    Hertfordsh ire Oil Storage v HSE [March 2010 CA Crim Div] - A decision of Court of Appeal oninterlocutory appeal concerning the Control of Major Hazard Regulations of 1999.

    Regulatory cases:

    R v Total (UK) Ltd and Ot hers:- 2010 St Albans CC

    Andrew led the prosecution of five companies involved in the Buncefield disaster. Two companiespleaded guilty and the remaining three were convicted after a three month trial. This was the culminationof three years work analysing, advising and shaping the case and guiding the proceedings to theirconclusion. Amongst other reactions following the trial the Health & Safety Executive (HSE) and theEnvironment Agency (EA) issued a joint statement:- This was the biggest and most complex criminalinquiry we have worked on together the product of many hundreds of hours of painstaking forensicinvestigation. When companies put workers and members of the public at risk and cause environmentaldamage we will prosecute.

    R v Smith s (Gloucester) Ltd:- 2010 Gloucester CC

    The successful defence of prosecution brought by the Environment Agency.

    HSE v Raymo nd Broth ers (2007, Swans ea CC) Defending a farmer (two week trial) in relation to aprosecution by the HSE of a fatality occasioned by a fall from height.

    HSE v Coru s UK (2005/6 Swansea CC) Concerning the Port Talbot Blast Furnace explosion resultingin the death of 3 workers and injuries to 17 others in November 2001, resulting in a fine and costs of 3m.

    R v Sm ith-Keary & Rudkin (2003-04, Exeter CC) This was a DEFRA prosecution of a 2 million poundfraud on the EEC Flax Fibre Scheme, tried in Exeter before HHJ Griggs September -December 2003. Iwas involved from an early stage (i.e. prior to commencement of proceedings) The case involves over150 witnesses, and centred around the interpretation of EEC regulations, the availability of grants, andfraudulent records created by directors of the two Companies involved.

    R v Imery Lt d & Ag gregate Indu str ies UK Ltd (2003, Truro Crow n Court) Litigation involving two

    large Companies involving a china clay quarry fatality, resulting in financial penalties of million.

    R v Polestar Purnel l Bristo l Crown Co urt (2003) The prosecution of a printing Company for anexplosion in the printing works.

    R v St Meryn Meat (2003, Cornwall) A trial in which I defended a prestigious slaughter house /meatpackaging business against Regulatory offences concerning the running of an slaughter house.

    R v Litt le john Bathrooms (2002, Winchester Crown Court) Defending breach of asbestosregulations.

    R v Econom ic Insulations (As bestos rem oval) Ltd (2002) Defending a company whose businesswas the removal of asbestos.

    R v Suffex Services Lim ited & RMC Surfacing Lim ited (2001, Bris tol Crown Co urt) A prosecutioninvolving a fatality resulting from a reversing truck during road works on the motorway. The issues raisedinclude attempts made by each defendant company to pass blame to each other.

    R v Rocdan Sea Limited (2002, Plymo uth Crow n Court ) Concerning a fatality and serious injuries toothers when trawler rigging collapsed though a pulley/block failure. It involved challenging the acceptedcultures operating within the industry.

    R v Walter Lawrence (2002, Taunton Cro wn Co urt) A prosecution of a Water Company involvingserious injuries to a child in the street upon the displacement of a water bowser.

    R v Western Pow er Distr ibut ion & Others (2001, Plymouth Crown Cou rt) This was case Andrewdefended for SWEB (WPD) instructed by Osborne Clarke (Bristol) where an apprentice had been badlyburned following absence of proper systems/training & supervision in a SWEB substation in Plymouth.WPD were fined 50,000.

    R v Peeble Services (2001, Bristol Crow n Cou rt) A case Andrew defended involving allegationsrelating to electrical failures in a factory.

    R v Devonport Royal Dockyard (2001, Plymouth Crown Court) A case defended involving seriousbreaches of asbestos regulations in the Plymouth Docks.

    R v Marshal l Mono (2001, Bristo l Crown Cou rt) This was a case Andrew prosecuted involving anaccident at work when a work cage carrying a workman fell off a forklift.
