April 19th, 2020, marks the 25th Anniversary of the Oklahoma City Bombing. The Oklahoma City National Memorial was built directly across the street from St. Joseph

Old Cathedral. It was erected to memorialize the lives lost and those forever changed in the 1995 bombing of the Oklahoma City Alfred P. Murrah Federal building. It was officially

opened in February 19, 2001 and features one of the nations top museums. St. Joseph Old Cathedral was severely damaged by the bombing and had to be extensively repaired, while

the old parish rectory had to be demolished.

SUNSET 2020 As the sun sets on 2019 and we begin a new decade, it seems only appropriate that the Board is entering into its legislated 2020 Sunset Review. For those of you unfamiliar with this longstanding legislative requirement that began in the late 1970’s, the legislature prescribes the number of years a board or agency exists and designates a “sunset date” for the agency. Prior to that date, the Board is required to appear before a legislative Sunset Committee in both the House and Senate to show cause why it should be recreated for another specified number of years – typically 4-6 years. Requested information is supplied to the legislative committee to assist them in preparing an analysis of each agency’s history, functions, performance, finances, programs, and future goals and objectives. The burden is on each agency reviewed to establish that sufficient public need is present to

justify its continued existence.

Four years ago, this Board successfully completed its Sunset Review, and was recreated until July 1, 2020. We are currently in the process of providing the legislature all requested information and statistical data covering the past 4 years to help them understand the function, purpose, and performance of this board. The evaluation criteria typically involves factors such as whether the Board has been efficient and responsive to public needs; compliance with rulemaking requirements; expeditious processing of complaints in the public interest; and whether other entities have the same or similar objectives which may duplicate the duties of the Board. The legislature will consider the information provided and act on this information during the 2020 legislative session. Both staff members and board members participate at the legislative hearings and committee meetings to ensure that the legislature is provided sufficient information to determine the importance of the continuance of this board. As Board Chair, it is my responsibility to ensure this board is well-represented and respond to any concerns.

With Occupational Licensing being a main topic of attention both statewide and nationally, a few years ago Governor Mary Fallin asked for a study of occupational licenses, which led to the creation of an Occupational Licensing Advisory Commission to review the occupations that require licensing. This commission, under the leadership of Labor Secretary Leslie Osborn, reviews annually one-fourth of the state’s occupational licenses and may make recommendations for potential changes. The commission’s goal is to protect public safety and ensure integrity of the trade while ensuring that licenses are not overly burdensome to applicants, don’t needlessly impede job entry, and aren’t instruments of industry protectionism. Last year the commission reviewed this board’s requirements for licensing professional engineers, engineer interns, and firms. No recommendations were made to revise or remove licensing requirements for these licensees. With the creation of this commission, not only will this Board be closely scrutinized each 4-6 years through the Sunset Review process, but oversite will be continuous through commissions such as this as well as additional legislated oversight.

Adams Appointed Public Member Patrick Adams was recently appointed by Governor J. Kevin Stitt to serve as the Public Member of the Board. Mr. Adams replaces Lucy Lambert Novotny, who was appointed by Governor Mary Fallin. Mr. Adams is a graduate of Oklahoma Baptist University, where he also served as Chairman of the Board of Trustees. He is President of CLS Group, which is a company based in Edmond, Oklahoma which in 1994 he led into utility, telecommunications and construction project management which operates domestically and internationally. Mr. Adams’ 28 plus year tenure with CLS has included the management of numerous oil and gas projects, telecommunications, construction and utility projects. Mr. Adams is also a member of many professional associations, including the International Right of Way Association, the American Association of Professional Landmen, the Oklahoma City Association of Professional Landmen, the Independent Oil and Gas Association of West Virginia, Who’s Who in American Business & Executives, and was Honorary Co-Chairman of the Business Advisory Council. He also served on the National Republican Congressional Committee.

Glen Smith, P.E., P.L.S., Reappointed to the Board Glen Smith was recently reappointed by Governor J. Kevin Stitt to serve his third, 6-year term as an engineer Board Member. Mr. Smith was appointed in 2007 by Governor Brad Henry and has continued to serve as an active member of the Board and member of NCEES during this time. He was recently awarded the NCEES Southern Zone Distinguished Service Award for his contributions for serving as the Southern Zone Assistant Vice President from 2015-2017, the Southern Zone Site Selection Committee from 2010-2018, and serving on the Southern Zone Awards Selection Committee. Mr. Smith has also made valuable contributions to the Board during his first 2 terms, acting as a ABET observer at Oklahoma universities as a program evaluator, serving on the Joint Practice Committee for Architects and Engineers, as well as the Joint Task force between the Board and OSLS. His efforts to create the Professionally Engineering the Future Scholarship for engineering students led to the granting of 35 - $2,000 scholarships last year during its first year. He is recently retired from Smith-Roberts-Baldischwiler in Oklahoma City, a civil engineering and surveying company. He is a past president of OSLS and member of the Oklahoma Land Title Association, ACSM and ALTA.

Dickerson and Hart Recognized for 30 Years of Service Bill Dickerson served as a Board Member from 1981-1986. In 1990, he retired from AT&T and came to work at the Board as its Principal Assistant. Since that time, he has been very active both as an employee and as an Associate Member of NCEES. His contributions to the Board are numerous. His passion for outreach efforts and the education regarding the importance of licensure launched the Board’s Outreach Program, which reaches thousands of engineering students annually. He has gained recognition nationally for his volunteer service to NCEES, working on the FE examination development committee and chairing the Committee on Examinations for Professional Engineers and the Committee on Examination Audit. In 2005, he was awarded the NCEES Distinguished Service Award and in 2011 the NCEES Distinguished Examination Service Award for his contributions to the development and improvement of NCEES licensing exams. In 2018 he was awarded the highest honor bestowed by NCEES – the Presidential Award, which has only been awarded 3 other times in its 100 year history.

Kathy Hart graduated from Oklahoma State University with a B.S. degree in Business Administration. She came to work for the Board in 1990 as its Executive Secretary to the Director. In 1994, upon the retirement of Norma Unruh, the Board selected Ms. Hart to be its Executive Director. Since that time, Kathy has been active statewide and nationally, working to improve mobility for both professional engineers and land surveyors. She has served on and chaired the NCEES Committee for Member Board Administrators and several other national committees, working to improve communications between boards and modernize processes and practices. Kathy was awarded the NCEES Meritorious Service Award in 2006 for her valuable contributions at the national level.

Alliance for Responsible Professional Licensing

NCEES is one of the founding members of the Alliance for Responsible Professional Licensing (ARPL)—a coalition of national associations that represents highly complex, technical professions and their national licensing boards. The professions currently engaged in this coalition are Certified Public Accountants, Architects, Professional Engineers, Professional Surveyors, and Landscape Architects. ARPL was created to ensure that a unified voice for the advanced professions is present and heard in the growing debate around the appropriate level of licensure for professions and occupations.

ARPL offers a central communications committee, providing template support materials and general communications tips and tools available for use by anyone. Go to ResponsibleLicensing.org to find out about all available resources which may help educate the public and state legislators as to how professional licensing protects the life, health, safety and welfare of the citizens of the state of Oklahoma.

THE PATH TO COMPLIANCE

Commencing a New DecadePrimary Responsibility… After many years of my writing (and hopefully – you reading) “The Path to Compliance” articles for the Board’s Bulletin, I am sure you have noticed a pattern of topics relating to in-depth studies of board laws or rules or the details and resolution of a particularly interesting enforcement case. In both circumstances, we need to be aware and fully understand details which are instructive in how NOT to conduct yourself and your practice and what rules and regulations must be followed. However, as we begin a new decade it is a good time to evaluate our commitment to our own ethical behavior and ask ourselves if we are we holding it in as high importance as in prior times. Let’s focus our full attention on our primary responsibility as licensees that we all should know by heart.

It’s more important than ever to read and truly understand the

aforementioned inspirational first sentence in the statute: “ In order to safeguard life, health and property, and to promote the public welfare, the practice of engineering and the practice of land surveying in this state are hereby declared to be subject to regulation in the public interest.”

Except for the addition of “practice of land surveying” in 1968, this first sentence of the statute remains exactly as it was in the original version passed by the Oklahoma legislature and signed into law by Governor William “Alfalfa Bill” Murray in 1935. This clear and concise statement of the purpose of licensure of these professions has stood strong for 85 years and is a testament to the commitment of the scriveners to public protection.

Primarily, we learned (or should have learned) about this responsibility early on in our professional careers. When we Baby Boomers were originally licensed, we were all required to sign a Code of Ethics that committed us to demonstrate proper regard for the health, safety and welfare of the public in the performance of our professional duties. Even today, licensees are required to certify online when we obtain or renew our licenses, that we have read and understand the board laws and rules. This required certification underscores the importance for licensees to know the board laws and rules and stay current with any changes that are made. Rules Are Important…

The Board Rules of Professional Conduct were first promulgated into the administrative rules and effective on June 11, 1993. These rules help give clarity to the language in the statute, give guidance for some the ethical situations that are faced in everyday practice, and support those licensees who are dedicated to practice ethically. Further, they continue to emphasize the principle found in the purpose clause of the statute and currently read (in part) as follows: 245:15-9-3. Responsibility to the public: Licensees shall at all times recognize their primary responsibility is to safeguard the health, property, safety, and public welfare when performing services for clients and employers. Maintaining the public trust … Since 1935, the public has held our professions in high regard and exhibits trust for these professions. The public believes and trusts that because we are licensed by the state, we accept this responsibility as guardians of the public health, safety, property and general welfare. They believe that licensees will thoroughly assess all the factors involved in a project and will faithfully act in accordance with the all applicable codes, ordinances and recognized standards. They believe that engineers and surveyors will be objective, thorough and truthful in the documents they produce, the statements they make, and the testimony they give. Baker failed to discharge his duties, obligations and responsibilities required under the Oklahoma Minimum Standards for the Practice of Land Surveying and the 2016 Minimum Standard Detail Requirements for ALTA/NSPS Land Title Surveys as adopted by ALTA and NSPS, which demonstrated a disregard or indifference toward the statutes and rules, codes, ordinances and other recognized standards governing the practice of land surveying. In this regard Baker Surveying, LLC and Gerald W. Baker were found Guilty. Baker Surveying, LLC and Gerald W. Baker, were assessed an administrative fine of $4,000 and were Reprimanded. Further, Gerald W. Baker shall be audited for compliance with continuing education requirements in the next renewal cycle of his Certificate of Licensure.

Fortress Structural Engineering, Inc. and Dr. Amin Ghafooripour and Marcus K. Oden, Case No. 2018-104 Through Consent: Fortress Structural Engineering, Inc. did not have a Certificate of Authorization to offer and/or practice engineering in the State of Oklahoma at the time engineering services were offered and provided. In this regard Fortress Structural Engineering, Inc. was found Guilty, assessed an administrative penalty of $2,000 and ordered to Cease and Desist offering and/or practicing engineering services in the State of Oklahoma until such time as they have been issued a Certificate of Authorization in accordance with the laws of the State of Oklahoma. In this regard TCC Consultants, Inc. was found Guilty, assessed an administrative penalty of $500 and ordered to Cease and Desist offering and/or practicing engineering services in the State of Oklahoma until such time as they have been issued a Certificate of Authorization in accordance with the laws of the State of Oklahoma. Brian David Scott, PLS 1585, Case No. 2019-038 Through Consent: Brian David Scott did not have a current Certificate of Licensure to offer and/or practice land surveying in the State of Oklahoma at the time the land surveying services were offered and provided. Further, Scott has failed to comply with the terms and requirements of the Final Orders in Case No’s. 2014-025 and 2015-021. In this regard, Scott was found Guilty of both violations, assessed an administrative penalty of $1,000 and ordered to Cease and Desist from offering and/or practicing land surveying in the State of Oklahoma until such time as he has been re-issued a Certificate of Licensure in accordance with the laws of the State of Oklahoma.

Winters Engineering Co. and Doug Winters, Jr., Case No. 2019-039 Through Consent: Winters Engineering Co. did not have a Certificate of Authorization to offer and/or practice engineering in the State of Oklahoma at the time the engineering services were offered and provided. In this regard Winters Engineering Co. was found Guilty, assessed an administrative penalty of $2,500 and ordered to Cease and Desist offering and/or practicing engineering services in the State of Oklahoma until such time as they have been issued a Certificate of Authorization in accordance with the laws of the State of Oklahoma. Doug Winters, Jr. did not have a Certificate of Licensure to offer and/or practice engineering in the State of Oklahoma at the time the engineering services were offered and provided. In this regard, Winters was found Guilty, assessed an administrative penalty of $2,500 and ordered to Cease and Desist offering and/or practicing engineering services in the State of Oklahoma until such time as he has been issued a Certificate of Licensure in accordance with the laws of the State of Oklahoma.

Hill, P.E. signed, sealed and dated structural engineering design drawings that were not prepared under his direct control and personal supervision. In this regard Hill was found Guilty and assessed an administrative penalty of $2,000.

RPLS, LLC, CA 7462 and David L. M. Louy, PLS 1310 Case No. 2018-099 Through Consent: RPLS, LLC issued a survey in which David L. M. In this regard, RPLS, LLC were found Guilty, and assessed an administrative penalty of $1,000. David L. M. Louy failed to achieve minimum standards as required by the Oklahoma Minimum Standards for the Practice of Land Surveying. You may apply to the Board for certification as an Engineer Intern or Land Surveyor Intern following completion of your education and examination requirements at www.pels.ok.gov

• The PS Exam is administered using CBT and is offered year-round. You must have your application approved by the Board prior to

NCEES seeks agricultural and biological engineers’ professional expertise and advice

NCEES is currently seeking licensed agricultural and biological engineers to participate in a professional activities and knowledge study, or PAKS, for the PE Agricultural and Biological Engineering exam. The results of this online survey will be used to update specifications for the exam, which is used throughout the United States for licensing purposes.

NCEES requires a cross section of licensed professional engineers practicing agricultural and biological engineering—including those working in industry, consulting, the public sector, and academia—to complete an online survey about the tasks and knowledge required of a licensed agricultural or biological engineer with four to six years of experience to practice in a manner that safeguards the health, safety, and welfare of the public. The survey can be completed in approximately 40 minutes.

“These studies help NCEES ensure its licensing exams remain relevant to current professional practice,” explained Director of Exam Services Tim Miller, P.E. “The value of this PAKS depends on the number of people who participate, so NCEES is eager to get input from professional engineers across all areas of agricultural and biological engineering.”
