U.S.C.98(b);andWestern28U.S.C.98(c).TheWesternDistrictisthelargestcourtasfaras
area,consistingof42parishesboundedontheeastbytheMississippiandAtchafalayaRivers,
onthe
north
by
the
State
of
Arkansas,
on
the
west
by
the
State

south

Venue:Venueisthelocationwheretheactionispending. Asamatteroflaw,venueonly
appliestothedistrict. Thereisnodivisionalrightofvenue.(Exception:28U.S.C.1441(a)
requiresthatacaseberemovedtothedistrict&divisionwhereitispending.) Normally,cases
areassignedtothedivisionwheretheactionaroseorwhereapreponderanceofthepartiesis
located. However,assignmentofcasesisamatterofadministrationandisaccomplishedin
accordancewiththeinstructionsoftheCourt.
Stateand
Federal
Court
Differences
FEES: Instatecourt,adepositmustbemadepriortofilingasuitandthereisachargeforeach
documentfiledinthecase. Infederalcourt,thereisaninitialfilingfeeforthefilingofthe
Complaint. Generally,thereisnofeeforfilinganysubsequentpleadingsinthecourtexceptfor
anoticeofappeal.
JURIES: Instatecourt,adepositmustbemadetocoverthecostofajury. Infederalcourt,
thereisnochargewhenapartyrequestsajury. However,ifthepartiesfailtotimelynotifythe
Courtofasettlementandthejurorsappearneedlessly,oneorbothofthepartiesmaybe
assessedjury
costs
under
LR54.1.
CASEMANAGEMENT: Instatecourt,theattorneyispermittedtocontrolthepaceofthe
litigation. Infederalcourt,oncethecomplaintisfiled,thecourttakescontrolofthe
