FEATURE ARTICLE
IF YOU ARE LIKE ME, one of your first lessons about how the legis-lative process works probably came from a catchy song from the “School House Rock” cartoon on Saturday mornings. You might remember the little lonely legislative bill named Bill sitting on the Capitol Hill steps waiting to be introduced to Congress. Imagine if there were 1,400 of those little guys hanging out on the Capitol Hill steps…or better yet, imagine all 1,400 of them appearing in your office one day, now twiddling their thumbs, just waiting for you to read them and decide what to do next. Even if a legisla-tor has been in office for years and has a staff of assistants, the task ahead can be daunting. She’s probably wishing someone who knew what all these proposed bills actually said and meant could just come in and explain it to them…someone with expertise on the real-world application of this pro-posed law and how it would affect that industry. Guess who they are wishing would help them out? YOU…and me and every other person you work with who knows how the multifamily housing industry works day in and day out.
Chances are, that legislator does not have the hands-on expertise in that specific industry to make the most informed decision, and they would love for you to enlighten them. In fact, they are counting on it.
Believe it or not, our government is counting on us to educate it and tell it what we want it to do for us. As basic as that sounds, it’s true. You are probably thinking, “That’s great and all, but how can I really make a difference? I don’t know anything about politics!” That’s what I thought, too—I mean, I’ve seen plenty of episodes of “House of Cards”! But the fact of the matter is, our elected officials count on us to gain the insight they need to make the laws that affect our lives. Which laws to pass, which laws would have such a devastating impact that they should never see the light of day, or perhaps, with some input and guidance from industry professionals like you, which revisions and amendments can be made to find a common ground that promotes mutual interests for everyone. Through the Tennessee Apartment Association, we have access to not only State legislators, but our Senators and Representatives in Washington, D.C. as well. It may be the closest way to make a difference in the world, and it is right at our fingertips. Being involved is as easy as being able to express your opinion about your job. All you need to do is know how to do your job, so you can tell legislators how to do theirs!
The Tennessee Apartment Association provides us with a special opportunity to have our voices heard. Jenna Willis serves as the Director of Communications & Marketing for the Ten-nessee Apartment Association and can be reached at the TAA office, which is located in the Greater Nashville Apartment Association office. Our Governmental Affairs representative and liaison, Catie Bailey, an attorney with the law firm of Miller and Martin in Nashville, is also a significant resource available to all TAA members, including GNAA and all area affiliates throughout the state. Catie knows the ins-and-outs of the political landscape and helps us organize meet-ings with legislators in Nashville and in Washington, D.C. to make our voices heard regarding legislation up for grabs that has an impact on our industry. She works with TAA member affiliates statewide to touch as much of the state as possible, to make sure legislators hear from constituents from their districts so they can make the best decisions for their communities. Getting involved with TAA is a fun and eye-opening way to realize how much of a difference you really have the power to make. You get to work with knowl-edgeable people who understand the process and help you along the way. The idea of getting involved with government affairs can seem like an intimidating job for someone else to deal with, but the reality is, you can make much more of a difference than you realize. IT’S THE LAW

RECENTLY, WE HAVE HAD several questions regarding towing. Towing vehicles from your property can get sticky and could be costly if not done properly. There are specific rules to be followed pursuant to the Uniform Residential Landlord Tenant Act. Proper procedure must be followed in accordance with the law, and if you have restricted parking you must provide notice through clear signage for the tenants and their guests as to where they can and cannot park.
The law is very specific as to the circumstances for towing and the time of notice required. The Landlord Tenant Act at TCA 66-28-518 sets out clearly the rights of the landlord to have an unauthorized vehi-cle towed. An “unauthorized vehicle” is defined as a vehicle that does not belong to a tenant, an occupant or a tenant’s known guest and that has been on the property for more than seven (7) consecutive days. A ten (10) day written notice must be posted by the landlord on an unau-thorized vehicle before the vehicle can be towed or removed from the property.
A different situation arises when an unauthorized vehicle is parked in an area or space where there are signs posted which specifically designate parking. A sign stating “permit parking only” or “tenant parking only” would give sufficient notice that parking by non-tenants or a non-permitted vehicle is unauthorized and therefore could be towed immediately and without notice. A vehicle may also be towed immediately, and without notice, if the vehicle is parked in an area with posted signage relative to traffic and other park-ing restrictions, such as traffic lanes, fire lanes, fire hydrants, parking for persons with disabilities and/or blocking trash receptacles. There is no specific language required for signs designating parking policies; however, if you are relying on signs to designate parking or places where there should be no parking, be sure to make the signs visible and easy to understand.
A vehicle parked on your property may also be towed if the vehicle has one or more flat or missing tires; is unable to operate on its own power; is missing or has a broken windshield; has more than one broken or missing window; has one or more missing fenders or bumpers; or the vehicle is not in compliance with all applicable local or state laws relative to titling, licensing, operation, and registration for more than 30 days. If the vehicle fits any of these categories, you must give a ten (10) day written notice by posting the notice on the vehicle prior to towing. The important part of this provision is that before towing the vehicle, the towing company must notify local law enforcement of details of the vehicle, such as the VIN number, registration information, license plate number and a description of the vehicle. Be sure that your towing company is aware of this policy and complies with it.
The last situation when you may need to have a vehicle towed from the property is if the vehicle is con-sidered to be a “nuisance.” The definition of a “nuisance vehicle” is a vehicle that is incapable of operating under its own power and is detrimental to the health, welfare or safety of persons in the community. The notice required for towing a nuisance vehicle is a 24-hour written notice being posted on the vehicle. Spe-cific situations where a vehicle may be considered to be detrimental to health, welfare or safety is if the vehicle is leaking hazardous liquids or materials, it has broken, shattered or missing windows where there is exposed glass, or if the contents of the vehicle pose a threat to public health or safety.
Always keep good records when towing a vehicle from the property. Err on the side of caution. If there is a notice period required, add one day to be sure you are in compliance with the law. Take pictures when the notice is posted and prior to towing and keep all documentation in your file. This could save you a lot of problems in the future when a dispute arises.

AS WE ARE TRYING TO RECOVER, we probably need to do some housekeeping and property walking. If we haven’t already, we need to remove branches that fell due to the extreme weight of the ice and snow. I don’t know about you, but I had quite a few limbs down, mostly pines. It is a good time to take a closer look at your trees and plan to weed out any future issues.
Among the other issues you need to look at are your gutter systems. These gutters took on an enormous amount of ice. The result of this is falling gutters and gutters pulled away from the facias. Be sure to inspect the facias for bad wood and replace if necessary. The gutter systems help pull the water away from the buildings. If water is not diverted it can cause great damage such
as wood deterioration and fence deterioration. It can also cause building grading erosion issues. This issue may lead to concrete foundation failures.
Don’t forget to walk your vacant apartments for any water issues due to the ice damming. It would not be good to walk into a vacant unit with a prospective renter and have them see water stains and feel uncomfortable about their possible new apartment.
Also, it’s time to resupply on ice melt. You never know what’s still to come in the near future. It’s better to have it stocked then not to have any at all. While you are inspecting, look for potholes and cold patch them if necessary.
But on the bright side we should be on the tail end of winter and spring is right around the corner! I think this is one of the prettiest times on my property with all the blossoms in full bloom.

ON MARCH 17, members of the Tennessee Apartment Association traveled to Washington, D.C., to attend the National Apartment Association’s annual Capitol Conference. Those who participated included: Jenna Willis, GNAA/TAA; Diane Carter, GNAA/TAA; Nathan Lybarger, GNAA; Henry Carter, GNAA; Tammy Lee, GNAA; Stacy Molen, GNAA; Callie Jones, AAGM; Robin Riggins, AAGM; Melissa Moore, AAGM/TAA Board President; Tammy Yeargan, AAGM; Cara Mober, CAA; Kirk Kent, CAA; Donna Kent, CAA; Cara Mefford, CAA; and Catie Lane Bailey, TAA. During their time on Capitol Hill, TAA members were able to meet with both Senators Alexander and Corker and all nine Tennessee Repre-sentatives or their designated congressional aide.
The theme for this year’s Lobby Day was “One Industry. One Voice.” For the National Apartment Association, speaking with one voice is the most effective way to influence decision-making on policies that impact members of the apartment industry. NAA members from across the country discussed the same three key issues
when meeting with their state’s delegation: restructuring immigration policy, enhancing the Section 8 hous-ing choice voucher program, and reforming the tax code. Below is a summary of the information that was provided to all conference attendees by NAA/NMHC.
First, restructuring immigration policy. Immigrants are a key driver of apartment demand and an important force in apartment construction and operations. NAA/NHMC believes Congress should enact comprehensive immigration reform to address the current patchwork of state and local requirements that impose additional responsibility on apartment firms for the immigration status of employees and apartment residents beyond federal law. Such federal legislation would help create predictability and consistency for both business and workers. NAA/NMHC support interior and border enforcement that safeguards national security and strengthens our economy; a temporary visa program that addresses changing workforce needs; a national employment verification system to efficiently and reliably check the legal status of direct employees; and a practical earned legalization process for undocumented individuals currently working in the U.S.
Second, enhancing the Section 8 housing choice voucher program. The Section 8 housing choice voucher program has long served as America’s primary method of rental assistance. The public-private Section 8 program could be the nation’s most effective affordable and community development tool. However, it is plagued with inefficiencies, onerous regulatory requirements and a flawed funding system. Lawmakers should address these issues to attract private housing providers’ participation in the voluntary program. Spe-cifically, there is legislation that would address the income verification requirements. Current law requires verification based on income at move-in and recertification annually. HR 233 by Representatives Ed Perl-mutter (D-CO) and Steve Stivers (R-OH) would focus verification efforts on residents whose income changes on an annual basis, while allowing those on fixed incomes to be reviewed every three years. TAA members encouraged the Tennessee representatives to support and co-sponsor this legislation.
Finally, reforming the tax code. NAA/NMHC supports tax reform that promotes economic growth and investment in rental housing without unfairly burdening apartment owners and renters relative to other asset classes. Much is potentially at stake for the apartment industry and its ability to meet the nation’s housing needs given that apartment firms pay tax when they build, operate, sell or transfer communities to their heirs. As such, tax reform legislation must protect flow-through entities (e.g., LLCs, partnerships, S Corporations, etc.) instead of publicly held corporations; maintain like-exchanges in order to protect the value and trad-ing of property; retain the deduction for business interest; ensure depreciation rules to avoid harming real estate; and protect the low-income housing tax credit – a major financing incentive for low-income housing development.
Participating in the NAA Capitol Conference and Lobby Day is an extremely effective way to grow the number of industry advocates. Working together with a unified voice is an easy way to make a difference and influence policymakers’ decisions. Conference attendees succeeded in communicating to lawmakers the real-world impact of the laws they enact by sharing their expertise and personal experiences. Put simply, 2015 was another very successful Capitol Conference for TAA!
