AGENCY ROLE, PERFORMANCE AND GOVERNANCE

Legislation and Structure The Teachers Registration and Standards Act 2004 (the Act) and the Teachers Registration and Standards Regulations 2005 (Regulations) were proclaimed on 31 March 2005. The legislation significantly enhanced the power, functions and responsibilities of the Board. Child protection and promoting the teaching profession and professional standards for teachers are the cornerstones of the legislation.

The object of the Act is to, establish and maintain in the public interest, a teacher registration system and professional standards for teachers to ensure members are competent educators and fit and proper persons to have the care of children.

The legislation forms a key part of the government’s Child Protection Reform programme Keeping them Safe.

The Board is a body corporate, has perpetual succession and a common seal and has the powers of a natural person and the functions and powers assigned or conferred under this and any other Act.

The welfare and best interests of children must be the primary consideration in the performance of the Board’s functions.

The functions of the Board are: - to administer the provisions of this Act for the regulation of the teaching profession; - to promote the teaching profession and professional standards for teachers; - to confer and collaborate with teacher education institutions with respect to the appropriateness

for registration purposes of teacher education courses; - to confer and collaborate with teacher employers, the teaching profession, teacher unions and

other organisations and other bodies and persons with respect to requirements for teacher registration and professional and other standards for teachers;

- to confer and collaborate with other teacher regulatory authorities to ensure effective national exchange of information and promote uniformity and consistency in the regulation of the teaching profession within Australia and New Zealand;

- to keep the teaching profession, professional standards for teachers and other measures for the regulation of the profession under review and to introduce change or provide advice to the Minister as appropriate.

The membership of the Board is determined pursuant to Section 9 (1) of the Act. The Minister for Education and Children’s Services, employers unions and the tertiary sector (teacher education) nominate members (and deputy members) who are appointed by the Governor.

The Board meets on a monthly basis to develop and approve policies and procedures, conduct general business and determine strategic directions. The Board delegates the determination of matters pursuant to Part 5 (Admissions) and Part 7 (whether conduct constitutes proper cause for disciplinary action or whether a teacher’s capacity to teach is seriously impaired by an illness or disability affecting the person’s behaviour or competence as a teacher) to a committee. This committee is comprised of not less than three members of the Board including a member who is a legal practitioner and a member who is a practising teacher. During the reporting period the Board determined there would be five members on a committee formed for this purpose.

Standing Committees To enable specific matters to be dealt with in an efficient and effective manner, the Board has established four standing committees. A range of matters are referred to these committees for discussion and to develop proposals and recommendations for resolution by the Board. Staff of the Board provide executive support to all standing committees

Organisational Chart

Inquiries The Board may, on complaint by the Registrar, or of its own motion, hold an Inquiry to determine whether the conduct of a registered teacher (or formerly registered teacher) constitutes proper cause for disciplinary action. The Teachers Registration and Standards Act 2004 increased the Board’s powers, responsibilities and sanctions to deal with unprofessional conduct and incapacity of teachers. Teachers, employers, the Commissioner of Police, the Department of Public Prosecutions and the Board have an obligation to report a range of matters as specified in the legislation.

In 2007 the Board held eleven Inquiries. Of these: four formerly registered teachers were disqualified from being registered on a permanent basis; three formerly registered teachers were disqualified from being registered until further order; one registered teacher had his registration cancelled until further order; one registered teacher had his registration cancelled and was disqualified from being a teacher on a permanent basis; one registered teacher received a severe reprimand and was suspended for a period of two years and seven months; one teacher was suspended for eight months. There were no appeals from a decision of the Board to the District Court.

Hearings – Incapacity Pursuant to Section 38 of the Act, the Board has the responsibility to inquire into matters where issues related to a teacher’s capacity to teach have been raised. Three matters have been heard in the reporting period. One teacher was suspended by consent until further order; two teachers retained their registration but were subject, in each case, to extensive conditions to take into account the susceptibility to recurrent exacerbations of mental illness.

Hearings – Admission to the Register The Board has held thirteen Hearings in relation to the Admission to the Register of new or formerly registered persons, who did not hold requisite prescribed qualifications and/or experience nor meet the Board’s policy on recency of practice. Ten applicants were granted provisional registration subject to the condition they upgrade their qualifications to meet prescribed qualification standards; two applicants were refused registration; one applicant was granted provisional registration subject to conditions related to the state of mental health. There were no appeals from a decision of the Board to the District Court.

Criminal Record Checks The Act requires an applicant to consent to the conduct by the Board of a criminal record check on application and renewal (every three years) of registration. The cost of the check is met by the teacher. A National Criminal History Record Check Service is provided by CrimTrac. The CrimTrac Agency was established in 2000 by the Commonwealth Government. CrimTrac provides a service to accredited third party agencies principally for the purpose of ensuring that persons in positions of trust are adequately screened for criminal records.

The Board has been an accredited Crimtrac agency since 2004 and has recently entered into a further contract period. Over 9,000 registered teachers are due to renew their registration by 31 December 2007, one month before the expiry date of 31 January 2008. On renewal of registration teachers will be required to consent to a criminal history record check, pay the fee and provide required documentation to satisfy a ‘100 point’ identity check.

The Board participated in an inter agency committee established by the Department of Families and Communities to determine a standard in line with the Children Protection Act 1993, in dealing with information obtained about criminal history of employees and volunteers who work with children in government and non-government organisations. It is expected protocols and guidelines will be developed by the end of 2007.

Delegations Section 19 of the Act requires the Board to include details in the Annual Report of any delegation of a function or power of the Board that was in operation during the relevant financial year. In addition to those previously reported, the Board delegated to the Registrar powers and functions in respect to granting provisional registration and impose on that registration only the condition required to be imposed by Section 24(2)(a) and 21(1)(b) of the Act and a standard condition. For the purposes of this delegation standard condition relates to the completion of mandatory notification training course within a period of time.

Raising the profile of teaching as a profession and highlighting the valuable contribution that teachers make to the community

researched, developed and launched a Code of Ethics for the teaching profession. The Code of Ethics articulates three core values South Australian teachers highlighted as underpinning the teaching profession; integrity, respect and responsibility.

developed professional teaching standards for pre-service teacher education graduate teachers and for change of registration status from provisional to registration – to be finalised by the end of 2007 and implemented 2008.

developed draft pre-service teacher education approval processes for pre-service teacher education providers in relation to teacher registration to be finalised by the end of 2007 and to be implemented 2008.

sponsorship of teachers to attend the Third International Middle Years of Schooling conference, August 2006.

Developing partnerships with other teacher regulatory authorities to promote uniformity and consistency of standards and exchange of information contributed to the development of national frameworks, policies and procedures in the areas of

teacher registration and pre-service teacher education.

actively participated as a member of the Australasian Forum of Teacher Registration and Accreditation Authorities (AFTRAA).

supported the incorporation of AFTRAA (to be in operation by the end of 2007).

supported an AFTRAA initiative relating to undertaking a national survey to research the current views of teachers throughout Australia about their experiences of professional development and its importance to their professional lives (completion date November 2007).

participated with members of AFTRAA and Australian Council of Education Research (ACER) to produce a periodic Research Digest. The Digest will focus on a single topical issue and provide a review of major messages from the research of the issue. The Digest will be published on the website and publicised in the Annual Newsletter.

supported and participated in meetings of AFTRAA Qualification Assessment Officers and Legal Officers (Investigations) to promote uniformity and consistency between authorities.

represented Australia on the nomination of AFTRAA and the Department of Education Science and Training at an international meeting of the (British) Commonwealth Secretariat Working Party on Teacher Qualifications and Professional Registration.

represented AFTRAA on the Teaching Australia Qualifications Advisory Panel. Teaching Australia is the designated assessing authority for people seeking to migrate under the Skills Migration Program.

represented AFTRAA and Australia, on nomination of the Department of Education, Science and Training as a member of the (British) Commonwealth Working Group on Teachers Qualifications, September 2006, Tshwane, South Africa.

Developing an integrated management system that maintains integrity and confidentiality of information and ensures compliance with requirements under the Act and Regulations

successfully tendered for a supplier to work with the Board to develop a new data base system to replace an existing outdated system (over twenty years old).

Applicants can apply for an assessment of overseas qualifications prior to lodging an application for registration to determine whether or not their qualifications would meet requirements appropriate for registration. During the period 1 July 2006 to 30 June 2007, there were 194 applications for assessment of overseas qualifications.

Of these 164 were assessed as meeting the qualification requirements for registration as a teacher and 30 were refused. Those assessed as meeting the qualification requirements included 45 from India, 44 from the United Kingdom, 17 from South Africa, 5 from the United States of America, China and the Philippines.

Workforce Diversity - Cultural and Linguistic Diversity Two males and three females (35.7%) were born overseas. One male and two females speak languages other than English at home.

Voluntary, Flexible Working Arrangements Two males and six females use flexi-time as part of their working arrangements. There have been no requests from employees to access other flexible working arrangements.

Performance Development As at 30 June 2007 thirteen employees had individual performance development plans reviewed within the last twelve months. A performance development plan will be negotiated with an employee who commenced mid-June 2007 in due course.

Due to significant changes resulting from the legislation proclaimed March 2005 and a subsequent organisational review which should be finalised by August 2007, targeted induction programmes including “in house” training have been an agency priority. Total Training and Development expenditure to 30 June 2007 was $13,000 (1.5%) of total salary expenditure and the total Leadership and Management Development expenditure was $17,000 (2.0%) of total salary expenditure. In addition, two Accredited Training Packages were undertaken at AS02 level and two at AS05 level.

Commitment to Customer Service All positions within the agency have either been established or reviewed since 2005. All Job and Person Specifications reflect a commitment to the provision of customer service.

Occupational Health, Safety and Injury Management / Risk Management There was one notifiable injury and claim for worker’s compensation during 2006-07. The injury was minor and no time was lost. The Board holds a Level 3 rating. There were no notifiable occurrences or injuries in 2004-05 or 2005-06. FINANCIAL PERFORMANCE Account Payment Performance During the 2006-07 financial year 675 accounts to the value of $2 675 342 (88.61%) were paid by the due date and 89 accounts to the value of $413 666 (13.39%) were paid within thirty days of the due date. A significant number of invoices were received later than the invoice date due to supplier invoicing issues.

Fraud There were no instances of fraud detected in the agency during the reporting period.

Overseas Travel One employee travelled to Tswhane, South Africa to represent the Australian Forum of Teacher Registration and Accreditation Authorities (AFTRAA) and the Commonwealth of Australia on nomination of the Department of Education Science and Training (DEST) at a meeting of the Commonwealth (British) Secretariat Working International Group regarding Professional Teaching Qualifications and Professional Teacher Registration. Total cost to the agency was $4,000 (including salary).

Disability Action Plans There is appropriate access for persons with disabilities or mobility impairment both in the client service areas and within office work areas. Services and programmes undertaken by the agency are documented and published on the website, as well as the Register of Teachers as prescribed in Section 28 b (b) of the Teachers Registration and Standards Act 2004. Feedback/comments can be submitted in person, telephone or through the Board’s info line.

Employment practices are based on merit and do not discriminate against people with disabilities. In accordance with legislative requirements, applicants for registration as a teacher need to satisfy the Board they are fit and proper to teach. Applicants are required to declare whether their capacity to teach is seriously impaired by an illness or disability affecting their behaviour or competence as a teacher. Depending on the circumstances, an applicant may be required to submit to a medical examination by a medical practitioner selected by the applicant from a panel of medical practitioners nominated by the Board. All matters are considered on a case by case basis observing the principles of natural justice and appropriate legislation e.g., Disability Discrimination Act and the Equal Opportunity Act.

Freedom of Information The structure and functions of the Board are stated in Part 3, Section 6 of the Teachers Registration and Standards Act 2004 and published in the Annual Report and on the Board’s website. The Teachers Registration Board is a Statutory Authority regulating the teaching profession in South Australia. The primary participation is through members of the Board who are nominated by the Minister for Education and Children’s Services, employers, unions and the university sector (teacher education) and appointed by the Governor. During the reporting period the Board entered into a new lease agreement for additional accommodation. The increase in persons employed within the agency (and associated resources) together with an increase in accommodation has impacted on energy usage. Energy efficiency measures are taken into consideration when purchasing equipment and in general operations undertaken on a daily basis e.g. turning off lights when rooms are not in use, turning off electrical equipment (if applicable), recycling of paper after shredding, recycling of printer cartridges. During 2007-08 the agency will consider aspects (where applicable) of the Go GO Operations framework to develop an agency Implementation Plan (as appropriate).
