ANTITRUST INTELLECTUAL PROPERTY CONFERENCE Antitrust and IP in Silicon Valley and Beyond

Thursday, October 6, 2011 8:00-8:45am Registration and Continental Breakfast

8:45-9:00am Welcome and Introduction

Speakers: Mark A. Lemley, Stanford Law School, Palo Alto, CA

Richard M. Steuer, Mayer Brown LLP, New York, NY

9:00-9:40am Opening Presentation: “The Global Market For Patents” Founded in 2000, Intellectual Ventures has built one of the world’s largest portfolios of U.S. patents. For over a decade, its business plan and strategies have been a constant topic of conversation in the technology world. What’s next?

Speaker: Peter N. Detkin, Founder and Vice Chairman, Intellectual Ventures, Seattle, WA

9:40-11:00am Antitrust and IP in China As Chinese companies, enforcers and courts become more assertive on the global stage, what are the biggest antitrust and IP issues that will emerge for technology businesses and practitioners doing business in China? How will China’s enforcement regime and courts compare to those of other countries? How will China treat its state-owned entities as compared to private firms – especially ones based outside of China? Will the Chinese system be as respectful of private IP rights as the U.S. regime? Under what circumstances will Chinese competition law find a duty to license IP, or impose compulsory license obligations on a “dominant firm”?

Moderator: Mark D. Janis, Indiana University Maurer School of Law, Bloomington, IN

Speakers: The Honorable William E. Kovacic, Commissioner, Federal Trade Commission, Washington, DC Gregory K. Leonard, NERA Inc., San Francisco, CA

Sean P. Murphy, VP and Counsel, International Government Affairs, Qualcomm Inc., San Diego, CA

Susan Ning, King & Wood, Beijing, China

11:00-11:15am Break

11:15am - 12:45pm Is Google a Monopoly, Or is Competition Just “A Click Away”? – An Oxford-Style Debate

Google’s acquisitions and business arrangements have attracted increasingly intense scrutiny from antitrust authorities and courts. Why? Are antitrust concerns about Google justified or overblown? Those questions will be the subject of our Oxford-style debate. At the conclusion of the debate, we will poll the audience for its views.

Moderator: Christopher B. Hockett, Davis Polk & Wardwell LLP, Menlo Park, CA

Speakers: Jonathan S. Kanter and Charles F. Rule, Cadwalader, Wickersham & Taft LLP, Washington, DC Jonathan M. Jacobson and Scott A. Sher, Wilson Sonsini LLP, Washington, DC

12:45-1:30pm Luncheon

1:30-2:15pm Luncheon Presentation: A Conversation on Innovation, Antitrust and the Global Economy

Speakers: Mark A. Lemley, Stanford Law School, Palo Alto, CA Carl Shapiro, President’s Council of Economic Advisors, Washington, DC

2:15-3:45pm Applying Antitrust and IP Rules To Open Source Does harm to open-source alternatives increase the chances that conduct will be found anticompetitive, either in the standard-setting context or otherwise? Does acquisition of an open source business or product by a proprietary software company pose antitrust issues (as it seemed to in the EU investigation of Oracle-Sun/MySQL)? And how will antitrust rules apply to collaborations among competitors when open source is the subject of their collaboration?

Moderator: David F. McGowan, University of California at San Diego School of Law, San Diego, CA

Speakers: Frances Marshall, U.S. Department of Justice, Antitrust Division, Washington, DC Heather Meeker, Greenberg Traurig LLP, East Palo Alto, CA Steve Mutkoski, Director of Standards & Interoperability, Microsoft Corporation,

Redmond, WA The Honorable Edith Ramirez, Commissioner, Federal Trade Commission,

Washington, DC

3:45-4:00pm Break

4:00-5:30pm Analyzing Mergers in Technology and Communications Industries Merger activity in the technology and communications space has picked up sharply, and so has the intensity of merger review by antitrust authorities. How can companies and practitioners better predict what types of mergers in these areas will attract serious antitrust objections? What are the best strategies for overcoming those objections? How will the authorities evaluate whether a merger will promote or impede innovation? And how will the authorities decide whether to intervene in industries where technological innovation can rapidly change competitive dynamics and market shares?

Moderator: Arthur J. Burke, Davis Polk & Wardwell LLP, New York, NY and Menlo Park, CA

Speakers: Deborah L. Feinstein, Arnold & Porter LLP, Washington, DC Richard J. Gilbert, University of California, Berkeley, CA Dana R. Wagner, General Counsel, Square, San Francisco, CA

Daniel M. Wall, Latham & Watkins LLP, San Francisco, CA

5:30-7:00pm Closing Reception

Page 2 Antitrust and IP in Silicon Valley and Beyond

Dear Colleagues:

On October 6, 2011, top practitioners, industry representatives, government enforce-ment officials, and respected scholars will gather at Stanford Law School for a one-day conference spotlighting the hottest emerging issues at the intersection of antitrust and intellectual property law.

Antitrust and IP issues have never been more important to technology companies and practitioners in Silicon Valley and beyond. Competition is intense, and often revolves around an increasingly global race to acquire and assert IP rights. This conference will focus on how these dynamics affect corporate and legal strategies, responses by anti-trust enforcers, and the roles of counsel and other professionals.

The conference will examine key questions and hot debates that bear directly on the technology industry. Should Google be considered a dangerous monopoly, or is competition just “a click away”? Listen to an Oxford-style debate on the question and decide for yourself. How will antitrust and IP rules apply to Open Source? What lies ahead for Antitrust and IP in China? What is the future direction of the global market for patents? And what are the latest antitrust challenges facing mergers in the tech-nology and communications industry?

Speakers include: FTC Commissioners William Kovacic and Edith Ramirez, Professor Carl Shapiro (President’s Council of Economic Advisors), Peter Detkin (Founder and Vice-Chairman, Intellectual Ventures), and other leading professionals from indus-try, private firms, academia, and government. At the conclusion of the conference, there will be a closing cocktail reception at the Law School open to all speakers and attendees.

Don’t miss this great opportunity to earn CLE credit and gain information and insights of real value to your practice. Mark your calendar and register now.

Mark A. Lemley, Stanford Law School, Palo Alto, CARichard M. Steuer, Mayer Brown LLP, New York, NY

9:00-9:40 a.m.Opening Presentation: “The Global Market For Patents”

Founded in 2000, Intellectual Ventures has built one of the world’s largest portfolios of U.S. patents. For over a decade, its business plan and strategies have been a constant topic of conversation in the technology world. What’s next?

SPEAKER:Peter N. Detkin, Founder and Vice Chairman, Intellectual Ventures, Palo Alto, CA

9:40-11:00 a.m.Antitrust and IP in China

As Chinese companies, enforcers and courts become more assertive on the global stage, what are the biggest antitrust and IP issues that will emerge for technology businesses and practi-tioners doing business in China? How will China’s enforcement regime and courts compare to those of other countries? How will China treat its state-owned entities as compared to private firms – especially ones based outside of China? Will the Chinese system be as respectful of private IP rights as the U.S. regime? Under what circumstances will Chinese competition law find a duty to license IP, or impose compulsory license obligations on a “dominant firm”?

MODERATOR:Mark D. Janis, Indiana University Maurer School of Law, Bloomington, IN

SPEAKERS:The Honorable William E. Kovacic, Commissioner, Federal Trade Commission, Washington, DC Gregory K. Leonard, NERA Inc., San Francisco, CA Susan Ning, King & Wood, Beijing, ChinaMallun Yen, Executive Vice President, RPX Corporation, San Francisco, CA

11:15 a.m.-12:45 p.m.Is Google a Monopoly, Or is Competition Just “A Click Away”? – An Oxford-Style Debate

Google’s acquisitions and business arrangements have attracted increasingly intense scru-tiny from antitrust authorities and courts. Why? Are antitrust concerns about Google justi-fied or overblown? Those questions will be the subject of our Oxford-style debate. At the conclusion of the debate, we will poll the audience for its views.

2:15-3:45 p.m.Applying Antitrust and IP Rules To Open Source

Does harm to open-source alternatives increase the chances that conduct will be found anti-competitive, either in the standard-setting context or otherwise? Does acquisition of an open source business or product by a proprietary software company pose antitrust issues (as it seemed to in the EU investigation of Oracle-Sun/MySQL)? And how will antitrust rules apply to collaborations among competitors when open source is the subject of their collaboration?

4:00-5:30 p.m.Analyzing Mergers in Technology and Communications Industries

Merger activity in the technology and communications space has picked up sharply, and so has the intensity of merger review by antitrust authorities. How can companies and practitioners better pre-dict what types of mergers in these areas will attract serious antitrust objections? What are the best strategies for overcoming those objections? How will the authorities evaluate whether a merger will promote or impede innovation? And how will the authorities decide whether to intervene in indus-tries where technological innovation can rapidly change competitive dynamics and market shares?
