Guide to the Prescriptive Energy Efficiency Design Summary FormThis form must accurately reflect the information contained on the drawings and specifications being submitted.Refer to Supplementary Standard SB-I 2 for details about building code compliance requirements. Furtherinformation about energy efficiency requirements for new buildings is available from the provincial building codewebsite or the municipal building department.

The building code permits a house designer to use one of four energy efficiency compliance options:

1. Comply with the SB- 12 Prescriptive design tables (this form is for this option (Option 1)),2. Use the SB- 12 Performance compliance method, and model the design against the prescriptive standards,3. Design to Enemy Star, or4 Design to R2000 standards.

COMPLETING THE FORMS. Compliance OptionsIndicate the compliance option being used.

SB-12 Prescriptive requires that the building conforms to a package of thermal insulation! window andmechanical system efficiency requirements set out in Subsection 3.1.1. of 56-12. Energy efficiency designmodehng and testing of the building is not required under this option. Certain substitutions are permitted. Inwhich case, the applicable airtightness targets in Table 3.1.I.4.A must be met.

C. Project Design ConditionsClimatic Zone: The number of degree days for Ontario cities is contained in Supplementary Standard SB-IWindows, Skylights and Glass Doors: If the ratio of the total gross area of windows, sidelights, skylights, glazingin doors and sliding glass doors to the total gross area of walls is more than 17%, higher efficiency glazing isrequired. lithe ratio is more than 22%, the SB-12 Rex4,M’e option may not be used. The total area is the sum of allthe structural rough openings. Some exceptions apply. Refer to 3.1.1.1. of SB-i 2 for further details.Fuel Source and Heating Equipment Efficiency: The fuel source and efficiency of the proposed heatingequipment must be specified in order to determine which 58-12 Prescriptive compliance package table applies.Other Building Conditions: These construction conditions affect 58-12 Pmscriotive compliance requirements.

0. Building SpecificationsThermal Insulation: Indicate the RSI or R-value being proposed where they apply to the house design. Underthe 58-12 Prescriptive option, aftemve ICE wall insulation is permitted in certain conditions where otherdesign elements meet higher standards Refer to SB-i 2 for further details. Where effective insulation valuesare being used, the Authority Having Jurisdiction may require supporting documentation.

BUILDING CODE REQUIREMENTS FOR AIRTIGHTNESS IN NEW HOUSESAll houses must comply with increased air barrier requirements in the building code. Notice of air barriercompletion must be provided and an inspection conducted prior to it being covered.

The air leakage rates in Table 3.1.1 .4.A are not requirements. This provision is a voluntary provision for whencredits for airtightness are claimed Credit for air tightness allows the designer to substitute the requirements ofcompliance packages as set out in Table 3.1.1.4.6 or 3.1.1 .4.C. Neither the air leakage test nor compliance withairtightness targets given in Table 3.1.1 .4.A are required, unless credit for airtightness is claimed. The building code requires that a blower door test be conducted to verify the air tightness of the house duringconstruction if the SB-12 Proscriptive option with airtightness credit being applied. Results of the airtightnesstest may need to be submitted to the Authority Having Jurisdiction. Airtightness of less than 2.5 ACH @ 50 Pa(or NLA or NLR equivalent) in the case of detached houses, or 3.0 ACH 50 Pa (or NLA or NLR equivalent) inthe case of attached houses is necessary to meet the required energy efficiency standard.

COMPLETING THE FORMB. Compliance OptionsIndicate the compliance option being used.

• SB-12 Performance refers to the method of compliance in Subsection 3.1.2. of SB-12. Using this approachthe designer must use recognized energy simulation software (such as HOT2000 Vi0.51 or newer), andsubmit documents which show that the annual energy use of the proposed building is equal to or less than aprescriptive (referenced) building package.

• ENERGY STAR houses must be designed to ENERGY STAR requirements and verified on completion by alicensed energy evaluator and/or service organization. The ENERGY STAR BOP form must be submitted withthe permitdocuments.

• R-2000 houses must be designed to the R-2000 Standard and verified on completion by a licensed energyevaluator and/or service organization. The HOT2000 report must be submitted with the permit documents.

Introduction

Land use planning affects almost every aspect of life inOntario. It helps decide where in our communities homesand factories should be built; where parks and schoolsshould be located; and where roads, sewers and otheressential services should be provided.

Land use planning means managing our land andresources. It helps each community to set goals about howit will grow and develop and to work out ways of reachingthose goals while keeping important social, economic andenvironmental concerns in mind. ft balances the interestsof individual property owners with the wider interests andobjectives of the whole community.

Good planning leads to orderly growth and the efficientprovision of services. It touches all of us and helps us to havethe kind of community we want.

But often we don’t see how it affects our lives and propertyeach day. And it often seems confusing. A series of Citizens’Guides has been prepared to help you understand howthe land use planning process works in Ontario. They areintended to give general information only and are not aninterpretation of the Planning Ad or any other ad. Youshould refer to the legislation for specific requirements andprocedures.

What Is a building peiiiik?

The body responsible for enforcing Ontario’s Building Codein your area issues permits forthe construction, renovation,demolition and certain changes of use of buildings, andfor the installation, alteration, extension or repair of on-sitesewage systems. Building Code enforcement is generallycarried out by municipal building departments, although inthe case of on-site sewage systems, enforcement in someareas is conducted by boards of health and conservationauthorities.

Why do you need to obtain a building

Building permits allow your municipality to protect theinterests of both individuals and the community as a whole.By reviewing and approving building plans before any workis done, the municipality can ensure that buildings complywith:

• the Building Code, which sets standards for the designand construction of buildings to meet objectives such ashealth, safety, fire protection, accessibility and resourceconservationthe local zoning by-law and other planning controls onbuildings

• other applicable legislation, including conservationauthority approvals and certain requirements under theEnvironmental Protection Act.

When do you need a building permit?

You must obtain a building permit before you:

• constmd any new building over ten square metersin area or place another stnjdure, such as a mobilehome, on your property

• make renovations or repairs or add to a buildingexcavate or canstnd a foundationconstruct a seasonal building.

Permits are also required for the installation, alteration,extension or repair of an an-site sewage system.

Contact your municipality if you have any questions aboutwhen a building permit may be required.

How do you apply for a building permit?

You can get on application for a building permit from eitheryour municipality or the Minishy of Municipal Mairs andHousing’s Building Code website under “publications”. fVisitvmw.ontaho.ca/buildingcode.) But it’s a good idea to talkto the staff at your municipality before you apply. They cantell you what information, drawings and plans you’ll haveto include with the application and whether you’ll needany other permits or approvals. Note that building permitapplications are submitted to your municipality, not to theprovincial government.

‘Mien you apply, you’ll have to attach drawings, plans, andother documents. You may also have lo pay o fee.

What happens to your appIkafion?

Staff at your municipality will review your application toconfirm that the proposed work complies with the BuildingCode and other laws set out in the Building Code, such aslocal zoning by-laws. They may send your application toother local/municipal officials for comments.

Applications for a simple alteration or addition can beprocessed fairly quickly, but more complex proposals maytake longer. The Building Code requires that a municipalityreview a permit application within a certain timeframewhere the application meets the criteria set out in the Code.For example, the timefrome on a permit application for ahouse is 1 0 days. For a more complex building, such as ahospital, the timeframe is 30 days. Wthin this timeframe, amunicipality must either issue the permit or refuse it with fullreasons for denial.

In order to be issued a permit, the proposed constructionmust comply with the Building Code and with the applicablelaws set out in the Building Code. if you need a zoningchange or a minor variance from the zoning by-law(municipal zoning is considered applicable law), or if theproposed constwdion does not comply with the BuildingCode, a permit will not be issued until the zoning changeor minor variance has been obtained, or the proposedconstruction complies with the Building Code.

If your property is covered by a site plan control by-la youwill not get a building permit until the plans and drawingshave been approved by the municipality See Zoning Bylaws, No. 3 in the series, for more informatIon about zoning,minor variances, and site plan controls.

What can you do if your application is turneddon?

If your municipality refuses your application, you will be toldwhy. if you can’t resolve the problems with the municipality,you have a few options for appealing their decision.

If the problem relates to technical requirements set outin the Building Code, you may apply to the BuildingCode Commission. The Building Code Commission isan independent adjudicative tribunal of the provincialgovemment whose mandate is to hear disputes relatedto compliance with the technical requirements of theBuilding Code. If you wish to apply to the BuildingCode Commission for a hearing, you can find theiraddress at the end of this guide. You can also find theBuilding Code Commission’s application farms andtheir Guidelines, Policies and ftocedures on the Building Code website (ontario.ca/buildingcode) under‘ppeals and Approvals”.

If the problem relates to compliance with other applicable laws, such as interpretation of the zoning by-law,you can appeal to a judge of the Superior Court ofJustice, who will review the zoning and decide whetheryour application complies with the zoning by-law. Youmay want to talk to a Iavyer first.

What happens during constradion?

The Building Code sets out the stages of construction atwhich different types of buildings/sewage systems requireinspections. It is the responsibility of the permit holder tocontact the municipality for an inspection when the projectis at the stages of constmdion set out in the Building Code.The municipal building official is required to carry outthe inspection within two working days of being notified.For construction of a sewage system, the inspector hasfive working days to conduct the inspection. During theinspection, a building inspector will inspect the work todetermine if it is carried out in accordance with the BuildingCode, your permit and the approved plans.

You will also be required to:

• show your permit in a window or other place where itcan be easily seen

• keep copies of the plans on the site• tell the municipality about any changes to the proposed

construction, which will also have to be approved by themunicipality.

The inspector must always be able to see the work. If it’sdifferent from the work that was approved and, unless youget permission for a revision to your plans, you will be told tocorrect it. If you don’t, the municipality can take enforcementaction, such as issuing orders authorized under the BuildingCodekt, 1992.

What about demoliflon?

Before you take down all or pert of o building, you will haveto apply to your municipality for a demolition permit. Theprocess is much the same as for a building permit, but somespecial situations may affect your application.

In a demolition control area, for example, you will notbe able to demolish a residential property until you havereceived a demolition permit issued by the municipal council.

Or, because of the building’s historic or architecturalimportance, it may be designated, or be intended fordesignation, as a heritage building under the OntarioHeritage Ad In that case, demolition will require council’s

approval and there may have to be negotiations overhow some of the unique character of the building can bepreserved.

What if you want to diange a building’s use?

If you want to change the way you use all or pert of thebuilding, you may need a change of use permit, even ifyou’re not planning any construction. A building evaluationmay have to be done to make sure that the existing buildingcan support the proposed use. Different uses have differentBuilding Code requirements.

Call your municipal building department to find out whetheryou will need a change of use pen-nit.

What happens if you contravene the BuildingCode Ad, 992?

An individual who is charged and found guilty of an offenceunder the Building Code Ad, 1992, such as building withouta permit, can be fined up to $50,000 for a first offence andup to $100,000 for subsequent offences. For a corporation,a first offence could result in a maximum fine of $100,000and $200,000 for subsequent infractions.

Failure to comply with an order from the municipal buildingdepartment is also an offence under the Building Code Act,W92.

What other approvals may be required?

In addition to the planning approvals and building permitwhich are required for a building project, other permits andapprovals may be required in particular circumstances,e.g., Conservation Authority and Minisby of Transportationapprovals. These approvals are considered applicable law.The applicable laws, which are set out in the Building Code,must be complied with for the building permit to be issued.
