Queen of Darkness GmbH General Terms and Conditions of Business1. Area of applicationOur policies apply to all contracts with the firm Queen of Darkness GmbH which a contracting party makes with our enterprise, regardless weather verbal, telephonic, written, by email or order transactions over our on-line Shop. Opposing conditions introduced by the customer are invalid.

2. Conclusion of a contract

Our offers are non-binding and noncommittal. Contracts are only valid with our acceptance. Usually this takes place via a confirmation of order or via shipping of the commodity.

3. Prices and terms of payment 4. Delivery

The prices indicated in each case apply. All prices are net are indicated in EURO. The prices do not include the legal tax of 19% and any shipping costs. Delivery takes place only by cash on delivery (only possible inside Germany), or after payment by bank transfer or credit card. If neither of these is carried out within two weeks after the billing date, we are entitled to withdraw from the contract. The commodity is delivered exclusively against bank transfer or cash on delivery (cash on delivery only possible inside Germany). The delivery is exclusively at the expense and risk of the buyer. The customer pays all cash on delivery fees. We normally deliver by DPD unless the buyer expressly wishes another delivery service. We accept no responsibility for delays of delivery on which we have no influence (e.g. strike or act of god).

5. Retention of title 6. Guarantee

Up to the time of complete payment the commodity remains the property of the company Queen of Darkness GmbH. In the case of seizure or judicial safeguards the customer must refer the creditor to the vested titles of the company Queen of Darkness GmbH. Legal warranty applies. It begins with the purchase date. The contracting party has the responsibility to examine the goods immediately and to convey possible notices of defect to us immediately and in writing. If the contracting party fails in these obligations, all warranty claims are void. The guarantee does not include damage which arises through inappropriate use or normal wear (washing, wearing etc.). Warranty claims in the context of the legal warranty are first subject to rework. If a rework should fail we will replace the commodity, give a discount or take the commodity back and refund the purchase price. In addition, the original purchase voucher and the label are absolutely necessary, therefore these should be saved. 7. Return policy

We point out expressly that by local law (Fernabsatzvertrgen nach 355 BGB) a special right of revocation exists for consumers. The customer is entitled to recall its order within a period of two weeks from receipt of the commodity. The revocation requires no grounds and is invoked by text or by return of the commodity to us within two weeks of its receipt by the customer. The customer is obligated to and responsible for returning the commodity. In compliance with local law, the buyer is responsible for shipping costs incurred for returns of articles worth up to 75.00 Euro, excluding the circumstance that the article does not correspond to the ordered article, or was delivered in an obviously and unmistakably damaged state. The seller is responsible for delivery costs incurred for returns of articles worth more than 75.00 Euro. In this case arrangements for the return of the article must be made with the seller. You may recall your contract without grounds, in written form (e.g. letter, Fax or Email) or by return of the goods, within the first 2 weeks. The period begins at the earliest with receipt of these instructions. In the case of a valid return, both sides of the provided value exchange must be repaid and in the case of inequality brought into balance (i.e. interest). If the buyer cannot completely return the articles, or only in damaged condition they are obligated to provide an equal value (i.e. receiving only partial repayment). In other respects the buyer can avoid this value obligation by leaving sent articles in the full and exact received state and not using them in any way as personal property. 8. Non-acceptance policy

If a customer should refuse the acceptance of ordered commodities, we reserve the right to refuse further transactions with this customer.

9. Place of delivery and area of jurisdiction 10. Final clauses

Place of delivery is our office in 08525 Plauen. As area of jurisdiction the Amtsgericht Plauen or the Landgericht Zwickau, Auenkammer Plauen is agreed upon. If one or more of these policies and regulations should become ineffective, this has no influence on the validity of the remaining trading conditions. If these GTCs contain any mistakes in content, meaning or translation the German version of the Allgemeine Geschftsbedingungen becomes valid.

2. Vertragsabschluss

Unsere Angebote sind freibleibend und unverbindlich. Vertrge kommen erst durch unsere Annahme zustande. In der Regel erfolgt dies durch eine Auftragsbesttigung und die Zusendung der Ware.

3. Preise und Zahlungsbedingungen

Es gelten die jeweils angegebenen Preise. Alle Preise verstehen sich exklusive der gesetzlichen Mehrwertsteuer von derzeit 19 % und sind in EURO angegeben. Lieferungen erfolgen ausschlielich gegen Vorkasse (Vorabberweisung oder Kreditkarte) oder Nachnahme. Wird die von uns angeforderte Vorkasse innerhalb von zwei Wochen nach Aufforderung nicht geleistet, sind wir berechtigt vom Vertrag zurckzutreten.

4. Lieferung

Die Ware wird ausschlielich gegen Vorkasse oder Nachnahme geliefert. Die Lieferung erfolgt zu Lasten und auf Gefahr des Kufers. Ab einem Warenwert ber 150,00 Euro liefern wir innerhalb Deutschlands frei Haus. Nachnahmegebhren trgt der Kunde. Wir versenden i. d. R. mit DPD, es sei denn, der Kufer wnscht ausdrcklich einen anderen Versandweg. Fr Verzgerungen auf dem Versandweg, auf die wir keinen Einfluss haben (z. B. Streik oder hhere Gewalt) bernehmen wir keine Haftung.

5. Eigentumsvorbehalt 6. Gewhrleistung

Bis zur vollstndigen Bezahlung bleibt die Ware Eigentum der Fa. Queen of Darkness GmbH. Im Falle von Pfndungs- und gerichtlichen Sicherungsmanahmen hat der Kunde den Glubiger auf die Eigentumsrechte der Firma Queen of Darkness GmbH hinzuweisen. Es gilt die gesetzliche Gewhrleistungspflicht. Sie beginnt mit dem Kaufdatum. Die Gewhrleistung umfasst nicht Schden, die durch unsachgemen Gebrauch oder normalen Verschlei (Waschen, Tragen usw.) auftreten. Gewhrleistungsansprche, die im Rahmen der gesetzlichen Gewhrleistungspflicht gestellt werden, sind zunchst auf Nachbesserung beschrnkt. Sollte eine Nachbesserung fehlschlagen, tauschen wir die Ware um, geben einen Preisnachlass oder nehmen die Ware gegen Kaufpreiserstattung zurck. Dazu sind der originale Kaufbeleg und das Etikett unbedingt notwendig, dies sollte also gut aufgehoben werden. 7. Rcktrittsrecht

Wir weisen ausdrcklich darauf hin, dass bei Fernabsatzvertrgen nach 355 BGB ein besonderes Widerrufsrecht fr Endverbraucher besteht. Der Kunde ist berechtigt, seine Bestellung innerhalb einer Frist von zwei Wochen nach Erhalt der Ware zu widerrufen. Der Widerruf muss keine Begrndung enthalten und ist in Textform oder durch Rcksendung bzw. Erteilung eines Abholauftrages an uns innerhalb von zwei Wochen nach Erhalt der Ware zu erklren. Der Kunde ist zur Rcksendung bzw. Herausgabe der bestellten Ware verpflichtet. Die Kosten der Rcksendung trgt bei Ausbung des Widerrufrechts bei einem Bestellwert bis 75 Euro der Kufer, es sei denn, die Ware entspricht nicht der bestellten Ware (Falschliefung) oder weist deutliche Mngel auf. Bei einem Warenwert ber 75 Euro gehen die Kosten der Rcksendung zu Lasten des Verkufers. In diesem Falle muss die Rckholung der Ware beim Verkufer beauftragt werden. Sie knnen Ihre Vertragserklrung innerhalb von zwei Wochen ohne Angabe von Grnden in Textform (z. B. Brief, Fax, E-Mail) oder durch Rcksendung der Sache widerrufen. Die Frist beginnt frhestens mit Erhalt dieser Belehrung. Zur Wahrung der Widerrufsfrist gengt die rechtzeitige Absendung des Widerrufs oder der Sache. Im Falle eines wirksamen Widerrufs sind die beiderseits empfangenen Leistungen zurckzugewhren und ggf. gezogene Nutzungen (z. B. Zinsen) herauszugeben. Knnen Sie uns die Artikel ganz oder teilweise nicht oder nur in verschlechtertem Zustand zurckgewhren, mssen Sie uns insoweit ggf. Wertersatz leisten. Bei der berlassung von Sachen gilt dies nicht, wenn die Verschlechterung der Sache ausschlielich auf deren Prfung - wie sie Ihnen etwa im Ladengeschft mglich gewesen wre - zurckzufhren ist. Im brigen knnen Sie die Wertersatzpflicht vermeiden, indem Sie die Sache nicht wie ein Eigentmer in Gebrauch nehmen und alles unterlassen, was deren Wert beeintrchtigt. Paketversandfhige Sachen sind zurckzusenden. Erfllungsort ist unsere Geschftsstelle in 08525 Plauen. Als Gerichtsstand gilt das Amtsgericht Plauen oder Landgericht Zwickau, Auenkammer Plauen als vereinbart. Sollten eine oder mehrere Bestimmungen unwirksam werden, so hat dies auf die Gltigkeit der brigen Geschftsbedingungen keinen Einfluss.
