    Sanction: Knowingly making a false statement or entry in any departmental report, record,application, interview, hearing or judicial proceeding. CLASS 5

    On April 29, 2015, City of Phoenix Citizen filed a Complaint against PoliceOfficer Joel Queenan claiming he completed a False Departmental Report. The Complaintstems from an incident at Luke Air Force Base (AFB) on March 16, 2015, where wasvideo and audio recording a military facility and was aggressive and uncompliant when askedfor identification by Department Of Defense (DOD) Police Officers and Law Enforcement as

    well as uncompliant when detained by Glendale Police Department (GPD) Officers. Queenanarrested and booked for Failure to Provide Identification and towed vehicle.

    Queenan, as witnessed by another Officer and three Luke AFB Law Enforcement Officers, aswell as viewed and heard on various video and audio recorded files, was within Policy asQueenan completed an accurate departmental report documenting his actions.

    Interview of Officer Donald Montgomery

    On Tuesday, April 28, 2015, at 13:21 hours, I conducted a digitally recorded interview withUnited States Air Force (USAF) Police Officer Donald Montgomery at a private office in theSecurity Forces Building at Luke AFB. The following is a summary of my interview. For thecomplete interview, listen to the audio recording which is saved in WAV format on the "N"Drive.

    Prior to asking Montgomery any questions, I gave him a brief summary of how the

    Departmental Investigation (DI) materialized, my role, and confirmed he was familiar with theinformation. I asked Montgomery what his official title and duty is to which Montgomery stateshe is a "Police Officer at Luke AFB" and works for the USAF with numerous responsibilities toinclude entry control on to Luke AFB. Montgomery explained he attended a Law EnforcementAcademy. On March 16th he was wearing the uniform he wore for this interview, and theuniform has patches on both sleeves with the word "POLICE" as well as displays a badge and police duty belt with pistol.

    Montgomery then explained the contact with to include operating a DashCamera in his vehicle, providing his Military Identification Card to Montgomery, andwhen Montgomery told he could not record the installation began screaming

    "get your supervisor, get your supervisor". Montgomery then asked to pull to the sideof the road to keep the entrance open and Montgomery called his supervisor to the scene.

    Montgomery states approximately 5 minutes later, exits his vehicle now recording thegate with his cell phone. begins approaching Montgomery and Montgomery begangiving commands for to return to his vehicle. As returns to his vehiclesays: "and fuck you too".

    I asked Montgomery if was confrontational to which he stated not threatening butconfrontational. I asked what the intention was for to which it was for a base supervisorto inform recording the base was not permitted, delete the video, and allow to

     proceed. Montgomery stated they never had a chance to ask for to delete the video ashe was non-compliant.

    Montgomery then stated when his supervisor USAF Reserve Master Sergeant (MSGT) LuanneBruggeman arrived she was briefed on actions and words and asked forDriver License and he refused. Montgomery had no further contact with .

    I asked Montgomery what he saw and heard concerning interaction with GPD towhich he stated he and Bruggeman gave Queenan a statement to what did and observedas Queenan and GPD Officer Jonathan Clubb detained . Montgomery had no furtherinvolvement.

    I concluded the interview by asking if he had anything further to add to which Montgomerystated: "the guy went from zero to pissed off instantaneously for whatever reason. I have noidea." Montgomery did ask the Officers if had weapons as Montgomery was concernedfor his safety.

    I then confirmed Montgomery was attempting to advise he was violating US Law towhich Montgomery advised the incident falls under Title 18 USC stating to video tape on baseyou need the Base Commander's approval. Montgomery had nothing further and was provideda business card with my contact information and the interview concluded.

    Interview of MSGT Luanne Bruggeman, USAF

    On Tuesday, April 28, 2015, at 13:32 hours, I conducted a digitally recorded interview withMSGT and DOD Police Officer Luanne Bruggeman at a private office in the Security ForcesBuilding at Luke AFB. The following is a summary of my interview. For the completeinterview, listen to the audio recording which is saved in WAV format on the "N" Drive.

    Prior to asking Bruggeman any questions, I gave her a brief summary of how the DImaterialized, my role, and confirmed she was familiar with the information. I asked Bruggemanto review her involvement to which she states Montgomery called Bruggeman (the FlightSupervisor) to speak with as he requested a supervisor. Bruggeman and USAF StaffSergeant (SSGT) Christopher Washburn arrived at the gate and Bruggeman located the Title 18US Code which prohibits filming of a military installation.

    Bruggeman then spoke with and attempted to explain the videotaping violation offederal law after getting a briefing from Montgomery of actions and words to includewhen he exited his vehicle confronting Montgomery. Bruggeman then spoke with hersupervisor briefing them of actions and was told based on actions and words

    he was to be denied entry onto Luke AFB. Bruggeman then advised of this and he became more uncompliant refusing to give Bruggeman his Driver License questioning herauthority. Bruggeman then told GPD was being called and stated wasvideotaping with his cell phone as well.

    Bruggeman stated when Queenan arrived she gave him a briefing of his non-compliance toinclude refusal to provide Identification. Bruggeman observed as Queenan opened the car door,asked to get out, refused by "leaning back to the center console of the vehicle",Queenan threatened the use of his Taser giving more commands, and then becamecompliant.

    Bruggeman explained GPD Officers calmed down by sitting him on the wall, gettinghim water, and then reading him his Miranda Warnings after obtaining his identity from theDriver License Queenan obtained from "in plain view" wallet.

    Bruggeman explained she observed twice the GPD Officers loosen the handcuffs on athis request. Bruggeman also stated Queenan explained to her he can only enforce State Law,not Federal, as well as the need for "search authority" to seize evidence. Bruggeman thencoordinated with the Luke AFB Judge Advocate General (JAG) for over an hour and could notget resolution so Bruggeman contacted her supervisor and briefed them on the vehicle beingtowed.

    I asked if the GPD Officers were rude to which she stated: "Absolutely not. They were professional with him at all times even when he was extremely uncompliant with them. It wasvery obvious from his behavior he had no respect for authority". Bruggeman confirmed theintention was for Luke AFB Officers to delete the Dash Camera video and allow to proceed but due to his non-compliance was not allowed on base as did notrecognize Luke AFB Officer's Law Enforcement authority.

    I then confirmed Honda was towed after Queenan booked due to the amountof time was detained. Bruggeman stated Queenan signed the base removal form for

    as he was in handcuffs. Bruggeman read the Police report and concurred with

    everything written. I then asked Bruggeman to explain what the Base Blotter is and obtained acopy of Luke AFB documentation of the incident which will be discussed later in this DI.Bruggeman had nothing further and was provided a business card with my contact informationand the interview concluded.

    Interview of SSGT Christopher Washburn, USAF

    On Tuesday, April 28, 2015, at 13:48 hours, I conducted a digitally recorded interview with

    SSGT Christopher Washburn at a private office in the Security Forces Building at Luke AFB.The following is a summary of my interview. For the complete interview, listen to the audiorecording which is saved in WAV format on the "N" Drive.

    Prior to asking Washburn any questions, I gave him a brief summary of how the DImaterialized, my role, and confirmed he was familiar with the information. Washburn stated hewas a back-up Officer to Bruggeman who was called to the gate for . Washburn was briefed by Montgomery of not recognizing Montgomery's authority to perform gatecontrol procedures. Washburn and Bruggeman made contact with in his Honda and

    "was verbally aggressive" and began videotaping the contact on his cell phone.

    Washburn stated GPD was called to the scene while Luke AFB Officers kept "eyes on him".Washburn stated would open his door and yell obscenities at the Officers and at one point did attempt to exit but was ordered back into his vehicle. Washburn stated GPD arrived,got a brief from Luke AFB Officers, and contacted in his Honda to whichresisted and GPD was eventually able to detain . Washburn stated throughout contact

    was verbally abusive, non-compliant and lacked respect for authority.

    I asked where was seated after he was detained to which Washburn stated on a smallwall behind his vehicle and later in the back seat of Queenan's Police vehicle. Washburnconfirmed his role was as a back-up. I asked if Washburn heard or observed Queenan adjust

    handcuffs to which he did see Officers adjust handcuffs on a few occasions.

    I asked if the GPD Officers were rude to which he stated no. Washburn remained on scene untilwas transported by Queenan at which point Washburn returned to patrol duties on Luke

    AFB. Washburn had nothing further and was provided a business card with my contactinformation and the interview concluded.

    Interview of

    On Wednesday, April 29, 2015, at 10:30 hours, I conducted a digitally recorded interview withMr. at the GPD main station conference room. Present for the interview wasProfessional Standards Unit (PSU) Lieutenant Carrie Castrovinci. The following is a summary

    After confirming information and explaining my role with GPD, I asked howI could assist him. stated: "Officer Queenan lied on his Police report and I want himcharged for False Reporting. That's a Misdemeanor. That's for starters." then stated hehad a number of questions concerning an inventory of his vehicle stating it was discussed in hisemail complaints. I then asked to go through his Complaint of Queenan.

     began looking through a copy of his Police report stating: "He didn't have Probable

    Cause to arrest me number one". states he was illegally detained for a Dash Camera atLuke AFB and this was an illegal detainment. states Queenan "conspired with the AirForce to arrest me" and Queenan lied on numerous occasions in the Police report.asked if this is a crime. I again told to tell me specifically where Queenan lied in hisreport.

     continued looking at his copy of the report. states: "He didn't identify himselfwhen he came up to the car". then reads what the report states and says Queenan did

    not identify himself. I noted this complaint detail and states Queenan reports: "Hestates he ordered me out of the vehicle. OK? That didn't happen. OK? He states I refused. It'sall here in the Police report. You know he's a liar."

    I noted this complaint detail and asked what other untruthfulness is in the report to whichstates: "Excessive force. He left me in the back of the vehicle for upwards of 45

    minutes. The time frame can be confirmed when he checked out. And when he yanked me openon the car door."

    I noted this complaint detail and asked what other areas was concerned with to whichstated when he was "yanked from the car door" he asked what he was being detained

    for. states Queenan replied trespassing on a military facility and nowhere is this listedin the Police report. states this is another illegal detainment and this happened twice,once by Luke AFB and once by GPD.

    I noted this complaint detail and asked what other areas was concerned with andasked if I had a copy of the email documents stating: "He didn't provide me with an

    inventory of my vehicle." states Queenan said he would provide a vehicle inventorysheet and didn't. states he is missing a RF card for a gated community in Scottsdale.

     states: "He took my keys. OK? And he didn't return them to me. OK? He didn't returnmy cell phone to me. He left them in the vehicle. Why did he do that?" I then explained the

    DOD was investigating and his vehicle and were deciding on options for search andseizure of evidence to which states: "You guys have a inter-government agreement.Don't you. The Glendale Police Department and Luke AFB are on the hook for this one. Anddepending on how I leave here is gonna depend you know if I'm gonna take legal action againstyou guys. And I'm not getting good vibes from you."

     then states he is looking at me and I have the same attitude as Police Officers all overthe country. then states he was lucky he had his video recording or he would have"been convicted of this bullshit charge". stated Queenan should be placed on theMaricopa County Attorney Integrity list for lying on a Police report. then expresses hisdissatisfaction with me as I am listening to Complaint. I attempted to explain the

    Complaint process when states he wants to "press charges against him for filing a falsePolice report" as well as the Sergeant at Luke AFB.

    I explained the Complaint process to and again asked him to review, in addition towhat he had already stated, what his Complaints were to which again reviewed hiscopy of the Police report for approximately one minute and then asked me what "leaning backtowards the center of the vehicle" meant to which I asked what he interpret this tomean as to which states he had no idea. I told n based on what is written in thePolice report was leaning towards the center of the vehicle from the driver seat towhich states: "That's a lie. All I did was sit there. They failed to identify themselves.

    All right those I believe are the two biggies".

    I then confirmed with his Complaint against Queenan was False Information on aPolice report to include: Queenan states he Identified himself to and ordered him fromthe Honda, Excessive Force as was in the back of Queenan's vehicle for an extendedtime, detained for Trespassing, did not receive a vehicle inventory property receipt, and

    did not pull away from Queenan towards the center of his vehicle. agreed withmy review of his Complaint.

    I then explained the GPD property slip procedures as well as the tow form and how the pinkcopy is what a citizen receives when a vehicle is towed. I explained the pink copy does not havethe property section on it. I then showed a blank tow form. I also contacted the TowAdministrator, obtained a copy of the Police section of the tow form for the Honda which hasthe property inventory, made a copy of that form, and gave it to . When I showed

    the pink copy of a blank tow form to compare it to the Police copy, states: "hedid send that."

     then explains he is an "IT professional" and was aggravated by the fact that hedid not get "read receipts" he selected in the send option of his various email to PSU. I then

    explained PSU does not acknowledge via "read receipt" options for various emails due to thesecurity issues with false email traffic and the computer systems and confirmed Daukas hadcontacted for follow up from his first e-mail. I explained also stated he couldnot discuss his case until it was resolved in court and was waiting for this to occur to which

    disagreed.

    I asked if he had any additional information concerning his Complaint to which he didnot but would contact me if he did. I advised I reviewed the two CD Disks he providedthe City Attorney of files which contacted Dash Camera video (Of Note: The two CDDisks will be reviewed and discussed later in this DI). I advised of the six files he provided, a 10 minute section of video is missing (13:31 to 13:41 hours) and asked if he had the

    file to which stated his vehicle was turned off during this time and the Dash Camerawas not operating.

     then states there are six video files from the Dash Camera and two video files from hisCell Phone. I advised I did not have the two files from his cell phone and requestedthem if he chose to provide them to which he stated he would e-mail them to me.

     then states his vehicle was searched and had a bag of 9 MM shell casings in hisvehicle and the Officers asked him if he had any weapons in his vehicle. states heknows his vehicle was searched and it was not professional that the items were not placed backwhere they were. I told I would discuss this with Queenan. I explained per Policy

    Officers are required to do an Inventory Search of a towed vehicle. then explains he hasvideo of the Officer's actions and "the videos they don't lie".

    I asked who approved him recording Luke AFB with his Dash Camera to whichreplies: "What difference does that make? What difference does that make? Why are

    you even asking that question? Did I violate the law? Did I commit a crime? Why are youasking that question?" then explains he has been recording on his Dash Camera for twoyears and never had an issue in the past and has not violated the law.

    I then confirmed also recorded his contact with Luke AFB on his cell phone and asked

    if he could provide me a copy of that as well as any other evidence to which he said he would.(Of Note: later emailed me two files which contained cell phone video. The two cellvideo files will be reviewed and discussed later in this DI). states the Luke AFBSergeant did not identify herself but did say "Driver's License" and walked away when began recording her on his cell phone.

    I asked how Queenan obtained his Driver License to which states he obtainedhis Driver License from wallet which was located on the front seat.

    I advised I met with the City Attorney to review all evidence to include the video provided, emails, and this Complaint statement is giving and asked

    other than the two cell phone files was there any other evidence he has related to this DI towhich he said there wasn't.

    I then reviewed with the GPD Citizen Complaint Statement and per Policy the need tocomplete the form if he desired a Complaint against an employee to which completedand signed the form against Queenan.

    n stated he wanted to file False Reporting charges on Queenan to which I stated this

    would be part of my DI. also wanted to file False Reporting charges againstBruggeman to which I advised procedures to file a report. (Of Note: DR 15-58843 will becompleted later).

    I advised he would hear back from PSU via a phone call or mail on his Complaintresolution and asked if I could assist further to which stated no and the interviewconcluded.

    Interview of Sergeant Jeff Daukas

    On Thursday, April 30, 2015, at 11:15 hours, I conducted a telephonic interview with Sergeant

    Jeff Daukas #12233 concerning his involvement with the DI. The interview was conductedtelephonically and digitally recorded as Daukas was a witness, did not desire a PeerRepresentative, and was not scheduled to return to duty for approximately 2 weeks. Daukas wasfamiliar with the GPD Notice of Admonishment, understood the notice, and advised he did notneed it read to him. The following is a summary of my interview with Daukas. For the completeinterview, listen to the audio recording which is saved in WAV format on the "N" Drive.

    Prior to asking Daukas any questions, I gave him a brief summary of how the DI materializedand confirmed he was familiar with the information. I asked Daukas if he recalled the originalCall For Service (CFS) and could he review what he recalled. Daukas stated he specificallyrecalled the incident at Luke AFB as the base was not Code 4 and he took note of this. Daukas

    recalls later receiving a call from Queenan updating him on the investigation and arrest. I askedDaukas if he had any further information concerning the CFS to which he did not.

    I then reviewed the email complaint (March 19) from which was forwarded to Daukas(March 20) for follow up to which Daukas recalled the information. I then stated PSU receiveda second email from on March 27 with an attachment which contained a memo Daukasmailed on March 22 and confirmed Daukas was familiar with this as well. I askedDaukas to describe his investigation of the Complaint.

    Daukas stated during his attempt to contact , he was unable to find a phone number. He

    reviewed this with his Lieutenant to include contacting at his Phoenix address to whichhe was advised to contact by mail and to not contact at home. Daukas stated hemailed the mentioned memo and documents but did not hear back from .

    I then reminded Daukas on March 27, PSU received the second email from and theinformation was again forwarded to Daukas and to review his additional follow up with

    . Daukas stated he specifically came to work when he got the email from PSU to calladvising he would address the concerns when he was back to work.

    told Daukas he understood and the conversation ended. Of Note: The 3/27 call Daukas made tois included as an exhibit to this DI.

    I then reminded Daukas on March 28, PSU received the third email from and theinformation was again forwarded to Daukas to include could not discuss the case untilthe Court process had been completed. Daukas stated he made no further attempt to speak with

    concerning his Complaint until Daukas received a voice mail from on April 20advising the charge had been dropped and wanted to proceed with his Complaint. Of Note: The 4/20 call made to Daukas is included as an exhibit to this DI. Daukas alsostated his Lieutenant was going to address the Complaint with when the case wasresolved by the court and Daukas had no further contact.

    I then reminded Daukas on April 22, PSU and the Chief received a forth email fromand the Chief directed me to investigate to which Daukas recalled the email and had no furtherinvolvement with or the Complaint. Daukas had nothing further to add concerning theCFS or DI and the interview concluded.

    Interview of Officer Jonathan Clubb

    On Thursday, April 30, 2015, at 13:00 hours, I conducted a digitally recorded interview withOfficer Jonathan Clubb #16439 at PSU concerning his involvement. Clubb was provided theGPD Notice of Admonishment and stated he understood the memo. The following is a

    summary of my interview. For the complete interview, listen to the audio recording which issaved in WAV format on the "N" Drive.

    Prior to asking Clubb any questions, I advised Clubb of video provided to the CityAttorney related to the case and allowed Clubb to view it. I then gave him a brief summary ofhow the DI materialized and confirmed he was familiar with the information. Clubb reviewedhis employment to include three years as a GPD Patrol Officer.

    I asked Clubb what he recalled concerning the CFS to which he stated he and Queenanresponded to Luke AFB for a CFS of a non-complaint subject who would not provideidentification. Clubb stated Queenan requested Dispatch check on Luke AFB Officers to which

    they advised they were not Code 4 and Clubb "expedited" his response to Luke.

    Clubb stated when he arrived at Luke AFB the subject was still inside his vehicle and past thegate entry point. Clubb and Queenan then approached the vehicle and Clubb heard Queenanstate: "Glendale Police step out of the car". Clubb stated he heard a male inside the vehiclestate: "no". Clubb stated he looked inside the front passenger window noting only one occupantand "I saw he was pulling away from Officer Queenan going toward the center console area ofthe car."

    Clubb then ran around the rear of the vehicle to assist Queenan at the driver door and began to

    draw his Taser for a less lethal option when Clubb noted Queenan had the driver by his lefthand with his Taser pointed at the driver. Clubb stated they were able to get the driver to becompliant and detained the driver with handcuffs.

    Clubb stated he sat the detained driver behind the vehicle on a short wall and stood by with himwhile Queenan investigated. Clubb stated wanted water to which Clubb provided onceQueenan returned to stand by with . Clubb retrieved the water from Hondatrunk at his request. Clubb stated while standing with made comments of an

    unlawful detainment by Luke AFB and GPD and he was taking legal action. Clubb also stood by while Queenan investigated to include Miranda Warnings, questioning, and the arrest of

    .

    I asked Clubb what was arrested for to which he stated Queenan told it was forfailing to provide Identification to Luke AFB Officers after being asked and required to provide. Clubb also stated he obtained wallet from inside the vehicle and placed itwith property. I asked Clubb if he searched vehicle to which he stated

    gave him permission to retrieve water from a golf bag in the trunk of Hondaand to turn his vehicle off to save fuel.

    I then explained to Clubb I had additional questions of which he may have already answered but we would go over them again. I asked Clubb if he had an opportunity to review the Policereport and was there anything incorrect in the report to which he said the report was accurate.

    I asked Clubb why he responded Code 3 on the call to which he stated based on the information provided that Luke AFB Officers were not Code 4 and the subject not detained Clubb andQueenan responded Code 3. Clubb stated this is the first time he has ever responded to LukeAFB Code 3 as Luke AFB Officers normally have the situation under control.

    I asked why was detained to which Clubb stated upon arrival s Honda was parked on base past the gate, was non-compliant, and would not provide identification.

    Clubb stated based on this information was detained for Trespassing and to make thescene safe.

    I asked if Queenan identified himself to to which Clubb stated yes, and to step out ofthe car. Clubb also stated he heard say no and observed physically pull awayfrom Queenan. I confirmed Clubb and Queenan were both in uniform and driving markedPolice vehicles.

    I then asked Clubb to specifically review what he observed do when Queenan askedhim to step out of the vehicle to which he stated he heard say "no" and Clubb lookedinto the front passenger window observing pulling his left arm away from Queenan and

    moving his right arm and body towards the center console of the Honda. Clubb confirmed theHonda was still operating. Clubb also repeated hearing say: "no". Clubb againdescribed how he assisted detain by holding his right hand while Queenan had

    left.

    I asked Clubb why was seated detained behind the Honda for approximately 40minutes and in the back seat of Queenan's vehicle for approximately 50 minutes and what wasoccurring. Clubb explained in addition to the State charge of not providing Identification, LukeAFB was also conducting their investigation and coordinating whether to file Federal chargesfor videotaping the base as well as coordinating search and seizure of the recording equipment

    inside of the Honda.

    I confirmed Clubb did not search Honda but did make entry (with permission) into the trunk area for water, the driver seat to turn the Honda off, and the passenger seat to retrieve his wallet and cell phone. I confirmed with Clubb to explain why thecell phone was ultimately left in the Honda to which Clubb later learned had also beenrecording the base with his cell phone and that, as well as the Dash Camera, was now beingconsidered by the DOD as possible evidence.

    I then confirmed once was detained he was read his Miranda Warning prior to beingquestioned to which he said: "yes". I asked Clubb if he heard Queenan explain to that itwas unlawful to not provide his Identification or he would be arrested to which Clubb statedQueenan explained the Luke AFB Law Enforcement lawfully detained him and he is requiredto provide Identification to Luke AFB and GPD.

    I then reviewed DI evidence to include In Car Camera video, Dash Camera video he provided the City Attorney, Luke AFB Officer's statements, and the report and asked if he wasaware of any additional evidence. Clubb stated he had additional evidence which was notlogged as part of the criminal investigation and explained he audio recorded a portion of his

    interaction with

    Clubb explained made comments while detained that he was going to take legal actionagainst the Federal and Local government and Clubb then activated his audio recordingcapturing approximately 22 minutes of audio. I asked Clubb if he completed a Police report towhich he stated no. I asked Clubb if he saved the audio file to the GPD DIMS system to whichhe said no. I asked Clubb why he still had the audio recording to which Clubb explained after

    made the allegations of Complaints and legal action Clubb recorded the conversationfor any future legal action. Clubb did not complete a report or log the file as evidence as Clubbdid not feel the recording had any criminally relevant information to it. Clubb kept the audiofile on his GPD issued recorder in the event of a future law suit or Complaint.

    I asked Clubb to review what was on the audio file to which he stated the recording wasactivated after was detained and the Officer's actions explained to him. Clubb stated thewater discussion, Clubb's role, Queenan's contact with to include Miranda Warnings,and follow up investigation to include Luke AFB Law Enforcement authority was recorded.

    I asked Clubb what demeanor was to which he stated was verbally aggressiveand talking over the Officers. I asked what other information Clubb recalled to which hediscussed everything.

    I then directed Clubb to complete a supplement report and to log the recorded audio file into

    DIMS as evidence to the criminal investigation which was completed on May 9. Clubb hadnothing further to add concerning the CFS or DI and the interview concluded.

    Interview of Officer Joel Queenan

    On Tuesday, May 5, 2015, at 14:15 hours, I conducted a digitally recorded interview withOfficer Joel Queenan #16320 at PSU concerning his involvement. Queenan was advised of thecomplaint on April 30. Queenan was given a Notice of Investigation (NOI) outlining hisemployee rights and summarizing what the investigation was pertaining to. He reviewed andsigned the NOI with no questions. A copy of the NOI was provided to him. The following is a

    summary of my interview with Queenan. For the complete interview, access the audiorecording which is saved on the "N" Drive.

    Prior to asking Queenan any questions, I advised Queenan of video provided to theCity Attorney related to the case and allowed Queenan to view it. I then gave him a briefsummary of how the DI materialized and confirmed he was familiar with the information.Queenan reviewed his employment which included 4 years as a GPD Patrol Officer, 6 month'sas an ADOT Sworn Officer, and 5 years as a United States Marine where his primary duty was

    Law Enforcement.

    I asked Queenan what he recalled concerning the CFS to which he stated he was dispatched to aCFS at Luke AFB for a subject disturbing. While in route, Queenan asked the Dispatcher tocheck on the status of the Luke AFB Officers due to the time and distance required to respondto the base. Queenan stated Dispatch advised the Luke AFB Officers "were not OK and thesubject not in custody" and Queenan responded to the base Code 3.

    Queenan said upon arrival he parked his patrol vehicle behind a Honda Civic parked past thegate on the right side of the road and obtained a statement from Luke AFB Officers. Officersadvised had been filming Luke AFB Force Protection procedures, was asked to pull to

    the side of the road, a Supervisor responded, refused to provide his identification, was"extremely non-compliant and combative" by getting out of the vehicle, and got in a verbaldiscussion with a Luke AFB Officer nearly to the point of a physical altercation. Queenanconfirmed was still in the Honda and approached the driver side while Clubbapproached the passenger side.

    Queenan noted the windows were rolled up and was on the phone. Queenan opened thedriver door and "identified myself as Glendale Police and asked him to step out of the vehicle".Queenan then stated: " leaned toward the center line of the vehicle". Queenan grabbed

    left hand and put it in a wrist lock and "he refused to continue to obey my commandsso I ended up removing my Taser and pointing it threatening it's use which he finally

    complied". Queenan then holstered his Taser, removed from the vehicle, and due toage did not want to ground but escorted from his vehicle giving

    commands for to put his right hand on top of the vehicle. Queenan and Clubb then tookinto custody with his hands cuffed behind his back, handcuffs locked, and checked for

    fit.

     was then escorted to a half wall behind his vehicle and asked what he was beingarrested for to which Queenan stated he was being detained for Trespassing due to theinformation Queenan was told and noting past the gate area on base. Clubb then stood by with while Queenan began meeting with Luke AFB Officers to investigate.

    Queenan met with Montgomery, which Queenan identified as an "Air Force Civilian LawEnforcement Officer standing at the gate when Mister approached the gate". Queenanstated he was told Montgomery observed a recording device was operating, a verbalexchange occurred which began to hold up traffic, and Montgomery told to pull to theside of the road to allow traffic to flow onto the base.

    Once parked, "he got out of the vehicle and became combative with him" to a point whereMontgomery had to assert himself ordering back into his vehicle to which he did aftershouting obscenities. remained in his vehicle until a supervisor arrived (Bruggeman).Queenan then transitioned his investigation to interview Bruggeman.

    Queenan stated he learned from the Luke AFB supervisor, Bruggeman, she was called to thegate by Montgomery and upon contact with requested his "Driver License" and herefused; to provide his name and date of birth and he refused, and GPD was then called torespond. After speaking with Montgomery and Bruggeman, Queenan stated he then spoke with

    .

    Queenan stated "I read him his Miranda Warnings verbatim from the Miranda Warning Card I

    keep in my front left pocket" and questioned . During the questioning, admittedto recording the base and pulling to the side of the road. When Queenan discussedidentification and Luke AFB Law Enforcement he would not give a clear answer but eventuallyacknowledged Luke AFB Officers were Law Enforcement for the base. As a result ofQueenan's investigation, he found Probable Cause for the arrest of for Failure toProvide Identification when lawfully detained and secured in the rear seat of Queenan'sTahoe Police vehicle.

    Once secured, Queenan continued to coordinate with Luke AFB Officers on the search andseizure of recording equipment to which Queenan updated Luke AFB on State Law.Queenan stated while he waited for Luke Command to decide on a Federal investigation,

    charges, and evidence search and seizure "for quite an extended period of time", Queenanchecked on updating him on the delay of waiting for Federal authorities to decide ontheir investigation.

    Queenan then decided to not wait any longer, secured vehicle, and transportedto the Glendale City Jail for booking. During booking stated he would bond

    out of jail and made a phone call to coordinate. Post booking, Queenan returned to the Hondaand had the vehicle towed from Luke AFB. Queenan then checked with the jail to discover

    had bonded out and Queenan secured his property and keys with the vehicle and mailedthe pink copy of the tow form to .

    I then explained to Queenan I had additional questions of which he may have already answered but we would go over them again. I asked Queenan if he had an opportunity to review hisPolice report and was there anything incorrect or untruthful in the report to which he said thereport was correct.

    I asked Queenan why he responded Code 3 on the call to which he stated based on the distanceto the base, Luke AFB Officers stated they were not OK, and not in custody, Queenanresponded Code 3 to expedite his response. I asked why was detained to whichQueenan stated appeared to be trespassing by being on base, parked to the side, and not being compliant to include not providing Identification. Queenan stated he detained fortrespassing to make the scene safe based on the information he had. Queenan stated he told

    this.

    I asked Queenan if he identified himself to which he stated: "yes I did". Queenan alsoacknowledged being in uniform and driving a marked Police vehicle. When Queenan contacted

    inside his Honda to detain him, I asked Queenan what he saw and heard to whichQueenan stated he approached as discussed and saw on his cell phone. Queenan stated:"Opened the driver door and I said Glendale Police and I began to order him out of the vehicle.Mister then leaned towards the center line of the vehicle". Queenan then attempted togain control of by grabbing his left arm and was saying "no, no, no" to whichQueenan continued giving commands to exit the vehicle. Queenan then drew his Taser

    and pointed it at which gained compliance from to include handcuffing.

    I asked Queenan to describe what he saw concerning how was leaning away fromQueenan and what he perceive this to mean to which he stated "it appeared to be defensiveresistance and he was leaning towards the inside of the vehicle. I wasn't sure if there was like aweapon in the vehicle or what was going on. But it was clearly the opposite of what I wasasking him to do. I was ordering him to get out of the vehicle after identifying myself". I askedwhat words use to show non-compliance to which he stated: "He kept saying no, no,

    no, what's your problem. Something like that."

    I asked what force Queenan used to escort from his vehicle to which he said: "Just asoft hold on his arm. Just walked him over to the half wall. Had him take a seat. No additionalforce was needed". I confirmed Queenan held left hand while Clubb held the right.Queenan could not remember whose handcuffs were used to detain . Queenan thenconfirmed a weapon pat down was accomplished as well.

    I asked Queenan to reconfirm what the investigation involved which resulted in beingdetained both behind the Honda and in the back of the Police vehicle for an extended amount oftime to which he stated post interviews with Luke AFB Officers, the base Legal Office was

    deciding on a Federal investigation to include a warrant for the search and seizure of the Hondaand property. Queenan stated this is what took so long. Queenan again stated he decided to notwait any longer and transported .

    I asked if requested his cuffs be loosened to which Queenan stated he did and Queenanchecked and the cuffs were loose per his training and advised of this.

    I asked Queenan to describe the arrest of for Failure to Provide Identification and theconnection to Luke AFB Officers to which Queenan explained Luke AFB Officers had askedand advised for his Identification and based on his non-compliance wasarrested. I confirmed Queenan read his Miranda Warnings.

    I asked Queenan how he obtained identification to which he stated it was in his walletseated next to him in his Honda in Plain View and Queenan took it from the wallet believingthe wallet and identification were evidence to the crime.

    I then reviewed the In Car Camera for Queenan's vehicle and a conversation he had withwhen asked how much bail was and providing identification. Queenan recalled

    the conversation and stated he was discussing his Honda with and asked howmuch bail would be or how long the processing would take. Queenan was not sure of the classof charge but indicated the worst would be $500 and told this. responded thathe would provide identification.

    I asked Queenan if he searched Honda to which he stated he performed an InventorySearch for towing. Other than the wallet, Queenan took no other items from the Honda.Queenan described 's cell phone was left with the vehicle to allow Luke AFB Legaltime to decide on a warrant while was booked. This included the keys as well to securethe Honda.

    I asked Queenan if he damaged or removed property from the Honda during his InventorySearch to which he stated he moved items in the trunk to account for everything but did notdamage any property.

    I then reviewed DI evidence to include In Car Camera video, Dash Camera video he provided the City Attorney, 's cell phone video he provided to PSU, Clubb's recordedaudio, Luke AFB Officer's statements, and the report, and asked if he was aware of anyadditional evidence to which Queenan stated he had no further evidence. Queenan had nothingfurther to add concerning the CFS or DI and the interview concluded.

    INVESTIGATOR STATEMENT by Sgt Mark Lankford

    On Thursday March 19, 2015, at 12:13 hours, PSU received via the City of Glendale PSUEmail address an email from Mr. with an attached file. The title of the file wasInternal Affairs Complaint. The attached file was a typed and signed letter fromadvising of a complaint against "one African American Police Officer" as well as a typed and partially completed GPD Citizen Complaint Form. The letter will be discussed later in this DI.On Friday March 20, 2015, the complaint was forward to Daukas for follow up as it wasdetermined Queenan was the Officer who arrested and was under Daukas' command.

    On March 22, 2015, Daukas sent a typed memo explaining the complaint process aswell as the GPD Citizen Complaint Statement as did not provide a phone number. The

    memo will be discussed later in this DI.

    On Friday March 27, 2015, at 10:09 hours, PSU received via the City of Glendale PSU Emailaddress a second email from with an attached file. The attached file was a typed andsigned letter from advising he was dissatisfied with Daukas for sending a letter to himvia the mail as well as the required formal GPD Complaint documents Daukas mailed .The letter will be discussed later in this DI. The letter now includes phone number towhich Daukas calls

    On Saturday March 28, 2015, at 10:52 hours, PSU received via the City of Glendale PSU Emailaddress a third email from with an attached file. The attached file was a typed and

    signed letter from advising he was dissatisfied with Daukas and also wanted to file acomplaint against the back up Officer who will later be identified as Clubb. The letter will bediscussed later in this DI. n states he will not discuss the case until it is settled in courtand Daukas ceases contact with . On Monday April 20, 2015, calls Daukasleaving a message stating the charges were dropped by the Court and wants to file acomplaint against Queenan.

    On Wednesday April 22, 2015, at 00:45 and 07:15 hours, PSU and Chief Black received via theCity of Glendale PSU Email address a forth email from with an attached file. Theattached file was a typed and signed letter from requesting another supervisor beassigned to investigate Complaint. The letter will be discussed later in this DI. Chief

    Black then directed me to investigate Complaint.

    On Monday April 27, 2015, at 13:36 hours, PSU received via the City of Glendale PSU Emailaddress a fifth email from with an attached file. The attached file was a typed letterfrom reviewing the Dash Camera Video recorded on March 16 at Luke AFB.The letter will be discussed later in this DI. PSU sends an email advising theinformation will be forwarded.

    On Wednesday April 29, 2015, was interviewed by PSU, completed the GPD CitizenComplaint Statement, and DI 2015 assigned. also requested to file a Police report

    against Luke AFB Officers for False Reporting and was advised of the procedures.

    At 2:08 hours, I received a sixth email from stating he waited an hour for an Officer butone did not arrive. I telephoned at the number he provided and left a voice mailadvising of procedures to complete a phone report. The email and phone message is filed as anexhibit to this DI.

    On Sunday May 3, 2015, at 2:39 hours, I received a seventh email from stating

    Lieutenant Jay O'Neil refused to take a report against a Federal Employee. I telephoned O'Neilupdating him on the criminal investigation and DI to which O'Neil contacted andarranged for a report to be taken. filed a phone report of False Reporting under GPDDR 15- completed by Officer Robert Schmuck #11194. The email is filed as an exhibit tothis DI.

    On Monday May 11, at 1:41 PM, I received an eighth email from stating the name ofthe Sergeant at Luke AFB was listed incorrectly on the report and requested I correct bothreports. I then directed Schmuck to correct both reports to which he did at 3:17 PM. On May12, I telephoned advising him the reports were changed. The email and phone call arefiled as an exhibit to this DI.

    In addition to the seven previously discussed interviews, the following information wasreviewed for the DI.

    GPD / Luke AFB Call For Service March 16, 2015, at 14:06 Hours

    The original CFS indicates on March 16, 2015, at 14:06 hours, Reporting Party Bruggemanrequested Officers respond to Luke AFB "Lightning Gate" for a subject filming them whilecoming on base and upon the base stopping the subject he became "uncompliant and belligerent". The subject was also refusing to give his information, was "cussing at the Sgts",and came in a white Honda Accord. At 14:11 hours, Queenan asks Dispatch to call Luke AFB

     back to check their status to which Luke AFB states the subject is not in custody and they arenot Code 4. At 14:19 hours, the back-up, Clubb, advises the subject detained. The event numberis E1500036144. The Incident number is I15034870. The CFS is filed as an exhibit to this DI.

    Luke AFB phone call to Dispatch requesting GPD Assistance

    The 911 phone call, from a Luke AFB Sergeant, indicates the same information as the previously discussed CFS. Twice the caller states the subject is very uncompliant and belligerent. The caller confirms GPD Officers will respond to this call next to which Dispatchadvises GPD Officers are already in route as a "priority". The WAV file is filed as an exhibit tothis DI.

    GPD Radio Traffic

    The GPD radio traffic from Dispatch indicates a voiced request for two units to respond toLuke AFB to which Queenan and Clubb answer up and respond. Dispatch advises the sameinformation as the previously discussed CFS and phone call to Dispatch. Queenan then asksDispatch to check on the status of the Luke AFB Officers and the subject to which Dispatchvoices after calling Luke AFB that the Luke Officers are not Code 4 and the subject is not incustody. Queenan copies the update.

    Officer Allan Seidl #16321 then asks Dispatch to place him on the CFS until the scene is Code4. Of Note: Seidl does not arrive on scene and is not a subject or witness to this DI.

    Club then voices he and Queenan have arrived and requests a check of Arizona License Plate. Dispatch advises the plate is current on a Honda Accord registered to

    n. Clubb copies the traffic and advises "one detained". Seidl then voices he is "10-8"(returning to Patrol status). The WAV file is filed as an exhibit to this DI.

    GPD phone call to check Luke AFB status

    As previously discussed, Queenan, while in route to Luke AFB, requests Dispatch call LukeAFB back to check on their status as well as the subjects. A review of the phone call fromDispatch confirms the Dispatcher asks Luke AFB if the subject is in custody and if they areCode 4 to which Luke AFB Police advises they are not. The WAV file is filed as an exhibit tothis DI.

    Queenan Officer Log

    A review of the Officer Log for Queenan indicates he was dispatched to Luke AFB at 14:07

    hours until 16:00 hours for a Suspicious Person / Circumstance CFS closing the call with anOffense report under Incident I15034870. Queenan's next log entry indicates he is at GPDDetention from 16:00 to 19:02 hours. The Log is filed as an exhibit to this DI.

    Clubb Officer Log

    A review of the Officer Log for Clubb indicates he was dispatched to Luke AFB at 14:07 hoursuntil 15:24 hours for a Suspicious Person / Circumstance CFS closing the call as a back-upOfficer under Incident I15034870. The Log is filed as an exhibit to this DI.

    GPD DR 15-34870

    A review of DR 15- indicates Queenan completed a "cleared arrest" report forfor Obstruction - Refuse True Name, a violation of ARS 13-2412.A, a Class 2 Misdemeanor.The City of Glendale is V1, Bruggeman is RP1, and Montgomery RP2. The vehicle involved is

    White Honda Accord.

    A review of the DR indicates the same CFS information as previously discussed of Luke AFBLaw Enforcement Personnel requesting GPD assistance for being non-compliant.Queenan reports having Dispatch check on Luke AFB and Dispatch advising Officers were notokay and not in custody. Queenan then responds Code 3.

    Queenan arrives observing Honda parked on Luke AFB past the gate. Queenancontacts Bruggeman who states Luke AFB personnel are Code 4 and , seated inside theHonda, was very aggressive and non-compliant refusing to provide his information or Driver'sLicense. Bruggeman then states was detained for violating DOD Policy of recordinghis approach to the Base. Bruggeman states Luke Officers were limited to their involvement as

    was a civilian and this is why GPD was called to assist.

    Queenan advises Bruggeman he can enforce State Statues only and not Federal Statues and assuch when a subject is detained is required to provide his identification. Queenan states heattempts to detain by having him exit his Honda and is non-compliant.

    Queenan describes his approach and detainment of to include: Queenan identifyinghimself, giving an order to exit, refusing by leaning his body away fromQueenan with movement to the center of the vehicle, Queenan grabbing by his lefthand, giving a second command, still refusing, Queenan displaying his Taser,and then complying. Queenan states was handcuffed with his hands behind his back and the cuffs checked for fit.

     is then escorted to a short wall next to the Honda and seated. Queenan notes

    age, confirms if he wants to be in the shade, and provides water. Clubb stands by withwhile Queenan continues investigating. Queenan interviews Montgomery stating he is

    a DOD Police Officer in uniform. Montgomery, the base century, tells Queenanapproached the gate driving his Honda and Montgomery observes recording the gatewith his cell phone and a camera mounted on the windshield near the dashboard. Whilechecking Military Privilege Card provided by , Montgomery adviseshe cannot record the base to which requested a supervisor and Montgomery asked

    to pull over to the side of the road to keep the traffic moving.

    Montgomery states once pulled to the side of the road, he then exited his Honda andapproached Montgomery in a very aggressive manner while swearing and yelling at

    Montgomery. Montgomery states continued to approach as Montgomery gave himcommands to get back in the Honda. refused with Montgomery now becoming firmerin his commands for to return to the Honda to which he did. remained in theHonda until the supervisor, Bruggeman, arrived on scene.

    Queenan then interviews Bruggeman and reports she contacted inside the Accordidentifying herself as Security Forces asking for Driver's License to whichrefused. Bruggeman then asks to identify himself by name and birthday to which

    also refused. Queenan then confirmed Bruggeman desired be charged withFailure to Provide Identification when detained and asked Queenan to seize the recordingequipment of the cell phone and dash camera. Queenan then advised Bruggeman he could not

    seize the recording equipment and advised the vehicle would be towed from the base after aninventory completed. Queenan then discussed the need for a warrant obtained by the DOD.Bruggeman then began coordinating with her superiors.

    Queenan then contacted reading him his Miranda warnings advising of thecriminal charge of Failure to Provide Identification. Queenan then had describe theincident to which admits recording, pulling his Honda to the side of the road asdirected, exiting his Honda, and Montgomery ordering back into his vehicle.then began making phone calls. Queenan asked about his conversations withBruggeman to which states: "I don't remember". Queenan then discusses the LukePolice Officers as Security Forces and how they are in uniform. makes statements

    which indicate he does not recognize Luke Police Officers as Law Enforcement. After furtherquestioning by Queenan, states he recognizes Luke Officers as Law Enforcement andQueenan again states he is required to provide identification when detained and stateshe does not understand this. was then arrested and secured in Queenan's patrol vehicle.

    Queenan states was transported and booked prior to the Honda being towed to getinside with water without further delay. Queenan states Bruggeman advises the DOD

    will not be pursuing a warrant for the recording equipment inside the Honda. Queenan securesthe Honda, books , and returns to Luke AFB to have the Honda towed. The report isapproved by Daukas.

    Post DI interview with Clubb, I directed Clubb to complete a supplement report to include hisinvolvement and the inclusion of the audio recording of Clubb's interaction with as partof the criminal investigation. Clubb's supplement was completed on May 9, 2015. A review ofthe report indicates the following.

    A review of Clubb's supplement to the DR indicates the same CFS information as previouslydiscussed of Luke AFB requesting GPD assistance for being non-compliant. Clubb also

    responded Code 3.

    Upon arrival at Luke AFB, Clubb, the back-up Officer to Queenan, approached the right side ofthe vehicle as Queenan approached the left. Clubb reports hearing Queenan identify himself asGlendale Police and order out of the vehicle. Clubb reports hearing say "no"and observe pull away from Queenan moving his body and arms towards the centerconsole of the vehicle. Clubb reports moving to the driver side to assist Queenan brieflyremoving his Taser from the holster but re-holsters noting follow on compliance tocommands.

    Once detained, Clubb reports asked what he was being arrested for and Clubb states

    trespassing. Clubb then stands by seated behind the Honda while Queenan investigates.Clubb reports began making comments of lawsuits against the Federal Government andGPD and for this reason Clubb activates his digital recorder and later saving the audio WAVfile in DIMS.

    Clubb reports requested water and gave permission for Clubb to get water fromHonda Accord trunk as well as shut the vehicle off to save fuel. Clubb also reports

    giving water to . Clubb reports the audio capture of Queenan's questioning of .Clubb reports initially retrieving keys and cell phone from the Honda atrequest but does not due to the possibility of the DOD seizing the items as evidence and as suchwas left inside the Honda.

    Of Note: Clubb's WAV file audio recording of will be reviewed and discussed later inthis DI.

    On May 11, 2015, Schmuck completed a supplement report correcting the name of Bruggemanas requested by and directed by me.

    Queenan In Car Camera Video

    Queenan's GPD Tahoe Police vehicle had an operational In Car Camera system. A review ofthe in car camera file associated with this CFS indicates usable video and audio for the CFS.

    The video begins at 14:11 hours with Queenan in route to Luke AFB driving Code 3 arriving at14:18 hours. Queenan parks his vehicle next to a Luke AFB Police Vehicle in a "fan"configuration and behind Honda with the Honda in camera view. The Honda is insidethe gate area parked on the right side of the road with two Luke AFB Police Officers / SecurityPersonnel standing behind their Police vehicle. The word "POLICE" can be seen written on theside of the Luke AFB Police vehicle.

    Queenan is out of camera view for 45 seconds then approaches the driver side door of theHonda while Clubb approaches the passenger side. As they approach, Clubb voices (as previously discussed) for Dispatch to perform a check of the Honda's license plate number. At

    14:19:06 hours, Queenan opens the driver door and is observed attempting to detainthe driver. appears to struggle with Queenan when Queenan is observed drawing hisTaser and pointing it at still seated in the Honda. Clubb is observed running around therear of the Honda to the driver door and assisting Queenan.

    Queenan then escorts out of the Honda while holding his left wrist while Clubb hasright wrist. Queenan then secures with handcuffs behind his back, does a

    search of , and escorts to a seated position behind the Honda on a small wall

    while Clubb stands next to . Clubb voices "copy, one detained" at 14:19:43 hours.Queenan then walks over to the open driver door, reaches into the Honda retrieving an item,then walks back to his Police vehicle. The only clear audio portion consists of police radiotraffic and car radio audio. Some audio is heard of Queenan discussing with Luke AFB Policeand their leadership that would not provide Identification to Luke AFB Officers and theneed for a warrant for seized items. Luke AFB Police also explain to Queenan exitinghis Honda and confronting them.

    At 14:24:23, Clubb is observed standing up, adjusting his handcuffs, and sitting back down. At 14:31:22 hours, Queenan, Bruggeman, and Washburn return to

    and Clubb behind the Honda and have a conversation which cannot be heard on the in car

    system.

    At 14:33:16 hours, Clubb is observed reaching into the driver door area, opening the trunk,retrieving a bottle of water from the trunk, and giving a drink of water. Clubb thencloses the trunk. At 14:35:45 Clubb returns to the Honda and sits in the driver seat. At 14:37:47hours, Queenan is observed walking out of camera view to where Luke AFB Police arestanding. At 14:40:56 hours, Clubb is observed giving another drink of water. At 14:44hours, Queenan returns to At 14:47 hours, Clubb is observed putting the water bottle back into the Honda trunk. At 14:48 hours, is escorted and secured in Queenan's right back seat of his Tahoe Police vehicle.

    At 14:49 hours, and Queenan discuss the Honda while Queenan explains tohow to be safely seated in the vehicle. Queenan adjusts the air conditioner to full for increasedair flow for . At 14:54 hours, Queenan returns to his vehicle and discusses the Hondawith to include a tow.

    At 14:54:30 hours, n asks how long will the processing take to which Queenan states 45minutes and then would see a Judge at 8:00 in the morning. then asks howmuch would bail cost. Queenan answers and states: "OK, I'll provide an ID". Queenanthen explains he would transport as soon as possible.

    At 15:05:30 hours, Queenan apologizes to for the delay as Queenan is waiting for the

    Base JAG to decide if they will pursue Federal charges. Queenan asks if he needsanything to which requests his handcuffs be adjusted and Queenan checks themadvising the cuffs are already loose and thanks Queenan. asks Queenan for hiscell phone to which Queenan explains he is waiting for the base to decide if they will seize the phone as evidence. then laughs.

    At 15:19:40, is heard while seated alone: "Assholes. Absolute assholes. Unbelievable."At 15:25 hours, Queenan is observed securing the Honda. At 15:33:15, is heard stating:"This is dragging on for ever and ever." At 15:39 hours, Queenan seatbelts in the seatand again apologizes for the delay as Queenan was waiting for Base Legal to make a decision.

    Clubb In Car Camera Video

    Clubb's GPD vehicle also had an operational In Car Camera system. A review of the in car

    camera file associated with this CFS indicates usable video and audio for the CFS. The video begins at 14:11 hours with Clubb following Queenan in route to Luke AFB driving Code 3arriving at 14:18 hours. Clubb parks his vehicle behind two Luke AFB Police vehicles andQueenan's GPD Tahoe vehicle. Queenan's vehicle has the overhead red and blue lights on.

    Honda is not in view.

    Queenan is observed speaking with a DOD Police Officer and a Military Security PoliceOfficer. As Clubb walks towards Queenan, Queenan and Clubb then walk out of video in thedirection of the Honda. The only clear audio portion consists of police radio traffic and carradio audio. Clubb voices (as previously discussed) for Dispatch to perform a check of theHonda's license plate number. Clubb voices "copy, one detained" at 14:19 hours.

    At 14:22 hours, three Military Police are observed behind Queenan's vehicle talking togetherand on Cell Phones. At 14:48 hours, Queenan is observed standing near the right rear door ofQueenan's vehicle searching and placing his property into a clear property bag held byClubb. is secured in Queenan's right back seat of his Tahoe Police vehicle. The videodoes not reveal any additional information applicable to the criminal investigation or DI. Thevideo is filed as an exhibit to this DI.

    Clubb Audio Recording of

    During an interview, Clubb states he audio recorded on his issued GPD recorder the majority of

    his contact with while sat behind the Honda after being detained. Clubb savedthe audio recording in DIMS and completed a supplement report. A review of the WAV filecopy of the recording indicates the following information for the DI.

    recording the base gate. Clubb gives a drink of water and asks if he hasfirearms in the Honda as Clubb notes shell casings in the trunk. Clubb then volunteers to shut

    Honda off to save fuel and agrees telling Clubb how to turn it off. Queenanoffers for to sit in his GPD vehicle with conditioned air and out of the sun to which

    declines. Clubb gives another drink of water.

    Queenan again returns to speak with advising the status of his investigation. Queenanstates n is not free to leave and reads his Miranda Warnings to which

    understands. Queenan then questions asking him what occurred. asks what heis being charged with to which Queenan advises Failure to Provide Identification to LawEnforcement. Queenan explains Luke AFB Officers asked for his Identification andrefused to which states they did not ask him.

    Queenan again asks what occurred to which states he entered the gate, provided his Disabled Veteran Card to enter the gate, was recording the gate with his DashCamera, parked and exited his Honda, the Officer ordered back into his Honda, and

     began making calls from inside his Honda.

    Queenan then reminded that Bruggeman spoke with in his vehicle and asked

    what occurred in that contact with . states he doesn't remember. Queenan thenexplains Bruggeman's authority and appearance and how she is dressed as a Law EnforcementOfficer for Luke AFB and asks if he recognizes her as Military Law Enforcement towhich states: "not really".

     then states he asked for an Officer to which Queenan explains Bruggeman is theranking Military Law Enforcement Officer. Queenan asks to look at her uniform toidentify her as Law Enforcement to which states: "I can't see. I can't see." Queenanstates should not be driving if he cannot see to which states he is sitting in thesun. then acknowledges the Military Officers are "security officers" and asks what hedid wrong.

    Queenan then explains when n was asked to pull to the side of the road by Luke AFBOfficers he was detained and required to provide Identification when asked to which he did not.

    states: "OK, I'm sorry". Queenan asks if it makes sense and states: "not really".Queenan then advises he will be booked into the Glendale City Jail and escorts him toQueenan's GPD Tahoe vehicle. The WAV File is filed as an exhibit to this DI.

     Dash Camera Video

    On March 16, 2015, was operating a Dash mounted Camera at Luke AFB. Post arrest by Queenan, provided the City Attorney select video (approximately 10 minutes

    missing) consisting of six individual files of video each approximately 10 minutes in length.also stated to PSU in email as well as an interview of six Dash Camera video files herecorded and provided to the City Attorney. PSU obtained the two CD Disks provided by

    and made copies of the CD Disks as part of this DI. A review of the two CD Disksindicates the following information.

    Disk one has three files listed. File one is titled "Luke Guard Gate" dated March 16, 2015, at1:31 PM. Of Note: The time set on the Dash Camera appears to be approximately 6 minutes offand later as the times do not match up by approximately 6 minutes to the GPD In Car Cameravideo previously discussed.

    Upon opening the file, a video plays which contains video and audio. The video image consistsof an unobstructed view from the front of a vehicle. The video has time stamped information toinclude the date and time. The audio is from inside the vehicle.

    File one (Luke Guard Gate) video displays the date of March 16, 2015, 13:26:11 hours,originating at the Luke AFB Golf Course. The vehicle radio is playing. drives to theLightning Gate at Luke AFB making a call arriving at 13:31 hours. The video shows

    Montgomery manning the gate and speaking with . The audio indicates is asked by Montgomery upon contact at the gate if the mounted equipment is a camera and if it isrecording to which says yes, and "what difference does it make".

    Montgomery states this is not allowed and asks to pull to the side of the road to whichyells: "Get your supervisor out here. Get your supervisor out here right now!"

    then pulls onto the base through the gate pulling to the right side of
