We neglect to have master lists of our assets and passwords (the keys to our digital kingdoms of Facebook/Google/Instagram accounts, fi- nancial accounts, etc.), outlines of funeral services and preparations, grave site choice, etc. Nobody likes to think about dying, but our chances of dying are 100%. Since we don’t know when our time will be up, procrastination is the enemy. As John Wooden said, “Failing to prepare is preparing to fail”. Without planning, we are seing our families up for trouble. They will be grieving and shouldn’t be forced to figure out online passwords, write an obituary, and plan a funeral with no guidance, etc. Not planning is selfish. Last month we talked about clearing clutter, and organizing our lives. Now let’s talk about organizing for our end-of-life and rethink-ing our approach to it.

As lawyers, we routinely advise our clients to have a will or trust, pow-ers of attorney, and a living will. We explain how these documents allow them to do tax planning, decide who will be guardian of their children, who cares for their pets, who gets their treasured items and the rest of their property after they die, etc. We advise them to pick a qualified personal representative, give that person a copy of their will, keep the original in a safe, and known, place. We tell them to review their will yearly, maybe on New Year’s Day, or their birthday, to make sure it still does what they want, because life changes things.

Leaders in Dispute Resolution

Hon. Patrick L. Woodward (Ret.)Retired Chief Judge, Court of Special Appeals of Maryland

The Honorable Patrick Woodward recently retired as Chief Judge of the Court of Special Appeals

of Maryland after thirteen years of distinguished service as an Associate Judge and Chief Judge

on that court. He previously served as an Associate Judge on the Circuit Court for Montgomery

County and as an Associate Judge on the District Court of Maryland for Montgomery County.

Before his judicial service, Judge Woodward enjoyed a successful law practice in Maryland and

DC. He is a two-time Recipient of the Outstanding Jurist Award from the Montgomery County

Bar Association and the 2018 Recipient of the Beverly Groner Family Law Award from the

Family and Juvenile Law Section of the Maryland State Bar Association. Judge Woodward now

brings this exemplary record of dedication and leadership to The McCammon Group to serve

the mediation and arbitration needs of lawyers and litigants in Maryland, DC, and beyond.

CIRCUIT COURT NOTESRobert A. Greenberg, Administrative Judge

FAMILY DIVISION MAGISTRATE:I am pleased to announce the appointment of Lili Khozeimeh to the position of Family Divi-sion Magistrate.  Lili joined the court in 2008 as an Attorney in our Family Law Self-Help Cen-ter.  In 2010, she moved to the role of Adoption/Guardianship Case Manager where she so aptly served as our Adoption Fairy.  Lili is a graduate of the Institute for Court Manage-ment and was in private prac-tice, specializing in family law, prior to her career with the court.  Lili will be joining the other magistrates on March 13th.  Magistrate Khozeimeh will hear cases in Hearing Room 2H and her office will be in Room 2780 on the 2nd floor of the South Tower.

PHOTOGRAPHS, VIDEOS OR RECORDINGS IN A COURT FACILITY:Except as permitted by Mary-land Rule or expressly permit-ted by order of the administra-tive judge, a person may not (i) take or record a photograph, video, or other visual image in a court facility, or (ii) transmit a photograph, video, or other visual image from or within a court facility.  Further, except with the express permission of the presiding judge or as oth-

erwise permitted by Maryland Rule, all electronic devices in-side a courtroom shall remain off and no electronic device may be used to receive, trans-mit, or record sound, visual im-ages, data, or other information.

MD RULE 1-321. SERVICE OF PLEADINGS AND PAPERS OTHER THAN ORIGINAL PLEADINGS:The Circuit Court has received numerous certificates of ser-vice indicating that pleadings were served by e-mail. Coun-sel are reminded that MD Rule 1-321 does not contemplate ser-vice of pleadings by e-mail.

aware and responsible. This talk doesn't have to be all doom and gloom. Talk about our lives and memories, explaining special pictures, sharing stories, and dis-cussing things they might want to know but never asked. Talk about things that will comfort them. Tell them how we dealt with our losses. You’ll feel pret-ty good that you’ve taken care of this while dying or becoming mentally incapacitated is just an abstract concept. If you’re ill or in the process of dying, it will bring you some peace of mind.

As you know, my dad died at 57 after a long illness. He hadn’t discussed funeral plans, and we hadn’t pushed him. Unfortu-nately, we hadn’t made plans ei-ther, so when he finally passed, we scrambled to make arrange-ments. It was not any fun, and was particularly hard on my grieving mom. As a result, mom and I had a number of discus-sions about what she wanted when it was her turn to go. She wanted a plain wooden box. In fact, she said she preferred a cardboard box, like the one new refrigerators come in. I laughed, but told her it probably would have to be the wooden one. She wanted to be buried next to my dad in NJ, although she had moved here a few years after he died. There were a few other details we discussed, but not as many as we should have.

When she suddenly died at age 84, I was a mess. No matter how old you are, when your second parent dies, you’re an orphan. The unconditional love our par-ents give us is gone. I was in a daze and felt terribly alone. At the funeral home, they kept trying to sell me a beautiful, top-of-the-line mahogany coffin, gorgeously displayed in rose lighting. Re-membering my discussion with mom, however, I insisted on the plain wooden box, which was leaning on its side against a wall in a dark corner, lid askew. They spoke of it disparagingly. I held firm. I was thankful that mom and I had talked.

Plan what you want to happen at your wake, funeral and/or me-

morial service, put it in writing, and let your family know your wishes. If you want a burial, contact a cemetery and pur-chase a plot now. Costs will only increase. If you want cremation, contact a funeral home and ar-range it. Where do you want your ashes spread? Planning your own funeral can be diffi-cult, so ask for help from friends, relatives, funeral celebrants or religious leaders. This lets you manage the costs, pick out your clothing, pick music to be played, who will speak, what readings and prayers to use, etc. Do you want flowers? Where should they be donated afterwards? Are you an organ donor? Spare your family these difficult decisions at a time when they will be in pain.

We have the option of prepaying funeral costs, with the money held by a third-party in a trust or a life insurance policy, so if the funeral home goes out of busi-ness we’re protected. Pre-need contracts are usually portable, some even refundable. We can pre-pay for the coffin, embalm-ing, chapel, dressing/casketing, floral arrangements, staff and service fees, as well as ceme-tery expenses, like the gravesite, headstone, opening and closing, outer burial container, etc. Let your family know what services you’ve paid for, and what you ha-ven’t, so they don’t later pay for things you’ve already arranged.

Prepaying also helps with Med-icaid issues, since it shelters some of your money from eli-gibility consideration (“spend-down”), although there may not be a benefit in locking your money up decades before you know whether you’ll need Med-icaid. Another way to cover fu-ture costs is to set money aside in an earmarked savings ac-count, if you have the discipline to not touch it. It can be joint with a spouse or child, or name them as a beneficiary upon your death. (In that way the money could be used in an emergency, then replenished.)

Where are the keys to your house and car? The passwords to your online accounts? Once you decide what you want, keep

(Continued from page 1) all the relevant info in a master file. Tell your family where it is. Billions of dollars sit unclaimed with the State because families didn’t know about accounts. Keep your information current.

What goes in the master file? Your estate planning docu-ments, legal papers and certif-icates, passwords, income info, financial asset list with account numbers/values, life insurance info (don’t forget about policies from former jobs), retirement asset info, membership lists, vehicle titles, real estate info, list of valuable tangible assets and location, social security number/card, passport, driver’s license info, military records, contact info for your health care professionals and phar-macy, medication list, hospital preference, Medicare/Medicaid info, social worker/case worker contact info, list of creditors and amounts, loans you’ve made to others, etc. (Some of this can be digital, just let others know how to access it.)

Go through your home and make a list of valuable things, like the house itself, tv’s, jewelry, collectibles, vehicles, computers, tools, etc. As we discussed last month, get rid of your clutter. List your non-tangible assets: in-vestment accounts, 401k plans, IRAs, bank accounts, life and other insurance policies, such as long-term care, homeowners, auto, disability, health, etc.

As you know, accounts and pol-icies with designated beneficia-ries pass directly to them when you die, not going through your will or trust. Ask for a list of whom you’ve named for each account/policy you own. Review it and make sure it’s still what you want.

You may have several different retirement plans or IRAs from different jobs. Consider consol-idating them for less paperwork and easier management. Maybe there’s a better investment op-tion.

Consider life insurance, not just for covering your salary after you die, but helping your family pay for funeral costs, debts, etc.

Groups you belong to may have low cost policies you can get.

Go over your investment/in-surance plans periodically. Life changes and so do your needs. Do you need long-term care in-surance? Disability coverage? Tax planning?

Carry emergency medical con-tact info with you. Run a free credit report once a year to re-view what’s there.

Once your advance planning is taken care of, enjoy your bucket list. Places to see, things to do? Sports, hobbies, activities to try? Family and friends to be with? Projects to start or finish? Caus-es to support? Personal history, books, articles to write? Regrets to be resolved? Spiritual mean-ing found? Things you’ve been afraid to do or say?

Laughing and being happy can be a part of coping with death. Death, like life, is complex. You can feel sad and be in pain, but still be a happy, positive person. You can feel grateful even when suffering.

We have an almost superstitious reluctance to speak about our death. But as Gail Rubin, the na-tionally known Death speaker (who will be our April luncheon guest), says “talking about sex doesn’t make you pregnant, and talking about dying won’t kill you”.

in the Rockville District Court Commissioner’s office. The of-fice is open 24/7/365. Commis-sioners can receive your filing and date-stamp your copy. Please sign in when you arrive. You can note that you are sim-ply filing papers. This should alert the Commissioner of the brief purpose of your visit and should expedite service.

SPECIALLY SET CASESHistorically, specially set cases were those longer than 2 hours, multiple parties and claims, or other extenuating circum-stances. The structure of the civil dockets in both court loca-tions permits judges to try lon-ger cases as part of the regular, Wednesday docket. The need to specially set cases is limit-ed now to trials over 3 hours, lengthy trials with multiple lan-guage interpreters, trials with parties, witnesses, other who have special needs, health con-cerns, travel arrangements, etc.

It is preferable that cases be tried on a regular docket as the District Court does not have the ability to implement individual calendaring. Specially setting

trials removes a judge from an entire docket in order to com-plete a single case. Please note that if a case is specially set, the parties are required to complete court-ordered mediation before a trial will be scheduled.

MDECThere is tremendous, ongoing, behind-the-scene preparation for the November conversion to MDEC. The District Courts are being wired, courtrooms have been retro-fitted for scan-ning stations, equipment is on order and internal trainings are beginning. As we progress, courthouse staff will receive in-depth training, including mock-courtroom/trial settings for courtroom clerks.

If you are unfamiliar with MDEC, the Judiciary website is well-stocked with background, policy procedural, technical, and practical information that will assuage your concerns. In the early fall, Chief Judge Mor-rissey and others will offer in-formational presentations and training seminars for lawyers to familiarize themselves with the nuts and bolts of e-filing. RECALL OF ARREST WARRANTSThe court is not permitted to recall original, unserved arrest warrants. Rule 4-212 authoriz-es a judicial officer to issue a criminal summons or warrant, dependent on the facts of each application. Once an arrest war-rant is issued, judges are pre-cluded from recalling said war-rant. Administrative Regulation XV—Cancellation of Charging

Document, explains that judges may recall a bench warrant for a person’s failure to appear. Oth-er charging documents must be addressed at trial (necessitating service on the defendant), or by the State’s Attorney entering a case nolle prosequi.

Youth Courthouse Project Committee Is Looking For Attorney ParticipantsCarter v. The United States was the subject of two mock trials by Montgomery College students last month as they probed the boundaries between individual privacy and cell phone contracts.  Earlier this year, third graders from Lakewood Ele-mentary School were assigned a slightly easier subject as they conducted a mini-mock trial of Goldilocks v. The Montgomery County Inn of Court is currently accepting applications for its 2019-2020 term. The Montgomery Coun-ty Inn of Court is devoted to developing the ethical and tri-al advocacy skills of Montgom-ery County litigators. The Inn currently comprises: 27 Associ-ates, 27 Barristers, 54 Benchers, and 45 Judges & Masters.  As-sociates are recent law school graduates or attorneys licensed to practice law in Maryland for not more than five years. As-sociates serve a one-year term and there are 27 vacancies anticipated for 2019-2020. Bar-risters are attorneys licensed to practice law in Maryland for at least five years, are of good character, and seek to improve their skills as trial or appellate advocates. Barristers serve a three-year term and 9 vacancies are anticipated for 2019-2020.  Benchers are attor-neys licensed to practice law in Maryland, who have demon-strated superior character, abil-ity, and competence as trial or appellate advocates. Benchers are honored with lifetime

membership in the Inn, but vacancies occasionally occur, so applications for Bencher positions are also being tak-en. The Montgomery Coun-ty Inn of Court meets on the second Tuesday of the month from September through May in Rockville, for a social hour and dinner, followed by an ed-ucational presentation in the Circuit Court. The Inn offers trial advocacy programs, ac-centuating legal excellence, ci-vility, professionalism and eth-ics. Usually, the Montgomery County Inn has been fortunate to have more qualified appli-cants than available vacancies. While preference is given to Montgomery County litigators, the Inn seeks to have a mem-bership that reflects a rich di-versity. Scholarship funds are available through the Salter Scholarship Fund. Management issues are very seductive and getting involved in them takes us away from billing clients and getting cli-ents. That can add up to a lot of lost revenue.

You can do the math for yourself. If you bill $400 per hour, you’ll lose $100,000 in revenue just for spending one hour per day on managing your practice. That’s why I work hard to coach fellow lawyers on how to minimize the time they spend on administrative tasks.

Here are some tips that might help you:

1. Outsource to contractors or assign to admins any work you can. Each hour you free up is found revenue and is almost always a net revenue gain.

2. Ask co-workers to write up any issues and email them to you instead of interrupting your work to discuss the prob-lem. You can answer an email in minutes; a live discussion prevents both of you from billing.

3. Spend saved administrative or management time on exist-ing work or on getting new clients.

For the lawyers I coach, I quantify the revenue they lose when they spend time on things that don’t need as much attention. A goal is then set to reduce that lost time. I then help them solve administrative issues in minutes instead of hours. $100,000 matters to a lot of practices.

Sometimes legal ethics ques-tions have an easy answer. However, in other cases, even the most ethically-minded at-torney can be placed in a quan-dary. For this reason - and for the reason that our bar associ-ations want their members to act ethically - the Bar Associ-ation of Montgomery County (“BAMC”) and the Maryland State Bar Association (“MSBA”) each staff attorneys on “Ethics Hotlines” available to all mem-bers. The contact information for each month’s Ethics Hot- line attorneys are found in the Monthly BAMC Bar Newslet-ter and also the MSBA and BAMC websites. The attorneys who are available for consulta-tion on these Ethics Hotlines are Members of the MSBA or BAMC Ethics Committees.

Fortunately, Members of the

MSBA or BAMC Ethics Com-mittees are generally very well versed in the Maryland At-torneys’ Rules of Professional Conduct. Thus, calling either of these Maryland-based Eth-ics Hotlines will provide BAMC and MSBA members with the ability to be pointed in the right direction regarding which Rules may (or may not) help guide the attorney in answer-ing their ethical dilemma and/or suggest rulings related to those Rules which may be in-structive. For this reason, it is highly recommended to (1) have reviewed the Maryland At-torneys’ Rules of Professional Conduct prior to calling one of the Hotlines and (2) have a copy of the Rules available to review when calling the Hotline.

It is important to note that at-torneys who staff each of these

Ethics Hotlines will not answer an ethical dilemma for your or tell you what you should do. The purpose of the Ethics Hotlines is not to provide legal advice for callers to solve their problems. Rather, the Ethics Hotlines are available as an additional guide to help direct BAMC and MSBA members to resources to help solve their ethical dilemma. As stated in one District of Columbia mat-ter, the DC Court of Appeals noted that attorneys who staff the D.C. Bar Ethics Hotline do not give “advice to attorneys call the D.C. Bar Ethics Ho-tline,” but rather they “direct[] attorneys to relevant rules and opinions.” In re Martin, Case No. 11-BG-775 (D.C.2014)

Nonetheless, while attorneys on these ethics hotlines will not provide a bar member with

a direct instruction of what to do, (1) calling one of these eth-ics hotlines can help guide bar members through finding a solution to an ethics problem and (2) the Court of Appeals has noted when an attorney makes a “bonafide effort to be as ethically correct as pos-sible” through calling “Ethics Hotline number” provided by the Bar Associations, it miti-gates a sanction. Gatewood v. State, 880 A.2nd 322, 388 Md. 526 (Md.2005). Thus, when facing an ethical dilemma, consider calling one of your bar associ-ation’s Ethics Hotlines. Those attorneys are available and willing to help be a further re-source for ethical dilemmas.

John Francis Burke, the last-named surviving principal of Bulman, Dunie, Burke and Feld, died after an extended illness at his home in Bethany Beach Delaware surrounded by his loving and devoted family. A homegrown talent, John was born in Washington, DC, at-tended Gonzaga College High School and Georgetown Uni-versity undergraduate and law school. He is survived by his wife, Joanne Yarnall Burke, five children, Patricia Ann Connor, Joan Rubertone, John F. Burke, Jr., Martin Burke and Cecilia D’Orazio, and fourteen grand-children.

A man of heartfelt religious and moral principles, John epit-omized the qualities of a true professional – civility, strength of conviction and advocacy, tempered with compassion and justice. These qualities were evident over the years as John assessed the frailties and in-discretions of other lawyers as a member of Inquiry Panel of the Attorney Grievance Com-mission and later as a member of the Attorney Peer Review Committee. And again, as Chair of the Bar Association’s Men-tor-Mentee Committee and its Professionalism & Quality of Life Committee. And yet again as co-founder of the Bar Asso-ciation’s Voluntary Arbitration Committee. For these efforts

and others, the Bar Associa-tion twice recognized John as Co-chairman of the year.

Besides these commitments, John added his specialized skill and expertise in family law matters to provide guidance to practitioners as the Chair of the Family Law Section and utilized all this experience as a mediator under the Alternative Dispute Resolution Program (ADR) reconciling family law conflicts in this non-judicial setting.

A patriot, John served his country through military ser-vice and as a dedicated church member, his faith through countless hours of volunteer service starting as a teenager.

Those of us who knew John recognized in him above all else, his sense of loyalty. John’s friendship meant an unending lifelong commitment to his friends and colleagues. And we at Bulman Dunie benefited from this dedication in count-less ways, from the annual Holiday remembrances, to the “couldn’t forget your . . .” phone call, to the fostering of the of-fice culture we cherish.

It is with a heavy heart we rec-ognize his passing, but, we are truly better off having shared our lives with his.

Andrew Haberman is an associate at Edell, Shapiro & Finnan and joined the firm in 2012.  Andrew focuses his prac-tice on patent preparation, prosecution, and counseling.   Andrew has prepared and prosecuted U.S. and foreign-origin patent applications relating to a wide range of technologies, including appli-cations in the mechanical, electrical, and electromechanical arts. Andrew

has experience counseling large and small corporate clients regarding all aspects of patent legal matters including port-folio management and filing strategies, freedom to operate and right-to-use issues, patent prosecution, post-issuance procedures, licensing, and enforcement.

Prior to joining the firm, Andrew prosecuted patents at an intellectual property law firm in Alexandria, Virginia. Ad-ditionally, while in law school, Andrew worked at the U.S. District Court of Maryland, the U.S. Court of Federal Claims, and the U.S. Department of Commerce’s Office of Intellectu-al Property in various capacities.

Andrew is a Montgomery County native and graduated from Wootton High School.  Before law school, Andrew completed his undergraduate studies at Penn in Mechanical Engineer-ing.  His favorite part of the Leadership Academy has been making connections with attorneys in other practice areas. 

Andrew and his wife recently welcomed a second son to their growing family.  In his (very limited) free time, he en-joys playing hockey, golf, and basketball and rooting for the Ravens and Caps.

HIGH SCHOOL MOCK TRIAL COMPETITION

Another great year. This was the most competitive and largest competition in the last 15 years for which I have been running this program. Over 25 schools competed in over 70 trials held at the Circuit Court between January 22nd and March 8th, 2019. The winner of the competition this year was Richard Montgomery High School – who always puts together a top 5 team. This program would not be possible without all the attorneys, magistrates and judges who took the time to judge one of the many trials. I would like to thank:

I would also like to thank Special Magistrate Keith Rosa, Magistrate Bibi Berry and Magistrate Lisa Segel, Judge James Sarsfield, Judge Rand Gelber, Judge Eric Nee, Judge John Moffett, Judge Debbie Dwyer, Judge Margaret Schweitzer and Judge Christopher Fogelman for judging many of the trials.

Of course, without use of the Courtrooms or the assistance of the Sheriff’s Office, none of this would be possible. Prior to the annual meeting, please note that we will begin our 2019 Lecture Series on April 4, 2019, at 5:30 p.m. Sec-tion Co-Chair and Administra-tive Law Judge Nicolas Orech-wa will present guest lecturers Administrative Law Judge Ste-ven Adler and Thomas Riordan with the Maryland Department of Management and Budget.

Judge Adler and Mr. Riordan will provide insight on the ba-sics of Maryland state employ-ee discipline and grievance pro-cedures, and appeals of those matters to the Maryland Office of Administrative Hearings. The lecture is designed to pro-vide practitioners with some practical information on this area of employment law and what representing a state em-ployee with a grievance or dis-cipline issue with their agency might entail.

TRIAL EXHIBITS AND MD. RULE 16-405Md. Rule 16-406 governs, in part, the disposition of trial exhibits after conclusion of a trial, entry of judgment by the Circuit Court, and following the expiration of the appeal period or the clerk’s receipt of a mandate issued by the final appellate court to consider an appeal (and there is no oppor-tunity for further review of the judgment). Rule 16-405 pro-vides for the return and/or de-struction of trial exhibits after proper notice by the clerk’s of-fice. With the implementation of MDEC around the corner, the clerk’s office will be issuing notices pursuant to Md. Rule 16-405 to parties, counsel, and/or self-represented litigants in cases tried prior to MDEC com-ing online which meet the cri-teria under the Rule. This will include Family Division cases. If the clerk’s office does not re-ceive a request to retrieve the exhibits within 30 days of the notice, the exhibits will be dis-posed of.

FAMILY LAW SELF-HELP CENTERThe Self-Help Center is transi-tioning to paperless processes.

INTERPRETERS AND MEDIATIONPer a Maryland Rule change (Md. Rule 1-333) courthouse staff inter-preters will no longer need to be sworn in before hearings. They will be signing an oath which will be kept on record with the Clerk and AOC. This applies only to courthouse staff interpreters, not private interpreters brought in to accommodate languages not spoken by courthouse staff interpreters. Private interpreters will still require swearing in be-fore hearings.

Please make sure to comply with the rule requiring 30-days notice for an interpreter re-quest for a proceeding, partic-ularly if you are requesting an interpreter for a language not spoken by a courthouse staff interpreter.

11:15 a.m. - 12:15 p.m. Taxation LawDemystifying IRS Letters While Resolving IRS Liens and Liens Speakers: John Pontius, Esquire of Pontius Tax Law and Michael Goldberg, Esquire of Stein Sperling

When a taxpayer has unpaid tax debt the IRS and the Maryland Comptroller, the law requires enforcement collection action against the taxpayer. The most common collection actions are tax liens and levies. A tax lien protects the government’s interest in all of a taxpayer’s property, including real estate, personal property and financial assets. A tax levy is legal seizure of a taxpayer’s property to satisfy a tax debt. Join John Pontius and Michael Goldberg for a review of common IRS letters sent to delinquent taxpayers. Mr. Pontius and Mr. Goldberg will advise on how to discharge property from a tax lien, subordinate a tax lien on real property as well as withdraw a tax lien. They will also discuss advanced tactics for levy collection alternatives such as installment agreements, offers in compromise and currently not collectible status. This discussion is designed for both tax and non-tax attorneys.

Exciting changes are happening at Stein Sperling. In addition to the launch of the firm’s newly redesigned website, Stein Sperling has begun the process of moving to its new headquarters at 1101 Wootton Parkway, Rockville, MD, a process scheduled for completion by the summer of 2020.

Reaching its largest size ever, Stein Sperling is excited to work with the Tower Company to occupy more than 40,000 square feet in the LEED Gold® and ENERGY STAR Certified Tower Building. This move will come in stages with a number of attorneys and staff working out of a temporary space in the building while the firm develops its new home. When complete, this move will allow attorneys and staff to connect and collaborate with ease. The firm’s new location will allow continued close proximity to the Montgomery County Courthouse and will accommodate future growth of the firm.

Founded in 1978, Stein Sperling started with just four attorneys plus three staff in one small building at 23 West Middle Lane, a building the firm still occupies, today along with four additional buildings in Rockville, Maryland as well as stand-alone offices in Wheaton, Langley Park, and Frederick in Maryland and Baileys Crossroads in Virginia. Since its inception, the firm has grown to 50 attorneys and 78 additional staff.

REMINDERSEXPANDED USE OF DISTRICT COURT COMMISSIONER FOR COURT HEARINGSAs of January 7, 2019, Commis-sioners began presiding over preliminary inquiries in crimi-nal cases of Mondays and Tues-days. These hearings will be conducted in Rockville only, in Courtroom 611, and will start at 8:30 a.m.

ADDITIONAL SERIOUS TRAFFIC DOCKETSAlso starting as of January 7, 2019, the Rockville District Court is scheduling additional serious traffic case trials in Courtroom 612 on Mondays and Tuesdays. These dockets will be designed to be shorter than traffic cas-es in 413 and 414, because the trial judges set in 612 will not be available after noon. Case Search is likely to report that the courtroom number is “06.”

GENERAL MATTERSJUDICIAL VACANCYJudge Sarsfield has retired but this vacancy has not been ad-vertised nor likely to be filled very soon. No allowance has been made by the Administra-tive Office of the Courts and Montgomery County will not get more “V.J.’s as a result. At this time, the District Court may be required to close some courtrooms without much prior notice if sickness or vaca-tions leave us short.

MDECWe learned that the Baltimore County courts went “live" in February and that training for court personnel in Mont-gomery County will begin this summer. Once MDEC is live in Montgomery county on No-vember 12, 2019, there will be a 30-day grace period where law-yers may be able to file written pleadings in the normal fashion, but electronic filing will then be the only way lawyers can file documents for the courts.

Only a limited number of cur-rent files will be “back scanned."

However, when there are new pleadings to be filed on old cas-es, for example, reconsideration of sentence or modification of custody, would then require a back scanning the entire file of the same case. Still unknown is whether lawyers will be able to access documents on-line in files other than those in which they are involved. In some counties where MDEC is already live, terminals in the courthouses allow review of other files. Stay tuned.

AFTER HOURS FILING IN ROCKVILLE AND SILVER SPRINGFor lawyers who want to file after 4:30 p.m. on a given day, Commissioners in Rockville are always available and the Commissioner in Silver Spring will usually be available until midnight. All documents filed with the Commissioner before midnight will be stamped as if filed by 4:30 p.m.

INTERPRETER REQUESTSReminder: There is a new Dis-trict Court form for requesting foreign language interpreters, and the Court prefers that at-torneys use this form and file them well in advance. Using the form permits the court to keep accounting and statistical information. See

As a re-evaluation of how dues revenue is spent, last month the Executive Com-mittee took up the issue of reducing the number of Bar lunches per year.  This dia-logue is continuing in the Executive committee.

I believe the membership needs to be heard on this matter. We are inviting your input as to the frequency of the lunches, and ways to increase attendance. Your continued partici-pation will carry us forward. It is never too late to get involved, and there are ample opportuni-ties. Our community residents really need you! Montgomery County Bar Foundation Pro Bono Program seeks volunteers – whether experienced or new-ly barred attorneys – to join our panel. There are many county residents that are in great need of pro bono services. Your call to volunteer will make a differ-ence to those without resourc-es. You will feel both the social and emotional impact that you have the capacity to help. So please consider volunteering!

The Pro Bono Program pro-vides two ways for county res-idents to receive FREE LEGAL SERVICES in civil cases – at a le-gal advice clinic or through the client intake line for referral to an attorney volunteer for direct representation. The legal advice clinics operate in five locations across the county (SEE BOX BELOW) and provide residents the opportunity to walk-in and meet with an attorney volun-teer without scheduling an appointment. Eligible clients present their legal problems to an attorney and receive free immediate legal advice and/or referral to a non-profit or gov-ernment social service agency that may be helpful. The cli-ent intake line operates out of the main office where the staff screens calls from potential clients. The Pro Bono Program staff conducts all screenings over the phone only. Cases re-ferred to attorney volunteers include family law, debt collec-tion, bankruptcy, limited em-ployment, limited immigration, wills and power of attorney.

I don’t think that I saw either Roz or Kristina break a sweat — they are both so graceful and efficient! Being president of the Chapter this year has been really eye opening. There are so many talented, energetic, smart and dedicated women in our Chapter — it makes my job so easy!
