LATE BREAKING NEWS – LATE BREAKING NEWS

Court Decision Quashes 2024 Deadline for

Standard Plate Conversion

Ontario Supreme Court, Justice D.G. Stinson handed down his decision on January 30th, quashing

the City of Toronto’s deadline for converting all taxicab licences to the new Toronto Taxi Licence

(T.T.L.). His decision directly impacts Standard Taxi Plate Owners who were facing a 2024 deadline

requiring they convert to a T.T.L. by the imposed date. However, Justice D.G. Stinson did uphold all

remaining sections of the City’s new Taxi Bylaw.

In his decision, Justice D.G. Stinson wrote, “The serious impact on Standard Taxi Licence (STL)

holders underscores the importance of providing notice and a chance to be heard on the subject of a

mandatory conversion date, in accordance with the procedural By-law”. He noted that STL plate

holders were not given the opportunity to make representations on the enactment of the deadline.

The Toronto Taxi Alliance, the industry group composed of taxi owners and taxi fleet operators and

represented by lawyer Michael Binetti, of Affleck Greene McMurtry L.L.P., had argued, at a hearing

held on November 17th, 18th and 19th before the Ontario Superior Court of Justice, that the Toronto

Taxi Licence (T.T.L.) was enacted inappropriately because the ten (10) recommendations before City

Council had been deferred until February 2015 by the Licensing & Standards Committee. The TTA

argued that Council failed to comply with its own Procedural Bylaw.

DRIVER PROFILE

Shairyar Malik

Congratulations to Shairyar Malik!

Recipient of the A.T.T.C.L. Service Excellence Award!

A.T.T.C.L. recently received a compliment from a customer commending Shairyar for his professional customer service.

The customer describes him as her “angel”. At just past midnight on the morning of Saturday, February 7th, 2015, he picked up a female customer whose car had just been towed from the Broadview and Danforth area to the impound lot in Markham. Shairyar drove her to the impound lot and stayed with her until she was able to retrieve her car. She stated that she was very nervous because it was an isolated area, but Shairyar would not leave her side. He escorted her to her car and then followed her out of the compound to ensure her safety.

Shairyar, emigrated from Pakistan 14 years ago and has been driving cab for the past 12 years. He has been providing superior customer service with Crown Taxi for the past 4 years.

Shairyar will receive $50 from A.T.T.C.L. for his exemplary customer service. Well done!

LICENSING AND STANDARDS COMMITTEE - MARCH 24, 2015 - UPDATE

Licensing and Standards Committee, at its meeting held on March 24, 2015, had before it the report “Information Regarding Municipal Code, Chapter 545, Licensing, Article VIII, Owners and Drivers of Taxicabs” submitted by the Executive Director of Municipal Licensing and Standards.

This item was considered by Licensing and Standards Committee and was adopted with the following amendments:

1. Directed the Executive Director of Municipal Licensing and Standards to submit to the Licensing and Standards Committee at its April 21, 2015 meeting the necessary by-law amendments to reinstate the Standard Taxicab regulations that were in effect prior to February 19, 2014, and direct that notice be given of these amendments.

2. Directed the Executive Director of Municipal Licensing and Standards to undertake a review, ensure notice is provided, and report back to the April 21, 2015 meeting of the Licensing and Standards Committee on potential amendments to reinstate Ambassador licences, where the licence was cancelled on or after June 27, 2013 as a result of the licence holder's death, or on other compassionate grounds, to allow the transfer of the licence in accordance with the bylaw amendments adopted by City Council in February, 2014.

3. Directed the Executive Director of Municipal Licensing and Standards to report to the next regular meeting on April 21, 2015 with amendments that would reinstate the 45 day plate transfer rule that existed prior to the 2014 amendments.
