Sewage Treatment Plant at Aghabullogue

Notice in respect of the above was published in the Irish Examiner dated 25U1 August2001 in accordance with Article 131 of the Local Government (Planning andDevelopment) Regulations, 1994.

(a) Nature and Extent of the Proposed Development

The construction of a Sewage Treatment Plant to treat domestic sewage fromAghabullogue.

(b) Implications with respect to Planning and Development of the Area

The proposed development is in compliance with the provisions of the 1996CDP and in accordance with the proper planning and development of thearea.

(c) Submissions and Observations received

The closing date for the receipt of submissions and observations was 10th

October 2001.

Submissions were received from the Chief Planning Officer of Cork CountyCouncil, from the Southern Health Board and from the South WesternRegional Fisheries Board.

(d) Issues raised in the submissions / observations received and Cork CountyCouncil's responses thereto.

SOUTHERN HEALTH BOARD

Following inspection of the site there areno objections to the above proposedwastewater treatment plan. DrinkingWater sources in the area should bedetermined to be not affected bydevelopment and comply withseparation distance regulations.

SOUTH WESTERN REGIONALFISHERIES BOAIW

Thank you for forwarding details of theproposed Waste Water Treatment Plantto serve Aghabullogue. It is proposedthat effluent from the waste watertreatment plant will ultimately dischargeto the Delehinagh River, a valuablesalmonid spawning and nursery water,While the Board welcomes all proposalsto improve waste water treatmentfacilities, it also feels that allimprovements should at least investigatethe need for the use of the best availabletechnology. In this instance the Boardfeels that there is an onus on the Council(in light of the Phosphorous Regulations)to ensure that the proposed developmentdoes not cause a deterioration in theDelehinagh River in terms of itsphosphorous concentrations and trophicstatus. To this end the Board feels thatthe Council should firstly carry out astudy determine the current trophicstatus of the river and based on thispredict the impact of the proposed

I WWTP. The Board would ask to beI informed when this, information is

available.

There is a similar proposal to upgradeRylane Sewerage Treatment Works,which will also ultimately discharge to

Ithe Delehinagh River. In t.hiS context theBoard feels that time is optimum that to

This was done during the developmentof the proposal. The replacement of theexisting septic tank by this proprietarytreatment unit will improve the existingsituation.

The proposal IS to replace an existingseptic tank treatment plant for theCouncil's Housing Estate, by a largermore effective modern plant to treatsewage from the overall village.

Even though the population IS

significantly less than that set out in theUrban Wastewater Regulations beforephosphorus removal is required (250 inAghabullogue, whereas the minimum forP removal in the Regulations is 10,000), amore extensive study of the DelehinaghRiver was undertaken by Dixon.Brosnanon the Council's behalf.

This report recommended;

Section 11.3 that the BOD should be <20,Section 11.5 that the SS should be < 25,Section 11.6 that the total P should be <3and the mtho-phosphate should be <1.

which will define development limits forboth Rylane and Aghabullogue in thecontext of sustainable development andthe assimilative capacity of the river.

(e) It is proposed to proceed with the above development includingphosphorus removal. Suitable treatment technologies for phosphorusremoval on such a small scale will be identified and assessed over the nextfew months.

This report is submitted to the Members of Cork County Council in the course ofcompliance with Section 2(7) of the City and County Management (Amendment) Act1955.

Re: Waste Water Discharge (Authorisation) Regulations 2007 - fees payable inrespect of applications to be submitted by 22Dd December, 2009.

Dear Mr. Clinton,

I refer to the 72 certificate applications and 3 discharge authorisation licence applicationswhich will be submitted by the council under the above regulations before the 22nd

December next.

I note that the fees payable in respect of these applications amount to €246,000 and referyou to our letter of 7th November 2008 (sent by Ted O'Leary, Senior Executive Officer)seeking a rebate/reduction, as is provided for under Art 38 (3) of the regulations. I notethat since that letter the council has paid a further € 570,000 in applications fees meaningthat the total amount paid by the council to date amounts to € 1,245,000.

As you will appreciate, in the current economic climate, the amount payable in respect ofthis final batch of applications is a significant sum that was not budgeted for in 2009.Moreover we have paid a substantial amount in fees already and have made our case for areduction/rebate. Accordingly, I must advise that we are not submitting payment inrespect of these applications as we anticipate the rebate due to the council exceeds thefees payable.
