Arts Law believes it is vital for Australia to have a deeper and richer engagement with Aboriginal and Torres Strait Islander peoples in order to achieve reconciliation. The arts and culture provide an exciting door through which many Australians can enter to commence a journey to better understanding and engagement with Aboriginal and Torres Strait Islander peoples and their cultures.

Arts Law has endeavoured to be part of this journey through our work with Aboriginal and Torres Strait Islander artists, their organisations and communities over the last 12 years, by being a strong voice for Aboriginal and Torres Strait Islander artists through our Artists in the Black service. Our engagement with current legal issues that affect Aboriginal and Torres Strait Islander artists ensures targeted advocacy, which promotes artists’ interests and ensures they are part of the conversation.

Arts Law has been on our RAP development journey for a couple of years, so it is exciting to see the hard work of the Reconciliation Working Group (RWG) coming together in this important document.

This RAP will strengthen our partnerships with external bodies that are also focussed on supporting Australia’s Aboriginal and Torres Strait Islander artists. Creating partnerships with likeminded organisations is vital to the delivery of our Artists in the Black program.

It is my hope that our RAP will provide us with the practical steps to achieve our goals as an organisation and clear a path toward justice and recognition for all our Aboriginal and Torres Strait Islander clients.

The Arts Law Centre of Australia (Arts Law) is the national community legal centre for the arts. It provides artists and creative organisations from all over Australia with low cost legal advice and information on a wide range of matters. These matters include contracts, copyright, defamation, insurance, employment and taxation. Arts Law wants to ensure Australia’s artists are properly rewarded for their creative work and avoid exploitation. Arts Law advises a wide range of creators including visual artists, authors, film makers, musicians and performers. The Centre provides telephone legal advice, a document review service, a mediation service and a referral service. Arts Law undertakes law reform and advocacy on arts related issues, lobbying Government and industry bodies on changes needed to laws, policies as well as best practice for the benefit of artists. Arts Law also provides educational workshops throughout Australia to artists and arts organisations.

Arts Law also operates the Artists in the Black (AITB) service which provides a specialised legal advice to Aboriginal and Torres Strait Islander artists and

art organisations. Part of the success of the AITB program stems from Arts Law’s commitment to employing Aboriginal and/or Torres Strait Islander staff members to facilitate the program. These staff members add tremendous value to the organisation by bringing knowledge and skills relating to Aboriginal and Torres Strait Islander peoples and communities.

Arts Law is staffed by 7 full-time and 4 part-time employees, 5 of whom are qualified lawyers. Since AITB’s launch in 2004, Arts Law has continued to employ at least 1 Aboriginal and Torres Strait Islander staff member in the position of the AITB Coordinator. Arts Law has 10 – 15 volunteers working in our offices each week and also relies on a panel of over 220 dedicated pro bono lawyers. Arts Law is funded by the Australia Council for the Arts, Ministry for the Arts, Attorney General’s Department and State and Territory governments.

Arts Law’s mission is to empower artists and creative communities through the law. Arts Law aspires to provide Aboriginal and Torres Strait Islander artists, organisations and communities access to free, culturally appropriate, specialist legal resources (including advice, information, education and advocacy services) to support and strengthen the Aboriginal and Torres Strait Islander arts sector in order for Aboriginal and Torres Strait Islander creators to achieve professional excellence and a sustainable income in a non-exploitative environment. Arts Law believes it is vital for Australia to have a deeper and richer engagement with Aboriginal and Torres Strait Islander peoples in order to achieve reconciliation. The arts and culture provide an exciting door through which many Australians can enter to commence a journey to better understanding and engagement with Aboriginal and Torres Strait Islander peoples and their cultures. Our vision for reconciliation is a community that values and respects diversity, equality, and inclusiveness of Aboriginal and Torres Strait Islander peoples.

Specifically, Arts Law advocates in relation to two main issues for Aboriginal and Torres Strait Islander peoples:

1. Appropriate recognition, protection and respect for Aboriginal and Torres Strait Islander Cultural and Intellectual Property (ICIP), and

2. Equipping Aboriginal and Torres Strait Islander artists and creative organisations with methods to develop sustainable arts and cultural practices.

Our vision for reconciliation is strengthened by our focus on building relationships both internally and externally, and raising awareness with our stakeholders to ensure there is shared understanding of our values and goals for reconciliation within our organisation.

4 Our journey

1983 2004 2007 2009 2011 2012 2013 2014/15Arts Law Centre of Australia established

Artist in the Black program established and first Aboriginal staff employed

First AITB outreach trip. Outreach was an important part of AITB right from the start. In the first year we did sessions in 16 locations with 800 participants: Melbourne (12-13 February and 23-24 September) Townsville (17-18 June) Western Australia (12-24 September) Northern Territory (11-15 October 2004, 18-19 November, 1-3 December) South Australia (25-26 November 2004). From the first year, partnerships with other organisations and stakeholders were extremely important to the success of the service especially the education and outreach.

Wills Project established – Creators of art can generate commercial income during their lives and can continue to benefit their families and loved ones after they pass away. If the artist doesn’t make a will before passing away, there’s no way of being certain that the friends and family who meant the most to the artist during his or her lifetime will be the ones to benefit. In every Australian state and territory, there are laws specifying how a deceased person‘s estate must be shared amongst his or her next of kin if there’s no will. Arts Law has been advocating that artists should make a will for several years now. Our Artists in the Black program conducts wills workshops for Aboriginal and Torres Strait Islander visual artists in remote and regional areas and over 1000 wills have been drafted in that program to date.

Wills Project outreach supported for the first time by a pro bono law firm with Phillips Fox (now DLA Piper) sending 2 lawyers with Arts Law to Mowanjum Community in WA.

Arts Law’s AITB lawyer, Trish Adjei, presented the AITB services to the World Indigenous Intellectual Property Organisation (WIPO) in Geneva, Switzerland.

Arts Law, together with other key organisations, successfully lobbied the Federal Government to introduce resale royalty rights.

Arts Law partnered with the Victorian Justice Department to deliver AITB educational workshops to Koorie prisoners in 6 Victorian prisons.

2011/12Arts Law launched Solid Arts resources on respecting and protecting Indigenous Intellectual Property.

Arts Law successfully lobbied the WA Government to repeal WA intestacy laws which discriminated against Aboriginal peoples

Arts Law made submissions on NSW and Tasmanian Aboriginal Cultural Heritage legislation.

Arts Law made submissions to IP Australia on Indigenous Cultural and Intellectual Property.

Adopt a Lawyer program established matching an Aboriginal and/or Torres Strait Islander art centre with a law firm to benefit from a direct one to one relationship.

Arts Law made numerous submissions to Government drawing attention to potential impact of proposed laws on Aboriginal and Torres Strait Islander peoples eg ALRC Copyright in a Digital Environment.

2015Arts Law launched AITB animations on Copyright, Contracts and Wills in partnership with CAAMA.

Arts Law launch in-house Cultural Understanding Training for all staff and volunteers of Arts Law on Harmony Day.

Arts Law host internal NAIDOC trivia event for all staff and volunteers.

The Reconciliation Action Plan (RAP) program, developed by Reconciliation Australia, is about organisations from every sector turning good intentions into real actions and rising to the challenge of reconciling Australia.

A RAP is a business plan that uses a holistic approach to create meaningful relationships, enhanced respect and promote sustainable opportunities for Aboriginal and Torres Strait Islander Australians.

An Innovate RAP is for organisations like ours that have developed strong relationships with their Aboriginal and Torres Strait Islander stakeholders and are ready to develop or implement new policies and programs for cultural learning to empower our organisation and the Aboriginal and Torres Strait Islander artists, communities and organisations we engage with. The Innovate RAP will give Arts Law the freedom to develop and test new and innovative approaches, and embed our Innovate RAP into our organisation.

In developing an Innovate RAP, our organisation commits to completing the following actions over the next 2 years to ensure we are well positioned to implement effective and mutually beneficial initiatives as part of future Reconciliation Action Plans. Our future RAPs will identify relationships, respect and opportunities actions specific to our organisation and our sphere of influence.

This Innovate RAP will allow our organisation to focus on building relationships both internally and externally, and raise awareness with our stakeholders to ensure there is shared understanding and ownership of our RAP within our organisation.

Development of our future RAPs will involve consultation with our staff including Aboriginal and Torres Strait Islander staff and our stakeholders to achieve our vision for reconciliation.

Our RAP sets out our journey to date and our future intentions in supporting Aboriginal and Torres Strait Islander peoples and their communities. We have built towards our RAP through our everyday engagement with Aboriginal and Torres Strait Islander peoples because we believe that the Arts Law Centre of Australia plays an integral role in the community by providing legal services and support to Aboriginal and Torres Strait Islander artists. We bring national and international awareness to the legal, moral, and cultural rights many Aboriginal and Torres Strait Islander artists practice every day.

Arts Law’s Reconciliation Working Group (RWG) includes the following staff and board members:

Over the next 2 years we aim to maintain this RAP working group made up of our senior management and staff to oversee and support the implementation of our RAP. Of the five members of our RWG, one staff member is an Aboriginal and/or Torres Strait Islander person.

Although Arts Law is a small organisation we have strong relationships with many external Aboriginal and Torres Strait Islander peoples and stakeholders who will act as advisors as we will continue to consult to seek advice and assistance in creating and implementing our RAP.

Arts Law builds on its existing strengths to deliver excellence in the services we provide to Aboriginal and Torres Strait Islander artists particularly through the AITB Program, including: high quality legal advice and referrals, education programs, professional development resources and leadership on the legal and policy issues affecting the arts. Arts Law empowers all their clients so they are secure in their legal and business dealings allowing their creativity to flourish so they can continue to engage and inspire us.

RESPECT Arts Law has a diverse workforce and respect is one of the core values that we promote. Consistent with the high value we place on respect for one another, we see ourselves as having a role to play in demonstrating respect for Aboriginal and Torres Strait Islander cultures, land and history within our workforce and more broadly due to our Artists in the Black program. Throughout all aspects of our work Arts Law responds to the needs of the Aboriginal and Torres Strait Islander artists for the better protection of, and respect for, Indigenous Cultural and Intellectual Property (ICIP). The misuse and misappropriation of ICIP causes significant distress and harm to Aboriginal and Torres Strait Islander peoples and their cultures and we continue to look at

legal and advocacy strategies to provide protection and remedies in this regard. Arts Law considers the need to respect Aboriginal and Torres Strait Islander peoples and cultures in all aspects of our service delivery, including legal advice to a non-Indigenous organisation, general education on artists’ rights and submissions to Government on legal issues such as copyright and privacy. Arts Law conducts all its programs and services with the knowledge, sensitivity and understanding of cultural protocols to the best of our ability. Arts Law ensures all staff, volunteers and stakeholders have access to appropriate cultural awareness training internally to maintain our high level of respect for Aboriginal and Torres Strait Islander peoples.

AITB mirrors Arts Law’s core service but services are tailored specifically to best address the needs of the Aboriginal and Torres Strait Islander arts community. Arts Law employs an Aboriginal

coordinator to facilitate this service and maintain effective partnerships across a broad range of Aboriginal and Torres Strait Islander arts agencies and organisations increasing our ability to deliver programs on a national and collaborative basis to Aboriginal and Torres Strait Islander artists, communities and organisations.

Arts Law aims to deliver all our services to artists and arts organisations that are accessible, affordable,

timely, relevant and practical. Arts Law will continue to evaluate our services and aims to maintain current high satisfaction levels with all aspects of our service delivery. We will also measure, evaluate and report upon the impact of our work with artists and the wider community.
