with the rules outlined in Attachment B in order to be considered for membership of the MUL.

20. CLARIFICATION AND ADDITIONAL INFORMATION20.1 We may seek clarification of applications or require further information from all or any

applicant/s.

21. SUCCESSFUL APPLICANTS21.1 We will advise successful applicants that they have been included on the MUL in

writing at the end of each evaluation process.

22. ADVICE TO UNSUCCESSFUL APPLICANTS22.1 We will promptly notify each unsuccessful applicant in writing that its application has

not been accepted/shortlisted.

23. DEBRIEF23.1 All unsuccessful applicants are entitled to a debrief upon request. This debrief will

provide feedback on the relative merits of their application bid against the requirements outlined in Part B, but will not refer to any other application and will not disclose the confidential information of any other applicant.

24. SUBCONTRACTS24.1 Any contract entered into requires that you do not subcontract the whole of your

obligations under a contract. You may, with our prior consent, subcontract part of your obligations, but you will still be responsible for the performance of that subcontracted work.

25. GENERAL CONDITIONS OF CONTRACT25.1 We expect successful applicants to provide the services in accordance with our

contract terms and conditions.

25.2 We reserve the right to negotiate the terms and conditions of any contract entered into with any or all of the applicants. If we and an applicant cannot agree on the terms and

conditions to be applied to the contracts created under this MUL, we reserve the right to remove the applicant from the MUL in accordance with clause 17.1

25.3 We do not warrant or make any representation that a successful applicant will be invited to participate in a tender process for any work or will be guaranteed any or any quantity of work.

25.4 We may, at our discretion, procure any of the type of services covered by this MUL without using any of the suppliers listed on the MUL.

25.5 Where we reject an expression of interest or an application for inclusion on the MUL or cease to recognise a potential supplier as having satisfied the conditions for participation in either, we will promptly inform the potential supplier and, on request, promptly provide the potential supplier with a written explanation of the reasons for our decision.

26. INSURANCE26.1 The successful applicants must, at their own expense, take out, provide and maintain

during the term of any contract entered into with us, the insurances specified in that contract.

3. DAILY RATE AND BUDGET

Please provide your standard daily rate (including any GST component). Please note that this will be negotiated during the procurement process and this information will be used to assess value for money during the selection process of inclusion on the MUL. In addition to the daily rate, lead facilitators are required to submit an estimate for their services for a full program using the following assumptions:

Arts Leaders Program Three (3) 5-day residentials and four virtual sessions

Future Leaders Program Two (2) 5-day residentials and two virtual sessions

First Nations Leadership Program (working title)

Four (4) 4-day residentials and five virtual sessions

Please refer to the facilitation services required in this document to ensure your estimate includes all the services required.

Co-facilitators are only required to submit their daily rate.

4. RESPONSE TO SELECTION CRITERIA

A statement responding to the selection criteria as per Section 4.1 in Part A (page 4). You may choose to describe how you would approach the selected facilitation services you are proposing to deliver.

5. SUPPORT MATERIAL

Any support material that will highlight your experience in delivering services similar to what is required in this MUL. A maximum of 10 pages of support material will be allowed. Any additional material will not be considered.

6. YOUR FINANCIAL VIABILITY

Briefly describe your organisation’s corporate history. If your organisation has been involved in significant litigation, real or possible organisational change, or disruption (past, present or pending), or any other activity which may be of interest to the Australia Council please provide details. Individuals should submit a statement indicating their ability and availability to deliver the projects as per this MUL.

APPENDIX A – INTRODUCTION TO THE FIRST NATIONS LEADERSHIP PROGRAM (WORKING TITLE)First Nations people(s) in Australia are regarded as having the oldest living culture in the world. For thousands of years, art has been a fundamental part of First Nations cultures and used to create leaders or Elders. The timing of this program is critical as Australia is in a state of crisis, First Nations languages and cultures are being influenced and dominated by western cultures, and it is now time for upward investments in making leaders for both worlds.

PROGRAM OVERVIEW

The Australia Council has been developing a First Nations Leadership Program (working title). This program is currently being considered by the Australia Council and working to finalise a pilot program to be launched in 2019. The program is not confirmed yet and we are seeking Expressions of Interests through this MUL process.

The focus of this program is centralised in identity. Encouraging deep listening and self-reflection better enabling a person’s transformation of their relationship to self, and others through the pursuit of leadership.

WHO IS THE PILOT PROGRAM FOR?

This program is designed for people from all career levels including, emerging, mid to established. This mixed cohort approach will maximise the learning experience through peer learning and custom components suited to various levels of experience.

DRAFT PILOT PROGRAM

The design of the program and the pilot will be co-created with the lead facilitator, but our research indicates that any program must have the following features:

Duration of the pilot program must be over a 12-months period. Include Elders in Residence for cultural guidance. Follow a Cultural Development Framework already developed as part of the initial

research completed. Include multiple intensive residentials, a minimum of four per program. Peer-to-peer engagement via an online platform. Access to ongoing opportunities through our alumni program.
