Minimum Eligibility Criteria:
1. The tenderer should have valid license/ registration of Manpower Service provider/
Agency/ Organization.
2. The tenderer should have successfully executed outsourcing works during last 3 (three)
years in State Govt./ Central Govt./ Govt. undertaking/ Urban local bodies / PSUs.
The tenderer can download the tender documents from the Govt. of Odisha Website from
10.00 hrs of dated 24.12.2018 up to 15.00 hrs of 04.01.2019 and use the down loaded
tender documents provided that the cost of tender paper in shape of account payee Demand
Draft/ Banker’s Pay Order (Non-Refundable) drawn in favour of the Project Engineer,
PMU-I, OWSSB, Sambalpur on any Nationalized/ Scheduled Bank payable at
Sambalpur is furnished along with the tender documents. The DD / Pay orders towards
cost of Tender Paper (downloaded) should be made within the last date of sale of Tender
Paper and not before 24.12.2018, failing which the tender will be liable for rejection.
OWSSB shall not be held responsible for any delay/ difficulties/ inaccessibility of the
downloading facility for any reason whatsoever. If the last date of sale/ opening of Tender
will be declared as holiday, the next working day will be the last date of sale/ opening of
Tender respectively.
The EMD should be in shape of Fixed deposit in any Nationalized or Schedule Bank/ NSC/
Post Office Time Deposit drawn & pledged in favour of Project Engineer, PMU-I, OWSSB,
Sambalpur. Tender without EMD of stipulated amount will be rejected summarily.
The tender will be received in the office of the Project Director, Project Management
Circle, Biju Pattnaik Chhak, Tulasipur, Cuttack-753008, within the last date and time of
receipt of tender documents by registered post/ Speed Post/ Courier service/ in person by
hand.

transit and no claim what so ever will be entertained on this account. The authority reserves

SCOPE OF WORK AND GENERAL INSTRUCTIONS FOR BIDDERS
1. The Project Engineer, PMU-I, OWSSB, Sambalpur invites tenders from registered
Manpower service provider/ agency/ Organisation to provide Manpower services on
contractual basis for Operation & Maintenace of Septage Treatment Plant at Khandual,
Sambalpur.
2. The contract for providing the aforesaid Manpower services will commence from the
date of agreement and would continue for three months. The period of the contract
may be further extended provided the requirement of the OWSSB for manpower persists
at that time at the same contract price or with allowable increase in cost as per
Notification of Labour Department, Govt. of Odisha on approval of competent authority.
The contract may be curtailed/ terminated at any time owing to deficiency in service or
substandard quality of manpower deployed by the selected Service Provider/ Agency/
Organisation or because of change in the OWSSB’s requirements. The OWSSB,
however, reserves the right to terminate the contract at any time after giving two week’s
notice to the selected Service Provider/ agency.
3. OWSSB have tentative requirement for 07 nos. personnel as listed in the DTCN Price
bid. The requirements may increase/decrease in any/all the categories.
4. The estimated cost of the contract is Rs. 3, 24,990.00 including EPF & ESI.
5. The interested Agency/ Organisation may submit the tender document complete in all
respects along with requisite Earnest Money Deposit (EMD) and other requisite
documents within last date & time as mentioned in the DTCN.
6. The tender has been invited under one bid system. The bid documents shall be submitted
in one sealed envelope superscribing “Tender for Providing Manpower Services to
OWSSB, Sambalpur”.
7. The required amount of Earnest Money Deposit (EMD) should be necessarily
accompanied with the Bid document in shape of Fixed deposit in any Nationalized or
Schedule Bank/ NSC/ Post Office Time Deposit drawn & pledged in favour of Project
Engineer, PMU-I, OWSSB, Sambalpur, failing which the tender shall be rejected
summarily. The EMD of unsuccessful tenderers will be returned after finalisation of
tender.
8. Successful bidders, after issue of LOI (Letter of Intent) by the Project Engineer, PMU-I,
OWSSB, Sambalpur shall submit Initial Security Deposit (ISD), 2% of the accepted
contract value in the form of Bank Draft/ Pay order in favour of Project Engineer,
PMU-I, OWSSB, Sambalpur, in any Nationalised/ Scheduled bank payable at
Sambalpur, The EMD amount furnished by successful bidder will be adjusted towards
ISD.
9. The Tendering Agency/ Organisation are requested to enclose photocopies of the
following documents (duly Notarised or attested by Gazetted Officer of the State
Government/ Central Government), along with the Tender paper, failing which their bids
shall be summarily rejected
i. Registration of agency / Organisation.
ii. PAN card.
iii. Documents in support of the Financial turnover of the agency
iv. Goods & Services Tax Registration Certificate.
v. EPF & ESI registration certificate.

10. The conditional bids shall not be considered and will be out rightly rejected in very first
instance.
11. All entries in the tender form should be legible and filled clearly. If the space for
furnishing information is insufficient, a separate sheet duly signed by the authorised
signatory may be attached. No overwriting or cutting is permitted in the Bid Form.
However the over writing or the cuttings, if any, in the Bid Application must be
initialled by the person authorised to sign the tender/bid failing which the tender shall
be summarily rejected.
12. The bidders are required to quote the service charges in percent only with maximum
one digit after decimal in the space provided in the price bid.
13. The Competent Authority of the Orissa Water Supply & Sewerage Board reserves the
right to reject any or all bids without assigning any reason.

TECHNICAL REQUIREMENT
TECHNICAL REQUIREMENTS FOR THE MANPOWER SERVICE PROVIDER
AGENCY/ ORGANISATION
1. The tendering Agency/ Organisation should fulfil the following technical specifications:
(a) The Agency/Organisation should provide the name, designation and contact number
of the person to liaise with OWSSB.
(b) They should have their own Bank Account;
(c) They should be registered with Income Tax and Goods & Service Tax departments;
(d) They shall have registered with appropriate authorities under Employees Provident
Fund and ESI.
(e) Minimum turn-over requirement -.Minimum Rs.10.00 lakhs per annum. (In any
year of last three years)
(f) Necessary documents copies should be furnished to full fill the requirement, either
self attested or notarized from competent authority. The tenderer shall provide the
original document for verification if required by the competent authority. Failing to
produce the original documents the contract will be cancelled/ rescinded.
(g) Good moral character certificate of service personnel shall be provided from a
Gazetted Officer for at least three years at the time of their joining.
(h) Physical fitness certificate from CDMO/ ADMO/ Asst. Surgeon of any Govt.
Hospital is to be furnished for all categories of manpower by successful agency at
the time of their joining.
(i) Bio-data in prescribed proferma of all the personnel along with necessary documents
copies regarding minimum educational qualification, experience, age, identity proof
& address proof should be furnished either attested or notarised in respect of all
categories of services (as per Table-1) at the time of signing of agreement.

TERMS & CONDITIONS
GENERAL
1. The Agreement is likely commence from the date of agreement of man power and shall
continue till three months unless it is curtailed or terminated by the authority owing to
deficiency of service, sub-standard quality of manpower deployed, breach of contract
etc. or change in requirements.
2. The Agreement shall automatically expire after three months unless extended further by
the mutual consent of the agency/ Organisation and the Authority on same terms and
conditions or modified.
3. The Agreement may be extended, on the same terms and conditions, or with some
additions/ deletions/ modifications, for a further specific period mutually agreed upon
by the Manpower Service Provider Agency/ organisation and the Authority if the
performance during the contract period is found satisfactory by the authority.
4. Manpower Service Provider Agency/ organisation shall not be allowed to transfer,
assign, pledge or subcontract the rights and liabilities under this Agreement to any
other agency or organisation by whatever name be called without the prior written
consent of the Authority.
5. At present, PMU-I, OWSSB, Sambalpur has requirement for 07 nos. of personnel as
mentioned in the DTCN. The requirement of the man power may further increase or
decrease during the period of initial contract and also the tenderer would have to
provide additional manpower services, if required, on the same terms and conditions.
6. Manpower Service Provider Agency/ organisation will be bound by the details
furnished by it to the Authority while submitting the tender or at subsequent stage. In
case, any of such documents furnished by it is found to be false at any stage, it would
be deemed to be a breach of terms of Agreement making it liable for legal action
besides termination of the Agreement.
7. The Authority reserves the right to terminate the Agreement during initial period also
after giving two week’s notice to the Manpower Service Provider Agency/
organisation.
8. The persons deployed shall be required to report for work at schedule time at the
Septage Treatment Plant Sit at Khandual, Sambalpur and report to the Project Engineer,
PMU-I, OWSSB, Sambalpur or such other officer in charge of Septage Treatment Plant
and would leave at schedule time after handing over charge to his reliever and may also
require to work beyond schedule time for which he would not be paid any extra
remuneration. In case, the person deployed remains absent on a particular day or comes
late/ leaves early on three occasions, proportionate deduction from the remuneration for
one day will be made.
9. The person deployed may be called on holidays during urgency/ emergency to attend
duty and shall not be paid extra remuneration by this office on attending such duty.

10. The Manpower Service Provider Agency/ organisation shall nominate a coordinator/
Supervisor who shall be responsible for immediate interaction with the Office so that
optimal services of the persons deployed could be availed without any disruption.
11. The entire financial liability in respect of manpower services deployed shall be that of
the Manpower Service Provider Agency/ organisation and the Authority concerned will
in no way be liable. It will be the responsibility of the Manpower Service Provider
Agency/ organisation to pay to the person deployed a sum not less than the minimum
wage rate quoted in the financial bid and produce such evidence as may be required by
the OWSSB / Authority concerned.
12. For all intents and purposes, the Manpower Service Provider Agency/ organisation
shall be the “Employer” within the meaning of different Rules & Acts in respect of
manpower so deployed. The persons deployed by the Manpower Service Provider
Agency/Organisation shall not have any claim whatsoever like employer and employee
relationship against the OWSSB or Authority concerned.
13. The Manpower Service Provider Agency/ organisation shall be solely responsible for
the redressal of grievances or resolution of disputes relating to persons deployed. The
Department shall, in no way, be responsible for settlement of such issues whatsoever.
In case the grievances of the deployed person are not attended to by the Manpower
Service Provider Agency/ organisation the deployed person can place their grievance
before a Joint Committee consisting of a representative of the OWSSB and an
Authorised representative of the Manpower Service Provider Agency/ organisation.
14. The OWSSB shall not be responsible for any financial loss or any injury to any person
deployed by the Manpower Service Provider Agency/ organisation in the course of
their performing the functions/duties, or for payment towards any compensation. The
Manpower service provider Agency/ organisation should make insurance of the
employees for any such type of incidents on life/ accident/ injury etc.
15. The Manpower service provider Agency/Organisation shall provide quality in Operation
& Maintenance of Septage Plant as well as maintaining all official records at Plant Site.
16. The persons deployed by the Manpower Service Provider Agency/Organisation shall
not claim nor shall be entitled to pay, perks and other facilities admissible to regular/
confirmed employees during the currency or after expiry of the Agreement.
17. In case of termination of this Agreement on its expiry or otherwise, the persons
deployed by the Manpower Service Provider Agency/ Organisation shall not be entitled
to and shall have no claim for any absorption in regular or other capacity.
18. The person deployed shall not claim any benefit or compensation or absorption or
regularisation of deployment with office under the provision of rules and Acts.
Undertaking from the person deployed to this effect shall be required to be submitted
by the Manpower Service Provider Agency/ Organisation at the time of their
engagement.

19. The Man Power proposed by the Agency to be deployed, are to face an interview/ Skill
test by the OWSSB for final selection before their engagement. The decision of
OWSSB in this regard shall be final and binding on the Manpower Service provider.
20. The Manpower Service Provider Agency/Organisation must be registered with the
concerned Govt. Authorities, i.e. State Govt. Labour Commissioner, Provident Fund
Authorities, Employees State Insurance Corporation etc. and a copy of the registration
should be submitted along with the tender. The Manpower Service Provider
Agency/Organisation shall comply with all the legal requirements for obtaining License
under Contract Labour (Regulations and Abolition) Act, 1970 if any, at his own part
and cost.*
21. The Manpower Service Provider Agency/Organisation shall provide a substitute well in
advance if there occurs any probability of the persons leaving the job due to his own
personal reasons. The payment in respect of the overlapping period of the substitute
shall be responsibility of the Manpower Service Provider Agency/ Organisation. The
Manpower Service Provider Agency/ Organisation shall be responsible for
contributions towards Provident Fund and Employees state insurance wherever
applicable.
22. The persons deployed by the Manpower Service Provider Agency/Organisation should
have good police records and no criminal case should be pending against them. Police
clearance certificate shall be provided against all personnel deployed/ to be deployed
by the successful tenderer after execution of agreement to the authority for verification
and acceptance within one months from award of work order.
23. The persons deployed should be polite, cordial and efficient while handling the
assigned work and their actions should promote good will and enhance the image of the
Employer/ OWSSB. The Manpower Service Provider Agency/ Organisation shall be
responsible for any act of indiscipline on the part of the persons deployed. In case of
any deviation, the agency/ Organisation shall remove errant personnel on written order
from employer.
LEGAL
24. The persons deployed shall, during the course of their work be privy to certain
documents and information which they are not supposed to divulge to third parties. In
view of this, it shall be required to take oath of confidentiality and breach of this
condition shall make the Manpower Service Provider as well as the person deployed
liable for penal action under the applicable laws besides, action for breach of contract.
25. The Manpower Service Provider Agency/ Organisation shall be responsible for
compliance of all statutory provisions relating to minimum wages payable to different
types of worker in respect of the persons deployed by it in the office concerned. The
OWSSB shall have no liability in this regard.

applicable Manpower Service Provider employing more than 20 workmen.

26. The Manpower Service Provider Agency/ Organisation shall also be liable for
depositing all taxes, levies, Cess etc. on account of service rendered by it to the
Department or office concerned to the concerned tax collection authorities, from time
to time, as per the rules and regulations in the matter. Attested Xerox copies of such
documents shall be furnished to OWSSB. As per statutory requirement, the employer
shall deduct TDS from bills of agency/ Organisation from time to time.
27. The Manpower Service Provider Agency/ Organisation shall maintain all statutory
registers under the Law and shall produce the same, on demand, to the authority of the
Department or office concerned or any other authority under law.
28. The Tax deduction at Source (T.D.S.) shall be done as per the provisions of Income
Tax Act/ Rules, as amended, from time to time and a certificate to this effect shall be
provided by OWSSB.
29. In case, the Manpower Service Provider Agency/ Organisation fails to comply with
any liability under appropriate law, and as a result thereof, the OWSSB will put to any
loss/ obligation, monetary or otherwise, the OWSSB will be entitled to get itself
reimbursed out of the outstanding bills or the Performance Security Deposit of the
Manpower Service Provider Agency/ Organisation, to the extent of the loss or
obligation in monetary terms.
30. The Agreement is liable to be terminated because of non-performance, deviation of
terms and conditions of contract, non-payment of remuneration of employed persons
and non-payment of statutory dues. OWSSB will have no liability towards non-
payment of remuneration to the persons employed by the Manpower Service Provider
Agency/ Organisation and the outstanding statutory dues of the service provider to
statutory authorities. If any loss or damage is caused to OWSSB by the persons
deployed, the same shall be recovered from the unpaid bills or adjusted from the
Performance Security Deposit/ ISD.
31. Copy of any other relevant documents as decided by the authority and copy of tender
documents of successful bidders would form part of the Agreement.
32. No person of the man power service provided shall damage/ break/ misuse/ make any
material within the premises of the Septage Treatment Plant. In case of any damage to
any of the material/ machineries by the man power of the Manpower Service Provider
Agency/ Organisation same shall bear the cost of repair/ replacement of the material as
per the market rate as decided by the OWSSB.
33. No person of the man power of service provider can take any material out of the
Septage Treatment Plant campus without the permission of the Project Engineer or his
authorized person.
FINANCIAL
34. The Bid should be accompanied with required Earnest Money Deposit (EMD), in
shape of Fixed deposit in any Nationalized or Schedule Bank/ NSC/ Post Office

Time Deposit drawn & pledged in favour of Project Engineer, PMU-I, OWSSB,
Sambalpur failing which the tender shall be rejected out rightly.
35. The Earnest Money Deposit in respect of the Agencies/Organisation which do not
qualify shall be refunded. In case of successful tendered if the agency fails to deploy
the required manpower against the initial requirement within 15 days from date of
placing the order/ drawal of agreement the EMD shall stand forfeited without giving
any further notice.
36. Successful bidders, after issue of LOI (Letter of Intent) by the Project Engineer,
PMU-I, OWSSB, Sambalpur shall submit initial security deposit (ISD), 2% of the
accepted contract value in the form of Bank Draft/ Pay order in favour of Project
Engineer, PMU-I, OWSSB, Sambalpur, in any Nationalised/ Scheduled bank
payable at, Sambalpur. The EMD amount furnished by successful bidder will be
adjusted towards ISD.
37. Additional Performance Security shall be deposited by the successful bidders when
the bid amount is less than the estimate cost. In such event the successful bidder will
deposit the additional performance security to the extent of the differential cost of
the bid amount to the estimated cost in shape of DD/ Pay Order/ NSC/ KVP/ POSB/
POTD/ Deposit receipt of schedule Bank drawn/pledged in favour of the Project
Engineer, PMU-I, OWSSB, Sambalpur.
38. In case of breach of any terms and conditions attached to this agreement, the
Performance Security Deposit and ISD of the Manpower Service Provider Agency/
Organisation shall be liable to be forfeited besides annulment of the Agreement.
39. The Manpower Service Provider Agency/ Organisation shall raise the bill, in
duplicate, along with attendance sheet and Quality assessment sheets duly verified
by OWSSB/Authority in respect of the persons deployed and submit the same to the
prescribed authority/ OWSSB in the first week of the succeeding month. As far as
possible the payment will be released by the second week of the succeeding month.
40. The claims in bills regarding Provident Fund, and Service Tax etc. should be
necessarily accompanied with documentary proof pertaining to the concerned bill
month. A requisite portion of the bill or whole of the bill amount shall be held up till
such proof is furnished, at the discretion of OWSSB/Authority.
41. The amount of liquidated damage calculated @ Rs. 100.00 per day per person on
account of delay, if any, in providing a suitable substitute for the period beyond
three working days by the Manpower Service Provider Agency/ Organisation shall
be deducted from its monthly bills in the succeeding month.
42. The Authority reserves the right to withdraw or relax any of the terms and condition
mentioned above so as to overcome the problem encountered at a later stage.
43. In the event of any dispute arising in respect of the clauses of the agreement the
same shall be resolved through negotiation. Alternatively the dispute shall be
referred to the higher authority or Member Secretary, OWSSB for his decision and
the same shall be binding on all parties.

44. All disputes shall be under the jurisdiction of the court at Sambalpur.
45. The successful bidder will enter into an agreement with the Project Engineer,
PMU – I, OWSSB, Sambalpur for supply of suitable and qualified manpower as per
requirement of OWSSB on the above terms and conditions.
46. The minimum labour rate should be paid to the deployed persons as approved by the
Govt. of Odisha. The wages must be changed for payment to the persons deployed if
the labour rate revised by the State Govt. and will be reimbursed from the OWSSB.
The revised rate will be paid by OWSSB from the date of effect of such order/
circular,
47. The Tax deduction at Source (T.D.S.) shall be done as per the provisions of Income
Tax Act/ Rules, as amended, from time to time and a certificate to this effect shall
be provided by OWSSB.

CONTRACT
1. List of Manpower shortlisted by agency for deployment in OWSSB (containing full
details i.e. date of birth, marital status, address, educational qualification, experience
etc.) containing full details. (Bio-Data form enclosed)
2. Following documents of all personnel along with their Bio-data: –
i) Good moral character certificate from Gazetted Officer for last three years.
ii) Physical fitness certificate from CDMO/ Medical Officer
iii) Police clearance certificate from District Police (if not available, then it
should be furnished within next one months.)
iv) Experience certificate from appropriate authorities/ individuals. (Govt./
Municipality/ WESCO, etc.)
v) Birth certificate/ School leaving certificate copy.
vi) Educational qualification certificate copy.
vii) Identity proof copy (Voter ID/ Aadhar/ Driving licence/ PAN Card)
viii) Address Proof copy (Voter ID/ Aadhar/ Driving licence/ Pass Port)
ix) Undertaking for not to claim any benefit or compensation or absorption or
regularisation of deployment.

AGREEMENT
This Agreement is made on this _____________day of ______________ between
the Orissa Water Supply & Sewerage Board represented by the Project Engineer, PMU – I,
OWSSB, Sambalpur here-in-after referred to as the “Authority” which expression shall,
where the context so requires or admits, also include its successors or assignees of the one
part;
and
M/s _________________________________ represented by Sri______________,
here-in after called the “Manpower Service Provider Agency/ Organisation” which
expression shall, where the context so requires or admits, also include its successors or
assignees of the other part.
Whereas, the “Authority” desires that the services of “___________” are required
by the Project Management Unit – I, OWSSB, Sambalpur for Operation & Maintenance of
Septage Treatment Plant at Khandual, Sambalpur;
And whereas the “Manpower Service Provider Agency/ Organisation” has offered
its willingness to the same in conformity with the Provisions of the agreement;
And whereas the “Authority” has finalized the rate as per the terms and conditions
of the agreement to the “Manpower Service Provider Agency/ Organisation”.
Now this agreement witnesses as below:-
1. That the Annexure containing the Terms and Conditions shall be deemed to form
and to be read and construed as part of this agreement.
2. That in consideration of the payment to be made by the “Authority” to the
“Manpower Service Provider Agency/ Organisation”, the “Manpower Service
Provider Agency/ Organisation” hereby agrees with the “Authority” to provide
personnel to be engaged as per Table I of DTCN for the Septage Treatment Plant at
Khandual, Sambalpur in conformity with the provisions of the Terms and
Conditions.
3. That the “Authority” hereby further agrees to pay the “Manpower Service Provider
Agency/ Organisation” the contract price at the time and in the manner prescribed in
the said Terms and Conditions.

4. That in the event of any dispute that may arise it shall be settled as per the Terms
and conditions of the contract.
5. That this agreement is valid for 03 (three) months and extensible on mutual consent
of both the parties.

here unto affixed or have here unto set their respective hands and seals on the day and year
