Your HBA watches local legislative items: building setbacks on rivers, tree preservation

When you join the HBA of F-M, you support and receive legislative representation at the local, state and national lev-els. We are your local watchdog, the North Dakota Associa-tion of Builders and the Builders Association of Minnesota are your state watchdogs and the National Association of Home Builders is your federal watchdog. It doesn’t much matter what time of year it is anymore, your watchdogs are busy guarding your livelihood constantly.Local…

Your HBA has been very involved with talks in Fargo about an ordinance relating to construction along rivers. The city currently has a moratorium for building on river

lots. Current policy forbids building within 450 feet from the center line of any river. The ordinance would address building setbacks along the three rivers and numerous drains that run through the city and its future growth areas. For a com-plete update, see page 11.

We have also been at the table with a task force discussing a tree preservation ordinance for Fargo. The task force worked through eight drafts before sending an ordinance to the City Commission for review.

The draft ordinance brought to the commission included several areas that needed discussion including a ban on removing trees within 350 feet of a river, preservation of significant trees in existing neighborhoods and tree inventory requirements, plus more. Commissioners sent the draft ordinance back to the task force for further review, and your HBA would like input from members on several of its provisions. For details, see page 11.State…

BAM offered assistance to its members and local associations experiencing problems with getting electrical inspections during the Minnesota government shutdown last month. Minnesota cities that had not passed an ordinance to per-form electrical inspections were having trouble getting an inspector to jobsites.

NDAB maintains a strong relationship with North Dakota’s Congressional delegation, is active in state legislation that helps the building industry and confronting other issues as they arise. Most recently, NDAB was very active this spring at the legislature in achieving balance to requirements for using an archi-tect on private projects and reforming the appraiser chapter of the N.D. Century Code. National…

NAHB is commending the U.S. Environmental Protection Agency for reject-ing a proposal to add third-party clearance testing to the Lead: Renovation, Re-pair and Painting Rule (RRP). At NAHB’s request, this regulation was selected for review by the EPA under the Presidential Executive Order for Regulatory Review concerning the impact of federal rules on small businesses and job cre-ation. Third-party clearance testing would have added extreme additional costs to the already burdensome process and costs created by the RRP Rule. Read more on page 15.Minot, Bismarck Flood Recovery

Our thoughts and prayers go out to our neighbors to the west in Minot and Bismarck as they face flood recovery. Your HBA leadership is considering op-tions on how to assist in the rebuilding efforts as an Association and through our membership. Minot Area Recovery Fund established

The Minot Area Recovery Fund was established to help in the long-term flood recovery needs of the area. Launched by the Minot Area Community Foundation with an initial contribution of $250,000 the fund will be looking to national, re-gional and local funding sources to help provide relief and restoration throughout the greater Minot area; including the counties of Ward, Renville, Bottineau and McHenry.

“Once this crisis passes, we will focus on getting people’s lives restored from the flood. We’ll use the fund to make grants to groups providing direct services to flood victims,” says Ken Kitzman, MACF president. “Every dollar received for the fund will be used to help people in our area. No administra-tion fees or allocations to national affiliates will be taken.”

Assistance will be provided initially to first responders, and then MACF will provide funding for:• Rebuilding Assistance – con-

struction materials, repairs, HVAC

• Rental/Mortgage Assistance/Transitional Housing

• Goods/Household Items – ap-pliances, furniture & bedding, clothing

• Services – childcare, legal, referral, transportation, animal care

• Counseling/Health Services – behavioral health & physical healthcare

• Direct Assistance – tax assis-tance, utilities

• Food Assistance

It will again offer the largest selection of home and garden exhibits in the region. Held at the Fargodome, this show features up to 110,000 square feet of exhibit space show-casing the diverse products available in today’s building industry.

Fall Home Show features seminars on organizing kitchens, garages, entries and mudrooms

MS. Simplicity will change your life: not by remodel-ing your home, but by reorganizing your life! Melissa Schmalenberger, known as MS. Simplicity, will open your eyes to what your home can look like... organized.

Schmalenberger’s career in professional organizing be-gan in 2007.

“It is my goal to help my clients create and maintain a system of organizing that works for each individual per-son,” she says. “I work with the client to create the orga-nized home or business that they never thought possible.”

Her seminars will focus on garage organization, tidying your kitchen and cleaning up clutter hotspots like the family “launch pad,” or entryway.

“The days of the dungeon garage are gone,” says MS Simplicity. “Find systems that will enable you to find every-thing in your garage, from a hammer to off-season clothing. I will also give tips on getting families in and out of the house in an organized manner every day, and ways to turn that front door dumping ground into the organized space you’ve been dreaming of.”

Her kitchen seminar will show attendees how to maxi-mize the space no matter if it’s big or small. She notes that families spend the majority of their time at home in the kitchen making it an important place to keep in-check!Fall Home Show details

The Fall Home Show will be Oct. 1-2 at the Fargo Civic Center. Hours are 9 a.m. - 6 p.m. Saturday and noon - 5 p.m. Sunday.

Now in its 22nd year, the Fall Home Show will display exhibits showcasing home improvement companies includ-ing contractors, flooring, siding, spas, windows, water pu-rification, decks, heating/air conditioning, interior decorat-ing and design, kitchen and bath design, cabinetry, garage doors and more.

Accent Kitchen & Bath is the show’s platinum sponsor and will present seminars on topics like renovating your kitchen and bath.

Admission is $3 and parking is free and convenient! Children younger than age 14 will be admitted free when accompanied by an adult. Public Issues Report of Area Affairs

Fargo City Commission discusses tree preservation ordinance by Rocky Schneider, Public Affairs Coordinator

A group of city staff and industry representatives have been working since last December to develop an ordinance to help preserve trees within the city of Fargo and in future development areas. The HBA of F-M has been an active par-ticipant in the task force meetings. The task force worked through eight drafts before sending an ordinance to the commission for review.

The draft ordinance brought to the city commission included several areas that needed discussion. Some of the areas are highlighted below: • Riparianbuffer: The ordinance looks to eliminate the removal of trees

within 350 feet of a river. • Significanttreesinexistingneighborhoods: One goal of the draft

ordinance is to help preserve the city’s existing significant trees (roughly defined as having an 18-inch diameter). This would be required in all areas of the city for new and existing homes. Homeowners would have to obtain approval from the city forester and either replant a 2-inch tree or provide payment equal to two times the cost to purchase and plant a tree elsewhere.

• Treeinventoryrequirements: The ordinance lays out a few require-ments for new developments including the creation of a tree inventory to accompany new developments during the platting phase. The tree inven-tory would detail existing trees on property to be developed. If significant or non-significant trees are to be removed, the developer must follow the

Fargo continues work on setback ordinance along rivers, drainsby Rocky Schneider, Public Affairs Coordinator

The city of Fargo continues to meet to develop an ordinance relating to building along rivers. The city currently has a moratorium for building on river lots. Current policy forbids building within 450 feet of any river. The ordinance would address building setbacks along the three rivers and numerous drains that run through the city and its future growth areas.

At a recent City Commission meeting the moratorium was further defined to state that permits for existing homes on river lots could be approved, if the remodeling did not result in the home being closer to the river. All new home permits still have to be approved by the full commission and meet the 450 foot setback.

The moratorium is temporary until the City Commission finishes studying the issue and an ordinance is approved. The new setbacks are necessary, according to city officials, to provide enough protection for the homes and the city in times of severe flooding.

The setback distance serves three primary functions. The first is simply to make sure homes will be far enough away from the river to be able to meet a proper elevation. The second is to prevent the weight of the home from causing a sloughing of the river banks. The final reason is to give the city adequate room behind the house to construct levees or other emergency measures if the situa-tion and need arises.

The distance of 450 feet was determined using an 8:1 ratio formula. It is determined by calculating the depth of the river (from the river bottom to the top of the river bank), multiplying it by eight, and adding 100 feet. Using this calculation on the Red River’s depth results in a 450-foot setback which is what is being used in the moratorium.

Already facing a weakened market from yearly flooding and a sputtering national economy, the lo-cal housing industry did its best to rebound despite the challenges.

This spring saw, for the third year in a row, a chance of disas-trous flooding in the Fargo-Moor-head area that delayed the start of the construction season by several months. The rising river levels do not just affect the river banks. Water table levels were high across the valley making the construction of homes almost impossible for the first several months of the year.

The housing market continues to be steady locally with 210 hous-ing starts so far in 2011 (Jan-June). This is down from 357 in 2010 over the same time frame. However, 2010 numbers include the period when the $8,000 first-time home-buyers tax credit was being offered. Total construction value continues to remain strong and has actually increased to a total of $165 million in 2011 which is up from $141 mil-lion in 2010.

“We are fortunate to have been insulated from the worst of the recession, but that doesn’t mean we are completely isolated from its effects,” said Tyrone Leslie, HBA president. “When you add in our perpetual flooding the last three years, every added barrier to homeownership and growth is felt a little more.”

Disaster Resources Available

Between the Missouri River flood-ing and the flooding in the Minot area, it’s been a difficult summer for our state and our members.

To assist, NAHB has compiled resources for members and HBAs to use to help their communities rebuild following a disaster. There are radio

public service announcement scripts, sample flyers and links to government information and resources.

The monumental challenges facing natural disaster victims who have lost their homes and, in many cases, all of their belongings and their jobs may seem overwhelm-ing. NAHB has created resources to help consumers begin to put the pieces of their lives back together. Find out how to find and select a professional builder or remodeler, how to avoid unscrupulous contractors, prepare for a natural disaster and other vital resources to help disaster victims recover.

President’s messageMinot’s flooding is devastating. I’m

hoping that members of the NDAB across the state may be able to help with flood recovery efforts, providing information on how their communi-ties handled it when faced with similar problems.

The numbers being compiled are staggering. Last count is as follows:

about 1,000 apartments damaged or destroyed; about 600 house rental properties; 875 homes destroyed; 2,200 homes “severely damaged” as well as countless businesses af-fected.

We have organized a Flood Recovery Committee and are looking for help in both the way of information and pos-sible collaboration with North Dakota builders and devel-opers that may be interested in working, building, develop-ment, etc., in the Minot area. The needs are great.

Please give it some thought and provide any information to me or Doreen at NDAB. All help will be greatly appreci-ated. There will be many obstacles, but with your help we can recover from this disaster.

Minot’s one-stop contractor licensing center

Gov. Jack Dalrymple, Attorney General Wayne Stene-hjem and Tax Commissioner Cory Fong announced the multi-agency “one-stop” contractor licensing center that opened in Minot July 11. The center is open Monday through Friday 9 a.m. to 5 p.m. and is located in the Job Service building at 3416 N. Broadway in Minot.

“This One-Stop Center will be a very effective way to prevent fraudulent contractors from taking advantage of Minot residents, but at the same time it will expedite the process of licensing for reputable contractors who are needed in Minot,” Dalrymple said.

“Contractors and clean-up related business will be critical to ensuring an efficient and orderly recovery ef-fort in Minot and the surrounding communities impacted by Souris River flooding,” said Tax Commissioner Cory Fong. “And, it is important that they are meeting the requirements of North Dakota law, which means they have the appropriate licenses and permits in order to work in the state, including having a sales tax permit and are regis-tered for withholding if they have employees.”

All contractors and their employees are required to be licensed by the Secretary of State. Contractors who aren’t permanently located in Minot also must post a bond and obtain a transient merchant’s license issued by the Attor-ney General’s office.

Employees from both state agencies will be staffing the One-Stop Center with employees from Job Service N. D., Workforce Safety, the Tax Commissioner’s office and the city of Minot. The One-Stop Center will enable contrac-

tors to quickly complete the required state licensing and registration procedures.

Agents from the Bureau of Criminal Investigation will conduct a warrants and registered sex offender search on all applicants, and any illegal aliens will be turned over to federal authorities. All individuals will be issued a One-Stop Center Photo Identification card so that home and business owners can easily determine that both the compa-ny and the individual employee are properly licensed and bonded with the state. The photo identification also will indicate if the licensee is a registered sex offender.

“Anyone in Minot needing to rebuild or repair flood-damaged property should ask to see the photo identifica-tion card issued by the One-Stop Center before doing business with a contractor. The ID card provides reassur-ance to the home or business owner that the contractor has complied with state licensing requirements,” said Stene-hjem.

Attorney General Stenehjem encouraged licensed contractors who operate permanently in Minot to visit the One-Stop Center as soon as possible to obtain photo identification cards for their employees. The process will be expedited for licensed contractors with a permanent business address in Minot. Documentation of the current license status will be required.

“Access to flood damaged areas is restricted, so con-tractors who do not have a photo identification card issued by the One-Stop center may find it difficult to gain entry into the restricted areas, particularly the residential streets,” said Stenehjem. Law enforcement in the restrict-ed areas will be checking all contractors for photo identifi-cation cards.

2011 BAM Legislative SummaryThe full Builders Association of Minnesota’s 2011 Legislative Summary is

now available online at www.bamn.org/legislation. In a nutshell, Minnesota Sen-ate Republicans, who hadn’t held a majority in over 30 years, won 16 new seats to take a 37 to 30 majority. The House of Representatives, which generally flips every few years, saw Republicans win the majority 72 to 62. Democrat Gov. Mark Dayton vetoed all but one spending bill and the executive and legislative branches did not come to a budget agreement prior to the constitutional end of the legislative session. That means, at the time of writing, the state of Minneso-ta’s government is shutdown. How long it will last; no one knows. The follow-ing is a summary of BAM’s top three offensive bills. Fire Sprinkler Bill

This bill, House File 460, would have prohibited the Legislature or the De-partment of Labor and Industry from passing a mandate requiring installation of fire sprinklers in new single-family construction.

Introduced Feb. 10 by BAM, the bipartisan bill passed the House 90 to 40 March 31, then, on May 16, passed the Senate 50 to 15. The bill went back to the House to be passed as amended and passed again; this time 97 to 36. On May 25, Gov. Dayton vetoed the bill even though the opposition provided un-substantiated information. BAM has contacted the Governor’s office to correct the information.

With the kind of bipartisan support the bill received, it was a huge disappoint-ment to receive the governor’s veto. But BAM is NOT giving up. The fire sprin-kler requirement has not been through the code process, which was scheduled to begin in July, but that will depend on how long the shutdown lasts. Therefore, it is not in code yet. Even if the code process does not warrant the desired out-come, an Administrative Law Judge hearing and the 2012 legislative session are our next steps and will be taken if necessary. Lead Abatement Bill

BAM introduced House File 166 and it was passed and signed into law by the governor Feb. 27. This bill pushed back the date cities must check the EPA website as a resource for certification of the EPA’s Lead: Renovation, Repair and Painting Rule to Aug. 1 from Feb. 1. It also prohibits municipalities from charg-ing a similar certification fee already paid to the federal government for lead certification. This does not give contractors more time for certification.Variance Bill

This bill, House File 52, was introduced by the League of Minnesota Cities and supported by both BAM and the Builders Association of the Twin Cities. It allows cities to grant variances again, after the Minnesota Supreme Court ruled on the Krummanacher case last year interpreting the law to mean an undue hardship needed to be proven in order for a city to grant a variance. Millions of dollars of member projects were held up by the interpretation, and its passage is a big win.

HBA takes part in Moorhead Housing Needs Assessmentby Rocky Schneider, Public Affairs Coordinator

Looking to bolster its share of the housing market, the city of Moorhead is working on a Housing Needs Assessment.

The city has retained Mary Bu-jold of Maxfield Research, Inc. to help lead focus groups and compile the research needed for the study. A key group of developers and builders met with Bujold July 21 to discuss building within the city and region.

The participants shared their experiences working with, and selling, the city of Moorhead. There were many points brought up on what makes it an attractive or unattractive place to work and live for home buyers, builders and developments. Also discussed were the differences between Moorhead and other area cities, including the differences between doing work in Minnesota versus North Dakota.

By a vote of 406 to 22, the House on July 12 over-whelmingly approved H.R. 1309, the Flood Insurance Reform Act of 2011, which would reauthorize the National Flood Insurance Program (NFIP) for five years through Sept. 30, 2016. The program, which covers about 5.5 million policyholders in more than 20,000 communities nationwide, is set to expire Sept. 30.

NAHB worked with House leadership throughout the legislative process to advance the bill and defeat any amendments to weaken the program. A letter was sent to lawmakers prior to the House vote designating support for passage of the legislation as a “key vote” for the housing industry.

“NAHB believes the five-year reauthorization of NFIP will help ensure the nation’s real estate markets operate smoothly and without delay,” the letter said. “H.R. 1309 re-flects these goals by offering programmatic improvements that establish solvency.”

NAHB led a coalition of 21 other organizations to oppose an amendment offered by Rep. Candice Miller (R-Mich.) that would have terminated the program effective Jan. 1, 2012. The coalition warned that without affordable coverage, home owners and business owners would be un-able to protect their largest investment, leaving taxpayers on the hook for reconstruction costs.

Miller’s amendment was soundly rejected by a 384 to 38

margin.In addition to reauthorizing the NFIP until 2016, H.R.

1309 would limit the Special Flood Hazard Area (SFHA) and any mapping to the 100-year flood level, certify the sci-entific validity of maps, phase in risk-based premiums and suspend mandatory flood insurance purchase requirements.

NAHB continues to work with the Senate as it drafts a companion bill in advance of the Sept. 30 deadline.

The House Subcommittee on Capital Markets and Government Sponsored Enterprises on July 12 approved six legislative proposals that would reduce the activities of Fannie Mae and Freddie Mac.

Rather than offering a comprehensive framework for overhauling the mortgage market, the bills, among other things, would cap the amount of money Fannie Mae and Freddie Mac can receive from the government, require them to dispose of all assets not critical to their housing fi-nance mission, eliminate the National Housing Trust Fund, and allow the Federal Housing Finance Agency to revoke Fannie and Freddie’s charter while they are held in receiv-ership.

NAHB applauds EPA rejection of renovation clearance testing requirementsJuly15,2011 - The National As-

sociation of Home Builders commends the U.S. Environmental Protection Agency for rejecting a proposal to

add third-party clearance testing to the Lead: Renovation, Repair and Painting Rule (RRP).

“We’re pleased that the EPA listened to the concerns of remodelers about the extreme costs the proposed clearance testing would have imposed,” said Bob Peterson, NAHB Remodelers chair and a remodeler from Fort Collins, Colo. “Home owners are saved from spending a great deal of money on lead testing. If remodeling is more affordable, home owners will be able to hire an EPA-certified renova-tor to keep them safe from lead dust hazards during renova-tion.”

At NAHB’s request this regulation was selected for re-view by the EPA under the Presidential Executive Order for Regulatory Review (Improving Regulation and Regulatory Review, 76 FR 3821 issued on Jan. 21) concerning the im-pact of federal rules on small businesses and job creation.

The lead rule applies to homes built before 1978 and requires renovator training and certification, following lead-safe work practices, containing and cleaning dust, and record keeping.

Under the lead paint rule, contractors have been required to wipe down the project area after completing remodel-ing or renovation work and match the result to an EPA-approved card to determine whether lead paint dust is still

present – a process that EPA says is “effective at reducing dust lead levels below the dust-lead hazard standard.”

The proposal would have required contractors to hire EPA-accredited dust samplers to collect several samples after a renovation and send them to an EPA-accredited lab for lead testing. Because of the cost of this as well as the waiting period for test results and the limited number of accredited labs nationwide, professional remodelers were very concerned about home owners’ willingness to undergo the process.

“The EPA has maintained its common sense approach to keeping families safe during renovation,” said Peterson. “Hiring trained professional remodelers to contain dust, use lead-safe work practices, and clean up has been shown to successfully minimize lead hazards and protect individuals from lead exposure.”

Several problems with the rule still remain. The EPA has yet to recognize an efficient, low-cost lead test kit that meets the requirements of the regulation. And last year the agency removed a key consumer choice measure – the opt-out provision – which allowed home owners with no children or pregnant women in residence to waive the rule’s requirement. In this down economy, consumers are still balking at the extra costs of the rule and often choose to re-duce the amount of work done on their homes, hire uncerti-fied contractors, or endanger themselves by attempting the work themselves.

HBA continues advances on strategic plan goals

In the spring of 2010, HBA of F-M leaders formulated a three-year strate-gic plan for the Association. The group consisted of HBA directors, committee members and staff. Facilitators from the National Association of Home Builders traveled from Washington, D.C., to conduct the planning session. The HBA’s mission statement remains the same: “The mission of the Home Builders Association of Fargo-Moor-head is to provide quality services, benefits and education to our members and the community. Striving to be a

visible and proactive influence, the Association represents the collective interests of the home building industry.”

At the planning session, we discussed four areas critical to the HBA and formulated objectives and strategies (listed to the right). The planning group appointed me to monitor the plan and work with staff to make regular reports to the board and membership. A common theme in this strategic plan is the need to communicate “return on investment” to the current membership and demonstrate the HBA’s posi-tive impact on the community to consumers.

In these challenging economic times, our leaders identi-fied the importance of showing members what they are re-ceiving for their dues, as well as increasing the HBA’s good works in the public’s eyes – which will positively impact members, too!

Much has been accomplished, and even completed, within the plan and requires an ongoing effort by staff and members.Progress: Staff has developed information for mem-

bers showing how much money an HBA membership saves through member discounts and benefits. They also developed a Political Action Committee accomplishments flyer detailing money saved for members through state and national legislative achievements the past two years.

We are also looking at innovative ways to attract new members, but realize that “closing the sale” will be harder than in the past. This ties in with using our return-on-investment information and legislative achievements to convince non-members of the need to join.

The plan also directs the HBA to look at the reach and methods of our communication to members and consumers.Progress: HBA staff has created Facebook pages for the

Association and its public events and is regularly marketing them to members and the public. An effort has been made to better communicate the HBA’s services and legislative successes to the public through our Parade of Homes and Home Show guides that are targeted at consumers and in the Membership Directory & Buyer’s Guide. The board has included in its priorities for 2011 to explore expand-ing technological communication options for use with the membership: smart phone apps, texts and website. The HBA website has been refreshed with a commitment to continually update all information, including the member’s

only section, and a smart phone app is available for our Parade events. Online interactivity of our Plains Builder, Membership Directory & Buyer’s Guide and public event guides has been achieved as well. The membership has been surveyed the past two years to collect feedback on the HBA’s performance and initiatives.

Leaders want to see staff, directors and committee chairs maintain a personal touch with members, and this intent will be kept in mind. Sometimes all it takes to get someone involved is personal contact over a cup of coffee or a phone call.Progress: Committees are making an effort to grow

themselves by members that are already active talking to other members about getting involved. Committee chair-persons are also charged with extending contact to existing committee members to keep that “personal” touch going. All committee members are now encouraged to contact members who have not renewed to extend encouragement on keeping their membership current. Staff is working on changing some of the General Membership Meetings’ timing and format to mix it up and attract members who

NAHB Senior Economist Eisenberg to give economic outlook at October GMM

On Oct. 18, the HBA of F-M’s General Membership Meeting and Annual Meeting will feature a National Asso-ciation of Home Builders Senior Economist Elliott Eisen-berg, Ph.D.

Eisenberg holds a bachelor’s degree in economics with honors from McGill University as well as a master of public administration degree and a doctorate in public administra-tion from Syracuse University.

He is a frequent public speaker on numerous housing and housing related topics including: the economic impact of home building, the unintended consequences of government regulations on house prices, residential fire safety and how to reduce risk and boost profits using financial derivatives.

He is the creator of the multi-family stock index and is the author of more than 45 homebuilding industry articles.

Darrick Guthmiller’s activity within the HBA of F-M has grown along with his time in the home building industry. His employers, Bob and Paul Kochmann, encouraged Guth-miller to get involved when he started at Kochmann Broth-ers Homes in 1997. Today he is manager and part owner of the home building company that focuses on new homes and remodeling.

Guthmiller has been on the board of directors since 2008 and currently serves as treasurer. He also participates on the Education Committee, New Member Development Com-mittee and Herdina Academy for the Construction Trades Advisory Committee.

Guthmiller is a regular contributor to the North Da-kota Association of Builders political action committee (NDAB-PAC), participates in Lake Agassiz Habitat for Humanity’s Tour de Habitat and volunteers to help mark booth spaces on the Fargodome floor for the RRV Home & Garden Show each February.

He stepped up to become involved on the board of directors upon encouragement by the Kochmanns and because he thought it would be a great opportunity personally.

Kassenborg Construction, Inc.Remodeling company owner applies Golden Rule to business dealings

“Treat others the way you would want to be treated:” Kirby Kassenborg applies the Golden Rule to all of his remodeling jobs and attitude toward his customers. In fact, it’s one of his top tips to those just starting out in the industry.

“I think being personable and doing the job the way the customer wants it done means a lot,” he says. “Quality workmanship is what I want the hom-

eowner to see at the end of a project. Meeting or exceeding their expectations is a must. A smile on a homeowner’s face is a reward in itself.”

Kassenborg is a people-person and says getting to know the owners of the homes he remodels is his favorite part of the job. He gets excited about giving them ideas to improve their living areas and maximize their money.

With over 20 years in the local construction industry, Kassenborg has plenty of experience to draw from for projects within his specialties of interior finish work and remodeling. He graduated from Minnesota State Commu-nity and Technical College in 1988, worked for a success-ful area remodeler for three years and then a custom home builder/remodeler for 14 years before striking out on his own in 2005.

“I had always done quite a lot of side jobs and wanted to start my own company,” Kassenborg says. “I had the op-portunity to get a couple of larger remodeling jobs if I was on my own, so my wife and I decided to take the chance and I haven’t regretted it!”

Kassenborg may build new homes in the future, but considers the remodeling market fairly strong locally. His projects vary once in awhile and have included window-well work, tiling and finishing a barn loft. He considers working alone a positive aspect of his services since own-ers feel at ease dealing with one person entrusted to work on their house.

“I try to be as competitive as I can and give people as good a deal as possible,” he says. “I am a small company so overhead is low and, with that, I feel I can give hom-eowners a better price. Keeping a clean jobsite is also very important; I try to leave the job as clean or cleaner than when I started.”

Kassenborg identifies the economy and the area flood protection issues as challenges to the home building and remodeling industry, saying that customers don’t want to spend money to remodel if they are worried about losing their job. “I had a couple of jobs that had to be put on hold this spring because they didn’t know if flood waters were going to be banging at their door or not,” he adds.

Grace ElectricFemale electrician sets herself apart with customer service

Over the past seven years, Grace Cummings Pas has developed a suc-cessful F-M metro area electrical contracting company in a field domi-nated by men; she doesn’t shy away from the fact she is the only woman electrician in this market.

In fact, she views has used it as a way to stand out from the crowd.

Pas’ past experience in the retail industry and as a housewife gave her valuable insight into customer service, product distribution, production, being flexible and working with a limited budget.

“I had three children close in age… pots, pans, a sewing machine, tool box, clothes line and a window to look out,” she says. “And by the way, we were broke! I made or fixed anything I possibly could.”

Pas was born in Girvan, Scotland, and moved many times living in other countries. She graduated from Moor-head High School (the ninth school she had attended). After high school, Grace began working in the retail industry in Washington, which lasted about 13 years; there, Pas met her husband, Mark, and convinced him to join her in the move back “home,” to Moorhead. In the early 1990s, she went back to school for electrical construction. Eventu-ally she was being asked to do so many side jobs that she decided to start Grace Electric.

“I just bought a van and the tools came later,” she says.Today, her company provides both residential and com-

mercial electrical wiring services including service up-grades, new and existing construction, emergency standby generators, communication, TV (HD), cabling, heating and air conditioning, off-peak, trenching and overhead lights.

The slower economy has affected Grace Electric, but Pas believes her diversified services have helped the company remain successful. She also enjoys learning about emerging technologies in the industry including wind power, solar power, geothermal and hydroelectric energy.

What is your company’s focus/specialty? “We focus on both residential and commercial security

systems. Directly for residential, we specialize with alarm systems and monitoring systems such as burglary, fire, carbon monoxide and low-temperature.”What is the latest trend in your business/industry?

“Things in the alarm business haven’t changed much in the past few years, but one thing that is becoming more popular is the cellualr monitoring of these systems.

“Having the ability to monitor your systems through your cellular device is huge. Also things like sever weather alerts and high-temperature alerts are very helpful to con-sumers.”

What do you think is the biggest challenge facing the industry today and how are you dealing with it?

“The biggest challenge right now is the move from analog copper phone lines to simulated analog phone lines through a modem, for example.

“Right now, a lot of phone and cable providers are simluated off the modem. What can happen here is that when the company goes down all your signal through that modem is lost.

“What we’re doing to fix this is working to install more battery backups for the modems or using a cell module to transmit the signal.”

Get your motorcycle, classic car, hot rod, street rod or cruiser ready for a sce-nic ride during the 8th Annual Home Builders Care Charity Ride Aug. 20.

The ride kicks off from U Motors, 3525 38th St. S. in Fargo. Registration will start at 9 a.m. and riders will head out at 10:30 a.m. A second starting point is scheduled at the Lakeland General Store and Cornfield Café in Dunvilla, Minn., with registration beginning at 11:30 a.m. and the ride continues on its route at noon.

The foundation, created in 1993 by the Home Builders Association of Fargo-Moorhead, is a local 501(c)3 nonprofit charitable organization.

It was established with funds donated by HBA members, fundraising events and the HBA itself. The purpose for its creation was to provide an outlet for the builder, remodeler, and companies related to the building industry to show the community that there is more to the building industry than demolition, construction, and remodeling.

The HBA of F-M handles the administrative duties for the foundation at no charge. Any contribution designated to the foundation goes directly to the foundation and its charitable work.

8th Annual Charity Ride is here, Fall scholarships available

The 8th Annual Charity Ride is this month! Make any final finishing touches on your bikes and cars so they are ready to roll Aug. 20. The ride leaves from U Motors, 3525 38th St S, Fargo at 10:30 a.m. Registration will be open from 9 - 10:30 a.m. and gives riders a chance to enjoy doughnuts for breakfast and check out all that U Motors has to offer.

The second starting point is at the Lakeland General Store and Cornfield Cafe in Dunvilla, Minn. Registration goes from 11:30 a.m. - noon. Each fall, Home Builders Care offers scholarships to students interested in the construction industry. Scholarships are available for high school students and post-secondary students at Minnesota State Community and Technical College, Minnesota State University Moorhead, North Dakota State College of Science and North Dakota State University. This year, applications are due by noon Friday, Sept. 23.

High school seniors must be planning on attending M State or NDSCS to study in construction-related program. Students from North Dakota and Min-nesota are eligible for this award. In addition to the Fargo-Moorhead schools, we distribute applications to many high schools outside of the metro area.

Post-secondary scholarships are available to students who are members of the National Association of Home Builders student chapters at M State, MSUM, NDSCS or NDSU. Students must be enrolled in construction-related programs to be eligible.

Scholarship recipients are based on academic standing, career and educa-tion objectives and financial need. Post-secondary students must also provide a resume and discuss their student chapter and community involvement. Applica-tions are judged by a committee made up HBA members, HBC board of trust-ees, HBA staff and school advisors from the schools listed above.

HBC Strategic Plan updateThe current strategic plan for

Home Builders Care went into effect last spring. The board of trustees has been working to continually evaluate the plan’s goals. The four key areas of this three-year strategic plan are fundraising, public relations, work-force development and operations. Keep reading to find out what your Foundation has done in each of these key areas.Fundraising: The HBC board set

out to raise money to continue fund-ing HBC programs and outreach activities. One strategy to accomplish

this goal was to initiate a long-term fundraising initiative to build the Foundation’s endowment fund and also help maintain current giving, support additional projects and provide for endowment growth. HBC created Framework for the Future to reflect this strategy. Home Builders Care hopes that Framework for the Future helps the Foundation become self-sustaining while also increasing its impact on the industry and community. All donations to the Founda-tion support Framework for the Future, except donations designated for Trades for Grades which directly support scholarships.

Other strategies under fundraising include exploring events. The board of trustees undertook this by partnering with Ferguson Bath, Kitchen & Lighting Gallery to sponsor a Fargo Force hockey game and, in turn, the event brought in $1,238 for the Foundation! Publicrelations: HBC has been working to increase

public and HBA of F-M member awareness of the Foun-dation. Activities like the Fargo Force game helped this initiative by promoting our Foundation to a wide group of people. We have set up a Facebook page and encourage all HBA members on Facebook to check it out at www.face-book.com/HomeBuildersCare. We also had a booth at the Red River Valley Home & Garden Show in February that was used to educate the public about what the Foundation does for the upcoming workforce and the Fargo-Moorhead community. In order to increase awareness within HBA membership, we have created a quarterly e-newsletter. The latest edition went out in July and is now available on our website at www.hbcfm.com. Workforcedevelopment:This area is relatively small

based on the state of our economy. While there is always a need for a skilled workforce, we have current members of the industry looking for work and it can be very hard for college graduates to find positions. However, workforce de-velopment is still an important part of HBC’s mission and the board aims to keep working on this objective. We are still giving away our normal fall scholarships which will be available soon. Operations:This area sets forth some basic guidelines

for creating roles, responsibilities and job descriptions for the board of trustees and committees. It also sets a strategy to identify the focus of HBC to determine what projects and

programs are the most important and should be addressed first.

This strategic plan has been a great guideline for the HBC Foundation to stay on track and move toward its goals. I think we have done a wonderful job putting the plan into action and we are coming closer and closer to meeting all of our goals. Thank you to everyone for seeing the value of having the Foundation and I hope to continu-ally see it grow.

replacement criteria laid out within the ordinance. • Replacementpenaltyforsignificantandnon-significanttreesinnew

developments: If replanting requirements cannot be met due to site spe-cific reasons, an amount equal to twice the cost of purchase and planting may be paid to the city to fund plantings elsewhere in the city.

• Treeprotectionmeasuresduringconstruction: There are a number of requirements on best practices that need to be performed during construc-tion on the area around “significant trees.” This area is measured as 1 foot for every inch of diameter of the tree. A couple of the more burden-some requirements are that you will need to place compaction prevention measures where you will drive near “significant” or “riparian” trees, and that there are no grade changes allowed near trees. Requirements can be waived by the forester, which means a visit to the Forestry Department will become more common.

The City Commission heard a presentation from the city forester in July and had a number of questions. Several of the commissioners questioned whether the city should dictate what can and can’t be done with trees in someone’s own backyard. The ability to put on an addition to a house would be severely limited with this ordinance in its current form without the added costs of tree replace-ments. The commission directed the draft ordinance be taken back to the task force and revised to remove the portions that deal with trees on private property.

The HBA continues to urge the commission to treat each waterway indepen-dently and use the same science for calculation of setback distance. This would likely lead to different distances on the Sheyenne River than on the Red River.

The task force also discussed the issue of setbacks along drains. City staff is planning to bring forth a recommendation that would require 500-feet right of way along drains. (250 feet on each side) Anything that is needed beyond that would be purchased by the city.

The HBA of F-M has also been working with city staff to prevent the ordi-nance from having a negative effect on existing neighborhoods. The first or-dinance heard by the commission would potentially have lead to the blighted conditions of hundreds of existing homes. The HBA cautioned the commission and asked for further consideration of the language and its negative effects.

The city plans to continue to have meetings regarding an increase in the base flood elevation levels, which set the minimum elevation of which a structure can be built. If you are interested in more information on this topic, please contact Rocky at (701) 232-5846 or [email protected].

Builder performance guildelines required in Minnesota

As of Jan. 1, Minnesota builders must, by law, include a set of perfor-mance guidelines with the contract for customers.

Guidelines are available to HBA of F-M members through the Builders Association of Minne-sota. BAM’s Building Performance Guidelines were put together by a task force made up of its members. Countless hours were dedicated to creating and refining this document to provide the best possible product for builders.

normally don’t attend these meetings.Education remains a key service of the HBA and our

offerings continue to grow. The strategic plan directs the HBA to offer member classes for Associate members. It also directs us to share the value of achieving professional designations through the National Association of Home Builders and the North Dakota Association of Builders with members, and promoting those who hold designations to the public.Progress:The HBA now offers Lunch & Learn classes

on a monthly basis that apply to small businesses and many Associates. We also offer electrical and power limited technician continuing education as well as safety training in conjunction with NDAB. A strong effort has been made to promote the professional designation programs in all consumer publications that we produce, and those programs are heavily promoted at all HBA educational offerings.

Government affairs has grown immensely in the past ten years. Our goal is to keep that momentum rolling and build on it; this is the basis of our existence, so it is critical. Every effort will be made to involve more members, build better relationships with government officials and commu-nicate our successes effectively, which goes back to com-municating return on investment.Progress: Your HBA worked with the F-M Chamber

of Commerce, Convention & Visitors Bureau, F-M Area Association of Realtors and Greater F-M Economic Devel-opment Corporation to organize “City Days on the Hill” in both Bismarck and St. Paul. We hope to increase our area’s

visibility with legislators and expand communication on our industry’s concerns and priorities. Your HBA also orga-nized members to participate in the North Dakota Associa-tion of Builders’ and Builders Association of Minnesota’s legislative events at each capitol. Early this year, your HBA also conducted legislative training to better-prepare lead-ers for activities during both states’ legislative sessions. It has taken initiative to become involved in campaigns that directly affect members, including activity in the half-cent sales tax election in 2010 and interviewing individuals run-ning for office in the metro area.

Operations speaks for itself: we must maintain the financial health of the HBA in uncertain economic times, increase our non-dues revenue efforts and keep a quality staff in place.Progress: Staff and the board of directors proposed a

balanced budget for 2011 and are keeping in mind the need for cuts if participation in our public events declines. We are also looking at ways to increase advertising participa-tion by members to supplement non-dues revenue.

members stating that the “piecemeal approach” represented by the bills “would further damage the already fragile housing market and impede economic recovery.” The letter added that NAHB supports housing finance reform, and “insists that a continuing and predictable government role is necessary to promote investor confidence and ensure liquidity and stability for homeownership and rental hous-ing.”

Along those lines, bipartisan legislation has been intro-duced in the House to develop a comprehensive plan with a clear federal backstop to provide a reliable flow of housing credit under all economic and financial market conditions.

Most recently, Reps. Gary Miller (R-Calif.) and Carolyn McCarthy (D-N.Y.) on July 7 introduced legislation at a Capitol Hill press event with NAHB Third Vice Chairman Kevin Kelly. H.R. 2413, the Secondary Market Facility for Residential Mortgages Act of 2011, would stabilize housing and ensure liquidity in the mortgage market by maintaining a federal role in the U.S. housing finance system.

Similar legislation (H.R. 1859) introduced this spring by Reps. John Campbell (R-Calif.) and Gary Peters (D-Mich.) would replace Fannie Mae and Freddie Mac with five pri-vate companies that would issue mortgage-backed securi-ties and have government backing.

These two legislative approaches to reform the govern-ment sponsored enterprises diverge from efforts by the House Republican leadership to fully privatize them and gradually diminish federal support.

The panel has yet to consider a proposal (H.R. 4889) by Rep. Jeb Hensarling (R-Texas) to end government control of Fannie Mae and Freddie Mac in two years and wind down or privatize the two housing government sponsored enterprises within five years.

During the hearing, Rep. Campbell echoed NAHB’s viewpoint, stating that the bills the panel was considering “are out of order” and that hearings should take place on comprehensive measures to replace Fannie Mae and Fred-die Mac that have been put forth by himself and Peters and by Miller and McCarthy.

Campbell also voiced opposition to the Hensarling bill and said that the panel should be considering the three bills that offer comprehensive plans.

NAHB has presented lawmakers with a detailed propos-al on restructuring the housing finance system to provide a consistent supply of mortgage liquidity and retain a federal backstop while limiting taxpayer exposure.

Actively involved in this issue, the association continues to encourage all congressional efforts that seek an appro-priate federal role to ensure a reliable and adequate flow of affordable housing credit.

Lake Agassiz Habitat for Humanity has kicked off its 20th anniversary with new construction beginning in June. This year, LAHFH will be building five homes, which shows significant progress since 1991 when the organization aver-aged only one or two homes every few years.

LAHFH thanks its volunteers and home sponsors for helping it grow, and this year, the affiliate is expanding into new build territory with its first-ever Habitat home in Barnesville. This home was also the first home of the build season, with the wall-raising ceremony held June 4 at 605 10th Ave. SE.

In addition to the Barnesville home, LAHFH participated in its 5th Women Build project. The construction on the single-family West Fargo home began June 15 and the wall raising was held June 18. The home is scheduled to be completed by September. LAHFH is also partnering with Thrivent Financial for Lutherans and area congregations to build a single-family home in Fargo. Construction began July 27 and the wall-raising ceremony is July 30. The home will be completed this fall. The 2011 build season will end in West Fargo with the construction of a duplex, sponsored by Easter Dakota Housing Alliance and other community supporters. Construction of the duplex will begin in early Sep-tember and will be home to two families before year end.

As LAHFH increases the number of homes built each season, it has also seen an increase in the need for the organization within the community. In fact, more than 150 people requested application information for the 2011 build season and 79 individuals attended the mandatory application orientation session. From this session, 41 families submitted applications and five families were chosen based on their need and ability to pay back the zero-interest loan.

While the organization has grown dramatically over the last two decades, many things have stayed the same, such as the mission of LAHFH to provide simple, decent and affordable housing to families in the community. Habitat would like to thank all its supporters and ask that they all continue to help as LAHFH looks forward to the next 20 years.

Volunteers needed to help rebuild Fargo-Moorhead communities

Do you have the skills it takes to lead volunteers in renovating a house in disrepair? Can you donate a couple of days a year to help a low income family? Rebuilding Together Fargo-Moor-head Area would like you to con-sider becoming a house captain.

Its mission is to bring volun-teers and communities together to improve the homes and lives of homeowners in need. The mission can be accomplished by offer-ing home repair and renovation services, free of charge, to low-income families with an emphasis on helping the elderly, veterans and people with disabilities.

A safe and healthy home for every person is the vision of Rebuilding Together Fargo-Moor-head Area. The people it serves are the hundreds of low-income hom-eowners in Cass and Clay coun-ties, many who live in substandard conditions. The need continues to grow as more homeowners are forced to choose between vital ne-cessities and critical home repair and maintenance.

Test locally for the National Association of Home Builders’ builder and remodeler certification courses. NAHB offers professional designations and courses to improve your skills, advance your career, and be recognized for your commitment to professional growth. The Certified Graduate Remodeler (CGR) and Certified Graduate Builder (CGB) are two designations designed to empha-size business and project management skills.

The first step toward earning a CGR designation is to take the Professional Remodeler Experience Profile (PREP), and for the CGB designation, the Builder Assessment Review (BAR).

PREP is a three-hour 130 multiple-choice assessment covering the following topic areas: marketing and sales, business administration, design, estimating and job cost, contracts, liability and risk management, project management. BAR is a three-hour 120 multiple-choice assessment which covers the following topic areas: building technology, business and finance, project management, sales and marketing. Your results will indicate which courses and how many courses will be required in a given subject area to receive your designation.

Plan now to attend the General Membership Meeting/HBA Picnic Aug. 18 at Oak Grove Park in Fargo. The picnic will be held in the main shelter. This event is family friendly and celebrates Associate membership by giving away $300 in prizes as well as a “grand prize.” We will have activities for the kids including two inflatable games from Games Galore. See page 30 for more details.

The HBA’s Fall Parade of Homes will be Sept. 10-11 and 17-18. We are looking forward to another great showing of Builder members’ homes with 32 entries. A listing is included on page 10.

Also, the Fall Home Show is Oct. 1-2 at the Fargo Civic Center. The HBA is bringing in Melissa Schmalenberger, MS. Simplicity, offering seminars on home organization. Her talks will address something for everyone: garage or-ganization, tidying your kitchen and cleaning up clutter hotspots like the fam-ily “launch pad,” or entryway. General InformationThe Membership Directory & Buyer’s Guide is a 206-page, spiral bound booklet published annually by the Home Builders Association of F-M. It contains articles of interest to consumers looking to buy, build or remodel a home, a complete listing of HBA member companies and features tabbed section covers that allow easy access to information. The directory is distributed to the HBA membership (approximately 830 companies), local government officials and area consumers at over 40 pick-up points throughout the metro area. Total circulation is 4,500. Nearly 70 percent of 2011 membership survey respondents indicated that they use the HBA’s Membership Directory & Buyer’s Guide on a regular basis.
