1 Preliminary1.1 Citation
Thislocalplanningpolicyismadepursuanttotheprovisionsof‘Division2-Localplanningpolicies’ under‘Part2-Localplanningframework’of‘Schedule2-Deemedprovisionsforlocalplanning schemes’ofthePlanning and Development (Local Planning Schemes) Regulations 2015,andmaybe citedasLocalPlanningPolicy:AccessandParkingforPedestrians,BicyclesandVehicles(herein referredtoasthe‘localplanningpolicy’).
1.2 Policy Area
Thislocalplanningpolicyappliestotheaccessandparkingrequirementsforpedestrians,bicyclesandvehicles(hereinreferredtoas'accessandparking')onallzonedandreservedlandwithinthelocalgovernmentdistrictoftheCityofBunbury,andassuch,thelocalplanningpolicyareaistheSchemearea.
Theboundariesofthelocalplanningpolicyareaincorporatethatareareferredtoasthe'RegionalCentreParkingArea',asdefinedbyMap 1: Regional Centre Parking Area(asamended).

1.3 PolicyApplication
WiththeexceptionofthoseaspectsofdevelopmenttowhichtheResidentialDesignCodes(the'R-Codes')apply,theprovisionsofthislocalplanningpolicyapplytothedevelopmentand/oruseofpremisesintheSchemeAreaforthepurposesofdeterminingvehicleaccessandparkingrequirementsapplicabletothedevelopmentoruseofland.
Allresidentialdwellingdevelopment(eithersolelyforresidentialpurposesoraspartofamixeduse development)shallcomplywiththeacceptabledevelopmentstandardsoftheR-Codesfortheprovisionofcarparking.
SubjecttotheScheme,developmentanduseoflandforpurposesnecessitatingtheprovisionofparkingshallmakeprovisionforparkingbaysinaccordancewiththestandardsandrequirementsofthislocalplanningpolicy;andexceptasotherwiseprovided,shallrequirethepriordevelopmentapprovalofthelocalgovernmentinaccordancewiththeprovisionsoftheScheme.
2 Purpose2.1 Thepurposeofthislocalplanningpolicyistoguidetheexerciseofdiscretioninthedeterminationof
applicationsfordevelopmentapprovalwithrespecttothosemattersaffectingtheprovisionofaccessandparkingforpedestrians,bicyclesandvehicles,inorderto-
(a) ensurethatthetransportneedsofthecommunityareadequatelymetbytheassociateduseanddevelopmentoflandwithinthecity,andinparticular,theRegionalCentreZone;and
(b) enableaconsistentandaccountableapproachtotheprovisionofcarparkingassociatedwithlanduseplanninganddevelopmentofthecityinaccordancewiththepolicyobjectives.
3 Objectives InaccordancewiththeAimsoftheScheme,landuseanddevelopmentistoachievethefollowingoutcomes
foraccess,parkingandpublictransportintegrationintheschemearea-
3.1 ObjectivesfortheSchemeArea
(a) anadequatesupplyofvehicleandbicycleparkingfacilitiesthataresafeandconvenienttoaccessandusebypedestriansandvehicles;
(b) efficientandsafeaccessandmovementofpedestriansandvehicleswithintheroadnetwork;
(c) integrationofpublictransportationwithinbothpublicandprivatedevelopments/areas;
(d) promotionofmultipletransportmodessuchaspublictransport,walking,cyclingandtheviability ofassociatedinfrastructurebylandusesanddevelopmentsthatgeneratedemandfortransportationof people;
(e) adequateprovisionofloadingandservicevehicleparkingfacilitiesbylandusesanddevelopments thatgeneratedemandfortransportationofgoodsandservices;and
(f) promotionofsupportiveenvironmentsforphysicalactivitybymaintainingstreetsthatarepedestrianandcyclistfriendly.
3.2 ObjectivesfortheRegionalCentreParkingArea
ToensuretheprimacyofBunbury’sRegionalCentreZone,asthecentralbusinessdistrict(CBD),landuse

anddevelopmentistoachievethefollowingoutcomesforaccess,parkingandpublictransportintegrationin the Regional Centre Parking Area -
(a) planningfortheRegionalCentreZoneneedstoensuretheefficient,convenient,safeandequitablemovementofpeople,goodsandservices;
(b) publictransportshouldbepromotedthroughouttheRegionalCentreZonetofacilitatepark-and-rideoptionsandtoencourageshortrunpatronageinpreferencetothemotorcar;
(c) strategicpublicparkingstationsshouldbeestablishedandprotectedinthenorthern,centralandsouthernsectorsoftheRegionalCentreZone;
(d) expansionofpublicparkingareasmustbebasedonacomprehensiveparkingdemandassessmentandextendedcost/benefitanalysisthatincludeconsiderationofeconomic,social/culturalandenvironmentalmatters;
(e) managementofparkingthatincludesplanning,construction,maintenanceandregulationistobeadedicatedareaofthelocalgovernment’soperations,withappropriateresourceallocationsthatarereviewedannually;and
(f) developercontributionstotheprovisionofparkingneedtobebasedonstandardsthatareregularlyreviewedandlinkedtootherobjectivesthatpromotedevelopment,improveamenity,conserveheritage,promotepedestrianandcyclemovementsandcaterparticularlyfortheneedsofpeoplewithadisability,agedpersonsandchildren.
4 ExemptionsfromDevelopmentApproval ExceptwhereprovidedforwithintheprovisionsoftheR-Codesandsubjecttocompliancewiththerelevant
developmentrequirementsandstandardsoftheScheme,therearenootherexemptionsorexclusionspermittedundertheSchemewithrespecttoaccessandparkingforpedestrians,bicyclesandvehicles.
5 LandUseandDevelopmentRequirements5.1 GeneralLandUseandDevelopmentRequirementsforAccessandParking
5.1.1 Parkingbaysareclearlydelineatedonsitebytheuseofappropriatemeans,suchaskerbing,landscaping,signageandlinemarking.
5.1.2 Thedimensionsofvehicleparkingbaysandaislesandthedesign,materialsandconstructionof off-streetparkingbays/areas,accessways,driveways,crossovers,loadingbaysandpick-up/ set-downareasistobeinaccordancewiththefollowingAustralianStandards(asamended)–
(a) AS2890.1ParkingFacilities-Part1:Off-streetCarParking;
(b) AS2890.2ParkingFacilities-Part2:Off-streetCommercialVehicleFacilities;
(c) AS2890.3ParkingFacilities-Part3:BicycleParkingFacilities;
(d) AS2890.5ParkingFacilities-Part5:On-streetParking;
(e) AS2890.6ParkingFacilities-Part6:Off-StreetParkingforPeoplewithDisabilities;and
(f) thelocalgovernment’sstandardconditions(drawings)forallcrossovertypes.
Notes: 1. Table 1 below sets out typically preferred minimum design requirements for off-street parking areas as rated in Figure 1 for information purposes only.

2. Subject to approval by the local government, standard variations to the desired car parking bay dimensions may include –
(a) Bays situated adjacent to walls or other obstructions that affect door opening, should be increased in width by 0.3 metres on the side of the obstruction.
(b) The length of parallel parking bays may be reduced to 5.5 metres for end bays where free access is available.
(c) The length of right angle parking bays may be reduced to 4.8 metres where vehicle overhang over a footway is allowed for. Where the vehicle may overhang the end of a bay, the footway should be widened by an additional 0.6 metres.
(d) Where access aisles intersect, adequate truncations shall be provided to facilitate the simultaneous movement of vehicles to and from the access aisles – 85 percent (85%) to vehicle swept path with 300mm clearances each side (refer to AS2890.1).

3. Additional guidance on parking standards is provided, where relevant, within the provisions of each zone.
5.1.3 Allsealedpedestrianandsharedpathsaredesignedandconstructedofappropriatematerialswithgradientstopermitall-ableaccessibilityandmobilityinaccordancewithAustralianStandardsAS1428(Set)DesignforAccessandMobilitySet,asapplicable,andspecificallyAS1428.1DesignforAccessandMobility-GeneralRequirementsforAccess-NewBuildingWork(asamended).
5.2 VehicleParkingDemandandAvailability
5.2.1 ParkingprovisionshallbebasedonanassessmentofparkingdemandthatidentifiestheeighthhighestshoppinghouroverthecourseofoneyearintheRegionalCentreParkingArea.
5.2.2 Applicationsfordevelopmentapprovalfora'medicalcentre'thatincorporatefloorspaceusedforthetreatmentofpatientsinadditiontothatdedicatedforthepurposesofconsultingroom(s)usedby

healthpractitioner(s)shallbeaccompaniedbyatrafficimpactassessmentpreparedinaccordancewithclause11.4ofthislocalplanningpolicyandclause67‘Matterstobeconsideredbylocalgovernment’of‘Part9–Procedurefordealingwithapplicationsfordevelopmentapproval’of‘Schedule2—Deemedprovisionsforlocalplanningschemes’underthePlanning and Development (Local Planning Schemes) Regulations 2015.
5.2.3 SubjecttotheSchemeandthesatisfactionofthelocalgovernment,theadditionalnumberofcarparkingbaysrequiredfora'medicalcentre'thatincorporatesfloorspaceusedforthetreatmentofpatientsinadditiontothatdedicatedforconsultingroom(s)usedbyhealthpractitioner(s)shallbecalculatedonthebasisof1bayper20squaremetresofgla.
Note: Car parking bays for employees other than for health practitioners is accounted for within the minimum car parking requirements of the Car Parking Table under the Scheme.
5.3 UnitsofMeasurement
Theunitsofmeasurementforcalculatingthenumberofrequiredparkingbaysshallbeinterpretedas follows-
(a) whentheunitofmeasurementisbasedonthenumberofemployees,theshiftoremploymentperiodduringwhichthegreatestnumberofemployeesarepresentatthepremisesshallbeusedinthecomputation;
(b) whentheunitofmeasurementisbasedonthe'grossleasablearea'themeaningofgrossleasablearea(gla)isasdefinedunderSection12ofthislocalplanningpolicy,andshallapplyfordeterminingthe required number of parking bays;
(c) whentheunitofmeasurementisbasedonthe'netlettablearea'themeaningofnetlettablearea (nla)isasdefinedundertheScheme,andshallapplyfordeterminingtherequirednumberofparkingbays; and
(d) whentheunitofmeasurementisbasedonthe'grossfloorarea'themeaningofgrossfloorarea(gfa)isasdefinedunderSection12thislocalplanningpolicy,andshallapplyfordeterminingtherequirednumberofparkingbays.
5.4 VehicleParkingTables
5.4.1 Parkingshallbeprovidedon-siteincompliancewiththeminimumnumberofbaysprescribedinthevehicleparkingtables(CarParkingTable)undertheSchemeand/orthislocalplanningpolicy(CarParkingTableforSpecificUses,ServiceVehicleParkingTableandBicycleParkingTable),accordingtotheuseofthelandandthescaleofdevelopment.
5.4.2 WherethenumberofparkingbayscalculatedforadevelopmentoruseinaccordancewiththeprovisionsoftheSchemeand/orthislocalplanningpolicyisnotawholenumber,thenumberofparkingbaysrequiredmustbethenexthighestwholenumber.
5.4.3 Wheremorethanoneuseispermittedonalot/developmentsite,thetotalnumberofparkingbaysisdeterminedbytheaccumulatednumberofbaysrequiredforeachpermitteduseasaproportionofthetotalareaofthelot/developmentsite.
5.4.4 Notwithstandingclause5.4.3,wheremorethanonetenancyisproposed/existsonalot/developmentsite,the total number of parking bays is determined by the accumulated number of bays required for each tenancyasaproportionofthetotalareaofapermitteduseonthelot/developmentsite.
Note: The following diagrams in Figure 2 below illustrates the relationship between land use and ground floor area in the calculation of car parking provision.

5.4.5 WhereauseclassisnotspecifiedintheCarParkingTable,thelocalgovernmentshalldeterminethenumberofparkingbaystobeprovidedhavingdueregardtoCarParkingTableforSpecificUsesofthislocalplanningpolicy, clause67‘Matterstobeconsideredbylocalgovernment’of‘Part9–Procedurefordealingwithapplicationsfordevelopmentapproval’of‘Schedule2—Deemedprovisionsforlocalplanningschemes’underthePlanning and Development (Local Planning Schemes) Regulations 2015,thenatureoftheproposeduse/development,thenumberofpersonslikelytooccupyorbeaccommodatedwithinthepremises,maintenanceofroadsafetyandtrafficmanagement,andtheamenityofthearea.
CarParkingTableforSpecificUsesInterpretationandapplicationoftheCarParkingTableforSpecificUsesshallbeinaccordancewith the following -

2. The'SpecificUses'listedincolumn2oftheCarParkingTableforSpecificUsesarethoseusesnotdefinedintheScheme,butwhicharedeterminedasfallingwithinthespecifieduseclasscategoryandwhicharedefinedinSection12ofthislocalplanningpolicy.
3. Foreachuseclassorspecificuselistedincolumns1and2oftheCarParkingTableforSpecificUses,theminimumnumberofparkingbaystobeprovidedislistedincolumn3.
4. Thelocationandhierarchyofactivitycentresisasprescribedbytherelevantstateplanningpolicy,localplanningstrategyand/orlocalplanningpolicyadoptedbythelocalgovernmentandendorsedbytheWesternAustralianPlanningCommission(WAPC).

5.5 ExistingVehicleParkingAreas
5.5.1 Allexistingprivateandpubliccarparkingareasaretoberetainedandmanagedinawaythatensuresappropriateaccess,signage,drainage,surfaces,landscaping(whereapplicable),lightingandsurveillance.MonitoringandreportingontheadequacyandconditionoftheparkingassetsintheRegionalCentreParkingAreashallbeundertakenonaregularbasisorasrequired.
5.5.2 Wherechangestoexistingparkingareasareproposedthatresultinthelossofparking,thenacomprehensivetrafficimpactassessmentmustbepreparedforthelocalgovernment’sconsiderationthataddressestheimplicationsandramificationsofsuchchangesontheoverallprovisionofparkingintheRegionalCentreParkingArea,andassociatedcosts(ifany)tothelocalgovernment.
5.6 ExistingDevelopment(aspartofaNewDevelopmentorChangeofUse)
5.6.1 Whereachangeofuseoccursonpartofalot/developmentsite,inadditiontoanexistingpermitteduseandassociatedbuilding(s),theadditionalparkingbaystomeettherequirementsofthenewuseshallbeprovidedinrespectoftheareasubjecttothechangeofuseonly,providedthat–
(a) thereisadequateprovisionofon-streetand/oroff-streetparkingbaysservicingtheexistinguse/developmentandanyexistingareaofparkingisnotreduced,orifdisturbed,anyexistingparkingbaysarereplacedinthenewdevelopment;and
(b) thetotalareaoftheuse/developmentremainsthesame.
Note: In circumstances where there is a proposed new use on a floor of an existing building, the determination of the need for additional parking requirements will only apply to the floor that is the subject of the change of use.
5.6.2 Whereanexistingpermitteduseandassociatedbuilding(s)onalot/developmentsiteisenlargedorintensified,suchasconstructionofanadditionalbuildingoranextensionofanexistingbuilding,additionalparkingbaystomeettherequirementsofthenewdevelopmentshallbeprovidedinrespectoftheadditionalbuildingorextensionoftheexistingbuildingonly,providedthat–
(a) thereisadequateprovisionofon-streetand/oroff-streetparkingbaysservicingtheexistinguse/developmentandanyexistingareaofparkingisnotreduced,orifdisturbed,anyexistingparkingbaysarereplacedinthenewdevelopment;and
(b) theuseofthelandremainsthesame.
5.7 NewDevelopmentorChangeofUse(overallBuilding)
5.7.1 SubjecttotheSchemeandthislocalplanningpolicy,carparkingbaysshallbeprovidedinrelationtoanyuseordevelopmentasoff-street,andsubjectfurthertotheprovisionsofsection7ofthislocalplanningpolicy,shallbeprovidedonthelandonwhichthedevelopmentisproposed.On-street(or‘kerbside’)parkingmaybeapprovedbythelocalgovernmentinaccordancewithprovisionsofsection5.14ofthislocalplanningpolicy.
5.7.2 Subjecttolocalgovernmentapproval,wherethereisadeficiencyinthenumberofvehicleparkingbaysprovidedtoserviceapremises,off-siteparkingshallbeprovidedinaccordancewithsection7ofthislocalplanningpolicy;wherebyparkingbaysforause/developmentonalot/developmentsitemaybeprovidedjointlywithanyoneormoreotherpremises,subjecttothesatisfactionofthelocalgovernmentandinaccordancewiththestandardsandrequirementsoftheSchemeandthislocalplanningpolicy.
5.7.3 Nobuildingorlandthesubjectofanapplicationfordevelopmentapprovaltocommencedevelopmentshall

beoccupieduntilallrequiredparkingandloadingfacilitieshavebeenprovidedtothesatisfactionofthelocalgovernment.
5.7.4 WhentheuseofanypremisesischangedtoauseclassthatundertheSchemerequiresagreaternumberofparkingbays,additionalparkingbaysshall,unlessotherwiseapprovedbythelocalgovernment,beprovidedtomeettherequirementsofthenewuse.
5.7.5 Anyoff-streetparkingorloadingfacilitywhichispermittedbutnotrequiredbytheScheme,shallcomplywiththeSchemeandthislocalplanningpolicywithrespecttothelocation,design,constructionandoperationofsuchfacilities.
5.7.6 Parkingbaysshallremainaccessibleandbeusedsolelyforthepurposeofparkingvehiclesatalltimes,andshall not be used for the storage of -
(a) unregisteredvehicles;or
(b) recreationalvehicles;or
(c) commercialvehicles,trucksortrailers(unlesstheparkingfacilitiesusedtostoresuchcommercialvehiclestrucksortrailersareinexcessoftheminimumrequirement);or
(d) vehiclesunderrepair;or
(e) binsorwastematerials;or
(f) anyothergoodsormaterialsfordisplayorsale.
5.7.7 Wherelandissetasideasanoff-streetparkingarea,nobuildingsorstructuresshallbeerected,placedorallowedtoremainonsuchlandunlesstheyhavereceivedrelevantdevelopmentapprovalandaresolelytoaccommodateparkedvehicles.Ifpartofaparkingareaisnotimmediatelyrequiredforparking,thelocalgovernmentmayapproveitsusetemporarilyforopenstorage,lawnsandgardensortradedisplayprovidedthatsuchusedoesnotcontraveneanyotherprovisionoftheScheme.
5.8 VehicleParkingforPeoplewithaDisability
5.8.1 Provisionfordisabledparkingshallbeassessedtakingintoaccounttheproposedlanduse,grosslettablearea,lotarea,locationandthespecificneedsoftheintendedoccupants/users.TheoverallamountofcarparkingbaysthatmustbeallocatedtodisabledparkingshallbeinaccordancewithAustralianStandardsAS2890.1ParkingFacilities-Part1:Off-streetCarParkingandAS2890.6ParkingFacilities-Part6:Off-StreetParkingforPeoplewithDisabilities.Asaminimum,twopercent(2%)oftheoverallamountofcarparkingbaysforretail/commerciallandusesmustbeallocatedtodisabledparking.
5.8.2 Thelocalgovernmentmayrequireanincreaseintheoverallprovisionandlevelofdisabledparkingfacilitiesforaparticulardevelopmentifthelocalgovernmentdeterminesthatsucharequirementwouldbejustifiedtoaddresstherequiredlevelofservice.
5.8.3 DisabledcarparkingbaysshallbedesignedinaccordancewithAustralianStandardsAS2890.1ParkingFacilities-Part1:Off-streetCarParking,AS2890.6ParkingFacilities-Part6:Off-StreetParkingforPeoplewithDisabilities,AS1428.1DesignforAccessandMobility,andanyotherrelevantstandardadoptedbythelocalgovernment.
5.9 CulturalHeritage
Whereaproposeddevelopment,redevelopment,orchangeofuseinvolvesaheritagearea,placeorbuilding (as established by inclusion on the State Register of Heritage Places or the Heritage List under the Scheme),thelocalgovernmentmaynotrequireadditionalparkingtothatwhichiscurrentlyprovided,subjecttotheheritagevaluesoftheheritagearea,placeorbuildingbeingconservedtothesatisfactionofthelocalgovernment.

5.10 FloorspaceDiscretionaryThresholds(withinRegionalCentreZone)
5.10.1 SubjecttotheSchemeandsection6ofthislocalplanningpolicy,thecarparkingrequirementmay,atthediscretionofthelocalgovernment,bereducediftheoveralltotalgrossfloorarea(gfa),includingexistingpremises/buildings,ofaproposednewdevelopment,extensionorchangeofuseonalotislessthan2,000m2withinthe'RegionalCentreZone'.
5.10.2 SubjecttotheSchemeandsection6ofthislocalplanningpolicy,theprovisionofcarparkingbayswithinthe'RegionalCentreZone'maybevariedaccordingtothefollowinggrossfloorareathresholdswherethelocalgovernmenthasexerciseditsdiscretioningrantingdevelopmentapproval-
(a) development/useoflessthan500m2gfaonalot,shallnotrequireparkingtobeprovidedonsite(i.e.100%concession);
(b) development/useofbetween500m2and1,000m2gfaonalot,theconcessionmaybetoamaximumof50%;
(c) development/useofbetween1,000m2and1,500m2gfaonalot,theconcessionmaybeuptoamaximumof33%;and
(d) development/useofbetween1,500m2and2,000m2gfaonalot,theconcessionmaybeuptoamaximumof25%.
5.10.3Whereaproposeddevelopment/usewithinthe'RegionalCentreZone'hasaminorvariationthatwouldexceedathresholdthatsubstantiallyreducestheconcession(e.g.501m2gfa),thelocalgovernmentmayexerciseitsdiscretioningrantingdevelopmentapprovalwithamaximumvariationofuptofivepercent(5%).
5.11 MixedUseDiscretionaryThreshold
Subjecttothelocalgovernmentexercisingitsdiscretioningrantingdevelopmentapproval,wheregreaterthan50percent(50%)ofthegrossfloorareaofapremisesisusedforresidentialpurposes,andwherethebalanceofthegrossfloorareaisusedpredominantlybetweenthehoursof9.00a.m.and5.00p.m.,thetotalnumberofcarparkingbaysrequiredtobeprovidedundertheCarParkingTableoftheSchememaybereducedbyuptoamaximumof25percent(25%).
5.12 AppropriateDistanceCriteriatoOff-siteVehicleParkingAreas
5.12.1 Subjecttothelocalgovernmentexercisingitsdiscretioningrantingdevelopmentapproval,premisesutilisedforanofficeorcommercialusewithnopublicaccesspermitteddonotrequireoff-streetcarparkingtobelocatedwithintheboundariesoftheuse/premises.Insuchcircumstances,anappropriateoff-streetcarparkingfacilitymaybelocateduptoamaximumof250metresawayfromtheuse/premises.
5.12.2 Subjecttothelocalgovernmentexercisingitsdiscretioningrantingdevelopmentapproval,premisesutilisedforaretail,officeorcommercialusewithpublicaccesspermittedmaybelocateduptoamaximumof100metresawayfromanappropriateareaforacarparkingfacility.
5.12.3 Subjecttothelocalgovernmentexercisingitsdiscretioningrantingdevelopmentapproval,premisesthatoperateoutofnormaltradinghours(i.e.after6pm,suchashotel,nightclub,restaurant,tavern,theatre,oranyotheruseasdeterminedbythelocalgovernment)maybelocateduptoamaximumof200metresawayfromanappropriateareaforacarparkingfacility.Subjecttothediscretionofthelocalgovernment,the appropriate area for a car parking facility may be located at a greater distance than 200 metres from the use/developmentsitewhereamenity,securityandsafetyissuesareadequatelyaddressed.
5.12.4 Theprovisionsofclause5.12.1to5.12.3donotaffecttherequirementforlandowners/developerstoprovideadequateoff-streetdisabledcarparkingwithintheboundariesoftheuse/premises.

5.13 AlternativeTransportModes
5.13.1 Forause/developmentgreaterthan3,000m2ingfa,thelocalgovernmentmayexerciseitsdiscretioningrantingdevelopmentapprovalbyreducingthecarparkingrequirementbyupto10percent(10%)wherethedevelopmentprovidesforapracticableandconvenientalternativetransportmodetotheprivatemotorvehicle.Considerationshallbegiven,butnotbelimitedto,busparkingandaccessforpeopleorgroupswithspecialneedsandbicyclestorageandaccesstothesatisfactionofthelocalgovernment.
5.13.2 Aconcessioninrespectofcarparkingrequirementsunderclause5.13.1shouldnotbegrantedinrespectofalanduseordevelopmentthatisalsosubjecttoanyotherrelaxationofcarparkingprovisionorstandardundertheSchemeorthislocalplanningpolicy.
5.14 On-StreetVehicleParking
5.14.1 Thelocalgovernmentmaygrantdevelopmentapprovalforthedevelopmentanduseofparkingbays/areaswithinaroadreserve(ontheroadverge),subjectto-
(a) ThesubmissionofatrafficimpactassessmentreportthatistobesubmittedforassessmentaspartofanapplicationfordevelopmentapprovalinaccordancewithSection11ofthislocalplanningpolicy.
(b) Theon-streetparkingbay/areadevelopmentmakingasubstantiveimprovementtotheamenityofthelocality,asdeterminedbythelocalgovernment.
(c) Thefollowingitemsshallbeconstructedorupgraded,asdeterminedbythelocalgovernment,aspartofanapplicationforon-streetparking-
(i) landscapingasrequired;
(ii) streetlightingasrequired;
(iii) drainageasrequired;
(iv) trafficmanagementinfrastructureitemsasrequired;
(v) signageandlinemarkingasrequired;
(vi) disabledparkingbaysasrequired;and
(vii)pedestrianpathwayconnectingtothemunicipalpathwaynetworkforthefullfrontageoftheproperty,orwherethereisanexistingslabpath,thepathwayshallbeupgradedtoaconcretepath.
5.14.2 Arequirementforon-streetparkingistobeadditionaltoanyapplicablerequirementfortheprovisionofoff-streetand/oron-siteparkingofalldevelopmentand/oruseofland.
5.14.3 Thelocalgovernmentmayatitsdiscretionremoveon-streetparkingbaysatalaterdateifrequiredforanyreason.
5.14.4 On-streetparkingbays/areasaretobeavailableforthegeneralpublic’suseatalltimes.Theapplicantmaynotrestrictaccesstooruseoftheparkingbay/areainanyway.
5.14.5 On-streetparkingshallbewhollycontainedwithintheroadreserveinaccordancewithdimensionsspecifiedbythedevelopmentstandardsandrequirementsofthislocalplanningpolicy.
5.14.6 On-streetparkingbays/areasaretobedesignedandconstructedtothesatisfactionofthelocalgovernmentinaccordancewiththefollowing(asamended)-
(a) AustroadsGuidetoTrafficManagementPart11-Parking;

(b) AustralianStandardAS2890.5ParkingFacilities-Part5:On-streetParking;and
(c) thelocalgovernment’sroadworksconstructionspecifications.
5.14.7 On-streetparkingbays/areasshallbesealed,kerbed,drainedandfinishedinasphaltorbrickpavingtothesatisfactionofthelocalgovernment.Thedesignofon-streetparkingbays/areasshallrequireengineeringcertificationpriortothecommencementofconstructionandoperation.
5.14.8 Theapplicationistobemadeintheformofanapplicationfordevelopmentapprovalinaccordancewithclause67oftheDeemedProvisionsofthePlanning and Development (Local Planning Schemes) Regulations 2015.
5.14.9 SubjecttotheScheme,allapplicationsforcarparkingbays/areaswithinroadreservesshallbeadvertisedinaccordancewithclause64‘Advertisingapplications’of‘Part8–Applicationsfordevelopmentapproval’of‘Schedule2—Deemedprovisionsforlocalplanningschemes’underthe Planning and Development (Local Planning Schemes) Regulations 2015andtherequirementsofsection3.51oftheLocal Government Act 1995.
5.14.10Theapplicantshallpayanapplicationfee,asdeterminedbythelocalgovernment,tocovertheadministration,assessment/approvalandinspectionsofworks.Thefeeshallbepaidpriortotheissuingofanydevelopmentapproval.Theapplicantshallmeetallcostsfordesign,assessment/approval,constructionandmaintenanceoftheon-streetparkingfacility.
5.15 VergeCrossovers
5.15.1 Alldevelopments/usesrequiringvehicleaccesstothelot/premisesshallhaveaconstructedvergecrossovertoaminimumstandardasprescribedbythelocalgovernment’sstandardconditions,drawingsandspecificationsforconcrete,brickpavedandasphaltdrivewaysrespectively.Alternativematerialsmaybeusedfortheconstructionofvehiclecrossoverssubjecttotheapprovalofthelocalgovernment.
5.15.2 Vergecrossoversaretobeapprovedandconstructedpriortooccupancyofpremisestothesatisfactionofthelocalgovernment.
5.15.3 Thelocalgovernmentmaybearonehalfofthecostofastandardvergecrossover,subjecttothecrossoverbeing -
(a) thefirstconstructedtothatlot;and
(b) located,designedandconstructedtothesatisfactionofthelocalgovernmentinaccordancewithitsstandardconditions,drawingsandspecifications.

5.15.4 Thelocalgovernmentmayrefusetopermitmorethanonevehicleentranceorexittoorfromanylot,mayrequireseparateentrancesandexits,andmayrequirethatentrancesandexitsbeplacedinpositionsnominatedbythelocalgovernment,ifitconsiderssuchprovisionnecessaryordesirabletoavoidortoreducetraffichazards,orotherwisetoassistinplanningforvehiculartraffic.

6 CashContributionInLieuOfProvidingParking Bays6.1 SubjecttotheSchemeandtheprovisionsofthislocalplanningpolicy,thelocalgovernmentmayrequirean
applicantseekingdevelopmentapprovaltoprovide,ormayotherwiseagreetoaccept,acashcontributioninlieuoftheprovisionofaproportionofthetotalnumberofcarparkingbaysrequiredundertheSchemeinaccordancewithfollowingrequirements-
(a) Acashinlieucontributionforcarparkingshallonlybeconsideredinlocationswhere-
(i) thelocalgovernmenthasplannedtoprovideapubliccarparkthatmayadequatelyservicetheparkingdemandsofboththegeneralpublicandtheproposeduse/development;and/or
(ii) apubliccarparkexists(includingthedeckingofanexistingcarparkingarea)thatmayadequatelyservicetheparkingdemandsofboththegeneralpublicandtheproposeduse/development;and
(iii) theproposeddevelopment/useissituatedinthelocalityofaplannedorexistingpubliccarparkinaccordancewiththerequirementsoftheAppropriateDistanceCriteriatoOff-siteCarParkingAreasunderclause5.12ofthislocalplanningpolicy.
(b) Thecashinlieucontributionbeinginaccordancewiththelocalgovernment’sadoptedScheduleofFeesandChargesfortherelevantdesignatedarea,orwherenototherwisespecifiedisnotlessthanthesumtotalofthefollowing:
(i) Thefairmarketvalueofthecarparkingbayarea,asdeterminedbytheValuerGeneral.Inadditiontotheparkingbayitself,theparkingbayareaincludestheturningarearequiredforeach bay (30 m2perbay),andmayincludeadditionalareasrequiredforaccess,manoeuvringandlandscaping,asdeterminedinaccordancewiththeprovisionsoftheSchemeandanyrelevantlocalplanningpolicy.
(ii) Theestimatedcostofprovidingandconstructingthecarparkingbayareaforthenumberofbaysapprovedforthemakingofacashinlieucontribution,eithergroundordeckedparking,asdeterminedbylocalgovernment.
(iii) Allcostsincurredinobtainingthevaluationtobebornebytheapplicantfordevelopmentapproval.
Note: Cash in lieu for parking is an item of the Schedule of Fees and Charges, as amended from time to time, adopted under the City of Bunbury’s Annual Budget pursuant to the Local Government Act 1995. The cash in lieu contribution rate specified in the local government’s adopted Schedule of Fees and Charges applies within the relevant designated area (e.g. Regional Centre Parking Area).
(c) Thecostofprovidingandconstructingpavedcarparkingbaysmayinclude,butnotbelimitedto-
(i) thecostofconstruction,sealing,drainingandcurbing,linemarking,landscaping,fencing,signage,illuminationandpathwaystothespecificationsandsatisfactionofthelocalgovernment;and
(ii) unlessotherwisedeterminedbythelocalgovernment,shallalsoincludeanyothermattersrelevanttoparkinginthelocalityasdeterminedbythelocalgovernment.
(d) Acashinlieucontributionforcarparkingreceivedbythelocalgovernmentshallbepaidintoatrustfundandshallonlybeusedfortheacquisitionand/ordevelopmentoflandasapubliccarparkinthelocalityofthelandthesubjectofthedevelopmentproposal,ortoreimbursethelocalgovernmentanyexpensesithasincurredinrespectthereofincludingloanrepayments.Theparkingbaysprovidedasaresultofcashinlieucontributionsshallremainavailabletothepublic,beadministeredbythelocal

governmentandmaybesubjecttosuchfeestructureasthelocalgovernmentfromtimetotimemayadopt.
(e) Thelocalgovernmentmay,priortoacceptingacashinlieucontributionforcarparking,adoptaprogrammetoacquireanddeveloplandasapubliccarpark(includingdeckingofanexistingpubliccarpark)inaccordancewithclause6.1(d)above.
(f) Thelocalgovernmentmay,priortoacceptingacashinlieucontributionforcarparking,adoptalocalplanningpolicydesignatingareaswithinwhichitwillgiveconsiderationtorequiringoracceptingacashinlieucontributionforcarparkingbays.
6.2 Subjecttotheagreementofthelocalgovernment,acashcontributioninlieuofcarparkingmaybepermittedtoamaximumof-
(a) 100%oftheoverallon-siteparkingrequirementsforadevelopment/usewithagfaofupto2,000m2; and
(b) 50%oftheoverallon-siteparkingrequirementsforadevelopment/usewithagfaofgreaterthan2,000m2,
subjecttotheproposalmeetingtherequirementsoftheAppropriateDistanceCriteriatoOff-siteCarParkingAreasunderclause5.12ofthislocalplanningpolicy.
6.3 SubjecttotheSchemeandtheprovisionsofthislocalplanningpolicy,thelocalgovernmentmayagreetoacceptacashcontributioninlieuoftheprovisionofaproportionofthetotalnumberofcarparkingbaysrequiredundertheSchemeason-streetparkingbaysconstructedtothelocalgovernment’sspecificationsandsatisfaction,inlocationswherethelocalgovernmenthasnotprovidedorisnotintendingtoprovideapubliccarpark(includingdeckingofanexistingpubliccarpark),orwhereapubliccarparkexiststhatinadequatelyservicesparkingdemandsofboththegeneralpublicandtheproposeddevelopment.
Subjecttotheagreementofthelocalgovernment,acashinlieucontributionmaybemadeeither-
(a) asaoneoffcashpaymentofthetotallumpsummadetothelocalgovernment;or
(b) asstagedlumpsumpaymentstothelocalgovernment;or
(c) asanagreedannualfixedratecontributionmadetothelocalgovernment;or
(d) asacombinationof(b)and(c)above.
7 ReciprocalParking(Private)andSharedParking (LocalGovernment)7.1 SubjecttotheSchemeandtheprovisionsofthislocalplanningpolicy,wherethereisadeficiencyinthe
numberofparkingbaysprovidedtoserveadevelopment/use,thelocalgovernmentmayexerciseitsdiscretioningrantingdevelopmentapprovaltopermittheparkingbaysforthatdevelopment/usetobeprovidedjointlywithanyoneormoreotherpremises,subjecttotheapplicantprovidingevidencetothesatisfactionofthelocalgovernmentthat-
(a) reciprocalorsharedoff-streetparkingfacilitiesareavailableinappropriateareas,asdefinedinclause5.12,toaccommodatethedeficitincarparkingrequiredundertheSchemeforthedevelopment/use;and/or
(b) thepeakhoursofoperationofdevelopments/usessosharingaredifferentanddonotsubstantiallyoverlap,whetherornotthepremisesprovidingreciprocatingcarparkingseparatelyhavetheprescribed number of parking bays; and

(c) thatalegalagreementhasbeenmadetoenablethosereciprocalorsharedoff-streetparkingfacilitiestobeusedforthatpurpose.Whereareciprocalorsharedparkingarrangementisproposedaspartofanapplicationfordevelopmentapproval,thewrittenconsentofthepropertyownerofthereciprocalorsharedparkingfacilitymustbeintheformofalegallybindingagreementbetweenbothpartiesthatispreparedtothesatisfactionofthelocalgovernment,andattheapplicant’sowncost.
7.2 Anapplicationfordevelopmentapprovalforadevelopment/usethatproposesareciprocalorsharedparkingarrangementshallcomplywiththefollowingrequirements-
(a) sufficientevidenceshallbeprovidedtosatisfythelocalgovernmentthatnosubstantialconflictwillexistinthepeakhoursoroperationofthedevelopments/usesforwhichthejointuseofparkingbaysorthereciprocalaccessandcirculationarrangementsisproposed;and
(b) anagreementistobepreparedbyasolicitortothesatisfactionofthelocalgovernmentandattheexpenseoftheapplicantseekingtotakeadvantageoftheprovisionsforreciprocalorsharedparkingarrangementunderthislocalplanningpolicy,detailingtherelevantissuesofthejointusage,andexecutedbyallpartiesconcerned.
7.3 Anysuchagreementmay,atthediscretionofthelocalgovernment,beintheformof–
(a) astrataoperatingasaneasement;or
(b) strataby-law;or
(c) aneasement;or
(d) aneasementingross;and/or
(e) arestrictivecovenant,
againstanylandprovidingparkingbays,reciprocalaccessorcirculationarrangementsandshallensurethatwheretheeasementorrestrictionismadeexpresslyinfavourofanadjacentlandownerotherthanthelocalgovernment,thattherestraintcannotberemovedwithouttheconsentofthelocalgovernment,uponthelocalgovernmentbeingsatisfiedthatthejointuseofparkingfacilitiesisnolongerrequired.
7.4 Subjecttothelocalgovernmentexercisingitsdiscretioningrantingdevelopmentapproval,reciprocalorsharedcarparkingarrangementsforadevelopment/usemaybeprovided-
(a) byoneowneroruserinrespectofseparatepremisesinappropriateareas;or
(b) jointlybytwoormoreownersorusersofapremises,
subjecttotheproposalmeetingtherequirementsoftheAppropriateDistanceCriteriatoOff-siteCarParkingAreasunderclause5.12ofthislocalplanningpolicy.
Note: Figures 3 and 4 give examples of how different reciprocal car parking arrangements may be applied.
7.5 Wherereciprocalcarparkingarrangementsareproposedaspartofanapplicationfordevelopmentapprovalinaccordancewithclauses7.1and7.2,thelocalgovernmentmayrequireatrafficimpactassessmenttobepreparedandsubmittedinaccordancewithsection11ofthislocalplanningpolicyforassessmentaspartofanapplicationfordevelopmentapproval.

8 On-StreetVehicleParkingManagementand Pricing8.1 On-streetparking(or‘kerbside’)parkingbaysshallbeallocatedinthefollowingorderofpriority-
(a) buszones,loadingandunloadingzonesandtaxistands;
(b) specialpurposesincludingpeoplewithadisability,bicyclestorageandstreetscaping;and
(c) privatecarsandmotorcycles.
8.2 On-streetmeteredcarparkingshallbeintroducedinareasdeterminedbythelocalgovernment,andpriceincentivesprovidedformotoriststousedesignatedoff-streetparkingareasforlongerdurationparkingperiods.
8.3 Pricingforoff-streetparkingshallbesetatalevelthatensuresthatpublictransportissignificantlycheaperthantheprivatecarforaccessingtheRegionalCentreParkingArea.
9 Funding9.1 Fundingfortheplanning,managementanddevelopmentofparkinginfrastructureshallbethroughthe
SpecifiedAreaRate,feeschargesandfines,cashinlieuofparkingandGeneralRateRevenueintheshortterm(i.e.fiveyears).ThepercentageofrevenueallocatedtoparkingintheRegionalCentreZonefromtheSpecifiedAreaRateistoincreasetoadedicated50%perannumoverthisshorttermperiod.
9.2 ThelocalgovernmentshallannuallyreviewtheadequacyoftheSpecifiedAreaRatetosupporttheparkingpolicyanditmayconsideranincreaseabovethatwhichappliestotheGeneralRate.

• issympatheticwiththedesiredamenity and streetscape character of the local area; and
10.2.1.1 Allnon-residentialdevelopmentmustprovideforvehiculartraffictoenterandleavepremisesinaforwarddirection(gear).
10.2.2.1 On-siteparkingbaysandinternalcirculationareasfornon-residentialandmixedusedevelopmentinallapplicablezones–

10.3.2 Publictransportstops,vehicleparkingandpick-up/set-downareasmustallowfortheseparationofvehiclesandpe-destriansinordertoprovidesafeandcomfortablepedestrianaccessbetweenparking areas or public streets and main entrancewaysofindividualbuildings.

11VariationofDevelopmentRequirementsand Standards Developmentinaccordancewiththispolicyisdeemedtocomply.However,alternativedesignsolutions
maybeconsideredsubjecttodemonstrationthattheproposedlanduseand/ordevelopmentisinkeepingwiththeintentandobjectivesofthispolicytothesatisfactionofthelocalgovernment.
11.1 Thelocalgovernmentwillalsoconsiderthefollowing-
(a) theamenityofthesubjectsite,adjacentpropertiesandthesurroundinglocalarea;and
(b) theavailabilityandneedforadditionalvehicularparkingfacilitieswithinthelocalarea;and
(c) theefficiencyandfunctionalityofvehicularandpedestriantrafficmovementontheroadnetwork;and
(d) thesafetyofroadusersandpedestrians.
11.2 Inexercisinganydiscretionthelocalgovernmentshouldensurethatthevariationwillnotcontravenethefollowingprovisions-
(a) intent&objectivesofthislocalplanningpolicy;
(b) clause9TheAimsoftheScheme;
(c) clause16ZoneObjectives;and
(d) clause67‘Matterstobeconsideredbylocalgovernment’of‘Part9–Procedurefordealingwithapplicationsfordevelopmentapproval’of‘Schedule2—Deemedprovisionsforlocalplanningschemes’underthePlanning and Development (Local Planning Schemes) Regulations 2015.
11.3 Whereanapplicationproposesavariationtooneormoredeemed-to-complydevelopmentsolutionsorisrequiredundertheScheme,orisconsideredtohaveasignificantimpactontheexistingconditionsofalocality,thelocalgovernmentmayrequireatrafficimpactassessmentand/ortrafficstudytobesubmittedforassessmentaspartofanapplicationfordevelopmentapproval.Atrafficimpactassessmentistobepreparedtothespecificationsandsatisfactionofthelocalgovernment,andistobeundertakenbyanappropriatelyqualifiedpersonorbodyattheapplicant’sexpense.

(a) thelocationofthesubjectsiteandthespecificnatureoftheproposeddevelopmentandongoingoperationstobeundertaken,andallfacilitiesproposedtobeprovided;
(b) siteanalysisshowingthelocationofexistingandproposedbuildingsonthepremises,relationshiptoadjoiningandsurroundinguses,andthenatureofexistingandlikelydevelopmentinthevicinityofthesubjectlot/developmentsite;
(c) thehoursofoperationofthedevelopmentorusefornon-residentialuses;
(d) themaximumnumberofemployees/stafftobeengagedonthepremisesandtheirexpectedparkingdemand;andorthenumberofresidentialdwellingsandexpectedoccupancyrates;

11.4 Applicationsfordevelopmentapprovalinvolvingthedevelopmentanduseoflandforacarparkasthepredominantusemayrequirethesubmissionofatrafficimpactassessmentand/ortrafficstudytobepreparedbytheproponentaspartofanyapplication.
