    AN ORDER RECONSTITUTING AND REORGANIZING THE MEMBERSHIP OFTHE CITY DEVELOPMENT COUNCIL PURSUANT TO REPUBLIC ACT NO.7160, OTHERWISE KNOWN AS THE LOCAL GOVERNMENT CODE OF 1991

    WHEREAS, Republic Act No. 7160, or the Local Government Code of 1991provides for the constitution and organization of the City Development Council inline with the national policy of encouraging local government units to evolve localdevelopment plans pursuant to existing laws, executive orders and other relatedissuances;

    WHEREAS, R.A. 7160 mandates the organization and strengthening of localgovernment councils, prescribing therein the compositions, organizations andfunctions of local development councils, as well as other related measures for theimplementation of said Republic Act;

    WHEREAS, Section 106 of the Local Government Code provides that eachlocal government unit shall have a comprehensive multi-sectoral development planto be initiated by its development council and approved by its Sanggunian;

    WHEREAS, the Davao City Development Council shall assist the localLegislative Body in setting the direction of economic and social development andcoordinating development efforts within the city;

    WHEREAS, Executive Order No. 22, dated May 6, 2014 created the DavaoCity Development Council;

    WHEREAS, in line with the development thrust of the City Government onfocusing its delivery of services, programs and projects into more specific andessential targets, there is a necessity for an integrated manner of planning andexpending its resources from within and outside sources into focused areas andbarangays;

    WHEREAS, there is a need to reconstitute and reorganize the membershipof the City Development Council;

    NOW, THEREFORE, I, SARA Z. DUTERTE, City Mayor of Davao, by virtueof the powers vested in me by law, do hereby order the following:

    SECTION 1. Composition of the City Development Council. The compositionof the City Development Council shall be as follows:

  • Members - All Barangay CaptainsChairman, Committee on Finance, Ways and MeansCongressman of each legislative district or theirrepresentativeRepresentative of non-governmental organizationsoperating in the city, who shall constitute not less thanone fourth (1/4) of the members of the fully organizedcouncil

    SECTION 2. Representatives of Civil Society Organizations. Per Departmentof Interior and Local Government Memorandum Circular No. 2016-97, the DILG CityDirector in coordination with the Local Government Unit shall call all accreditedorganizations to a meeting where such organizations shall choose from amongthemselves the representative organizations to a meeting where such organizationsshall choose among themselves the representative organizations to the various LocalSpecial Bodies.

    The following civil society organizations were accredited by the SangguniangPanlungsod from July 1, 2013 to September 30, 2016, and the same wererecommended to form part of the membership of the City Development Council asagreed during the Selection of Civil Society Organizations held on November 22,2016 conducted by the Department of the Interior and Local Government, namely:

    SECTION 3. Functions of the City Development Council. The CityDevelopment Council shall exercise the following functions:

    a) Formulate the long-term, medium-term and annual socio-economicdevelopment plans and policies

    b) Formulate the medium-term and annual public investment programsc) Appraise and prioritize socio-economic development programs and

    projectsd) Formulate local investment incentives to promote inflow and direction of

    private investment capitale) Coordinate, monitor and evaluate the implementation of development

    programs and projectsf) Perform such other functions as may be provided for by law.

    SECTION 4. Executive Committee. The City Development Council shall createan Executive Committee to represent it and act in its behalf when it is not in session.The composition of the Executive Committee shall be as follows:

    Chairman - The City Mayor or her alternate, the City Administrator

    Members@ Chairman, Committee on Finance, Ways and Means

    (Appropriations), Sangguniang Panlungsod@ President, Association of Barangay Captains@ Representative of Non-Governmental Organizations@ Chairperson, Social Development Committee@ Chairperson, Economic Development Committee@ Chairperson, Infrastructure Development Committee/Zoning

    and Land Use@ Chairperson, Environment Development Committee@ Chairperson, Public Administration Development Committee

    The Executive Committee shall exercise the following functions:

    a) Ensure that the decision for the Council are faithfully carried outand implemented;

    b) Act on matters requiring immediate attention or action by theCouncil;

    c) Formulate policies, plans and programs, based on the generalprinciples laid down by the Council;

    d) Act on other matters that may be authorized by the Council.

    SECTION 5. Sectoral or Functional Committees. The City DevelopmentCouncil shall organize sectoral or functional committees to assist in the performanceof their functions, namely: Economic Development Committee (EDC), InfrastructureDevelopment Committee (IDC), Social Development Committee (SDC) andEnvironment Development Committee (EnvDC), Public Administration DevelopmentCommittee (PADC), the respective chairpersons thereof shall become member of theExecutive Committee, as above-provided.

    All National and City Government Offices shall be accordingly represented in theappropriate development committees.

    SECTION 6. Secretariat. There is hereby constituted a secretariat which shall beresponsible for providing technical support, documentation of proceedings,preparation of reports and such other assistance as may be required in thedischarge of its functions.

    The secretariat of the City Development Council shall be headed by the City Planningand Development Coordinator.

    SECTION 7. Technical Assistance to the Council. All City Government Offices/Departments/Agencies are hereby enjoined to provide technical assistance, supportand cooperation to the Council.

    SECTION 8. Operational Expense and Funding. Members, Consultants andTechnical Staff are hereby authorized to claim for incidental expenses and/ortravelling allowance relative to the services rendered in addition to their duties andresponsibilities and for the work beyond office hours subject to the usual accountingand auditing rules and regulations chargeable against the budgetary allocations ofthe council.

    SECTION 9. Repealing Clause. All Executive Orders or issuances inconsistentwith the provisions of this Executive Order are hereby repealed or modifiedaccordingly.

    SECTION 10. Effectivity. This Executive Order shall take effect immediately.
