In this opportunity, I would like to wish all Malaysian a very happy Merdeka day. On another note, Malaysia have recorded several Zika cases recently. I wish to remind all contractors to be vigilant in tackling this threat by taking care of their project sites. The Government initiative in making it mandatory for developers to install mosquito traps in housing projects in a move to control Zika and dengue outbreaks is to be applauded. However, I believe there are also better ways to overcome this issue. The contractors have always been vigilant on such matter by organising regular fogging and reducing standing waters around the project sites to prevent mosquitoes from breeding. Abate were also extensively use to control the developing of larvae. Therefore, the construction industry should be given the flexibility to overcome this problem with the methods that best suits them. The following are the main events that happened in August 2016:- Politeknik Sultan Salahuddin Abdul Aziz Shah organised a CEO Talk on 3 rd August 2016 and invited the Chairman of MBAM Education Committee, Tan Sri Dato’ Sri Sufri bin Haji Mohd Zin to be the speaker. In his presentation, Tan Sri Dato’ Sri Sufri talked about his experiences in his early years, from his studying days to his most recent projects in Sarawak. He also touched on a lot of related topics such as on entrepreneurship, on being street smart versus book smart and on the issue of women in the construction industry. August will always be an auspicious month for our country as we celebrate our Independence Dayon 31st August 2016. In this opportunity, I would like to wish all Malaysian a very happy Merdekaday.

On another note, Malaysia have recorded several Zika cases recently. I wish to remind allcontractors to be vigilant in tackling this threat by taking care of their project sites. The Governmentinitiative in making it mandatory for developers to install mosquito traps in housing projects in amove to control Zika and dengue outbreaks is to be applauded. However, I believe there are alsobetter ways to overcome this issue. The contractors have always been vigilant on such matter byorganising regular fogging and reducing standing waters around the project sites to preventmosquitoes from breeding. Abate were also extensively use to control the developing of larvae.Therefore, the construction industry should be given the flexibility to overcome this problem withthe methods that best suits them.

After his talk, the floor was open to Q&A session and Tan Sri Dato’ Sri Sufri waskept busy fielding a lot of questions from the students who wanted to know aboutthe secret to his success. The event concluded with a presentation of mementofrom the management of the Politeknik Sultan Salahuddin Abdul Aziz Shah toTan Sri Dato’ Sri Sufri for taking time off his busy schedule to deliver the talk.Overall, the talk was well received as it inspired the students to succeed in theircareer especially in the construction industry.

The meeting was held on 3rd August 2016 at Tan Sri DatukTee Hock Seng’s Conference Room. Representing MBAMwere MBAM President, Mr Foo Chek Lee, MBAM VicePresident and Chairman of MBAM Contracts and PracticesCommittee, Mr Oliver Wee, Deputy Chairman of MBAMContracts and Practices Committee, Mr Steven Shee, MBAMContracts and Practices Committee Member, Mr KhooCheong, MBAM Senior Manager, Mr Lenny Lim and MBAMAssistant Manager, Mr Mohd Farhan Mohammed Din.Representing Chartered Institute of Arbitrators (CIArb),Malaysia Branch were Chairman, Mr Lam Wai Loon, DeputyChairman, Mr Thayananthan Baskaran, Honorary Secretary, Ms Serene Hiew, Committee Member, Mr Foo Joon Liang and Assistantto Hon. Secretary, Ms Lye Ca-ryn.

Matters discussed include:i. Joint Courses with MBAM on Alternative Dispute Resolution (ADR)-arbitration, adjudication, mediation, expert determination.ii. Enhancing the knowledge of contractors/ builders in the construction industry.iii. CIPAA training for contractors.iv. Courses with MBAM relevant to the contractors such as construction LA and contract administration.

Overall, it was a successful first meeting and we hope some beneficialcollaboration can materialise out of it. It was also decided that a jointmemorandum of understanding should be signed by both organisations.

The Courtesy Visit to see Minister of Finance II, YB DatukJohari bin Abdul Ghani on 4th August 2016 at Ministry ofFinance, Putrajaya was attended by MBAM President,Mr Foo Chek Lee, MBAM Immediate Past President, MrMatthew Tee, MBAM Deputy Secretary General 1, Mr OngKa Thiam, MBAM alternate Council Member, Mr AbdulRashid Bin Abdul Rahman, MBAM Senior Managers, MrLenny Lim and Mr Michael Thong, and I.

Topics discussed include our appeal for the furtherreduction of import duties on heavy machineries in theconstruction industry, the issue of safeguard measures onimported steel bars and the grounds for MBAM to reject it.

On the matter of reduction of import duties, MBAM proposedfurther reduction for construction machineries with the followingTariff codes: -

I. HS 8704.10.211 for New Dumpers Designed foroff-highway g.v.w not exceeding 38 tonnes.

II. HS 8705.10.000 for Crane Lorries:III. HS 8705.90.000 for Special Purpose Motor Vehicles.IV. HS 8429.11.000 for Self-Propelled Bulldozers and

Track Laying.V. HS 8429.40.110 for road rollers –Vibratory.VI. HS 8429.59.000 for excavators, shovel loaders,

tamping machines.VII. HS 8430.69.000 for other moving, grading and

boring machinery.

MBAM also mentioned to the Minister that the Association hadsubmitted our objection to the proposed safeguard measures asit will lead to greater problems to the construction industry.

Through the courtesy visit and dialogue, MBAM sought theMinistry of Finance’s help on all the matters raised. Overall, itwas a productive visit as the Minister proposed to set up a FocusGroup to look into the issue of high import duties on constructionmachineries. A token of appreciation was presented to YB DatukJohari bin Abdul Ghani. As a part of MBAM continuous effort to build better rapport with themedia, MBAM had organised a courtesy visit and dialogue to Sin ChewMedia Corporation on 5th August 2016. The visit was attended by MBAMPresident, Mr Foo Chek Lee, MBAM Treasurer-General, Mr Kenneth Liew,

MBAM Senior Manager, Mr Lenny Lim, MBAM Manager, Ms Chai Min Fung, MBAM Executive Officer, Ms Abbie Ng and I.

Executive Director, Mr Koo Cheng, News Editor, Mr Choo JooKian, Senior Account Manager (Direct), Mr Yeoh Yee Soon andSenior Manager (Corporate Communication & Promotion), MrLow Kon Sin represented SCMC. Mr Koo Cheng thanked MBAMfor the visit and welcome the opportunity for better cooperationbetween the two organisations.

Issues affecting the construction industry were highlightedduring the dialogue and we suggested a column for MBAM tovoice out current issues. Mr Koo said that he will let the editorialteam to discuss on the request raised. A souvenir was presentedto Mr Koo to commemorate the visit. Also presented were a copyof the 60th MBAM Anniversary Coffee Table book and the latestissue of Master Builders Journal.

Overall, the visit achieved the aim to introduce MBAMrepresentatives to key media and editorial representatives fromSCMC.

of Civil Engineering Department graduated on that day, and we hope that all of them will enterthe construction industry full of spirit to take it to the next level. Politeknik Ungku Omaris working together with MBAM on a work based learning (WBL) programme for itsengineering students and we look forward to continue to expand on this partnership forthe betterment of the industry.

On 15th August 2016, Ministry of International Trade and Industry(MITI) conducted a public hearing session for the investigationin accordance with Regulation 21 of the Safeguards Regulations2007 at MITI Tower. The session was chaired by Datuk Wong SengFoo, Senior Director, Multilateral Trade Policy and NegotiationsDivision. Master Builders Association Malaysia (MBAM) wascordially invited to participate in the session. The session wasattended by MBAM President, Mr Foo Chek Lee, MBAM ExecutiveDirector, Ms Loh Mei Ling, MBAM Senior Manager, Mr MichaelThong, MBAM Assistant Manager, Mr Leon Leong and I.

MBAM opposed the safeguard investigation on the following grounds:-n If safeguard is granted it would lead to increase in price, artificial shortage and a recurrence of the year 2008 steel shortage episoden The local manufacturers are also importing the steel bars to sell in the domestic market and have benefitted from the imports.n We urge the local manufacturers to upgrade & be more efficient in their production to meet competition.n Any safeguard measure granted will push up the cost of construction and inevitably it will push up the inflation in our domestic

economy.n Any safeguard measure will trigger a retaliatory action by other countries.n We urge the investigation authority to dismiss the safeguard application given that the construction industry contribution to the

GDP is 7.9% (1Q, 2016) and support 140 allied industries.

related training programmes. He also expressed his hope to see morecontractors joining the arbitration training programme. Datuk Professor SundraRajoo mentioned KLRCA is willing to share updated statistics on CIPAA withMBAM. Overall, it was a productive meeting with KLRCA which is anadjudication authority under the Construction Payment & Adjudication Act2012 (CIPAA).

SESSION 4: RISK MANAGEMENT & INSURANCES ANDBONDS / DETERMINATION AND DISPUTE RESOLUTION

Managing Director of BK Entrusty, Sr. Ong Hock Tek trained 50 attendees whoturned up for the fourth and final session of Practical Construction ContractAdministration/Management on 18th August 2016 at MBAM Training Centre.This final session focused on “Risk Management and Insurances/Bonds &Determination and Dispute Resolution”.

MBAM Vice President and Chairman of MBAM Contracts and PracticesCommittee, Mr Oliver Wee in his closing speech said that we sometimes forgetor don’t realise what it takes to enable us to enjoy the programmes that theContracts and Practices Committee has to offer. The success of this series

of programme is alsoachieved through the efficient co-ordination and dedicated hard-work of Sr. HTOng, his staff, MBAM Contracts and Practices Committee Members and MBAMSecretariat staff who have worked tirelessly to ensure the programmes aresuccessful.

The attendees of the programme learnt how to better understand and evaluatethe risk associated with the commercial terms and conditions typically found inall construction contracts. It is hoped that the programme has increased theparticipants’ knowledge on how to lessen or eliminate commercial risk throughsuccessful negotiation of a contract’s commercial terms and conditions.

Master Builders Association Malaysia (MBAM) organised its AnnualGolf Tournament on 20th August 2016 at Glenmarie Golf & Country Club,

Shah Alam. The event was attended by the Director General, Department of Occupational Safety and Health Malaysia (DOSH), YBhg.Dato’ Ir. Mohtar bin Musri as the Guest of Honour and as one of the players. There were 134 players who participated making a totalof 34 flights in the 18-point shotgun tournament.

MBAM SCHOLARSHIP AWARD 2016

The presentation of the MBAM Scholarship Awards2016 was held on 20th August 2016 at Glenmarie Golf& Country Club, Shah Alam (GGCC) in conjunctionwith the MBAM Annual Golf Tournament 2016. TheMBAM President, Mr Foo Chek Lee and Chairmanof Education Fund Board of Management (BoM),Mr Chua Siow Leng presented the Scholarship to10 deserving recipients. MBAM has decided to increase the value of the scholarship from RM8,000.00 to RM10,000.00 per annum this year. The last timethe scholarship value was increased was in 2013 and the inflation as well as the cost living has increased significantly since then.The increase in the value of the scholarship is to assist the students in view of the increase in the cost of living and educationexpenses in general. The scholarship will be disbursed in two instalments; in February and August/September upon verification ofsemester examination results.

MBAM 2-DAY SEMINAR ON OCCUPATIONAL SAFETY &HEALTH (OSH) & WORKSHOP ON HEAVY LIFTING PLANMBAM Safety and Health Committee together with the Penang Master Builders& Building Materials Dealers Association (PMBBMDA) jointly organised a 2-DaySeminar on Occupational Safety & Health (OSH) and Workshop on Heavy LiftingPlan on 24th to 25th August 2016 at Sunway Hotel, Seberang Jaya, Penang. Weare honoured to have the Director, Department of Occupational Safety andHealth (DOSH) Penang, Ir. Mohd Rosdee bin Yaacob as our Guest-of-Honour(GOH) to officiate the opening ceremony. In total 110 participants attended thisSeminar.

This Seminar was supported by the Social Security Organisation (SOCSO) andConstruction Industry Development Board (CIDB) and was endorsed by The

National Council for Occupation Safety & Health (NCOSH) and theDepartment of Occupational Safety & Health (DOSH). It is held with theaim to enhance the standard of safety and health at construction worksites by increasing awareness among the employers and constructionpersonnel on the importance of practicing high standard of occupationalsafety management and also by the sharing of best practices by industrypractitioners.

In line with the Occupational Safety & Health Master Plan 2015(OSHMP15) this seminar was held with the objective to push ourconstruction industries towards instilling Risk Reduction Culture and tomake construction sites a HAZARD FREE ZONE.

Attending from Selangor and Federal Territory Kin Cho Hong were Chairman of Selangor and Federal Territory Kin Cho Hong, Mr LeongKien Keong. Also present from Kin Cho Hong were Mr Leong Foo Yew, Mr Tee Seng Kong, Mr Alwin Liew, Mr Liew Yu Chan, Dato’ NgTong Chun and Mr Liong Ban Lee.

The purpose of the meeting was to invite Selangor and Federal Territory Kin Cho Hong to be MBAM Council Member and also to discusspressing issues. It is hoped the meeting will spark further dialogues with MBAM Affiliate Members so that MBAM can continue torepresent our Members with a stronger voice.

MEETING WITH MATRADE ON CONSTRUCTIONRELATED SERVICES & BUILDING MATERIALS2017 WORK PROGRAMMEMr. Mohamad Noor Azhab Mohd Shazilli and Ms Wong Pooi Yinfrom the Construction Services & Building Materials Unit ofMATRADE visited MBAM on 26th August 2016 to discuss onMATRADE’s 2017 Work Progamme on Construction RelatedServices & Building Materials.  MBAM Deputy President, Tan SriA.K. Nathan, MBAM Executive Director, Ms Loh Mei Ling, MBAMSenior Manager, Mr Lenny Lim, MBAM Manager, Ms Lee SiewMei and I were present at the meeting.

At the meeting MATRADE also proposed to organize a specializedconstruction mission to Qatar for projects related to the World

Cup. MBAMadvised them to focus on other Middle East countries as projects related tothe World Cup mostly has been awarded.  Potential countries for Malaysiancompanies and MATRADE to target includes ASEAN countries such Myanmar,Philippines, Indonesia, India, etc.  The meeting also shared that MBAM memberscan utilise the existing Services Export Fund (SEF) or Market Development Fund(MGD) for MATRADE mission as well as participation in the internationalexhibitions.  Meanwhile MATRADE will keep MBAM members updated on theinternational projects opportunities from time to time from their internationalnetwork.

On 30th August 2016, MBAM delegates paid a visit to the Embassyof Malaysia in Nepal in conjunction with the celebration of MerdekaDay. Led by MBAM President, Mr Foo Chek Lee, MBAM delegateswas received by Mr Ahmad Phadil Ismail, First Secretary of theEmbassy of Malaysia in Kathmandu, Nepal.
