November 11 marked the 98th anniversaryof Armistice, better known as Remem-

brance Day. On this occasion 3700 gathered atthe Australian War Memorial in thecapital city Canberra to remember themore than 102,000 Australians wholost their lives in wars and other oper-ations.

If you have recently undergone a sep-aration, estrangement from yourchildren or know of anyone who is

experiencing family conflict, take a mo-ment to consider this: does the law allowyou to make any kind of Will you wish?Can you leave a family member out ofyour will? Can the Court override yourintentions?In New South Wales, the answer is yes

on all fronts. For over 100 years, parliament has tried

to ensure that the laws of New SouthWales kept up with social attitudes to-wards the age old issue of whether or notindividuals should have complete free-dom to make any kind of Will they wish. In some European countries, the idea of

‘robbing’ your children of their rightfulinheritance and instead gifting your en-tire estate to a local charity is almost im-possible to execute, as their laws placegreat emphasise on the testator’s moralobligation to provide for family mem-bers and dependents. In New South Wales parliament has at-

tempted to strike a more even balancebetween an individual’s freedom to gifttheir assets in any manner they chooseand their moral obligations to their de-pendents, by limiting the extent andscope of their moral obligations with ref-erence to certain factors such as the fi-nancial needs of the person challengingthe Will.

Time frame for making a claim

An ‘eligible person’ may make an ap-plication for a Family Provision order atany time within twelve months after the

When will the Court make a Family Provision Order?

A Court may make a Family ProvisionOrder if the Court determines that the in-dividual seeking the order is firstly, an‘eligible person’ and secondly, has not re-ceived provision for the proper mainte-nance, education or advancement in lifeby the Will of the deceased.

What factors will the Court Consider?

Whether or not the scales will tip infavour of the estate or the person chal-

a) the relationship between the appli-cant and the deceased person;

b) the nature and extent of any obliga-tions or responsibilities owed by thedeceased person to the applicant;

c) the nature and size of the deceasedperson’s estate;

d) the financial resources (includingearning capacity) and financial needs(both present and future) of the appli-cant;

e) any physical, intellectual or mentaldisability of the applicant;

f) the age of the applicant;

g) any contribution (whether financialor otherwise) by the applicant to the ac-quisition, conservation and improve-ment of the property of the deceasedperson or to the welfare of the deceasedperson;

h) any provision made for the applicantby the deceased person;

i) any evidence of the testamentary in-tentions of the deceased person;

j) whether any other person is liable tosupport the applicant;

k) the character and conduct of the ap-plicant before and after the date of thedeath of the deceased person; and

l) any other matter the Court considersrelevant.

Virtu Ferries of Malta, which operates a va-riety of high-speed craft services through-out the Mediterranean and Adriatic has

chosen Australian shipbuilding Incat Tasmania todesign and build for it a 110-metre vehicle pas-senger (RoPax) ferry. The vessel is intended forVirtu Ferries’ year round lifeline service betweenMalta and European UnionAFLOAT magazine reported Robert Clifford, the

chairman of Incat saying that Virtu Ferries werelooking for increased reliability, sea keeping, pas-senger comfort, capacity and economy with lessoperational downtime, and that Inca were pleasedto welcome them to its family of shipowners.The new 110m wave-piercing catamaran will be-

come the 15th fast ferry Virtu has acquired. It willbe the largest high-speed catamaran in theMediterranean and with a service speed up to 38knots; it will complete the crossing from Malta toSicily, berth to berth, in around 90 minutes.For Virtu Ferries this new vessel provides a sig-

nificant increase in capacity offering 43% more truck capacity, 15%more passenger capacity and 7% more car capacity.

The vessel will incorporate a three-class interior (VIP, Businessand Economy) with a total of 1134 seats of which 996 seats are in-side and 138 outdoor.The design was extensively tank tested and optimised at QinetiQ,

the tank and aerospace testing facility in the UK that was purposebuilt for use by the British Navy and UK Ministry f Defence.

Virtu Ferries Chairman and owner Mr Francis Portelli said, “wesimply want to provide our passengers and freight operators with

the highest levels of service, reliability and comfort yet at the sametime operate an economical and environmentally sustainable highspeed service.”He went on to say,” We are confident that we will be delivered a

fantastic vessel suited not only to our requirements but the designis suited for many other island communities around the world.”

Construction of the vessel will commence early next year withdelivery scheduled at the end of 2018. Incat currently has a 500strong workforce at its Hobart shipyard and the yard is geared fordelivering up to two large HSC (High Speed Craft) per year.

The recurring theme duringthe 5th edition of the BOVAviation Outlook, the avia-

tion expo and unique platform forall players in the aviation industryin Malta held at Bank of Valletta’sHead Office in the presence ofMinister for Tourism Hon. Dr Ed-ward Zammit Lewis, was whetherMalta could become the Maldivesof the Mediterranean for seaplaneoperations.

Following the demise of Euro-pean Coastal Airlines in Croatia,the seaplane business in Europetook a battering with negative ef-fect on Nordic Seaplanes too. The BOV Avi-ation Outlook conference shed light on theinvaluable experience gained by the CivilAviation Directorate in the regulating andmonitoring of a seaplane operation.

BOV Chief Credit Business DevelopmentOfficer Albert Frendo said that over the re-cent years, Malta has witnessed growth in theaviation industry, attracting internationallyrenowned organisations to set up operationsin Malta, including maintenance, back officeset-ups, research and development and pro-duction of aircraft components/He went on to explain that recently aviation

in Malta has been under focus as part of theGovernment's strategy to promote Malta to

become a ‘one-off destination’ in the aviationindustry.

Meanwhile, Barry Lightening, an experi-enced Head of Flight Operations at a sea-plane company, highlighted what needs to bedone so that the burden on any prospectiveentrants in this line of business is alleviated,while aviation lawyer Dr Francesca Galea,spoke about the fiscal and legal requirementsand how the seaplane industry could helpboost the already well-established and fastexpanding marine industry. Peter Hermle, CEO at world renowned air-

craft manufacturer Dornier Seawings, andIng. Simon Schell presented their top sea-plane, the Dornier Seastar and delved into

how this aircraft can become thecentre of seaplane activity in Malta.

At the same event, PauloFigueiredo, a Portuguese aeronau-tical entrepreneur and owner of anew company Floatlook & Travel,launched his novel idea of combin-ing seaplanes and tourism. He ishoping to quickly expand into theMediterranean basin and has tar-geted Malta as its possible first baseoutside of Portugal. As is customary, the BOV Aviation

Outlook honoured a number of in-dustry leaders, who through theircontribution helped in no small way

to put Malta’s aviation industry on the worldmap. Captain Norman D’Amato, a veteran flyer

was presented with the BOV Aviator of theYear Award. Leader of the Year Award wentto Captain Joseph Agius, currently in the em-ploy of AirX but who has held senior posi-tions with the national carrier Air Malta andJet Magic and was one of the inspectors atthe Civil Aviation Directorate way back in2012.Charles Stafrace, who was instrumental in

setting up the Malta Aviation Society in the70s, was an active aviation journalist and re-searcher and authored a number of books, re-ceived the BOV Lifetime Achievement Award.

able, was one of the the first activitiesafter Reskeon’s Annual General Meet-ing that was held at Merrilands Com-munity Centre, Reservoir.

panying delegationmade a marathontour of seven Euro-pean capitals in fourdays to discuss withtheir leaders theagenda to be fol-lowed during Maltatakes over the EUPresidency in thefirst six months ofnext year.

The first leg of histour took him to Pariswhere he met French President Francois Hol-lande. The two discussed the situation in theMediterranean, the situations in Syria andLibya, and the future of Turkey; topics thetwo countries agreed must be given priorityduring the Maltese presidency.Later Dr Muscat said he had a very focused

and productive meeting with Hollande.From Paris he flew to Dublin for a meeting

and talks with Irish Prime Minister EndaKenny. Muscat said the two countries arepractical member states interested in find-ing solutions for Europe. Talks centred onBrexit, immigration, financial and the eco-nomic situation and governance

On the second day, PM Muscat flew toGermany for talks with the German Chan-cellor Angela Merkel who expressed satis-faction that Malta would be taking over thePresidency of the EU because it wouldshoulder this responsibility in an exemplarymanner. She said she looked forward to thisPresidency led by a country that had excel-lent bilateral relations with Germany.

Malta’s geographical position, she said,would help the Presidency place the mostimportant themes at the forefront of theagenda.

Ms Merkel said that Malta’s geographicalposition would help the Presidency placethe most important themes at the forefrontof the agenda.

Both leaders agreed that the immigrationchallenge was evolving daily particularlybecause of the situation in Turkey, Libya in-stability, and the Mediterranean route. Theyagreed on the need for dialogue, agreementwith stakeholders and the need for an equaldistribution of the immigration burden.

Joseph Muscat said was proud of what itwas doing and would continue to work inthe best way possible. He said Malta’swould be a pragmatic presidency and every-one should judge Malta on its work.

Next, the Maltese delegation went to Es-tonia and a meeting in Tallinn with PM JuriRatas who told Joseph Muscat that hiscountry, which takes over the Presidencyjust after Malta, looks at Malta as a modelin its preparations for the Presidency.Then followed a trip to the Polish capital,

Warsaw and a meeting with Prime Ministerof Beata Szydlo. Here the leaders’ maintopic of discussion was the challenges ofmigration. They also discussed the impactof Brexit and the related process.

Muscat said that such a meeting reflectedMalta’s attitude during the Presidency thatwill build on relations with countries thathave a different opinion. “It is useless tohope that everyone will always agree witheverything, so we have to build bridge be-tween all the different forces,” he said.

A few hours later Joseph Muscat was inDenmark where he met with the country’sPM Lokke Rasmussen. He said that it wassignificant how two countries such as Maltaand Denmark, which are geographically indifferent regions, have common positionson the themes that have been placed at thetop of the agenda during the Presidency ofthe EU Council.

Rasmussen expressed his satisfaction atMuscat’s visit and described the talks asbeing very important. He said he was look-ing forward to establish strong co-operationwith Malta.

Prime Minister Joseph Muscat’s last stopwas in Budapest where he met and had dis-cussions with Hungarian Prime MinisterVictor Orban.

German credit rating agency Cred-itreform Rating AG has assigned anA+ long-term sovereign rating to

Malta and described its outlook as stable.Creditreform, which forms part of the

worldwide operating Creditreform Groupand is considered as one of the leading rat-

ing agencies in Europe, said that the posi-tive sovereign rating was based on “Malta’shigh level of creditworthiness mainly basedon its strong macroeconomic performanceand strong fiscal sustainability.”

It highlighted the fact that Malta’s poten-tial growth is among the highest of all euroarea members, and that such dynamicgrowth, backed by a buoyant labour mar-ket, is supporting Malta’s income conver-gence towards the EU-28 average. It alsoexpects favourable growth prospects for theMaltese economy in the coming years, sup-ported by moderate growth in investmentand growth in private consumption reflect-ing further improvements in labour marketconditions and wage growth.

Furthermore, it confirmed that Malta’scurrent fiscal consolidation is expected toprogress in 2016-17.

Latest government finance data pub-lished by the National Statistics Office

Malta became an independent state in1964, following intense negotiationswith the UK. It achieved independenceas a Commonwealth realm. This meantthat Malta retained the British monarch(Queen Elizabeth II) as its head of state.

In 1971, the Malta Labour Party wonthe election and began promoting theidea of transforming Malta into a repub-lic and on December 13, 1974, thecountry's constitution was substantiallyrevised with Malta becoming a republicwithin the Commonwealth of Nations.

Republic Day, one of Malta's five na-tional holidays, is celebrated throughoutthe country with various festive eventsand activities, including (but not limitedto) flag-hoisting, wreath-laying ceremon-ies, public speeches, military parades,awarding ceremonies, and culturalevents.

The largest celebrations are held inMalta's capital Valletta and on a smallerscale Marsa, where the Republic Daymonument (pictured left) is located.The day also celebrates the first Presi-

Immigration Minister Peter Dutton has suggested that theMalcolm Fraser Liberal government made a mistake by re-settling people of Lebanese/Muslim background as part of

immigration policies of 1970. "The advice I have is that out ofthe last 33 people who have been charged with terrorist-relatedoffences in this country, 22 of those people are from second andthird generation Lebanese-Muslim background," he said.The Australian Bureau of Statistics (ABS) states that arrivals of

people born in Lebanon peaked at 4,906 in 1977, with a smallerpeak of 2,600 in 1987. It further stated that since 1992 arrivalshave been relatively stable, fluctuating between 883 and 1,368persons annually.As of 2006, the number of Australians of Lebanese background

totalled 181,738 — including 16,201 people whose parents wereborn in Australia. According to figures from the ABS, more than

10.6 million Aus-tralians had at leastone grandparentborn overseas as of2011.

Labor MP TimWatts posted onFacebook that Mr.Dutton's commentswere "extraordi-nary." He added:"The Minister forImmigration seemsto think that crimi-nal behaviour by'second and thirdgeneration migrants' (AKA 'Australians,' AKA the grandchildrenof migrants) is attributable to immigration policy." In February, the ABC reported on a Cabinet document that sin-

gled out the Lebanese community as the "most prominent ethnicgroup amongst Australian Sunni extremists."

The document points to "lessons learned" after a wave of mi-gration to Australia as a result of the Lebanese civil war between1975 and 1990."Australia's historical experience with the Sunni Lebanese com-

munity illustrates potential community safety and national secu-rity risks associated with unsuccessful integration," it said.Jacinta Caroll writing in the SMH says, “Fortunately in Australia

to date the number of supporters of Islamicist extremism and ter-rorism is very low; so low. In fact, they are categorised as casesand clusters rather being statistically useful. The figure of 22 rep-resents less than 0.01 percent of the about 180,000 Australiansof Lebanese background, according to the ABS.”

to many of her closest friends and col-leagues: her experience, over 29 of her 36years, with domestic violence.

She spoke of her dad hurling food at thewall and damaging the family car so hermum couldn't escape. And of how she andher children became entangled in violencejust as her own mother had. If an MP had given such a personal speech

before, no one could remember it. Her col-leagues stood to applaud, tears runningdown their cheeks.

With a speech written in an hour beforequestion time that day, the backbencherfrom Penrith had catapulted herself to na-tional attention less than six months sincebeing elected.

After the speech, some of her parliamen-tary colleagues whispered to her that theytoo had experienced domestic violence. Po-litical staffers told her the same thing.

Australia’s Nationals leader andDeputy PM Barnaby Joyce hasrubbished a Grattan Institute pro-

posal to introduce a soft drink tax in Aus-tralia, saying it is a "bonkers mad" ideathat would restrict individual freedom andharm the local sugar industry.

Mr. Joyce said the proposal was a“moralistic tax” that would cause “mas-sive problems” for the local sugar industryin Queensland and NSW. “If you want todeal with being overweight, here's a sug-gestion: stop eating so much and do a bitof exercise,” Mr. Joyce said.

“This is one of these suggestions rightfrom the start we always thought wasbonkers mad but now it's getting more andmore momentum, so we have to say, 'Weare not going to be supporting a sugartax.'”Mr. Joyce said it was appropriate for the

government to increase the tobacco excisebecause all cigarettes are harmful butdrinking the occasional soft drink is not.

“Take responsibility for yourself; theAustralian Taxation Office is not going tosave you,” he said. “The ATO is not a bet-ter solution than jumping in the pool andgoing for a swim.”

Treasurer, Scott Morrison, hasdeclined to rule out a tax onsugar. Asked twice on Adelaideradio whether he supported theproposal to tax sugary drinks tofight obesity, the Treasurer saidonly that it was a well-inten-tioned suggestion, but his focuswas elsewhere for now.

Mr. Morrison repeated Mr.Joyce's line that the responsibilityfor diet rested primarily with par-ents. Mr. Morrison's stanceechoed Health Minister SusanLey, who said on Tuesday thegovernment did not support a sugar tax atthis time but would continue to consider ev-idence.

Australian Food and Grocery Councilchief executive, Garry Dawson, said therewas no evidence that a sugar tax wouldhave any effect on obesity. He said that even the Grattan Institute ac-

knowledged in its report that the effects ofa sugar tax would be a negligible few hun-dred grams less weight for the averageAustralian, and the $520 million cost ofthe proposal would far outweigh any ben-efits.

The celebrations would in-clude citizenship ceremonies that havepreviously happened on Australia Day.“We were never trying to say to people theycouldn't do anything or shouldn't do any-thing on Australia Day,” Fremantle mayorBrad Pettitt told the West Australian news-paper. “That's for other people to judge.We're simply offering what I think is a re-ally good alternative.”However, prominent Aboriginal elder and

former Western Australian of the Year,Robert Isaacs, criticised the city's decision.

“That's not in the spirit of the Australiaway," he told the ABC, adding the decisiondid not "stand up" with him. He said thecouncil "should not be playing around withwhite politics and black politics.”

Someabout the freezingclimate to whichthey were not accustomed, havingcome from the Mediterranean, orconversely the oppressing heat theytoiled in. Many sang about the lone-liness of living in rural areas, in iso-lation on their farms or working asfarm hands. “Others, who were employed in sug-

arcane plantations, engaged in back-breaking work and suffocating heatand sang about their difficult plight.One must remember that many Mal-tese had to face the culture shock ofleaving a generally urbanised envi-ronment in Malta, to surviving in avast land where in some cases yournext-door neighbour lived milesaway.”

Other songs deal with the tragediesof war which some singers experi-enced personally. Perhaps the mostpoignant is one about a tragedy thatoccurred in an air-raid shelter inMalta. The author cannot erase fromhis mind the faces of the dead chil-dren, which he helped to pull outfrom under the rubble, and he trans-

formed his grief into a heart-rendingsong.Casha states that, as a musician, he

entered the G˙ana field ‘to under-stand, discover and try and preserveand cultivate a very special part ofMaltese culture in Melbourne.’

The question of course arises: willthe second and subsequent genera-tion be interested in this type ofmusic? Casha is optimistic about

this. He remarks: ‘It might not becommonly known that 95% of‘g˙annejja’, past and present, livingin Melbourne started their careersafter they emigrated….

It is just as remarkable to discoverthat most lead guitarists (primi) inMelbourne were actually born andbred in Melbourne suburbs and somehave never seen Malta.’

So the future of playing Maltesefolksongs seems to be assured. Thesame, however, cannot be said aboutthe art of actually creating the songsthemselves, which depends, amongother things, on a deep grasp of theMaltese language together with thenecessity of being able to provide im-promptu rhyming.

Casha states: “it is a fact that whileAustralia produced some wonderfulplayers, no indigenous g˙annej hasbeen produced… so far”. Even so, theinterest shown by these young play-ers has helped to maintain a level ofcommand of the language. Cashasays: “while young players ‘cannot

sing and rhyme, [they] can speak thelanguage a lot more fluently sincetaking up the Maltese guitar”.

In this book we find a comprehen-sive section on writers of and G˙anasingers in Australia. They came inlarge numbers in the post-war period,particularly in the 1950s and 60s.While their experience of life inMalta still informs a lot of the topicstreated in their songs, with time, thelocal element starts to find its wayinto the song.

He writes: “Many writers in Aus-tralia ‘kept writing on traditionallines and on topics, which relatedmore to the Maltese environmenteven though they had lived in Aus-

tralia for a num-ber of years….[and particu-larly] to a Maltathey rememberedfrom childhood.”

It is curious tonote that the vastmajority of folk-singers are men.This is not sur-prising in view ofthe origin ofG˙ana, whichoccurred mostlyin bars to whichfew women werewelcome. Theaggressive natureof the interactionbetween differentfolk-singers wasalso more suit-able to the malerather than thefemale character.

However, several women did takepart in folk singing, inventing theirown particular brand, known asG˙ana tal-banju, (or ‘washer-womenfolksongs’). Their songs were usuallymuch less aggressive; they did not in-dulge in contests to prove who is thebetter singer.

Interesting also, Casha commentsthat women sing in a different key tomen female singers sing in higher reg-ister. Men prefer the more aggressivekey of G, which ‘creates the anticipa-tion of the contest or battle’ whereaswomen prefer the key of C, which ‘cre-ates a happier anticipation.’Casha has analysed the structure of

these G˙ana in great detail. He goesover the various types of G˙ana, ex-plaining the structure of this artform, for those of us who have neverreally bothered to enquire into the in-tricacies and genius behind the abil-ity of extemporising rhyming verse inan impromptu fashion.

Drive Kurnell on the shoresof Botany Bay, South of Syd-ney, a stone’s throw awayfrom where Captain JamesCook first landed in Aus-tralia back in 1770 will beopened for the public to visitduring the month of Decem-ber.

Two Maltese from the vil-lage of Mosta originally builtthis Presepju. It took VictorSammut eight months tobuild it back in 2008, whileJoe il-Mosti Deguara outlaidthe money. All the figurines(pasturi) were brought fromMalta.

The Nativity Scene depict-ing a village life in Bethlehem2016 years ago went on dis-play for the first time at St.James Presbyterian Churchin Kurnell, during theirChristmas Carols in 2008.

In the presence of 250 peo-ple Joe gave an explanationand an interpretation of theMaltese Presepju, and howimportant it is to the Maltesepeople as during the Christ-mas period practically everyhouse in Malta has a Presepjuon display .

The Maltese Presepju that

has been on display to thepublic at the current locationin Kurnell every Christmas,over the years has been fea-tured in the media, particu-larly the former MalteseHerald, The Sutherland andSt George Leader, The Kur-nell Village News and TheVoice of the Maltese

Since it was first built, manyinteresting objects have beenadded to it such as an au-thentic waterfall. This year isno exception. The Presepjuhas been enlarged by 1.5square meters as a miniaturefarm and the Garden ofOlives have been added. Itnow measures 2.7 meterswide, 1.5 meter high, and 1.5meter deep. The 250 figurineson display range in size from.075 mm to .270 mm high.

The Sutherland and StGeorge Maltese Group willbe having their annual BBQon December 14 in front ofthe Presepju with Joe Galealeading the Group withChristmas Carols.

The Presepju is open to thepublic every Friday, Satur-day and Sunday from 7.00pm till late. Groups wantingto visit during the day shouldcontact Joe Deguara on 0408966 877 for an appointment.

A Christmas crib with the Maltese touch

The recent annual general meeting of the Maltese Commu-nity Council of NSW has confirmed its president, and

v/president for another year and elected Frances Montesin tooccupy the position of secretary. It also endorsed all the toppositions and nominated Lawrence Dimech as life memberfor his contribution to the Council since its inception.

With the arrival of thewarm spring weath-

er, the very active groupof Maltese seniors re-cently enjoyed a big dayout in one of the many ac-tivities that are enjoyed bythis lively group of sen-iors.

With our trusty community bus, andfriendly driver, the group departed fromthe St Theresa’s Church Hall at FairfieldHeights with the first stop along the scenicGeorges River National Park for a deli-cious morning tea of homemade Maltesesweets and biscuits. The group then enjoyed a leisurely walk

along the foreshore of the Georges River.After a while, we set off to visit historic

La Perouse, where we enjoyed a lovely af-ternoon by the seaside. A great lunch offish and chips was had by many of thegroup, while others brought a picnic lunch.

Then for the more active part, a walk tovisit Bare Island and the historic fort. Oth-ers from the group just preferred to sit inthe lovely park area to soak in the stunningviews, relax under the giant trees along the

shore and chat happilywith their friends.A great time was had by

all, and now the group islooking forward to itsChristmas Party in De-cember that will includelots of dancing, singingand great food to beshared with friends.
