ENVIRONMENTAL IMPACTASSESSMENTNOTICE OF ENVIRONMENTALSTATEMENT IN ACCORDANCE WITHSECTION 105 B OF THE HIGHWAYSACT 1980 (AS AMENDED)

ASSESSMENT OF IMPLICATIONS FOREUROPEAN SITESNOTICE OF STATEMENT TO INFORMAN APPROPRIATE ASSESSMENT INACCORDANCE WITH SECTION 61 OFTHE CONSERVATION OF HABITATSAND SPECIES REGULATIONS 2010

The Welsh Ministers have decided toproceed with the above project to provide a1km long, two lane dual carriageway roadconnecting the existing A4232 QueensGate Roundabout and the Ocean WayRoundabout at Cardiff Bay The WelshMinisters determined that this project is arelevant project and subject toEnvironmental Impact Assessment inaccordance with Part VA of the HighwaysAct 1980 (as amended) and EC Directive2014/52/EU (as amended).

The project is also subject to anAssessment of Implications on EuropeanSites (AIES) in accordance with theConservation of Habitats and SpeciesRegulations (2010) and Article 6(3) of theHabitats Directive 92/43/EC.

In accordance with the abovedetermination an Environmental Statement(ES) was prepared which identifies the keyenvironmental issues associated with theproject. The ES also details the mitigationmeasures that are to be provided in orderto avoid, reduce or offset the project’sadverse effects. At the same time aStatement to Inform an AppropriateAssessment (SIAA) was also preparedunder Regulation 48 of the Conservation(Natural Habitats &c.) of the Regulations1994.

The ES, a non-technical summary of it andthe SIAA were published on 23 December2015 and placed on deposit at thelocations listed below until 3 February2016 and comments were invited.Responses were received and consideredby the Welsh Ministers before reachingtheir decision to proceed with theimprovement.

Copies of the ES, non-technical summary,the SIAA and the Welsh Ministers DecisionLetter may be inspected duringoffice/opening hours from the x March2016 until xx April 2016 or within 6 weeksof the publication date of this notice,whichever period expires later, at thefollowing locations;

Any person aggrieved by the decision ofthe Welsh Ministers to proceed with thisimprovement for which an ES has beenmade and desiring to question the validityof that decision, on the ground:a) that it is not within the powers of the

Highways Act 1980 orb) that any requirement of that Act, or of

regulations made thereunder has notbeen complied with;

may, within 6 weeks from the publicationdate of this notice, apply to the High Courtfor the suspension or quashing of thedecision to proceed.
