NOTICE OF APPLICATION AND INTERVENTION DEADLINE

On June 22, 2020, Montana-Dakota Utilities Co. (“MDU”) filed with the Montana Public Service Commission (“Commission”) its Application for Authority to Establish Increased Rates for Natural Gas Service (“Application”). MDU asserts that its current rates are unjust, unreason-able, and not compensatory and that said rates should be increased so that MDU will have an opportunity to earn a just and reasonable rate of return on its natural gas property that is devoted to providing service to its Montana natural gas customers. The primary reason for the proposed increase in rates is MDU’s continued investment in distribution facilities to improve system safety and reliability. The additional investment has generally increased the associated depreciation, taxes, and operation and maintenance expenses.

MDU’s Application proposes an increase in annual revenue of $8,559,529, based on a 2019 test period. This proposed request would impact 86,435 customers and amounts to a 13.42% increase over current natural gas distribution rates. If approved, this proposed increase will result in a 19.81% increase in residential rates, which amounts to an average increase of $8.24 per month for a residential customer using 77 dekatherms. MDU’s request is made pursuant to Mont. Code Ann. Title 69, Chapter 3, regarding regulation of utilities; Title 2, Chapter 4, regarding administrative proceedings; and Mont. Admin. R. §§ 38.5.101, et seq.

MDU also requests interim rate relief in the amount of $4,884,024, as set forth in its Application for Interim Increase in Natural Gas Rates (filed contemporaneously with this Application) and requests this increase take effect on February 1, 2021. The interim request is made pursuant to Mont. Admin. R. §§ 38.5.501 through 38.5.506.

A copy of the filing is publicly available online at the Commission’s website (www.psc.mt.gov) under Docket No. 2020.06.076. On March 20, 2020, the Commission issued a Notice of Operational Changes in Response to Coronavirus (“Notice”). Under the “Office Closed to Public” section of the Notice, the Commission outlined a temporary change for office closure during business hours. Monday, June 220025 – An officer thought

a male was coming around the corner by the library. At 0030, a PBT of 0.371 was logged for the male.

0914 – A male advised he spoke with an officer, who told him to call and make a report for record. The caller stated a male has been hanging around the area and they do not want him there. The caller stated further that the male has been coming around in the evening so the caller hasn’t been able to catch him to tell him he isn’t allowed on the property. The caller further stated the of-ficer was going to send out an email to the GPD about this.

0954 – An officer advised someone found two credit cards in the park next to the swim-ming pool over the weekend.

Both cards have the same name on them.

0954 – An officer requested a call for service be started for a theft that occurred on May 7, 2020.

1235 – A male said he tried to register his snowmobile but they said an inspection needed to be done first. He has all the paperwork at his residence in St. Marie. A deputy was notified when he got back in his vehicle. At 1314, the deputy stated the inspection was completed.

1524 – A deputy entered the detention center to serve a war-rant on an inmate.

1833 – A person called be-cause their battery in their boat died between Southerland Point and Hell Creek. The Marina and Hell Creek Marina were contacted, of which Hell Creek Marina tried to give the boaters ideas before going out to jump their battery. At 1957, Miles City Dispatch called stating an officer heard about the call for the stranded boat and was pro-

vided the updated information. Miles City dispatcher stated the people haven't been found as of yet by their officer but will call back if anything more is needed. At 2015 an update of the location was provided which was passed along to Miles City Dispatch. At 2044, the boaters reported they were going to try to make it to the Pines and see if someone is out there that can jump the battery. They are moving along alright at the moment and will contact dispatch if things change.

2133 – A caller reported a fire hydrant that appeared to be leaking. The Fire Chief was contacted to find out if there was anything going on in the area, of which it was stated there wasn’t. An officer was also notified who at 2145 stated the hydrant was leaking pretty good and advised to contact the water department. The water department was con-tacted and a female was reached who would be on her way to check it out. At 2200, a male from the water department called and stated there is a pressure re-lease valve that will release water once in a while when the pressure builds up. He was advised that someone was contacted from the water department who was on their way to check it out.

Tuesday, June 230919 – A male advised he

spoke with an officer who told him to also report the incident to dispatch. The caller said he contracted a male to do some work for him and upon comple-tion of the work, the male would be compensated, with part of the compensation being a 1994 Mazda pickup the caller recently purchased. The caller stated the male did not complete the work and therefore broke the contract but took the pickup with him. The male will not communicate with the caller and the caller wants the pickup back. The male was living in a residence on the north-side but was evicted a week or so ago so unknown where he is living now. The caller doesn’t want to press charges for theft at this time he just wants the vehicle back as it’s in his name.

1005 – A male reported to a deputy that someone broke into a shop he owns and mechanic tools are missing.

1221 – A female called want-ing an officer right away. She wouldn’t speak to dispatch but was talking to people in the background. When dispatch got the caller’s attention, she stated she was near her grandmother’s house. She then again started to speak to other people. The caller relayed she gave her friend $20 to hold on to for her and the friend’s boyfriend beat up the friend and took the money. The caller stated he won’t give the money back and is following her now. The caller then started to speak with someone else and wouldn’t answer the questions being asked regarding who the boyfriend was, but it did come up that she didn’t think he had any weapons. The caller then said she was leaving to go her house and hung up the phone. She called back a minute later and said she stopped her car and the boyfriend gave the money back. She stated she no longer needed assistance and asked to cancel her request for officers.

1339 – A male reported he was just in a two-vehicle ac-cident in front of Holiday. No one is hurt but there is one lane of traffic blocked. At 1347, an officer had the owners move the vehicles off the road. A right-of-way violation was issued to the female driver.

1753 – A reporting party called in about a small grass fire at the downstream campground. Flames are visible but it’s a grass fire and not near the campers.

2149 – A reporting party called about fresh cuts in the paint of the hood of his vehicle. He states his dad’s truck has some vandalism he would like to have someone come look at it.

2244 – A deputy entered the detention center and served a warrant to an inmate for MHP.

Wednesday, June 241106 – A male advised there

is a white Dodge pickup heading towards Glasgow westbound passing Whatley Road. It has no rear plate and is swerving all over the road. He will not sign a complaint.

1434 – A male called in to advise he backed into a pole and has knocked it down. It is laying across the road at this time. An officer was notified who cited the driver for careless driving.

1603 – A male, who wished to remain anonymous, reported a white van speeding, driving erratically and swerving all over the road. The male stated if officers need him to sign a complaint they can call him. At 1630, a deputy advised she was unable to locate the vehicle. She patrolled all the way to MM 565 and didn’t see anything.

1647 – A female from BLM called reporting they received a call from Grasslands National Park in Canada stating they be-lieve a fire they have there will cross into the U.S. Opheim FC was contacted and he requested to page out Opheim Fire. Ophe-im Fire stated they were close to losing cell service but they could not see smoke but would proceed further and if they still do not see anything they will come back. Later on, the Opheim Fire Department reported they were within eight miles of the Canadian border and could not see any smoke and from where they were, they could see into Canada. Dispatch notified Long Run Fire and BLM what Opheim Fire reported.

1824 – A female reported a man walking around in his boxer shorts with everything hanging out. She is concerned as there are children around. An officer re-corded a .086 PBT for the male.

1837 – A male reported he had a dog trying to jump his fence to get to his dog.

2022 – A female called in requesting a deputy for an in-toxicated female at an address. After providing the address to dispatch, the female hung up.

2034 – An alarm at a resi-dential location was reported. A deputy checked the residence. Though it was unsecured, no one was there.

2230 – A female called in to report that she was at her daugh-ter’s house and she saw a flashing beacon light.

Thursday, June 25 0817 – A caller called in to

report a stolen vehicle. He said a man took the vehicle and has left town. The caller stated he was letting the male use it but now he has left town in it. The caller also stated he purchased the truck from Valley Auto Sales the first week of May. The vehicle has a temporary tag but doesn’t know the number. The caller stated he also wanted a deputy to call him on this incident and will come in and sign the vehicle as stolen sometime today. At 1259 the caller came by dispatch and dropped off the signed stolen vehicle report. He said a female never came by with the money.

1136 – A male advised he received a call stating he had a warrant out of Valley County. He didn’t talk to the person on the other line or give them any information. The caller was noti-fied there is no warrant for him and that this is a scam call.

1318 – A male called in re-questing a VIN inspection on a boat trailer. He states he has all his paperwork. Dispatch noti-fied the caller there is no one available at this time but would have an officer call him and set up a time to come over and get it done. At 1506, the officer ad-vised no VIN was located.

1926 – While on shift, dis-patch heard FG talk to MHP about a male. A deputy radioed that she would be en route re-garding the warrant. It was deter-mined the male was on District Court Conditions. Both deputy and MHP was notified regarding the conditions.

2141 – A male called in to report his truck stolen. He stated it was stolen three hours ago and he was sure it was a female that took his truck. RC911 was noti-fied and they stated the male had just called in on their 911 and he stated the truck was not stolen, instead his niece took the truck and she is on her way to him.

2241 – A female reported a dead deer and the deer was a mess. A deputy advised she dragged the deer into the east side ditch of the highway and DOT was notified.

2316 – A reporting party called and said there was a

person laying on the ground in front of the Episcopal Church. He made contact with the female, who sat up and said she was fine and then laid back down again. The female refused to provide her name when asked. An officer was notified who stated he had already spoke with the person. She was just taking a break from driving and everything is okay.

Friday, June 26 0003 – A male called in and

said he just passed an abandoned vehicle and then a little later a woman walking along the side of the highway. He said it was near Little Bonner Road. Dispatch asked him if he was in Valley County because the road name was unfamiliar. He said he was in Valley County and then real-ized he called the wrong Valley County, as he wanted Valley County, Idaho.

0736 – A deputy checked with an attached trailer on a public as-sist. There is a flat tire and they have someone coming to help them. The trailer is off the road and not a hazard.

0810 – A deputy advised he received a call on his cell about a dead deer. The deputy pulled the deer off the road and it’s now on the south side of the road. A message was left for MDOT.

1005 – A male came into the lobby with a plastic bag. He said he needed to talk to an officer because he thinks this is the evidence they need to catch the person breaking into his house. An officer was notified.

1006 – A female needs a VIN inspection on a vehicle. She said she is down at the yellow counter in the basement of the courthouse. A deputy was noti-fied who will go speak to her.

1246 – A male came into the dispatch lobby and stated he found a phone laying by the sidewalk. At 1458 the owner of the phone came in to pick it up.

1523 – A female called in wanting a VIN inspection on a boat and trailer.

1723 – A male came in with his two boys. He believes his ex-wife is saying inappropriate things to his sons and wants it on record and an officer to talk to them so the officer can hear it from them without him present.

1755 – A male called in on the 911 line to advise that his son was bitten by someone’s dog out at the campground. He doesn’t want an ambulance but believes his son may need stitches in one of the bite wounds. The dog owner is on scene. At 1801 the male called back and said his son is hurting pretty bad, as he was bit in two places. The caller was advised an officer is on his way and if anything changes to call back.

2003 – A female advised her officer called in a grass fire right off the highway by a yellow house, however it looks like it is just about out. A deputy and a tribal officer are on scene.

2050 – A female reported a kayak was stolen from her backyard.

2207 – Suspicious activity of a door being ajar on a vehicle was reported.

2350 – A female reported she hit a deer. She kept going but there is damage to her headlight, hood and fender. At 0003, per a deputy the deer got dragged off the road on the north ditch at the base of Creature Feature Hill. MDT local office was notified.

Saturday, June 270021 – A female called in ask-

ing if there were papers to serve on her. She is home and awake if they want to come over now.

0856 – A reporting party called to report a white service truck was driving erratically in front of them. They are con-cerned for the safety of the driver and other traffic. A deputy was notified and the reporting party is willing to sign a statement if needed.

0901 – A reporting party reported a truck with a Uhaul trailer, heading westbound out of Agland, with a flat tire on the trailer. He was concerned if it’s headed out on the highway, it would be a possible fire risk. An officer was advised. At 0912, two officers reported they were unable to locate the truck.

1148 – A reporting party called in as he was out on his boat and noticed a truck with a kayak that is on his brother’s

property. His brother has a gate up to keep people from going past a certain point on his prop-erty and this truck apparently has gone through the gate. The reporting party would like to have this checked out since they are not supposed to be there. At 1244, a deputy advised he patrolled around and there is no one around at this time. The caller was advised of this. The caller then stated to the deputy he spoke to the subject and told him to leave. The caller is also going to put a lock on the gate.

1227 – A caller, who wished to remain anonymous, stated there is a male sitting along side of the road. He wasn’t doing anything bad, but the caller was concerned for his safety.

1251 – A male called in stat-ing he is locked out of his house. He was provided numbers to the locksmith. He was also notified if he doesn’t get a hold of them to call dispatch back. At 1329 dispatch called the caller back to make sure he got a hold of someone.

1458 – A male called in stat-ing he would like an officer to come over and give him some information on how much he needs to clean up. He is there cleaning up his rental property and wants to know how much he needs to do before the renters get back. At 1507, an officer spoke with the property owner and gave him the ordinances.

1929 – A male came into the dispatch lobby wishing to speak to an officer about his ex-step daughter-in-law spreading ru-mors about him.

2052 – A female called in stating there is a white pickup that has been parked in front of their house all day. She feels it is something that needs to be checked on. Per officer the vehi-cle owners were at the neighbor’s house the entire time.

Sunday, June 28 0100 – A deputy is requesting

city officers as there is someone walking around with just shorts and no shoes.

0935 – A male called to see if there were any car accidents reported in the area. His son left Scobey at 0430 this morning to meet someone in Malta to go to Butte for the Guards. The father hasn’t heard from him and isn’t sure if the son’s phone is work-ing. The father says he isn’t sure when the son made it to Malta, if the person he was meeting was late and maybe his son continued to dive to Butte on his own. He isn’t looking to have anything done at this time just contacting law enforcement along the way to make sure there is nothing wrong.

1200 – An officer received a call from a friend who was on the lake and he noticed a truck sunk along the water up to the bottom of the truck. No other description was given of the vehicle. The information was passed along. At 1235 a deputy reported no vehicle was seen in the area however the area will be patrolled.

1212 – A reporting party called to state the ex-wife is not allowing him to speak with his boys. He requested to be put down to a deputy voicemail.

1239 – A reporting party was concerned about a Chevy Malibu driven by a female approxi-mately 50 years of age driving all over the road. She crossed the center line at least three times into traffic. The reporting party managed to pass the vehicle and stated they were just approaching Nashua. MHP and a deputy was notified. A deputy patrolled US 2 all the way to Nashua then High-way 117 back to Fort Peck and was unable to locate the vehicle.

2130 – A male on violations logged a PBT of 0.296. The male was told to go to his buddy’s house. At 2150 the officer re-ported the male is still there lean-ing on the wll waiting for a ride.

2152 – A deputy is out with a female on violations. A PBT of 0.115 was logged.

2238 – A male received a call at the front desk and couldn’t understand what the person was saying but thought they might need help. It was determined the number had called earlier about getting a room.
