CLARIFICATION

In pursuance of the Judgments of the Hon’ble Supreme Court of India, in the case

TMA Pai Foundation (2002) 8SCC481 and P A Inamdar v/s State of Maharashtra &

others 2005 (6) SCC 537, Unaided Private Medical & Dental Colleges have a right to

admit students and to hold Common Entrance Test, Therefore at this stage

admissions to all the seats in the Unaided Private Medical & Dental College except

NRI seats will be done as per Asso-CET 2015 merit only.

As per the aforesaid P A Inamdar judgment there is NRI quota upto 15% at the

discretion of the member colleges. Particulars regarding the same will be displayed

on the official website of AMUPMDC.

The Information Brochure is approved by the Pravesh Niyantran Samiti

The programme mentioned in this brochure is applicable to the admissions to be

given for the Academic year 2015-16 at the Unaided Private Medical, Dental and all

Other Health Science Courses Mentioned in Brochure.

The Association is conducting Asso-CET 2015 as per the Schedule in the order of

the Hon'ble High Court in Review Petition No. 120 of 2006 in Writ petition No 6332 of

2005 dated 10/8/2006.

However, it is made amply clear that after publication of the brochure, if there is any

legislation by State Legislature or Parliament or Judicial pronouncement not is

consonance with above referred Judgments of the Apex Court AMUPMDC reserves

its right to challenge the same.

1. PREAMBLE The Association of Managements of Unaided Private Medical and Dental Colleges, Maharashtra (AMUPMDC) herein after referred as Association was established in 1994 and

registered under the Societies Registration Act 1860 at No. GBBSD No. 308/1994 dated 30th

March, 1994.

A Common Entrance Test (Asso-CET 2015) will be conducted by the Association for

admissions to Health Science Courses in Private Unaided Medical, Dental, Ayurvedic,

Physiotherapy, Occupational Therapy and Nursing Colleges (i.e. MBBS, BDS, BAMS, BPTh,

BOTh, BASLP, BSc-Nursing).

Asso-CET 2015 will be held in the form of multiple – choice questions. The answer sheets are

assessed by scanning with the help of computer. The admissions will be on the basis of merit

in Asso-CET 2015 conducted by Association.

The brochure for Asso-CET 2015 will be displayed on official website of AMUPMDC. It also

contains Rules for admission and information about Colleges. These Rules are applicable for

admission process only for the Academic year 2015-16.

2. COMPETENT AUTHORITY

2.1. The Competent Authority appointed by the Association will be available at

Association’s office with prior appointment.

2.2. The Competent Authority will supervise the conduct of Asso-CET 2015 and also

supervise the declaration of Merit List. The Competent Authority will issue necessary

instructions for implementation of these rules and provide relevant information to be

published and communicated.

2.3. The Competent Authority will be Chairperson of the Appeal Committee for

representations, queries, complaints etc. of the candidates.

3. APPLICATION The information Brochure and online application Form will be available from

23/03/2015 to 25/04/2015. Before filling Online Application form, download information

brochure of Asso-CET 2015 and read the same carefully. The online form should be

submitted as mentioned below.

3.1. Online application for Asso CET-2015 Link will be available on www.amupmdc.org.

Click on the above Link.

3.2. Go through the Instructions for filling online Application Form. After reading

Instructions, applicant has to click NEXT button to display Online Application form.

3.3. Application form will be displayed.

3.4. Candidate should fill all the application form along with Scanned photograph and

signature.

3.5. System will validate the required information filld in before allowing the submission.

3.6. Eligible Candidate only will be able to submit the form. There is provision to make

changes in the Application Form. However, before Clicking on the “SUBMIT”

Button, Candidate should verify the Correctness of entries made in application

form. There is no provision to make changes in the application form once

“SUBMIT” button is clicked.

3.7. During submission, system will ask the Candidate for Password.

3.8. Bank Challan will be Displayed in duplicate.

3.9. Candidate should take printout of Bank Challan, With this Challan pay the fee Rs.

3000.00 by Cash towards the Processing of Application Form & Examination Fee, in

account of AMUPMDC in any Branch of State Bank of India in next two working

days onwards, from the day of Printing of Challan and obtain your copy of Challan

showing Journal ID / Transaction ID.

3.10. Unique Application No./Username will be available on challan for the fee Rs. 3,000/-

for Processing of Application Form & Examination Fee and same details will be

mailed to the Candidate on his given E-mail ID.

3.11. ‘LOG IN’ Link will be available on www.amupmdc.org

3.12. Candidate should login with Application No. /User Name and Password to Verify the

Application Form.

3.13. Applicants need not send copy of Application Form or any Document to this office.

However he can take printout of Application Form for his/her personal records.

3.14. The Applicants must possess the required criteria and education qualification as

mentioned in the Information Brochure of Asso CET-2015.

3.15. Please note that if you commit any mistake in filling the online Application Form, it

cannot be corrected by this office. The office will take no responsibility of any kind

for such Forms.

3.16. The candidate shall submit one and only one application form. In case candidate

submits more than one application form, he/she shall be liable for disqualification for

appearing for Asso-CET 2015.

4. ADMIT CARDS

The Admit card will be available on our Website of AMUPMDC between 10-05-2015 to 16-05-2015. The candidate can take printout of Admit card from our official website www.amupmdc.org and go to the Centre with printout of admit card and Photo ID of School last attended.

5. CONDUCT OF COMMON ENTRANCE TEST Asso-CET 2015 5.1. Asso-CET 2015 shall be conducted by the Competent Authority appointed by

the Association of Managements of Unaided Private Medical and Dental

Colleges. Candidates should go through the contents of this Brochure

carefully and for any clarification and genuine doubts / difficulties approach

the Office of AMUPMDC, Mumbai. Further information, if any, about

Entrance Test, will be uploaded and published regularly on the Association

website i.e. www.amupmdc.org Students & Parents are requested to visit the

website regularly.

5.2. Asso-CET 2015 will be conducted at the following cities.

Centres within Maharashtra State:

(01) Mumbai, (02) Navi Mumbai, (03) Thane (City), (04) Pune, (05) Nashik, (06) Dhule, (07) Jalgaon, (08) Ahmednagar, (09) Solapur, (10) Kolhapur, (11) Aurangabad, (12) Parbhani, (13) Nanded, (14) Latur, (15) Nagpur, (16) Akola, (17) Amravati,

Centres outside Maharashtra State:

(18) Delhi, (19) Chandigarh, (20) Lucknow, (21) Jaipur, (22) Bhopal, (23) Indore, (24) Ahmedabad. (25) Hyderabad, (26) Kolkata

Note: Change of Examination Centre is not permitted.

Please Note: Association reserves the right to add or delete the examination centers.

Due to unforeseen circumstances like mass copying, leakage of question paper, entry

of unauthorized person(s) in the Examination Centres/halls, natural calamities, riots,

etc. or any other reasons beyond control of AMUPMDC for the smooth conduct of

Asso-CET 2015 the Competent Authority may cancel the examination at such or all

centre(s). It shall be further notified on the website regarding fresh programme for

conduct of Asso-CET 2015 at such centre(s) only.

5.3. Syllabus for the Asso-CET 2015 will be displayed on website of AMUPMDC

(www.amupmdc.org). Based on 12th Std.

5.4. The Asso-CET 2015 will consist of one common question paper in the subjects of

Physics, Chemistry and Biology (Botany & Zoology) consisting of 200 Multiple

Choice Question (MCQs) 50 in Physics, 50 in Chemistry & 100 in Biology. The

candidate is expected to attempt all the 200 questions. Out of four circles provided

for selection of answer against a question, the candidate should fill-up one circle of

right choice with black ball pen only. Each correct answer will be given one mark.

There shall be no negative marking for wrong answers. Scratching, overwriting, tick

marks, erasers, whiteners & multiple answers will be considered as wrong answers

and no marks will be awarded to them. Use of pencil is prohibited.

5.5. Duration of examination will be of 3 hours.

5.6. The medium of examination shall be English Only.

5.7. No candidate will be allowed to appear for Asso-CET 2015 unless he /she holds

Admit Card issued by the Competent Authority and Identity card of the last attended

school. 5.8. SCHEDULE OF Asso-CET 2015:

Date: Sunday, 17th May 2015. Time: 2 pm to 5 pm Subjects: Physics, Chemistry & Biology

6. ELIGIBILITY A candidate will be eligible for admission to Health Science Courses i.e. MBBS, BDS, BAMS,

BPTh, BOTh, BSc-Nursing for the academic year 2015–16 on fulfillment of the following

conditions:

6.1 The candidate may be an Indian National / NRI / Foreign National. The candidate is

required to produce proof in support of his/her Nationality from a District Magistrate,

Additional Magistrate or Metropolitan Magistrate, School Leaving certificate of

HSC/12th Std indicating the nationality of the candidate as Indian or Valid Passport

also shall be considered as sufficient proof of Nationality.

6.2 For Admissions to MBBS, BDS, B.Sc Nursing the candidate must be born on or before

31ST December 1998 to be eligible to appear for Asso-CET 2015. For admissions to

BAMS candidate must be born on or before 1st October 1998. The Secondary School

Certificate (i.e. SSC) or equivalent examination certificate endorsing the date of birth

will constitute the valid proof.

6.3 The candidate must be medically fit and must submit a certificate of medical fitness

Annexure “G ”.

6.4 Eligibility Criteria for qualifying Examination for various courses:- 6.4.1 For MBBS, BDS and BAMS :

A candidate belonging to open category must have obtained not less than

50% Marks in Physics, Chemistry & Biology subject taken together at the

XIIStd / HSC (or Equivalent) Examination.

A Candidates belonging to Reserved Category must have obtained not less

than 40% Marks Physics, Chemistry & Biology subject taken together at the

HSC (or Equivalent) Examination.

6.4.2 For B. Sc (Nursing):-

A candidate belonging to open category must have obtained not less than

45% Marks in Physics, Chemistry, Biology & English subject taken together

at the HSC (or Equivalent) Examination.

A Candidates belonging to Reserved Category must have obtained not less

than 40% Marks Physics, Chemistry, Biology & English subject taken

together at the HSC (or Equivalent) Examination.

6.4.3 For BPTh, BOTh, BASLP rule no. 6.4.1, 6.4.2 and 6.4.3 is not applicable to

this course, passing at Std. XII or HSC or equivalent examination is

necessary.

6.5 No rounding off of the marks secured by the candidate will be done in individual

subject or final total while converting marks of the individual subject out of 100 or total

marks out of 300. For example, if the total of the marks in three subjects comes to 149

out of 300, percentage comes to 49.66 that will not qualify the candidate.

6.6 The candidates who are appearing for the qualifying examination i.e. HSC or

equivalent in March/April–2015 are also eligible to appear for Asso-CET 2015,

provided they must fulfill the eligibility criteria.

6.7 The eligibility conditions may vary in accordance with Judicial Pronouncements and

orders issued by appropriate Authorities from time to time.

7. REVALUATION OF HSC / EQUIVALENT MARKS

If the marks of a candidate at HSC (or equivalent) examination have been revised after re–

evaluation, the eligibility of the candidate may be altered. The candidate will be permitted to

avail the benefit of revised marks subject to his/her representation to the Competent Authority

and production of necessary proof to the satisfaction of the Competent Authority. The

candidates must note that the Competent Authority will not be responsible for late declaration

of result of such re-evaluations or late submissions of proof due to any reason whatsoever

and request to consider / reconsider the claim of the candidate arising out of such re-

evaluation shall not be entertained.

8. RESERVATIONS

Admissions under the constitutional reservation seats will be governed by the Maharashtra Schedule Castes, Scheduled Tribes, Denotified Tribes, (Vimukt Jati), Nomadic Tribes, Other Backward Classes and Special Backward Category (regulation of issuance and verification of) Caste Certificate Act 2000 (Maharashtra Act No. XXIII of 2001). In this connection Govt. of Maharashtra has issued following notification Annexure “B”. Reservation of Seats for SC/ST/OBC/VJ/NT1/NT2/NT3 will be as per Government notification No MED/-2006/1196/CR206/06 Edu-1(2) dated 24/06/2006. Candidate belonging to Reserved Category will be required to submit the caste certificate and the caste/tribe validity certificate from the appropriate authorities of the Government of Maharashtra. Candidate who want to claim the benefit of constitutional reservation has to make such a claim in the original application form for Asso CET, later requests will not be considered as per Ho’ble High Court Orders. NON CREAMY LAYER : A candidate claiming the benefit of reservation under categories applicable will be required to produce Non – Creamy layer Certificate valid upto 31-03-2015. The candidate belonging to Creamy layer must note that the Provision of reservation is Not applicable to them.

9. MARKSHEET

Mark sheet will be available on the web site of AMUPMDC

(www.amupmdc.org) with unique QR Code. The candidate can take print out

of the Mark Sheet from the official website and go to the allotted college.

Mark Sheets will be verified with the help of Unique QR Code by the

admission Committee of concerned College.

10. VERIFICATION OF MARKS The answer sheets of Asso-CET 2015 examination will be assessed by scanning

with the help of computer. The candidate wishes to verify the Answer sheet should

apply online from 28th May 2015 to 31st May 2015. After applying online the students

should pay verificication fee of Rs. 1,000/- (Rupees One Thousand Only) by challan

to State Bank of India only up to 2nd June 2015. The candidate will be given

photocopy of the answer sheet and model answer key after verification by the

Competent Authority. In case, there is any change in the marks, the revised mark-

sheet will be issued.

11. MERIT LIST 11.1. Basis of Merit Ranking.

Marks obtained by the candidate at the Asso-CET 2015 will form the basis of

Merit Ranking.

11.2. Tie–Breakers.

In case of equal marks at the Asso-CET 2015, the following procedure shall

be adopted for deciding inter–se–merit.

11.3. First level: A candidate with higher marks in Biology at the Asso-CET 2015

Exam shall be preferred, if the tie still persists then:

11.4. Second level: A candidate with higher marks in Chemistry at the Asso-CET

2015 Exam shall be preferred, if the tie still persists then;

11.5. Third level: A candidate with higher percentage of aggregate marks at the

SSC (or equivalent) Exam shall be preferred, if the tie still persists then:

11.6. Fourth level: An older candidate shall be preferred over a younger candidate.

12. INSTRUCTION FOR FILLING-UP PREFERENCE FORM 12.1. Admissions to the Health Science Courses for the first year for the academic

year 2015-16 will be done by filling up the Preference Form online. The

Preference filled by the Candidate will be centrally processed by computer

on the basis of merit cum preference and list of selected candidates will be

declared on the Official Website of AMUPMDC (www.amupmdc.org).

Candidates selected should report to the allotted College/Course within the

stipulated time. Candidates can fill up their preference froms online from 7/06/2015 to

12/06/2015

12.2. For MBBS and BDS course minimum 50% marks are required in Asso-CET

2015 for open Category Students and 40% marks are required for Reserve

Category Students. Those who do not comply with this condition will not be

eligible to apply for MBBS & BDS Course.

12.3. Candidate will fill-in the relevant information along with his/her Roll Number

Merit Number etc. of Asso-CET 2015.

12.4. Only one Preference Form should be submitted online.

12.5. In case the candidate is not eligible for admission as per the rules, the Preference

Form submitted online will be treated as cancelled.

12.6. Candidate should read all the instructions before filling the Online Preference Form.

Candidate should carefully fill-in the College Code and after submission take one

printout for personal record.

12.7. List of Colleges and their Code Numbers will be displayed on website from 5st June 2015. .

12.8. Candidate can fill minimum one preference or any desired number upto Maximum

100 Preferences available. The same course and College Code should not be filled

more than once. In case the candidate fills the same Code More than once higher

Preference will be considered and subsequent repeated Preference numbers will be

ignored. If the candidate fills any wrong course and College code it will be rejected. 12.9. If a Candidate does not give Preference for a Particular College then it means that

he/she is not interested in that College. Candidate should note that there will be no

Change/Addition /Deletion in the Preference at any stage after submission of preference form.

12.10. The candidate selected as per his/her Merit Cum Preference for a Particular College

has to join the College as per Procedure. In case the candidate fails to join the

Allotted College he/she is debarred/dropped from subsequent admission process of

Asso-CET 2015. 12.10.1 candidate once selected is eligible to be considered for the subsequent rounds for

betterment only when he/she reports to the allotted college, however doesnot give

the status retention form.

12.11. In case the candidate is not selected in the First Selected List then he/she remains

eligible for the subsequent Rounds as per Preference which he/she has given in the

Preference Form for MBBS/BDS only. 12.12. For filling of vacant seats after the First Round same Preference Form will be

considered and no separate Preference Form will be required to be filled in by the

candidate.

12.13. Candidate should submit only one Preference Form online.

12.14. Candidate should note that the Preference of College Codes once entered in the

data shall be final and irrevocable. Thereafter there cannot be change addition or

deletion of Preference entered by Candidate. This final data shall be used in entire

selection Process for the admission to Health Science Courses.

13. SELECTION PROCESS

Pursuant to the orders dt 10-08-2006 the Hon'ble High Court of Bombay in writ

Petition No, 5655 of 2006, and orders dated 08-05-12 of the Hon’ble Supreme Court in

Civil Petition No. 27089/11 & Civil Appeal No. 4318/12, the Selection to all the Health Science

Courses will be made as per Merit Cum Preference given by the candidates. The Selection

Process will be as follows:

13.1. As per the above orders there will be Three Rounds of Selection Process for

MBBS & BDS Courses only.

13.2. For BAMS, BPTh, Both, B.Sc Nursing there will be only only ONE Round of

Centralized Admission. Thereafter the respective Association or Such

Colleges will fill-in the unfilled Seats at their own level on the basis of Merit of Asso-

CET 2015.

13.3. For MBBS & BDS Courses there shall be Three Rounds of selection of

candidates depending on the availability of vacant seats. The selection will

be on the basis of Merit and the Preference submitted by the candidates in

their Preference Form. For second and third rounds no separate Preference

Form will be filled in by the candidates. The choices of the College & Course

once entered in the data shall be final and irrevocable. This final data shall

be used in entire selection process for the admission to first year Health

Science Courses for the academic year 2015–16.

13.4. For MBBS & BDS Courses

After Three rounds of selection of candidates, the vacant seats will be filled in

by the respective Colleges at their own level on the basis of merit of Asso

CET–2015.

13.5. The candidates may kindly note that while filling the Preference form Asso-

CET 2015 merit number will be operated from number one onwards in each

Round of selection. The candidate selected in previous Round will be

considered for betterment in the subsequent Round. The betterment means

the higher Preference exercised by the candidate. The shift in such

betterment shall be compulsory and mandatory except for those who have

filled Status Retention Form. Such a candidate who has filled Status

Retention Form will not be considered for any subsequent Rounds of selection

process for the year 2015–16.

13.6. Based on Merit and Preference given, the seat will be allotted on merit and

the allotment will be displayed on Official Website of AMUPMDC

(www.amupmdc.org). No separate letters will be issued to the candidates. They should report to the allotted Colleges with a printout

downloaded from the website.

13.7. Candidates as per the allotment should report along with all Original

Certificates and a set of attested photocopies of each document at the

allotted College as per the schedule. All Original Certificates will be verified

by the allotted College before finalizing the admission. Certificates &

documents should be submitted as per the list given below:

a) Asso-CET 2015 Mark Sheet.

b) Nationality Certificate or Valid Passport.

c) Proof of Age (SSC Passing Certificate).

d) Statement of Marks obtained in the HSC or equivalent examination.

e) Passing Certificate of HSC or equivalent.

f) Last School/College Leaving Certificate.

g) Medical Fitness Certificate as per Annexure - G. h) Caste Certificate Caste Validity and non-creamylayer issued by

appropriate authorities of the Govt. of Maharashtra where applicable.

13.8. Canvassing directly or indirectly for the allotment of seat would disqualify the

candidate for admission. Influencing the staff by unfair means will lead to

cancellation of allotted seat and such candidate will also face disqualification for

appearance in the subsequent Asso-CET.

13.9. Candidate selected for admission shall be subject to disciplinary rules of

University/Institution/Government and Management.

13.10. A candidate selected for any Health Science Course as per Merit cum

Preference will not be allowed for change of college on mutual basis.

Request for mutual transfer is not permissible. Such request will

not be entertained.

13.11. The selection made by the Competent Authority as per procedure is final and will be

binding on the candidate.

13.12. Status Retention of Admissions : After selection in first round if the candidate

desires to retain the same selection (Course & College) and does not want to take

any further betterment then he/she can do so by filing "Status Retention Form" in

prescribed proforma given in the Brochure. Status Retention Form is to be submitted

to the Competent Authority through the College Principal/Dean where he/she is

admitted. However Candidate should note that once Retention Form is given his/her

admission is confirmed in that College and his/her name will be deleted from the

further selection process for the academic year 2015–16. (Annexure “D”)

13.13. To confirm the admission the Candidate will have to deposit his/her all relevant

Original Certificates, documents along with the tuition fees to the concerned college

where the candidate is admitted

14. PROCESS FOR FILLING VACANT SEATS of MBBS & BDS Courses only.

14.1. After first round, the vacant seats will be filled-in. For these seats, the selected

candidates who have not given the status retention as well as not selected

candidates who have filled the Preference Form are eligible. For this process Asso-

CET 2015 Merit List will be operated from Merit Number 1 onwards. The Candidate

selected in round one will be considered for betterment in the 2nd round and third

round of selection process. Provided that they have not submitted their status

retention froms. "Betterment" means the higher preference exercised by the

candidates. The shift in such betterment shall be compulsory and mandatory, except

as provided in para no. 13.12.

14.2. The Competent Authority will issue notice which will be displayed on the website of

AMUPMDC indicating the date of subsequent round of selection process.

14.3. The following candidates will not be eligible for subsequent admission process.

a) A candidate who is selected as per his/her merit cum preference, but does not

join the allotted college or cancels the admission after joining is not eligible for

further selection process.

b) Accepting admission but not reporting to the College and/or not paying the fees.

14.4. For MBBS & BDS after 3nd round and the remaining other Health Science Courses after 1st round the vacant seats will be filled in by the respective Colleges as per the

procedure laid down bt Pravesh Niyantran Samiti.

15. DISQUALIFICATION FOR ADMISSION

Notwithstanding anything stated in the rules here-in-above, a candidate who was

allotted a seat in any course under MUHS Nashik in previous year(s) and who

vacates/abandons it after availing the said seat, has completed such a period of

course which would result into lapse of the said seat, will not be eligible for

admission for the next two years.

16. FEES FOR COURSES

16.1. Fee Structure: Fee Structure will be as per declaration of the Shikshan Shulka

Samiti, appropriate authority and Judicial pronouncements. The fees declared by the

Shikshan Shulka Samiti is displayed on the official website of the Samiti i.e.

www.sspnsamiti.gov.in. 16.2. Payment of Fees: The Candidate shall be admitted only on payment of full fees as

declared by Shikshan Shulka Samiti or Judicial pronouncements.

17. NUMBER OF SEATS Information regarding the number of seats available in various institutions/colleges for

admission on the basis of merit in Asso-CET 2015 will be displayed on the official website of

the Association.

18. CANCELLATION and REFUND OF FEES

18.1. CANCELLATION a) The Selected candidate must join the College at which he/she is selected on

or before the date prescribed by the Competent Authority. Failing which

his/her admission stands cancelled.

b) The selected candidate who has taken admission wishes to cancel the

admission should cancel it at the respective College. The College should

accept the cancellation and inform the Competent Authority along with copy of

the cancellation Letter immediately (Annexure E)

18.2. REFUND OF FEE a) If a candidate cancels his/her admission before the Cut-off-date, the

College/Institute has to deduct Rs. 1000.00 as administrative charges and

balance amount of fees paid by a students be refunded within two days,

otherwise the same amounts to profiteering and charging a capitation fees. The

Samiti futher directs that the College/Institure should also return the original

documents/certificates collected ftom the students within two days.

b) If a candidate expires within three months from the date of admission full refund

shall be made after deducting Rs. 1000.00 as administrative charges.

c) After Cut-off-date except as in (b) above no refund shall be made.

19. GRANTING OF TERM

Maharashtra University of Health Sciences, Nashik shall take the decision regarding granting

of the term and the eligibility of selected candidates. The decision taken by MUHS will be final

and binding on the candidate/student.

20. CONDUCT AND DISCIPLINE. 20.1. The student while studying in the Health Sciences Courses, if found indulging in

antinational activities, unlawful activities or ragging in any form, in addition to the

provisions of Acts and Law enforced by Government, will be liable to be expelled

from the college by the Dean / Principal of the College.

20.1.1 Pursuant to the orders in W. P. (Civil) No. 645 of 1999, Hon’ble Supreme Court of

India, has directed the Department of Human resources Development and

Education, Govt. of India, to take all necessary steps to curb the menace of ragging

and take severe action against the students involved in such activities. Students to

take serious note of the same.

20.1.2 As per the provisions of Maharashtra Act XXXIII known as “Maharashtra Prohibition

of Ragging Act of 1999”, students indulging in ragging can be punished under the

Act resulting in suspension, expulsion from the college and imprisonment. 20.2. Failure of the candidate in making full and correct statements in the application form

and / or Suppression of any information is liable for disqualification of the candidate,

Even at later date. such a candidate will be debarred from the entire selection

process and pursuing the course of studies.

20.3. It is the responsibility of every candidate to submit proper documents. Any attempt to

submit documents, which are not genuine, will lead to cancellation of the admission

of the candidate, forfeiture of the fees, deposits and expulsion of the candidate from

the college by the Competent Authority or by his authorized official. The name of

such candidate/s shall be deleted from the Merit List.

20.4. Any issue not dealt here-in above will be dealt with, when arising, fully and finally by

the Competent Authority.

21. INSURANCE SCHEME In accordance with GR. NO. MED-100/880/CR–129/EDU–1, dated 23/10/2003 "Amartya Shiksha Yojana", an insurance scheme has been introduced by Govt. of Maharashtra. The details about this scheme shall be known to the candidate at the time of admission.

Annexure - “ B ”

CONSTITUTIONAL RESERVATIONS

1. The candidates recognized by the State of Maharashtra as belonging to the following Backward Classes, shall alone be eligible to claim admissions as against the seats reserved for such backward class categories. These Backward Class categories are as follows:- (i) Scheduled Castes and Scheduled Caste converts to Buddhism (SC) 6.50 % (ii) Scheduled Tribes (ST) 3.50 % (iii) Vimukta Jati ( VJ/DT - A ) 1.50 % (iv) Nomadic Tribes ( NT - B ) 1.25 % (v) Nomadic Tribes ( NT - C ) 1.75 % (vi) Nomadic Tribes ( NT - D ) 1.00 % (vii) Other Backward Category (OBC) including SBC 9.50 %

Total 25.00 % 2. Candidates belonging to aforesaid Backward Class categories will be required to submit

the Caste Certificate and the Caste/Tribe Validity Certificate. 3. Caste certificate issuing authority: - Caste certificate stating that the caste is recognized

under a particular backward class category in Maharashtra state is issued by Sub-Divisional Magistrate /Executive Magistrate /Metropolitan Magistrate in Maharashtra state.

4. The Caste/Tribe validity Certificate Issuing Authorities are as follows:- 4.1. For Candidates belonging to Scheduled Caste, Scheduled Caste converts to

Buddhism, Vimukta Jati (A), Nomadic Tribes B, C & D and Other Backward Class, Caste Validity Certificate is issued by Divisional Caste Scrutiny Committee of respective Divisional Social Welfare Office (Mumbai, Pune, Nashik, Aurangabad, Amravati, Nagpur and Latur).

4.2. For Candidates belonging to Scheduled Tribe the Tribe Validity Certificate is issued by Commissioner/Jt. Commissioner, Tribe Scrutiny Committee of respective Region [Kokan (Thane), Pune, Nashik, Aurangabad, Amravati, Nagpur, Nandurbar and Gadchiroli].

5. The candidates who have claimed the Constitutional Reservation in the original

Application Form must submit Caste Validity Certificate at the time of filling the Preference Form, failing which the category claim, will not be granted.

6. NON-CREAMY LAYER

A candidate belonging to ‘Creamy Layer’ amongst the categories (iii), (iv), (v), (vi) and (vii) must note that the provision of reservation is NOT applicable to him/her. A candidate claiming benefit of reservation under the categories (iii), (iv), (v), (vi) and (vii) above will be required to produce Non-Creamy Layer Certificate in the name of candidate as specified in the Government resolution No. – CBC 10 / 2006 / CR 15 / Ma.V.K., dated 30-6-2006.. The certificate stating that it is valid upto 31/3/2015 should be submitted at the time of filling up of Preference Form. The Non-Creamy Layer Certificate is issued by Sub- Divisional Officer/Deputy Collector/Collector of the district. However, such a Non-Creamy Layer Certificate shall be produced in any case on or before the last date of filling up of Preference Form, failing which the category claim will not be granted.

Applicants belonging to Special Backward Category

N.B.: Hon’ble High Court Mumbai had stayed admission to Special Backward Category as a separate quota and therefore, vide Government Circular from Social Welfare, Cultural Affairs and Sports Department No. CBC-1095/WS/264/BCW-5 dated 24th October 1995, the persons belonging to Special Backward Category (SBC) are to be considered as OBC candidates. Admission under constitutional reservation seat will be governed by the Maharashtra Schedule Castes, Scheduled Tribes, Denotified Tribes (Vimukta Jatis), Nomadic Tribes, Other Backward Classes and Special Backward Category (Regulation of Issuance and Verification of) Caste Certificate Act, 2000 (Mah. Act No.XXIII of 2001). Candidates are instructued to note following provisions of the said act; Para 10: (Benefits secured on the basis of false Caste Certificate to be withdrawn)

1. Whoever not being a person belonging to any of the Scheduled Castes, Scheduled Tribes, Denotified Tribes, De-notified tribes, (Vimukta Jatis), Nomadic Tribes, Other Backward Classes or Special

Backward Category secures admission in any educational institution against a seat reserved for such Castes, Tribes or Classes, or secures any appointment in the Government, local authority or in any other company of Corporation, owned or controlled by the Government or in any Government aided institution or Co-Operative Society against a post reserved for such Castes, Tribes or Classes by producing a false Caste Certificate shall, on cancellation of the Caste Certificate by the Scrutiny Committee, be liable to be debarred from the concerned educational institution, or as the case may be, discharged from the said employment forthwith and any other benefits enjoyed or derived by virtue of such admission or appointment by such person as aforesaid shall be withdrawn forthwith.

2. Any amount paid to such person by the Government or any other agency by way of scholarship, grant, allowance or other financial benefit shall be recovered from such person as an arrears of land revenue.

3. Notwithstanding anything contained in any Act for the time being in force, any Degree, Diploma or any other educational qualification acquired by such person after securing admission in any educational institution on the basis of a Caste Certificate which is subsequently proved to be false shall also stand cancelled, on cancellation of such Caste Certificate, by the Scrutiny Committee.

4. Notwithstanding anything contained in any law for the time being in force, a person shall be disqualified for being a member of any statutory body if he has contested the election for local authority, Co-operative Society or any statutory body on the seat reserved for any of Scheduled Castes, Scheduled Tribes, De-notified Tribes, (Vimukt jatis), Nomadic Tribes, Other Backward Classes or Special Backward Category by procuring a false Caste Certificate as belonging to such Caste, Tribe or Class on such false Caste Certificate being cancelled by the Scrutiny Committee; and any benefits obtained by such person shall be recoverable as arrears of land revenue and the election of such person shall be deemed to have been terminated retrospectively.

Para 11: (Offences & Penalties) 1 Whoever,- (a) Obtains a false Caste Certificate by furnishing false information or filing false statements or documents or any

other fraudulent means ; or (b) not being a person belonging to any of the Scheduled Tribes, De-notified Tribes, (Vimukt jatis), Nomadic Tribes,

Other Backward Classes or Special Backward Category secures any benefits or appointment exclusively reserved for such Castes, Tribes or Classes in the Government, local authority or any other company or corporation owned or controlled by the Government or in any Government aided institution, or secures admission in any educational institution against a seat exclusively reserved for such Castes, Tribes or Classes or is elected to any of the elective offices of local authority or Co-operative Society against the office, reserved for such Castes, Tribes of Classes by producing a false Caste Certificate; shall, on conviction, be punished , with rigorous imprisonment for a term which shall not be less than six months but which may extent up to two years or with fine which shall not be less than two thousand rupees, but which may extend up to twenty thousand rupees or both.

2 No court shall take cognizance of an offence punishable under this section except upon a complaint, in writing, made by the scrutiny Committee or by any other officer duly authorized by the Scrutiny Committee for this purpose.

Para 12: (Offences under Act to be cognizable & non-bailable) Notwithstanding anything contained in the Code of Criminal Procedure; 1973 --

(a) offence punishable under section 11 shall be cognizable and non-bailable; (b) every offence punishable under this Act, shall be tried by any Magistrate of First Class in a summery way and

provisions of sections 262except sub-section(2) to 265 both inclusive of this Code shall as for as possible may be applied to such trial.

Para 13: (Penalty for issuing false Caste Certificate)) 1 Any person or authority performing the functions of Competent Authority under this act, who intentionally issues

of false Caste Certificate shall earn conviction, be punished with rigorous imprisonment for a term which shall not be less than six months but which may extend up to two years or with fine which shall not be less than two thousand rupees, but which may extend up to twenty thousand rupees or both.

2 No court shall take cognizance of an offence punishable under this section except with the previous sanction of the Government.

Para 14: (Penalty for abatement) Whoever abets any offence punishable under this Act shall be punished with the punishment provided for in this Act for such offence.
